      },

        "text": "years old. Mendonsa contended that the pattern",
        "paragraph_id": "para_38"
      },
      {
        "text": "enhancement unambiguously applies only to conduct related",
        "paragraph_id": "para_39"
      },
      {
        "text": "to the offense of conviction, and that under Kisor v. Wilkie,",
        "paragraph_id": "para_40"
      },
      {
        "text": "588 U.S. 558 (2019), the district court’s deference to the",
        "paragraph_id": "para_41"
      },
      {
        "text": "Guidelines commentary was inappropriate. The panel held",
        "paragraph_id": "para_42"
      },
      {
        "text": "that § 2G2.2(b)(5) is ambiguous as to whether the pattern",
        "paragraph_id": "para_43"
      },
      {
        "text": "enhancement reaches conduct outside the offense of",
        "paragraph_id": "para_44"
      },
      {
        "text": "conviction, that the commentary interpretation permitting",

      },

      {
        "text": "The district court applied the five-level sentencing",
        "paragraph_id": "para_88"
      },
      {
        "text": "enhancement in Section 2G2.2(b)(5) of the United States",
        "paragraph_id": "para_89"
      },
      {
        "text": "Sentencing Guidelines for defendants who “engaged in a",
        "paragraph_id": "para_90"
      },
      {
        "text": "pattern of activity involving the sexual abuse or exploitation",
        "paragraph_id": "para_91"
      },
      {
        "text": "of a minor.” Consistent with the Guidelines commentary,",
        "paragraph_id": "para_92"
      },
      {
        "text": "the district court interpreted the pattern enhancement to",
        "paragraph_id": "para_93"
      },
      {
        "text": "encompass Mendonsa’s prior sex abuse convictions that",
        "paragraph_id": "para_94"
      },
      {
        "text": "were over 30 years old.",
        "paragraph_id": "para_95"
      },
      {
        "text": "Mendonsa contends that the pattern enhancement",
        "paragraph_id": "para_96"
      },
      {
        "text": "unambiguously applies only to conduct related to the offense",
        "paragraph_id": "para_97"
      },
      {
        "text": "of conviction, and that under Kisor v. Wilkie, 588 U.S. 558",
        "paragraph_id": "para_98"
      },
      {
        "text": "(2019), the district court’s deference to the Guidelines",
        "paragraph_id": "para_99"
      },
      {
        "text": "commentary was inappropriate. Alternatively, he argues",
        "paragraph_id": "para_100"
      },
      {
        "text": "that even if his prior convictions may be considered for the",
        "paragraph_id": "para_101"
      },
      {
        "text": "pattern enhancement, the district court erred under the",
        "paragraph_id": "para_102"
      },
      {
        "text": "categorical approach by considering the underlying factual",
        "paragraph_id": "para_103"
      },
      {
        "text": "record from his state convictions to determine that the",
        "paragraph_id": "para_104"
      },
      {
        "text": "enhancement applied.",

        "text": "We hold that the pattern enhancement is ambiguous and",
        "paragraph_id": "para_106"
      },
      {
        "text": "deference to the Guidelines commentary is appropriate.",

      {
        "text": "In April 2024, Mendonsa pleaded guilty to seven counts",
        "paragraph_id": "para_116"
      },
      {
        "text": "of distribution of child pornography in violation of 18 U.S.C.",
        "paragraph_id": "para_117"
      },
      {
        "text": "§ 2252(a)(2) and one count of possession of child",
        "paragraph_id": "para_118"
      },
      {
        "text": "pornography in violation of 18 U.S.C. § 2252(a)(4).",
        "paragraph_id": "para_119"
      },
      {
        "text": "Mendonsa posted hundreds of images on four “dark web”",
        "paragraph_id": "para_120"
      },
      {
        "text": "websites—of which he was an administrator or moderator—",
        "paragraph_id": "para_121"
      },
      {
        "text": "between July and November 2022.",
        "paragraph_id": "para_122"
      },
      {
        "text": "Decades before the child pornography offenses, a state",
        "paragraph_id": "para_123"
      },
      {
        "text": "jury found Mendonsa guilty of child sex abuse offenses for",
        "paragraph_id": "para_124"
      },
      {
        "text": "molesting newspaper delivery boys whom he supervised. In",
        "paragraph_id": "para_125"
      },
      {
        "text": "1993, he was convicted of nine counts of lewd and lascivious",
        "paragraph_id": "para_126"
      },
      {
        "text": "acts upon a child under age 14 in violation of California",
        "paragraph_id": "para_127"
      },
      {
        "text": "Penal Code § 288(a); two counts of oral copulation with a",
        "paragraph_id": "para_128"
      },
      {

        "text": "a lewd act upon a child in violation of Penal Code § 288(c).",
        "paragraph_id": "para_130"
      },
      {
        "text": "All but the last of these involved the same victim. Mendonsa",
        "paragraph_id": "para_131"
      },
      {
        "text": "was sentenced to 14 years in prison for the offenses.",
        "paragraph_id": "para_132"
      },
      {
        "text": "Section 2G2.2 of the Sentencing Guidelines governs the",
        "paragraph_id": "para_133"
      },
      {
        "text": "offense-level calculation for Mendonsa’s federal child",
        "paragraph_id": "para_134"
      },
      {
        "text": "pornography crimes. This appeal concerns the pattern",
        "paragraph_id": "para_135"
      },
      {
        "text": "enhancement in § 2G2.2(b)(5), which requires a five-level",
        "paragraph_id": "para_136"
      },
      {
        "text": "increase “[i]f the defendant engaged in a pattern of activity",
        "paragraph_id": "para_137"
      },
      {
        "text": "involving the sexual abuse or exploitation of a minor.”",
        "paragraph_id": "para_138"
      },
      {
        "text": "U.S.S.G. § 2G2.2. The commentary to § 2G2.2 defines a",
        "paragraph_id": "para_139"
      },
      {
        "text": "“pattern of activity involving the sexual abuse or",
        "paragraph_id": "para_140"
      },
      {
        "text": "exploitation of a minor” as:",
        "paragraph_id": "para_141"
      },
      {
        "text": "any combination of two or more separate",
        "paragraph_id": "para_142"
      },
      {
        "text": "instances of the sexual abuse or sexual",
        "paragraph_id": "para_143"
      },
      {
        "text": "exploitation of a minor by the defendant,",
        "paragraph_id": "para_144"
      },
      {
        "text": "whether or not the abuse or exploitation",
        "paragraph_id": "para_145"
      },
      {
        "text": "6 USA V. MENDONSA",
        "paragraph_id": "para_146"
      },
      {
        "text": "(A) occurred during the course of the offense;",
        "paragraph_id": "para_147"
      },
      {
        "text": "(B) involved the same minor; or (C) resulted",
        "paragraph_id": "para_148"
      },
      {
        "text": "in a conviction for such conduct.",
        "paragraph_id": "para_149"
      },
      {
        "text": "Id. cmt. n.1. The commentary further defines “sexual abuse",
        "paragraph_id": "para_150"
      },
      {
        "text": "or exploitation” as conduct described in specified federal",
        "paragraph_id": "para_151"
      },
      {
        "text": "statutes, including 18 U.S.C. §§ 2241–2243 (criminalizing",
        "paragraph_id": "para_152"
      },
      {
        "text": "sexual acts involving force or threats, minors, or persons",
        "paragraph_id": "para_153"
      },
      {
        "text": "incapable of giving consent), or equivalent state-law",
        "paragraph_id": "para_154"
      },
      {
        "text": "conduct. Id.",
        "paragraph_id": "para_155"
      },
      {
        "text": "The original presentence report (PSR) prepared by the",
        "paragraph_id": "para_156"
      },
      {
        "text": "U.S. Probation Office did not recommend applying the",
        "paragraph_id": "para_157"
      },
      {
        "text": "pattern enhancement to Mendonsa. The government",
        "paragraph_id": "para_158"
      },
      {
        "text": "informally objected and argued for the enhancement, citing",
        "paragraph_id": "para_159"
      },
      {
        "text": "discovery materials related to his 1993 convictions. Over",
        "paragraph_id": "para_160"
      },
      {
        "text": "Mendonsa’s objection, the final PSR recommended applying",
        "paragraph_id": "para_161"
      },
      {
        "text": "the pattern enhancement based on his prior lewd and",
        "paragraph_id": "para_162"
      },
      {
        "text": "lascivious acts on minor victims on several occasions.",
        "paragraph_id": "para_163"
      },
      {
        "text": "Mendonsa objected to the pattern enhancement on two",
        "paragraph_id": "para_164"
      },
      {
        "text": "grounds, arguing: (1) that it was “based on conduct that",
        "paragraph_id": "para_165"
      },
      {
        "text": "allegedly occurred thirty years prior to the offense”; and",
        "paragraph_id": "para_166"
      },
      {
        "text": "(2) that the evidence concerning his 1993 convictions was",
        "paragraph_id": "para_167"
      },
      {
        "text": "“insufficient to establish that he committed two separate",
        "paragraph_id": "para_168"
      },
      {
        "text": "incidents of specifically defined sexual crimes.”",
        "paragraph_id": "para_169"
      },
      {
        "text": "At the sentencing hearing, the district court summarized",
        "paragraph_id": "para_170"
      },
      {
        "text": "the documents from the 1993 convictions and understood",
        "paragraph_id": "para_171"
      },
      {
        "text": "them to reflect multiple acts involving one victim at different",
        "paragraph_id": "para_172"
      },
      {
        "text": "times. The court found that there were “six separate",
        "paragraph_id": "para_173"
      },
      {
        "text": "incidents,” including four where Mendonsa touched the",
        "paragraph_id": "para_174"
      },
      {
        "text": "victim under his clothing. The court also described an",
        "paragraph_id": "para_175"
      },
      {
        "text": "incident with another victim, in which, according to the",
        "paragraph_id": "para_176"
      },
      {
        "text": "investigation report, Mendonsa “touched [the victim’s] leg",
        "paragraph_id": "para_177"
      },
      {

      {
        "text": "and moved towards his penis . . . then continued rubbing",
        "paragraph_id": "para_179"
      },
      {
        "text": "[his] neck and worked his way down to his groin area.” The",
        "paragraph_id": "para_180"
      },
      {
        "text": "district court concluded that the underlying records detailed",
        "paragraph_id": "para_181"
      },
      {
        "text": "“different occurrences” and that the § 2G2.2 commentary",
        "paragraph_id": "para_182"
      },
      {
        "text": "“eliminates any need for any temporal or factual nexus",
        "paragraph_id": "para_183"
      },
      {
        "text": "between . . . the offense of conviction and any prior act of",
        "paragraph_id": "para_184"
      },
      {
        "text": "sexual abuse.” Consequently, the court applied the pattern",
        "paragraph_id": "para_185"
      },
      {
        "text": "enhancement.",
        "paragraph_id": "para_186"
      },
      {
        "text": "Mendonsa was sentenced to 292 months in prison",
        "paragraph_id": "para_187"
      },
      {
        "text": "followed by 10 years of supervised release. He timely",
        "paragraph_id": "para_188"
      },
      {
        "text": "appealed his sentence.",
        "paragraph_id": "para_189"
      },
      {
        "text": "II",
        "paragraph_id": "para_190"
      },
      {
        "text": "“We review the district court’s interpretation of the",
        "paragraph_id": "para_191"
      },
      {
        "text": "Sentencing Guidelines de novo, its application of the",
        "paragraph_id": "para_192"
      },
      {
        "text": "Guidelines to the facts of the case for abuse of discretion,",
        "paragraph_id": "para_193"
      },
      {
        "text": "and its factual findings for clear error.” United States v.",
        "paragraph_id": "para_194"
      },
      {
        "text": "Kirilyuk, 29 F.4th 1128, 1133 (9th Cir. 2022).",
        "paragraph_id": "para_195"
      },
      {
        "text": "III",
        "paragraph_id": "para_196"
      },
      {
        "text": "Mendonsa principally argues that the district court erred",
        "paragraph_id": "para_197"
      },
      {
        "text": "in applying the § 2G2.2(b)(5) pattern enhancement because",
        "paragraph_id": "para_198"
      },
      {
        "text": "that Guidelines provision unambiguously applies only to",
        "paragraph_id": "para_199"
      },
      {
        "text": "conduct relevant to the offense of conviction, not to sexual",
        "paragraph_id": "para_200"
      },
      {
        "text": "abuse occurring decades earlier. In the alternative, he argues",
        "paragraph_id": "para_201"
      },
      {
        "text": "that the record does not support application of the",
        "paragraph_id": "para_202"
      },
      {
        "text": "enhancement and that the district court erred in relying on",
        "paragraph_id": "para_203"
      },
      {
        "text": "hearsay to support its contrary conclusion.",
        "paragraph_id": "para_204"
      },
      {
        "text": "A",
        "paragraph_id": "para_205"
      },
      {
        "text": "We first address Mendonsa’s contention that the pattern",
        "paragraph_id": "para_206"
      },
      {
        "text": "enhancement in § 2G2.2(b)(5) applies only to conduct that is",
        "paragraph_id": "para_207"
      },
      {
        "text": "temporally or otherwise related to the offense of conviction.",
        "paragraph_id": "para_208"
      },
      {

      },
      {
        "text": "The Guidelines commentary rejects such limitations, stating",
        "paragraph_id": "para_210"
      },
      {
        "text": "that the enhancement applies “whether or not the abuse or",
        "paragraph_id": "para_211"
      },
      {
        "text": "exploitation . . . occurred during the course of the offense.”",
        "paragraph_id": "para_212"
      },
      {
        "text": "U.S.S.G. § 2G2.2 cmt. n.1. Relying on the commentary, this",
        "paragraph_id": "para_213"
      },
      {
        "text": "court previously held that the pattern enhancement (then",
        "paragraph_id": "para_214"
      },
      {
        "text": "found at § 2G2.2(b)(4)) “allows for consideration of",
        "paragraph_id": "para_215"
      },
      {
        "text": "expanded relevant conduct” unrelated to the offense of",
        "paragraph_id": "para_216"
      },
      {
        "text": "conviction. United States v. Williamson, 439 F.3d 1125,",
        "paragraph_id": "para_217"
      },
      {
        "text": "1140 (9th Cir. 2006). At the time we decided Williamson,",
        "paragraph_id": "para_218"
      },
      {
        "text": "we gave the Guidelines commentary “controlling weight",
        "paragraph_id": "para_219"
      },
      {
        "text": "unless it is plainly erroneous or inconsistent with the",
        "paragraph_id": "para_220"
      },
      {
        "text": "regulation.” Stinson v. United States, 508 U.S. 36, 45 (1993)",
        "paragraph_id": "para_221"
      },
      {
        "text": "(quoting Bowles v. Seminole Rock & Sand Co., 325 U.S. 410,",
        "paragraph_id": "para_222"
      },
      {
        "text": "414 (1945)). The Supreme Court’s subsequent decision in",
        "paragraph_id": "para_223"
      },
      {
        "text": "Kisor, however, requires us to reexamine the conclusion in",
        "paragraph_id": "para_224"
      },
      {
        "text": "Williamson, which rested solely on the Guidelines",
        "paragraph_id": "para_225"
      },
      {
        "text": "commentary and cases finding the commentary",
        "paragraph_id": "para_226"
      },
      {
        "text": "unambiguous.",
        "paragraph_id": "para_227"
      },
      {
        "text": "Kisor established a two-step framework for determining",
        "paragraph_id": "para_228"
      },
      {
        "text": "whether to defer to an agency’s interpretation of its own",
        "paragraph_id": "para_229"
      },
      {
        "text": "regulations. First, the court asks whether the regulation is",
        "paragraph_id": "para_230"
      },
      {
        "text": "“genuinely ambiguous” after applying the traditional tools",
        "paragraph_id": "para_231"
      },
      {
        "text": "of interpretation. 588 U.S. at 573. If not, the regulation",
        "paragraph_id": "para_232"
      },
      {
        "text": "controls. Id. at 575. Second, if the regulation is found to be",
        "paragraph_id": "para_233"
      },
      {
        "text": "ambiguous, the court defers only if the agency’s",
        "paragraph_id": "para_234"
      },
      {
        "text": "interpretation is reasonable and its character and context",
        "paragraph_id": "para_235"
      },
      {
        "text": "warrant controlling weight—meaning that it reflects the",
        "paragraph_id": "para_236"
      },
      {
        "text": "agency’s official position, implicates its substantive",
        "paragraph_id": "para_237"
      },
      {
        "text": "expertise, and represents its fair and considered judgment.",
        "paragraph_id": "para_238"
      },
      {
        "text": "Id. at 575–79. Although the circuits disagree over the",
        "paragraph_id": "para_239"
      },
      {
        "text": "deference owed to the Guidelines commentary after Kisor,",
        "paragraph_id": "para_240"
      },
      {
        "text": "USA V. MENDONSA 9",
        "paragraph_id": "para_241"
      },
      {
        "text": "this court applies the Kisor framework. United States v.",
        "paragraph_id": "para_242"
      },
      {
        "text": "Castillo, 69 F.4th 648, 655 (9th Cir. 2023).1",
        "paragraph_id": "para_243"
      },
      {
        "text": "1",
        "paragraph_id": "para_244"
      },
      {
        "text": "Mendonsa argues that deference to the Guidelines",
        "paragraph_id": "para_245"
      },
      {
        "text": "commentary is inappropriate because the § 2G2.2(b)(5)",
        "paragraph_id": "para_246"
      },
      {
        "text": "enhancement for “a pattern of activity involving the sexual",
        "paragraph_id": "para_247"
      },
      {
        "text": "abuse or exploitation of a minor” unambiguously limits the",
        "paragraph_id": "para_248"
      },
      {
        "text": "qualifying pattern of abuse or exploitation to conduct related",
        "paragraph_id": "para_249"
      },
      {
        "text": "to the offense of conviction. Neither the plain text nor the",
        "paragraph_id": "para_250"
      },
      {
        "text": "standard tools of construction compel that reading.",
        "paragraph_id": "para_251"
      },
      {
        "text": "a",
        "paragraph_id": "para_252"
      },
      {
        "text": "There is no express temporal or offense-related",
        "paragraph_id": "para_253"
      },
      {
        "text": "limitation in the text of § 2G2.2(b)(5). The guideline merely",
        "paragraph_id": "para_254"
      },
      {
        "text": "provides that the offense level should be increased “[i]f the",
        "paragraph_id": "para_255"
      },
      {
        "text": "defendant engaged in a pattern of activity involving the",
        "paragraph_id": "para_256"
      },
      {
        "text": "sexual abuse or exploitation of a minor.” U.S.S.G.",
        "paragraph_id": "para_257"
      },
      {
        "text": "§ 2G2.2(b)(5) (emphasis added).",
        "paragraph_id": "para_258"
      },
      {
        "text": "A “pattern of activity” is a recurring course of conduct.",
        "paragraph_id": "para_259"
      },
      {
        "text": "As relevant here, “pattern” means “a reliable sample of",
        "paragraph_id": "para_260"
      },
      {
        "text": "traits, acts, tendencies, or other observable characteristics of",
        "paragraph_id": "para_261"
      },
      {
        "text": "a person.” Webster’s Third New International Dictionary",
        "paragraph_id": "para_262"
      },
      {
        "text": "1657 (1993). Applied to § 2G2.2(b)(5), that definition looks",
        "paragraph_id": "para_263"
      },
      {
        "text": "to repeated acts of sexual abuse as evidence of a",
        "paragraph_id": "para_264"
      },
      {

        "text": "809–13 (10th Cir. 2023). The Supreme Court recently granted certiorari",
        "paragraph_id": "para_268"
      },
      {
        "text": "to decide whether Stinson remains the governing standard. Beaird v.",
        "paragraph_id": "para_269"
      },
      {
        "text": "United States, No. 25-5343, 2026 WL 1052007, at *1 (U.S. Apr. 20,",
        "paragraph_id": "para_270"
      },
      {
        "text": "2026). The issue does not affect the result here because Mendonsa",
        "paragraph_id": "para_271"
      },
      {
        "text": "cannot prevail even under Kisor’s less deferential standard.",
        "paragraph_id": "para_272"
      },
      {
        "text": "10 USA V. MENDONSA",
        "paragraph_id": "para_273"
      },
      {
        "text": "characteristic course of behavior. The focus is therefore on",
        "paragraph_id": "para_274"
      },
      {
        "text": "the recurrence of the conduct, not its connection to any",
        "paragraph_id": "para_275"
      },
      {
        "text": "particular offense.",
        "paragraph_id": "para_276"
      },
      {
        "text": "The nature of the pattern of activity—“sexual abuse or",
        "paragraph_id": "para_277"
      },
      {
        "text": "exploitation of a minor”—reinforces this focus. Section",
        "paragraph_id": "para_278"
      },
      {
        "text": "2G2.2 governs nonproduction child-pornography offenses;",
        "paragraph_id": "para_279"
      },
      {
        "text": "the pattern enhancement, by contrast, targets a defendant’s",
        "paragraph_id": "para_280"
      },
      {
        "text": "personal involvement in the sexual abuse or exploitation of",
        "paragraph_id": "para_281"
      },
      {
        "text": "minors. See United States v. Ketcham, 80 F.3d 789, 794–95",
        "paragraph_id": "para_282"
      },
      {
        "text": "(3d Cir. 1996) (explaining that § 2G2.2(b)(4)—now",
        "paragraph_id": "para_283"
      },
      {
        "text": "§ 2G2.2(b)(5)—targets “more dangerous” defendants who",
        "paragraph_id": "para_284"
      },
      {
        "text": "have been “involved first hand in the exploitation of",
        "paragraph_id": "para_285"
      },
      {
        "text": "children”). The enhancement’s focus on sexual abuse or",
        "paragraph_id": "para_286"
      },
      {
        "text": "exploitation—conduct distinct from the child-pornography",
        "paragraph_id": "para_287"
      },
      {
        "text": "offense—suggests that the aggravating factor is the",
        "paragraph_id": "para_288"
      },
      {
        "text": "defendant’s history of such conduct, not its connection to the",
        "paragraph_id": "para_289"
      },
      {
        "text": "offense of conviction.",
        "paragraph_id": "para_290"
      },
      {
        "text": "Thus, the text does not contain the limitations Mendonsa",
        "paragraph_id": "para_291"
      },
      {
        "text": "seeks to impose—much less unambiguously so.",
        "paragraph_id": "para_292"
      },
      {
        "text": "b",
        "paragraph_id": "para_293"
      },
      {
        "text": "The inquiry does not end with the text of § 2G2.2(b)(5),",
        "paragraph_id": "para_294"
      },
      {
        "text": "because in determining whether a guideline is ambiguous,",
        "paragraph_id": "para_295"
      },
      {
        "text": "courts must exhaust the tools of construction, including by",
        "paragraph_id": "para_296"
      },
      {
        "text": "looking to its “structure, history, and purpose.” Kisor, 588",
        "paragraph_id": "para_297"
      },
      {
        "text": "U.S. at 575; United States v. Cisneros, No. 24-6774, 2026",
        "paragraph_id": "para_298"
      },
      {
        "text": "WL 2451424, at *3 (9th Cir. Aug. 21, 2026) (explaining that",
        "paragraph_id": "para_299"
      },
      {
        "text": "“[w]e may not defer to the Sentencing Commission’s",
        "paragraph_id": "para_300"
      },
      {
        "text": "commentary interpreting the Sentencing Guidelines unless",
        "paragraph_id": "para_301"
      },
      {
        "text": "the guideline itself is genuinely ambiguous” after exhausting",
        "paragraph_id": "para_302"
      },
      {
        "text": "the traditional tools of construction). Mendonsa argues that",
        "paragraph_id": "para_303"
      },
      {
        "text": "the Guidelines’ structure—including § 2G2.2(b)(5)’s",
        "paragraph_id": "para_304"
      },
      {
        "text": "location, its interaction with other Guidelines provisions,",
        "paragraph_id": "para_305"
      },
      {
        "text": "USA V. MENDONSA 11",
        "paragraph_id": "para_306"
      },
      {
        "text": "and the limitations in the neighboring subsections of",
        "paragraph_id": "para_307"
      },
      {
        "text": "§ 2G2.2—requires finding that the pattern enhancement is",
        "paragraph_id": "para_308"
      },
      {
        "text": "limited to conduct related to the offense of conviction.",
        "paragraph_id": "para_309"
      },
      {
        "text": "The strongest support for Mendonsa’s argument comes",
        "paragraph_id": "para_310"
      },
      {
        "text": "from U.S.S.G. § 1B1.3(a). Section 1B1.3(a) provides that,",
        "paragraph_id": "para_311"
      },
      {
        "text": "“[u]nless otherwise specified,” Chapter Two adjustments—",
        "paragraph_id": "para_312"
      },
      {
        "text": "where the pattern enhancement is found—“shall be",
        "paragraph_id": "para_313"
      },
      {
        "text": "determined” based on several categories of relevant",
        "paragraph_id": "para_314"
      },
      {
        "text": "information. One such category, set out in subsection",
        "paragraph_id": "para_315"
      },
      {
        "text": "(a)(1)(A), includes “all acts and omissions committed . . . by",
        "paragraph_id": "para_316"
      },
      {
        "text": "the defendant . . . that occurred during the commission of the",
        "paragraph_id": "para_317"
      },
      {
        "text": "offense of conviction.” U.S.S.G. § 1B1.3(a)(1)(A).",
        "paragraph_id": "para_318"
      },
      {
        "text": "Mendonsa reads this language as imposing a default",
        "paragraph_id": "para_319"
      },
      {
        "text": "limitation: unless the applicable guideline specifies",
        "paragraph_id": "para_320"
      },
      {
        "text": "otherwise, a court may not consider conduct that occurred",
        "paragraph_id": "para_321"
      },
      {
        "text": "outside the offense of conviction.",
        "paragraph_id": "para_322"
      },
      {
        "text": "That argument, however, gives subsection (a)(1) more",
        "paragraph_id": "para_323"
      },
      {
        "text": "limiting force than the structure of § 1B1.3(a) supports.",
        "paragraph_id": "para_324"
      },
      {
        "text": "Section 1B1.3(a)(1) is only one of four categories of",
        "paragraph_id": "para_325"
      },
      {
        "text": "information the provision directs courts to consider.",
        "paragraph_id": "para_326"
      },
      {
        "text": "Subsection (a)(4) separately permits consideration of “any",
        "paragraph_id": "para_327"
      },
      {
        "text": "other information specified in the applicable guideline.”",
        "paragraph_id": "para_328"
      },
      {
        "text": "Thus, subsection (a)(1) does not itself categorically limit",
        "paragraph_id": "para_329"
      },
      {
        "text": "Chapter Two adjustments to conduct occurring during the",
        "paragraph_id": "para_330"
      },
      {
        "text": "offense of conviction.2 See United States v. Arias-Granados,",
        "paragraph_id": "para_331"
      },
      {
        "text": "941 F.2d 996, 998 (9th Cir. 1991) (considering prior",
        "paragraph_id": "para_332"
      },
      {

      },
      {
        "text": "need to because it concluded that the commentary expressly permitted",
        "paragraph_id": "para_336"
      },
      {
        "text": "consideration of conduct unrelated to the offense of conviction. Id. at",
        "paragraph_id": "para_337"
      },
      {
        "text": "1140.",
        "paragraph_id": "para_338"
      },
      {
        "text": "12 USA V. MENDONSA",
        "paragraph_id": "para_339"
      },
      {
        "text": "unrelated offenses in calculating guidelines range); United",
        "paragraph_id": "para_340"
      },
      {
        "text": "States v. Davis, 360 F.3d 901, 903 (8th Cir. 2004) (relying",
        "paragraph_id": "para_341"
      },
      {
        "text": "on § 1B1.3(a)(4) to impose enhancement for firearm used in",
        "paragraph_id": "para_342"
      },
      {
        "text": "offense unrelated to conviction and rejecting argument that",
        "paragraph_id": "para_343"
      },
      {
        "text": "§ 1B1.3(a)(1) limited its application).",
        "paragraph_id": "para_344"
      },
      {
        "text": "That does not mean, however, that subsection (a)(4)",
        "paragraph_id": "para_345"
      },
      {
        "text": "resolves the issue in the government’s favor. Subsection",
        "paragraph_id": "para_346"
      },
      {
        "text": "(a)(4) permits consideration only of information “specified",

        "paragraph_id": "para_352"
      },
      {
        "text": "(a)(4) or its effect on that inquiry.",
        "paragraph_id": "para_353"
      },
      {
        "text": "Setting aside § 1B1.3(a)(4), Mendonsa’s reliance on",
        "paragraph_id": "para_354"
      },
      {
        "text": "§ 1B1.3(a)(1) still does not establish that the pattern",
        "paragraph_id": "para_355"
      },
      {
        "text": "enhancement is limited to conduct occurring during the",
        "paragraph_id": "para_356"
      },
      {
        "text": "offense of conviction because that limitation is qualified by",
        "paragraph_id": "para_357"
      },
      {
        "text": "the phrase “[u]nless otherwise specified.” A guideline",
        "paragraph_id": "para_358"
      },
      {
        "text": "“otherwise specifie[s]” if its text directs consideration of",
        "paragraph_id": "para_359"
      },
      {
        "text": "conduct different from § 1B1.3’s default scope, whether or",
        "paragraph_id": "para_360"
      },
      {
        "text": "not it expressly references § 1B1.3 or disclaims its default",
        "paragraph_id": "para_361"
      },
      {
        "text": "rule.",
        "paragraph_id": "para_362"
      },
      {
        "text": "The First Circuit has adopted this reading. United States",
        "paragraph_id": "para_363"
      },
      {
        "text": "v. Salvador-Gutierrez, 128 F.4th 299, 311–13 (1st Cir.",

        "text": "2025). It held that a guideline “otherwise specifie[s]” when",

        "text": "its language is “best read as an explicit instruction to adjust",

        "paragraph_id": "para_367"
      },
      {
        "text": "narrower) range of conduct than the conduct specified in",
        "paragraph_id": "para_368"
      },
      {
        "text": "§ 1B1.3.” Id. at 311. The guideline need not, however,",
        "paragraph_id": "para_369"
      },
      {
        "text": "“mention § 1B1.3 by name or quote from its text.” Id. This",
        "paragraph_id": "para_370"
      },
      {
        "text": "court has similarly recognized in another context that a",
        "paragraph_id": "para_371"
      },
      {
        "text": "USA V. MENDONSA 13",

        "text": "provision may “specify” a condition that triggers an",
        "paragraph_id": "para_373"
      },
      {
        "text": "exception to a default rule without expressly referencing the",
        "paragraph_id": "para_374"
      },

        "text": "statute containing the default rule. Spencer Enters., Inc. v.",
        "paragraph_id": "para_375"
      },
      {
        "text": "United States, 345 F.3d 683, 688–90 (9th Cir. 2003) (holding",
        "paragraph_id": "para_376"
      },
      {
        "text": "that an immigration statute providing that the Attorney",
        "paragraph_id": "para_377"
      },
      {
        "text": "General “may” grant asylum would, absent a specific",
        "paragraph_id": "para_378"
      },
      {
        "text": "carveout in the statute, trigger a jurisdiction-stripping",
        "paragraph_id": "para_379"
      },
      {
        "text": "provision applicable when a decision or action “is specified",
        "paragraph_id": "para_380"
      },
      {
        "text": ". . . to be in the discretion of the Attorney General”).",
        "paragraph_id": "para_381"
      },
      {
        "text": "Section 2G2.2(b)(5) may fairly be read to “otherwise",
        "paragraph_id": "para_382"
      },
      {
        "text": "specif[y]” a broader range of conduct than the offense-",
        "paragraph_id": "para_383"
      },
      {
        "text": "related conduct described in § 1B1.3(a)(1). As discussed,",
        "paragraph_id": "para_384"
      },
      {
        "text": "the enhancement’s focus on a defendant’s “pattern of",
        "paragraph_id": "para_385"
      },
      {
        "text": "activity” points to a recurring course of conduct, and the",
        "paragraph_id": "para_386"
      },
      {
        "text": "nature of that conduct—firsthand sexual abuse or",
        "paragraph_id": "para_387"
      },
      {
        "text": "exploitation—distinguishes it from the nonproduction child-",
        "paragraph_id": "para_388"
      },
      {
        "text": "pornography conduct governed by § 2G2.2. Taken together,",
        "paragraph_id": "para_389"
      },
      {
        "text": "these textual cues provide a basis for looking beyond the",
        "paragraph_id": "para_390"
      },
      {
        "text": "offense of conviction. At a minimum, they undermine",
        "paragraph_id": "para_391"
      },
      {
        "text": "Mendonsa’s argument that § 1B1.3(a)(1) unambiguously",
        "paragraph_id": "para_392"
      },
      {
        "text": "limits the pattern enhancement to abuse related to the child-",
        "paragraph_id": "para_393"
      },
      {
        "text": "pornography offense.",
        "paragraph_id": "para_394"
      },
      {
        "text": "This conclusion is bolstered by the pattern",
        "paragraph_id": "para_395"
      },
      {
        "text": "enhancement’s immediate context. Section 2G2.2(b)(5)’s",
        "paragraph_id": "para_396"
      },
      {
        "text": "reference to whether “the defendant engaged in” a pattern of",
        "paragraph_id": "para_397"
      },
      {
        "text": "abuse or exploitation stands in stark contrast to the",
        "paragraph_id": "para_398"
      },
      {
        "text": "neighboring subsections, each of which ties the enhancement",
        "paragraph_id": "para_399"
      },
      {
        "text": "to the conduct or circumstances of the child-pornography",
        "paragraph_id": "para_400"
      },
      {
        "text": "offense itself. See U.S.S.G. § 2G2.2(b)(2) (enhancing where",
        "paragraph_id": "para_401"
      },
      {
        "text": "“the material involved a prepubescent minor or a minor who",
        "paragraph_id": "para_402"
      },
      {
        "text": "had not attained the age of 12 years”); id. § 2G2.2(b)(3)(A)",
        "paragraph_id": "para_403"
      },
      {
        "text": "(enhancing where “the offense involved distribution for",
        "paragraph_id": "para_404"
      },
      {
        "text": "pecuniary gain”); id. § 2G2.2(b)(3)(B) (enhancing where",
        "paragraph_id": "para_405"
      },
      {

        "text": "“the defendant distributed in exchange for any valuable",
        "paragraph_id": "para_407"
      },
      {
        "text": "consideration”); id. § 2G2.2(b)(3)(C)–(E) (enhancing where",

      },
      {
        "text": "“the offense involved distribution to a minor” under",
        "paragraph_id": "para_409"
      },
      {
        "text": "specified circumstances); id. § 2G2.2(b)(3)(F) (enhancing",
        "paragraph_id": "para_410"
      },
      {
        "text": "where “the defendant knowingly engaged in distribution”);",
        "paragraph_id": "para_411"
      },
      {
        "text": "id. § 2G2.2(b)(4) (enhancing where “the offense involved",
        "paragraph_id": "para_412"
      },
      {
        "text": "material that portrays” sadistic or masochistic conduct,",
        "paragraph_id": "para_413"
      },
      {
        "text": "violence, or abuse of an infant or toddler); id. § 2G2.2(b)(6)",
        "paragraph_id": "para_414"
      },
      {
        "text": "(enhancing where “the offense involved the use of a",
        "paragraph_id": "para_415"
      },
      {
        "text": "computer or an interactive computer service”); id.",
        "paragraph_id": "para_416"
      },
      {
        "text": "§ 2G2.2(b)(7) (enhancing where “the offense involved” a",
        "paragraph_id": "para_417"
      },
      {
        "text": "specified number of images). Section 2G2.2(b)(1) is the",
        "paragraph_id": "para_418"
      },
      {
        "text": "lone neighboring provision that reduces, rather than",
        "paragraph_id": "para_419"
      },
      {
        "text": "increases, the offense level. But it too focuses on the offense",
        "paragraph_id": "para_420"
      },
      {
        "text": "conduct, applying when “the defendant’s conduct was",
        "paragraph_id": "para_421"
      },
      {
        "text": "limited to the receipt or solicitation” of qualifying material",
        "paragraph_id": "para_422"
      },
      {
        "text": "and the defendant lacked intent to traffic or distribute it. Id.",
        "paragraph_id": "para_423"
      },
      {
        "text": "§ 2G2.2(b)(1).",
        "paragraph_id": "para_424"
      },
      {
        "text": "Mendonsa invokes these neighboring provisions to argue",
        "paragraph_id": "para_425"
      },
      {
        "text": "that § 2G2.2(b)(5) should be read to contain a similar",
        "paragraph_id": "para_426"
      },
      {
        "text": "offense-related limitation. But “[t]he Supreme Court has",
        "paragraph_id": "para_427"
      },
      {
        "text": "emphasized that ‘Congress generally acts intentionally when",
        "paragraph_id": "para_428"
      },
      {
        "text": "it uses particular language in one section of a statute but",
        "paragraph_id": "para_429"
      },
      {
        "text": "omits it in another,’ and that this canon ‘applies with",
        "paragraph_id": "para_430"
      },
      {
        "text": "particular force’ when the use and omission occur ‘in close",
        "paragraph_id": "para_431"
      },
      {
        "text": "proximity’ to one another.” Castillo, 69 F.4th at 658",
        "paragraph_id": "para_432"
      },
      {
        "text": "(quoting Dep’t of Homeland Sec. v. MacLean, 574 U.S. 383,",
        "paragraph_id": "para_433"
      },
      {
        "text": "391–92 (2015)). In Castillo, the definition of “controlled",
        "paragraph_id": "para_434"
      },
      {
        "text": "substance offense” listed completed drug offenses but did",
        "paragraph_id": "para_435"
      },
      {
        "text": "not include related attempt and conspiracy offenses, even",
        "paragraph_id": "para_436"
      },
      {
        "text": "though neighboring Guidelines provisions expressly",
        "paragraph_id": "para_437"
      },
      {
        "text": "included such inchoate crimes. The court reasoned that the",
        "paragraph_id": "para_438"
      },
      {
        "text": "contrast showed that the drafters “knew how to include”",
        "paragraph_id": "para_439"
      },
      {

        "text": "inchoate offenses when intended but chose not to include",
        "paragraph_id": "para_441"
      },
      {
        "text": "them in the definition at issue. Id. The same reasoning cuts",
        "paragraph_id": "para_442"
      },
      {
        "text": "against Mendonsa here. The neighboring subsections",
        "paragraph_id": "para_443"
      },
      {
        "text": "demonstrate that the Commission knew how to tie an",
        "paragraph_id": "para_444"
      },
      {
        "text": "adjustment to offense-related conduct and did so in every",
        "paragraph_id": "para_445"
      },
      {
        "text": "neighboring provision. Section 2G2.2(b)(5), by",
        "paragraph_id": "para_446"
      },
      {
        "text": "comparison, asks only whether “the defendant engaged in” a",
        "paragraph_id": "para_447"
      },
      {
        "text": "pattern of abuse or exploitation, without referring to “the",
        "paragraph_id": "para_448"
      },
      {
        "text": "defendant’s conduct,” “the offense,” or the “material” at",
        "paragraph_id": "para_449"
      },
      {
        "text": "issue. That contrast suggests that the omission of an offense-",
        "paragraph_id": "para_450"
      },
      {
        "text": "related limitation was deliberate.",
        "paragraph_id": "para_451"
      },
      {
        "text": "Mendonsa’s remaining structural arguments are",
        "paragraph_id": "para_452"
      },
      {
        "text": "similarly unavailing. He first relies on the title of",
        "paragraph_id": "para_453"
      },
      {
        "text": "§ 2G2.2(b)—“Specific Offense Characteristics”—to argue",
        "paragraph_id": "para_454"
      },
      {
        "text": "that the pattern enhancement is limited to a pattern of activity",
        "paragraph_id": "para_455"
      },
      {
        "text": "related to the offense of conviction. Like many guidelines",
        "paragraph_id": "para_456"
      },
      {
        "text": "in Chapter Two, § 2G2.2 is organized into subdivisions that",
        "paragraph_id": "para_457"
      },
      {
        "text": "set the base offense level, provide adjustments to that level,",
        "paragraph_id": "para_458"
      },
      {
        "text": "and supply a cross-reference. In that structure, “Specific",
        "paragraph_id": "para_459"
      },
      {
        "text": "Offense Characteristics” identifies a category of adjustments",
        "paragraph_id": "para_460"
      },
      {
        "text": "to the base offense level; it does not itself define the conduct",
        "paragraph_id": "para_461"
      },
      {
        "text": "relevant to those adjustments. See U.S.S.G. § 1B1.3(a)",
        "paragraph_id": "para_462"
      },
      {
        "text": "(providing that “specific offense characteristics” are",
        "paragraph_id": "para_463"
      },
      {
        "text": "determined under its relevant-conduct rules “[u]nless",
        "paragraph_id": "para_464"
      },
      {
        "text": "otherwise specified”); cf. United States v. Ellison, 113 F.3d",
        "paragraph_id": "para_465"
      },
      {
        "text": "77, 82 (7th Cir. 1997) (“The listing of an enhancement under",
        "paragraph_id": "para_466"
      },
      {
        "text": "the heading ‘specific offense characteristics’ does not",
        "paragraph_id": "para_467"
      },
      {
        "text": "require us to truncate the definition of ‘offense’ by ignoring",
        "paragraph_id": "para_468"
      },
      {
        "text": "the full range of relevant conduct under § 1B1.3.”). The title",
        "paragraph_id": "para_469"
      },
      {
        "text": "therefore does not establish that the pattern enhancement",
        "paragraph_id": "para_470"
      },
      {
        "text": "unambiguously applies only to conduct related to the offense",
        "paragraph_id": "para_471"
      },
      {
        "text": "of conviction.",
        "paragraph_id": "para_472"
      },
      {

      },
      {
        "text": "Finally, Mendonsa argues that § 2G2.2(b)(5)’s",
        "paragraph_id": "para_474"
      },
      {
        "text": "placement in Chapter Two, rather than Chapter Four,",
        "paragraph_id": "para_475"
      },
      {
        "text": "indicates that the enhancement is limited to conduct related",
        "paragraph_id": "para_476"
      },
      {
        "text": "to the offense of conviction. But that argument conflates a",
        "paragraph_id": "para_477"
      },
      {
        "text": "defendant’s criminal history with a defendant’s history of",
        "paragraph_id": "para_478"
      },
      {
        "text": "conduct. Part A of Chapter Four calculates a defendant’s",
        "paragraph_id": "para_479"
      },
      {
        "text": "criminal history category principally from “prior",
        "paragraph_id": "para_480"
      },
      {
        "text": "sentence[s].” U.S.S.G. § 4A1.1. A “prior sentence” is one",
        "paragraph_id": "para_481"
      },
      {
        "text": "“previously imposed upon adjudication of guilt . . . for",
        "paragraph_id": "para_482"
      },
      {
        "text": "conduct not part of the instant offense.” U.S.S.G.",
        "paragraph_id": "para_483"
      },
      {
        "text": "§ 4A1.2(a)(1). Some enhancements in Chapter Two require",
        "paragraph_id": "para_484"
      },
      {
        "text": "a prior conviction, see, e.g., U.S.S.G. § 2L1.2(b), which may",
        "paragraph_id": "para_485"
      },
      {
        "text": "or may not also be included in calculating a defendant’s",
        "paragraph_id": "para_486"
      },
      {
        "text": "criminal history category, see U.S.S.G. § 4A1.2(c). But the",
        "paragraph_id": "para_487"
      },
      {
        "text": "pattern enhancement here, like other pattern enhancements",
        "paragraph_id": "para_488"
      },
      {
        "text": "in Chapter Two, turns on whether the defendant engaged in",
        "paragraph_id": "para_489"
      },
      {
        "text": "qualifying conduct, regardless of whether that conduct",
        "paragraph_id": "para_490"
      },
      {
        "text": "resulted in a conviction or sentence. Cf. U.S.S.G.",
        "paragraph_id": "para_491"
      },
      {
        "text": "§ 2A6.2(b)(1)(E) & cmt. n.1 (“pattern of activity involving",
        "paragraph_id": "para_492"
      },
      {
        "text": "stalking, threatening, harassing, or assaulting the same",
        "paragraph_id": "para_493"
      },
      {
        "text": "victim”); U.S.S.G. § 2B1.5(b)(5) & cmt. n.6 (“pattern of",
        "paragraph_id": "para_494"
      },
      {
        "text": "misconduct involving cultural heritage resources or",
        "paragraph_id": "para_495"
      },
      {
        "text": "paleontological resources”). Its placement outside Chapter",
        "paragraph_id": "para_496"
      },

        "text": "Four therefore does not establish that the qualifying conduct",

        "text": "In sum, neither the immediate context of § 2G2.2(b)(5)",

        "text": "nor the broader structure of the Guidelines unambiguously",

      },
      {
        "text": "limits the pattern enhancement to conduct related to the",
        "paragraph_id": "para_501"
      },
      {
        "text": "offense of conviction.",

      {

      },

        "text": "establish a ‘heartland’ characteristic in child pornography",
        "paragraph_id": "para_512"
      },

        "text": "cases.” U.S. Sent’g Comm’n, The History of the Child",
        "paragraph_id": "para_513"
      },
      {
        "text": "Pornography Guidelines 16 (2009). The Commission",
        "paragraph_id": "para_514"
      },
      {
        "text": "responded by amending § 2G2.2’s commentary to",
        "paragraph_id": "para_515"
      },
      {
        "text": "“recommend consideration of an upward departure where",
        "paragraph_id": "para_516"
      },
      {
        "text": "the defendant had sexually abused a minor at any time in the",
        "paragraph_id": "para_517"
      },
      {
        "text": "past.” Id. (citing U.S.S.G. app. C, amend. 325). In 1991, as",
        "paragraph_id": "para_518"
      },
      {
        "text": "part of an effort to increase sentences for child-pornography",
        "paragraph_id": "para_519"
      },
      {
        "text": "offenses, Congress directed the Commission to “provide at",
        "paragraph_id": "para_520"
      },
      {
        "text": "least a 5 level increase for offenders who have engaged in a",
        "paragraph_id": "para_521"
      },
      {
        "text": "pattern of activity involving the sexual abuse or exploitation",
        "paragraph_id": "para_522"
      },
      {
        "text": "of a minor.” Id. at 23 (quoting Treasury, Postal Service and",
        "paragraph_id": "para_523"
      },
      {
        "text": "General Government Appropriations Act, 1992, Pub. L. No.",
        "paragraph_id": "para_524"
      },
      {
        "text": "102–141, § 632, 105 Stat. 834, 876 (1991)).",
        "paragraph_id": "para_525"

        "text": "The Commission implemented that directive by",
        "paragraph_id": "para_526"
      },
      {
        "text": "amending § 2G2.2 itself to add the pattern enhancement,",

        "text": "Thus, the pattern enhancement grew out of the",

        "text": "recognized connection between child-pornography offenses",

      },
      {
        "text": "and a defendant’s history of sexually abusing or exploiting",
        "paragraph_id": "para_543"
      },
      {
        "text": "minors—a concern the Commission first addressed by",
        "paragraph_id": "para_544"
      },
      {
        "text": "recommending an upward departure, and Congress later",
        "paragraph_id": "para_545"
      },
      {
        "text": "addressed by directing the Commission to create the",
        "paragraph_id": "para_546"
      },
      {
        "text": "enhancement. Neither the pattern enhancement nor its",
        "paragraph_id": "para_547"
      },
      {
        "text": "contemporaneous definition required that the abuse be",
        "paragraph_id": "para_548"
      },
      {
        "text": "related to the child-pornography offense. After the First and",
        "paragraph_id": "para_549"
      },
      {
        "text": "Sixth Circuits held that conduct under the enhancement must",
        "paragraph_id": "para_550"
      },
      {
        "text": "relate to the offense of conviction, the Commission made",
        "paragraph_id": "para_551"
      },
      {
        "text": "explicit that the enhancement encompasses a broader scope",
        "paragraph_id": "para_552"
      },
      {
        "text": "of conduct, amending the commentary to state that the",
        "paragraph_id": "para_553"
      },
      {
        "text": "enhancement applies “whether or not the abuse or",
        "paragraph_id": "para_554"
      },
      {
        "text": "exploitation . . . occurred during the course of the offense.”",
        "paragraph_id": "para_555"
      },
      {
        "text": "See Williamson, 439 F.3d at 1139–40 & n.17 (discussing",

      },
      {
        "text": "history of the pattern enhancement’s commentary).",
        "paragraph_id": "para_557"
      },
      {
        "text": "This history supports the government’s reading. The",
        "paragraph_id": "para_558"
      },
      {
        "text": "enhancement was designed to account for a child-",
        "paragraph_id": "para_559"
      },
      {
        "text": "pornography offender’s history of prior sexual abuse, and",
        "paragraph_id": "para_560"
      },
      {
        "text": "nothing in its development suggests that Congress or the",
        "paragraph_id": "para_561"
      },
      {
        "text": "Commission intended to confine it to abuse connected to the",
        "paragraph_id": "para_562"
      },
      {

        "text": "The plain text, structure, and history of § 2G2.2(b)(5) do",
        "paragraph_id": "para_568"

        "text": "not unambiguously limit the enhancement to offense-related",
        "paragraph_id": "para_569"
      },
      {
        "text": "conduct, but neither do they unambiguously establish that it",
        "paragraph_id": "para_570"
      },
      {
        "text": "reaches conduct unrelated to the offense of conviction. The",
        "paragraph_id": "para_571"
      },
      {
        "text": "enhancement does not expressly extend to such unrelated",
        "paragraph_id": "para_572"
      },
      {
        "text": "conduct, and its placement under the “Specific Offense",
        "paragraph_id": "para_573"
      },
      {
        "text": "Characteristics” heading, coupled with § 1B1.3(a)(1)’s",
        "paragraph_id": "para_574"
      },
      {
        "text": "general focus on offense-related conduct, leaves sufficient",
        "paragraph_id": "para_575"
      },
      {
        "text": "uncertainty about the enhancement’s scope to render the",
        "paragraph_id": "para_576"
      },
      {
        "text": "guideline ambiguous. Although Mendonsa ends his Kisor",
        "paragraph_id": "para_577"
      },
      {
        "text": "analysis at the first step and does not dispute that the",
        "paragraph_id": "para_578"
      },
      {
        "text": "government can satisfy the remaining steps for deference,",
        "paragraph_id": "para_579"
      },
      {
        "text": "the government addresses those steps on the merits and does",
        "paragraph_id": "para_580"
      },
      {
        "text": "not invoke forfeiture. Cf. Cisneros, 2026 WL 2451424, at",
        "paragraph_id": "para_581"
      },
      {
        "text": "*4 n.2 (finding that defendant forfeited any challenge to",
        "paragraph_id": "para_582"
      },
      {
        "text": "Kisor’s third step by making no argument). Accordingly, we",
        "paragraph_id": "para_583"
      },
      {
        "text": "briefly consider the remaining Kisor steps.",
        "paragraph_id": "para_584"
      },
      {
        "text": "a",
        "paragraph_id": "para_585"
      },
      {
        "text": "The next step is to determine whether the Commission’s",
        "paragraph_id": "para_586"
      },
      {
        "text": "interpretation of the enhancement in the commentary is",
        "paragraph_id": "para_587"
      },
      {
        "text": "reasonable. United States v. Trumbull, 114 F.4th 1114, 1118",
        "paragraph_id": "para_588"
      },
      {
        "text": "(9th Cir. 2024). To be reasonable, the interpretation “must",
        "paragraph_id": "para_589"
      },
      {
        "text": "come within the zone of ambiguity the court has identified",
        "paragraph_id": "para_590"
      },
      {
        "text": "after employing all its interpretive tools.” Kisor, 588 U.S. at",
        "paragraph_id": "para_591"
      },
      {
        "text": "575–76.",
        "paragraph_id": "para_592"
      },
      {
        "text": "The commentary defines a “pattern of activity involving",
        "paragraph_id": "para_593"
      },
      {
        "text": "the sexual abuse or exploitation of a minor” as a",
        "paragraph_id": "para_594"
      },
      {
        "text": "“combination of two or more separate instances of the sexual",
        "paragraph_id": "para_595"
      },
      {
        "text": "abuse or sexual exploitation of a minor by the defendant,",
        "paragraph_id": "para_596"
      },
      {
        "text": "whether or not the abuse or exploitation (A) occurred during",
        "paragraph_id": "para_597"
      },
      {
        "text": "the course of the offense; (B) involved the same minor; or",
        "paragraph_id": "para_598"
      },
      {
        "text": "20 USA V. MENDONSA",
        "paragraph_id": "para_599"
      },
      {
        "text": "(C) resulted in a conviction for such conduct.” U.S.S.G.",
        "paragraph_id": "para_600"
      },
      {
        "text": "§ 2G2.2 cmt. n.1. This court has explained that the",
        "paragraph_id": "para_601"
      },
      {
        "text": "application note “obviously intends to cast a wide net to",
        "paragraph_id": "para_602"
      },
      {
        "text": "draw in any conceivable history of sexual abuse or",
        "paragraph_id": "para_603"
      },
      {
        "text": "exploitation of children.” United States v. Garner, 490 F.3d",
        "paragraph_id": "para_604"
      },
      {
        "text": "739, 743 (9th Cir. 2007).",
        "paragraph_id": "para_605"
      },
      {
        "text": "The Commission’s interpretation is reasonable. As",
        "paragraph_id": "para_606"
      },
      {
        "text": "discussed, the text of § 2G2.2(b)(5) can be read to reach a",
        "paragraph_id": "para_607"
      },
      {
        "text": "defendant’s history of abusive conduct unrelated to the",
        "paragraph_id": "para_608"
      },
      {
        "text": "offense of conviction, and the enhancement’s structure,",
        "paragraph_id": "para_609"
      },
      {
        "text": "history, and purpose support that reading. The commentary",
        "paragraph_id": "para_610"
      },
      {
        "text": "adopts that permissible reading by specifying that the pattern",
        "paragraph_id": "para_611"
      },
      {
        "text": "of abuse need not have “occurred during the course of the",
        "paragraph_id": "para_612"
      },
      {
        "text": "offense.” That interpretation falls within the zone of",
        "paragraph_id": "para_613"
      },
      {
        "text": "ambiguity identified above.",
        "paragraph_id": "para_614"
      },
      {
        "text": "b",
        "paragraph_id": "para_615"
      },
      {
        "text": "The final step of the Kisor analysis examines the",
        "paragraph_id": "para_616"
      },
      {
        "text": "“character and context of the agency interpretation,” asking",
        "paragraph_id": "para_617"
      },
      {
        "text": "whether the commentary: (1) represents the agency’s",
        "paragraph_id": "para_618"
      },
      {
        "text": "“official position” rather than an “ad hoc statement not",
        "paragraph_id": "para_619"
      },
      {
        "text": "reflecting the agency’s views”; (2) “implicates the agency’s",
        "paragraph_id": "para_620"
      },
      {
        "text": "substantive expertise”; and (3) “reflects the agency’s fair and",
        "paragraph_id": "para_621"
      },
      {
        "text": "considered judgment.” Trumbull, 114 F.4th at 1118 (cleaned",
        "paragraph_id": "para_622"
      },
      {
        "text": "up) (quoting Kisor, 588 U.S. at 574–79).",
        "paragraph_id": "para_623"
      },
      {
        "text": "Mendonsa does not dispute that these requirements are",
        "paragraph_id": "para_624"
      },
      {
        "text": "satisfied. As in Trumbull, the application note represents the",
        "paragraph_id": "para_625"
      },
      {
        "text": "Commission’s official position on the meaning of the",
        "paragraph_id": "para_626"
      },
      {
        "text": "guideline, implicates its substantive expertise in federal",
        "paragraph_id": "para_627"
      },
      {
        "text": "sentencing, and reflects its “fair and considered judgment”",
        "paragraph_id": "para_628"
      },
      {
        "text": "through the Commission’s process for reviewing and",
        "paragraph_id": "para_629"
      },
      {
        "text": "promulgating Guidelines commentary. Id. at 1120–21;",
        "paragraph_id": "para_630"
      },
      {
        "text": "accord United States v. Yafa, 136 F.4th 1194, 1199 (9th Cir.",
        "paragraph_id": "para_631"
      },
      {
        "text": "USA V. MENDONSA 21",
        "paragraph_id": "para_632"
      },
      {
        "text": "2025); see also Stinson, 508 U.S. at 45 (discussing the",
        "paragraph_id": "para_633"
      },
      {
        "text": "Commission’s statutory duty to periodically review and",
        "paragraph_id": "para_634"
      },
      {
        "text": "revise the Guidelines). Deference to the commentary to",
        "paragraph_id": "para_635"
      },
      {
        "text": "§ 2G2.2(b)(5) is therefore appropriate under Kisor.",
        "paragraph_id": "para_636"
      },
      {
        "text": "In sum, because the Commission’s interpretation is",
        "paragraph_id": "para_637"
      },
      {
        "text": "reasonable and satisfies Kisor’s remaining requirements, we",
        "paragraph_id": "para_638"
      },
      {
        "text": "defer to its conclusion that § 2G2.2(b)(5) reaches a",
        "paragraph_id": "para_639"
      },
      {
        "text": "defendant’s pattern of sexual abuse or exploitation unrelated",
        "paragraph_id": "para_640"
      },
      {
        "text": "to the offense of conviction.",
        "paragraph_id": "para_641"
      },
      {
        "text": "B",
        "paragraph_id": "para_642"
      },
      {
        "text": "We next consider Mendonsa’s alternative argument that",
        "paragraph_id": "para_643"
      },
      {
        "text": "his 1993 convictions do not satisfy § 2G2.2(b)(5) because",
        "paragraph_id": "para_644"
      },
      {
        "text": "(1) his convictions for lewd and lascivious acts under Cal.",
        "paragraph_id": "para_645"
      },
      {
        "text": "Pen. Code § 288(a) do not qualify as “sexual abuse or",
        "paragraph_id": "para_646"
      },
      {
        "text": "exploitation” and (2) his two convictions for oral copulation",
        "paragraph_id": "para_647"
      },
      {
        "text": "do not constitute a “pattern” because they may have arisen",
        "paragraph_id": "para_648"
      },
      {
        "text": "from the same incident.",
        "paragraph_id": "para_649"
      },
      {
        "text": "1",

      },
      {
        "text": "The commentary to U.S.S.G. § 2G2.2(b)(5) defines",
        "paragraph_id": "para_651"
      },
      {
        "text": "“sexual abuse or exploitation” as any of the following:",
        "paragraph_id": "para_652"
      },
      {
        "text": "(A) conduct described in 18 U.S.C. § 2241,",
        "paragraph_id": "para_653"
      },
      {
        "text": "§ 2242, § 2243, § 2251(a)–(c),",
        "paragraph_id": "para_654"
      },
      {
        "text": "§ 2251(d)(1)(B), § 2251A, § 2260(b),",
        "paragraph_id": "para_655"
      },
      {
        "text": "§ 2421, § 2422, or § 2423; (B) an offense",
        "paragraph_id": "para_656"
      },
      {
        "text": "under state law, that would have been an",
        "paragraph_id": "para_657"
      },
      {
        "text": "offense under any such section if the offense",
        "paragraph_id": "para_658"
      },
      {
        "text": "had occurred within the special maritime or",
        "paragraph_id": "para_659"
      },
      {
        "text": "territorial jurisdiction of the United States; or",
        "paragraph_id": "para_660"
      },
      {

        "text": "(C) an attempt or conspiracy to commit any",
        "paragraph_id": "para_662"
      },
      {
        "text": "of the offenses under subdivisions (A) or (B).",

      },
      {
        "text": "U.S.S.G. § 2G2.2(b)(5) cmt. n.1.",
        "paragraph_id": "para_664"
      },
      {
        "text": "Mendonsa argues that his convictions under Cal. Penal",
        "paragraph_id": "para_665"
      },
      {
        "text": "Code § 288(a) do not satisfy the definition because § 288(a)",
        "paragraph_id": "para_666"
      },
      {
        "text": "encompasses over-the-clothes touching that would not",
        "paragraph_id": "para_667"
      },
      {
        "text": "violate the federal statutes identified in the commentary.3",
        "paragraph_id": "para_668"
      },
      {
        "text": "This argument rests on the assumption that a prior state",
        "paragraph_id": "para_669"
      },
      {
        "text": "conviction may qualify for the enhancement only if it",
        "paragraph_id": "para_670"
      },
      {
        "text": "satisfies the categorical approach, under which a court may",
        "paragraph_id": "para_671"
      },
      {
        "text": "examine only “the fact of conviction and the statutory",
        "paragraph_id": "para_672"
      },
      {
        "text": "definition of the prior offense.” Taylor v. United States, 495",
        "paragraph_id": "para_673"
      },
      {
        "text": "U.S. 575, 602 (1990).",
        "paragraph_id": "para_674"
      },
      {
        "text": "The categorical approach does not apply where an",
        "paragraph_id": "para_675"
      },
      {
        "text": "enhancement is based on prior conduct rather than prior",
        "paragraph_id": "para_676"
      },
      {
        "text": "convictions. See United States v. Dailey, 941 F.3d 1183,",
        "paragraph_id": "para_677"
      },
      {
        "text": "1191 (9th Cir. 2019) (applying noncategorical approach",
        "paragraph_id": "para_678"
      },
      {
        "text": "where the statute “cover[ed] ‘any conduct that by its nature",
        "paragraph_id": "para_679"
      },
      {
        "text": "is a sex offense against a minor’” (quoting 34 U.S.C.",
        "paragraph_id": "para_680"
      },
      {
        "text": "§ 20911)); accord United States v. Byun, 539 F.3d 982, 992",
        "paragraph_id": "para_681"
      },
      {
        "text": "(9th Cir. 2008) (rejecting categorical approach where statute",
        "paragraph_id": "para_682"
      },
      {
        "text": "addressed “conduct”); cf. Taylor, 495 U.S. at 600 (reasoning",
        "paragraph_id": "para_683"
      },
      {
        "text": "that a statute’s reference to “convictions” for specified",
        "paragraph_id": "para_684"
      },
      {
        "text": "crimes supported application of the categorical approach);",
        "paragraph_id": "para_685"
      },
      {
        "text": "United States v. Thompson, 127 F.4th 1204, 1210–13 (9th",
        "paragraph_id": "para_686"
      },
      {
        "text": "Cir. 2025) (applying categorical approach to sentencing",
        "paragraph_id": "para_687"
      },
      {
        "text": "enhancement that required a qualifying “prior conviction”).",
        "paragraph_id": "para_688"
      },
      {
        "text": "Courts use “ordinary tools of statutory construction, relying",
        "paragraph_id": "para_689"
      },
      {

        "text": "primarily on the language of the statute,” to determine",
        "paragraph_id": "para_693"
      },
      {
        "text": "whether a provision “calls for a categorical approach or an",
        "paragraph_id": "para_694"
      },
      {
        "text": "examination of the facts underlying prior convictions.”",
        "paragraph_id": "para_695"
      },
      {
        "text": "Byun, 539 F.3d at 991 (internal quotation marks omitted).",
        "paragraph_id": "para_696"
      },
      {
        "text": "Here, although the commentary’s definition of sexual",
        "paragraph_id": "para_697"
      },
      {
        "text": "abuse or exploitation references specific federal provisions,",
        "paragraph_id": "para_698"
      },
      {
        "text": "it applies to the “conduct described in” those statutes.",
        "paragraph_id": "para_699"
      },
      {
        "text": "U.S.S.G. § 2G2.2 cmt. n.1. The definition of a “pattern of",
        "paragraph_id": "para_700"
      },
      {
        "text": "activity” also expressly extends to “instances” of sexual",
        "paragraph_id": "para_701"
      },
      {
        "text": "abuse regardless of whether they “resulted in a conviction.”",
        "paragraph_id": "para_702"
      },
      {
        "text": "Id. The enhancement thus turns on whether the defendant",
        "paragraph_id": "para_703"
      },
      {
        "text": "engaged in qualifying conduct, not whether a prior",
        "paragraph_id": "para_704"
      },
      {
        "text": "conviction categorically qualifies. Accordingly, the",
        "paragraph_id": "para_705"
      },
      {
        "text": "categorical approach does not apply to Mendonsa’s § 288(a)",
        "paragraph_id": "para_706"
      },
      {
        "text": "convictions.4",
        "paragraph_id": "para_707"
      },
      {
        "text": "2",
        "paragraph_id": "para_708"
      },
      {
        "text": "Because the categorical approach does not apply, the",
        "paragraph_id": "para_709"
      },
      {
        "text": "district court was entitled to examine the facts underlying",
        "paragraph_id": "para_710"
      },
      {
        "text": "Mendonsa’s 1993 convictions. To apply the pattern",
        "paragraph_id": "para_711"
      },
      {
        "text": "enhancement, the district court had to find by a",
        "paragraph_id": "para_712"
      },
      {
        "text": "preponderance of the evidence that Mendonsa’s 1993",
        "paragraph_id": "para_713"
      },
      {
        "text": "convictions involved “two or more separate instances of",
        "paragraph_id": "para_714"
      },
      {
        "text": ". . . sexual abuse or sexual exploitation of a minor.” Id.; see",
        "paragraph_id": "para_715"
      },
      {
        "text": "United States v. Lucas, 101 F.4th 1158, 1162 (9th Cir. 2024)",
        "paragraph_id": "para_716"
      },
      {

        "text": "United States v. Davis, 751 F.3d 769, 778 (6th Cir. 2014); United States",
        "paragraph_id": "para_720"
      },
      {
        "text": "v. Morin, 417 F. App’x 885, 887 (11th Cir. 2011).",
        "paragraph_id": "para_721"
      },
      {
        "text": "24 USA V. MENDONSA",
        "paragraph_id": "para_722"
      },
      {
        "text": "(en banc) (adopting preponderance-of-the-evidence standard",
        "paragraph_id": "para_723"
      },
      {
        "text": "at sentencing).",
        "paragraph_id": "para_724"
      },
      {
        "text": "The government submitted police reports and charging",
        "paragraph_id": "para_725"
      },
      {
        "text": "documents from the state sentencing proceedings. In",
        "paragraph_id": "para_726"
      },
      {
        "text": "reviewing this evidence at the sentencing hearing, the district",
        "paragraph_id": "para_727"
      },
      {
        "text": "court described multiple instances of sexual contact with one",
        "paragraph_id": "para_728"
      },
      {
        "text": "victim, including direct genital touching and oral sexual",
        "paragraph_id": "para_729"
      },
      {
        "text": "conduct. Mendonsa was convicted of two counts of oral",
        "paragraph_id": "para_730"
      },
      {
        "text": "copulation and nine counts of lewd and lascivious acts,",
        "paragraph_id": "para_731"
      },
      {
        "text": "including multiple instances of skin-to-skin sexual contact",
        "paragraph_id": "para_732"
      },
      {
        "text": "with this victim. Based on this evidence, the district court",
        "paragraph_id": "para_733"
      },
      {
        "text": "reasonably concluded by a preponderance of the evidence",
        "paragraph_id": "para_734"
      },
      {
        "text": "that Mendonsa committed at least two separate instances of",
        "paragraph_id": "para_735"
      },
      {
        "text": "qualifying sexual abuse.",
        "paragraph_id": "para_736"
      },
      {
        "text": "Focusing on this one victim,5 Mendonsa argues that the",
        "paragraph_id": "para_737"
      },
      {
        "text": "police reports show only “one very brief incident” involving",
        "paragraph_id": "para_738"
      },
      {
        "text": "five sexual acts on September 20, 1992. The reports,",
        "paragraph_id": "para_739"
      },
      {
        "text": "however, do not support that characterization. The victim",
        "paragraph_id": "para_740"
      },
      {
        "text": "reported that “Mendonsa fondled and orally copulated him”",
        "paragraph_id": "para_741"
      },
      {
        "text": "on September 20 and further described six additional",
        "paragraph_id": "para_742"
      },
      {
        "text": "incidents—five in Mendonsa’s vehicle and one behind his",
        "paragraph_id": "para_743"
      },
      {
        "text": "truck. Nothing in the report states that those additional",
        "paragraph_id": "para_744"
      },
      {
        "text": "incidents occurred during the same encounter or even on the",
        "paragraph_id": "para_745"
      },
      {
        "text": "same day. And the conduct reported on September 20 itself",
        "paragraph_id": "para_746"
      },
      {
        "text": "was not confined to a single brief episode: the report",
        "paragraph_id": "para_747"
      },
      {
        "text": "describes sexual acts separated by intervening events over a",
        "paragraph_id": "para_748"
      },
      {
        "text": "work shift lasting from approximately 12:30 a.m. to 5:00",
        "paragraph_id": "para_749"
      },
      {
        "text": "a.m. The charging documents further allege qualifying",
        "paragraph_id": "para_750"
      },
      {
        "text": "conduct over different date ranges. The district court",
        "paragraph_id": "para_751"
      },
      {
        "text": "5 The district court also identified qualifying conduct involving at least",
        "paragraph_id": "para_752"
      },
      {
        "text": "one other victim, further supporting its conclusion.",
        "paragraph_id": "para_753"
      },
      {
        "text": "USA V. MENDONSA 25",
        "paragraph_id": "para_754"
      },
      {
        "text": "therefore did not clearly err in finding at least two separate",
        "paragraph_id": "para_755"
      },
      {
        "text": "instances of qualifying sexual abuse involving this victim.6",
        "paragraph_id": "para_756"
      },
      {
        "text": "C",
        "paragraph_id": "para_757"
      },
      {
        "text": "Finally, Mendonsa argues that the district court erred by",
        "paragraph_id": "para_758"
      },
      {
        "text": "relying on unreliable hearsay—namely, documents",
        "paragraph_id": "para_759"
      },
      {
        "text": "describing the conduct involved in his 1993 convictions.",
        "paragraph_id": "para_760"
      },
      {
        "text": "Hearsay evidence is admissible at sentencing provided that",
        "paragraph_id": "para_761"
      },
      {
        "text": "it is accompanied by “some minimal indicia of reliability.”",
        "paragraph_id": "para_762"
      },
      {
        "text": "United States v. Berry, 258 F.3d 971, 976 (9th Cir. 2001)",
        "paragraph_id": "para_763"
      },
      {
        "text": "(quoting United States v. Petty, 982 F.2d 1365, 1369 (9th",
        "paragraph_id": "para_764"
      },
      {
        "text": "Cir.), amended, 992 F.2d 1015 (9th Cir. 1993)). A district",
        "paragraph_id": "para_765"
      },
      {
        "text": "court’s determination whether hearsay statements are",
        "paragraph_id": "para_766"
      },
      {
        "text": "sufficiently reliable at sentencing is reviewed for abuse of",
        "paragraph_id": "para_767"
      },
      {
        "text": "discretion.7 United States v. Shetty, 130 F.3d 1324, 1331",
        "paragraph_id": "para_768"
      },
      {
        "text": "(9th Cir. 1997).",
        "paragraph_id": "para_769"
      },
      {
        "text": "The documents reviewed by the district court consisted",
        "paragraph_id": "para_770"
      },
      {
        "text": "of (1) charging documents, (2) court records, and (3) police",
        "paragraph_id": "para_771"
      },
      {
        "text": "reports. Mendonsa does not genuinely challenge the",
        "paragraph_id": "para_772"
      },
      {
        "text": "accuracy of the charging documents or court records. As for",
        "paragraph_id": "para_773"
      },
      {
        "text": "the police reports, hearsay may be sufficiently reliable when",
        "paragraph_id": "para_774"
      },
      {
        "text": "6 Indeed, Mendonsa conceded below that if the categorical approach did",
        "paragraph_id": "para_775"
      },
      {
        "text": "not apply, his prior lewd-and-lascivious conduct would satisfy the",
        "paragraph_id": "para_776"
      },
      {
        "text": "requirements of the enhancement. In light of that concession, the district",
        "paragraph_id": "para_777"
      },
      {
        "text": "court’s finding arguably should be reviewed for plain error. See Greer",
        "paragraph_id": "para_778"
      },
      {
        "text": "v. United States, 593 U.S. 503, 507 (2021) (forfeited claims are reviewed",
        "paragraph_id": "para_779"
      },
      {
        "text": "for plain error). But the government does not seek plain-error review,",
        "paragraph_id": "para_780"
      },
      {
        "text": "and Mendonsa’s challenge in any event fails under the more favorable",

        "text": "7 The record does not indicate that Mendonsa challenged the documents’",

        "text": "reliability below, arguably subjecting his evidentiary challenge to plain-",

        "text": "error review. Greer, 593 U.S. at 507. Regardless, the challenge fails",
        "paragraph_id": "para_785"
      },
      {
        "text": "under the more favorable abuse-of-discretion standard.",
        "paragraph_id": "para_786"
      },
      {
        "text": "26 USA V. MENDONSA",
        "paragraph_id": "para_787"
      },
      {
        "text": "corroborated by other evidence. United States v. Littlesun,",
        "paragraph_id": "para_788"
      },
      {
        "text": "444 F.3d 1196, 1200–01 (9th Cir. 2006). Here, the victims’",
        "paragraph_id": "para_789"
      },
      {
        "text": "accounts in the police reports largely correspond to the",
        "paragraph_id": "para_790"
      },
      {
        "text": "charges on which Mendonsa was convicted, providing",
        "paragraph_id": "para_791"
      },
      {
        "text": "sufficient indicia of reliability for sentencing purposes.",
        "paragraph_id": "para_792"
      },
      {
        "text": "Mendonsa’s contrary arguments are unpersuasive. His",
        "paragraph_id": "para_793"
      },
      {
        "text": "contention that we cannot evaluate the reliability of the",
        "paragraph_id": "para_794"
      },
      {
        "text": "documents because they are not in the record is moot",
        "paragraph_id": "para_795"
      },
      {
        "text": "because we granted the government’s unopposed motion to",
        "paragraph_id": "para_796"
      },
      {
        "text": "supplement the record on appeal. Nor is it disputed that the",
        "paragraph_id": "para_797"
      },
      {
        "text": "government provided the documents to the U.S. Probation",
        "paragraph_id": "para_798"
      },
      {
        "text": "Office, which incorporated information from them into the",
        "paragraph_id": "para_799"
      },
      {
        "text": "presentence report reviewed by the parties and the district",
        "paragraph_id": "para_800"
      },
      {
        "text": "court. That they were not separately filed on the docket",
        "paragraph_id": "para_801"
      },
      {
        "text": "below does not call their reliability into question.",
        "paragraph_id": "para_802"
      },
      {
        "text": "Second, Mendonsa argues that the police reports are not",
        "paragraph_id": "para_803"
      },
      {
        "text": "reliable because at the time they were prepared, the author",
        "paragraph_id": "para_804"
      },
      {
        "text": "of the reports was “tasked with investigating whether there",
        "paragraph_id": "para_805"
      },
      {
        "text": "were separate counts and not whether there were separate",
        "paragraph_id": "para_806"
      },
      {
        "text": "instances of federally defined offenses.” But Mendonsa",
        "paragraph_id": "para_807"
      },
      {
        "text": "confuses the purpose of the investigation with the reliability",
        "paragraph_id": "para_808"
      },
      {
        "text": "of the facts it produced. The investigator’s purpose may bear",
        "paragraph_id": "para_809"
      },
      {
        "text": "on what the documented facts establish, but it does not",
        "paragraph_id": "para_810"
      },
      {
        "text": "undermine the reliability of the facts themselves.",
        "paragraph_id": "para_811"
      },
      {
        "text": "Third, he contends that the passage of time since the",
        "paragraph_id": "para_812"
      },
      {
        "text": "police reports were authored makes it impossible for the",
        "paragraph_id": "para_813"
      },
      {
        "text": "defense to test their accuracy. But the inability to cross-",
        "paragraph_id": "para_814"
      },
      {
        "text": "examine the source of hearsay does not, by itself, render the",
        "paragraph_id": "para_815"
      },
      {
        "text": "evidence unreliable at sentencing. See Petty, 982 F.2d at",
        "paragraph_id": "para_816"
      },
      {
        "text": "1367 (upholding reliance on a hearsay statement despite the",
        "paragraph_id": "para_817"
      },
      {
        "text": "defendant’s inability to cross-examine the declarant).",
        "paragraph_id": "para_818"
      },
      {

        "text": "In sum, Mendonsa has not shown that the district court",
        "paragraph_id": "para_820"
      },
      {
        "text": "abused its discretion by relying on the documents from the",
        "paragraph_id": "para_821"
      },
      {
        "text": "state-court proceedings.",
        "paragraph_id": "para_822"
      },
      {
        "text": "IV",
        "paragraph_id": "para_823"
      },
      {
        "text": "We hold that § 2G2.2(b)(5) is ambiguous as to whether",
        "paragraph_id": "para_824"
      },
      {
        "text": "the pattern enhancement reaches conduct outside the offense",
        "paragraph_id": "para_825"
      },
      {
        "text": "of conviction and that the Commission’s interpretation",
        "paragraph_id": "para_826"
      },
      {
        "text": "permitting consideration of such conduct is reasonable and",
        "paragraph_id": "para_827"
      },
      {
        "text": "entitled to deference. Because the district court properly",
        "paragraph_id": "para_828"
      },
      {
        "text": "applied the enhancement, we affirm Mendonsa’s sentence.",
        "paragraph_id": "para_829"
      },
      {
