        "text": "Aviation and Transportation Security Act / Montreal",

        "text": "The panel affirmed the district court’s summary",
        "paragraph_id": "para_32"
      },
      {
        "text": "judgment in favor of Delta Air Lines, Inc., in an action",
        "paragraph_id": "para_33"
      },
      {
        "text": "brought under the Montreal Convention by Atef Bandary.",
        "paragraph_id": "para_34"
      },
      {
        "text": "During a domestic Delta flight, a passenger reported",
        "paragraph_id": "para_35"
      },
      {
        "text": "concerns about Bandary to flight attendants. After",
        "paragraph_id": "para_36"
      },
      {
        "text": "consulting with the aircraft’s captain, the lead flight",
        "paragraph_id": "para_37"
      },
      {
        "text": "attendant approached Bandary with the intention of asking",
        "paragraph_id": "para_38"
      },
      {
        "text": "him to stay seated for the short remainder of the flight. The",
        "paragraph_id": "para_39"
      },
      {
        "text": "encounter quickly escalated into a physical altercation, and",
        "paragraph_id": "para_40"
      },
      {
        "text": "the lead flight attendant sought help from a federal law",
        "paragraph_id": "para_41"
      },
      {
        "text": "enforcement agent on board. With the lead flight attendant’s",
        "paragraph_id": "para_42"
      },
      {
        "text": "assistance, the agent restrained Bandary until the plane",
        "paragraph_id": "para_43"
      },
      {
        "text": "landed.",
        "paragraph_id": "para_44"
      },
      {
        "text": "Bandary alleged injuries caused by the restraint. The",
        "paragraph_id": "para_45"
      },
      {
        "text": "jury returned a verdict in favor of Bandary, but the district",
        "paragraph_id": "para_46"
      },
      {
        "text": "court vacated the verdict and granted summary judgment in",
        "paragraph_id": "para_47"
      },
      {
        "text": "favor of Delta, finding that Delta was immune under the",
        "paragraph_id": "para_48"
      },
      {
        "text": "Aviation and Transportation Security Act (“ATSA”).",
        "paragraph_id": "para_49"
      },
      {

        "text": "The ATSA grants immunity against civil liability for “a",
        "paragraph_id": "para_53"
      },
      {
        "text": "voluntary disclosure [to law enforcement] of any suspicious",
        "paragraph_id": "para_54"
      },
      {
        "text": "transaction relevant to a possible violation of law or",
        "paragraph_id": "para_55"
      },
      {
        "text": "regulation, relating to air piracy, a threat to aircraft or",
        "paragraph_id": "para_56"
      },
      {
        "text": "passenger safety, or terrorism.” Joining two other circuits,",
        "paragraph_id": "para_57"
      },
      {
        "text": "the panel held that under the plain text and purpose of the",
        "paragraph_id": "para_58"
      },
      {
        "text": "ATSA, immunity applies both to the initial disclosure to law",
        "paragraph_id": "para_59"
      },
      {
        "text": "enforcement and to the conduct stemming from law",
        "paragraph_id": "para_60"
      },
      {
        "text": "enforcement’s decisions following such disclosure.",
        "paragraph_id": "para_61"
      },
      {
        "text": "Applying this standard, the panel affirmed the district",
        "paragraph_id": "para_62"
      },
      {
        "text": "court’s finding that Delta was immune for any injury",
        "paragraph_id": "para_63"
      },
      {
        "text": "sustained after the flight attendants reported Bandary’s",
        "paragraph_id": "para_64"
      },
      {
        "text": "behavior to law enforcement because there was no genuine",
        "paragraph_id": "para_65"
      },
      {
        "text": "despute of material fact as to whether Bandary’s conduct",
        "paragraph_id": "para_66"
      },
      {
        "text": "was “suspicious” to a reasonable airline employee. There",
        "paragraph_id": "para_67"
      },
      {
        "text": "was also no triable issue whether Delta was solely",
        "paragraph_id": "para_68"
      },
      {
        "text": "responsible for Bandary’s injuries or whether he was injured",
        "paragraph_id": "para_69"
      },
      {
        "text": "prior to law enforcement’s involvement. The panel held that",
        "paragraph_id": "para_70"
      },
      {
        "text": "because Delta was immune for all of Bandary’s physical",
        "paragraph_id": "para_71"
      },
      {
        "text": "injuries, he also could not recover for any of his alleged",
        "paragraph_id": "para_72"
      },
      {
        "text": "emotional injuries under the Montreal Convention.",

        "text": "NGUYEN, Circuit Judge:",

        "text": "During a domestic flight on Delta Air Lines, Inc.",
        "paragraph_id": "para_98"
      },
      {
        "text": "(“Delta”), passenger Atef Bandary (“Bandary”) engaged in",
        "paragraph_id": "para_99"
      },
      {
        "text": "behavior that several passengers perceived as suspicious.",
        "paragraph_id": "para_100"
      },
      {
        "text": "One passenger, an off-duty pilot for another airline, reported",
        "paragraph_id": "para_101"
      },
      {
        "text": "his concerns directly to the flight attendants. The lead flight",
        "paragraph_id": "para_102"
      },
      {
        "text": "attendant, Joy Rodemoyer (“Rodemoyer”) also learned of",
        "paragraph_id": "para_103"
      },
      {
        "text": "other passenger complaints from two of her colleagues.",
        "paragraph_id": "para_104"
      },
      {
        "text": "After consulting with the aircraft’s captain, Rodemoyer",
        "paragraph_id": "para_105"
      },
      {
        "text": "BANDARY V. DELTA AIR LINES, INC. 5",
        "paragraph_id": "para_106"
      },
      {
        "text": "approached Bandary with the intention of asking him to stay",
        "paragraph_id": "para_107"
      },
      {
        "text": "seated for the short remainder of the flight. The encounter",
        "paragraph_id": "para_108"
      },

        "text": "quickly escalated into a physical altercation, and Rodemoyer",
        "paragraph_id": "para_109"
      },

        "text": "Bandary sued Delta under the Montreal Convention for",
        "paragraph_id": "para_113"
      },
      {
        "text": "alleged injuries to his wrists, neck, and shoulders caused by",

        "text": "a substantial monetary verdict in his favor. The district",
        "paragraph_id": "para_116"
      },
      {
        "text": "court, however, vacated the verdict and granted summary",
        "paragraph_id": "para_117"
      },
      {
        "text": "judgment in favor of Delta, finding that Delta is immune",
        "paragraph_id": "para_118"
      },
      {
        "text": "under the Aviation and Transportation Security Act",
        "paragraph_id": "para_119"
      },
      {
        "text": "(“ATSA”).",
        "paragraph_id": "para_120"
      },
      {
        "text": "The ATSA grants an airline immunity against civil",
        "paragraph_id": "para_121"
      },
      {
        "text": "liability for “a voluntary disclosure [to law enforcement] of",
        "paragraph_id": "para_122"
      },
      {
        "text": "any suspicious transaction relevant to a possible violation of",
        "paragraph_id": "para_123"
      },
      {
        "text": "law or regulation, relating to air piracy, a threat to aircraft or",
        "paragraph_id": "para_124"
      },
      {
        "text": "passenger safety, or terrorism.” 49 U.S.C.A. § 44941(a).",
        "paragraph_id": "para_125"
      },
      {
        "text": "Congress enacted the ATSA in part “to ensure that air",
        "paragraph_id": "para_126"
      },
      {
        "text": "carriers and their employees would not hesitate to provide",
        "paragraph_id": "para_127"
      },
      {
        "text": "the TSA with the information it needed.” Air Wis. Airlines",
        "paragraph_id": "para_128"
      },
      {
        "text": "Corp. v. Hoeper, 571 U.S. 237, 248–49 (2014) (citation",
        "paragraph_id": "para_129"
      },
      {
        "text": "omitted).",
        "paragraph_id": "para_130"
      },
      {
        "text": "The district court held that, under the text and purpose of",
        "paragraph_id": "para_131"
      },
      {
        "text": "the ATSA, immunity applies both to the disclosure to law",
        "paragraph_id": "para_132"
      },
      {
        "text": "enforcement and the conduct stemming from law",
        "paragraph_id": "para_133"
      },
      {
        "text": "enforcement’s decisions following such disclosure.",
        "paragraph_id": "para_134"
      },
      {
        "text": "Applying the statute, the district court found that Delta is",
        "paragraph_id": "para_135"
      },
      {
        "text": "immune for any injury sustained after the flight attendants",
        "paragraph_id": "para_136"
      },
      {
        "text": "reported Bandary’s behavior to law enforcement because",
        "paragraph_id": "para_137"
      },
      {
        "text": "Bandary’s conduct was “suspicious” to a reasonable airline",
        "paragraph_id": "para_138"
      },
      {

      },
      {
        "text": "employee. The court also found that no bodily injury",
        "paragraph_id": "para_140"
      },
      {
        "text": "occurred prior to law enforcement’s involvement.",
        "paragraph_id": "para_141"
      },
      {
        "text": "Bandary challenges the district court’s interpretation of",
        "paragraph_id": "para_142"
      },
      {
        "text": "the ATSA and its application to the facts of this case.",
        "paragraph_id": "para_143"
      },
      {
        "text": "Because we conclude that the district was correct on both",
        "paragraph_id": "para_144"
      },
      {
        "text": "counts, we affirm.",
        "paragraph_id": "para_145"
      },
      {
        "text": "I",
        "paragraph_id": "para_146"
      },
      {
        "text": "A",
        "paragraph_id": "para_147"
      },
      {
        "text": "On May 29, 2015, Bandary was on a Delta flight from",
        "paragraph_id": "para_148"
      },
      {
        "text": "Atlanta, Georgia, to Salt Lake City, Utah. As soon as in-",
        "paragraph_id": "para_149"
      },
      {
        "text": "flight service began, Bandary approached one of the flight",
        "paragraph_id": "para_150"
      },
      {
        "text": "attendants and asked for food to take with his HIV",
        "paragraph_id": "para_151"
      },
      {
        "text": "medication. The flight attendant told Bandary to return to",
        "paragraph_id": "para_152"
      },
      {
        "text": "his seat and wait his turn because she could only serve one",
        "paragraph_id": "para_153"
      },
      {
        "text": "person at a time. Bandary then spoke to a second flight",
        "paragraph_id": "para_154"
      },
      {
        "text": "attendant, Lucy Cook (“Cook”), who apologized for the poor",
        "paragraph_id": "para_155"
      },
      {
        "text": "service and gave him free wine and food.",
        "paragraph_id": "para_156"
      },
      {
        "text": "During the three-and-a-half-hour flight, Bandary was",
        "paragraph_id": "para_157"
      },
      {
        "text": "frequently out of his seat—he walked up and down the",
        "paragraph_id": "para_158"
      },
      {
        "text": "aisles, peered into the first-class cabin through the mesh",
        "paragraph_id": "para_159"
      },
      {
        "text": "curtains on more than one occasion, visited his partner who",
        "paragraph_id": "para_160"
      },
      {
        "text": "was seated a few rows ahead of him, and used the bathroom",
        "paragraph_id": "para_161"
      },
      {
        "text": "several times. Bandary testified that his medication caused",
        "paragraph_id": "para_162"
      },
      {
        "text": "him to have diarrhea, and he needed frequent visits to the",
        "paragraph_id": "para_163"
      },
      {
        "text": "bathroom. During one of Bandary’s bathroom visits, he took",
        "paragraph_id": "para_164"
      },
      {
        "text": "a photo of two flight attendants. Bandary stated that he did",
        "paragraph_id": "para_165"
      },
      {
        "text": "so because they were “staring at [him]” and because he",
        "paragraph_id": "para_166"
      },
      {
        "text": "intended to file a customer service complaint against them.",
        "paragraph_id": "para_167"
      },
      {
        "text": "At trial, three passengers, including an off-duty JetBlue",
        "paragraph_id": "para_168"
      },
      {
        "text": "Airlines pilot, Tim Lunzar (“Lunzar”), testified that they",
        "paragraph_id": "para_169"
      },
      {
        "text": "found Bandary’s behavior concerning or suspicious. While",
        "paragraph_id": "para_170"
      },
      {
        "text": "BANDARY V. DELTA AIR LINES, INC. 7",
        "paragraph_id": "para_171"
      },
      {
        "text": "it is unclear how many passengers shared their concerns",
        "paragraph_id": "para_172"
      },
      {
        "text": "directly with a flight attendant, it is undisputed that Lunzar",
        "paragraph_id": "para_173"
      },
      {
        "text": "reported his concerns to the flight attendants.",
        "paragraph_id": "para_174"
      },
      {
        "text": "Lead flight attendant Rodemoyer spoke to two of her",
        "paragraph_id": "para_175"
      },
      {
        "text": "colleagues, who reported that passengers seated in different",
        "paragraph_id": "para_176"
      },
      {
        "text": "parts of the plane were “nervous” at Bandary’s unusual",
        "paragraph_id": "para_177"
      },
      {
        "text": "behavior and frequent visits to different bathrooms.",
        "paragraph_id": "para_178"
      },
      {
        "text": "Rodemoyer contacted the captain, who relayed to her that he",
        "paragraph_id": "para_179"
      },
      {
        "text": "had checked into Bandary’s background with Delta",
        "paragraph_id": "para_180"
      },
      {
        "text": "personnel on the ground and there was nothing noteworthy.",
        "paragraph_id": "para_181"
      },
      {
        "text": "The pilots and Rodemoyer nonetheless agreed that, with",
        "paragraph_id": "para_182"
      },
      {
        "text": "only about 45 minutes left until landing, it would be a good",
        "paragraph_id": "para_183"
      },
      {
        "text": "idea to ask Bandary to remain seated for the remainder of the",
        "paragraph_id": "para_184"
      },
      {
        "text": "flight. As Rodemoyer approached Bandary in the back",
        "paragraph_id": "para_185"
      },
      {
        "text": "galley of the plane, the situation quickly escalated.",
        "paragraph_id": "para_186"
      },
      {
        "text": "Rodemoyer testified that Bandary started screaming at",
        "paragraph_id": "para_187"
      },
      {
        "text": "her, lunged toward her, and backed her up against the wall.",
        "paragraph_id": "para_188"
      },
      {
        "text": "But Bandary said that when Rodemoyer asked him to sit",
        "paragraph_id": "para_189"
      },
      {
        "text": "down, he simply asked if he could use the restroom.",
        "paragraph_id": "para_190"
      },
      {
        "text": "According to Bandary, the flight attendants cornered him",
        "paragraph_id": "para_191"
      },
      {
        "text": "against the back of the plane, causing him to fall on his",
        "paragraph_id": "para_192"
      },
      {
        "text": "bottom.",
        "paragraph_id": "para_193"
      },
      {
        "text": "Rodemoyer again phoned the captain, who could hear",
        "paragraph_id": "para_194"
      },
      {
        "text": "Bandary’s screaming through the phone. The captain",
        "paragraph_id": "para_195"
      },
      {
        "text": "reminded her that Special Agent Vahe (“agent Vahe”), a law",
        "paragraph_id": "para_196"
      },
      {
        "text": "enforcement officer, was on board. Rodemoyer immediately",
        "paragraph_id": "para_197"
      },
      {
        "text": "left to seek agent Vahe’s assistance, leaving Cook alone with",
        "paragraph_id": "para_198"
      },
      {
        "text": "Bandary at the back of the plane. Agent Vahe testified that",
        "paragraph_id": "para_199"
      },
      {
        "text": "when Rodemoyer asked for help, he immediately got up,",
        "paragraph_id": "para_200"
      },
      {
        "text": "placed his law enforcement badge around his neck, and",
        "paragraph_id": "para_201"
      },
      {
        "text": "walked to the back of the plane. As he approached the back,",
        "paragraph_id": "para_202"
      },
      {
        "text": "he could hear Bandary screaming. Cook stepped forward in",
        "paragraph_id": "para_203"
      },
      {

      },
      {
        "text": "an attempt to put plastic handcuffs, known as “tuff cuffs” or",
        "paragraph_id": "para_205"
      },
      {
        "text": "“flex cuffs” on Bandary, and agent Vahe saw Bandary swing",
        "paragraph_id": "para_206"
      },
      {
        "text": "his hands down in an attempt “to strike [Cook].” Cook",
        "paragraph_id": "para_207"
      },
      {
        "text": "testified that Bandary struck her hand so hard that she",
        "paragraph_id": "para_208"
      },
      {
        "text": "“thought he broke it.” Bandary, however, denies that he",
        "paragraph_id": "para_209"
      },
      {
        "text": "struck or attempted to strike Cook.",
        "paragraph_id": "para_210"
      },
      {
        "text": "Agent Vahe immediately took control of the situation.",
        "paragraph_id": "para_211"
      },
      {
        "text": "He placed himself between Cook and Bandary and held",
        "paragraph_id": "para_212"
      },
      {
        "text": "Bandary in place while Rodemoyer placed flex cuffs on him.",
        "paragraph_id": "para_213"
      },
      {
        "text": "Because the cuffs were initially too tight, agent Vahe cut the",
        "paragraph_id": "para_214"
      },
      {
        "text": "flex cuffs off Bandary’s wrists and placed a new set of cuffs",
        "paragraph_id": "para_215"
      },
      {
        "text": "on him. Agent Vahe kept Bandary cuffed for the remainder",
        "paragraph_id": "para_216"
      },
      {
        "text": "of the flight.",
        "paragraph_id": "para_217"
      },
      {
        "text": "Bandary alleges that he suffered physical injuries,",
        "paragraph_id": "para_218"
      },
      {
        "text": "including cuts and bleeding from his wrists because of the",
        "paragraph_id": "para_219"
      },
      {
        "text": "flex cuffs and shoulder and neck pain from sitting with his",
        "paragraph_id": "para_220"
      },
      {
        "text": "hands behind his back. Bandary also alleges emotional",
        "paragraph_id": "para_221"
      },
      {
        "text": "injuries, including depression and post-traumatic stress",
        "paragraph_id": "para_222"
      },
      {
        "text": "disorder.",
        "paragraph_id": "para_223"
      },
      {
        "text": "B",
        "paragraph_id": "para_224"
      },
      {
        "text": "Bandary sued Delta for malicious prosecution and bodily",
        "paragraph_id": "para_225"
      },
      {
        "text": "and emotional injury under the Montreal Convention.",
        "paragraph_id": "para_226"
      },
      {
        "text": "Article 17 of the Montreal Convention allows passengers to",
        "paragraph_id": "para_227"
      },
      {
        "text": "recover for “bodily injury” sustained from an “accident”",
        "paragraph_id": "para_228"
      },
      {
        "text": "while on board the aircraft. Phifer v. Icelandair, 652 F.3d",
        "paragraph_id": "para_229"
      },
      {
        "text": "1222, 1223 (9th Cir. 2011). Following a trial, the jury found",
        "paragraph_id": "para_230"
      },
      {
        "text": "that: (1) Delta was not entitled to immunity under the ATSA,",
        "paragraph_id": "para_231"
      },
      {
        "text": "(2) Delta caused Bandary to sustain bodily injury, and",
        "paragraph_id": "para_232"
      },
      {
        "text": "(3) Bandary suffered emotional distress caused by bodily",
        "paragraph_id": "para_233"
      },
      {
        "text": "injury. After accounting for contributory negligence, the",
        "paragraph_id": "para_234"
      },
      {
        "text": "jury awarded Bandary a total of $7.2 million dollars for both",
        "paragraph_id": "para_235"
      },
      {
        "text": "bodily injury and emotional distress damages.",
        "paragraph_id": "para_236"
      },
      {
        "text": "BANDARY V. DELTA AIR LINES, INC. 9",
        "paragraph_id": "para_237"
      },
      {
        "text": "Delta moved for a new trial. The district court granted",
        "paragraph_id": "para_238"
      },
      {
        "text": "its motion, finding the damages excessive and contrary to the",
        "paragraph_id": "para_239"
      },
      {
        "text": "weight of the evidence. The court vacated the jury’s verdict",
        "paragraph_id": "para_240"
      },
      {
        "text": "in its entirety because “the issue of damages [was] dependent",
        "paragraph_id": "para_241"
      },
      {
        "text": "on the jury’s finding of liability.”",
        "paragraph_id": "para_242"
      },
      {
        "text": "Delta then moved for summary judgment, which the",
        "paragraph_id": "para_243"
      },
      {
        "text": "district court granted. The district court ruled that “[i]mplicit",
        "paragraph_id": "para_244"
      },
      {
        "text": "in immunity for making reports to law enforcement is",
        "paragraph_id": "para_245"
      },
      {
        "text": "immunity from liability for whatever law enforcement might",
        "paragraph_id": "para_246"
      },
      {
        "text": "do with those reports.” And the court found that, based on",
        "paragraph_id": "para_247"
      },
      {
        "text": "the evidence presented at trial, Delta was entitled to ATSA",
        "paragraph_id": "para_248"
      },
      {
        "text": "immunity for any injury sustained after Rodemoyer",
        "paragraph_id": "para_249"
      },
      {
        "text": "disclosed Bandary’s suspicious behavior to agent Vahe.",
        "paragraph_id": "para_250"
      },
      {
        "text": "According to the district court, there was “no evidence in the",
        "paragraph_id": "para_251"
      },
      {
        "text": "record to suggest that flight attendant Joy Rodemoyer",
        "paragraph_id": "para_252"
      },
      {
        "text": "contacted Vahe for any reason other than to report activity",
        "paragraph_id": "para_253"
      },
      {
        "text": "that she suspected violated laws related to passenger safety.”",
        "paragraph_id": "para_254"
      },
      {
        "text": "Further, the district court found that any potential bodily",
        "paragraph_id": "para_255"
      },
      {
        "text": "injury happened after agent Vahe arrived on the scene.",
        "paragraph_id": "para_256"
      },
      {
        "text": "Specifically, Bandary “directly testified at trial that the first",
        "paragraph_id": "para_257"
      },
      {
        "text": "time any of the flight attendants touched him was when they",
        "paragraph_id": "para_258"
      },
      {
        "text": "attempted to put on the cuffs,” and that the cuffs were first",
        "paragraph_id": "para_259"
      },
      {
        "text": "applied after agent Vahe intervened. The district court",
        "paragraph_id": "para_260"
      },
      {
        "text": "concluded that because ATSA immunity applies, Bandary’s",
        "paragraph_id": "para_261"
      },
      {
        "text": "Montreal Convention claim necessarily fails.",
        "paragraph_id": "para_262"
      },
      {
        "text": "II",
        "paragraph_id": "para_263"
      },
      {
        "text": "We review a summary judgment decision de novo.",
        "paragraph_id": "para_264"
      },
      {
        "text": "Desire, LLC v. Manna Textiles, Inc., 986 F.3d 1253, 1259",
        "paragraph_id": "para_265"
      },
      {
        "text": "(9th Cir. 2021). Summary judgment is appropriate when,",
        "paragraph_id": "para_266"
      },
      {
        "text": "“viewing the evidence in the light most favorable to the non-",
        "paragraph_id": "para_267"
      },
      {
        "text": "movant,” “there is no genuine issue of material fact.” Soc.",
        "paragraph_id": "para_268"
      },
      {
        "text": "Techs. LLC v. Apple Inc., 4 F.4th 811, 816 (9th Cir. 2021).",
        "paragraph_id": "para_269"
      },
      {

      },
      {
        "text": "III",
        "paragraph_id": "para_271"
      },
      {
        "text": "Under the ATSA, any airline or airline employee “who",
        "paragraph_id": "para_272"
      },
      {
        "text": "makes a voluntary disclosure of any suspicious transaction”",
        "paragraph_id": "para_273"
      },
      {
        "text": "to a federal, state, or local law enforcement authority “shall",
        "paragraph_id": "para_274"
      },
      {
        "text": "not be civilly liable to any person under any law or regulation",
        "paragraph_id": "para_275"
      },
      {
        "text": ". . . for such disclosure.” 49 U.S.C.A. § 44941(a).1 Congress",
        "paragraph_id": "para_276"
      },
      {
        "text": "granted airlines immunity “[t]o ensure that the TSA would",
        "paragraph_id": "para_277"
      },
      {
        "text": "be informed of potential threats.” Air Wis., 571 U.S. at 241",
        "paragraph_id": "para_278"
      },
      {
        "text": "(citing 49 U.S.C.A. § 44941(a)).",
        "paragraph_id": "para_279"
      },
      {
        "text": "A",
        "paragraph_id": "para_280"
      },
      {
        "text": "We start, as a matter of first impression in this circuit,",
        "paragraph_id": "para_281"
      },
      {
        "text": "with determining the scope of ATSA immunity. Bandary",
        "paragraph_id": "para_282"
      },
      {
        "text": "argues that the ATSA immunizes only the initial disclosure",
        "paragraph_id": "para_283"
      },
      {
        "text": "of suspicious behavior to law enforcement, not any conduct",
        "paragraph_id": "para_284"
      },
      {
        "text": "by an airline employee that follows that disclosure.",
        "paragraph_id": "para_285"
      },
      {
        "text": "Therefore, according to Bandary, conduct by the flight",
        "paragraph_id": "para_286"
      },
      {
        "text": "attendants that caused his injuries, whether before or after",
        "paragraph_id": "para_287"
      },
      {
        "text": "agent Vahe’s involvement, falls outside of ATSA immunity.",
        "paragraph_id": "para_288"
      },
      {
        "text": "In interpreting a statute, we begin with its plain text. See",
        "paragraph_id": "para_289"
      },
      {
        "text": "Gonzalez v. Herrera, 151 F.4th 1076, 1081 (9th Cir. 2025).",
        "paragraph_id": "para_290"
      },
      {
        "text": "Bandary contends that the statute’s language focuses on",
        "paragraph_id": "para_291"
      },
      {
        "text": "“disclosures” and therefore ATSA immunity is limited to",
        "paragraph_id": "para_292"
      },
      {
        "text": "defamation-type claims. For example, he cites to the",
        "paragraph_id": "para_293"
      },
      {
        "text": "ATSA’s text immunizing airlines “for such disclosure(s)”",
        "paragraph_id": "para_294"
      },
      {
        "text": "and exempting certain disclosures from ATSA immunity.",
        "paragraph_id": "para_295"
      },
      {
        "text": "Bandary’s reading of the statute is, at best, incomplete. The",
        "paragraph_id": "para_296"
      },
      {
        "text": "ATSA’s text immunizes against “any” laws, not just those",
        "paragraph_id": "para_297"
      },
      {
        "text": "1 The ATSA exempts “any disclosure made with actual knowledge that",

        "text": "the disclosure was false, inaccurate, or misleading,” or “any disclosure",
        "paragraph_id": "para_299"
      },
      {
        "text": "made with reckless disregard as to the truth or falsity of that disclosure.”",
        "paragraph_id": "para_300"
      },
      {
        "text": "Id. § 44941(b). That exemption is not an issue here.",
        "paragraph_id": "para_301"
      },
      {

      {
        "text": "akin to defamation. 49 U.S.C.A. § 44941(a). Thus, there is",
        "paragraph_id": "para_303"
      },
      {
        "text": "a strong textual basis to exempt from civil liability certain",
        "paragraph_id": "para_304"
      },
      {
        "text": "conduct that follows from a disclosure. See, e.g., Coronado",
        "paragraph_id": "para_305"
      },
      {
        "text": "v. Bank Atlantic Bancorp., Inc., 222 F.3d 1315, 1321-1322",
        "paragraph_id": "para_306"
      },
      {
        "text": "(11th Cir. 2000) (interpreting nearly identical language in",
        "paragraph_id": "para_307"
      },
      {
        "text": "the Annunzio-Wylie Act to apply to claims beyond",
        "paragraph_id": "para_308"
      },
      {
        "text": "defamation and explaining that “the adjective ‘any’ is not",
        "paragraph_id": "para_309"
      },
      {
        "text": "ambiguous; it has a well-established meaning and, read",
        "paragraph_id": "para_310"
      },
      {
        "text": "naturally . . . has an expansive meaning, that is, one or some",
        "paragraph_id": "para_311"
      },
      {
        "text": "indiscriminately of whatever kind” (quotation marks and",
        "paragraph_id": "para_312"
      },
      {
        "text": "citation omitted)).",
        "paragraph_id": "para_313"
      },
      {
        "text": "Bandary’s cramped reading of the ATSA’s grant of",
        "paragraph_id": "para_314"
      },
      {
        "text": "immunity is also inconsistent with the statute’s purpose. See",
        "paragraph_id": "para_315"
      },
      {
        "text": "Gonzalez, 151 F.4th at 1081 (explaining that “[i]f the",
        "paragraph_id": "para_316"
      },
      {
        "text": "statute’s terms are ambiguous,” we may consider “the",
        "paragraph_id": "para_317"
      },
      {
        "text": "statute’s overall purpose to illuminate Congress’s intent”",
        "paragraph_id": "para_318"
      },
      {
        "text": "(simplified) (quoting Ileto v. Glock, Inc., 565 F.3d 1126,",
        "paragraph_id": "para_319"
      },
      {
        "text": "1133 (9th Cir. 2009)). “The ATSA shifted from airlines to",
        "paragraph_id": "para_320"
      },
      {
        "text": "the TSA the responsibility ‘for assessing and investigating",
        "paragraph_id": "para_321"
      },
      {
        "text": "possible threats to airline security.’” Air Wis., 571 U.S. at",
        "paragraph_id": "para_322"
      },
      {
        "text": "248 (citation omitted). In enacting the ATSA, “Congress",
        "paragraph_id": "para_323"
      },
      {
        "text": "wanted to ensure that air carriers and their employees would",
        "paragraph_id": "para_324"
      },
      {
        "text": "not hesitate to provide the TSA with the information it",
        "paragraph_id": "para_325"
      },
      {
        "text": "needed.” Id. at 249. Thus, the grant of immunity to airlines",
        "paragraph_id": "para_326"
      },
      {
        "text": "created a policy of “when in doubt, report.” Id. at 257",
        "paragraph_id": "para_327"
      },
      {
        "text": "(citation omitted).",
        "paragraph_id": "para_328"
      },
      {
        "text": "Holding an airline civilly liable for conduct flowing from",
        "paragraph_id": "para_329"
      },
      {
        "text": "its employees’ disclosure to law enforcement would chill",
        "paragraph_id": "para_330"
      },
      {
        "text": "their willingness to report and substantially defeat the",

      },
      {
        "text": "12 BANDARY V. DELTA AIR LINES, INC.",
        "paragraph_id": "para_336"
      },
      {
        "text": "Cal. Rptr. 3d 533, 552–53 (2022) (holding that ATSA",
        "paragraph_id": "para_337"
      },
      {
        "text": "immunity is not limited to disclosures because “Congress",
        "paragraph_id": "para_338"
      },
      {
        "text": "intended to confer upon air carriers the greatest possible",
        "paragraph_id": "para_339"
      },
      {
        "text": "degree of protection by enacting section 44941” and “the",
        "paragraph_id": "para_340"
      },
      {
        "text": "consequences of disclosing a security threat cannot be so",
        "paragraph_id": "para_341"
      },
      {
        "text": "easily separated from the disclosure itself”). We therefore",
        "paragraph_id": "para_342"
      },
      {
        "text": "hold that, consistent with the text and purpose of the statute,",
        "paragraph_id": "para_343"
      },
      {
        "text": "ATSA immunity applies to conduct that flows from law",
        "paragraph_id": "para_344"
      },
      {
        "text": "enforcement’s decisions following a suspicious disclosure.",
        "paragraph_id": "para_345"
      },
      {
        "text": "Our holding today is consistent with the application of",
        "paragraph_id": "para_346"
      },
      {
        "text": "ATSA immunity in two of our sister circuits. In Baez v.",
        "paragraph_id": "para_347"
      },
      {
        "text": "JetBlue Airways Corp., the plaintiff made a comment about",
        "paragraph_id": "para_348"
      },
      {
        "text": "the possibility of a bomb in her luggage, and the gate agent",
        "paragraph_id": "para_349"
      },
      {
        "text": "reported the statement to law enforcement. 793 F.3d 269,",
        "paragraph_id": "para_350"
      },
      {
        "text": "271 (2d Cir. 2015). The plaintiff was arrested and brought",
        "paragraph_id": "para_351"
      },
      {
        "text": "various claims against the airline and the gate agent,",
        "paragraph_id": "para_352"
      },
      {
        "text": "including claims for defamation, negligence, false arrest, and",
        "paragraph_id": "para_353"
      },
      {
        "text": "intentional infliction of emotional distress. Id. at 271–73.",
        "paragraph_id": "para_354"
      },
      {
        "text": "The Second Circuit acknowledged that the gate agent and",
        "paragraph_id": "para_355"
      },
      {
        "text": "airline were required to report any threats to law",
        "paragraph_id": "para_356"
      },
      {
        "text": "enforcement, and that “[j]udgment calls about how to act on",
        "paragraph_id": "para_357"
      },
      {
        "text": "such reports are the province of the TSA and other law",
        "paragraph_id": "para_358"
      },
      {
        "text": "enforcement officers.” Id. at 276. Noting that the “adverse",
        "paragraph_id": "para_359"
      },
      {
        "text": "consequences to Baez flowed from the decisions made by",
        "paragraph_id": "para_360"
      },
      {
        "text": "such law enforcement officers,” the court applied ATSA",
        "paragraph_id": "para_361"
      },
      {
        "text": "immunity to all the asserted claims against the airline and its",
        "paragraph_id": "para_362"
      },
      {
        "text": "employee—not just the defamation claim. Id.",
        "paragraph_id": "para_363"
      },
      {
        "text": "The Fifth Circuit adopted this reasoning in Abdallah v.",
        "paragraph_id": "para_364"
      },
      {
        "text": "Mesa Air Grp., Inc., 83 F.4th 1006 (5th Cir. 2023). Quoting",
        "paragraph_id": "para_365"
      },
      {
        "text": "Baez, the court held that Section 44941(a) “grants immunity",
        "paragraph_id": "para_366"
      },
      {
        "text": "for any communications made between [the airline] and",
        "paragraph_id": "para_367"
      },
      {
        "text": "external security agents—and to any impact that ‘flowed",
        "paragraph_id": "para_368"
      },
      {

        "text": "from the decisions made by such law enforcement officers.’”",
        "paragraph_id": "para_370"
      },
      {
        "text": "Id. at 1012 (quoting Baez, 793 F.3d at 276).",
        "paragraph_id": "para_371"
      },
      {
        "text": "Because the Second and Fifth Circuits’ holdings are",
        "paragraph_id": "para_372"
      },
      {
        "text": "consistent with our own reading of the ATSA’s text, we join",
        "paragraph_id": "para_373"
      },
      {
        "text": "our sister circuits and hold that ATSA immunity applies to",
        "paragraph_id": "para_374"
      },
      {
        "text": "the conduct that flowed from agent Vahe’s decisions",
        "paragraph_id": "para_375"
      },
      {
        "text": "following Delta’s suspicious disclosure.",
        "paragraph_id": "para_376"
      },
      {
        "text": "B",
        "paragraph_id": "para_377"
      },
      {
        "text": "Bandary argues in the alternative that, even if the ATSA",
        "paragraph_id": "para_378"
      },
      {
        "text": "covers conduct stemming from the disclosure of suspicious",
        "paragraph_id": "para_379"
      },
      {
        "text": "activity, genuine disputes exist as to whether his conduct was",
        "paragraph_id": "para_380"
      },
      {
        "text": "suspicious, whether Delta is solely responsible for his",
        "paragraph_id": "para_381"
      },
      {
        "text": "injuries, or whether he was injured prior to law",
        "paragraph_id": "para_382"
      },
      {
        "text": "enforcement’s involvement.",
        "paragraph_id": "para_383"
      },
      {
        "text": "i",
        "paragraph_id": "para_384"
      },
      {
        "text": "ATSA immunity applies for an airline’s “voluntary",
        "paragraph_id": "para_385"
      },
      {
        "text": "disclosure of any suspicious transaction . . . relating to air",
        "paragraph_id": "para_386"
      },
      {
        "text": "piracy, a threat to aircraft or passenger safety, or terrorism.”",
        "paragraph_id": "para_387"
      },
      {
        "text": "49 U.S.C.A. § 44941(a). Bandary argues that whether he",
        "paragraph_id": "para_388"
      },
      {
        "text": "engaged in suspicious conduct should be assessed under an",
        "paragraph_id": "para_389"
      },
      {
        "text": "objective standard, that is, whether Bandary’s actions were",
        "paragraph_id": "para_390"
      },
      {
        "text": "suspicious to a reasonable airline employee. But by any",
        "paragraph_id": "para_391"
      },
      {
        "text": "metric, and viewing the facts in the light most favorable to",
        "paragraph_id": "para_392"
      },
      {
        "text": "Bandary, the district court correctly found that no material",
        "paragraph_id": "para_393"
      },
      {
        "text": "issues of fact exist as to whether there was a “suspicious",
        "paragraph_id": "para_394"
      },
      {
        "text": "transaction.”",
        "paragraph_id": "para_395"
      },
      {
        "text": "Bandary continually paced the aisles, went in and out of",
        "paragraph_id": "para_396"
      },
      {
        "text": "different bathrooms, peered into the first-class cabin",
        "paragraph_id": "para_397"
      },
      {
        "text": "multiple times, took a photograph of flight attendants, and",
        "paragraph_id": "para_398"
      },
      {
        "text": "stared at passengers. Lunzar, an off-duty pilot, testified that",
        "paragraph_id": "para_399"
      },
      {
        "text": "he observed Bandary staring at passengers for twenty to",
        "paragraph_id": "para_400"
      },
      {
        "text": "14 BANDARY V. DELTA AIR LINES, INC.",
        "paragraph_id": "para_401"
      },
      {
        "text": "thirty seconds straight, in what he described as an",
        "paragraph_id": "para_402"
      },
      {
        "text": "expressionless “dead stare.” He observed that Bandary was",
        "paragraph_id": "para_403"
      },
      {
        "text": "constantly fidgeting, getting up from his seat, and moving",
        "paragraph_id": "para_404"
      },
      {
        "text": "around. Lunzar thought Bandary’s behavior was suspicious",
        "paragraph_id": "para_405"
      },
      {
        "text": "enough to report to the flight attendants that Bandary was",
        "paragraph_id": "para_406"
      },
      {
        "text": "acting “suspiciously and oddly, staring at customers, making",
        "paragraph_id": "para_407"
      },
      {
        "text": "them feel uncomfortable, [and] pacing around the aircraft.”",
        "paragraph_id": "para_408"
      },
      {
        "text": "Lunzar also testified that the two women sitting next to",
        "paragraph_id": "para_409"
      },
      {
        "text": "him brought Bandary’s behavior to his attention because",
        "paragraph_id": "para_410"
      },
      {
        "text": "they were similarly concerned. One of those women",
        "paragraph_id": "para_411"
      },
      {
        "text": "testified that Bandary was “interested in making sure he",
        "paragraph_id": "para_412"
      },
      {
        "text": "knew who every single person was on the plane,” was",
        "paragraph_id": "para_413"
      },
      {
        "text": "“walking around,” and was “just staring at each individual",
        "paragraph_id": "para_414"
      },
      {
        "text": "group going up and down the aisles.” Based on her",
        "paragraph_id": "para_415"
      },
      {
        "text": "observations, she testified that Bandary looked “anxious”",
        "paragraph_id": "para_416"
      },
      {
        "text": "and “it felt like he was working up some kind of a plan.”",
        "paragraph_id": "para_417"
      },
      {
        "text": "Rodemoyer testified that other flight attendants told her",
        "paragraph_id": "para_418"
      },
      {
        "text": "that passengers from different parts of the plane had",
        "paragraph_id": "para_419"
      },
      {
        "text": "complained that they were “nervous” about Bandary’s",
        "paragraph_id": "para_420"
      },
      {
        "text": "behavior. The situation was concerning enough that she felt",
        "paragraph_id": "para_421"
      },
      {
        "text": "the need to raise it with the captain because she believed",
        "paragraph_id": "para_422"
      },
      {
        "text": "Bandary’s behavior was “something suspect of unusual and",
        "paragraph_id": "para_423"
      },
      {
        "text": "safety related.” Bandary’s behavior when she approached",
        "paragraph_id": "para_424"
      },
      {
        "text": "him caused Rodemoyer to become concerned about her own",
        "paragraph_id": "para_425"
      },
      {
        "text": "personal safety.",
        "paragraph_id": "para_426"
      },
      {
        "text": "Bandary argues that his conduct was not suspicious",
        "paragraph_id": "para_427"
      },
      {
        "text": "because he merely used the restroom multiple times, visited",
        "paragraph_id": "para_428"
      },
      {
        "text": "his partner who was seated a few rows ahead of him,",
        "paragraph_id": "para_429"
      },
      {
        "text": "expressed dissatisfaction with Delta’s customer service, and",
        "paragraph_id": "para_430"
      },
      {
        "text": "took a picture of flight attendants about whom he wanted to",
        "paragraph_id": "para_431"
      },
      {
        "text": "complain. Further, Bandary notes that Cook and Rodemoyer",
        "paragraph_id": "para_432"
      },
      {
        "text": "both testified at one point that they did not believe Bandary",
        "paragraph_id": "para_433"
      },
      {
        "text": "BANDARY V. DELTA AIR LINES, INC. 15",
        "paragraph_id": "para_434"
      },
      {
        "text": "was a suspicious passenger. Bandary contends that these",
        "paragraph_id": "para_435"
      },
      {
        "text": "facts stand in contrast to Air Wisconsin and Baez, where the",
        "paragraph_id": "para_436"
      },
      {
        "text": "plaintiffs’ actions were suspicious because they involved the",
        "paragraph_id": "para_437"
      },
      {
        "text": "threat of a weapon.",
        "paragraph_id": "para_438"
      },
      {
        "text": "But Bandary fails to show that a reasonable flight",
        "paragraph_id": "para_439"
      },
      {
        "text": "attendant, faced with the concerns expressed by numerous",
        "paragraph_id": "para_440"
      },
      {
        "text": "passengers, would have acted differently. Although Cook",
        "paragraph_id": "para_441"
      },
      {
        "text": "and Rodemoyer did not view Bandary as suspicious at",
        "paragraph_id": "para_442"
      },
      {
        "text": "certain points during their interactions with him, Cook also",
        "paragraph_id": "para_443"
      },
      {
        "text": "testified that Bandary appeared “very agitated and very",
        "paragraph_id": "para_444"
      },
      {
        "text": "upset,” and was “out of control,” and Rodemoyer testified",
        "paragraph_id": "para_445"
      },
      {
        "text": "that Bandary’s behavior caused her to become concerned for",
        "paragraph_id": "para_446"
      },
      {
        "text": "her safety. And as the district court noted, there is no",
        "paragraph_id": "para_447"
      },
      {
        "text": "evidence that Rodemoyer contacted agent Vahe for any",
        "paragraph_id": "para_448"
      },
      {
        "text": "reason other than to report Bandary’s potentially suspicious",
        "paragraph_id": "para_449"
      },
      {
        "text": "behavior. See id. at 248 (noting that the ATSA shifted",
        "paragraph_id": "para_450"
      },
      {
        "text": "responsibility from airlines to the TSA “for assessing and",
        "paragraph_id": "para_451"
      },
      {
        "text": "investigating possible threats to airline security” (citation",
        "paragraph_id": "para_452"
      },
      {
        "text": "omitted)).",
        "paragraph_id": "para_453"
      },
      {
        "text": "For these reasons, the district court properly held that",
        "paragraph_id": "para_454"
      },
      {
        "text": "there was no genuine dispute of material fact as to whether",
        "paragraph_id": "para_455"
      },
      {
        "text": "Bandary’s actions were suspicious within the meaning of",
        "paragraph_id": "para_456"
      },
      {
        "text": "§ 44941(a).2",
        "paragraph_id": "para_457"
      },
      {
        "text": "2 The dissent cites Bandary’s trial testimony concerning his various",
        "paragraph_id": "para_458"
      },
      {
        "text": "medical conditions, his status as an Egyptian immigrant, and his belief",
        "paragraph_id": "para_459"
      },
      {
        "text": "that he was racially profiled. We focus only on what was known to the",
        "paragraph_id": "para_460"
      },
      {
        "text": "flight attendants at the time they decided to seek Agent Vahe’s",
        "paragraph_id": "para_461"
      },
      {
        "text": "assistance. Much of the testimony cited by the dissent is therefore",
        "paragraph_id": "para_462"
      },
      {
        "text": "irrelevant, and there is no evidence that any racial animus influenced the",
        "paragraph_id": "para_463"
      },
      {
        "text": "flight attendants’ conduct. The dissent similarly references the jury’s",
        "paragraph_id": "para_464"
      },
      {
        "text": "findings on whether Bandary’s conduct was suspicious. Although the",
        "paragraph_id": "para_465"
      },
      {
        "text": "jury found that Delta did not make a voluntary disclosure of a suspicious",
        "paragraph_id": "para_466"
      },
      {
        "text": "transaction, the verdict was vacated by the district court. That order is",
        "paragraph_id": "para_467"
      },
      {
        "text": "16 BANDARY V. DELTA AIR LINES, INC.",
        "paragraph_id": "para_468"
      },
      {
        "text": "ii",
        "paragraph_id": "para_469"
      },
      {
        "text": "Bandary raises a few other arguments. First, relying on",
        "paragraph_id": "para_470"
      },
      {
        "text": "Abdallah, he contends that Delta was solely responsible for",
        "paragraph_id": "para_471"
      },
      {
        "text": "his injuries. In Abdallah, the Fifth Circuit held that the",
        "paragraph_id": "para_472"
      },
      {
        "text": "ATSA “does not grant immunity for things that occurred",
        "paragraph_id": "para_473"
      },
      {
        "text": "solely because of the airline’s actions.” 83 F.4th at 1012–",
        "paragraph_id": "para_474"
      },
      {
        "text": "13. There, the airline decided to delay the flight after",
        "paragraph_id": "para_475"
      },
      {
        "text": "security officials found that there was no reason for concern.",
        "paragraph_id": "para_476"
      },
      {
        "text": "Id. at 1013. Because the decision to delay the flight was",
        "paragraph_id": "para_477"
      },
      {
        "text": "made solely by the airline, the Fifth Circuit held that the",
        "paragraph_id": "para_478"
      },
      {
        "text": "ATSA did not immunize against any damages that flowed",
        "paragraph_id": "para_479"
      },
      {
        "text": "from that decision. Id.",
        "paragraph_id": "para_480"
      },
      {
        "text": "Bandary’s argument that Delta is solely responsible for",
        "paragraph_id": "para_481"
      },
      {
        "text": "his injuries is belied by the record. Agent Vahe testified that",
        "paragraph_id": "para_482"
      },
      {
        "text": "he personally surveyed the scene before making the decision",
        "paragraph_id": "para_483"
      },
      {
        "text": "to intervene, and the flight attendants were “just there to",
        "paragraph_id": "para_484"
      },
      {
        "text": "assist [him].” Agent Vahe asked for Rodemoyer’s assistance",
        "paragraph_id": "para_485"
      },
      {
        "text": "to place the flex cuffs on Bandary, and he testified that he",
        "paragraph_id": "para_486"
      },
      {
        "text": "tightened the second set of cuffs himself. Cook also testified",
        "paragraph_id": "para_487"
      },
      {
        "text": "that agent Vahe initially directed her to leave the scene when",
        "paragraph_id": "para_488"
      },
      {
        "text": "he arrived. Finally, from the moment agent Vahe intervened,",
        "paragraph_id": "para_489"
      },
      {
        "text": "Bandary “was effectively in [his] custody until [he] turned",
        "paragraph_id": "para_490"
      },
      {
        "text": "[Bandary] over to somebody else.” On this record, no",
        "paragraph_id": "para_491"
      },
      {
        "text": "evidence suggests that Delta was solely responsible for",
        "paragraph_id": "para_492"
      },
      {
        "text": "Bandary’s injuries. Accordingly, ATSA immunity applies.",
        "paragraph_id": "para_493"
      },
      {
        "text": "not on appeal. Therefore, without an operative verdict, “the parties are",
        "paragraph_id": "para_494"
      },
      {
        "text": "left in the same situation as if no trial had ever taken place.” United",
        "paragraph_id": "para_495"
      },
      {
        "text": "States v. Recio, 371 F.3d 1093, 1105 n.11 (9th Cir. 2004) (quoting United",
        "paragraph_id": "para_496"
      },
      {
        "text": "States v. Ayres, 76 U.S. (9 Wall.) 608, 610 (1869)). Further, “to the",
        "paragraph_id": "para_497"
      },
      {
        "text": "extent that the immunity determination belongs to the court . . . a court’s",
        "paragraph_id": "para_498"
      },
      {
        "text": "deferential review of jury findings cannot substitute for its own analysis",
        "paragraph_id": "para_499"
      },
      {
        "text": "of the record.” Air Wis., 571 U.S. at 250.",
        "paragraph_id": "para_500"
      },
      {
        "text": "BANDARY V. DELTA AIR LINES, INC. 17",
        "paragraph_id": "para_501"
      },
      {
        "text": "Second, Bandary briefly argues that, even if ATSA",
        "paragraph_id": "para_502"
      },
      {
        "text": "immunity applies after agent Vahe’s involvement, he may",
        "paragraph_id": "para_503"
      },
      {
        "text": "still be able to recover for any injury that occurred before the",
        "paragraph_id": "para_504"
      },
      {
        "text": "disclosure. But Bandary conceded that he suffered no",
        "paragraph_id": "para_505"
      },
      {
        "text": "physical injury prior to agent Vahe’s involvement other than",
        "paragraph_id": "para_506"
      },
      {
        "text": "a fall on his bottom.3 Accordingly, Bandary failed to show",
        "paragraph_id": "para_507"
      },
      {
        "text": "a triable question of fact on his assertion that he suffered",
        "paragraph_id": "para_508"
      },
      {
        "text": "bodily injury before agent Vahe arrived.",
        "paragraph_id": "para_509"
      },
      {
        "text": "Because Delta is immune for all Bandary’s physical",
        "paragraph_id": "para_510"
      },
      {
        "text": "injuries, Bandary also cannot recover for any of his alleged",
        "paragraph_id": "para_511"
      },
      {
        "text": "emotional injuries under the Montreal Convention. See El",
        "paragraph_id": "para_512"
      },
      {
        "text": "Al Israel Airlines, Ltd. v. Tsui Yuan Tseng, 525 U.S. 155, 172",
        "paragraph_id": "para_513"
      },
      {
        "text": "(1999) (noting that Article 17 does not permit recovery of",
        "paragraph_id": "para_514"
      },
      {
        "text": "purely “psychic or psychosomatic injuries” absent “bodily",
        "paragraph_id": "para_515"
      },
      {
        "text": "injury”). Bandary cites no case in which a court has allowed",
        "paragraph_id": "para_516"
      },
      {
        "text": "a plaintiff to recover for purely emotional injuries when the",
        "paragraph_id": "para_517"
      },
      {
        "text": "airline is immune under the ATSA for all physical injuries.",
        "paragraph_id": "para_518"
      },
      {
        "text": "AFFIRMED.",
        "paragraph_id": "para_519"
      },
      {
        "text": "HIGGINSON, Circuit Judge, dissenting:",
        "paragraph_id": "para_520"
      },

        "text": "A jury awarded Atef Bandary $7,225,000 for physical",
        "paragraph_id": "para_521"
      },
      {
        "text": "and emotional injuries that occurred on a Delta Air Lines",
        "paragraph_id": "para_522"
      },
      {
        "text": "flight. Delta moved for a new trial on damages, which the",
        "paragraph_id": "para_523"
      },
      {
        "text": "district court granted. The district court also vacated the",
        "paragraph_id": "para_524"
      },
      {
        "text": "judgment on liability. Delta then moved for summary",
        "paragraph_id": "para_525"
      },
      {
        "text": "judgment, which the district court granted. Bandary",
        "paragraph_id": "para_526"
      },
      {
        "text": "appealed the grant of summary judgment. I depart from my",
        "paragraph_id": "para_527"
      },
      {
        "text": "3 Aside from his testimony in passing that his “bottom was hurt,”",
        "paragraph_id": "para_528"
      },

        "text": "Bandary did not provide any evidence of physical injury due to the fall",
        "paragraph_id": "para_529"

        "text": "on his bottom. This testimony is not sufficient to defeat summary",

      },
      {
        "text": "18 BANDARY V. DELTA AIR LINES, INC.",

      },
      {
        "text": "colleagues’ well-reasoned opinion in one, determinative",
        "paragraph_id": "para_533"
      },
      {
        "text": "respect: the district court erred in granting summary",
        "paragraph_id": "para_534"
      },
      {
        "text": "judgment to Delta, as the jury’s verdict demonstrates a",
        "paragraph_id": "para_535"
      },
      {
        "text": "genuine dispute of material fact as to whether Bandary acted",
        "paragraph_id": "para_536"
      },
      {
        "text": "suspiciously.",
        "paragraph_id": "para_537"
      },
      {
        "text": "Bandary sued Delta under Article 17 of the Montreal",
        "paragraph_id": "para_538"
      },
      {
        "text": "Convention based on injuries he suffered after a report to law",
        "paragraph_id": "para_539"
      },
      {
        "text": "enforcement while he was onboard a Delta flight. As my",
        "paragraph_id": "para_540"
      },
      {
        "text": "colleagues explain in more detail, the Aviation",
        "paragraph_id": "para_541"
      },
      {
        "text": "Transportation Security Act (“ATSA”) grants airlines and",
        "paragraph_id": "para_542"
      },
      {
        "text": "their employees immunity from civil liability for reporting",
        "paragraph_id": "para_543"
      },
      {
        "text": "suspicious behavior to law enforcement. See 49 U.S.C.",
        "paragraph_id": "para_544"
      },
      {
        "text": "§ 44941. After a four-day trial, a jury concluded that",
        "paragraph_id": "para_545"
      },
      {
        "text": "Bandary had not acted suspiciously. Indeed, a special",
        "paragraph_id": "para_546"
      },
      {
        "text": "verdict form asked the jury the following question: “By",
        "paragraph_id": "para_547"
      },
      {
        "text": "engaging Special Agent Vahe’s assistance, did Delta Air",
        "paragraph_id": "para_548"
      },
      {
        "text": "Lines make a voluntary disclosure of any suspicious",

        "text": "transaction relevant to a possible violation of law or",
        "paragraph_id": "para_550"
      },
      {
        "text": "regulation relating to a threat to aircraft or passenger",
        "paragraph_id": "para_551"
      },
      {
        "text": "safety[?]” The jury answered “No.” It went on to award",
        "paragraph_id": "para_552"
      },
      {
        "text": "Bandary substantial damages.",
        "paragraph_id": "para_553"
      },
      {
        "text": "At summary judgment, a court must view the evidence",
        "paragraph_id": "para_554"
      },
      {
        "text": "in the light most favorable to the non-movant. See Soc.",
        "paragraph_id": "para_555"
      },
      {
        "text": "Techs. LLC v. Apple Inc., 4 F.4th 811, 816 (9th Cir. 2021).",
        "paragraph_id": "para_556"
      },
      {
        "text": "Bandary himself testified at trial. He testified that he has",
        "paragraph_id": "para_557"
      },
      {
        "text": "numerous medical conditions: he is blind in one eye and",
        "paragraph_id": "para_558"
      },
      {
        "text": "suffers from HIV, diverticulitis, arthritis, osteoporosis, an",
        "paragraph_id": "para_559"
      },
      {
        "text": "enlarged prostate, and bowel movement syndrome. He said:",
        "paragraph_id": "para_560"
      },
      {
        "text": "“I am disabled, a senior citizen, I go to the bathroom very",
        "paragraph_id": "para_561"
      },
      {
        "text": "often, I’m HIV positive, I have a list of problems.” On this",
        "paragraph_id": "para_562"
      },
      {
        "text": "flight, he told the jury, he had to use the bathroom repeatedly",
        "paragraph_id": "para_563"
      },
      {
        "text": "in part because of diarrhea caused by taking his HIV",
        "paragraph_id": "para_564"
      },
      {
        "text": "medication without adequate food. See Abdallah v. Mesa",
        "paragraph_id": "para_565"
      },
      {
        "text": "BANDARY V. DELTA AIR LINES, INC. 19",
        "paragraph_id": "para_566"
      },
      {
        "text": "Air Grp., Inc., 83 F.4th 1006, 1018 (5th Cir. 2023) (“[U]sing",
        "paragraph_id": "para_567"
      },
      {
        "text": "the restroom” alone is not “so obviously suspicious” as to",
        "paragraph_id": "para_568"
      },
      {
        "text": "foreclose a genuine dispute of fact as to suspicion.). Bandary",
        "paragraph_id": "para_569"
      },
      {
        "text": "also testified that he was an immigrant from Egypt,",
        "paragraph_id": "para_570"
      },
      {
        "text": "consistent with his name and accent, and he believed he was",
        "paragraph_id": "para_571"
      },
      {
        "text": "racially profiled by other passengers and Delta staff who",
        "paragraph_id": "para_572"
      },
      {
        "text": "reported him. The jury additionally heard that Delta’s",
        "paragraph_id": "para_573"
      },
      {
        "text": "background paperwork on Bandary came back clear.",
        "paragraph_id": "para_574"
      },
      {
        "text": "At trial, other evidence of suspiciousness prior to Delta’s",
        "paragraph_id": "para_575"
      },
      {
        "text": "report to law enforcement required the jury to weigh the",
        "paragraph_id": "para_576"
      },
      {
        "text": "credibility of Bandary and several flight attendant witnesses.",
        "paragraph_id": "para_577"
      },
      {
        "text": "One flight attendant testified that she did not think Bandary",
        "paragraph_id": "para_578"
      },
      {
        "text": "was “acting out of line” or that he was suspicious, a terrorist,",
        "paragraph_id": "para_579"
      },
      {
        "text": "or a threat to passenger safety. She also stated that no",
        "paragraph_id": "para_580"
      },
      {
        "text": "passengers complained to her about Bandary. The jury was",
        "paragraph_id": "para_581"
      },
      {
        "text": "read another flight attendant’s deposition testimony",
        "paragraph_id": "para_582"
      },
      {
        "text": "explaining that she did not determine that Bandary was",
        "paragraph_id": "para_583"
      },
      {
        "text": "suspicious at any point during the flight. To the extent that",
        "paragraph_id": "para_584"
      },
      {
        "text": "Bandary and the flight attendants had contradictory",
        "paragraph_id": "para_585"
      },
      {
        "text": "testimony concerning whether Bandary screamed or",
        "paragraph_id": "para_586"
      },
      {
        "text": "physically threatened them, that further presents a question",
        "paragraph_id": "para_587"
      },
      {
        "text": "of fact. Although Bandary testified that he tried to retreat",
        "paragraph_id": "para_588"
      },
      {
        "text": "when one flight attendant was “violent and . . . so angry at",
        "paragraph_id": "para_589"
      },
      {
        "text": "me,” the flight attendant testified that Bandary hit one of her",
        "paragraph_id": "para_590"
      },
      {
        "text": "colleagues. Bandary and the flight attendants also disagreed",
        "paragraph_id": "para_591"
      },
      {
        "text": "on whether Bandary began screaming at a flight attendant",
        "paragraph_id": "para_592"
      },
      {
        "text": "who asked about his name. On this record, it was up to the",
        "paragraph_id": "para_593"
      },
      {
        "text": "jury to make credibility determinations and assess",
        "paragraph_id": "para_594"
      },
      {
        "text": "contradictory accounts of Bandary’s behavior.",
        "paragraph_id": "para_595"
      },
      {
        "text": "Considering this evidence, and above all the jury’s",
        "paragraph_id": "para_596"
      },
      {
        "text": "special verdict finding no suspiciousness, there was at least",
        "paragraph_id": "para_597"
      },
      {
        "text": "a triable issue of fact as to whether Bandary behaved",
        "paragraph_id": "para_598"
      },
      {
        "text": "suspiciously. See Anderson v. Liberty Lobby, Inc., 477 U.S.",
        "paragraph_id": "para_599"
      },
      {
        "text": "20 BANDARY V. DELTA AIR LINES, INC.",
        "paragraph_id": "para_600"
      },
      {
        "text": "242, 248 (1986) (“[S]ummary judgment will not lie . . . if the",
        "paragraph_id": "para_601"
      },
      {
        "text": "evidence is such that a reasonable jury could return a verdict",
        "paragraph_id": "para_602"
      },
      {
        "text": "for the nonmoving party[,]” that is, for Bandary, as the jury",
        "paragraph_id": "para_603"
      },
      {
        "text": "did here). Again, a jury did not only find that Bandary’s",
        "paragraph_id": "para_604"
      },
      {
        "text": "suspicion was debatable; the jury found that Bandary had not",
        "paragraph_id": "para_605"
      },
      {
        "text": "behaved suspiciously.1",
        "paragraph_id": "para_606"
      },
      {
        "text": "I greatly respect the decision of my colleagues, but I",
        "paragraph_id": "para_607"
      },
      {
        "text": "would reverse the district court’s order granting summary",
        "paragraph_id": "para_608"
      },
      {
        "text": "judgment to Delta on Bandary’s Montreal Convention claim.",
        "paragraph_id": "para_609"
      },
      {
        "text": "1 Separately, I note that under 49 U.S.C. § 46504, Bandary was",
        "paragraph_id": "para_610"
      },
      {
        "text": "criminally charged with “assault[ing] and intimidat[ing] a flight",
        "paragraph_id": "para_611"
      },
      {
        "text": "attendant[.]” Bandary testified in front of that jury, too, and was",
        "paragraph_id": "para_612"
      },
      {
        "text": "acquitted after a nine-day trial.",
