        "text": "Guidelines policy statement, U.S.S.G. § 1B1.13, precludes",

        "text": "courts from considering a nonretroactive change to the",
        "paragraph_id": "para_39"

        "text": "Guidelines as an extraordinary and compelling reason",

        "text": "denial of his motion for “compassionate release” under 18",

      },

        "text": "policy statement bars consideration of any nonretroactive",
        "paragraph_id": "para_107"
      },
      {
        "text": "amendments, alone or in combination. Therefore, we affirm.",
        "paragraph_id": "para_108"
      },
      {
        "text": "I. FACTUAL BACKGROUND",
        "paragraph_id": "para_109"
      },
      {
        "text": "A.",
        "paragraph_id": "para_110"
      },
      {
        "text": "Defendant James Troiano is currently serving a 24-year",
        "paragraph_id": "para_111"
      },
      {
        "text": "sentence and is scheduled to be released in 2027. In 2005,",
        "paragraph_id": "para_112"
      },
      {
        "text": "Troiano and a co-defendant robbed a liquor and convenience",
        "paragraph_id": "para_113"
      },
      {
        "text": "store in Waialua, Hawaii. Troiano took approximately",
        "paragraph_id": "para_114"
      },
      {
        "text": "$2,000 in cash from a safe and approximately $12,500 from",
        "paragraph_id": "para_115"
      },
      {
        "text": "an ATM machine. Troiano hit the store owner in the face",
        "paragraph_id": "para_116"
      },
      {
        "text": "with a handgun when he first entered the store and then held",
        "paragraph_id": "para_117"
      },
      {
        "text": "the owner at gun point. In April 2006, a jury convicted",
        "paragraph_id": "para_118"
      },
      {
        "text": "Troiano on four counts: (1) conspiracy to commit Hobbs Act",
        "paragraph_id": "para_119"
      },
      {
        "text": "robbery in violation of 18 U.S.C. §§ 1951–52; (2) Hobbs Act",
        "paragraph_id": "para_120"
      },
      {
        "text": "robbery in violation of 18 U.S.C. §§ 1951–52;",
        "paragraph_id": "para_121"
      },
      {
        "text": "(3) brandishing a firearm during commission of a crime of",
        "paragraph_id": "para_122"
      },
      {
        "text": "violence in violation of 18 U.S.C. § 924(c); and (4) being a",
        "paragraph_id": "para_123"
      },
      {
        "text": "felon in possession of a firearm in violation of 18 U.S.C.",
        "paragraph_id": "para_124"
      },
      {
        "text": "§§ 922(g)(1), 924(e).",
        "paragraph_id": "para_125"
      },
      {
        "text": "At sentencing, the district court adopted the Guidelines",
        "paragraph_id": "para_126"
      },
      {
        "text": "calculations in the Presentence Report (“PSR”). Applying",
        "paragraph_id": "para_127"
      },
      {
        "text": "U.S.S.G. § 2B3.1(a) (2005), Troiano’s base offense level for",
        "paragraph_id": "para_128"
      },
      {
        "text": "Count 1 was 20. He received an increase of two levels for",
        "paragraph_id": "para_129"
      },
      {
        "text": "causing bodily injury, § 2B3.1(b)(3) (2005), two levels for",
        "paragraph_id": "para_130"
      },
      {
        "text": "restraint of another person, § 2B3.1(b)(4)(B) (2005), and one",
        "paragraph_id": "para_131"
      },
      {
        "text": "level because the loss from the robbery exceeded $10,000,",
        "paragraph_id": "para_132"
      },
      {
        "text": "§ 2B3.1(b)(7)(B) (2005), resulting in an adjusted offense",
        "paragraph_id": "para_133"
      },
      {
        "text": "level of 25. He also received the career-offender",
        "paragraph_id": "para_134"
      },
      {
        "text": "enhancement based on two prior Hawaii state burglary",
        "paragraph_id": "para_135"
      },
      {
        "text": "convictions from 1992 and 1999, which, under the Guideline",
        "paragraph_id": "para_136"
      },
      {
        "text": "in effect at the time, recast his total offense level to 32. See",
        "paragraph_id": "para_137"
      },
      {
        "text": "U.S.S.G. § 4B1.1 (2005).",
        "paragraph_id": "para_138"
      },
      {

      },
      {
        "text": "For his criminal history score, Troiano received three",
        "paragraph_id": "para_140"
      },
      {
        "text": "points for each of the 1992 and 1999 burglary convictions",
        "paragraph_id": "para_141"
      },
      {
        "text": "(six points total), one point for each of two additional",
        "paragraph_id": "para_142"
      },
      {
        "text": "burglary convictions accompanying those two burglary",
        "paragraph_id": "para_143"
      },
      {
        "text": "convictions (two points total) pursuant to U.S.S.G.",
        "paragraph_id": "para_144"
      },
      {
        "text": "§ 4A1.1(f) (2005), three points for a 1989 controlled",
        "paragraph_id": "para_145"
      },
      {
        "text": "substance felony, two points for committing the offense",
        "paragraph_id": "para_146"
      },
      {
        "text": "while on parole pursuant to U.S.S.G. § 4A1.1(d) (2005), and",
        "paragraph_id": "para_147"
      },
      {
        "text": "one status point for committing the offense less than two",
        "paragraph_id": "para_148"
      },
      {
        "text": "years after his last release from prison pursuant to U.S.S.G.",
        "paragraph_id": "para_149"
      },
      {
        "text": "§ 4A1.1(e) (2005). The total of 14 criminal history points",
        "paragraph_id": "para_150"
      },
      {
        "text": "placed Troiano in criminal history category VI. See",
        "paragraph_id": "para_151"
      },
      {
        "text": "U.S.S.G. ch. 5, pt. A (sentencing table) (2005). The career-",
        "paragraph_id": "para_152"
      },
      {
        "text": "offender enhancement also placed him in category VI,",
        "paragraph_id": "para_153"
      },
      {
        "text": "independently of the criminal history points. See U.S.S.G.",
        "paragraph_id": "para_154"
      },
      {
        "text": "§ 4B1.1 (2005).",
        "paragraph_id": "para_155"
      },
      {
        "text": "The Guidelines range for a total offense level of 32 and",
        "paragraph_id": "para_156"
      },
      {
        "text": "criminal history category VI was (and still is) 210 to 262",
        "paragraph_id": "para_157"
      },
      {
        "text": "months. U.S.S.G. ch. 5, pt. A (2005). But the career-",
        "paragraph_id": "para_158"
      },
      {
        "text": "offender enhancement, combined with the § 924(c) firearm",
        "paragraph_id": "para_159"
      },
      {
        "text": "conviction, increased Troiano’s Guidelines range to 360",
        "paragraph_id": "para_160"
      },
      {
        "text": "months to life. See U.S.S.G. § 4B1.1(c)(2), (3) (2005). The",
        "paragraph_id": "para_161"
      },
      {
        "text": "district court varied downward and sentenced Troiano to 204",
        "paragraph_id": "para_162"
      },
      {
        "text": "months (17 years) in custody on Counts 1, 2, and 4, running",
        "paragraph_id": "para_163"
      },
      {
        "text": "concurrently, along with a consecutive seven-year",
        "paragraph_id": "para_164"
      },
      {
        "text": "mandatory minimum sentence on Count 3, the § 924(c)",
        "paragraph_id": "para_165"
      },
      {
        "text": "firearm charge, see 18 U.S.C. § 924(c)(1)(A)(ii). Troiano",
        "paragraph_id": "para_166"
      },
      {
        "text": "received a total sentence of 288 months (24 years).",
        "paragraph_id": "para_167"
      },
      {
        "text": "B.",
        "paragraph_id": "para_168"
      },
      {
        "text": "Since 2006, when Troiano was sentenced, the United",
        "paragraph_id": "para_169"
      },
      {
        "text": "States Sentencing Commission has enacted four",
        "paragraph_id": "para_170"
      },
      {
        "text": "amendments to the Guidelines that would significantly",
        "paragraph_id": "para_171"
      },
      {
        "text": "USA V. TROIANO 7",
        "paragraph_id": "para_172"
      },
      {
        "text": "shorten Troiano’s sentence—if all four amendments applied",
        "paragraph_id": "para_173"
      },
      {
        "text": "retroactively. But only one of those amendments is",
        "paragraph_id": "para_174"
      },
      {
        "text": "retroactive, and as we will explain, the retroactive",
        "paragraph_id": "para_175"
      },
      {
        "text": "amendment alone does not help Troiano.",
        "paragraph_id": "para_176"
      },
      {
        "text": "First, and most significantly, the Commission removed",
        "paragraph_id": "para_177"
      },
      {
        "text": "generic burglary from the list of crimes that count as",
        "paragraph_id": "para_178"
      },
      {
        "text": "predicate offenses for the career-offender enhancement. See",
        "paragraph_id": "para_179"
      },
      {
        "text": "U.S.S.G. § 4B1.2; U.S.S.G. app. C, amend. 798 (Supp.",
        "paragraph_id": "para_180"
      },
      {
        "text": "2016). This amendment is not retroactive. See U.S.S.G.",
        "paragraph_id": "para_181"
      },
      {
        "text": "§ 1B1.10(d). If it were retroactive, Troiano’s two state",
        "paragraph_id": "para_182"
      },
      {
        "text": "burglary convictions would no longer qualify him for the",
        "paragraph_id": "para_183"
      },
      {
        "text": "enhancement, and without the career-offender enhancement,",
        "paragraph_id": "para_184"
      },
      {
        "text": "Troiano would have a total offense level of 25, instead of 32.",
        "paragraph_id": "para_185"
      },
      {
        "text": "Second, the Commission increased the minimum loss",
        "paragraph_id": "para_186"
      },
      {
        "text": "threshold from $10,000 to $20,000. See U.S.S.G. app. C,",
        "paragraph_id": "para_187"
      },
      {
        "text": "amend. 791 (Supp. 2015). This amendment also is not",
        "paragraph_id": "para_188"
      },
      {
        "text": "retroactive. See U.S.S.G. § 1B1.10(d). If it were retroactive,",
        "paragraph_id": "para_189"
      },
      {
        "text": "the approximately $14,000 loss from the robbery would no",
        "paragraph_id": "para_190"
      },
      {
        "text": "longer trigger a one-point offense level increase. See",
        "paragraph_id": "para_191"
      },
      {
        "text": "U.S.S.G. § 2B3.1(b)(7)(A) (2005).",
        "paragraph_id": "para_192"
      },
      {
        "text": "Third, the Commission eliminated the provision",
        "paragraph_id": "para_193"
      },
      {
        "text": "requiring additional points for a defendant who commits a",
        "paragraph_id": "para_194"
      },
      {
        "text": "crime within two years’ release from prison. See U.S.S.G.",
        "paragraph_id": "para_195"
      },
      {
        "text": "app. C, amend. 742 (Supp. 2010). And, fourth, the",
        "paragraph_id": "para_196"
      },
      {
        "text": "Commission provided that a defendant receives one point",
        "paragraph_id": "para_197"
      },
      {
        "text": "(instead of two) if he commits a crime while under",
        "paragraph_id": "para_198"
      },
      {
        "text": "supervision and he already has more than seven points;",
        "paragraph_id": "para_199"
      },
      {
        "text": "otherwise, he receives zero points. See U.S.S.G. app. C,",
        "paragraph_id": "para_200"
      },
      {
        "text": "amend. 821, pt. A (Supp. 2023). The 2010 amendment is",
        "paragraph_id": "para_201"
      },
      {
        "text": "not retroactive, but the 2023 amendment is. See U.S.S.G.",
        "paragraph_id": "para_202"
      },
      {
        "text": "§ 1B1.10(d). Although the retroactive 2023 amendment",
        "paragraph_id": "para_203"
      },
      {
        "text": "reduces Troiano’s criminal history score by one point,",
        "paragraph_id": "para_204"
      },
      {

      {
        "text": "standing alone, it does not affect Troiano’s sentence because",
        "paragraph_id": "para_206"
      },
      {
        "text": "the career-offender enhancement independently places",
        "paragraph_id": "para_207"
      },
      {
        "text": "Troiano in criminal history category VI. See U.S.S.G.",
        "paragraph_id": "para_208"
      },
      {
        "text": "§ 4B1.1(b).",
        "paragraph_id": "para_209"
      },
      {
        "text": "If all four of these amendments were applied to Troiano,",
        "paragraph_id": "para_210"
      },
      {
        "text": "his total offense level for Counts 1, 2, and 4 would be 24,",
        "paragraph_id": "para_211"
      },
      {
        "text": "and his criminal history score of 12 would place him in",
        "paragraph_id": "para_212"
      },
      {
        "text": "category V, resulting in a Guidelines range of 92 to 115",
        "paragraph_id": "para_213"
      },
      {
        "text": "months. See U.S.S.G. ch. 5, pt. A. After adding the seven-",
        "paragraph_id": "para_214"
      },
      {
        "text": "year mandatory minimum consecutive sentence for his",
        "paragraph_id": "para_215"
      },
      {
        "text": "§ 924(c) conviction, see U.S.S.G. § 2K2.4(b), Troiano’s",
        "paragraph_id": "para_216"
      },
      {
        "text": "total Guidelines range today would be 176 to 199 months—",
        "paragraph_id": "para_217"
      },
      {
        "text": "significantly lower than his original Guidelines range of 360",
        "paragraph_id": "para_218"
      },
      {
        "text": "months to life and the 288-month sentence he is now serving.",
        "paragraph_id": "para_219"
      },
      {
        "text": "II. STANDARD OF REVIEW",
        "paragraph_id": "para_220"
      },
      {
        "text": "We review a district court’s ruling on a compassionate",
        "paragraph_id": "para_221"
      },
      {
        "text": "release motion under 18 U.S.C. § 3582(c)(1) for abuse of",
        "paragraph_id": "para_222"
      },
      {
        "text": "discretion. United States v. Wright, 46 F.4th 938, 944 (9th",
        "paragraph_id": "para_223"
      },
      {
        "text": "Cir. 2022). “A district court may abuse its discretion if it",
        "paragraph_id": "para_224"
      },
      {
        "text": "does not apply the correct law or if it rests its decision on a",
        "paragraph_id": "para_225"
      },
      {
        "text": "clearly erroneous finding of material fact.” United States v.",
        "paragraph_id": "para_226"
      },
      {
        "text": "Dunn, 728 F.3d 1151, 1155 (9th Cir. 2013) (quoting United",
        "paragraph_id": "para_227"
      },
      {
        "text": "States v. Lightfoot, 626 F.3d 1092, 1094 (9th Cir. 2010)).",
        "paragraph_id": "para_228"
      },
      {
        "text": "The meaning of a statute is a question of law which we",
        "paragraph_id": "para_229"
      },
      {
        "text": "review de novo. Comcast of Sacramento I, LLC v.",
        "paragraph_id": "para_230"
      },
      {
        "text": "Sacramento Metro. Cable Television Comm’n, 923 F.3d",
        "paragraph_id": "para_231"
      },
      {
        "text": "1163, 1168 (9th Cir. 2019). We also review the",
        "paragraph_id": "para_232"
      },
      {
        "text": "interpretation of the Sentencing Guidelines de novo. United",
        "paragraph_id": "para_233"
      },
      {
        "text": "States v. Riewe, 165 F.3d 727, 728 (9th Cir. 1999).",
        "paragraph_id": "para_234"
      },
      {

      {
        "text": "III. DISCUSSION",
        "paragraph_id": "para_236"
      },
      {
        "text": "A district court has discretion to grant a motion for",
        "paragraph_id": "para_237"
      },
      {
        "text": "sentence reduction under the “compassionate release”",
        "paragraph_id": "para_238"
      },
      {
        "text": "provision, 18 U.S.C. § 3582(c)(1)(A)(i), if it finds that three",
        "paragraph_id": "para_239"
      },
      {
        "text": "requirements are met: (1) “extraordinary and compelling",
        "paragraph_id": "para_240"
      },
      {
        "text": "reasons” warrant a sentence reduction; (2) the reduction is",
        "paragraph_id": "para_241"
      },
      {
        "text": "“consistent with applicable policy statements issued by the",
        "paragraph_id": "para_242"
      },
      {
        "text": "Sentencing Commission”; and (3) the sentence reduction is",
        "paragraph_id": "para_243"
      },
      {
        "text": "“warranted under the particular circumstances of the case”",
        "paragraph_id": "para_244"
      },
      {
        "text": "considering the factors in 18 U.S.C. § 3553(a). Wright, 46",
        "paragraph_id": "para_245"
      },
      {
        "text": "F.4th at 945 (citation modified). The district court may deny",
        "paragraph_id": "para_246"
      },
      {
        "text": "the defendant’s motion “if a defendant fails to satisfy any of",
        "paragraph_id": "para_247"
      },
      {
        "text": "these” requirements. Id.",
        "paragraph_id": "para_248"
      },
      {
        "text": "In 2024, Troiano filed a motion to reduce his sentence",
        "paragraph_id": "para_249"
      },
      {
        "text": "under 18 U.S.C. § 3582(c)(1)(A)(i). Troiano raised only one",
        "paragraph_id": "para_250"
      },
      {
        "text": "argument: his sentence was “unusually long” and “grossly",
        "paragraph_id": "para_251"
      },
      {
        "text": "disproportionate” when compared to the sentence that",
        "paragraph_id": "para_252"
      },
      {
        "text": "“would result from using the far lower guideline range that",
        "paragraph_id": "para_253"
      },
      {
        "text": "applies to him today.” The district court denied Troiano’s",
        "paragraph_id": "para_254"
      },
      {
        "text": "motion because (1) he did not show he was serving an",
        "paragraph_id": "para_255"
      },
      {
        "text": "“unusually long sentence” within the meaning of the",
        "paragraph_id": "para_256"
      },
      {
        "text": "applicable policy statement, U.S.S.G. § 1B1.13(b)(6)",
        "paragraph_id": "para_257"
      },
      {
        "text": "(“Policy Statement”), given that he received a below-",
        "paragraph_id": "para_258"
      },
      {
        "text": "guidelines sentence, and (2) the Policy Statement prohibits",
        "paragraph_id": "para_259"
      },
      {
        "text": "courts from granting compassionate release based on",
        "paragraph_id": "para_260"
      },
      {
        "text": "nonretroactive Guideline amendments.",
        "paragraph_id": "para_261"
      },
      {
        "text": "On appeal, Troiano primarily contends that 28 U.S.C.",
        "paragraph_id": "para_262"
      },
      {
        "text": "§ 994(t), the statute that the Policy Statement implements,",
        "paragraph_id": "para_263"
      },
      {
        "text": "does not give the Commission the authority to prohibit",
        "paragraph_id": "para_264"
      },
      {
        "text": "courts from considering nonretroactive Guideline",
        "paragraph_id": "para_265"
      },
      {
        "text": "amendments, and therefore, the Policy Statement is invalid.",
        "paragraph_id": "para_266"
      },
      {
        "text": "To understand the arguments Troiano makes in support of",
        "paragraph_id": "para_267"
      },
      {

        "text": "his interpretation of the statute and our reasons for rejecting",
        "paragraph_id": "para_269"
      },
      {
        "text": "that interpretation, it is helpful to understand the history of",
        "paragraph_id": "para_270"
      },
      {
        "text": "the statute, Policy Statement, and related precedents. We",
        "paragraph_id": "para_271"
      },
      {
        "text": "first provide that background, and then we address Troiano’s",
        "paragraph_id": "para_272"
      },
      {
        "text": "arguments.",
        "paragraph_id": "para_273"
      },
      {
        "text": "A.",
        "paragraph_id": "para_274"
      },
      {
        "text": "As noted, under 18 U.S.C. § 3582(c)(1)(A)(i), a district",
        "paragraph_id": "para_275"
      },
      {
        "text": "court may grant a compassionate release motion only if it",
        "paragraph_id": "para_276"
      },
      {
        "text": "finds that “extraordinary and compelling reasons warrant” a",
        "paragraph_id": "para_277"
      },
      {
        "text": "sentence reduction and that “such a reduction is consistent",
        "paragraph_id": "para_278"
      },
      {
        "text": "with applicable policy statements issued by the Sentencing",
        "paragraph_id": "para_279"
      },
      {
        "text": "Commission.” 18 U.S.C. § 3582(c)(1)(A), (A)(i).",
        "paragraph_id": "para_280"
      },
      {
        "text": "Congress did not define “extraordinary and compelling.”",
        "paragraph_id": "para_281"
      },
      {
        "text": "See id. Rather, Congress authorized the Commission to",
        "paragraph_id": "para_282"
      },
      {
        "text": "promulgate policy statements that “describe what should be",
        "paragraph_id": "para_283"
      },
      {
        "text": "considered extraordinary and compelling",
        "paragraph_id": "para_284"
      },
      {
        "text": "reasons . . . including the criteria to be applied and a list of",
        "paragraph_id": "para_285"
      },
      {
        "text": "specific examples.” 28 U.S.C. § 994(t).",
        "paragraph_id": "para_286"
      },
      {
        "text": "Originally, the compassionate release statute authorized",
        "paragraph_id": "para_287"
      },
      {
        "text": "only the Director of the Federal Bureau of Prisons (“BOP”)",
        "paragraph_id": "para_288"
      },
      {
        "text": "to file a § 3582(c)(1)(A) motion on the defendant’s behalf.",
        "paragraph_id": "para_289"
      },
      {
        "text": "See United States v. Keller, 2 F.4th 1278, 1281 (9th Cir.",
        "paragraph_id": "para_290"
      },
      {
        "text": "2021) (per curiam). Accordingly, when the Commission",
        "paragraph_id": "para_291"
      },
      {
        "text": "first issued a policy statement defining “extraordinary and",
        "paragraph_id": "para_292"
      },
      {
        "text": "compelling reasons,” it addressed only compassionate",
        "paragraph_id": "para_293"
      },
      {
        "text": "release motions filed by the BOP Director. U.S.S.G.",
        "paragraph_id": "para_294"
      },
      {
        "text": "§ 1B1.13 (2006). The Commission updated the policy",
        "paragraph_id": "para_295"
      },
      {
        "text": "statement in 2007, 2010, 2016, and 2018, but the policy",
        "paragraph_id": "para_296"
      },
      {
        "text": "statement continued to address only motions filed by the",
        "paragraph_id": "para_297"
      },
      {
        "text": "BOP Director. U.S.S.G. § 1B1.13 (2018) (“2018 § 1B1.13",
        "paragraph_id": "para_298"
      },
      {
        "text": "Policy Statement”).",
        "paragraph_id": "para_299"
      },
      {

      {
        "text": "When Congress passed the First Step Act in late",
        "paragraph_id": "para_301"
      },
      {
        "text": "December 2018, it amended the compassionate release",
        "paragraph_id": "para_302"
      },
      {
        "text": "statute to authorize a defendant to file such a motion himself.",
        "paragraph_id": "para_303"
      },
      {
        "text": "First Step Act of 2018, Pub. L. No. 115-391, § 603(b)(1),",
        "paragraph_id": "para_304"
      },
      {
        "text": "132 Stat. 5194, 5239 (codified at 18 U.S.C.",
        "paragraph_id": "para_305"
      },
      {
        "text": "§ 3582(c)(1)(A)). However, the Commission lost a quorum",
        "paragraph_id": "para_306"
      },
      {
        "text": "shortly after the First Step Act went into effect, and it did not",
        "paragraph_id": "para_307"
      },
      {
        "text": "update the 2018 § 1B1.13 Policy Statement to address this",
        "paragraph_id": "para_308"
      },
      {
        "text": "change. See Rutherford v. United States, 146 S. Ct. 1320,",
        "paragraph_id": "para_309"
      },
      {
        "text": "1328 (2026).",
        "paragraph_id": "para_310"
      },
      {
        "text": "Consequently, when defendants started filing their own",
        "paragraph_id": "para_311"
      },
      {
        "text": "motions for compassionate release, courts needed to decide:",
        "paragraph_id": "para_312"
      },
      {
        "text": "Was the 2018 § 1B1.13 Policy Statement’s definition of",
        "paragraph_id": "para_313"
      },
      {
        "text": "“extraordinary and compelling reasons” applicable to",
        "paragraph_id": "para_314"
      },
      {
        "text": "motions brought by defendants or only motions brought by",
        "paragraph_id": "para_315"
      },
      {
        "text": "the BOP Director?1 We held that the 2018 § 1B1.13 Policy",
        "paragraph_id": "para_316"
      },
      {
        "text": "Statement was not applicable to defendant-filed motions.",
        "paragraph_id": "para_317"
      },
      {
        "text": "United States v. Aruda, 993 F.3d 797, 802 (9th Cir. 2021)",

      },

      },
      {
        "text": "1096 n.3, 1098 (9th Cir. 2022) (holding that, in the absence",
        "paragraph_id": "para_325"
      },
      {
        "text": "of a binding policy statement to the contrary, a district court",
        "paragraph_id": "para_326"
      },
      {
        "text": "could “consider non-retroactive changes in sentencing law,",
        "paragraph_id": "para_327"
      },
      {
        "text": "in combination with other factors particular to the individual",
        "paragraph_id": "para_328"
      },
      {

        "text": "§ 1B1.13, cmt. n.1(A)–(D) (2018).",
        "paragraph_id": "para_333"
      },
      {
        "text": "12 USA V. TROIANO",
        "paragraph_id": "para_334"
      },
      {
        "text": "defendant”), abrogated by Rutherford, 146 S. Ct. 1320;",
        "paragraph_id": "para_335"
      },
      {
        "text": "United States v. Roper, 72 F.4th 1097, 1101–02 (9th Cir.",
        "paragraph_id": "para_336"
      },
      {
        "text": "2023) (holding that a district court could consider changes in",
        "paragraph_id": "para_337"
      },
      {
        "text": "decisional law), abrogated in part by Fernandez v. United",
        "paragraph_id": "para_338"
      },
      {
        "text": "States, 146 S. Ct. 1292 (2026).",
        "paragraph_id": "para_339"
      },
      {
        "text": "In 2023, however, the Commission amended § 1B1.13",
        "paragraph_id": "para_340"
      },
      {
        "text": "“to govern motions by a defendant.” United States v. Bryant,",
        "paragraph_id": "para_341"
      },
      {
        "text": "144 F.4th 1119, 1124 (9th Cir. 2025); U.S.S.G. § 1B1.13",
        "paragraph_id": "para_342"
      },
      {
        "text": "(2023). Thus, to the extent Aruda and related cases were",
        "paragraph_id": "para_343"
      },
      {
        "text": "premised on the fact that there was no policy statement that",
        "paragraph_id": "para_344"
      },
      {
        "text": "governed defendant-filed motions, they have been",
        "paragraph_id": "para_345"
      },
      {
        "text": "superseded by the 2023 amendment. See id. at 1124 n.1",
        "paragraph_id": "para_346"
      },
      {
        "text": "(noting that “Aruda has therefore been superseded to the",
        "paragraph_id": "para_347"
      },
      {
        "text": "extent that it sets out a different rule for motions filed by",
        "paragraph_id": "para_348"
      },
      {
        "text": "defendants after the effective date of the 2023 revisions to",
        "paragraph_id": "para_349"
      },
      {
        "text": "§ 1B1.13”). Today, courts are bound by the § 1B1.13 Policy",
        "paragraph_id": "para_350"
      },
      {
        "text": "Statement in deciding all motions for sentence reduction",
        "paragraph_id": "para_351"
      },
      {
        "text": "under § 3582(c)(1)(A). Id. at 1124. “If a defendant cannot",
        "paragraph_id": "para_352"
      },
      {
        "text": "show ‘extraordinary and compelling reasons’ as defined in",
        "paragraph_id": "para_353"
      },
      {
        "text": "[the Policy Statement], then he is ineligible for” a sentence",
        "paragraph_id": "para_354"
      },
      {
        "text": "reduction under § 3582(c)(1)(A). Id.",
        "paragraph_id": "para_355"
      },
      {
        "text": "As relevant, subsection (b)(6) of the current § 1B1.13",
        "paragraph_id": "para_356"
      },
      {
        "text": "Policy Statement provides:",
        "paragraph_id": "para_357"
      },
      {
        "text": "Extraordinary and compelling reasons exist",
        "paragraph_id": "para_358"
      },
      {
        "text": "under any of the following circumstances or",
        "paragraph_id": "para_359"
      },
      {
        "text": "a combination thereof:",
        "paragraph_id": "para_360"
      },
      {
        "text": ". . . .",
        "paragraph_id": "para_361"
      },
      {
        "text": "(6) Unusually Long Sentence.—If a",
        "paragraph_id": "para_362"
      },
      {
        "text": "defendant received an unusually long",
        "paragraph_id": "para_363"
      },
      {
        "text": "sentence and has served at least 10 years of",
        "paragraph_id": "para_364"
      },
      {
        "text": "the term of imprisonment, a change in the law",
        "paragraph_id": "para_365"
      },
      {
        "text": "USA V. TROIANO 13",
        "paragraph_id": "para_366"
      },
      {
        "text": "(other than an amendment to the Guidelines",
        "paragraph_id": "para_367"
      },
      {
        "text": "Manual that has not been made retroactive)",
        "paragraph_id": "para_368"
      },
      {
        "text": "may be considered in determining whether",
        "paragraph_id": "para_369"
      },
      {
        "text": "the defendant presents an extraordinary and",
        "paragraph_id": "para_370"
      },
      {
        "text": "compelling reason, but only where such",
        "paragraph_id": "para_371"
      },
      {
        "text": "change would produce a gross disparity",
        "paragraph_id": "para_372"
      },
      {
        "text": "between the sentence being served and the",
        "paragraph_id": "para_373"
      },
      {
        "text": "sentence likely to be imposed at the time the",
        "paragraph_id": "para_374"
      },
      {
        "text": "motion is filed, and after full consideration of",
        "paragraph_id": "para_375"
      },
      {
        "text": "the defendant’s individualized",
        "paragraph_id": "para_376"
      },
      {
        "text": "circumstances.",
        "paragraph_id": "para_377"
      },
      {
        "text": "U.S.S.G. § 1B1.13(b) (emphasis added).",
        "paragraph_id": "para_378"
      },
      {
        "text": "And, subsection (c) of the § 1B1.13 Policy Statement",
        "paragraph_id": "para_379"
      },
      {
        "text": "provides:",
        "paragraph_id": "para_380"
      },
      {
        "text": "Except as provided in subsection (b)(6), a",
        "paragraph_id": "para_381"
      },
      {
        "text": "change in the law (including an amendment",
        "paragraph_id": "para_382"
      },
      {
        "text": "to the Guidelines Manual that has not been",
        "paragraph_id": "para_383"
      },
      {
        "text": "made retroactive) shall not be considered for",
        "paragraph_id": "para_384"
      },
      {
        "text": "purposes of determining whether an",
        "paragraph_id": "para_385"
      },
      {
        "text": "extraordinary and compelling reason exists",
        "paragraph_id": "para_386"
      },
      {
        "text": "under this policy statement. However, if a",
        "paragraph_id": "para_387"
      },
      {
        "text": "defendant otherwise establishes that",
        "paragraph_id": "para_388"
      },
      {
        "text": "extraordinary and compelling reasons",
        "paragraph_id": "para_389"
      },
      {
        "text": "warrant a sentence reduction under this",
        "paragraph_id": "para_390"
      },
      {
        "text": "policy statement, a change in the law",
        "paragraph_id": "para_391"
      },
      {
        "text": "(including an amendment to the Guidelines",
        "paragraph_id": "para_392"
      },
      {
        "text": "Manual that has not been made retroactive)",
        "paragraph_id": "para_393"
      },
      {
        "text": "may be considered for purposes of",
        "paragraph_id": "para_394"
      },
      {
        "text": "determining the extent of any such reduction.",
        "paragraph_id": "para_395"
      },
      {
        "text": "14 USA V. TROIANO",
        "paragraph_id": "para_396"
      },
      {
        "text": "U.S.S.G. § 1B1.13(c) (emphasis added).2",
        "paragraph_id": "para_397"
      },
      {
        "text": "B.",
        "paragraph_id": "para_398"
      },
      {
        "text": "Troiano argues that subsections (b)(6) and (c) of the",
        "paragraph_id": "para_399"
      },
      {
        "text": "§ 1B1.13 Policy Statement “exceed[] the authority that",
        "paragraph_id": "para_400"
      },
      {
        "text": "Congress delegated to the Sentencing Commission in [28]",
        "paragraph_id": "para_401"
      },
      {
        "text": "U.S.C. § 994(t)” and are therefore invalid. In his view,",
        "paragraph_id": "para_402"
      },
      {
        "text": "because § 994(t) expressly grants the Commission authority",
        "paragraph_id": "para_403"
      },
      {
        "text": "only to “describe what should be considered extraordinary",
        "paragraph_id": "para_404"
      },
      {
        "text": "and compelling reasons,” § 994(t) does not grant the",
        "paragraph_id": "para_405"
      },
      {
        "text": "Commission authority to specify what may not be",
        "paragraph_id": "para_406"
      },
      {
        "text": "considered “extraordinary and compelling.” Thus, he argues",
        "paragraph_id": "para_407"
      },
      {
        "text": "that the Commission lacked the statutory authority to bar",
        "paragraph_id": "para_408"
      },
      {
        "text": "district courts from considering a nonretroactive amendment",
        "paragraph_id": "para_409"
      },
      {
        "text": "to the Sentencing Guidelines (or any other particular",
        "paragraph_id": "para_410"
      },
      {
        "text": "circumstance that might be “extraordinary and compelling”).",
        "paragraph_id": "para_411"
      },
      {
        "text": "The Government argues that § 994(t) gives the Commission",
        "paragraph_id": "para_412"
      },
      {
        "text": "authority to define the scope of “extraordinary and",
        "paragraph_id": "para_413"
      },
      {
        "text": "compelling reasons” both by specifying what is included and",
        "paragraph_id": "para_414"
      },
      {
        "text": "by specifying what is excluded.",
        "paragraph_id": "para_415"
      },
      {
        "text": "The Supreme Court recently considered the scope of the",
        "paragraph_id": "para_416"
      },
      {
        "text": "Commission’s authority under § 994(t) to define",
        "paragraph_id": "para_417"
      },
      {
        "text": "“extraordinary and compelling reasons” in Rutherford, 146",
        "paragraph_id": "para_418"
      },
      {
        "text": "S. Ct. at 1320. Accordingly, we start by considering whether",
        "paragraph_id": "para_419"
      },
      {
        "text": "that decision controls here. In Rutherford, the issue was",
        "paragraph_id": "para_420"
      },
      {
        "text": "whether a nonretroactive statutory sentencing change can",
        "paragraph_id": "para_421"
      },
      {
        "text": "serve as an “extraordinary and compelling” reason that",
        "paragraph_id": "para_422"
      },
      {
        "text": "warrants a sentence reduction under § 3582(c)(1)(A)(i).",
        "paragraph_id": "para_423"
      },
      {
        "text": "Relying on contemporaneous dictionary definitions, the",
        "paragraph_id": "para_424"
      },
      {
        "text": "2 This Policy Statement applies to § 3582(c)(1)(A) compassionate",
        "paragraph_id": "para_425"
      },
      {
        "text": "release motions filed after November 1, 2023. Bryant, 144 F.4th at 1124",
        "paragraph_id": "para_426"
      },
      {
        "text": "n.1; U.S.S.G. app. C, amend. 814 (Supp. 2023). This includes Troiano’s",
        "paragraph_id": "para_427"
      },
      {
        "text": "motion, which he filed in June 2024.",
        "paragraph_id": "para_428"
      },
      {
        "text": "USA V. TROIANO 15",
        "paragraph_id": "para_429"
      },
      {
        "text": "Supreme Court concluded that “‘extraordinary and",
        "paragraph_id": "para_430"
      },
      {
        "text": "compelling’ reasons for compassionate release are those that",
        "paragraph_id": "para_431"
      },
      {
        "text": "are especially unusual and convincing.” Id. at 1330. The",
        "paragraph_id": "para_432"
      },
      {
        "text": "Supreme Court further concluded that a disparity created by",
        "paragraph_id": "para_433"
      },
      {
        "text": "a nonretroactive statutory change “is neither an",
        "paragraph_id": "para_434"
      },
      {
        "text": "‘extraordinary’ nor a ‘compelling’ reason that warrants a",
        "paragraph_id": "para_435"
      },
      {
        "text": "reduction in sentence” because the disparity “is an",
        "paragraph_id": "para_436"
      },
      {
        "text": "unexceptional feature of a system in which nonretroactivity",
        "paragraph_id": "para_437"
      },
      {
        "text": "is the default” and “reflects Congress’s deliberate choice to",
        "paragraph_id": "para_438"
      },
      {
        "text": "extend relief to some prisoners and not others.” Id. at 1330,",
        "paragraph_id": "para_439"
      },
      {
        "text": "1332. Because such a disparity cannot be “extraordinary” or",
        "paragraph_id": "para_440"
      },
      {
        "text": "“compelling” under § 3582(c)(1)(A)(i), the Commission",
        "paragraph_id": "para_441"
      },
      {
        "text": "lacked authority under § 994(t) to define “extraordinary and",
        "paragraph_id": "para_442"
      },
      {
        "text": "compelling” to include such a disparity. Id. at 1334-35.",
        "paragraph_id": "para_443"
      },
      {
        "text": "Therefore, the Court held, subsection (b)(6) of the Policy",
        "paragraph_id": "para_444"
      },
      {
        "text": "Statement is invalid to the extent it allows district courts to",
        "paragraph_id": "para_445"
      },
      {
        "text": "consider the disparity created by a nonretroactive statutory",
        "paragraph_id": "para_446"
      },
      {
        "text": "sentencing amendment as a reason for compassion release.",
        "paragraph_id": "para_447"
      },
      {
        "text": "Id.",
        "paragraph_id": "para_448"
      },
      {
        "text": "Rutherford’s holding does not squarely control here",
        "paragraph_id": "para_449"
      },
      {
        "text": "because it addressed statutory amendments enacted by",
        "paragraph_id": "para_450"
      },
      {
        "text": "Congress, not Guidelines amendments enacted by the",
        "paragraph_id": "para_451"
      },
      {
        "text": "Commission. Further, Troiano’s challenge presents a",
        "paragraph_id": "para_452"
      },
      {
        "text": "converse issue: in Rutherford, the question was whether the",
        "paragraph_id": "para_453"
      },
      {
        "text": "Commission exceeded its authority by permitting courts to",
        "paragraph_id": "para_454"
      },
      {
        "text": "consider a disparity created by a nonretroactive statutory",
        "paragraph_id": "para_455"
      },
      {
        "text": "amendment, id. at 1326, whereas here, the question is",
        "paragraph_id": "para_456"
      },
      {
        "text": "whether the Commission exceeded its authority by",
        "paragraph_id": "para_457"
      },
      {
        "text": "prohibiting courts from considering a disparity created by a",
        "paragraph_id": "para_458"
      },
      {
        "text": "nonretroactive Guidelines amendment. Still, we are of",
        "paragraph_id": "para_459"
      },
      {
        "text": "course bound by the Court’s reasoning, and to the extent that",
        "paragraph_id": "para_460"
      },
      {
        "text": "it applies in this case, we abide by it.",
        "paragraph_id": "para_461"
      },
      {
        "text": "16 USA V. TROIANO",
        "paragraph_id": "para_462"
      },
      {
        "text": "We turn to Troiano’s textual argument. Section 994(t)",
        "paragraph_id": "para_463"
      },
      {
        "text": "states: “The Commission, in promulgating general policy",
        "paragraph_id": "para_464"
      },
      {
        "text": "statements regarding the sentencing modification provisions",
        "paragraph_id": "para_465"
      },
      {
        "text": "in [the compassionate release statute,] section 3582(c)(1)(A)",
        "paragraph_id": "para_466"
      },
      {
        "text": "of title 18, shall describe what should be considered",
        "paragraph_id": "para_467"
      },
      {
        "text": "extraordinary and compelling reasons for sentence",
        "paragraph_id": "para_468"
      },
      {
        "text": "reduction, including the criteria to be applied and a list of",
        "paragraph_id": "para_469"
      },
      {
        "text": "specific examples.” Congress provided only one express",
        "paragraph_id": "para_470"
      },
      {
        "text": "limitation: “Rehabilitation of the defendant alone shall not",
        "paragraph_id": "para_471"
      },
      {
        "text": "be considered an extraordinary and compelling reason.” Id.",
        "paragraph_id": "para_472"
      },
      {
        "text": "Through § 994(t), “Congress has empowered the",
        "paragraph_id": "para_473"
      },
      {
        "text": "Commission to ‘give meaning’ to the compassionate release",
        "paragraph_id": "para_474"
      },
      {
        "text": "provision by identifying the circumstances that constitute",
        "paragraph_id": "para_475"
      },
      {
        "text": "‘extraordinary and compelling’ reasons for release.”",
        "paragraph_id": "para_476"
      },
      {
        "text": "Rutherford, 146 S. Ct. at 1334 (quoting Loper Bright Enters.",
        "paragraph_id": "para_477"
      },
      {
        "text": "v. Raimondo, 603 U.S. 369, 394 (2024)). “When the best",
        "paragraph_id": "para_478"
      },
      {
        "text": "reading of a statute is that it delegates discretionary",
        "paragraph_id": "para_479"
      },
      {
        "text": "authority,” our role is to “fix[] the boundaries of the",
        "paragraph_id": "para_480"
      },
      {
        "text": "delegated authority, and ensur[e] the agency has engaged in",
        "paragraph_id": "para_481"
      },
      {
        "text": "reasoned decisionmaking within those boundaries.” Loper",
        "paragraph_id": "para_482"
      },
      {
        "text": "Bright, 603 U.S. at 395 (citation modified); see also",
        "paragraph_id": "para_483"
      },
      {
        "text": "Rutherford, 146 S. Ct. at 1334 (“[T]he Commission’s",
        "paragraph_id": "para_484"
      },
      {
        "text": "interpretation must land within the statutory goalposts, no",
        "paragraph_id": "para_485"
      },
      {
        "text": "matter how wide they might be.”).",
        "paragraph_id": "para_486"
      },
      {
        "text": "Recall that in Troiano’s view, because § 994(t) (the",
        "paragraph_id": "para_487"
      },
      {
        "text": "statutory source of the Commission’s authority) expressly",
        "paragraph_id": "para_488"
      },
      {
        "text": "directs the Commission to describe what “should be”",
        "paragraph_id": "para_489"
      },
      {
        "text": "considered extraordinary and compelling reasons, the",
        "paragraph_id": "para_490"
      },
      {
        "text": "Commission lacks statutory authority to specify what cannot",
        "paragraph_id": "para_491"
      },
      {
        "text": "be considered extraordinary and compelling reasons. But",
        "paragraph_id": "para_492"
      },
      {
        "text": "Congress itself—in § 994(t)—partly defined “extraordinary",
        "paragraph_id": "para_493"
      },
      {
        "text": "and compelling reasons” by doing just that—it specified that",
        "paragraph_id": "para_494"
      },
      {
        "text": "rehabilitation alone cannot be considered an extraordinary",
        "paragraph_id": "para_495"
      },
      {
        "text": "USA V. TROIANO 17",
        "paragraph_id": "para_496"
      },
      {
        "text": "and compelling reason. Congress’s use of an express",
        "paragraph_id": "para_497"
      },
      {
        "text": "exclusion in the authorizing statute suggests that the",
        "paragraph_id": "para_498"
      },
      {
        "text": "Commission may also define “extraordinary and",
        "paragraph_id": "para_499"
      },
      {
        "text": "compelling” by exclusion. Indeed, it is common to define or",
        "paragraph_id": "para_500"
      },
      {
        "text": "clarify a term by specifying what it is not. See, e.g., 47",
        "paragraph_id": "para_501"
      },
      {
        "text": "U.S.C. § 551(a)(2)(A) (“[T]he term ‘personally identifiable",
        "paragraph_id": "para_502"
      },
      {
        "text": "information’ does not include any record of aggregate data",
        "paragraph_id": "para_503"
      },
      {
        "text": "which does not identify particular persons[.]”). If Congress",
        "paragraph_id": "para_504"
      },
      {
        "text": "preferred that the Commission avoid defining “extraordinary",
        "paragraph_id": "para_505"
      },
      {
        "text": "and compelling” by exclusion, it could have said so but did",
        "paragraph_id": "para_506"
      },
      {
        "text": "not.",
        "paragraph_id": "para_507"
      },
      {
        "text": "The authority Congress gave the Commission to define",
        "paragraph_id": "para_508"
      },
      {
        "text": "“extraordinary and compelling” in § 994(t) resembles the",
        "paragraph_id": "para_509"
      },
      {
        "text": "authority Congress gave the Commission in other statutes,",
        "paragraph_id": "para_510"
      },
      {
        "text": "such as 28 U.S.C. § 994(u). We upheld the Commission",
        "paragraph_id": "para_511"
      },
      {
        "text": "policy statement that implements § 994(u), U.S.S.G.",
        "paragraph_id": "para_512"
      },
      {
        "text": "§ 1B1.10, in United States v. Tercero, 734 F.3d 979 (9th Cir.",
        "paragraph_id": "para_513"
      },
      {
        "text": "2013). Section 994(u) provides:",
        "paragraph_id": "para_514"
      },
      {
        "text": "If the Commission reduces the term of",
        "paragraph_id": "para_515"
      },
      {
        "text": "imprisonment recommended in the",
        "paragraph_id": "para_516"
      },
      {
        "text": "guidelines applicable to a particular offense",
        "paragraph_id": "para_517"
      },
      {
        "text": "or category of offenses, it shall specify in",
        "paragraph_id": "para_518"
      },
      {
        "text": "what circumstances and by what amount the",
        "paragraph_id": "para_519"
      },
      {
        "text": "sentences of prisoners serving terms of",
        "paragraph_id": "para_520"
      },
      {
        "text": "imprisonment for the offense may be",
        "paragraph_id": "para_521"
      },
      {
        "text": "reduced.",
        "paragraph_id": "para_522"
      },
      {
        "text": "(Emphasis added.) The policy statement that implements",
        "paragraph_id": "para_523"
      },
      {
        "text": "§ 994(u) provides, in relevant part:",
        "paragraph_id": "para_524"
      },
      {
        "text": "[T]he court shall not reduce the defendant’s",
        "paragraph_id": "para_525"
      },
      {
        "text": "term of imprisonment under 18 U.S.C.",
        "paragraph_id": "para_526"
      },
      {
        "text": "18 USA V. TROIANO",
        "paragraph_id": "para_527"
      },
      {
        "text": "§ 3582(c)(2) and this policy statement to a",
        "paragraph_id": "para_528"
      },
      {
        "text": "term that is less than the minimum of the",
        "paragraph_id": "para_529"
      },
      {
        "text": "amended guideline range determined under",
        "paragraph_id": "para_530"
      },
      {
        "text": "subdivision (1) of this subsection.",
        "paragraph_id": "para_531"
      },
      {
        "text": "U.S.S.G. § 1B1.10(b)(2)(A) (emphases added). Thus,",
        "paragraph_id": "para_532"
      },
      {
        "text": "Congress authorized the Commission to specify “in what",
        "paragraph_id": "para_533"
      },
      {
        "text": "circumstances” a sentence may be reduced, 28 U.S.C.",
        "paragraph_id": "para_534"
      },
      {
        "text": "§ 994(u), and the Commission responded by issuing a policy",
        "paragraph_id": "para_535"
      },
      {
        "text": "statement specifying in what circumstances a sentence may",
        "paragraph_id": "para_536"
      },
      {
        "text": "not be reduced—much like the § 1B1.13 Policy Statement at",
        "paragraph_id": "para_537"
      },
      {
        "text": "issue here.",
        "paragraph_id": "para_538"
      },
      {
        "text": "Subsequently, in Tercero, we held that § 1B1.10(b)’s",
        "paragraph_id": "para_539"
      },
      {
        "text": "limitations on sentence reductions were within the scope of",
        "paragraph_id": "para_540"
      },
      {
        "text": "the Commission’s authority under § 994(u). 734 F.3d at",
        "paragraph_id": "para_541"
      },
      {
        "text": "983–84 (“[R]ather than conflicting with congressional",

        "text": "Tercero, that argument is at odds with Tercero’s holding.",
        "paragraph_id": "para_546"
      },
      {
        "text": "Troiano’s textual argument applies equally to § 994(u), and",
        "paragraph_id": "para_547"
      },
      {
        "text": "under his reasoning, because § 994(u) expressly authorizes",
        "paragraph_id": "para_548"
      },
      {
        "text": "the Commission to specify the circumstances that “may”",
        "paragraph_id": "para_549"
      },
      {
        "text": "warrant a sentence reduction, it impliedly prohibits the",
        "paragraph_id": "para_550"
      },
      {
        "text": "Commission from specifying the circumstances that may",
        "paragraph_id": "para_551"
      },
      {
        "text": "not. Troiano’s view would mean that the Commission",
        "paragraph_id": "para_552"
      },
      {
        "text": "lacked the statutory authority to adopt the policy statement",
        "paragraph_id": "para_553"
      },
      {
        "text": "that we approved in Tercero, but our court held the opposite.",
        "paragraph_id": "para_554"
      },
      {
        "text": "Troiano also argues that, to the extent the Policy",
        "paragraph_id": "para_555"
      },
      {
        "text": "Statement precludes courts from considering nonretroactive",
        "paragraph_id": "para_556"
      },
      {
        "text": "Guidelines amendments, it conflicts with our prior",
        "paragraph_id": "para_557"
      },
      {
        "text": "interpretation of § 994(t) in United States v. Chen, 48 F.4th",
        "paragraph_id": "para_558"
      },
      {
        "text": "at 1098. Recall that we decided Chen when the Policy",
        "paragraph_id": "para_559"
      },
      {
        "text": "USA V. TROIANO 19",
        "paragraph_id": "para_560"
      },
      {
        "text": "Statement addressed only compassionate release motions",
        "paragraph_id": "para_561"
      },
      {
        "text": "filed by the BOP Director, not those filed by defendants",
        "paragraph_id": "para_562"
      },
      {
        "text": "themselves. Supra, pp. 11–12. Because that version of the",
        "paragraph_id": "para_563"
      },
      {
        "text": "Policy Statement did not apply to motions filed by",
        "paragraph_id": "para_564"
      },
      {
        "text": "defendants, the only authority that limited the district court’s",
        "paragraph_id": "para_565"
      },
      {
        "text": "discretion was the statute, § 994(t). See Chen, 48 F.4th at",
        "paragraph_id": "para_566"
      },
      {
        "text": "1098. Considering only § 994(t), we concluded that “[t]here",
        "paragraph_id": "para_567"
      },
      {
        "text": "is no textual basis for precluding district courts from",
        "paragraph_id": "para_568"
      },
      {
        "text": "considering non-retroactive changes in sentencing law when",
        "paragraph_id": "para_569"
      },
      {
        "text": "determining what is extraordinary and compelling.” Id.",
        "paragraph_id": "para_570"
      },
      {
        "text": "But there are two problems with Troiano’s reliance on",
        "paragraph_id": "para_571"
      },
      {
        "text": "Chen. First, Chen’s holding has been abrogated by the",
        "paragraph_id": "para_572"
      },
      {
        "text": "Supreme Court’s recent decision in Rutherford—at least to",
        "paragraph_id": "para_573"
      },
      {
        "text": "the extent Chen applied to nonretroactive statutory changes.",
        "paragraph_id": "para_574"
      },
      {
        "text": "See supra pp. 11–12, 14–15; Rutherford, 146 S. Ct. at 1331",
        "paragraph_id": "para_575"
      },
      {
        "text": "(considering a disparity created by a nonretroactive statutory",
        "paragraph_id": "para_576"
      },
      {
        "text": "change to be an “extraordinary and compelling reason”",
        "paragraph_id": "para_577"
      },
      {
        "text": "warranting a sentence reduction “would undermine",
        "paragraph_id": "para_578"
      },
      {
        "text": "Congress’s choice to leave the sentence intact”). Second,",
        "paragraph_id": "para_579"
      },
      {
        "text": "even assuming Chen’s holding remains good law to the",
        "paragraph_id": "para_580"
      },
      {
        "text": "extent it applies to nonretroactive Guidelines amendments,",
        "paragraph_id": "para_581"
      },
      {
        "text": "our court held only that § 994(t) itself does not limit the",
        "paragraph_id": "para_582"
      },
      {
        "text": "district court’s discretion to consider nonretroactive",
        "paragraph_id": "para_583"
      },
      {
        "text": "changes; we did not hold that the Commission lacks",
        "paragraph_id": "para_584"
      },
      {
        "text": "authority to do so. Chen, 48 F.4th at 1098. Indeed, we",
        "paragraph_id": "para_585"
      },
      {
        "text": "expressly acknowledged in Chen that “the definition of",
        "paragraph_id": "para_586"
      },
      {
        "text": "extraordinary and compelling is bound by applicable policy",
        "paragraph_id": "para_587"
      },
      {
        "text": "statements from the Sentencing Commission,” and our",
        "paragraph_id": "para_588"
      },
      {
        "text": "holding was premised on “the absence of an applicable",
        "paragraph_id": "para_589"
      },
      {
        "text": "policy statement from the Sentencing Commission.” Id. at",
        "paragraph_id": "para_590"
      },
      {
        "text": "1095–96 (emphases added). An applicable policy statement",
        "paragraph_id": "para_591"
      },
      {
        "text": "is now in effect, and it is that policy statement, not § 994(t),",
        "paragraph_id": "para_592"
      },
      {
        "text": "20 USA V. TROIANO",
        "paragraph_id": "para_593"
      },
      {
        "text": "that prohibits consideration of nonretroactive Guidelines",
        "paragraph_id": "para_594"
      },
      {
        "text": "amendments.",
        "paragraph_id": "para_595"
      },
      {
        "text": "Troiano also asks us to adopt the reasoning of United",
        "paragraph_id": "para_596"
      },
      {
        "text": "States v. McGee, 992 F.3d 1035 (10th Cir. 2021), abrogated",
        "paragraph_id": "para_597"
      },
      {
        "text": "in part by Rutherford, 146 S. Ct. 1320. In McGee, the Tenth",
        "paragraph_id": "para_598"
      },
      {
        "text": "Circuit held that a district court’s assessment of",
        "paragraph_id": "para_599"
      },
      {
        "text": "“extraordinary and compelling reasons” is not bound by the",
        "paragraph_id": "para_600"
      },
      {
        "text": "Commission’s policy statements. The Tenth Circuit",
        "paragraph_id": "para_601"
      },
      {
        "text": "“conclude[d] that Congress did not, by way of § 994(t)",
        "paragraph_id": "para_602"
      },
      {
        "text": "intend for the Sentencing Commission to exclusively define",
        "paragraph_id": "para_603"
      },
      {
        "text": "the phrase ‘extraordinary and compelling reasons,’ but rather",
        "paragraph_id": "para_604"
      },
      {
        "text": "for the Sentencing Commission to describe those",
        "paragraph_id": "para_605"
      },
      {
        "text": "characteristics or significant qualities or features that",
        "paragraph_id": "para_606"
      },
      {
        "text": "typically constitute ‘extraordinary and compelling reasons,’",
        "paragraph_id": "para_607"
      },
      {
        "text": "and for those guideposts to serve as part of the general policy",
        "paragraph_id": "para_608"
      },
      {
        "text": "statements to be considered by district courts under the",
        "paragraph_id": "para_609"
      },
      {
        "text": "second part of the statutory test in § 3582(c)(1)(A).” 992",
        "paragraph_id": "para_610"
      },
      {
        "text": "F.3d at 1045.",
        "paragraph_id": "para_611"
      },
      {
        "text": "Even if we agreed with Troiano that McGee’s reasoning",
        "paragraph_id": "para_612"
      },
      {
        "text": "is persuasive, we could not adopt its holding because it",
        "paragraph_id": "para_613"
      },
      {
        "text": "conflicts with our precedent. We have already held that the",
        "paragraph_id": "para_614"
      },
      {
        "text": "Commission’s definition of “extraordinary and compelling”",
        "paragraph_id": "para_615"
      },
      {
        "text": "in an applicable § 1B1.13 policy statement is binding on",
        "paragraph_id": "para_616"
      },
      {
        "text": "district courts. See, e.g., Bryant, 144 F.4th at 1124 (“If a",
        "paragraph_id": "para_617"
      },
      {
        "text": "defendant cannot show ‘extraordinary and compelling",
        "paragraph_id": "para_618"
      },
      {
        "text": "reasons’ as defined in § 1B1.13, then he is ineligible for” a",
        "paragraph_id": "para_619"
      },
      {
        "text": "sentence reduction under § 3582(c)(1)(A)); Wright, 46 F.4th",
        "paragraph_id": "para_620"
      },
      {
        "text": "at 945 (the defendant must show that his request for",
        "paragraph_id": "para_621"
      },
      {
        "text": "compassionate release is “consistent with applicable policy",
        "paragraph_id": "para_622"
      },
      {
        "text": "statements issued by the Sentencing Commission”) (citation",
        "paragraph_id": "para_623"
      },
      {
        "text": "modified); see also Dillon v. United States, 560 U.S. 817,",
        "paragraph_id": "para_624"
      },
      {
        "text": "USA V. TROIANO 21",
        "paragraph_id": "para_625"
      },
      {
        "text": "821 (2010) (holding that the Commission’s § 1B1.10 policy",
        "paragraph_id": "para_626"
      },
      {
        "text": "statement is binding on district courts).3",
        "paragraph_id": "para_627"
      },
      {
        "text": "In sum, we conclude that the Commission may, within",
        "paragraph_id": "para_628"
      },
      {
        "text": "the scope of its statutory authority under § 994(t), exclude a",
        "paragraph_id": "para_629"
      },
      {
        "text": "nonretroactive Guidelines amendment from the definition of",
        "paragraph_id": "para_630"
      },
      {
        "text": "“extraordinary and compelling reasons for sentence",
        "paragraph_id": "para_631"
      },
      {
        "text": "reduction.” Therefore, subsections (b)(6) and (c) of the",
        "paragraph_id": "para_632"
      },
      {
        "text": "§ 1B1.13 Policy Statement validly bar district courts from",
        "paragraph_id": "para_633"
      },
      {
        "text": "considering nonretroactive changes to the Sentencing",
        "paragraph_id": "para_634"
      },
      {
        "text": "Guidelines in deciding whether there are “extraordinary and",
        "paragraph_id": "para_635"
      },
      {
        "text": "compelling reasons for [a] sentence reduction.” 28 U.S.C.",
        "paragraph_id": "para_636"
      },
      {
        "text": "§ 994(t).",
        "paragraph_id": "para_637"
      },
      {
        "text": "C.",
        "paragraph_id": "para_638"
      },
      {
        "text": "Troiano alternatively argues that, if the district court is",
        "paragraph_id": "para_639"
      },
      {
        "text": "bound by subsections (b)(6) and (c) of the § 1B1.13 Policy",
        "paragraph_id": "para_640"
      },
      {
        "text": "Statement, those provisions only prohibit a court from",
        "paragraph_id": "para_641"
      },
      {
        "text": "considering “an amendment” to the Guidelines (in the",
        "paragraph_id": "para_642"
      },
      {
        "text": "singular)—and therefore permit a court to consider the",
        "paragraph_id": "para_643"
      },
      {
        "text": "combined effect of three nonretroactive Guidelines changes",
        "paragraph_id": "para_644"
      },
      {
        "text": "(in the plural). U.S.S.G. § 1B1.13(b)(6), (c) (emphasis",
        "paragraph_id": "para_645"
      },
      {
        "text": "added). Again, we are unpersuaded.",
        "paragraph_id": "para_646"
      },
      {
        "text": "When interpreting text, we ordinarily “assume ‘words",
        "paragraph_id": "para_647"
      },
      {
        "text": "importing the singular include and apply to several persons,",
        "paragraph_id": "para_648"
      },
      {
        "text": "3 Dillon concerned a defendant’s motion for a sentence reduction under",
        "paragraph_id": "para_649"
      },
      {
        "text": "18 U.S.C. § 3582(c)(2), which permits a district court to reduce a",
        "paragraph_id": "para_650"
      },
      {
        "text": "defendant’s sentence when it was based on a Guidelines range “‘that has",
        "paragraph_id": "para_651"
      },
      {
        "text": "subsequently been lowered by the Sentencing Commission pursuant to",
        "paragraph_id": "para_652"
      },
      {
        "text": "28 U.S.C. 994(o)’ and made retroactive pursuant to § 994(u).” Dillon,",
        "paragraph_id": "para_653"
      },
      {
        "text": "560 U.S. at 823-24 (quoting 18 U.S.C. § 3582(c)(2)). Section 3582(c)(2)",
        "paragraph_id": "para_654"
      },
      {
        "text": "permits a sentence reduction only if it “is consistent with applicable",
        "paragraph_id": "para_655"
      },
      {
        "text": "policy statements issued by the Sentencing Commission”—much like",
        "paragraph_id": "para_656"
      },
      {
        "text": "§ 3582(c)(1)(A), the compassionate release statute at issue here.",
        "paragraph_id": "para_657"
      },
      {

      {
        "text": "parties, or things,’ unless ‘context indicates otherwise.’”",
        "paragraph_id": "para_659"
      },
      {
        "text": "United States v. Myers, 170 F.4th 1180, 1185 (9th Cir. 2026)",
        "paragraph_id": "para_660"
      },
      {
        "text": "(quoting 1 U.S.C. § 1); see also Schott v. Comm’r of Internal",
        "paragraph_id": "para_661"
      },
      {
        "text": "Revenue, 319 F.3d 1203, 1206 (9th Cir. 2003) (“[S]ingulars",
        "paragraph_id": "para_662"
      },
      {
        "text": "normally include plurals.”). Applying this well-established",
        "paragraph_id": "para_663"
      },
      {
        "text": "interpretive rule, it is clear that the Policy Statement’s",
        "paragraph_id": "para_664"
      },
      {
        "text": "reference to “an amendment” includes multiple",
        "paragraph_id": "para_665"
      },
      {
        "text": "amendments. U.S.S.G. § 1B1.13(b)(6), (c) (emphasis",
        "paragraph_id": "para_666"
      },
      {
        "text": "added). Context does not indicate otherwise. If the",
        "paragraph_id": "para_667"
      },
      {
        "text": "Commission intended to bar consideration of a single",
        "paragraph_id": "para_668"
      },
      {
        "text": "nonretroactive amendment to the Guidelines but allow",
        "paragraph_id": "para_669"
      },
      {
        "text": "consideration of the combined effect of multiple",
        "paragraph_id": "para_670"
      },
      {
        "text": "nonretroactive amendments, the Commission likely would",
        "paragraph_id": "para_671"
      },
      {
        "text": "have used more specific language to make that clear. We",
        "paragraph_id": "para_672"
      },
      {
        "text": "therefore conclude that the Policy Statement prohibits",
        "paragraph_id": "para_673"
      },
      {
        "text": "consideration of the combined effect of multiple",
        "paragraph_id": "para_674"
      },
      {
        "text": "nonretroactive amendments to the Guidelines.4",
        "paragraph_id": "para_675"
      },
      {
        "text": "IV. CONCLUSION",
        "paragraph_id": "para_676"
      },
      {
        "text": "We conclude that subsections (b)(6) and (c) of the",
        "paragraph_id": "para_677"
      },
      {
        "text": "§ 1B1.13 Policy Statement validly prevent district courts",
        "paragraph_id": "para_678"
      },
      {
        "text": "from considering nonretroactive changes to the Sentencing",
        "paragraph_id": "para_679"
      },
      {
        "text": "Guidelines in deciding whether there are “extraordinary and",
        "paragraph_id": "para_680"
      },
      {
        "text": "compelling reasons for [a] sentence reduction,” 28 U.S.C.",
        "paragraph_id": "para_681"
      },
      {
        "text": "§ 994(t), and that restriction is binding on district courts",
        "paragraph_id": "para_682"
      },
      {
        "text": "considering motions for compassionate release. We also",
        "paragraph_id": "para_683"
      },
      {
        "text": "conclude that the combined effect of multiple nonretroactive",
        "paragraph_id": "para_684"
      },
      {
        "text": "amendments to the Sentencing Guidelines is not an",
        "paragraph_id": "para_685"
      },
      {
        "text": "4 The district court alternatively held that the sentencing factors in 18",
        "paragraph_id": "para_686"
      },
      {
        "text": "U.S.C. § 3553(a) did not support granting Troiano’s motion. Because",

        "text": "we conclude that Troiano did not show that extraordinary and",

        "text": "compelling reasons warrant a sentence reduction, we do not reach",

        "text": "Troiano’s arguments challenging the district court’s § 3553(a) analysis.",

      },

        "text": "extraordinary and compelling reason for compassionate",
        "paragraph_id": "para_692"
      },

        "text": "release under that Policy Statement. Accordingly, we affirm",
        "paragraph_id": "para_693"
      },
      {
        "text": "the district court’s denial of Troiano’s motion for",
        "paragraph_id": "para_694"
      },
      {
        "text": "compassionate release on that ground.",
