        "paragraph_id": "para_64"
      },
      {
        "text": "warrant and may again attempt to flee. Accordingly, the",
        "paragraph_id": "para_65"
      },
      {
        "text": "Officers’ use of force under these circumstances was",
        "paragraph_id": "para_66"
      },
      {
        "text": "reasonable and did not violate Medrano’s Fourth",
        "paragraph_id": "para_67"
      },
      {
        "text": "Amendment rights.",
        "paragraph_id": "para_68"
      },
      {
        "text": "The panel further held that Medrano’s claimed Fourth",
        "paragraph_id": "para_69"
      },
      {
        "text": "Amendment right was not clearly established under existing",
        "paragraph_id": "para_70"
      },
      {
        "text": "law because it was not sufficiently clear to the Officers here",
        "paragraph_id": "para_71"
      },
      {
        "text": "that what they were doing violated Medrano’s Fourth",
        "paragraph_id": "para_72"
      },
      {
        "text": "Amendment right.",
        "paragraph_id": "para_73"
      },
      {
        "text": "Judge Paez concurred in part and dissented in part. He",
        "paragraph_id": "para_74"
      },
      {
        "text": "joined Section II.C of the majority opinion, which held that",

      },

        "text": "the Officers’ conduct did not violate clearly established",
        "paragraph_id": "para_76"
      },

        "text": "CALLAHAN, Circuit Judge:",

        "text": "To execute a felony arrest warrant against Plaintiff Alex",
        "paragraph_id": "para_98"
      },
      {
        "text": "R. Medrano, two police officers approached Medrano from",
        "paragraph_id": "para_99"
      },
      {
        "text": "ten to twenty feet away with their guns drawn. The officers",
        "paragraph_id": "para_100"
      },
      {
        "text": "kept their guns drawn until they had safely placed him under",
        "paragraph_id": "para_101"
      },
      {
        "text": "arrest. Medrano sued, claiming that by aiming their firearms",
        "paragraph_id": "para_102"
      },
      {
        "text": "at his head, the officers used excessive force in violation of",
        "paragraph_id": "para_103"
      },
      {
        "text": "the Fourth Amendment. The district court denied the",
        "paragraph_id": "para_104"
      },
      {
        "text": "officers’ motion for summary judgment, ruling that a juror",
        "paragraph_id": "para_105"
      },
      {
        "text": "could find that they used excessive force and that “under the",
        "paragraph_id": "para_106"
      },
      {
        "text": "circumstances, such action was a clear violation of an",
        "paragraph_id": "para_107"
      },
      {
        "text": "established constitutional right.”",
        "paragraph_id": "para_108"
      },
      {
        "text": "In arresting Medrano, the officers reasonably believed",
        "paragraph_id": "para_109"
      },
      {
        "text": "that he had committed serious crimes, presented a threat to",
        "paragraph_id": "para_110"
      },
      {
        "text": "their safety, and may resist arrest or attempt to flee. We hold",
        "paragraph_id": "para_111"
      },
      {
        "text": "that they did not violate the Fourth Amendment by",
        "paragraph_id": "para_112"
      },
      {

        "text": "approaching him with their weapons drawn and ready to use.",
        "paragraph_id": "para_114"
      },
      {
        "text": "We thus reverse and remand. 1",
        "paragraph_id": "para_115"
      },
      {
        "text": "I",
        "paragraph_id": "para_116"
      },
      {
        "text": "A",
        "paragraph_id": "para_117"
      },
      {
        "text": "On June 8, 2018, Bell Gardens Police Department",
        "paragraph_id": "para_118"
      },
      {
        "text": "(BGPD) Officers Acosta and Roberts were both working",
        "paragraph_id": "para_119"
      },
      {
        "text": "patrol duty. 2 Around 7:30 p.m., each Officer received a",
        "paragraph_id": "para_120"
      },
      {
        "text": "report that Medrano had been seen leaving his girlfriend’s",
        "paragraph_id": "para_121"
      },
      {
        "text": "residence in Bell Gardens and was headed to his father’s",
        "paragraph_id": "para_122"
      },
      {
        "text": "residence. Both Officers were familiar with Medrano, who",
        "paragraph_id": "para_123"
      },
      {
        "text": "they believed was affiliated with a local street gang.",
        "paragraph_id": "para_124"
      },
      {
        "text": "On or around May 25, roughly two weeks prior to",
        "paragraph_id": "para_125"
      },
      {
        "text": "receiving the June 8 report, Officer Acosta learned that",
        "paragraph_id": "para_126"
      },
      {
        "text": "“Medrano had [recently] fled from a lawful traffic stop",
        "paragraph_id": "para_127"
      },
      {
        "text": "conducted by a BGPD officer,” and was currently “on the",
        "paragraph_id": "para_128"
      },
      {
        "text": "run” from a “felony ‘no bail’ federal warrant for [his] arrest",
        "paragraph_id": "para_129"
      },
      {
        "text": "related to drug charges.” The next day, Medrano’s mother",
        "paragraph_id": "para_130"
      },
      {
        "text": "contacted BGPD regarding Medrano and asked that officers",
        "paragraph_id": "para_131"
      },
      {
        "text": "respond to his residence. 3 When BGPD officers (including",
        "paragraph_id": "para_132"
      },
      {
        "text": "Officer Acosta) arrived at the residence, Medrano’s mother",
        "paragraph_id": "para_133"
      },
      {
        "text": "1 Medrano was ably represented on appeal by counsel appointed through",
        "paragraph_id": "para_134"
      },
      {
        "text": "the Ninth Circuit’s pro bono program. We thank counsel for their",
        "paragraph_id": "para_135"

        "paragraph_id": "para_136"
      },
      {
        "text": "2 “Because this case comes here on [the Officers’] motion for summary",
        "paragraph_id": "para_137"
      },
      {
        "text": "judgment, we view the facts in the light most favorable to the nonmoving",
        "paragraph_id": "para_138"
      },
      {
        "text": "party, [Medrano].” Zorn v. Linton, 607 U.S. 568, 570 n.1 (2026). We",
        "paragraph_id": "para_139"
      },
      {
        "text": "also “consider facts offered by the defendants that are ‘uncontradicted",
        "paragraph_id": "para_140"
      },
      {
        "text": "by any evidence in the record.’” Hopson v. Alexander, 71 F.4th 692, 697",
        "paragraph_id": "para_141"
      },
      {
        "text": "(9th Cir. 2023) (quoting Wilkinson v. Torres, 610 F.3d 546, 551 (9th Cir.",
        "paragraph_id": "para_142"
      },
      {
        "text": "2010)).",
        "paragraph_id": "para_143"
      },
      {
        "text": "3 The record is unclear as to whether this was Medrano’s residence, his",

      },
      {
        "text": "mother’s residence, or a shared residence.",
        "paragraph_id": "para_145"
      },
      {
        "text": "6 MEDRANO V. ACOSTA",
        "paragraph_id": "para_146"
      },
      {
        "text": "stated that he was inside alone, “acting paranoid and spray",
        "paragraph_id": "para_147"
      },
      {
        "text": "painting ‘the federal police [a]re out to get me’ inside the",
        "paragraph_id": "para_148"
      },
      {
        "text": "interior.” BGPD officers obtained a search warrant and",
        "paragraph_id": "para_149"
      },
      {
        "text": "entered the residence but did not find Medrano.",
        "paragraph_id": "para_150"
      },
      {
        "text": "On June 5, a federal magistrate judge recalled Medrano’s",
        "paragraph_id": "para_151"
      },
      {
        "text": "outstanding arrest warrant after Medrano voluntarily",
        "paragraph_id": "para_152"
      },
      {
        "text": "appeared in court. But the California Law Enforcement",
        "paragraph_id": "para_153"
      },
      {
        "text": "Telecommunications System (CLETS) had not been updated",
        "paragraph_id": "para_154"
      },
      {
        "text": "to reflect that new development, and on June 8 CLETS still",
        "paragraph_id": "para_155"
      },
      {
        "text": "indicated that Medrano had an active warrant out for his",
        "paragraph_id": "para_156"
      },
      {
        "text": "arrest. Accordingly, the Officers did not know that the",
        "paragraph_id": "para_157"
      },
      {
        "text": "federal arrest warrant had been recalled.",
        "paragraph_id": "para_158"
      },
      {
        "text": "On June 8, after receiving their respective reports that",
        "paragraph_id": "para_159"
      },
      {
        "text": "Medrano was en route to his father’s residence, Officers",
        "paragraph_id": "para_160"
      },
      {
        "text": "Acosta and Roberts went to the residence “and established a",
        "paragraph_id": "para_161"
      },
      {
        "text": "perimeter.” They approached the house from a neighboring",
        "paragraph_id": "para_162"
      },
      {
        "text": "driveway, which was separated from the house by a chain-",
        "paragraph_id": "para_163"
      },
      {
        "text": "linked fence approximately six feet tall. The fence had white",
        "paragraph_id": "para_164"
      },
      {
        "text": "aluminum strips that “obstructed visibility from atop to six",
        "paragraph_id": "para_165"
      },
      {
        "text": "feet below.” The Officers saw Medrano in the backyard",
        "paragraph_id": "para_166"
      },
      {
        "text": "alone with an unidentified dog, likely “some type of pit",
        "paragraph_id": "para_167"
      },
      {
        "text": "bull.” From approximately ten to twenty feet away, the",
        "paragraph_id": "para_168"
      },
      {
        "text": "Officers drew their weapons, aimed them at Medrano’s head,",
        "paragraph_id": "para_169"
      },
      {
        "text": "and “commanded [Medrano] to approach [their] position.” 4",
        "paragraph_id": "para_170"
      },
      {
        "text": "4 There is no dispute that the Officers drew their weapons. However,",
        "paragraph_id": "para_171"
      },
      {
        "text": "where the Officers aimed their weapons is subject to dispute. Medrano",
        "paragraph_id": "para_172"
      },
      {
        "text": "alleges that the Officers both had their weapons aimed at his head.",
        "paragraph_id": "para_173"
      },
      {
        "text": "Officer Roberts denies that he had his firearm pointed at Medrano’s",
        "paragraph_id": "para_174"
      },
      {
        "text": "head. He claims that he had his weapon drawn, without specifying in",
        "paragraph_id": "para_175"
      },
      {
        "text": "which direction it was pointed. Officer Acosta also denies that he had",
        "paragraph_id": "para_176"
      },
      {
        "text": "his gun aimed at Medrano’s head. He asserts that he had his weapon",
        "paragraph_id": "para_177"
      },
      {
        "text": "MEDRANO V. ACOSTA 7",
        "paragraph_id": "para_178"
      },
      {
        "text": "It was still light outside, and Medrano first became aware",
        "paragraph_id": "para_179"
      },
      {
        "text": "of the Officers when he looked to the right and saw Officer",
        "paragraph_id": "para_180"
      },
      {
        "text": "Roberts’s firearm pointed at him. Medrano claims that he",
        "paragraph_id": "para_181"
      },
      {
        "text": "was not fully aware of what Officer Acosta was doing",
        "paragraph_id": "para_182"
      },
      {
        "text": "because he was “under extreme fear and extreme shock by",
        "paragraph_id": "para_183"
      },
      {
        "text": "Officer Roberts’[s] firearm[,]” and feared for his life. He",
        "paragraph_id": "para_184"
      },
      {
        "text": "complied with the Officers’ command and climbed the fence",
        "paragraph_id": "para_185"
      },
      {
        "text": "without incident. The Officers immediately handcuffed him",
        "paragraph_id": "para_186"
      },
      {
        "text": "as soon as he was over the fence. Medrano does not recall",
        "paragraph_id": "para_187"
      },
      {
        "text": "at what point they put away their firearms during the arrest.",
        "paragraph_id": "para_188"
      },
      {
        "text": "After handcuffing Medrano, the Officers walked him to",
        "paragraph_id": "para_189"
      },
      {
        "text": "a patrol vehicle. They then transported him to Bell Gardens",
        "paragraph_id": "para_190"
      },
      {
        "text": "jail, where he was booked based on the arrest warrant and",
        "paragraph_id": "para_191"
      },
      {
        "text": "for violating California Penal Code § 148 due to his having",
        "paragraph_id": "para_192"
      },
      {
        "text": "fled from law enforcement during the May 25 traffic stop.",
        "paragraph_id": "para_193"
      },
      {
        "text": "On June 11, the U.S. Marshals Service took custody of",
        "paragraph_id": "para_194"
      },
      {
        "text": "Medrano. That same day, a federal magistrate judge ordered",
        "paragraph_id": "para_195"
      },
      {
        "text": "Medrano to be released because the earlier arrest warrant had",
        "paragraph_id": "para_196"
      },
      {
        "text": "been recalled.",
        "paragraph_id": "para_197"
      },
      {
        "text": "B",
        "paragraph_id": "para_198"
      },
      {
        "text": "On December 4, 2018, Medrano initiated this pro se civil",
        "paragraph_id": "para_199"
      },
      {
        "text": "rights action. On July 8, 2022, following some preliminary",
        "paragraph_id": "para_200"
      },
      {
        "text": "litigation, Medrano filed his operative complaint. Relevant",
        "paragraph_id": "para_201"
      },
      {
        "text": "to this appeal, the operative complaint brings claims against",
        "paragraph_id": "para_202"
      },
      {
        "text": "Officers Acosta and Roberts pursuant to 42 U.S.C. § 1983,",
        "paragraph_id": "para_203"
      },
      {
        "text": "alleging that they violated his rights under the Fourth",
        "paragraph_id": "para_204"
      },
      {
        "text": "Amendment by using excessive force to effectuate his arrest.",
        "paragraph_id": "para_205"
      },
      {
        "text": "aimed in the direction of Medrano’s torso. For present purposes, we",
        "paragraph_id": "para_206"
      },
      {
        "text": "accept the facts as alleged by Medrano.",
        "paragraph_id": "para_207"
      },
      {
        "text": "8 MEDRANO V. ACOSTA",
        "paragraph_id": "para_208"
      },
      {
        "text": "Eventually, the Officers moved for summary judgment,",
        "paragraph_id": "para_209"
      },
      {
        "text": "arguing that “their use of force was reasonable, and, in the",
        "paragraph_id": "para_210"
      },
      {
        "text": "alternative, they are shielded from liability by the doctrine of",
        "paragraph_id": "para_211"
      },
      {
        "text": "qualified immunity.” The district judge referred the motion",
        "paragraph_id": "para_212"
      },
      {
        "text": "to a magistrate judge, who issued a report and",
        "paragraph_id": "para_213"
      },
      {
        "text": "recommendation that the district judge grant summary",
        "paragraph_id": "para_214"
      },
      {
        "text": "judgment to the Officers. The report reasoned that:",
        "paragraph_id": "para_215"
      },
      {
        "text": "(1) Officer Acosta did not violate Medrano’s Fourth",
        "paragraph_id": "para_216"
      },
      {
        "text": "Amendment rights, because Medrano could not specifically",
        "paragraph_id": "para_217"
      },
      {
        "text": "recall whether Officer Acosta had a firearm drawn at all and",
        "paragraph_id": "para_218"
      },
      {
        "text": "the record established only that Officer Acosta had his",
        "paragraph_id": "para_219"
      },
      {
        "text": "firearm drawn and pointed at Medrano’s torso; (2) Officer",
        "paragraph_id": "para_220"
      },
      {
        "text": "Roberts may have violated Medrano’s Fourth Amendment",
        "paragraph_id": "para_221"
      },
      {
        "text": "rights, because a reasonable juror could conclude Officer",
        "paragraph_id": "para_222"
      },
      {
        "text": "Roberts aimed his firearm at Medrano’s head; and (3) both",
        "paragraph_id": "para_223"
      },
      {
        "text": "Officers were entitled to qualified immunity because",
        "paragraph_id": "para_224"
      },
      {
        "text": "Medrano’s claimed Fourth Amendment right was not clearly",
        "paragraph_id": "para_225"
      },
      {
        "text": "established under existing law.",
        "paragraph_id": "para_226"
      },
      {
        "text": "The district judge rejected the magistrate judge’s",
        "paragraph_id": "para_227"
      },
      {
        "text": "recommendations and denied the Officers’ motion for",
        "paragraph_id": "para_228"
      },
      {
        "text": "summary judgment. The district judge held that Officer",
        "paragraph_id": "para_229"
      },
      {
        "text": "Acosta was not entitled to summary judgment because",
        "paragraph_id": "para_230"
      },
      {
        "text": "“Medrano has shown a genuine dispute of material fact” as",
        "paragraph_id": "para_231"
      },
      {
        "text": "to “whether Officer Acosta pointed his gun at Medrano’s",
        "paragraph_id": "para_232"
      },
      {
        "text": "head,” which the district judge found to be “material to the",
        "paragraph_id": "para_233"
      },
      {
        "text": "excessive force analysis.” In the district judge’s view,",
        "paragraph_id": "para_234"
      },
      {
        "text": "neither Officer was entitled to qualified immunity because",
        "paragraph_id": "para_235"
      },
      {
        "text": "“a juror could find that both of the Officer Defendants",
        "paragraph_id": "para_236"
      },
      {
        "text": "pointed their guns at Medrano’s head, and under the",
        "paragraph_id": "para_237"
      },
      {
        "text": "circumstances, such action was a clear violation of an",
        "paragraph_id": "para_238"
      },
      {
        "text": "established constitutional right.”",
        "paragraph_id": "para_239"
      },
      {
        "text": "The Officers timely appealed.",
        "paragraph_id": "para_240"
      },
      {
        "text": "MEDRANO V. ACOSTA 9",
        "paragraph_id": "para_241"
      },
      {
        "text": "II",
        "paragraph_id": "para_242"
      },
      {
        "text": "We have jurisdiction under 28 U.S.C. § 1291 to review a",
        "paragraph_id": "para_243"
      },
      {
        "text": "district court’s summary judgment order denying qualified",
        "paragraph_id": "para_244"
      },
      {
        "text": "immunity. Hopson v. Alexander, 71 F.4th 692, 696–97 (9th",
        "paragraph_id": "para_245"
      },
      {
        "text": "Cir. 2023); see Mitchell v. Forsyth, 472 U.S. 511, 530 (1985)",
        "paragraph_id": "para_246"
      },
      {
        "text": "(holding that “a district court’s denial of a claim of qualified",
        "paragraph_id": "para_247"
      },
      {
        "text": "immunity, to the extent that it turns on an issue of law, is an",
        "paragraph_id": "para_248"
      },
      {
        "text": "appealable ‘final decision’ within the meaning of 28 U.S.C.",
        "paragraph_id": "para_249"
      },
      {
        "text": "§ 1291”). Reviewing de novo, we must decide “whether the",
        "paragraph_id": "para_250"
      },
      {
        "text": "facts, ‘considered in the light most favorable to the plaintiff,’",
        "paragraph_id": "para_251"
      },
      {
        "text": "show that qualified immunity is warranted.” Hopson, 71 F.",
        "paragraph_id": "para_252"
      },
      {
        "text": "4th at 697 (citing Ames v. King County, 846 F.3d 340, 347",
        "paragraph_id": "para_253"
      },
      {
        "text": "(9th Cir. 2017)).",
        "paragraph_id": "para_254"
      },
      {
        "text": "“Under the doctrine of qualified immunity, police",
        "paragraph_id": "para_255"
      },
      {
        "text": "officers are not liable under § 1983 ‘unless (1) they violated",
        "paragraph_id": "para_256"
      },
      {
        "text": "a federal statutory or constitutional right, and (2) the",
        "paragraph_id": "para_257"
      },
      {
        "text": "unlawfulness of their conduct was clearly established at the",
        "paragraph_id": "para_258"
      },
      {
        "text": "time.’” Id. (quoting District of Columbia v. Wesby, 583 U.S.",
        "paragraph_id": "para_259"
      },
      {
        "text": "48, 62–63 (2018)). We may “approach the qualified",
        "paragraph_id": "para_260"
      },
      {
        "text": "immunity question using either prong as [the] starting",
        "paragraph_id": "para_261"
      },
      {
        "text": "point.” Id. (quoting Pearson v. Callahan, 555 U.S. 223, 236",
        "paragraph_id": "para_262"
      },
      {
        "text": "(2009)).",
        "paragraph_id": "para_263"
      },
      {
        "text": "A",
        "paragraph_id": "para_264"
      },
      {
        "text": "The Fourth Amendment of the Constitution, made",
        "paragraph_id": "para_265"
      },
      {
        "text": "applicable to the States by the Fourteenth Amendment,",
        "paragraph_id": "para_266"
      },
      {
        "text": "protects “[t]he right of the people to be secure in their",
        "paragraph_id": "para_267"
      },
      {
        "text": "persons . . . against unreasonable searches and seizures[.]”",
        "paragraph_id": "para_268"
      },
      {
        "text": "See Bailey v. United States, 568 U.S. 186, 192 (2013). The",
        "paragraph_id": "para_269"
      },
      {
        "text": "Amendment’s central purpose is “to safeguard the privacy",
        "paragraph_id": "para_270"
      },
      {
        "text": "and security of individuals against arbitrary invasions by",
        "paragraph_id": "para_271"
      },
      {
        "text": "governmental officials.” Chatrie v. United States, 146 S. Ct.",
        "paragraph_id": "para_272"
      },
      {
        "text": "10 MEDRANO V. ACOSTA",
        "paragraph_id": "para_273"
      },
      {
        "text": "2193, 2204 (2026) (quoting Carpenter v. United States, 585",
        "paragraph_id": "para_274"
      },
      {
        "text": "U. S. 296, 303 (2018)).",
        "paragraph_id": "para_275"
      },
      {
        "text": "The Fourth Amendment prohibits police officers from",
        "paragraph_id": "para_276"
      },
      {
        "text": "using excessive force in conducting a seizure, including a",

        "text": "Excessive force, however, must be distinguished from",
        "paragraph_id": "para_279"
      },
      {
        "text": "appropriate force; an officer’s “right to make an arrest or",
        "paragraph_id": "para_280"
      },
      {
        "text": "investigatory stop necessarily carries with it the right to use",
        "paragraph_id": "para_281"
      },
      {
        "text": "some degree of physical coercion or threat thereof to effect",
        "paragraph_id": "para_282"
      },
      {
        "text": "it.” Id. at 396 (citing Terry v. Ohio, 392 U.S. 1, 22–27",
        "paragraph_id": "para_283"
      },
      {
        "text": "(1968)); see Saucier v. Katz, 533 U.S. 194, 206 (2001)",
        "paragraph_id": "para_284"
      },
      {
        "text": "(noting the “sometimes ‘hazy border between excessive and",
        "paragraph_id": "para_285"
      },
      {
        "text": "acceptable force’” (quoting Priester v. Riveria Beach, 208",
        "paragraph_id": "para_286"
      },
      {
        "text": "F.3d 919, 926–27 (11th Cir. 2000))). “[W]hen an officer",
        "paragraph_id": "para_287"
      },
      {
        "text": "reasonably believes force is necessary to protect his own",
        "paragraph_id": "para_288"
      },
      {
        "text": "safety or the safety of the public, measures used to restrain",
        "paragraph_id": "para_289"
      },
      {
        "text": "individuals, such as stopping them at gunpoint and",
        "paragraph_id": "para_290"
      },
      {
        "text": "handcuffing them, are reasonable.” Hopson, 71 F.4th at 701",
        "paragraph_id": "para_291"
      },
      {
        "text": "(emphasis in original) (quoting Alexander v. County of Los",
        "paragraph_id": "para_292"
      },
      {
        "text": "Angeles, 64 F.3d 1315, 1320 (9th Cir. 1995)).",
        "paragraph_id": "para_293"
      },
      {
        "text": "“Determining whether the force used to effect a",
        "paragraph_id": "para_294"
      },
      {
        "text": "particular [arrest] is ‘reasonable’ under the Fourth",
        "paragraph_id": "para_295"
      },
      {
        "text": "Amendment requires careful balancing of the nature and",
        "paragraph_id": "para_296"
      },
      {
        "text": "quality of the intrusion on the individual’s Fourth",
        "paragraph_id": "para_297"
      },
      {
        "text": "Amendment interests against the countervailing government",
        "paragraph_id": "para_298"
      },
      {
        "text": "interests at stake.” Graham, 490 U.S. at 396 (citation",
        "paragraph_id": "para_299"
      },
      {
        "text": "modified); see also Lowry v. City of San Diego, 858 F.3d",
        "paragraph_id": "para_300"
      },
      {
        "text": "1248, 1256 (9th Cir. 2017) (en banc). “The operative",
        "paragraph_id": "para_301"
      },
      {
        "text": "question . . . is ‘whether the totality of the circumstances,",
        "paragraph_id": "para_302"
      },
      {
        "text": "justifie[s] a particular sort of search or seizure.’” County of",
        "paragraph_id": "para_303"
      },
      {
        "text": "Los Angeles v. Mendez, 581 U.S. 420, 427–28 (2017)",
        "paragraph_id": "para_304"
      },
      {
        "text": "(quoting Tennessee v. Garner, 471 U.S. 1, 8–9 (1985)). In",
        "paragraph_id": "para_305"
      },
      {
        "text": "answering this question, we must view the circumstances",
        "paragraph_id": "para_306"
      },
      {
        "text": "MEDRANO V. ACOSTA 11",

      },
      {
        "text": "“from the perspective of a reasonable officer on the scene,",
        "paragraph_id": "para_308"
      },
      {
        "text": "rather than with the 20/20 vision of hindsight[,]” bearing in",
        "paragraph_id": "para_309"
      },
      {
        "text": "mind that “[a]n officer’s use of force cannot be deemed",
        "paragraph_id": "para_310"
      },
      {
        "text": "excessive based on facts that he reasonably would not have",
        "paragraph_id": "para_311"
      },
      {
        "text": "known or anticipated.” Graham, 490 U.S. at 396; Lowry,",
        "paragraph_id": "para_312"
      },
      {
        "text": "858 F.3d at 1256.",
        "paragraph_id": "para_313"
      },
      {
        "text": "B",
        "paragraph_id": "para_314"
      },
      {
        "text": "1",
        "paragraph_id": "para_315"
      },
      {
        "text": "To consider whether the Officers used unconstitutionally",
        "paragraph_id": "para_316",
        "court_paragraph": 1
      },
      {
        "text": "excessive force in arresting Medrano, we first “assess the",
        "paragraph_id": "para_317"
      },
      {
        "text": "severity of the intrusion on [Medrano’s] Fourth Amendment",
        "paragraph_id": "para_318"
      },
      {
        "text": "rights by evaluating ‘the type and amount of force",
        "paragraph_id": "para_319"
      },
      {
        "text": "inflicted.’” Espinosa v. City & County of San Francisco,",
        "paragraph_id": "para_320"
      },
      {
        "text": "598 F.3d 528, 537 (9th Cir. 2010) (quoting Miller v. Clark",
        "paragraph_id": "para_321"
      },
      {
        "text": "County, 340 F.3d 959, 964 (9th Cir. 2003)); see also Lowry,",
        "paragraph_id": "para_322"
      },
      {
        "text": "858 F.3d at 1256–57. The Officers concede, as they must,",
        "paragraph_id": "para_323"
      },
      {
        "text": "that under our precedent, “pointing guns at a suspect is",
        "paragraph_id": "para_324"
      },
      {
        "text": "deemed a high level of force.” See Thompson v. Rahr, 885",
        "paragraph_id": "para_325"
      },
      {
        "text": "F.3d 582, 586 (9th Cir. 2018) (“In the context of a residential",
        "paragraph_id": "para_326"
      },
      {
        "text": "confrontation, ‘pointing a loaded gun at a suspect,",
        "paragraph_id": "para_327"
      },
      {
        "text": "employing the threat of deadly force, is use of a high level",
        "paragraph_id": "para_328"
      },
      {
        "text": "of force.’” (quoting Espinosa, 598 F.3d at 537)). We thus",
        "paragraph_id": "para_329"
      },
      {
        "text": "agree that the Officers used a high level of force here.",
        "paragraph_id": "para_330"
      },
      {
        "text": "2",
        "paragraph_id": "para_331"
      },
      {
        "text": "“The second step of the excessive force analysis”",
        "paragraph_id": "para_332",
        "court_paragraph": 2
      },
      {
        "text": "requires us “to ‘evaluate the government’s interest in the use",
        "paragraph_id": "para_333"
      },
      {
        "text": "of force.’” Lowry, 858 F.3d at 1257 (quoting Glenn v.",
        "paragraph_id": "para_334"
      },
      {
        "text": "Washington County, 673 F.3d 864, 871 (9th Cir. 2011)). In",
        "paragraph_id": "para_335"
      },
      {
        "text": "doing so, we look to “three primary factors: ‘(1) the severity",
        "paragraph_id": "para_336"
      },
      {
        "text": "of the crime at issue, (2) whether the suspect posed an",
        "paragraph_id": "para_337"
      },
      {
        "text": "immediate threat to the safety of the officers or others, and",
        "paragraph_id": "para_338"
      },
      {
        "text": "(3) whether the suspect was actively resisting arrest or",
        "paragraph_id": "para_339"
      },
      {

      },
      {
        "text": "attempting to evade arrest by flight.’” Id. (quoting Miller,",
        "paragraph_id": "para_341"
      },
      {
        "text": "340 F.3d at 964); see also Graham, 490 U.S. at 396",
        "paragraph_id": "para_342"
      },
      {
        "text": "(establishing factors). These factors “are not exclusive,” and",
        "paragraph_id": "para_343"
      },
      {
        "text": "we may also evaluate other relevant factors such as",
        "paragraph_id": "para_344"
      },
      {
        "text": "“‘whether proper warnings were given’ and ‘the availability",
        "paragraph_id": "para_345"
      },
      {
        "text": "of less intrusive alternatives to the force employed.’” Lowry,",
        "paragraph_id": "para_346"
      },
      {
        "text": "858 F.3d at 1257, 1259 (quoting Glenn, 673 F.3d at 872).",
        "paragraph_id": "para_347"
      },
      {
        "text": "The key factor is “whether the suspect pose[d] a threat.”",
        "paragraph_id": "para_348"
      },
      {
        "text": "Hopson, 71 F.4th at 698.",
        "paragraph_id": "para_349"
      },
      {
        "text": "Severity of the crimes at issue",
        "paragraph_id": "para_350"
      },
      {
        "text": "The Officers sought to arrest Medrano for being on the",
        "paragraph_id": "para_351"
      },
      {
        "text": "run from “a felony ‘no bail’ federal warrant . . . related to",
        "paragraph_id": "para_352"
      },
      {
        "text": "felony drug charges,” and for fleeing from other BGPD",
        "paragraph_id": "para_353"
      },
      {
        "text": "officers during a recent local traffic stop. Three separate",
        "paragraph_id": "para_354"
      },
      {
        "text": "potential crimes are at issue here: distribution of dangerous",
        "paragraph_id": "para_355"
      },
      {
        "text": "drugs (methamphetamine), failure to appear (in the drug",
        "paragraph_id": "para_356"
      },
      {
        "text": "distribution case), and resisting arrest. See 21 U.S.C.§ 841",
        "paragraph_id": "para_357"
      },
      {
        "text": "(a)(1), (b)(1)(B)(viii); 18 U.S.C. § 3146(b); Cal Pen. Code",
        "paragraph_id": "para_358"
      },
      {
        "text": "§ 148(a)(1). The first two of these three are felony offenses",
        "paragraph_id": "para_359"
      },
      {
        "text": "that carry significant criminal penalties. 21 U.S.C.",
        "paragraph_id": "para_360"
      },
      {
        "text": "§§ 841(b), 18 U.S.C. § 3146.",
        "paragraph_id": "para_361"
      },
      {
        "text": "Medrano argues that the crimes at issue were not severe",
        "paragraph_id": "para_362"
      },
      {
        "text": "because (1) his methamphetamine distribution crime did not",
        "paragraph_id": "para_363"
      },
      {
        "text": "necessarily include violent conduct, (2) his failure to appear",
        "paragraph_id": "para_364"
      },
      {
        "text": "offense was already resolved, (3) his resisting arrest crime",
        "paragraph_id": "para_365"
      },
      {
        "text": "was only a misdemeanor, and (4) he was not actively",
        "paragraph_id": "para_366"
      },
      {
        "text": "engaging in any felonious conduct at the time of the arrest.",
        "paragraph_id": "para_367"
      },
      {
        "text": "The Officers, however, had no reason to know that his drug",
        "paragraph_id": "para_368"
      },
      {
        "text": "distribution offense did not include violent conduct or that",
        "paragraph_id": "para_369"
      },
      {
        "text": "the arrest warrant was no longer active.",
        "paragraph_id": "para_370"
      },
      {
        "text": "We cannot judge the Officers’ conduct through the lens",
        "paragraph_id": "para_371"
      },
      {
        "text": "of “facts that [they] reasonably would not have known[.]”",
        "paragraph_id": "para_372"
      },
      {
        "text": "MEDRANO V. ACOSTA 13",
        "paragraph_id": "para_373"
      },
      {
        "text": "Lowry, 858 F.3d at 1256. Considering that the Officers had",
        "paragraph_id": "para_374"
      },
      {
        "text": "an objective basis to think that Medrano was actively on the",
        "paragraph_id": "para_375"
      },
      {
        "text": "run from a felony arrest warrant related to distributing",
        "paragraph_id": "para_376"
      },
      {
        "text": "dangerous drugs (and had recently fled from another",
        "paragraph_id": "para_377"
      },
      {
        "text": "encounter with law enforcement), we conclude that they",
        "paragraph_id": "para_378"
      },
      {
        "text": "reasonably believed that the crimes at issue were serious.",
        "paragraph_id": "para_379"
      },
      {
        "text": "Accordingly, this factor weighs in the Officers’ favor.",
        "paragraph_id": "para_380"
      },
      {
        "text": "Whether Medrano posed an immediate threat to safety",
        "paragraph_id": "para_381"
      },
      {
        "text": "We next consider whether it was reasonable for the",
        "paragraph_id": "para_382"
      },
      {
        "text": "Officers to believe that Medrano presented a threat to their",
        "paragraph_id": "para_383"
      },
      {
        "text": "safety. We do so, bearing in mind that the “calculus of",
        "paragraph_id": "para_384"
      },
      {
        "text": "reasonableness must embody allowance for the fact that",
        "paragraph_id": "para_385"
      },
      {
        "text": "police officers are often forced to make split-second",
        "paragraph_id": "para_386"
      },
      {
        "text": "judgments—in circumstances that are tense, uncertain, and",
        "paragraph_id": "para_387"
      },
      {
        "text": "rapidly evolving—about the use of force that is necessary in",
        "paragraph_id": "para_388"
      },
      {
        "text": "a particular situation[.]” Robinson v. Solano County, 278",
        "paragraph_id": "para_389"
      },
      {
        "text": "F.3d 1007, 1009 (9th Cir. 2002) (en banc) (quoting Graham,",
        "paragraph_id": "para_390"
      },
      {
        "text": "490 U.S. at 395).",
        "paragraph_id": "para_391"
      },
      {
        "text": "Upon making contact with Medrano, the Officers did not",
        "paragraph_id": "para_392"
      },
      {
        "text": "have an opportunity to check him for weapons and saw him",
        "paragraph_id": "para_393"
      },
      {
        "text": "with a pit bull. The Officers knew that Medrano had",
        "paragraph_id": "para_394"
      },
      {
        "text": "previously been on the run from law enforcement related to",
        "paragraph_id": "para_395"
      },
      {
        "text": "felony drug distribution charges; believed that he still was an",
        "paragraph_id": "para_396"
      },
      {
        "text": "active fugitive; and were aware that he had recently fled",
        "paragraph_id": "para_397"
      },
      {
        "text": "during another attempt by law enforcement to detain him.",
        "paragraph_id": "para_398"
      },
      {
        "text": "They also believed that he had long been affiliated with a",
        "paragraph_id": "para_399"
      },
      {
        "text": "local street gang. And they knew that Medrano’s mother had",
        "paragraph_id": "para_400"
      },
      {
        "text": "recently called the police to have Medrano arrested, due to",
        "paragraph_id": "para_401"
      },
      {
        "text": "his erratic behavior and her knowledge of his outstanding",
        "paragraph_id": "para_402"
      },
      {
        "text": "arrest warrant. The totality of these circumstances would",
        "paragraph_id": "para_403"
      },
      {
        "text": "lead reasonable officers to believe that Medrano posed an",
        "paragraph_id": "para_404"
      },
      {
        "text": "objective threat, at least until they had an opportunity to",
        "paragraph_id": "para_405"
      },
      {
        "text": "14 MEDRANO V. ACOSTA",
        "paragraph_id": "para_406"
      },
      {
        "text": "“secure the premises and to ensure their own safety.” Los",
        "paragraph_id": "para_407"
      },
      {
        "text": "Angeles County v. Rettele, 550 U.S. 609, 614 (2007).",
        "paragraph_id": "para_408"
      },
      {
        "text": "Medrano contends that he “presented little to no",
        "paragraph_id": "para_409"
      },
      {
        "text": "objective threat” to the Officers’ safety and that he fully",
        "paragraph_id": "para_410"
      },
      {
        "text": "complied with their commands. He disputes that he actually",
        "paragraph_id": "para_411"
      },
      {
        "text": "had gang affiliations. He argues that the evidence does not",
        "paragraph_id": "para_412"
      },
      {
        "text": "show that the Officers suspected Medrano of having a",
        "paragraph_id": "para_413"
      },
      {
        "text": "firearm or that the dog presented a threat. He also contends",
        "paragraph_id": "para_414"
      },
      {
        "text": "that he was compliant and did not pose a flight risk.",
        "paragraph_id": "para_415"
      },
      {
        "text": "Medrano’s arguments are not persuasive because they",
        "paragraph_id": "para_416"
      },
      {
        "text": "each require us to view the circumstances “based on facts",
        "paragraph_id": "para_417"
      },
      {
        "text": "that [a reasonable officer] would not have known or",
        "paragraph_id": "para_418"
      },
      {
        "text": "anticipated,” and “with the 20/20 vision of hindsight.”",
        "paragraph_id": "para_419"
      },
      {
        "text": "Lowry, 858 F.3d at 1256; Graham, 490 U.S. at 396. But,",
        "paragraph_id": "para_420"
      },
      {
        "text": "even accepting the facts as alleged by Medrano, we find that",
        "paragraph_id": "para_421"
      },
      {
        "text": "reasonable officers confronting the circumstances here",
        "paragraph_id": "para_422"
      },
      {
        "text": "would justifiably determine that Medrano presented a threat",
        "paragraph_id": "para_423"
      },
      {
        "text": "to their safety. Therefore, this factor, “the most important",
        "paragraph_id": "para_424"
      },
      {
        "text": "single element” of our inquiry, weighs in favor of the",
        "paragraph_id": "para_425"
      },
      {
        "text": "Officers. See Chew v. Gates, 27 F.3d 1432, 1441 (9th Cir.",
        "paragraph_id": "para_426"
      },
      {
        "text": "1994).",
        "paragraph_id": "para_427"
      },
      {
        "text": "Whether Medrano was actively resisting arrest or",
        "paragraph_id": "para_428"
      },
      {
        "text": "attempting to flee",
        "paragraph_id": "para_429"
      },
      {
        "text": "We turn next to the third factor and conclude that the",
        "paragraph_id": "para_430"
      },
      {
        "text": "Officers had a reasonable basis to believe that Medrano was",
        "paragraph_id": "para_431"
      },
      {
        "text": "both actively evading arrest and might further resist arrest or",
        "paragraph_id": "para_432"
      },
      {
        "text": "flee. Indeed, the entire interaction at issue was premised",
        "paragraph_id": "para_433"
      },
      {
        "text": "upon the Officers’ reasonable belief that they were arresting",
        "paragraph_id": "para_434"
      },
      {
        "text": "an active fugitive subject to a felony arrest warrant, who had",
        "paragraph_id": "para_435"
      },
      {
        "text": "recently fled from law enforcement. Although Medrano was",
        "paragraph_id": "para_436"
      },
      {
        "text": "not physically resisting arrest at the exact moment the",
        "paragraph_id": "para_437"
      },
      {
        "text": "Officers attempted to arrest him, he was nonetheless",
        "paragraph_id": "para_438"
      },
      {
        "text": "MEDRANO V. ACOSTA 15",
        "paragraph_id": "para_439"
      },
      {
        "text": "generally seeking to evade arrest. See id. at 1442 (finding “a",
        "paragraph_id": "para_440"
      },
      {
        "text": "slight edge goes to the government on this [factor]” under",
        "paragraph_id": "para_441"
      },
      {
        "text": "analogous circumstances where defendant officers sought to",
        "paragraph_id": "para_442"
      },
      {
        "text": "arrest a suspect who had recently fled from a traffic stop and",
        "paragraph_id": "para_443"
      },
      {
        "text": "had outstanding arrest warrants); contra Dissent 28–29.",
        "paragraph_id": "para_444"
      },
      {
        "text": "Medrano’s sole counterargument is that he was",
        "paragraph_id": "para_445"
      },
      {
        "text": "compliant with the Officers’ commands. The Officers,",
        "paragraph_id": "para_446"
      },
      {
        "text": "however, had no reason to believe that he would be",
        "paragraph_id": "para_447"
      },
      {
        "text": "compliant at the time that they drew their weapons and",
        "paragraph_id": "para_448"
      },
      {
        "text": "approached him, given what they already believed about",
        "paragraph_id": "para_449"
      },
      {
        "text": "Medrano. We must “evaluate the nature of any resistance in",
        "paragraph_id": "para_450"
      },
      {
        "text": "light of the actual facts of the case.” Bryan v. MacPherson,",
        "paragraph_id": "para_451"
      },
      {
        "text": "630 F.3d 805, 830 (9th Cir. 2010). In doing so, we find that",
        "paragraph_id": "para_452"
      },
      {
        "text": "this factor provides further support for the Officers.",
        "paragraph_id": "para_453"
      },
      {
        "text": "Other relevant factors",
        "paragraph_id": "para_454"
      },
      {
        "text": "Medrano urges us to consider several other factors. He",
        "paragraph_id": "para_455"
      },
      {
        "text": "asserts that: (1) “less intrusive methods of arresting [him]",
        "paragraph_id": "para_456"
      },
      {
        "text": "were available,” (2) the “Officers did not adequately warn",
        "paragraph_id": "para_457"
      },
      {
        "text": "[him] prior to pointing a gun at his head,” and (3) the",
        "paragraph_id": "para_458"
      },
      {
        "text": "“Officers failed to identify themselves as law enforcement.”",
        "paragraph_id": "para_459"
      },
      {
        "text": "We find these points unpersuasive. As an initial matter,",
        "paragraph_id": "para_460"
      },
      {
        "text": "it is not clear what less intrusive method would have been",
        "paragraph_id": "para_461"
      },
      {
        "text": "effective here. Medrano claims that the Officers could have",
        "paragraph_id": "para_462"
      },
      {
        "text": "“knocked on the front door or called to Medrano without",
        "paragraph_id": "para_463"
      },
      {
        "text": "pointing their guns at his head.” But the Officers had an",
        "paragraph_id": "para_464"
      },
      {
        "text": "objective basis to believe that Medrano was actively evading",
        "paragraph_id": "para_465"
      },
      {
        "text": "a felony arrest warrant, had recently fled from law",
        "paragraph_id": "para_466"
      },
      {
        "text": "enforcement, and was potentially dangerous. With a six-foot",
        "paragraph_id": "para_467"
      },
      {
        "text": "fence separating the Officers from Medrano, the Officers",
        "paragraph_id": "para_468"
      },
      {
        "text": "could have reasonably believed that their use of force was",
        "paragraph_id": "para_469"
      },
      {
        "text": "the best method of ensuring compliance while preventing the",
        "paragraph_id": "para_470"
      },
      {
        "text": "situation from escalating. As we have said before, “officers",
        "paragraph_id": "para_471"
      },
      {
        "text": "16 MEDRANO V. ACOSTA",
        "paragraph_id": "para_472"
      },
      {
        "text": "‘are not required to use the least intrusive degree of force",
        "paragraph_id": "para_473"
      },
      {
        "text": "possible.’” Lowry, 858 F.3d at 1259 (quoting Nelson v. City",
        "paragraph_id": "para_474"
      },
      {
        "text": "of Davis, 685 F.3d 867, 882 (9th Cir. 2012)).",
        "paragraph_id": "para_475"
      },
      {
        "text": "Similarly, the fact that the Officers did not provide a",
        "paragraph_id": "para_476"
      },
      {
        "text": "warning has little relevance because in this context the",
        "paragraph_id": "para_477"
      },
      {
        "text": "Officers’ use of force served as a warning to Medrano so as",
        "paragraph_id": "para_478"
      },
      {
        "text": "to mitigate the need to use additional, potentially deadly",
        "paragraph_id": "para_479"
      },
      {
        "text": "force. Cf. Robinson, 278 F.3d at 1018 (Fernandez, J.,",
        "paragraph_id": "para_480"
      },
      {
        "text": "concurring) (“The threat [of force] may . . . escalate and",
        "paragraph_id": "para_481"
      },
      {
        "text": "finally lead to an excessive application of force to the person",
        "paragraph_id": "para_482"
      },
      {
        "text": "of another. Still, the threat alone is not that application. One",
        "paragraph_id": "para_483"
      },
      {
        "text": "can bare a fang without biting.”); Thompson, 885 F.3d at 586",
        "paragraph_id": "para_484"
      },
      {
        "text": "(noting that “pointing a loaded gun at a suspect” is a “threat",
        "paragraph_id": "para_485"
      },
      {
        "text": "of deadly force” (quoting Espinosa, 598 F.3d at 537)). Nor",
        "paragraph_id": "para_486"
      },
      {
        "text": "is there any reason to believe that the Officers identifying",
        "paragraph_id": "para_487"
      },
      {
        "text": "themselves would have made a difference, because Medrano",
        "paragraph_id": "para_488"
      },
      {
        "text": "has never asserted that he did not know that the Officers were",
        "paragraph_id": "para_489"
      },
      {
        "text": "law enforcement.",
        "paragraph_id": "para_490"
      },
      {
        "text": "In sum, Officers Acosta and Roberts reasonably believed",

        "text": "offenses, posed a threat to their safety, and was actively on",
        "paragraph_id": "para_493"
      },

        "text": "the run from a felony arrest warrant and may again attempt",
        "paragraph_id": "para_494"
      },
      {
        "text": "to flee. Therefore, the Officers had strong countervailing",
        "paragraph_id": "para_495"
      },
      {
        "text": "interests in employing the force at issue here.",
        "paragraph_id": "para_496"
      },
      {
        "text": "3",
        "paragraph_id": "para_497"
      },
      {
        "text": "Finally, we balance the parties’ respective interests,",
        "paragraph_id": "para_498",
        "court_paragraph": 3
      },
      {
        "text": "remaining mindful that “[t]he operative question . . . is",
        "paragraph_id": "para_499"
      },
      {
        "text": "‘whether the totality of the circumstances justified’” the",
        "paragraph_id": "para_500"
      },
      {
        "text": "Officers’ actions here. Mendez, 581 U.S. at 428 (quoting",
        "paragraph_id": "para_501"
      },
      {
        "text": "Garner, 471 U.S. at 8–9). On the one hand, the Officers used",
        "paragraph_id": "para_502"
      },
      {
        "text": "a high level of force that did not physically injure Medrano",
        "paragraph_id": "para_503"
      },
      {
        "text": "but nonetheless allegedly placed him “in shock” and “in fear",
        "paragraph_id": "para_504"
      },
      {

      {
        "text": "for [his] life.” On the other hand, the Officers had an",
        "paragraph_id": "para_506"
      },
      {
        "text": "objective basis to reasonably believe that Medrano: (1) had",
        "paragraph_id": "para_507"
      },
      {
        "text": "committed multiple serious felony offenses; (2) presented an",
        "paragraph_id": "para_508"
      },
      {
        "text": "objective threat to their safety; and (3) was actively evading",
        "paragraph_id": "para_509"
      },
      {
        "text": "arrest on a felony warrant and may continue to do so.",
        "paragraph_id": "para_510"
      },
      {
        "text": "An officer’s “right to make an arrest . . . necessarily",
        "paragraph_id": "para_511"
      },
      {
        "text": "carries with it the right to use some degree of physical",
        "paragraph_id": "para_512"
      },
      {
        "text": "coercion or threat thereof to effect it.” Graham, 490 U.S. at",
        "paragraph_id": "para_513"
      },
      {
        "text": "394. And “[w]hen officers execute a valid warrant and act",
        "paragraph_id": "para_514"
      },
      {
        "text": "in a reasonable manner to protect themselves from harm . . .",
        "paragraph_id": "para_515"
      },
      {
        "text": "the Fourth Amendment is not violated.” Rettele, 550 U.S. at",
        "paragraph_id": "para_516"
      },
      {
        "text": "616. Here, the Officers’ conduct fits that description. We",
        "paragraph_id": "para_517"
      },
      {
        "text": "thus hold that the Officers’ use of force under these",
        "paragraph_id": "para_518"
      },
      {
        "text": "circumstances was reasonable and did not violate Medrano’s",
        "paragraph_id": "para_519"
      },
      {
        "text": "Fourth Amendment rights.",
        "paragraph_id": "para_520"
      },
      {
        "text": "C",
        "paragraph_id": "para_521"
      },
      {
        "text": "Even assuming that the Officers used excessive force,",
        "paragraph_id": "para_522"
      },
      {
        "text": "Medrano’s claim still fails because the Officers “enjoy",
        "paragraph_id": "para_523"
      },
      {
        "text": "qualified immunity from suit under § 1983 unless their",
        "paragraph_id": "para_524"
      },
      {
        "text": "conduct violates clearly established law.” Zorn, 607 U.S. at",
        "paragraph_id": "para_525"
      },
      {
        "text": "571. “A right is clearly established when it is ‘sufficiently",
        "paragraph_id": "para_526"
      },
      {
        "text": "clear that every reasonable official would have understood",
        "paragraph_id": "para_527"
      },
      {
        "text": "that what he is doing violates that right.’” Id. (quoting Rivas-",
        "paragraph_id": "para_528"
      },
      {
        "text": "Villegas v. Cortesluna, 595 U.S. 1, 5 (2021). “A right is not",
        "paragraph_id": "para_529"
      },
      {
        "text": "clearly established if existing precedent does not place the",
        "paragraph_id": "para_530"
      },
      {
        "text": "constitutional question ‘beyond debate.’” Id. (quoting",
        "paragraph_id": "para_531"
      },
      {
        "text": "Rivas-Villegas, 595 U.S. at 5). “The relevant precedent must",
        "paragraph_id": "para_532"
      },
      {
        "text": "define the right with ‘a high degree of specificity,’ so that",
        "paragraph_id": "para_533"
      },
      {
        "text": "‘every reasonable official would interpret it to establish the",
        "paragraph_id": "para_534"
      },
      {
        "text": "particular rule the plaintiff seeks to apply.’” Id. (quoting",
        "paragraph_id": "para_535"
      },
      {
        "text": "Wesby, 583 U.S. at 63). “The rule’s contours must be so well",
        "paragraph_id": "para_536"
      },
      {
        "text": "defined that it is ‘clear to a reasonable officer that his",
        "paragraph_id": "para_537"
      },
      {

      },
      {
        "text": "conduct was unlawful in the situation he confronted.’”",
        "paragraph_id": "para_539"
      },
      {
        "text": "Wesby, 583 U.S. at 63 (quoting Saucier, 533 U.S. at 202).",
        "paragraph_id": "para_540"
      },
      {
        "text": "Medrano argues that our Court’s holding in Robinson v.",
        "paragraph_id": "para_541"
      },
      {
        "text": "Solano County, 278 F.3d at 1014, clearly established the",
        "paragraph_id": "para_542"
      },
      {
        "text": "unlawfulness of the Officers’ conduct. We disagree.",
        "paragraph_id": "para_543"
      },
      {
        "text": "“In Robinson, we held that police used excessive force",
        "paragraph_id": "para_544"
      },
      {
        "text": "in pointing their guns at a 64-year old unarmed retired police",
        "paragraph_id": "para_545"
      },
      {
        "text": "officer who had his hand up.” Thomspon, 885 F.3d at 588",
        "paragraph_id": "para_546"
      },
      {
        "text": "(9th Cir. 2018) (citing Robinson, 278 F.3d at 1010, 1015).",
        "paragraph_id": "para_547"
      },
      {
        "text": "There, police officers responded to “a radio dispatch",
        "paragraph_id": "para_548"
      },
      {
        "text": "regarding a man carrying a shotgun who had just shot two",
        "paragraph_id": "para_549"
      },
      {
        "text": "dogs and [was] ‘in the middle of the street yelling[.]’”",
        "paragraph_id": "para_550"
      },
      {
        "text": "Robinson, 278 F.3d at 1010. When the officers arrived at",
        "paragraph_id": "para_551"
      },
      {
        "text": "Robinson’s home, Robinson went out to greet the officers",
        "paragraph_id": "para_552"
      },
      {
        "text": "and two of them pulled out their guns from roughly six feet",
        "paragraph_id": "para_553"
      },
      {
        "text": "away. Id. Robinson put his hands over his head at one of",
        "paragraph_id": "para_554"
      },
      {
        "text": "the officer’s command. Id. That officer then “thrust his gun",
        "paragraph_id": "para_555"
      },
      {
        "text": "three or four feet from Robinson’s head.” Id. We ruled that",
        "paragraph_id": "para_556"
      },
      {
        "text": "“[a] police officer who terrorizes a civilian by brandishing a",
        "paragraph_id": "para_557"
      },
      {
        "text": "cocked gun in front of that civilian’s face may not cause",
        "paragraph_id": "para_558"
      },
      {
        "text": "physical injury, but he has certainly laid the building blocks",
        "paragraph_id": "para_559"
      },
      {
        "text": "for a section 1983 claim against him.” Id. at 1015 (quoting",
        "paragraph_id": "para_560"
      },
      {
        "text": "Petta v. Rivera, 143 F.3d 895, 905 (5th Cir. 1998))",
        "paragraph_id": "para_561"
      },
      {
        "text": "(emphasis in original).",
        "paragraph_id": "para_562"
      },
      {
        "text": "Robinson is not analogous to this case and certainly did",
        "paragraph_id": "para_563"
      },
      {
        "text": "not put the constitutional question at issue here “beyond",
        "paragraph_id": "para_564"
      },
      {
        "text": "debate.” See Rivas-Villegas, 595 U.S. at 5. The police",
        "paragraph_id": "para_565"
      },
      {
        "text": "officers in Robinson did not believe that they were making a",
        "paragraph_id": "para_566"
      },
      {
        "text": "felony arrest but were “investigating a mere misdemeanor.”",
        "paragraph_id": "para_567"
      },
      {
        "text": "Hopson, 71 F.4th at 704 (citing Robinson, 278 F.3d at 1010,",
        "paragraph_id": "para_568"
      },
      {
        "text": "1014). In seizing Robinson, the officers needlessly",
        "paragraph_id": "para_569"
      },
      {
        "text": "“terrorize[d]” him by pointing their firearms at him from",
        "paragraph_id": "para_570"
      },
      {

        "text": "point blank range, despite him having his hands on his head.",
        "paragraph_id": "para_572"
      },
      {
        "text": "See Robinson, 278 F.3d at 1015. Moreover, the officers had",

        "text": "no cause to believe that Robinson was resisting arrest or",
        "paragraph_id": "para_574"
      },
      {
        "text": "would try to flee. These facts are materially different than",
        "paragraph_id": "para_575"
      },
      {
        "text": "those present here, such that our holding in Robinson would",
        "paragraph_id": "para_576"
      },
      {
        "text": "not have made “clear to [the Officers] that [their] conduct",
        "paragraph_id": "para_577"
      },
      {
        "text": "was unlawful in the situation [they] confronted.” Wesby,",
        "paragraph_id": "para_578"
      },
      {
        "text": "583 U.S. at 63 (quoting Saucier, 533 U.S. at 202) (internal",
        "paragraph_id": "para_579"
      },
      {
        "text": "quotation marks omitted).",
        "paragraph_id": "para_580"
      },
      {
        "text": "In denying the Officers qualified immunity, the district",
        "paragraph_id": "para_581"
      },
      {
        "text": "judge looked to Ninth Circuit precedent based on Robinson",
        "paragraph_id": "para_582"
      },
      {
        "text": "that established the specific rule “that officers use",
        "paragraph_id": "para_583"
      },
      {
        "text": "unconstitutionally excessive force when they aim their",
        "paragraph_id": "para_584"
      },
      {
        "text": "weapons at people who are not suspected of violent crimes,",
        "paragraph_id": "para_585"
      },
      {
        "text": "who do not pose a threat, who have complied with the",
        "paragraph_id": "para_586"
      },
      {
        "text": "officer’s instructions, who are not resisting and who are not",
        "paragraph_id": "para_587"
      },
      {
        "text": "attempting to flee.” See, e.g., Thompson, 885 F.3d at 586–",
        "paragraph_id": "para_588"
      },
      {
        "text": "87; Espinosa, 598 F.3d at 538; Hopkins v. Bonvicino, 573",
        "paragraph_id": "para_589"
      },
      {
        "text": "F.3d 752, 776–77 (9th Cir. 2009); Tekle v. United States, 511",
        "paragraph_id": "para_590"
      },
      {
        "text": "F.3d 839, 845–846 (9th Cir. 2007); Robinson, 278 F.3d at",
        "paragraph_id": "para_591"
      },
      {
        "text": "1015. But for the reasons we have explained, that rule does",
        "paragraph_id": "para_592"
      },
      {
        "text": "not square with the circumstances of this case, when viewed",
        "paragraph_id": "para_593"
      },
      {
        "text": "“from the perspective of a reasonable officer on the scene,",
        "paragraph_id": "para_594"
      },
      {
        "text": "rather than with the 20/20 vision of hindsight.” See Graham,",
        "paragraph_id": "para_595"

        "text": "490 U.S. at 396. Accordingly, it did not make “sufficiently",

        "text": "clear” to the Officers here “that what [they were] doing",
        "paragraph_id": "para_597"
      },
      {
        "text": "violate[d]” Medrano’s Fourth Amendment right. See Rivas-",
        "paragraph_id": "para_598"
      },
      {
        "text": "Villegas, 595 U.S. at 5.",
        "paragraph_id": "para_599"
      },
      {
        "text": "III",
        "paragraph_id": "para_600"
      },
      {
        "text": "In this case, the Officers reasonably believed that",
        "paragraph_id": "para_601"
      },
      {
        "text": "Medrano had committed serious offenses, presented a threat",
        "paragraph_id": "para_602"
      },
      {
        "text": "to their safety, and may resist arrest or attempt to flee. By",
        "paragraph_id": "para_603"
      },
      {
        "text": "20 MEDRANO V. ACOSTA",
        "paragraph_id": "para_604"
      },
      {
        "text": "approaching him with firearms drawn and ready to use, we",
        "paragraph_id": "para_605"
      },
      {
        "text": "hold that the Officers did not violate the Fourth Amendment.",
        "paragraph_id": "para_606"
      },
      {
        "text": "We thus reverse and remand with instructions to enter",
        "paragraph_id": "para_607"
      },
      {
        "text": "judgment in favor of the Officers.",
        "paragraph_id": "para_608"
      },
      {
        "text": "REVERSED and REMANDED.",

      {

        "text": "I concur in Section II.C of the majority opinion on the",

      },
      {
        "text": "question of clearly established law. I respectfully dissent,",

        "text": "however, from the majority’s conclusion that Officers",
        "paragraph_id": "para_614"
      },
      {
        "text": "Acosta and Roberts did not violate Alex Medrano’s Fourth",
        "paragraph_id": "para_615"

        "text": "The majority concludes that it was objectively",

      },
      {
        "text": "reasonable for the Officers to aim their guns at Medrano’s",

        "text": "head from near point-blank range, as a matter of",
        "paragraph_id": "para_619"
      },
      {
        "text": "constitutional law, such that no rational jury could conclude",
        "paragraph_id": "para_620"
      },
      {
        "text": "otherwise. That decision is both unnecessary and flawed.",
        "paragraph_id": "para_621"
      },
      {
        "text": "The decision is unnecessary because we could have, and",
        "paragraph_id": "para_622"
      },
      {
        "text": "should have, resolved this case on the second prong of the",
        "paragraph_id": "para_623"
      },
      {
        "text": "qualified immunity analysis. We are not required to address",
        "paragraph_id": "para_624"
      },
      {
        "text": "both prongs, and doing so may run “counter to the older,",
        "paragraph_id": "para_625"
      },
      {
        "text": "wiser judicial counsel not to pass on questions of",
        "paragraph_id": "para_626"
      },
      {
        "text": "constitutionality . . . unless such adjudication is",
        "paragraph_id": "para_627"
      },
      {
        "text": "unavoidable.” Pearson v. Callahan, 555 U.S. 223, 241",

        "text": "the majority’s decision turns on many unique facts, see infra",

        "text": "Section II.A, the constitutional question is “so factbound that",
        "paragraph_id": "para_636"
      },
      {
        "text": "the decision provides little guidance for future cases.” Id. at",
        "paragraph_id": "para_637"
      },
      {
        "text": "237. Second, and because of that unique confluence of facts,",
        "paragraph_id": "para_638"
      },
      {
        "text": "the clearly established question in this case is far easier than",
        "paragraph_id": "para_639"
      },
      {
        "text": "the constitutional question.1 Id. at 239.",

      },
      {
        "text": "That risk of bad decisionmaking is borne out here. The",
        "paragraph_id": "para_641"

        "text": "majority holds that it is objectively reasonable, as a matter",

        "text": "of law, for officers to rely on non-violent acts long predating",

        "text": "an arrest to treat a suspect as immediately dangerous and",

        "text": "actively evading arrest at the scene. The majority also",
        "paragraph_id": "para_645"
      },
      {
        "text": "intimates, in direct conflict with Robinson v. Solano County,",
        "paragraph_id": "para_646"
      },
      {
        "text": "278 F.3d 1007 (9th Cir. 2002) (en banc), that aiming a gun",
        "paragraph_id": "para_647"
      },
      {
        "text": "at a suspect is a warning, rather than a use of force. And the",
        "paragraph_id": "para_648"
      },
      {
        "text": "majority ignores a squarely presented argument on a less",
        "paragraph_id": "para_649"
      },
      {
        "text": "intrusive alternative that we have repeatedly held precludes",
        "paragraph_id": "para_650"
      },
      {
        "text": "summary judgment: holding a gun in the low-ready position,",
        "paragraph_id": "para_651"
      },
      {
        "text": "ready to employ but away from the suspect.",

        "text": "I address the majority’s errors at each step of the Fourth",

      {
        "text": "the fact of Medrano’s gang affiliation as a given.",
        "paragraph_id": "para_665"
      },
      {
        "text": "22 MEDRANO V. ACOSTA",
        "paragraph_id": "para_666"
      },
      {
        "text": "I. Nature and Quality of the Intrusion",
        "paragraph_id": "para_667"
      },
      {
        "text": "In all of three sentences, the majority concludes that “the",
        "paragraph_id": "para_668"
      },
      {
        "text": "Officers used a high level of force.” Majority 11. While I",
        "paragraph_id": "para_669"
      },
      {
        "text": "agree with the bottom-line conclusion, the majority’s",
        "paragraph_id": "para_670"
      },
      {
        "text": "analysis omits important detail.",
        "paragraph_id": "para_671"
      },
      {
        "text": "“Rather than relying on broad characterizations, we must",
        "paragraph_id": "para_672"
      },
      {
        "text": "evaluate the nature of the specific force employed in a",
        "paragraph_id": "para_673"
      },
      {
        "text": "specific factual situation.” Bryan v. MacPherson, 630 F.3d",
        "paragraph_id": "para_674"
      },
      {
        "text": "805, 825 (9th Cir. 2010). And, to be specific, aiming a gun",
        "paragraph_id": "para_675"
      },
      {
        "text": "at a suspect’s head from near point-blank range is a far",
        "paragraph_id": "para_676"
      },
      {
        "text": "greater use of force than aiming anywhere else or from a",
        "paragraph_id": "para_677"
      },
      {
        "text": "greater distance. See Robinson, 278 F.3d at 1010, 1014–15.",
        "paragraph_id": "para_678"
      },
      {
        "text": "It is the threat of instant death.",
        "paragraph_id": "para_679"
      },
      {
        "text": "Here, the majority omits from its analysis that the",
        "paragraph_id": "para_680"
      },
      {
        "text": "Officers aimed their guns at Medrano’s head from as close",
        "paragraph_id": "para_681"
      },
      {
        "text": "as three to five feet away. Medrano testified that the Officers",
        "paragraph_id": "para_682"
      },
      {
        "text": "were ten to twenty feet away “when [he] first noticed",
        "paragraph_id": "para_683"
      },
      {
        "text": "[them],” but also that they kept their guns aimed at his head",
        "paragraph_id": "para_684"
      },
      {
        "text": "at least until he reached the fence, roughly three feet away",
        "paragraph_id": "para_685"
      },
      {
        "text": "from the Officers. On the Officers’ account, their guns were",
        "paragraph_id": "para_686"
      },
      {
        "text": "as close as five feet away from Medrano.",
        "paragraph_id": "para_687"
      },
      {
        "text": "Without these details, we cannot properly weigh the",
        "paragraph_id": "para_688"
      },
      {
        "text": "intrusion against the government’s interest, identify fact-",
        "paragraph_id": "para_689"
      },
      {
        "text": "specific alternatives (e.g., aiming elsewhere), or ask how the",
        "paragraph_id": "para_690"
      },
      {
        "text": "balance of interests changed as the arrest progressed. See",
        "paragraph_id": "para_691"
      },
      {
        "text": "infra Sections II.D, III.",
        "paragraph_id": "para_692"
      },
      {
        "text": "II. Government Interests",
        "paragraph_id": "para_693"
      },
      {
        "text": "A. Immediate Threat to Safety",
        "paragraph_id": "para_694"
      },
      {
        "text": "“The central issue is whether it was objectively",
        "paragraph_id": "para_695"
      },
      {
        "text": "reasonable under the circumstances for the deputies to",
        "paragraph_id": "para_696"
      },
      {
        "text": "MEDRANO V. ACOSTA 23",
        "paragraph_id": "para_697"
      },
      {
        "text": "believe that [Medrano] posed an immediate threat to their",
        "paragraph_id": "para_698"
      },
      {
        "text": "safety.” Hayes v. County of San Diego, 736 F.3d 1223, 1233",
        "paragraph_id": "para_699"
      },
      {
        "text": "(9th Cir. 2013). If a reasonable jury could find that Medrano",
        "paragraph_id": "para_700"
      },
      {
        "text": "“posed no immediate safety threat,” then this factor weighs",
        "paragraph_id": "para_701"
      },
      {
        "text": "against the Officers. Chew v. Gates, 27 F.3d 1432, 1442 (9th",
        "paragraph_id": "para_702"
      },
      {
        "text": "Cir. 1994) (original emphasis). Because there are many",
        "paragraph_id": "para_703"
      },
      {
        "text": "ways to view the objective danger posed by a fact-intensive",
        "paragraph_id": "para_704"
      },
      {
        "text": "scenario, we routinely leave this question to the jury. See,",
        "paragraph_id": "para_705"
      },
      {

        "text": "Under these standards, a rational jury could easily",
        "paragraph_id": "para_711"
      },
      {
        "text": "conclude that Medrano posed no immediate danger to the",
        "paragraph_id": "para_712"
      },
      {
        "text": "Officers or anyone else. The Officers did not suspect",
        "paragraph_id": "para_713"
      },
      {
        "text": "Medrano of any violent crimes. Medrano neither appeared",
        "paragraph_id": "para_714"
      },
      {
        "text": "to be armed nor gave the Officers any reason to believe he",
        "paragraph_id": "para_715"
      },
      {
        "text": "would be. Medrano was also “compliant” and",
        "paragraph_id": "para_716"
      },
      {
        "text": "“outnumbered,” and five other officers surrounded the",
        "paragraph_id": "para_717"
      },
      {
        "text": "home, all of which “counts against a finding that []he posed",
        "paragraph_id": "para_718"
      },
      {
        "text": "a threat.” Green v. City & County of San Francisco, 751",
        "paragraph_id": "para_719"
      },
      {
        "text": "F.3d 1039, 1050 (9th Cir. 2014). I would thus conclude that",
        "paragraph_id": "para_720"
      },
      {
        "text": "this most important factor weighs in favor of Medrano.",
        "paragraph_id": "para_721"
      },
      {
        "text": "The majority and the Officers contend that six facts",
        "paragraph_id": "para_722"
      },
      {
        "text": "compel the conclusion that Medrano posed an immediate",
        "paragraph_id": "para_723"
      },
      {
        "text": "danger: 1) one month before the arrest, Medrano skipped a",
        "paragraph_id": "para_724"
      },
      {
        "text": "detention hearing in his drug distribution case; 2) two weeks",
        "paragraph_id": "para_725"
      },
      {
        "text": "before the arrest, Medrano fled a traffic stop; 3) also two",
        "paragraph_id": "para_726"
      },
      {
        "text": "weeks prior, Medrano was acting erratically at his mother’s",
        "paragraph_id": "para_727"
      },
      {
        "text": "house, spray-painting her walls; 4) at the scene, Medrano",
        "paragraph_id": "para_728"
      },
      {
        "text": "was with a pitbull; 5) the Officers believed Medrano was",
        "paragraph_id": "para_729"
      },
      {
        "text": "affiliated with a gang; and 6) the Officers had not checked",
        "paragraph_id": "para_730"
      },
      {
        "text": "24 MEDRANO V. ACOSTA",
        "paragraph_id": "para_731"
      },
      {
        "text": "Medrano for weapons. Properly applying our case law, a",
        "paragraph_id": "para_732"
      },
      {
        "text": "rational jury could discount each of these facts.",
        "paragraph_id": "para_733"
      },
      {
        "text": "The first three facts are irrelevant to the danger inquiry",
        "paragraph_id": "para_734"
      },
      {
        "text": "twice over: they are stale and nonviolent. The majority",
        "paragraph_id": "para_735"
      },
      {
        "text": "offers no authority for the proposition that events long",
        "paragraph_id": "para_736"
      },
      {
        "text": "predating an arrest make a suspect objectively and",
        "paragraph_id": "para_737"
      },
      {
        "text": "immediately dangerous at the scene as a matter of law. For",
        "paragraph_id": "para_738"
      },
      {
        "text": "good reason. The Graham standard requires facts showing",
        "paragraph_id": "para_739"
      },
      {
        "text": "that the “the suspect poses an immediate threat to the safety",
        "paragraph_id": "para_740"
      },
      {
        "text": "of the officers or others.” 490 U.S. at 396 (emphasis added).",
        "paragraph_id": "para_741"
      },
      {
        "text": "Accordingly, it is the law of this circuit to reject inferences",
        "paragraph_id": "para_742"
      },
      {
        "text": "from prior conduct against the nonmovant at summary",
        "paragraph_id": "para_743"
      },
      {
        "text": "judgment. For instance, in Robinson, we rejected the",
        "paragraph_id": "para_744"
      },
      {
        "text": "officers’ argument that Robinson necessarily posed an",
        "paragraph_id": "para_745"
      },
      {
        "text": "immediate danger because he shot two dogs shortly before",
        "paragraph_id": "para_746"
      },
      {
        "text": "officers arrived on the scene. 278 F.3d at 1014. We",
        "paragraph_id": "para_747"
      },
      {
        "text": "emphasized that “[t]here were no dangerous or exigent",
        "paragraph_id": "para_748"
      },
      {
        "text": "circumstances apparent at the time of the detention.” Id.",
        "paragraph_id": "para_749"
      },
      {
        "text": "(emphasis added).",
        "paragraph_id": "para_750"
      },
      {
        "text": "Not only were Medrano’s prior flights and spray-",
        "paragraph_id": "para_751"
      },
      {
        "text": "painting incident stale, they were also nonviolent. Skipping",
        "paragraph_id": "para_752"
      },
      {
        "text": "a hearing and fleeing a traffic stop does not necessarily make",
        "paragraph_id": "para_753"
      },
      {
        "text": "one more likely to violently resist arrest, as “neither entail[s]",
        "paragraph_id": "para_754"
      },
      {
        "text": "violence or gun possession.” See A. K. H ex rel. Landeros v.",
        "paragraph_id": "para_755"
      },
      {
        "text": "City of Tustin, 837 F.3d 1005, 1012 (9th Cir. 2016). Nor",
        "paragraph_id": "para_756"
      },
      {
        "text": "does “act[ing] paranoid and spray-paint[ing]” make one",
        "paragraph_id": "para_757"
      },
      {
        "text": "more likely, as a matter of law, to shoot at arresting officers.",
        "paragraph_id": "para_758"
      },
      {
        "text": "To conclude otherwise, the majority improperly resolves an",
        "paragraph_id": "para_759"
      },
      {
        "text": "inferential dispute against Medrano. See Green, 751 F.3d at",
        "paragraph_id": "para_760"
      },
      {
        "text": "1050.",
        "paragraph_id": "para_761"
      },
      {
        "text": "The fourth fact—the pitbull—is categorically irrelevant.",
        "paragraph_id": "para_762"
      },
      {
        "text": "It is undisputed that the Officers were separated from the dog",
        "paragraph_id": "para_763"
      },
      {

      },
      {
        "text": "by a metal fence. The Officers would have had to jump the",
        "paragraph_id": "para_765"
      },
      {
        "text": "fence into the backyard to encounter any danger posed by",
        "paragraph_id": "para_766"
      },
      {
        "text": "the dog.",
        "paragraph_id": "para_767"
      },
      {
        "text": "That leaves two facts. Fifth, the district court found that",
        "paragraph_id": "para_768"
      },
      {
        "text": "Medrano “who went by the moniker ‘Dreamer,’. . . was",
        "paragraph_id": "para_769"
      },
      {
        "text": "affiliated with the street gang Bell Gardens Locos,” and that",
        "paragraph_id": "para_770"
      },
      {
        "text": "the Officers knew of this affiliation (but apparently no other",
        "paragraph_id": "para_771"
      },
      {
        "text": "details regarding the nature of the affiliation). Sixth, the",
        "paragraph_id": "para_772"
      },
      {
        "text": "Officers had not yet checked Medrano for weapons before",
        "paragraph_id": "para_773"
      },
      {
        "text": "attempting to arrest him.",
        "paragraph_id": "para_774"
      },
      {
        "text": "Neither fact is dispositive. We have previously held that",
        "paragraph_id": "para_775"
      },
      {
        "text": "an individual with a “known gang association” did not",
        "paragraph_id": "para_776"
      },
      {
        "text": "necessarily pose a serious threat to officer safety.",
        "paragraph_id": "para_777"
      },
      {
        "text": "Blankenhorn v. City of Orange, 485 F.3d 463, 478 (9th Cir.",
        "paragraph_id": "para_778"
      },
      {
        "text": "2007); see also Cruz v. City of Anaheim, 765 F.3d 1076 (9th",
        "paragraph_id": "para_779"
      },
      {
        "text": "Cir. 2014) (holding, in a deadly force case, that a gang",
        "paragraph_id": "para_780"
      },
      {
        "text": "member known to carry a gun would not have been an",
        "paragraph_id": "para_781"
      },
      {
        "text": "“immediate threat” if he was compliant and not making a",
        "paragraph_id": "para_782"
      },
      {
        "text": "threatening gesture); Landeros, 837 F.3d at 1012 (known",
        "paragraph_id": "para_783"
      },
      {
        "text": "gang member did not necessarily pose an immediate threat",
        "paragraph_id": "para_784"
      },
      {
        "text": "based on other mitigating circumstances). 2 That makes",
        "paragraph_id": "para_785"
      },
      {
        "text": "sense. To hold otherwise would, again, improperly draw an",
        "paragraph_id": "para_786"
      },
      {
        "text": "inference against the nonmovant, this time based on his",
        "paragraph_id": "para_787"
      },
      {
        "text": "associations.",
        "paragraph_id": "para_788"
      },
      {
        "text": "2 Moreover, Medrano disputes that he has an affiliation at all and argues",
        "paragraph_id": "para_789"
      },
      {
        "text": "that the Officers racially profiled him. For present purposes, we must",
        "paragraph_id": "para_790"
      },
      {
        "text": "assume the fact of his gang affiliation. See supra n.1. But if he can",
        "paragraph_id": "para_791"
      },
      {
        "text": "disprove this alleged affiliation at trial, and prove that the Officers’",
        "paragraph_id": "para_792"
      },
      {
        "text": "“mistake of fact” was based on racial profiling rather than a reasonable",
        "paragraph_id": "para_793"
      },
      {
        "text": "basis, that may further undercut the reasonableness of the Officers’",
        "paragraph_id": "para_794"
      },
      {
        "text": "estimation of danger. See S.R. Nehad v. Browder, 929 F.3d 1125, 1133",
        "paragraph_id": "para_795"
      },
      {
        "text": "(9th Cir. 2019).",
        "paragraph_id": "para_796"
      },
      {
        "text": "26 MEDRANO V. ACOSTA",
        "paragraph_id": "para_797"
      },
      {
        "text": "As for the lack of a prior search, we routinely leave it for",
        "paragraph_id": "para_798"
      },
      {
        "text": "the jury to decide whether this circumstance justifies an",
        "paragraph_id": "para_799"
      },
      {
        "text": "officer’s decision to aim a loaded weapon. In Espinosa and",
        "paragraph_id": "para_800"
      },
      {
        "text": "Robinson, for example, the officers had not yet searched the",
        "paragraph_id": "para_801"
      },
      {
        "text": "suspect in either case before aiming their guns. Espinosa,",
        "paragraph_id": "para_802"
      },
      {
        "text": "598 F.3d at 533, 537–38; Robinson, 278 F.3d at 1011.",
        "paragraph_id": "para_803"
      },
      {
        "text": "Nonetheless, we denied summary judgment in both cases.",
        "paragraph_id": "para_804"
      },
      {
        "text": "These two circumstances, then, are just that—",
        "paragraph_id": "para_805"
      },
      {
        "text": "“circumstances,” which “can be viewed in various ways.”",
        "paragraph_id": "para_806"
      },
      {
        "text": "Glenn, 673 F.3d at 878. So, “a jury should have the",
        "paragraph_id": "para_807"
      },
      {
        "text": "opportunity to assess the reasonableness of the force used",
        "paragraph_id": "para_808"
      },
      {
        "text": "after hearing all the evidence.” Id.",
        "paragraph_id": "para_809"
      },
      {
        "text": "The majority claims that it must reach this conclusion",
        "paragraph_id": "para_810"
      },
      {
        "text": "based on Graham’s hindsight directive—that we can only",
        "paragraph_id": "para_811"
      },
      {
        "text": "consider facts known to the officers. Majority 14. But this",
        "paragraph_id": "para_812"
      },
      {
        "text": "confuses two distinct issues: what evidence we may",
        "paragraph_id": "para_813"
      },
      {
        "text": "consider, and how we should look at that evidence.",
        "paragraph_id": "para_814"
      },
      {
        "text": "Graham’s hindsight directive does not bear on the latter.3",
        "paragraph_id": "para_815"
      },
      {
        "text": "Hayes, 736 F.3d at 1234 n.6. As we have already explained:",
        "paragraph_id": "para_816"
      },
      {
        "text": "“The question on summary judgment . . . is not whether",
        "paragraph_id": "para_817"
      },
      {
        "text": "some version of the facts supports [the officers’] position,",
        "paragraph_id": "para_818"
      },
      {
        "text": "but rather whether a trier of fact, viewing the evidence in the",
        "paragraph_id": "para_819"
      },
      {
        "text": "light most favorable to [the plaintiff], could find in [the",
        "paragraph_id": "para_820"
      },
      {
        "text": "plaintiff’s] favor.” S.R. Nehad, 929 F.3d at 1133.",
        "paragraph_id": "para_821"
      },
      {
        "text": "B. Severity of Crime at Issue",
        "paragraph_id": "para_822"
      },
      {
        "text": "“[W]e have established ‘two slightly different ways’ of",
        "paragraph_id": "para_823"
      },
      {
        "text": "assessing the seriousness of the offense in question.” Singh,",
        "paragraph_id": "para_824"
      },
      {
        "text": "3 As Medrano’s last contact with the police was ten days prior to the",
        "paragraph_id": "para_825"
      },
      {
        "text": "arrest, this was not—contrary to the majority’s suggestion—“an",
        "paragraph_id": "para_826"
      },
      {
        "text": "occasion on which the police were forced to make ‘split-second",
        "paragraph_id": "para_827"
      },
      {
        "text": "judgments.’” Chew, 27 F.3d at 1443 (quoting Graham, 490 U.S. at 397).",
        "paragraph_id": "para_828"
      },
      {
        "text": "MEDRANO V. ACOSTA 27",
        "paragraph_id": "para_829"
      },
      {
        "text": "124 F.4th at 752 (quoting S.R. Nehad, 929 F.3d at 1136).",
        "paragraph_id": "para_830"
      },
      {
        "text": "The first is to split crimes into felonies (generally serious)",
        "paragraph_id": "para_831"
      },
      {
        "text": "and misdemeanors (not serious). Id. The second is to use",
        "paragraph_id": "para_832"
      },
      {
        "text": "the severity of the crime at issue as a proxy for the danger",
        "paragraph_id": "para_833"
      },
      {
        "text": "posed by the suspect. Id.",
        "paragraph_id": "para_834"
      },
      {
        "text": "Under the proxy-for-danger approach, none of the crimes",
        "paragraph_id": "para_835"
      },
      {
        "text": "at issue were violent. See supra Section II.A. The majority",
        "paragraph_id": "para_836"
      },
      {
        "text": "acknowledges the argument that the drug distribution charge",
        "paragraph_id": "para_837"
      },
      {
        "text": "did not necessarily entail violent conduct. But it responds",
        "paragraph_id": "para_838"
      },
      {
        "text": "that the Officers had no reason to know the conduct was not",
        "paragraph_id": "para_839"
      },
      {
        "text": "violent, so, as a matter of law, the Officers reasonably",
        "paragraph_id": "para_840"
      },
      {
        "text": "inferred that it was violent. Majority 12. That inference",
        "paragraph_id": "para_841"
      },
      {
        "text": "defies logic and our precedent. See Mattos v. Agarano, 661",
        "paragraph_id": "para_842"
      },
      {
        "text": "F.3d 433, 449 (9th Cir. 2011) (en banc) (“Considering . . .",
        "paragraph_id": "para_843"
      },
      {
        "text": "the severity of the crime at issue, we are mindful that we",
        "paragraph_id": "para_844"
      },
      {
        "text": "must construe the facts in the light most favorable to [the",
        "paragraph_id": "para_845"
      },
      {
        "text": "nonmovant] at this stage.”).",
        "paragraph_id": "para_846"
      },
      {
        "text": "On the felony/misdemeanor dichotomy, the results are",
        "paragraph_id": "para_847"
      },
      {
        "text": "mixed. Medrano was suspected of two felonies and one",
        "paragraph_id": "para_848"
      },
      {
        "text": "misdemeanor. The majority acknowledges, but does not",
        "paragraph_id": "para_849"
      },
      {
        "text": "respond to, Medrano’s argument that the misdemeanor is",
        "paragraph_id": "para_850"
      },
      {
        "text": "necessarily low-severity. I agree with Medrano on this",
        "paragraph_id": "para_851"
      },
      {
        "text": "point. Singh, 124 F.4th at 752 (“[C]ases involving a",
        "paragraph_id": "para_852"
      },
      {
        "text": "misdemeanor [] ‘provide little, if any, basis for a use of",
        "paragraph_id": "para_853"
      },
      {
        "text": "deadly force.’” (quoting S.R. Nehad, 929 F.3d at 1136)).",
        "paragraph_id": "para_854"
      },
      {
        "text": "All else equal, however, the felonies tend to support a",
        "paragraph_id": "para_855"
      },
      {
        "text": "government interest in arresting Medrano. S.R. Nehad, 929",
        "paragraph_id": "para_856"
      },
      {
        "text": "F.3d at 1136. Accordingly, I would hold that this factor tips",
        "paragraph_id": "para_857"
      },
      {
        "text": "slightly in favor of the government.",
        "paragraph_id": "para_858"
      },
      {
        "text": "28 MEDRANO V. ACOSTA",
        "paragraph_id": "para_859"
      },
      {
        "text": "C. Resisting Arrest",
        "paragraph_id": "para_860"
      },
      {
        "text": "As for this factor, the relevant question is whether the",
        "paragraph_id": "para_861"
      },
      {
        "text": "suspect was “actively resisting arrest or attempting to evade",
        "paragraph_id": "para_862"
      },
      {
        "text": "arrest by flight.” Graham, 490 U.S. at 396 (emphasis",
        "paragraph_id": "para_863"
      },
      {
        "text": "added). That a suspect has previously fled does not mean, as",
        "paragraph_id": "para_864"
      },
      {
        "text": "a matter of law, that he actively resists or evades arrest in",
        "paragraph_id": "para_865"
      },
      {
        "text": "every future encounter—particularly one that is distant from",
        "paragraph_id": "para_866"
      },
      {
        "text": "his prior flight. In Chew, the suspect ran from officers",
        "paragraph_id": "para_867"
      },
      {
        "text": "during a traffic stop and hid in a scrapyard for two hours",
        "paragraph_id": "para_868"
      },
      {
        "text": "before police found him. 27 F.3d at 1436. “With respect to",
        "paragraph_id": "para_869"
      },
      {
        "text": "whether he was attempting to evade arrest by flight,” we held",
        "paragraph_id": "para_870"
      },
      {
        "text": "that “the answer is yes and no. In a general sense he was, but",
        "paragraph_id": "para_871"
      },
      {
        "text": "in more precise terms his flight had terminated, at least",
        "paragraph_id": "para_872"
      },
      {
        "text": "temporarily, in the scrapyard.” Id. at 1442. In these mixed",
        "paragraph_id": "para_873"
      },
      {
        "text": "circumstances, we held that this factor weighed in favor of",
        "paragraph_id": "para_874"
      },
      {
        "text": "the government, “but only slightly.” Id.",
        "paragraph_id": "para_875"
      },
      {
        "text": "The majority’s brief analysis—finding it dispositive that",
        "paragraph_id": "para_876"
      },
      {
        "text": "Medrano had evaded officers in the weeks and months prior",
        "paragraph_id": "para_877"
      },
      {
        "text": "to the arrest—is thus irreconcilable with Chew, where the",
        "paragraph_id": "para_878"
      },
      {
        "text": "events spanned mere hours and the suspect fled directly to",
        "paragraph_id": "para_879"
      },
      {
        "text": "his place of eventual arrest. And it ignores a circumstance",
        "paragraph_id": "para_880"
      },
      {
        "text": "that cuts strongly against the government—five officers, not",
        "paragraph_id": "para_881"
      },
      {
        "text": "counting Officers Acosta and Roberts, surrounded the house.",
        "paragraph_id": "para_882"
      },
      {
        "text": "Resolving ambiguities in favor of Medrano, this made it",
        "paragraph_id": "para_883"
      },
      {
        "text": "virtually certain that he “could not escape.” Espinosa, 598",
        "paragraph_id": "para_884"
      },
      {
        "text": "F.3d at 537.",
        "paragraph_id": "para_885"
      },
      {
        "text": "The majority concludes that Medrano was “actively",
        "paragraph_id": "para_886"
      },
      {
        "text": "evading arrest” when he was standing with a dog in his",
        "paragraph_id": "para_887"
      },
      {
        "text": "father’s backyard. Majority 14. But Medrano was not",
        "paragraph_id": "para_888"
      },
      {
        "text": "“actively” doing anything, so this is not a recitation of the",
        "paragraph_id": "para_889"
      },
      {
        "text": "facts in the record, but an inference from those facts against",
        "paragraph_id": "para_890"
      },
      {
        "text": "Medrano—i.e., that Medrano was likely to evade the",
        "paragraph_id": "para_891"
      },
      {
        "text": "MEDRANO V. ACOSTA 29",
        "paragraph_id": "para_892"
      },
      {
        "text": "Officers based on his prior flights. This is, again, contrary",
        "paragraph_id": "para_893"
      },
      {
        "text": "to how we must view a summary judgment record on appeal.",
        "paragraph_id": "para_894"
      },
      {
        "text": "Given that Medrano’s prior flights were more removed",
        "paragraph_id": "para_895"
      },
      {
        "text": "in time than the scrapyard escape in Chew, that Medrano was",
        "paragraph_id": "para_896"
      },
      {
        "text": "completely surrounded, and that he did not resist arrest at the",
        "paragraph_id": "para_897"
      },
      {
        "text": "scene, I would conclude that this factor tips for Medrano.",
        "paragraph_id": "para_898"
      },
      {
        "text": "D. Other Factors",
        "paragraph_id": "para_899"
      },
      {
        "text": "1. Failure to Warn",
        "paragraph_id": "para_900"
      },
      {
        "text": "We have repeatedly held that the failure of an officer to",
        "paragraph_id": "para_901"
      },
      {
        "text": "warn a suspect before applying force cuts against the",
        "paragraph_id": "para_902"
      },
      {
        "text": "reasonableness of the officer’s conduct. Mattos, 661 F.3d at",
        "paragraph_id": "para_903"
      },
      {
        "text": "451; Glenn, 673 F.3d at 876; Hayes, 736 F.3d at 1234–35;",
        "paragraph_id": "para_904"
      },
      {
        "text": "S.R. Nehad, 929 F.3d at 1137; Singh, 124 F.4th at 754. That",
        "paragraph_id": "para_905"
      },
      {
        "text": "makes sense—where feasible, a suspect should be given the",
        "paragraph_id": "para_906"
      },
      {
        "text": "opportunity to voluntarily comply before officers force",
        "paragraph_id": "para_907"
      },
      {
        "text": "compliance.",
        "paragraph_id": "para_908"
      },
      {
        "text": "Rather than apply this settled rule, the majority",
        "paragraph_id": "para_909"
      },
      {
        "text": "apparently seeks to revive the rejected reasoning of an en",
        "paragraph_id": "para_910"
      },
      {
        "text": "banc dissent that is at odds with twenty-five years of law in",
        "paragraph_id": "para_911"
      },
      {
        "text": "this circuit. The majority reasons that the Officers did not",
        "paragraph_id": "para_912"
      },
      {
        "text": "need to provide a warning because aiming their guns at",
        "paragraph_id": "para_913"
      },
      {
        "text": "Medrano itself “served as a warning” to “mitigate the need",
        "paragraph_id": "para_914"
      },
      {
        "text": "to use additional, potentially deadly force.” Majority 16.",
        "paragraph_id": "para_915"
      },
      {
        "text": "For that proposition, the majority cites Thompson v. Rahr,",
        "paragraph_id": "para_916"
      },
      {
        "text": "885 F.3d 582 (9th Cir. 2018), and the separate writing of",
        "paragraph_id": "para_917"
      },
      {
        "text": "Judge Fernandez in Robinson.",
        "paragraph_id": "para_918"
      },
      {
        "text": "To the extent that the majority endorses Judge",
        "paragraph_id": "para_919"
      },
      {

        "text": "this circuit, aiming a loaded gun at a suspect is not the threat",
        "paragraph_id": "para_921"

        "text": "of force, it is force. Robinson, 278 F.3d at 1015; Thompson,",
        "paragraph_id": "para_922"
      },
      {
        "text": "885 F.3d at 586 (“With regard to the force used, pointing a",
        "paragraph_id": "para_923"
      },
      {
        "text": "30 MEDRANO V. ACOSTA",
        "paragraph_id": "para_924"
      },
      {
        "text": "loaded gun at a suspect, employing the threat of deadly force,",
        "paragraph_id": "para_925"
      },
      {
        "text": "is use of a high level of force” (quoting Espinosa, 598 F.3d",
        "paragraph_id": "para_926"
      },
      {
        "text": "at 537)). That was the majority holding from which Judge",
        "paragraph_id": "para_927"
      },
      {
        "text": "Fernandez dissented—he concurred “in the result only[,]”",
        "paragraph_id": "para_928"
      },
      {
        "text": "and only on the grounds that the officers were entitled to",
        "paragraph_id": "para_929"
      },
      {
        "text": "qualified immunity. Id. at 1017. It was Judge Fernandez’s",
        "paragraph_id": "para_930"
      },
      {
        "text": "view that aiming a gun does not constitute force under the",
        "paragraph_id": "para_931"
      },
      {
        "text": "Fourth Amendment when “there has not been a touching.”",
        "paragraph_id": "para_932"
      },
      {
        "text": "Id. We did not adopt Judge Fernandez’s dissenting view, id.",
        "paragraph_id": "para_933"
      },
      {
        "text": "at 1013–15, and the majority is wrong to the extent it adopts",
        "paragraph_id": "para_934"
      },
      {
        "text": "it here.",
        "paragraph_id": "para_935"
      },
      {
        "text": "2. Failure to Use Less Intrusive Alternative",
        "paragraph_id": "para_936"
      },
      {
        "text": "Finally, an officer’s failure to use available, less intrusive",
        "paragraph_id": "para_937"
      },
      {
        "text": "alternatives also supports the conclusion that the officer’s",
        "paragraph_id": "para_938"
      },
      {
        "text": "chosen method of effecting an arrest was unreasonable.",
        "paragraph_id": "para_939"
      },
      {
        "text": "Green, 751 F.3d at 1050–51. Whether an alternative was",
        "paragraph_id": "para_940"
      },
      {
        "text": "reasonably available to the officer, and whether the officer",
        "paragraph_id": "para_941"
      },
      {
        "text": "should have used the alternative, is generally a question for",
        "paragraph_id": "para_942"
      },
      {
        "text": "the jury. Seidner v. de Vries, 39 F.4th 591, 601 (9th Cir.",
        "paragraph_id": "para_943"
      },
      {
        "text": "2022); Glenn, 673 F.3d at 878. Alternatives in the officer’s",
        "paragraph_id": "para_944"
      },
      {
        "text": "training or policy manual are particularly probative of",
        "paragraph_id": "para_945"
      },
      {
        "text": "reasonableness. See Glenn, 673 F.3d at 876.",
        "paragraph_id": "para_946"
      },
      {
        "text": "Medrano argues that the Officers had a safer and less",
        "paragraph_id": "para_947"
      },
      {
        "text": "intrusive alternative available: holding their firearms in the",
        "paragraph_id": "para_948"
      },
      {
        "text": "low-ready position—toward the ground and away from",
        "paragraph_id": "para_949"
      },
      {
        "text": "Medrano—rather than at his head. The Officers’ training",
        "paragraph_id": "para_950"
      },
      {
        "text": "manual endorses this alternative: “If the officer does not",
        "paragraph_id": "para_951"
      },
      {
        "text": "initially perceive a threat but reasonably believes that the",
        "paragraph_id": "para_952"
      },
      {
        "text": "potential for such threat exists, firearms should generally be",
        "paragraph_id": "para_953"
      },
      {

        "text": "kept in the low-ready position.”4 A jury could conclude that",
        "paragraph_id": "para_955"
      },
      {
        "text": "this encounter matched the policy manual, given that",
        "paragraph_id": "para_956"
      },
      {
        "text": "Medrano was not actively threatening the Officers. Indeed,",
        "paragraph_id": "para_957"
      },
      {
        "text": "we have repeatedly recognized this specific alternative as a",
        "paragraph_id": "para_958"
      },
      {
        "text": "significant factor in declining to grant officers summary",
        "paragraph_id": "para_959"
      },
      {
        "text": "judgment. Green, 751 F.3d at 1050–51; see also Thompson,",
        "paragraph_id": "para_960"
      },
      {
        "text": "885 F.3d at 586, 590.",
        "paragraph_id": "para_961"
      },
      {
        "text": "The majority, for its part, does not mention this squarely",
        "paragraph_id": "para_962"
      },
      {
        "text": "presented argument at all.",
        "paragraph_id": "para_963"
      },
      {
        "text": "III. Balance of Interests",
        "paragraph_id": "para_964"
      },
      {
        "text": "In sum, a rational jury could conclude that the Officers",
        "paragraph_id": "para_965"
      },
      {
        "text": "used a particularly high level of force by aiming two guns at",
        "paragraph_id": "para_966"
      },
      {
        "text": "Medrano’s head from near point-blank range; that Medrano",
        "paragraph_id": "para_967"
      },
      {
        "text": "was neither an immediate threat nor actively resisting arrest;",
        "paragraph_id": "para_968"
      },
      {
        "text": "that the Officers unreasonably failed to warn Medrano prior",
        "paragraph_id": "para_969"
      },
      {
        "text": "to aiming their guns at his head; and that the Officers",
        "paragraph_id": "para_970"
      },
      {
        "text": "unreasonably failed to instead hold their guns in the low-",
        "paragraph_id": "para_971"
      },
      {
        "text": "ready position. On the other side of the ledger, a rational",
        "paragraph_id": "para_972"
      },
      {
        "text": "jury could conclude that at least some of the felonies at issue",
        "paragraph_id": "para_973"
      },
      {
        "text": "were severe. That is insufficient to award the Officers",
        "paragraph_id": "para_974"
      },
      {
        "text": "judgment as a matter of law. See, e.g., Thompson, 885 F.3d",
        "paragraph_id": "para_975"
      },
      {
        "text": "at 586–87 (felony arrest); Green, 751 F.3d at 1050 (same).",
        "paragraph_id": "para_976"
      },
      {
        "text": "Moreover, the balance tipped only further in Medrano’s",
        "paragraph_id": "para_977"
      },
      {
        "text": "favor “[a]s the situation evolved.” Jones v. L.V. Metro.",
        "paragraph_id": "para_978"
      },
      {
        "text": "Police Dep’t, 873 F.3d 1123, 1130 (9th Cir. 2017).",

      },
      {
        "text": "Medrano’s immediate compliance undercut any possible",
        "paragraph_id": "para_980"
      },
      {
        "text": "inference that he was actively dangerous or resisting arrest.",

        "text": "“When all disputes of fact are resolved in [Medrano’s]",

      },

        "text": "favor, as they must be for purposes of summary judgment, it",

        "text": "is apparent that application of the Graham factors would not",
        "paragraph_id": "para_995"
      },
      {
        "text": "have required a rational jury to decide that [aiming two guns",
        "paragraph_id": "para_996"
      },

        "text": "at his head] to apprehend him was reasonable.” Chew, 27",
        "paragraph_id": "para_997"
      },

        "text": "F.3d at 1441. Because the majority instead draws every",
        "paragraph_id": "para_998"
      },

        "text": "inference against Medrano and creates conflicts in our case",
