        "text": "be vaccinated by October 18, 2021, unless an individual",
        "paragraph_id": "para_55"
      },

        "text": "received an approved religious or medical exemption. An",
        "paragraph_id": "para_56"
      },
      {
        "text": "email notice sent to employees who had requested an",
        "paragraph_id": "para_57"
      },
      {
        "text": "exemption provided examples of beliefs that do not qualify",
        "paragraph_id": "para_58"
      },
      {
        "text": "for a religious exemption, including “[a]n objection to the",
        "paragraph_id": "para_59"
      },
      {
        "text": "vaccine on the basis of fetal cell concerns, either in the",
        "paragraph_id": "para_60"
      },
      {
        "text": "vaccines or in testing and development.”",
        "paragraph_id": "para_61"
      },
      {
        "text": "MacDonald, who was a registered nurse at Doernbecher",
        "paragraph_id": "para_62"
      },
      {
        "text": "Children’s Hospital of OHSU, requested a religious",
        "paragraph_id": "para_63"
      },
      {
        "text": "exemption, asserting, in part, that her “beliefs regarding the",
        "paragraph_id": "para_64"
      },
      {
        "text": "sanctity of life conflict directly with any requirement to",
        "paragraph_id": "para_65"
      },
      {
        "text": "inject abortion derived cell lines into [her] body.” After her",
        "paragraph_id": "para_66"
      },
      {
        "text": "exemption request was denied, and she was terminated for",
        "paragraph_id": "para_67"
      },
      {
        "text": "failing to be vaccinated, MacDonald filed suit alleging (1) a",
        "paragraph_id": "para_68"
      },
      {
        "text": "42 U.S.C. § 1983 Free Exercise claim against individuals",
        "paragraph_id": "para_69"
      },
      {
        "text": "who served on the OHSU Board of Directors and members",
        "paragraph_id": "para_70"
      },
      {
        "text": "of OHSU’s Vaccine Exception Review Committee",
        "paragraph_id": "para_71"
      },
      {
        "text": "(collectively, the “Individual Defendants”); and (2) a 42",
        "paragraph_id": "para_72"
      },
      {
        "text": "U.S.C. § 2000e-2(a)(1) Title VII failure to accommodate her",
        "paragraph_id": "para_73"
      },
      {
        "text": "religious beliefs claim against OHSU.",
        "paragraph_id": "para_74"
      },
      {
        "text": "The panel held that the Individual Defendants were",
        "paragraph_id": "para_75"
      },
      {
        "text": "entitled to qualified immunity on MacDonald’s Free",
        "paragraph_id": "para_76"
      },
      {
        "text": "Exercise claim because the right to refuse a state-mandated",
        "paragraph_id": "para_77"
      },
      {
        "text": "vaccine by a healthcare worker who works in-person with",
        "paragraph_id": "para_78"
      },
      {
        "text": "vulnerable populations due to allegedly religious concerns",
        "paragraph_id": "para_79"
      },
      {
        "text": "about fetal cells and bodily integrity or sanctity was not",
        "paragraph_id": "para_80"
      },
      {
        "text": "clearly established at the time the Individual Defendants",
        "paragraph_id": "para_81"
      },
      {
        "text": "denied MacDonald’s religious exemption.",
        "paragraph_id": "para_82"
      },
      {
        "text": "The panel next affirmed the district court’s summary",
        "paragraph_id": "para_83"
      },
      {
        "text": "judgment for OHSU on MacDonald’s Title VII failure to",
        "paragraph_id": "para_84"
      },
      {
        "text": "accommodate claim because OHSU demonstrated that it",
        "paragraph_id": "para_85"
      },
      {
        "text": "4 MACDONALD V. OR HEALTH & SCIENCE UNIVERSITY",
        "paragraph_id": "para_86"
      },
      {
        "text": "could not have accommodated Macdonald without undue",
        "paragraph_id": "para_87"
      },
      {
        "text": "hardship. OHSU’s evidence established that the health and",
        "paragraph_id": "para_88"
      },
      {
        "text": "safety risks posed to OHSU’s patients and employees",
        "paragraph_id": "para_89"
      },
      {
        "text": "presented a substantial hardship in the context of its",
        "paragraph_id": "para_90"
      },
      {
        "text": "business, and accommodating MacDonald would have",
        "paragraph_id": "para_91"
      },
      {
        "text": "imposed substantial operational and financial costs on",
        "paragraph_id": "para_92"
      },
      {
        "text": "OHSU.",
        "paragraph_id": "para_93"
      },
      {
        "text": "Addressing MacDonald’s pretext arguments, the panel",
        "paragraph_id": "para_94"
      },
      {
        "text": "wrote that there is no precedent that imports a “pretext” or",
        "paragraph_id": "para_95"
      },
      {
        "text": "“discriminatory motives” analysis into the “undue hardship”",
        "paragraph_id": "para_96"
      },
      {
        "text": "failure to accommodate analysis. And even if pretext were",
        "paragraph_id": "para_97"
      },
      {
        "text": "a part of the analysis, MacDonald failed to present a triable",
        "paragraph_id": "para_98"
      },
      {
        "text": "issue of material fact establishing that OHSU’s",
        "paragraph_id": "para_99"
      },
      {
        "text": "demonstrated substantial economic and noneconomic costs",
        "paragraph_id": "para_100"
      },
      {
        "text": "in allowing MacDonald to work while unvaccinated were",
        "paragraph_id": "para_101"
      },
      {
        "text": "mere pretext.",
        "paragraph_id": "para_102"
      },
      {
        "text": "Dissenting, Judge Tung wrote that the defendants’",
        "paragraph_id": "para_103"
      },
      {
        "text": "conduct here plainly violated established law prohibiting the",
        "paragraph_id": "para_104"
      },
      {
        "text": "targeting of a person’s religious beliefs. The policy singled",
        "paragraph_id": "para_105"
      },
      {
        "text": "out an employee’s religious objection to abortion and the use",
        "paragraph_id": "para_106"
      },
      {
        "text": "of fetal tissue as categorically undeserving of any",
        "paragraph_id": "para_107"
      },
      {
        "text": "consideration, which is a classic case of the State targeting",
        "paragraph_id": "para_108"
      },
      {
        "text": "religious beliefs and is never permissible. Because",
        "paragraph_id": "para_109"
      },
      {
        "text": "MacDonald had a right to be free from the State’s targeting",
        "paragraph_id": "para_110"
      },
      {
        "text": "of her religious belief (against the use of aborted fetal cells)",
        "paragraph_id": "para_111"
      },
      {
        "text": "by deeming such a belief not “religious” at all and thus not",
        "paragraph_id": "para_112"
      },
      {
        "text": "worthy of consideration for an exemption, the Defendants",
        "paragraph_id": "para_113"
      },
      {
        "text": "should have been denied qualified immunity.",

        "text": "We must decide (i) whether it was clearly established as",
        "paragraph_id": "para_127"
      },
      {
        "text": "of 2021 that the denial of a mandatory COVID-19 vaccine",
        "paragraph_id": "para_128"
      },
      {
        "text": "exemption request based on “fetal cell” and “bodily integrity",
        "paragraph_id": "para_129"
      },
      {
        "text": "and sanctity” concerns violates the Free Exercise Clause of",
        "paragraph_id": "para_130"
      },
      {
        "text": "the First Amendment such that qualified immunity does not",
        "paragraph_id": "para_131"
      },
      {
        "text": "apply to individual officers of Oregon Health and Science",
        "paragraph_id": "para_132"
      },
      {
        "text": "University (“OHSU”); and (ii) whether Defendant OHSU",
        "paragraph_id": "para_133"
      },
      {
        "text": "demonstrated that it could not have provided a COVID-19",
        "paragraph_id": "para_134"
      },
      {
        "text": "vaccine exemption accommodation to a registered nurse in",
        "paragraph_id": "para_135"
      },
      {
        "text": "the Mother Baby Unit (“MBU”) of the Doernbecher",
        "paragraph_id": "para_136"
      },
      {
        "text": "Children’s Hospital of OHSU without undue hardship. We",
        "paragraph_id": "para_137"
      },
      {
        "text": "affirm the district court’s decision that (i) qualified",
        "paragraph_id": "para_138"
      },
      {
        "text": "immunity applies to Plaintiff’s Free Exercise claim; and",
        "paragraph_id": "para_139"
      },
      {
        "text": "(ii) OHSU was entitled to summary judgment on Plaintiff’s",
        "paragraph_id": "para_140"
      },
      {
        "text": "Title VII failure to accommodate claim because OHSU",
        "paragraph_id": "para_141"
      },
      {

        "text": "demonstrated it could not accommodate Plaintiff without",
        "paragraph_id": "para_143"
      },
      {
        "text": "undue hardship.",
        "paragraph_id": "para_144"
      },
      {
        "text": "BACKGROUND",
        "paragraph_id": "para_145"
      },
      {
        "text": "In the fall of 2021, Plaintiff-Appellant Brittany K.",
        "paragraph_id": "para_146"
      },
      {
        "text": "MacDonald (“MacDonald”) was a registered nurse in the",
        "paragraph_id": "para_147"
      },
      {
        "text": "MBU of the Doernbecher Children’s Hospital of OHSU who",
        "paragraph_id": "para_148"
      },
      {
        "text": "had worked there since October 8, 2012. The MBU provides",
        "paragraph_id": "para_149"
      },
      {
        "text": "intensive care to pregnant mothers, newborns and",
        "paragraph_id": "para_150"
      },
      {
        "text": "immunocompromised patients with critical conditions,",
        "paragraph_id": "para_151"
      },
      {
        "text": "including cancer. MBU registered nurses must be in direct",
        "paragraph_id": "para_152"
      },
      {
        "text": "physical contact with, or close proximity to, their patients",
        "paragraph_id": "para_153"
      },
      {
        "text": "because MBU registered nurses provide direct care such as",
        "paragraph_id": "para_154"
      },
      {
        "text": "feeding, bathing, diapering, administering medications,",
        "paragraph_id": "para_155"
      },
      {

        "text": "holding and breastfeeding their babies. MacDonald is a",
        "paragraph_id": "para_157"
      },
      {
        "text": "practicing Christian who opposes abortion. OHSU had",
        "paragraph_id": "para_158"
      },
      {
        "text": "previously accommodated MacDonald’s religious",
        "paragraph_id": "para_159"
      },
      {
        "text": "preference to not participate in performing abortions.",
        "paragraph_id": "para_160"
      },
      {
        "text": "OHSU is Oregon’s largest public hospital system and",
        "paragraph_id": "para_161"
      },
      {
        "text": "only public academic health institution. In 2021, OHSU",
        "paragraph_id": "para_162"
      },
      {
        "text": "employed approximately 20,000 employees and cared for",
        "paragraph_id": "para_163"
      },
      {
        "text": "approximately 330,000 patients. The Oregon State",
        "paragraph_id": "para_164"
      },
      {
        "text": "legislature created OHSU and charged OHSU with",
        "paragraph_id": "para_165"
      },
      {
        "text": "“serv[ing] the people of the State of Oregon” and delivering",
        "paragraph_id": "para_166"
      },
      {
        "text": "health care “in the manner that . . . best promotes the public",
        "paragraph_id": "para_167"
      },
      {
        "text": "welfare of the people of the State of Oregon.” Or. Rev. Stat.",
        "paragraph_id": "para_168"
      },
      {
        "text": "§ 353.030(1), (4).",
        "paragraph_id": "para_169"
      },
      {
        "text": "COVID-19 is a disease caused by the SARS-CoV-2 virus",
        "paragraph_id": "para_170"
      },
      {
        "text": "and was declared a global pandemic in March 2020. SARS-",
        "paragraph_id": "para_171"
      },
      {
        "text": "CoV-2 evolved and mutated into different variants including",
        "paragraph_id": "para_172"
      },
      {
        "text": "the highly transmissible Delta variant in the summer of 2021.",
        "paragraph_id": "para_173"
      },
      {
        "text": "The Delta variant was more contagious than prior variants,",
        "paragraph_id": "para_174"
      },
      {
        "text": "MACDONALD V. OR HEALTH & SCIENCE UNIVERSITY 7",
        "paragraph_id": "para_175"
      },
      {
        "text": "involved a significantly higher risk of severe disease and",
        "paragraph_id": "para_176"
      },
      {
        "text": "hospitalization, and surged between June and September",
        "paragraph_id": "para_177"
      },
      {
        "text": "2021—at its peak, the Delta variant claimed 1,500 American",
        "paragraph_id": "para_178"
      },
      {
        "text": "lives per day. The risk of Delta transmission was especially",
        "paragraph_id": "para_179"
      },
      {
        "text": "high in hospitals where social distancing between healthcare",
        "paragraph_id": "para_180"
      },
      {
        "text": "workers and patients was often not possible. The Centers for",
        "paragraph_id": "para_181"
      },
      {
        "text": "Disease Control and Prevention, World Health",
        "paragraph_id": "para_182"
      },
      {
        "text": "Organization, Food and Drug Administration and Centers",
        "paragraph_id": "para_183"
      },
      {
        "text": "for Medicare & Medicaid Services recommended vaccines",
        "paragraph_id": "para_184"
      },
      {
        "text": "as the best way to protect against COVID-19.",
        "paragraph_id": "para_185"
      },
      {
        "text": "In response to the deadly Delta variant in August 2021,",
        "paragraph_id": "para_186"
      },
      {
        "text": "Oregon Governor Kate Brown issued Executive Order No.",
        "paragraph_id": "para_187"
      },
      {
        "text": "21-29, which required all healthcare workers in Oregon’s",
        "paragraph_id": "para_188"
      },
      {
        "text": "healthcare facilities to be vaccinated against COVID-19 by",
        "paragraph_id": "para_189"
      },
      {
        "text": "October 18, 2021, and prohibited OHSU from allowing any",
        "paragraph_id": "para_190"
      },
      {
        "text": "unvaccinated healthcare employee to continue to work for",
        "paragraph_id": "para_191"
      },
      {
        "text": "OHSU after October 18, 2021 (the “Vaccine Mandate”). See",
        "paragraph_id": "para_192"
      },
      {
        "text": "Or. Admin. R. 333-019-1010 (2021). To comply, OHSU",
        "paragraph_id": "para_193"
      },
      {
        "text": "required all OHSU personnel to be vaccinated by October",
        "paragraph_id": "para_194"
      },
      {
        "text": "18, 2021, unless an individual received an approved",
        "paragraph_id": "para_195"
      },
      {
        "text": "religious or medical exemption. The Vaccine Exception",
        "paragraph_id": "para_196"
      },
      {
        "text": "Review Committee (the “Review Committee”) reviewed",
        "paragraph_id": "para_197"
      },
      {
        "text": "and decided all requests for religious exemptions.",
        "paragraph_id": "para_198"
      },
      {
        "text": "On September 19, 2021, MacDonald submitted a",
        "paragraph_id": "para_199"
      },
      {
        "text": "religious exemption request to OHSU and attached a five-",
        "paragraph_id": "para_200"
      },
      {
        "text": "page document with her responses to the request form’s",
        "paragraph_id": "para_201"
      },
      {
        "text": "three questions. MacDonald asserted that her “body was the",
        "paragraph_id": "para_202"
      },
      {
        "text": "temple of the Holy Spirit” and her “beliefs regarding the",
        "paragraph_id": "para_203"
      },
      {
        "text": "sanctity of life conflict directly with any requirement to",
        "paragraph_id": "para_204"
      },
      {
        "text": "inject abortion derived cell lines into [her] body.” She also",
        "paragraph_id": "para_205"
      },
      {
        "text": "asserted that she was “moved by the Holy Spirit to reject the",
        "paragraph_id": "para_206"
      },
      {
        "text": "vaccine repeatedly” and received “divine guidance” from",
        "paragraph_id": "para_207"
      },
      {
        "text": "God to reject the COVID-19 vaccine.",
        "paragraph_id": "para_208"
      },
      {

        "paragraph_id": "para_209"
      },
      {
        "text": "On September 30, 2021, OHSU sent an email notice to",
        "paragraph_id": "para_210"
      },
      {
        "text": "employees and supervisors of employees who had requested",
        "paragraph_id": "para_211"
      },
      {
        "text": "an exemption. The email notice stated that “each review”",
        "paragraph_id": "para_212"
      },
      {
        "text": "required “a high level of individual assessment by multiple",
        "paragraph_id": "para_213"
      },
      {
        "text": "reviewers.” The email also “shar[ed] further detail on",
        "paragraph_id": "para_214"
      },
      {
        "text": "OHSU’s narrow criteria for exemption approvals,” which",
        "paragraph_id": "para_215"
      },
      {
        "text": "“ha[d] been set to help OHSU keep [its] members and those",
        "paragraph_id": "para_216"
      },
      {
        "text": "[it] served safe” to help guide decision-making because",
        "paragraph_id": "para_217"
      },
      {
        "text": "OHSU “expect[ed] very few of the submitted requests for",
        "paragraph_id": "para_218"
      },
      {
        "text": "religious exemptions to be approved.” The email notice",
        "paragraph_id": "para_219"
      },
      {
        "text": "provided notice of “[e]xamples of beliefs that do not qualify",
        "paragraph_id": "para_220"
      },
      {
        "text": "for a religious exemption” including:",
        "paragraph_id": "para_221"
      },
      {
        "text": "Concerns over vaccine safety or content.",
        "paragraph_id": "para_222"
      },
      {
        "text": "• These are not religious arguments and",
        "paragraph_id": "para_223"
      },
      {
        "text": "often inconsistent with proven facts.",
        "paragraph_id": "para_224"
      },
      {
        "text": "An objection to the vaccine on the basis of",
        "paragraph_id": "para_225"
      },
      {
        "text": "fetal cell concerns, either in the vaccines or in",
        "paragraph_id": "para_226"
      },
      {
        "text": "testing and development.",
        "paragraph_id": "para_227"
      },
      {
        "text": "• These professed beliefs are personal",
        "paragraph_id": "para_228"
      },
      {
        "text": "moral choices and/or conscientious",
        "paragraph_id": "para_229"
      },
      {
        "text": "objections rather than a tenet of a",
        "paragraph_id": "para_230"
      },
      {
        "text": "religious faith.",
        "paragraph_id": "para_231"
      },
      {
        "text": "• No fetal tissue or cells are contained in",
        "paragraph_id": "para_232"
      },
      {
        "text": "any of the vaccines currently available",
        "paragraph_id": "para_233"
      },
      {
        "text": "under FDA approval or emergency use",
        "paragraph_id": "para_234"
      },
      {
        "text": "authorization in the U.S.",
        "paragraph_id": "para_235"
      },
      {
        "text": "• While they played no role in their",
        "paragraph_id": "para_236"
      },
      {
        "text": "development or production, HEK-293",
        "paragraph_id": "para_237"
      },
      {
        "text": "cell lines created over 50 years ago were",
        "paragraph_id": "para_238"
      },
      {
        "text": "used in confirmatory testing of the",
        "paragraph_id": "para_239"
      },
      {
        "text": "current mRNA vaccines. Cells from the",
        "paragraph_id": "para_240"
      },
      {
        "text": "same line have commonly been used in",
        "paragraph_id": "para_241"
      },
      {

        "paragraph_id": "para_242"
      },
      {
        "text": "biologic research since the late 70s. This",
        "paragraph_id": "para_243"
      },
      {
        "text": "cell line is used in the testing of many",
        "paragraph_id": "para_244"
      },
      {
        "text": "common medicines, including Tylenol,",
        "paragraph_id": "para_245"
      },
      {
        "text": "Advil, Aspirin, Claritin, Benadryl, Pepto-",
        "paragraph_id": "para_246"
      },
      {
        "text": "Bismol, Mucinex, Turns and Prilosec,",
        "paragraph_id": "para_247"
      },
      {
        "text": "among many others.",
        "paragraph_id": "para_248"
      },
      {
        "text": "A personal revelation from God about the",
        "paragraph_id": "para_249"
      },
      {
        "text": "vaccine, an objection to the vaccine based",
        "paragraph_id": "para_250"
      },
      {
        "text": "upon bodily integrity or sanctity, and/or a",
        "paragraph_id": "para_251"
      },
      {
        "text": "belief that the vaccine is “unclean.”",
        "paragraph_id": "para_252"
      },
      {
        "text": "• These are personal moral choices and/or",
        "paragraph_id": "para_253"
      },
      {
        "text": "conscientious objection rather than a",
        "paragraph_id": "para_254"
      },
      {
        "text": "tenet of a religious faith.",
        "paragraph_id": "para_255"
      },
      {
        "text": "A vaccine exemption would be provided to those who",
        "paragraph_id": "para_256"
      },
      {
        "text": "“demonstrate[d] a sincerely held religious belief and past",
        "paragraph_id": "para_257"
      },
      {
        "text": "behavior consistent with that belief.”",
        "paragraph_id": "para_258"
      },
      {
        "text": "On October 7, 2021, OHSU sent MacDonald an email",
        "paragraph_id": "para_259"
      },
      {
        "text": "informing MacDonald that the Review Committee had",
        "paragraph_id": "para_260"
      },
      {
        "text": "denied MacDonald’s request for a religious exemption. This",
        "paragraph_id": "para_261"
      },
      {
        "text": "email did not provide individualized reasons for denying",
        "paragraph_id": "para_262"
      },
      {
        "text": "MacDonald’s request but stated that the “vast majority” of",
        "paragraph_id": "para_263"
      },
      {
        "text": "“denials were because the requestor did not meet the legal",
        "paragraph_id": "para_264"
      },
      {
        "text": "requirements for a religious exemption but instead stated",
        "paragraph_id": "para_265"
      },
      {
        "text": "personal beliefs or conscientious objections as opposed to a",
        "paragraph_id": "para_266"
      },
      {
        "text": "fundamental tenet of a religious faith.” The Committee",
        "paragraph_id": "para_267"
      },
      {
        "text": "again provided examples of beliefs that did not qualify for",
        "paragraph_id": "para_268"
      },
      {
        "text": "religious exemption including: “concerns over vaccine",
        "paragraph_id": "para_269"
      },
      {
        "text": "safety or content,” “an objection to the vaccine on the basis",
        "paragraph_id": "para_270"
      },
      {
        "text": "of fetal cell concerns,” a “personal revelation from God",
        "paragraph_id": "para_271"
      },
      {
        "text": "about the vaccine,” and “an objection to the COVID vaccine",
        "paragraph_id": "para_272"
      },
      {
        "text": "based upon bodily integrity or sanctity and/or a belief that",
        "paragraph_id": "para_273"
      },
      {
        "text": "the vaccine is ‘unclean.’” OHSU’s October 7, 2021 email",
        "paragraph_id": "para_274"
      },
      {

        "paragraph_id": "para_275"
      },
      {
        "text": "informed MacDonald that if she was not vaccinated against",
        "paragraph_id": "para_276"
      },
      {
        "text": "COVID-19 by October 18, 2021, she could not “continue to",
        "paragraph_id": "para_277"
      },
      {
        "text": "work” at OHSU. MacDonald failed to be vaccinated against",
        "paragraph_id": "para_278"
      },
      {
        "text": "COVID-19 and was terminated on December 2, 2021.",
        "paragraph_id": "para_279"
      },
      {
        "text": "On December 15, 2022, MacDonald filed her complaint",
        "paragraph_id": "para_280"
      },
      {
        "text": "in the district court alleging two causes of action: (1) a 42",
        "paragraph_id": "para_281"
      },
      {
        "text": "U.S.C. § 1983 Free Exercise claim against: (a) individuals",
        "paragraph_id": "para_282"
      },
      {
        "text": "who served on the OHSU Board of Directors (the “Board",
        "paragraph_id": "para_283"
      },
      {
        "text": "Defendants”) who allegedly established OHSU’s policies",
        "paragraph_id": "para_284"
      },
      {
        "text": "and protocols regarding religious exemptions from the",
        "paragraph_id": "para_285"
      },
      {
        "text": "Vaccine Mandate, and (b) members of OHSU’s Vaccine",
        "paragraph_id": "para_286"
      },
      {
        "text": "Exception Review Committee (“VERC Defendants,”",
        "paragraph_id": "para_287"
      },
      {
        "text": "together with the Board Defendants, the “Individual",
        "paragraph_id": "para_288"
      },
      {
        "text": "Defendants”) who allegedly reviewed and evaluated medical",
        "paragraph_id": "para_289"
      },
      {
        "text": "and religious exemption requests, (the “Free Exercise",
        "paragraph_id": "para_290"
      },
      {
        "text": "Claim”); and (2) a 42 U.S.C. § 2000e-2(a)(1) Title VII",
        "paragraph_id": "para_291"
      },
      {
        "text": "failure to accommodate her religious beliefs claim against",
        "paragraph_id": "para_292"
      },
      {
        "text": "OHSU.",
        "paragraph_id": "para_293"
      },
      {
        "text": "On August 28, 2023, the district court granted the",
        "paragraph_id": "para_294"
      },
      {
        "text": "Individual Defendants’ motion to dismiss MacDonald’s Free",
        "paragraph_id": "para_295"
      },
      {
        "text": "Exercise Claim and request for declaratory relief with",
        "paragraph_id": "para_296"
      },
      {
        "text": "prejudice but denied OHSU’s motion to dismiss",
        "paragraph_id": "para_297"
      },
      {
        "text": "MacDonald’s Title VII claims. The district court held that",
        "paragraph_id": "para_298"
      },
      {
        "text": "the Individual Defendants were entitled to qualified",
        "paragraph_id": "para_299"
      },
      {
        "text": "immunity on MacDonald’s Free Exercise Claim because",
        "paragraph_id": "para_300"
      },
      {
        "text": "“the right to refuse a state-mandated vaccine by a healthcare",
        "paragraph_id": "para_301"
      },
      {
        "text": "worker who works in-person with vulnerable populations",
        "paragraph_id": "para_302"
      },
      {
        "text": "due to allegedly religious concerns about ‘fetal cells’ and",
        "paragraph_id": "para_303"
      },
      {
        "text": "‘bodily integrity or sanctity’ was not clearly established at",
        "paragraph_id": "para_304"
      },
      {
        "text": "the time the Individual Defendants denied Plaintiff’s",
        "paragraph_id": "para_305"
      },
      {
        "text": "religious exemption.” The district court denied and",
        "paragraph_id": "para_306"
      },
      {
        "text": "dismissed Plaintiff’s request for declaratory relief as",
        "paragraph_id": "para_307"
      },
      {
        "text": "retrospective and barred by the Eleventh Amendment.",
        "paragraph_id": "para_308"
      },
      {
        "text": "MACDONALD V. OR HEALTH & SCIENCE UNIVERSITY 11",

      },
      {
        "text": "The district court subsequently granted OHSU’s motion",
        "paragraph_id": "para_310"
      },
      {
        "text": "for summary judgment on MacDonald’s Title VII claim.",
        "paragraph_id": "para_311"
      },
      {
        "text": "The district court granted summary judgment because",
        "paragraph_id": "para_312"
      },
      {
        "text": "OHSU demonstrated that if it had accommodated",
        "paragraph_id": "para_313"
      },
      {
        "text": "MacDonald, OHSU would have suffered “undue hardship”",
        "paragraph_id": "para_314"
      },
      {
        "text": "through “substantial increased cost[s]” and the risk of losing",
        "paragraph_id": "para_315"
      },
      {
        "text": "personnel and patients to illness.",
        "paragraph_id": "para_316"
      },
      {
        "text": "STANDARD OF REVIEW",
        "paragraph_id": "para_317"
      },
      {
        "text": "We review a district court’s grant of a motion to dismiss",
        "paragraph_id": "para_318"
      },
      {
        "text": "and issues of qualified immunity de novo. Keates v. Koile,",
        "paragraph_id": "para_319"
      },
      {
        "text": "883 F.3d 1228, 1234 (9th Cir. 2018) (citation modified).",
        "paragraph_id": "para_320"
      },
      {
        "text": "“[W]e consider whether the complaint alleges sufficient",
        "paragraph_id": "para_321"
      },
      {
        "text": "facts, taken as true, to support the claim that the officials’",
        "paragraph_id": "para_322"
      },
      {
        "text": "conduct violated clearly established constitutional rights of",
        "paragraph_id": "para_323"
      },
      {
        "text": "which a reasonable officer would be aware ‘in light of the",
        "paragraph_id": "para_324"
      },
      {
        "text": "specific context of the case.’” Id. at 1235 (quoting Mullenix",
        "paragraph_id": "para_325"
      },
      {
        "text": "v. Luna, 577 U.S. 7, 12 (2015)).",
        "paragraph_id": "para_326"
      },
      {
        "text": "We review the district court’s summary judgment",
        "paragraph_id": "para_327"
      },
      {
        "text": "decision “de novo, viewing the evidence and drawing all",
        "paragraph_id": "para_328"
      },
      {
        "text": "reasonable inferences in the light most favorable to the non-",
        "paragraph_id": "para_329"
      },
      {
        "text": "moving party.” Petersen v. Snohomish Reg’l Fire & Rescue,",
        "paragraph_id": "para_330"
      },
      {
        "text": "150 F.4th 1211, 1215 (9th Cir. 2025) (citation modified).",
        "paragraph_id": "para_331"
      },
      {
        "text": "The central issue is “whether the evidence presents a",
        "paragraph_id": "para_332"
      },
      {
        "text": "sufficient disagreement to require submission to a jury or",
        "paragraph_id": "para_333"
      },
      {
        "text": "whether it is so one-sided that one party must prevail as a",
        "paragraph_id": "para_334"
      },
      {
        "text": "matter of law.” Anderson v. Liberty Lobby, Inc., 477 U.S.",
        "paragraph_id": "para_335"
      },
      {
        "text": "242, 251–52 (1986).",
        "paragraph_id": "para_336"
      },
      {

      {
        "text": "DISCUSSION",
        "paragraph_id": "para_338"
      },
      {
        "text": "I. MacDonald’s Free Exercise Claim and Qualified",
        "paragraph_id": "para_339"
      },
      {
        "text": "Immunity",
        "paragraph_id": "para_340"
      },
      {
        "text": "A. The Qualified Immunity Legal Framework",
        "paragraph_id": "para_341"
      },
      {
        "text": "“Qualified immunity attaches when an official’s conduct",
        "paragraph_id": "para_342"
      },
      {
        "text": "‘does not violate clearly established statutory or",
        "paragraph_id": "para_343"
      },
      {
        "text": "constitutional rights of which a reasonable person would",
        "paragraph_id": "para_344"
      },
      {
        "text": "have known.’” White v. Pauly, 580 U.S. 73, 78–79 (2017)",
        "paragraph_id": "para_345"
      },
      {
        "text": "(quoting Mullenix, 577 U.S. at 11). Qualified immunity",
        "paragraph_id": "para_346"
      },
      {
        "text": "protects “‘all but the plainly incompetent or those who",
        "paragraph_id": "para_347"
      },
      {
        "text": "knowingly violate the law.’” White, 580 U.S. at 79 (quoting",
        "paragraph_id": "para_348"
      },
      {
        "text": "Mullenix, 577 U.S. at 12). Although “a case directly on",
        "paragraph_id": "para_349"
      },
      {
        "text": "point” is not required, “existing precedent must have placed",
        "paragraph_id": "para_350"
      },
      {
        "text": "the statutory or constitutional question beyond debate.”",
        "paragraph_id": "para_351"
      },
      {
        "text": "Ashcroft v. al-Kidd, 563 U.S. 731, 741 (2011) (citation",
        "paragraph_id": "para_352"
      },
      {
        "text": "modified). “The relevant, dispositive inquiry . . . is whether",
        "paragraph_id": "para_353"
      },
      {
        "text": "it would be clear to a reasonable officer that his conduct was",
        "paragraph_id": "para_354"
      },
      {
        "text": "unlawful in the situation he confronted.” Saucier v. Katz,",
        "paragraph_id": "para_355"
      },
      {
        "text": "533 U.S. 194, 202 (2001) (citation omitted), overruled in",
        "paragraph_id": "para_356"
      },
      {
        "text": "part on other grounds by Pearson v. Callahan, 555 U.S. 223",
        "paragraph_id": "para_357"
      },
      {
        "text": "(2009).",
        "paragraph_id": "para_358"
      },
      {
        "text": "In evaluating a grant of qualified immunity, courts",
        "paragraph_id": "para_359"
      },
      {
        "text": "consider whether the alleged government conduct violated",
        "paragraph_id": "para_360"
      },
      {
        "text": "(1) a constitutional right, and (2) “clearly established law”",
        "paragraph_id": "para_361"
      },
      {
        "text": "such that a reasonable officer would be on notice that such",
        "paragraph_id": "para_362"
      },
      {
        "text": "alleged misconduct was unlawful. Pearson, 555 U.S. at 232,",
        "paragraph_id": "para_363"
      },
      {
        "text": "244 (citing Saucier, 533 U.S. at 201). After Pearson, we are",
        "paragraph_id": "para_364"
      },
      {
        "text": "no longer required to first engage in an analysis of whether",
        "paragraph_id": "para_365"
      },
      {
        "text": "the facts in a complaint alleged a constitutional violation",
        "paragraph_id": "para_366"
      },
      {
        "text": "because “[t]he procedure sometimes results in a substantial",
        "paragraph_id": "para_367"
      },
      {
        "text": "expenditure of scarce judicial resources on difficult",
        "paragraph_id": "para_368"
      },
      {
        "text": "questions that have no effect on the outcome of the case,”",
        "paragraph_id": "para_369"
      },
      {
        "text": "MACDONALD V. OR HEALTH & SCIENCE UNIVERSITY 13",

      },
      {
        "text": "and “[t]here are cases in which it is plain that a constitutional",
        "paragraph_id": "para_371"
      },
      {
        "text": "right is not clearly established but far from obvious whether",
        "paragraph_id": "para_372"
      },
      {
        "text": "in fact there is such a right.” 555 U.S. at 236–37. In other",
        "paragraph_id": "para_373"
      },
      {
        "text": "words, “[e]ither question may be addressed first, and if the",
        "paragraph_id": "para_374"
      },
      {
        "text": "answer to either is ‘no,’ then the state actor cannot be held",
        "paragraph_id": "para_375"
      },
      {

        "text": "We affirm the district court’s finding that qualified",
        "paragraph_id": "para_378"
      },
      {
        "text": "immunity applies to MacDonald’s Free Exercise Claim",
        "paragraph_id": "para_379"
      },
      {
        "text": "because “the right to refuse a state-mandated vaccine by a",
        "paragraph_id": "para_380"
      },
      {
        "text": "healthcare worker who works in-person with vulnerable",
        "paragraph_id": "para_381"
      },
      {
        "text": "populations due to allegedly religious concerns about ‘fetal",
        "paragraph_id": "para_382"
      },
      {
        "text": "cells’ and ‘bodily integrity or sanctity’ was not clearly",
        "paragraph_id": "para_383"
      },
      {
        "text": "established at the time the Individual Defendants denied",
        "paragraph_id": "para_384"
      },
      {
        "text": "Plaintiff’s religious exemption.” Because our holding on the",
        "paragraph_id": "para_385"
      },
      {
        "text": "“clearly established” qualified immunity prong is dispositive",
        "paragraph_id": "para_386"
      },
      {
        "text": "in favor of the Individual Defendants’ qualified immunity",
        "paragraph_id": "para_387"
      },
      {
        "text": "defense, we need not consider whether the alleged",
        "paragraph_id": "para_388"
      },
      {
        "text": "government misconduct violated a constitutional right under",
        "paragraph_id": "para_389"
      },
      {
        "text": "the general rule of constitutional avoidance. See Pearson,",
        "paragraph_id": "para_390"
      },
      {
        "text": "555 U.S. at 236, 241 (holding that courts no longer were",
        "paragraph_id": "para_391"
      },
      {
        "text": "required to address as the “initial inquiry” whether an",
        "paragraph_id": "para_392"
      },
      {
        "text": "“officer’s conduct violated a constitutional right” before",
        "paragraph_id": "para_393"
      },
      {
        "text": "deciding whether the right at issue was clearly established",
        "paragraph_id": "para_394"
      },
      {
        "text": "because, amongst other reasons, requiring courts to decide",
        "paragraph_id": "para_395"
      },
      {
        "text": "on the constitutional question first “departs from the general",
        "paragraph_id": "para_396"
      },
      {
        "text": "rule of constitutional avoidance”).",
        "paragraph_id": "para_397"
      },
      {

        "paragraph_id": "para_398"
      },
      {
        "text": "B. There Was No Clearly Established Law in 2021",
        "paragraph_id": "para_399"
      },
      {
        "text": "that Provided Fair Notice to the Individual",
        "paragraph_id": "para_400"
      },
      {
        "text": "Defendants that Their Actions Violated the Free",
        "paragraph_id": "para_401"
      },
      {
        "text": "Exercise Clause",
        "paragraph_id": "para_402"
      },
      {
        "text": "i. The “Clearly Established” Legal Standard",
        "paragraph_id": "para_403"
      },
      {
        "text": "The “clearly established” inquiry turns on the “objective",
        "paragraph_id": "para_404"
      },
      {
        "text": "legal reasonableness of the [government] action, assessed in",
        "paragraph_id": "para_405"
      },
      {
        "text": "light of the legal rules that were clearly established at the",
        "paragraph_id": "para_406"
      },
      {
        "text": "time it was taken.” Pearson, 555 U.S. at 244 (citation",
        "paragraph_id": "para_407"
      },
      {
        "text": "modified). “A Government official’s conduct violates",
        "paragraph_id": "para_408"
      },
      {
        "text": "clearly established law when, at the time of the challenged",
        "paragraph_id": "para_409"
      },
      {
        "text": "conduct, ‘[t]he contours of [a] right [are] sufficiently clear’",
        "paragraph_id": "para_410"
      },
      {
        "text": "[such] that every ‘reasonable official would [have",
        "paragraph_id": "para_411"
      },
      {
        "text": "understood] that what he is doing violates that right.’”",
        "paragraph_id": "para_412"
      },
      {
        "text": "Ashcroft, 563 U.S. at 741 (quoting Anderson v. Creighton,",
        "paragraph_id": "para_413"
      },
      {
        "text": "483 U.S. 635, 640 (1987)). The “dispositive inquiry” is",
        "paragraph_id": "para_414"
      },
      {
        "text": "“whether it would be clear to a reasonable officer that his",
        "paragraph_id": "para_415"
      },
      {
        "text": "conduct was unlawful in the situation he confronted.”",
        "paragraph_id": "para_416"
      },
      {
        "text": "Saucier, 533 U.S. at 202 (citing Wilson v. Layne, 526 U.S.",
        "paragraph_id": "para_417"
      },
      {
        "text": "603, 615 (1999)).",
        "paragraph_id": "para_418"
      },
      {
        "text": "The Supreme Court has thus continued to “reiterate the",
        "paragraph_id": "para_419"
      },
      {
        "text": "longstanding principle that ‘clearly established law’ should",
        "paragraph_id": "para_420"
      },
      {
        "text": "not be defined ‘at a high level of generality.’” White, 580",
        "paragraph_id": "para_421"
      },
      {
        "text": "U.S. at 79 (quoting Ashcroft, 563 U.S. at 742). We consider",
        "paragraph_id": "para_422"
      },
      {
        "text": "whether the alleged facts “support the claim that the",
        "paragraph_id": "para_423"
      },
      {
        "text": "officials’ conduct violated clearly established constitutional",
        "paragraph_id": "para_424"
      },
      {
        "text": "rights of which a reasonable officer would be aware, ‘in light",
        "paragraph_id": "para_425"
      },
      {
        "text": "of the specific context of the case, . . . not as a broad general",
        "paragraph_id": "para_426"
      },
      {
        "text": "proposition.’” Keates v. Koile, 883 F.3d 1228, 1235, 1239",
        "paragraph_id": "para_427"
      },
      {
        "text": "(9th Cir. 2018) (quoting Mullenix, 577 U.S. at 12).",
        "paragraph_id": "para_428"
      },
      {
        "text": "“Otherwise, ‘[p]laintiffs would be able to convert the rule of",
        "paragraph_id": "para_429"
      },
      {
        "text": "qualified immunity . . . into a rule of virtually unqualified",
        "paragraph_id": "para_430"
      },
      {

      },
      {
        "text": "liability simply by alleging violation of extremely abstract",
        "paragraph_id": "para_432"
      },
      {
        "text": "rights.’” White, 580 U.S. at 79 (quoting Anderson, 483 U.S.",
        "paragraph_id": "para_433"
      },
      {
        "text": "at 639).",
        "paragraph_id": "para_434"
      },
      {
        "text": "That we look to “the specific context” of MacDonald’s",
        "paragraph_id": "para_435"
      },
      {
        "text": "allegations under the “clearly established” prong, Mullenix,",
        "paragraph_id": "para_436"
      },
      {
        "text": "577 U.S. at 12, comports with the Supreme Court’s Free",
        "paragraph_id": "para_437"
      },
      {
        "text": "Exercise framework. The Free Exercise Clause of the First",
        "paragraph_id": "para_438"
      },
      {
        "text": "Amendment protects free exercise of religion from",
        "paragraph_id": "para_439"
      },
      {
        "text": "government interference, see Cantwell v. Connecticut, 310",
        "paragraph_id": "para_440"
      },
      {
        "text": "U.S. 296, 303–04 (1940), but any “burden” on “religious",
        "paragraph_id": "para_441"
      },
      {
        "text": "exercise” does not “presumptively violate” the Free Exercise",
        "paragraph_id": "para_442"
      },
      {
        "text": "Clause. Youth 71Five Ministries v. Williams, 160 F.4th 964,",
        "paragraph_id": "para_443"
      },
      {
        "text": "978 (9th Cir. 2025). “Under [Supreme Court] precedents,",
        "paragraph_id": "para_444"
      },
      {
        "text": "the government is generally free to place incidental burdens",
        "paragraph_id": "para_445"
      },
      {
        "text": "on religious exercise so long as [the government] does so",
        "paragraph_id": "para_446"
      },
      {
        "text": "pursuant to a neutral policy that is generally applicable,” and",
        "paragraph_id": "para_447"
      },
      {
        "text": "the government action is rationally related to a legitimate",
        "paragraph_id": "para_448"
      },
      {
        "text": "government interest. Mahmoud v. Taylor, 606 U.S. 522, 564",
        "paragraph_id": "para_449"
      },
      {
        "text": "(2025) (citing Emp. Div., Dep’t of Human Res. v. Smith, 494",
        "paragraph_id": "para_450"
      },
      {
        "text": "U.S. 872, 878–79 (1990)). Conversely, if a government",
        "paragraph_id": "para_451"
      },
      {
        "text": "action is not neutral or generally applicable, it triggers “strict",
        "paragraph_id": "para_452"
      },
      {
        "text": "scrutiny,” which requires that the government action be",
        "paragraph_id": "para_453"
      },
      {
        "text": "“justified by a compelling state interest” and “narrowly",
        "paragraph_id": "para_454"
      },
      {
        "text": "tailored in pursuit of that interest” to avoid a Free Exercise",
        "paragraph_id": "para_455"
      },
      {
        "text": "violation. Id. at 564 (citation modified). Thus, for the",
        "paragraph_id": "para_456"
      },
      {
        "text": "Individual Defendants to be on notice that their actions",
        "paragraph_id": "para_457"
      },
      {
        "text": "would violate the Free Exercise Clause such that they are not",
        "paragraph_id": "para_458"
      },
      {
        "text": "covered by qualified immunity, there must be “clearly",
        "paragraph_id": "para_459"
      },
      {
        "text": "established” law that the facts here violate a “clearly",
        "paragraph_id": "para_460"
      },
      {
        "text": "established” Free Exercise right under the applicable",
        "paragraph_id": "para_461"
      },
      {
        "text": "standard of review.",
        "paragraph_id": "para_462"
      },
      {
        "text": "We also examine whether there are factually similar",
        "paragraph_id": "para_463"
      },
      {
        "text": "cases to determine if the alleged constitutional Free Exercise",
        "paragraph_id": "para_464"
      },
      {

      },
      {
        "text": "right was “clearly established” at the time of the challenged",
        "paragraph_id": "para_466"
      },
      {
        "text": "conduct. A.K.H. ex. rel. Landeros v. City of Tustin, 837 F.3d",
        "paragraph_id": "para_467"
      },
      {
        "text": "1005, 1013 (9th Cir. 2016) (“To determine whether [the",
        "paragraph_id": "para_468"
      },
      {
        "text": "officer] violated clearly established law, we look to ‘cases",
        "paragraph_id": "para_469"
      },
      {
        "text": "relevant to the situation [the officer] confronted.’” (quoting",
        "paragraph_id": "para_470"
      },
      {
        "text": "Brosseau v. Haugen, 543 U.S. 194, 200 (2004))). Courts",
        "paragraph_id": "para_471"
      },
      {
        "text": "may not deny qualified immunity based on cases post-dating",
        "paragraph_id": "para_472"
      },
      {
        "text": "the time of the alleged act “[b]ecause the focus is on whether",
        "paragraph_id": "para_473"
      },
      {
        "text": "the officer had fair notice that her conduct was unlawful,”",
        "paragraph_id": "para_474"
      },
      {
        "text": "Kisela v. Hughes, 584 U.S. 100, 104 (2018), so we “turn[] to",
        "paragraph_id": "para_475"
      },
      {
        "text": "Supreme Court and Ninth Circuit law existing at the time of",
        "paragraph_id": "para_476"
      },
      {
        "text": "the alleged act” in 2021, Cmty. House, Inc. v. City of Boise,",
        "paragraph_id": "para_477"
      },
      {
        "text": "623 F.3d 945, 967 (9th Cir. 2010) (citation modified).",
        "paragraph_id": "para_478"
      },
      {
        "text": "ii. MacDonald’s Allegations of the",
        "paragraph_id": "para_479"
      },
      {
        "text": "Individual Defendants’ Misconduct",
        "paragraph_id": "para_480"
      },
      {
        "text": "The “right to [free exercise of religion] is quite clearly",
        "paragraph_id": "para_481"
      },
      {
        "text": "established by the [First Amendment],” “[b]ut if the test of",
        "paragraph_id": "para_482"
      },
      {
        "text": "‘clearly established law’” was “applied at this level of",
        "paragraph_id": "para_483"
      },
      {
        "text": "generality,” it would “transform[] a guarantee of immunity”",
        "paragraph_id": "para_484"
      },
      {
        "text": "“into a rule of virtually unqualified liability” as long as",
        "paragraph_id": "para_485"
      },
      {
        "text": "plaintiffs “alleg[e] violation of extremely abstract rights.”",
        "paragraph_id": "para_486"
      },
      {
        "text": "Anderson, 483 U.S. at 639 (explaining principle in the Due",
        "paragraph_id": "para_487"
      },
      {
        "text": "Process context). To “define the contours of the right",
        "paragraph_id": "para_488"
      },
      {
        "text": "allegedly violated” we look to “what is really being",
        "paragraph_id": "para_489"
      },
      {
        "text": "litigated.” LSO, Ltd. v. Stroh, 205 F.3d 1146, 1158 (9th Cir.",
        "paragraph_id": "para_490"
      },
      {
        "text": "2000).",
        "paragraph_id": "para_491"
      },
      {
        "text": "Unlike many Free Exercise claims, MacDonald’s",
        "paragraph_id": "para_492"
      },
      {
        "text": "challenge is not to the passing or enforcement of a law or",
        "paragraph_id": "para_493"
      },
      {
        "text": "regulation that burdens her free exercise of religion, but to",
        "paragraph_id": "para_494"
      },
      {
        "text": "the Individual Defendants’ failure to grant her an exemption",
        "paragraph_id": "para_495"
      },
      {
        "text": "to a legal requirement for state healthcare employees to be",
        "paragraph_id": "para_496"
      },
      {
        "text": "vaccinated for COVID-19 amid a global pandemic. See e.g.,",
        "paragraph_id": "para_497"
      },
      {
        "text": "MACDONALD V. OR HEALTH & SCIENCE UNIVERSITY 17",
        "paragraph_id": "para_498"
      },
      {
        "text": "Church of Lukumi Babalu Aye, Inc. v. City of Hialeah., 508",
        "paragraph_id": "para_499"
      },
      {
        "text": "U.S. 520, 532–47 (1993). MacDonald’s allegations",
        "paragraph_id": "para_500"
      },
      {
        "text": "against the individual Board Defendants and the VERC",
        "paragraph_id": "para_501"
      },
      {
        "text": "Defendants slightly differ. 1 MacDonald alleges that the",
        "paragraph_id": "para_502"
      },
      {
        "text": "VERC Defendants violated her Free Exercise rights by",
        "paragraph_id": "para_503"
      },
      {
        "text": "denying MacDonald a vaccine exemption and forcing",
        "paragraph_id": "para_504"
      },
      {
        "text": "MacDonald to choose between her employment in the MBU",
        "paragraph_id": "para_505"
      },
      {
        "text": "or following her religious beliefs. MacDonald does not",
        "paragraph_id": "para_506"
      },
      {
        "text": "allege that the Board Defendants denied her vaccine",
        "paragraph_id": "para_507"
      },
      {
        "text": "exemption request but alleges that the Board Defendants",
        "paragraph_id": "para_508"
      },
      {
        "text": "“were, collectively responsible for establishing policies and",
        "paragraph_id": "para_509"
      },
      {
        "text": "protocols aimed at ensuring the health and safety of OHSU’s",
        "paragraph_id": "para_510"
      },
      {
        "text": "employees and patients during the COVID-19 pandemic”",
        "paragraph_id": "para_511"
      },
      {
        "text": "and “expressed overt hostility toward the religious beliefs of",
        "paragraph_id": "para_512"
      },
      {
        "text": "certain OHSU employees.” MacDonald also alleges that the",
        "paragraph_id": "para_513"
      },
      {
        "text": "“Board Defendants effectively declared that because",
        "paragraph_id": "para_514"
      },
      {
        "text": "multiple high-profile religious organizations had expressed",
        "paragraph_id": "para_515"
      },
      {
        "text": "approval of COVID-19 vaccines despite their connection to",
        "paragraph_id": "para_516"
      },
      {
        "text": "abortion,” MacDonald had “no excuse” for failing to",
        "paragraph_id": "para_517"
      },
      {

        "text": "defendant in its qualified immunity analysis, to the extent the dissent",
        "paragraph_id": "para_519"

      },
      {
        "text": "the Individual Defendants—not against OHSU. Moreover, even if",
        "paragraph_id": "para_521"
      },
      {
        "text": "MacDonald did assert a Free Exercise Claim against OHSU, a Free",
        "paragraph_id": "para_522"
      },
      {
        "text": "Exercise claim against OHSU is not proper because, as correctly",
        "paragraph_id": "para_523"
      },
      {
        "text": "observed by the district court, OHSU “is an arm of the state and is",
        "paragraph_id": "para_524"
      },
      {
        "text": "entitled to sovereign immunity under the Eleventh Amendment.”",
        "paragraph_id": "para_525"
      },
      {
        "text": "MacDonald v. Oregon Health & Sci. Univ., No. 3:22-CV-01942-IM,",
        "paragraph_id": "para_526"
      },
      {
        "text": "2024 WL 3316199, at *5 n.2 (D. Or. July 5, 2024) (quoting United States",
        "paragraph_id": "para_527"
      },
      {
        "text": "ex rel. Doughty v. Or. Health & Scis. Univ., No. 3:13-CV-01306-BR,",
        "paragraph_id": "para_528"
      },
      {
        "text": "2017 WL 1364208, at *3 (D. Or. Apr. 11, 2017) (“Every court that has",
        "paragraph_id": "para_529"
      },
      {
        "text": "addressed the issue and conducted an arm-of-the-state analysis has",
        "paragraph_id": "para_530"
      },
      {
        "text": "concluded OHSU is an arm of the State of Oregon entitled to Eleventh",
        "paragraph_id": "para_531"
      },
      {
        "text": "Amendment immunity.”) (collecting cases)).",
        "paragraph_id": "para_532"
      },
      {
        "text": "18 MACDONALD V. OR HEALTH & SCIENCE UNIVERSITY",
        "paragraph_id": "para_533"
      },
      {
        "text": "vaccinate and “pressure[ed] Plaintiff to conform to the",
        "paragraph_id": "para_534"
      },
      {
        "text": "prevailing approved religion.”2",
        "paragraph_id": "para_535"
      },
      {
        "text": "MacDonald’s allegations regarding the Individual",
        "paragraph_id": "para_536"
      },
      {
        "text": "Defendants’ misconduct are sparse,3 but essentially allege",
        "paragraph_id": "para_537"
      },
      {
        "text": "that the Individual Defendants engaged in impermissible",
        "paragraph_id": "para_538"
      },
      {
        "text": "religious hostility toward her beliefs by denying her a",
        "paragraph_id": "para_539"
      },
      {
        "text": "religious exemption based on her “fetal cell” and “bodily",
        "paragraph_id": "para_540"
      },
      {
        "text": "integrity or sanctity” objections to the COVID-19 vaccine.",
        "paragraph_id": "para_541"
      },
      {
        "text": "MacDonald fails, however, to allege any facts to support her",
        "paragraph_id": "para_542"
      },
      {
        "text": "conclusory claim that the September 30, 2021 email notice",
        "paragraph_id": "para_543"
      },
      {
        "text": "stating that vaccine objections based on “fetal cell” and",
        "paragraph_id": "para_544"
      },
      {
        "text": "“bodily integrity or sanctity” beliefs would not receive a",
        "paragraph_id": "para_545"
      },
      {
        "text": "religious exemption because these were “personal moral",
        "paragraph_id": "para_546"
      },
      {
        "text": "2 It is not apparent that MacDonald sufficiently alleged that the Board",
        "paragraph_id": "para_547"
      },
      {
        "text": "Defendants were “integral participants in the unlawful conduct” as",
        "paragraph_id": "para_548"
      },
      {
        "text": "required for a constitutional violation under 42 U.S.C. § 1983. Keates,",
        "paragraph_id": "para_549"
      },
      {
        "text": "883 F.3d at 1241. MacDonald does not allege that the Board Defendants",
        "paragraph_id": "para_550"
      },
      {
        "text": "denied her exemption request but only that the VERC Defendants did so.",
        "paragraph_id": "para_551"
      },
      {
        "text": "MacDonald alleges that “OHSU circulated to its employees” the",
        "paragraph_id": "para_552"
      },
      {
        "text": "September 30, 2021 email notice but does not allege that the Board",
        "paragraph_id": "para_553"
      },
      {
        "text": "Defendants personally authored, ratified, or enforced the September 30,",
        "paragraph_id": "para_554"
      },
      {
        "text": "2021 email notice. MacDonald alleges that the VERC Defendants",
        "paragraph_id": "para_555"
      },
      {
        "text": "denied her exemption request “pursuant to polices established by the",
        "paragraph_id": "para_556"
      },
      {
        "text": "Board Defendants” but fails to identify the policies the Board Defendants",
        "paragraph_id": "para_557"
      },
      {
        "text": "set, or allege that the Board Defendants personally drafted, reviewed, or",
        "paragraph_id": "para_558"
      },
      {
        "text": "ratified any specific policies. But for the purposes of the analysis here,",
        "paragraph_id": "para_559"
      },
      {
        "text": "we assume, arguendo, that MacDonald has alleged that the Board",
        "paragraph_id": "para_560"
      },
      {
        "text": "Defendants were “integral participants in the unlawful conduct.” Keates,",
        "paragraph_id": "para_561"
      },
      {
        "text": "883 F.3d at 1241.",
        "paragraph_id": "para_562"
      },
      {
        "text": "3 Other than OHSU’s October 7, 2021 email informing MacDonald that",
        "paragraph_id": "para_563"
      },
      {
        "text": "the Review Committee had denied MacDonald’s request for a religious",
        "paragraph_id": "para_564"
      },
      {
        "text": "exemption, MacDonald’s hostility allegations rely solely on the",
        "paragraph_id": "para_565"
      },
      {
        "text": "September 30, 2021 email notice OHSU sent to employees who had",
        "paragraph_id": "para_566"
      },
      {
        "text": "requested an exemption that provided “[e]xamples of beliefs that do not",
        "paragraph_id": "para_567"
      },
      {
        "text": "qualify for a religious exception.”",
        "paragraph_id": "para_568"
      },
      {
        "text": "MACDONALD V. OR HEALTH & SCIENCE UNIVERSITY 19",
        "paragraph_id": "para_569"
      },
      {
        "text": "choices” demonstrates that the Individual Defendants were",
        "paragraph_id": "para_570"
      },
      {
        "text": "motivated by “overt hostility” in denying MacDonald an",
        "paragraph_id": "para_571"
      },
      {
        "text": "exemption. To the contrary, the September 30, 2021 email",
        "paragraph_id": "para_572"
      },
      {
        "text": "demonstrates an attempt to counter and correct",
        "paragraph_id": "para_573"
      },
      {
        "text": "misinformation about the COVID-19 vaccine, by informing",
        "paragraph_id": "para_574"
      },
      {
        "text": "employees that “no fetal tissue or cells are contained in any",
        "paragraph_id": "para_575"
      },
      {
        "text": "of the [COVID-19] vaccines”; “HEK-293 cell lines created",
        "paragraph_id": "para_576"
      },
      {
        "text": "over 50 years ago were used in confirmatory testing of the",
        "paragraph_id": "para_577"
      },
      {
        "text": "current mRNA vaccines” but “played no role in their",
        "paragraph_id": "para_578"
      },
      {
        "text": "development or production”; and “[c]ells from the same line",
        "paragraph_id": "para_579"
      },
      {
        "text": "have commonly been used in biologic research since the late",
        "paragraph_id": "para_580"
      },
      {
        "text": "70s,” and are “used in testing of many common medicines,",
        "paragraph_id": "para_581"
      },
      {
        "text": "including Tylenol, Advil, Aspirin, Claritin, Benadryl, Pepto-",
        "paragraph_id": "para_582"
      },
      {
        "text": "Bismol, Mucinex, Tums and Prilosec, among many others.”",

        "text": "her conclusory claim that the Individual Defendants were",
        "paragraph_id": "para_586"
      },
      {
        "text": "motivated instead by religious hostility in denying her",
        "paragraph_id": "para_587"
      },
      {
        "text": "exemption request.",
        "paragraph_id": "para_588"
      },
      {
        "text": "At bottom, MacDonald alleges that the Individual",
        "paragraph_id": "para_589"
      },
      {
        "text": "Defendants infringed on MacDonald’s right to refuse a",
        "paragraph_id": "para_590"
      },
      {
        "text": "COVID-19 vaccine and continue to work in close-contact",
        "paragraph_id": "para_591"
      },
      {
        "text": "with medically vulnerable patients—including newborns,",
        "paragraph_id": "para_592"
      },
      {
        "text": "pregnant women, postpartum mothers, and patients",
        "paragraph_id": "para_593"
      },
      {
        "text": "undergoing cancer treatment—during the height of a deadly,",
        "paragraph_id": "para_594"
      },
      {
        "text": "global, COVID-19 pandemic, based on her religious beliefs",
        "paragraph_id": "para_595"
      },
      {
        "text": "regarding “fetal cells,” and “bodily integrity and sanctity”",
        "paragraph_id": "para_596"
      },
      {
        "text": "concerns. At the time the Individual Defendants denied",
        "paragraph_id": "para_597"
      },
      {
        "text": "MacDonald an exemption, there was no case, much less a",
        "paragraph_id": "para_598"
      },
      {
        "text": "body of case law, that clearly established a healthcare",
        "paragraph_id": "para_599"
      },
      {
        "text": "worker’s Free Exercise right to an exemption from a state-",
        "paragraph_id": "para_600"
      },
      {
        "text": "law mandated vaccine based on religious objections at the",
        "paragraph_id": "para_601"
      },
      {
        "text": "height of a global pandemic.",
        "paragraph_id": "para_602"
      },
      {
        "text": "20 MACDONALD V. OR HEALTH & SCIENCE UNIVERSITY",

        "text": "iii. Application",
        "paragraph_id": "para_604"
      },
      {
        "text": "None of the three cases MacDonald cites regarding the",
        "paragraph_id": "para_605"
      },
      {
        "text": "COVID-19 pandemic or vaccine mandates—Roman",
        "paragraph_id": "para_606"
      },
      {
        "text": "Catholic Diocese of Brooklyn v. Cuomo, 592 U.S. 14 (2020)",
        "paragraph_id": "para_607"
      },
      {
        "text": "(per curiam), Jacobson v. Massachusetts, 197 U.S. 11",
        "paragraph_id": "para_608"
      },
      {
        "text": "(1905), or Keene v. City & County of San Francisco, No. 22-",
        "paragraph_id": "para_609"
      },
      {
        "text": "16567, 2023 WL 3451687 (9th Cir. May 15, 2023)—",
        "paragraph_id": "para_610"
      },
      {
        "text": "“clearly establishes” that MacDonald had a right to a",
        "paragraph_id": "para_611"
      },
      {
        "text": "religion-based vaccine exemption. Roman Catholic",
        "paragraph_id": "para_612"
      },
      {
        "text": "involved a direct Free Exercise challenge to the New York",
        "paragraph_id": "para_613"
      },
      {
        "text": "Governor’s Executive Order regarding COVID-19 group",
        "paragraph_id": "para_614"
      },
      {
        "text": "gathering restrictions—not vaccine mandates—that",
        "paragraph_id": "para_615"
      },
      {
        "text": "expressly “single[d] out houses of worship for especially",
        "paragraph_id": "para_616"
      },
      {
        "text": "harsh treatment.” 592 U.S. at 17.4 By contrast, here, the",
        "paragraph_id": "para_617"
      },
      {
        "text": "Individual Defendants did not single out religion for",
        "paragraph_id": "para_618"
      },
      {
        "text": "“especially harsh treatment,” but rather, favorable treatment",
        "paragraph_id": "para_619"
      },
      {
        "text": "because individuals with vaccine objections based in secular",
        "paragraph_id": "para_620"
      },
      {
        "text": "beliefs did not have access to any exemption process. Id.",
        "paragraph_id": "para_621"
      },
      {
        "text": "MacDonald’s reliance on Jacobson v. Massachusetts,",
        "paragraph_id": "para_622"
      },
      {
        "text": "197 U.S. 11 (1905) is also misplaced; the case instead",
        "paragraph_id": "para_623"
      },
      {
        "text": "undermines MacDonald’s position. In Jacobson, the",
        "paragraph_id": "para_624"
      },
      {
        "text": "Supreme Court upheld a smallpox vaccine mandate where",
        "paragraph_id": "para_625"
      },
      {
        "text": "the plaintiff claimed the mandate violated his Fourteenth",
        "paragraph_id": "para_626"
      },
      {
        "text": "Amendment right to liberty. 197 U.S. at 27–30. The",
        "paragraph_id": "para_627"
      },
      {
        "text": "Supreme Court noted that failing to uphold the vaccine",
        "paragraph_id": "para_628"
      },
      {
        "text": "mandate would “strip the legislative department of its",
        "paragraph_id": "para_629"
      },
      {
        "text": "4 In November 2022, over a year after the Individual Defendants denied",
        "paragraph_id": "para_630"
      },
      {
        "text": "MacDonald’s exception request, this Court observed that even in Roman",
        "paragraph_id": "para_631"
      },
      {
        "text": "Catholic’s “pandemic closures” context, the law was not yet clearly",
        "paragraph_id": "para_632"
      },
      {
        "text": "established because “[t]he debate over pandemic closures and the Free",
        "paragraph_id": "para_633"
      },
      {
        "text": "Exercise Clause continued—and continues—even after Roman Catholic",
        "paragraph_id": "para_634"
      },
      {
        "text": "Diocese was decided.” Horizon Christian Sch. v. Brown, No. 21-35947,",
        "paragraph_id": "para_635"
      },
      {
        "text": "2022 WL 17038695, at *2 (9th Cir. Nov. 17, 2022).",
        "paragraph_id": "para_636"
      },
      {

        "text": "function to care for the public health and the public safety",
        "paragraph_id": "para_638"
      },
      {
        "text": "when endangered by epidemics of disease.” Id. at 37. The",
        "paragraph_id": "para_639"
      },
      {
        "text": "Jacobson Court recognized that the government has an",
        "paragraph_id": "para_640"
      },
      {
        "text": "interest in “preventing the spread of [disease] . . . to protect",
        "paragraph_id": "para_641"
      },
      {
        "text": "the public health.” Id. at 30–31. Years later, the Roman",
        "paragraph_id": "para_642"
      },
      {
        "text": "Catholic Court reiterated the same interest. 592 U.S. at 18",
        "paragraph_id": "para_643"
      },
      {
        "text": "(“[s]temming the spread of COVID–19 is unquestionably a",
        "paragraph_id": "para_644"
      },
      {
        "text": "compelling interest”). Protecting public health and safety",
        "paragraph_id": "para_645"
      },
      {
        "text": "remains a compelling government interest. Neither of these",
        "paragraph_id": "para_646"
      },
      {
        "text": "two cases “clearly establishes” MacDonald’s alleged right to",
        "paragraph_id": "para_647"
      },
      {
        "text": "a religious exemption to a legal mandate requiring healthcare",
        "paragraph_id": "para_648"
      },
      {
        "text": "workers to be vaccinated during a global pandemic while",
        "paragraph_id": "para_649"
      },
      {
        "text": "working with vulnerable populations in a hospital setting.",
        "paragraph_id": "para_650"
      },
      {
        "text": "Keene v. City & County of San Francisco also fails to",
        "paragraph_id": "para_651"
      },
      {
        "text": "support MacDonald’s position because Keene was decided",
        "paragraph_id": "para_652"
      },
      {
        "text": "almost two years after the Individual Defendants denied",
        "paragraph_id": "para_653"
      },
      {
        "text": "MacDonald an accommodation. No. 22-16567, 2023 WL",
        "paragraph_id": "para_654"
      },
      {
        "text": "3451687, at *1 (9th Cir. May 15, 2023). The Individual",
        "paragraph_id": "para_655"
      },
      {
        "text": "Defendants’ actions thus cannot be assessed under Keene",
        "paragraph_id": "para_656"
      },
      {
        "text": "because Keene was not “law at the time of the conduct.”",
        "paragraph_id": "para_657"
      },
      {
        "text": "Kisela, 584 U.S. at 104. Keene, moreover, did not address",
        "paragraph_id": "para_658"
      },
      {
        "text": "qualified immunity, the Free Exercise Clause, or a motion to",
        "paragraph_id": "para_659"
      },
      {
        "text": "dismiss. In Keene, the plaintiffs asserted Title VII failure to",
        "paragraph_id": "para_660"
      },
      {
        "text": "accommodate claims after they were denied religious",
        "paragraph_id": "para_661"
      },
      {
        "text": "exemptions to the defendants’ vaccine mandate and moved",
        "paragraph_id": "para_662"
      },
      {
        "text": "for a preliminary injunction requiring the City and County",
        "paragraph_id": "para_663"
      },
      {
        "text": "of San Francisco to accommodate their religious beliefs.",
        "paragraph_id": "para_664"
      },
      {
        "text": "Keene, 2023 WL 3451687, at *1. The Keene panel held that",
        "paragraph_id": "para_665"
      },
      {
        "text": "the district court erred in evaluating the first prong of a Title",
        "paragraph_id": "para_666"
      },
      {
        "text": "VII failure to accommodate prima facie case—whether an",
        "paragraph_id": "para_667"
      },
      {
        "text": "employee has a bona fide religious belief—by concluding",
        "paragraph_id": "para_668"
      },
      {
        "text": "that neither “Plaintiff ha[d] demonstrated that their religious",
        "paragraph_id": "para_669"
      },
      {
        "text": "beliefs are sincere or that those beliefs conflict with",
        "paragraph_id": "para_670"
      },
      {

        "text": "receiving the COVID-19 vaccine.” Id. at *2. Although “an",

        "text": "assertion of a sincere religious belief is generally accepted”",

      },
      {
        "text": "in the Title VII failure to accommodate prima facie analysis,",
        "paragraph_id": "para_674"
      },
      {
        "text": "id., the district court’s failure to properly assess a Title VII",
        "paragraph_id": "para_675"
      },
      {
        "text": "failure to accommodate prima facie case has no bearing on",
        "paragraph_id": "para_676"
      },
      {
        "text": "the qualified immunity analysis for a Free Exercise claim.",
        "paragraph_id": "para_677"
      },
      {
        "text": "MacDonald’s other cited cases involve substantially",
        "paragraph_id": "para_678"
      },
      {
        "text": "different facts and do not articulate a clearly established right",
        "paragraph_id": "para_679"
      },
      {
        "text": "under the Free Exercise Clause in the circumstances of her",
        "paragraph_id": "para_680"
      },
      {
        "text": "case. See Lukumi, 508 U.S. at 532–47 (holding that a city",
        "paragraph_id": "para_681"
      },
      {
        "text": "ordinance that allowed non-religious animal killing but",
        "paragraph_id": "para_682"
      },
      {
        "text": "prohibited ritual animal sacrifice targeted the Santeria",
        "paragraph_id": "para_683"
      },
      {
        "text": "religion, served no compelling government interest, was not",
        "paragraph_id": "para_684"
      },
      {
        "text": "narrowly tailored, and violated the Free Exercise Clause);",
        "paragraph_id": "para_685"
      },
      {
        "text": "Masterpiece Cakeshop Ltd. v. Colo. C.R. Comm’n, 584 U.S.",
        "paragraph_id": "para_686"
      },
      {
        "text": "617, 634 (2018) (holding that the Colorado state commission",
        "paragraph_id": "para_687"
      },
      {
        "text": "violated the Free Exercise Clause when it concluded that a",
        "paragraph_id": "para_688"
      },
      {
        "text": "baker was required under state law to create cakes for a",
        "paragraph_id": "para_689"
      },
      {
        "text": "same-sex wedding because the commission showed “clear",
        "paragraph_id": "para_690"
      },
      {
        "text": "and impermissible hostility” to baker’s religious beliefs in",
        "paragraph_id": "para_691"
      },
      {
        "text": "public meetings and upheld as lawful other bakers’ refusal",
        "paragraph_id": "para_692"
      },
      {
        "text": "to create cakes with images stating disapproval of same-sex",
        "paragraph_id": "para_693"
      },
      {
        "text": "marriage with religious text). MacDonald’s reliance on",
        "paragraph_id": "para_694"
      },
      {
        "text": "these factually distinct Free Exercise cases demands analysis",
        "paragraph_id": "para_695"
      },
      {
        "text": "of the alleged constitutional violation at an impermissibly",
        "paragraph_id": "para_696"
      },
      {
        "text": "“high level of generality” and “avoids the crucial question”",
        "paragraph_id": "para_697"
      },
      {
        "text": "of “whether the official acted reasonably in the particular",
        "paragraph_id": "para_698"
      },
      {
        "text": "circumstances that he or she faced,” which the Supreme",
        "paragraph_id": "para_699"
      },
      {
        "text": "Court has “repeatedly stressed” we may not do. District of",
        "paragraph_id": "para_700"
      },
      {
        "text": "Columbia v. Wesby, 583 U.S. 48, 62–63 (2018) (citing",
        "paragraph_id": "para_701"
      },
      {
        "text": "Plumhoff v. Rickard, 572 U.S. 765, 779 (2014)).",
        "paragraph_id": "para_702"
      },
      {
        "text": "Similarly, MacDonald’s cases regarding the denial of",
        "paragraph_id": "para_703"
      },
      {
        "text": "unemployment benefits and contraceptive mandates present",
        "paragraph_id": "para_704"
      },
      {

        "text": "substantially distinct and inapposite factual circumstances",
        "paragraph_id": "para_706"
      },
      {
        "text": "and legal claims and thus, did not provide fair notice to the",
        "paragraph_id": "para_707"
      },
      {
        "text": "Individual Defendants. See Thomas v. Rev. Bd. of Ind. Emp.",
        "paragraph_id": "para_708"
      },
      {
        "text": "Sec. Div., 450 U.S. 707, 719 (1981) (holding that state could",
        "paragraph_id": "para_709"
      },
      {
        "text": "not withhold unemployment benefits from someone who left",
        "paragraph_id": "para_710"
      },
      {
        "text": "a job because his religious beliefs would not allow him to",
        "paragraph_id": "para_711"
      },
      {
        "text": "make weapons); Sherbert v. Verner, 374 U.S. 398, 401–02",
        "paragraph_id": "para_712"
      },
      {
        "text": "(1963) (holding same for individual who had refused work",
        "paragraph_id": "para_713"
      },
      {
        "text": "based on the individual’s religious beliefs); Frazee v. Ill.",
        "paragraph_id": "para_714"
      },
      {
        "text": "Dep’t of Emp. Sec., 489 U.S. 829, 835 (1989) (holding same",
        "paragraph_id": "para_715"
      },
      {
        "text": "and noting that “there may exist state interests sufficiently",
        "paragraph_id": "para_716"
      },
      {
        "text": "compelling to override a legitimate claim to the free exercise",
        "paragraph_id": "para_717"
      },
      {
        "text": "of religion” but “[n]o such interest has been presented",
        "paragraph_id": "para_718"
      },
      {
        "text": "here”); Burwell v. Hobby Lobby Stores, Inc., 573 U.S. 682,",

      },
      {
        "text": "736 (2014) (analyzing only the Religious Freedom",

      },
      {
        "text": "Restoration Act of 1993 (“RFRA”) in holding that a",
        "paragraph_id": "para_721"
      },
      {
        "text": "government regulation requiring private employers to pay",
        "paragraph_id": "para_722"
      },
      {
        "text": "for contraceptives violated RFRA); Little Sisters of the Poor",
        "paragraph_id": "para_723"
      },
      {
        "text": "Saints Peter & Paul Home v. Pennsylvania, 591 U.S. 657,",

        "text": "to provide any notice to the Individual Defendants that",
        "paragraph_id": "para_729"
      },
      {
        "text": "denying a vaccine exemption to a healthcare worker amid a",
        "paragraph_id": "para_730"
      },
      {
        "text": "pandemic would be a “clearly established” violation of the",
        "paragraph_id": "para_731"
      },
      {
        "text": "Free Exercise Clause “in the specific context” of this case.",
        "paragraph_id": "para_732"
      },
      {
        "text": "Mullenix, 577 U.S. at 12 (citation modified).",
        "paragraph_id": "para_733"
      },
      {
        "text": "MacDonald also cites and quotes Dodge v. Evergreen",
        "paragraph_id": "para_734"
      },
      {
        "text": "School District #114, to argue that constitutional principles",
        "paragraph_id": "para_735"
      },
      {
        "text": "established in other contexts can apply “in novel factual",
        "paragraph_id": "para_736"
      },
      {
        "text": "circumstances,” if the “case involves mere application of",
        "paragraph_id": "para_737"
      },
      {
        "text": "settled law to a new factual permutation.” 56 F.4th 767, 784",
        "paragraph_id": "para_738"
      },
      {

        "text": "threatened a teacher’s employment if he continued to bring",

      },
      {
        "text": "a “Make America Great Again” hat to teacher-only trainings.",
        "paragraph_id": "para_742"
      },
      {
        "text": "Id. at 772–74. At the time of the principal’s actions, the",
        "paragraph_id": "para_743"
      },
      {
        "text": "Supreme Court had issued two decisions involving speech",
        "paragraph_id": "para_744"
      },
      {
        "text": "restrictions in public schools. See id.at 784–86. This Circuit",
        "paragraph_id": "para_745"
      },
      {
        "text": "applied those two Supreme Court decisions and prior Ninth",
        "paragraph_id": "para_746"
      },
      {
        "text": "Circuit decisions to the similar facts at issue in Dodge. Id.",
        "paragraph_id": "para_747"
      },
      {
        "text": "at 786–87. In other words, prior to Dodge, the Supreme",
        "paragraph_id": "para_748"
      },
      {
        "text": "Court had articulated certain principles in factual",
        "paragraph_id": "para_749"
      },
      {
        "text": "circumstances involving the same government action and",
        "paragraph_id": "para_750"
      },
      {
        "text": "context as those in Dodge—respectively speech restrictions",
        "paragraph_id": "para_751"
      },
      {
        "text": "and public schools. By contrast, MacDonald cites to no",
        "paragraph_id": "para_752"
      },
      {
        "text": "governing precedent regarding a state hospital’s response to",
        "paragraph_id": "para_753"
      },
      {
        "text": "a registered nurses’ religious exemption request to vaccine",
        "paragraph_id": "para_754"
      },
      {
        "text": "mandates during a pandemic. Nor is there binding precedent",
        "paragraph_id": "para_755"
      },
      {
        "text": "regarding the Free Exercise Clause where a government",
        "paragraph_id": "para_756"
      },
      {
        "text": "actor denies a religious exemption request submitted through",
        "paragraph_id": "para_757"
      },
      {
        "text": "a religious accommodation process. Thus, MacDonald’s",
        "paragraph_id": "para_758"
      },
      {
        "text": "case is not a “new factual permutation” of already “settled",
        "paragraph_id": "para_759"
      },
      {
        "text": "law,” but instead presents “novel factual circumstances”",
        "paragraph_id": "para_760"
      },
      {
        "text": "because no court had yet provided a decision, much less",
        "paragraph_id": "para_761"
      },
      {
        "text": "settled law in this factual context, when the Individual",
        "paragraph_id": "para_762"
      },
      {
        "text": "Defendants denied MacDonald’s exemption request. See",
        "paragraph_id": "para_763"
      },
      {
        "text": "Dodge, 56 F.4th at 784.5",
        "paragraph_id": "para_764"
      },
      {
        "text": "Furthermore, MacDonald’s failure to cite any Free",
        "paragraph_id": "para_765"
      },
      {
        "text": "Exercise case involving similar facts such that the Individual",
        "paragraph_id": "para_766"
      },
      {
        "text": "Defendants had fair notice of how the Free Exercise",
        "paragraph_id": "para_767"
      },
      {
        "text": "5 Dodge v. Evergreen Sch. Dist. #114, 56 F.4th 767 (9th Cir. 2022) was",
        "paragraph_id": "para_768"
      },
      {
        "text": "also decided after the Individual Defendants denied MacDonald an",
        "paragraph_id": "para_769"
      },
      {
        "text": "exception to work unvaccinated, and thus does not constitute relevant,",
        "paragraph_id": "para_770"
      },
      {
        "text": "existing precedent “at the time of the alleged act.” Cmty. House, Inc.,",
        "paragraph_id": "para_771"
      },
      {
        "text": "623 F.3d at 967 (citation modified).",
        "paragraph_id": "para_772"
      },
      {

        "text": "framework would apply in the circumstances presented,",

      },
      {
        "text": "including what standard of review would apply, also",

        "text": "demonstrates the lack of “clearly established” law applicable",
        "paragraph_id": "para_776"
      },
      {
        "text": "here. At most, the Individual Defendants were on notice that",
        "paragraph_id": "para_777"
      },
      {
        "text": "their actions would trigger rational basis review. In 2021,",
        "paragraph_id": "para_778"
      },
      {
        "text": "there was no clearly established law that strict scrutiny",
        "paragraph_id": "para_779"
      },
      {
        "text": "applies to facts where, as here, there are no allegations that",
        "paragraph_id": "para_780"
      },
      {
        "text": "the Individual Defendants “treat[ed] any comparable secular",
        "paragraph_id": "para_781"
      },
      {
        "text": "activity more favorably than religious exercise” such that the",
        "paragraph_id": "para_782"
      },
      {
        "text": "Individual Defendants’ actions were “not neutral and",
        "paragraph_id": "para_783"
      },
      {
        "text": "generally applicable.” Tandon v. Newsom, 593 U.S. 61, 62",
        "paragraph_id": "para_784"
      },
      {
        "text": "(2021) (emphasis in original) (citing Roman Catholic, 592",
        "paragraph_id": "para_785"
      },
      {
        "text": "U. S. at 18–20). By contrast, the Individual Defendants",
        "paragraph_id": "para_786"
      },
      {
        "text": "arguably provided preferential treatment toward healthcare",
        "paragraph_id": "para_787"
      },
      {
        "text": "employees with religious beliefs versus healthcare",
        "paragraph_id": "para_788"
      },
      {
        "text": "employees with secular beliefs—who had no option to seek",
        "paragraph_id": "para_789"
      },
      {
        "text": "any exemption. Furthermore, the September 30, 2021 email",
        "paragraph_id": "para_790"
      },
      {
        "text": "stated that any employee who objected based on “[c]oncerns",
        "paragraph_id": "para_791"
      },
      {
        "text": "over vaccine safety or content” would not be entitled to a",
        "paragraph_id": "para_792"
      },
      {
        "text": "religious exemption because “[t]hese are not religious",
        "paragraph_id": "para_793"
      },
      {
        "text": "arguments and [are] often inconsistent with proven facts.”",
        "paragraph_id": "para_794"
      },
      {

        "text": "safety or content” concerns including “fetal cell” or “bodily",
        "paragraph_id": "para_796"
      },
      {
        "text": "integrity or sanctity” concerns—no matter if such concerns",
        "paragraph_id": "para_797"
      },
      {
        "text": "were based in Christian, Muslim, other religious beliefs, or",
        "paragraph_id": "para_798"
      },
      {
        "text": "secular beliefs—were treated equally and remained subject",
        "paragraph_id": "para_799"
      },
      {
        "text": "to the mandatory vaccination policy.6 MacDonald fails to",
        "paragraph_id": "para_800"
      },
      {
        "text": "6 This is a different circumstance from the one presented in Lukumi. See",
        "paragraph_id": "para_801"
      },
      {
        "text": "508 U.S. at 543–46. There, to advance the city’s interest in preventing",
        "paragraph_id": "para_802"
      },

        "text": "animal cruelty, a city ordinance prohibited the killing of and disposal of",

      },
      {
        "text": "animals in Santeria sacrificial rituals but did not prohibit comparable",

        "text": "secularly motivated activities such as hunting or the extermination of",
        "paragraph_id": "para_805"
      },
      {
        "text": "mice or pests that likewise endangered the city’s interest in preventing",
        "paragraph_id": "para_806"
      },
      {

      },
      {
        "text": "cite any clearly established law to demonstrate that the",
        "paragraph_id": "para_808"
      },
      {
        "text": "Individual Defendants’ had fair notice that their actions were",
        "paragraph_id": "para_809"
      },
      {
        "text": "not neutral, generally applicable, and subject to rational basis",
        "paragraph_id": "para_810"
      },
      {
        "text": "review.",
        "paragraph_id": "para_811"
      },
      {
        "text": "Moreover, no caselaw is before us that would have",
        "paragraph_id": "para_812"
      },
      {
        "text": "provided the Individual Defendants with fair notice in 2021",
        "paragraph_id": "para_813"
      },
      {
        "text": "that the Individual Defendants’ interest in preventing the",
        "paragraph_id": "para_814"
      },
      {
        "text": "spread of COVID-19, thereby protecting public health and",
        "paragraph_id": "para_815"
      },
      {
        "text": "safety, would not satisfy rational basis review. See Roman",
        "paragraph_id": "para_816"
      },
      {
        "text": "Catholic, 592 U.S. at 18 (“[s]temming the spread of COVID-",
        "paragraph_id": "para_817"
      },
      {
        "text": "19 is unquestionably a compelling interest”); Jacobson, 197",
        "paragraph_id": "para_818"
      },
      {
        "text": "U.S. at 30–34 (recognizing that government had interest in",
        "paragraph_id": "para_819"
      },
      {
        "text": "“preventing the spread of [disease] . . . to protect the public",
        "paragraph_id": "para_820"
      },
      {
        "text": "health”); Brox v. Woods Hole, 164 F.4th 37, 50 (1st Cir.",
        "paragraph_id": "para_821"
      },
      {
        "text": "2026) (defendants had “legitimate interests in preventing the",
        "paragraph_id": "para_822"
      },
      {
        "text": "spread of COVID-19 and in protecting the health and safety",
        "paragraph_id": "para_823"
      },
      {
        "text": "of its employees, customers, and vendors”) (collecting",
        "paragraph_id": "para_824"
      },
      {
        "text": "cases). Thus, the only clearly established law regarding the",
        "paragraph_id": "para_825"
      },
      {
        "text": "specific factual circumstances here supports the Individual",
        "paragraph_id": "para_826"
      },
      {
        "text": "Defendants’ legitimate and compelling government interest",
        "paragraph_id": "para_827"
      },
      {
        "text": "in protecting the public health during a deadly global",
        "paragraph_id": "para_828"
      },
      {
        "text": "pandemic.",
        "paragraph_id": "para_829"
      },
      {
        "text": "Even assuming, arguendo, that strict scrutiny applies,",
        "paragraph_id": "para_830"
      },
      {
        "text": "MacDonald cites no case law that would have provided fair",
        "paragraph_id": "para_831"
      },
      {
        "text": "notice to the Individual Defendants that denying MacDonald",
        "paragraph_id": "para_832"
      },
      {
        "text": "a vaccine exemption would not survive strict scrutiny. The",
        "paragraph_id": "para_833"
      },
      {
        "text": "exemption denial was “narrowly tailored” to the",
        "paragraph_id": "para_834"
      },
      {
        "text": "“compelling government interest” of preventing the spread",
        "paragraph_id": "para_835"
      },
      {
        "text": "of COVID-19—especially when MacDonald’s job as a",
        "paragraph_id": "para_836"
      },
      {
        "text": "animal cruelty. See id. (city ordinance was not “generally applicable”",
        "paragraph_id": "para_837"
      },
      {
        "text": "because it prohibited “conduct motivated by religious beliefs” but not",
        "paragraph_id": "para_838"
      },
      {
        "text": "similar conduct motivated by secular activities).",
        "paragraph_id": "para_839"
      },
      {
        "text": "MACDONALD V. OR HEALTH & SCIENCE UNIVERSITY 27",

      },
      {
        "text": "registered nurse in the Mother Baby Unit required close",
        "paragraph_id": "para_841"
      },
      {
        "text": "contact with vulnerable populations. The COVID-19",
        "paragraph_id": "para_842"
      },
      {
        "text": "gathering restrictions on houses of worship in Roman",
        "paragraph_id": "para_843"
      },
      {
        "text": "Catholic, were not as stringently applied to gatherings for",
        "paragraph_id": "para_844"
      },
      {
        "text": "secular activities, prompting the Court to find that the more",
        "paragraph_id": "para_845"
      },
      {
        "text": "severe gathering restrictions on houses of worship were not",
        "paragraph_id": "para_846"
      },
      {
        "text": "“narrowly tailored” to serve the “compelling interest” of",
        "paragraph_id": "para_847"
      },
      {
        "text": "“[s]temming the spread of COVID-19.” 592 U.S. at 18.",
        "paragraph_id": "para_848"
      },
      {
        "text": "MacDonald does not contest that exemptions were not",
        "paragraph_id": "para_849"
      },
      {
        "text": "provided to employees with secular objections. Nor does",
        "paragraph_id": "para_850"
      },
      {
        "text": "MacDonald cite “clearly established” law that would",
        "paragraph_id": "para_851"
      },
      {
        "text": "provide the Individual Defendants fair notice that under the",
        "paragraph_id": "para_852"
      },
      {
        "text": "facts here, courts would find that “less restrictive” measures",
        "paragraph_id": "para_853"
      },
      {
        "text": "were available to “address [the government’s] interest in",
        "paragraph_id": "para_854"
      },
      {
        "text": "reducing the spread of COVID,” amongst its employees and",
        "paragraph_id": "para_855"
      },
      {
        "text": "patients, including vulnerable populations in the MBU. See",
        "paragraph_id": "para_856"
      },
      {
        "text": "Tandon, 593 U.S. at 63.",
        "paragraph_id": "para_857"
      },
      {
        "text": "Because MacDonald and the dissent fail to cite any",
        "paragraph_id": "para_858"
      },
      {
        "text": "governing precedent articulating principles in factual",
        "paragraph_id": "para_859"
      },
      {
        "text": "circumstances involving sufficiently similar government",
        "paragraph_id": "para_860"
      },
      {
        "text": "action and circumstances as those here—a state official’s",
        "paragraph_id": "para_861"
      },
      {
        "text": "denial of a religious exemption to a state governor’s vaccine",
        "paragraph_id": "para_862"
      },
      {
        "text": "mandate—the dissent must and does concede that this case",
        "paragraph_id": "para_863"
      },
      {
        "text": "presents “novel factual circumstances.” Dissent at 49. To",
        "paragraph_id": "para_864"
      },
      {
        "text": "address this concession, the dissent relies on the statement in",
        "paragraph_id": "para_865"
      },
      {
        "text": "Hope v. Pelzer that “officials can still be on notice that their",
        "paragraph_id": "para_866"
      },
      {
        "text": "conduct violates established law even in novel factual",
        "paragraph_id": "para_867"
      },
      {
        "text": "circumstances.” 536 U.S. 730, 741 (2002). But the Supreme",
        "paragraph_id": "para_868"
      },
      {
        "text": "Court’s analysis in Pelzer makes clear the complete dearth",
        "paragraph_id": "para_869"
      },
      {
        "text": "of clearly established law sufficient to provide fair notice to",
        "paragraph_id": "para_870"
      },
      {
        "text": "the Individual Defendants that their actions could be",
        "paragraph_id": "para_871"
      },
      {
        "text": "unconstitutional.",
        "paragraph_id": "para_872"
      },
      {
        "text": "28 MACDONALD V. OR HEALTH & SCIENCE UNIVERSITY",
        "paragraph_id": "para_873"
      },
      {
        "text": "In Pelzer, the Supreme Court held that prison guards",
        "paragraph_id": "para_874"
      },
      {
        "text": "were on notice that handcuffing a shirtless prisoner to a",
        "paragraph_id": "para_875"
      },
      {
        "text": "“hitching post” for seven hours with no bathroom breaks and",
        "paragraph_id": "para_876"
      },
      {
        "text": "limited water “while the sun burned his skin” violated the",
        "paragraph_id": "para_877"
      },
      {
        "text": "Eighth Amendment. Id. at 734–35, 741–42. Pelzer applied",
        "paragraph_id": "para_878"
      },
      {
        "text": "the same qualified immunity “clearly established” standard",
        "paragraph_id": "para_879"
      },
      {
        "text": "that the majority applies here, and states that “the salient",
        "paragraph_id": "para_880"
      },
      {
        "text": "question . . . is whether the state of the law in 1995 gave",
        "paragraph_id": "para_881"
      },
      {
        "text": "respondents fair warning that their alleged treatment of [the",
        "paragraph_id": "para_882"
      },
      {
        "text": "prisoner] was unconstitutional.” Id. at 741. The Supreme",
        "paragraph_id": "para_883"
      },
      {
        "text": "Court found that “in light of binding Eleventh Circuit",
        "paragraph_id": "para_884"
      },
      {
        "text": "precedent” holding that “handcuffing inmates to the fence",
        "paragraph_id": "para_885"
      },
      {
        "text": "and to cells for long periods of time” violated the Eighth",
        "paragraph_id": "para_886"
      },
      {
        "text": "Amendment, and the DOJ’s prior advisement to the",
        "paragraph_id": "para_887"
      },
      {
        "text": "Alabama Department of Corrections to “cease use of the",
        "paragraph_id": "para_888"
      },
      {
        "text": "hitching post in order to meet constitutional standards,” a",
        "paragraph_id": "para_889"
      },
      {
        "text": "“reasonable person would have known” that the prison",
        "paragraph_id": "para_890"
      },
      {
        "text": "guards’ actions violated “clearly established law.” Id. at",
        "paragraph_id": "para_891"
      },
      {
        "text": "741–45 (citation modified). In other words, like the Ninth",
        "paragraph_id": "para_892"
      },
      {
        "text": "Circuit in Dodge, the Supreme Court held that the Pelzer",
        "paragraph_id": "para_893"
      },
      {
        "text": "defendants were not entitled to qualified immunity because",
        "paragraph_id": "para_894"
      },
      {
        "text": "there was “clearly established” prior law that the same",
        "paragraph_id": "para_895"
      },
      {
        "text": "government action—tying a prisoner to a stationary object—",
        "paragraph_id": "para_896"
      },
      {
        "text": "in the same context—prisons—violated the Constitution.",
        "paragraph_id": "para_897"
      },
      {
        "text": "See id. Where, as here, MacDonald cites to no prior case",
        "paragraph_id": "para_898"
      },
      {
        "text": "involving a similar government action and context–a state",
        "paragraph_id": "para_899"
      },
      {
        "text": "official’s denial of a religious exemption to a state",
        "paragraph_id": "para_900"
      },
      {
        "text": "governor’s vaccine mandate during a global pandemic—",
        "paragraph_id": "para_901"
      },
      {
        "text": "there was no “clearly established” law sufficient to provide",
        "paragraph_id": "para_902"
      },
      {
        "text": "notice to the Individual Defendants that their actions were",
        "paragraph_id": "para_903"
      },
      {
        "text": "unconstitutional in 2021.",
        "paragraph_id": "para_904"
      },
      {
        "text": "The dissent asserts that our decision today will allow",
        "paragraph_id": "para_905"
      },
      {
        "text": "defendants to mischaracterize religious belief or practice as",
        "paragraph_id": "para_906"
      },
      {
        "text": "MACDONALD V. OR HEALTH & SCIENCE UNIVERSITY 29",
        "paragraph_id": "para_907"
      },
      {
        "text": "a “personal moral choice” to deny religious exemptions with",
        "paragraph_id": "para_908"
      },
      {
        "text": "impunity to a Muslim woman observing the wearing of a",
        "paragraph_id": "para_909"
      },
      {
        "text": "hijab, a Sikh man who maintains a beard, a Seventh-day",
        "paragraph_id": "para_910"
      },
      {
        "text": "Adventist who observes the Sabbath, and a Catholic doctor",
        "paragraph_id": "para_911"
      },
      {
        "text": "who refuses to perform an abortion. Dissent at 47. In these",
        "paragraph_id": "para_912"
      },
      {
        "text": "hypothetical circumstances, however, there is clearly",
        "paragraph_id": "para_913"
      },
      {
        "text": "established law that may preclude potential defendants who",
        "paragraph_id": "para_914"
      },
      {
        "text": "deny religious exemption requests based on these beliefs and",
        "paragraph_id": "para_915"
      },
      {
        "text": "practices from qualified immunity. See e.g., EEOC v.",
        "paragraph_id": "para_916"
      },
      {
        "text": "Abercrombie & Fitch Stores, Inc., 575 U.S. 768, 773–74",
        "paragraph_id": "para_917"
      },
      {
        "text": "(2015) (sustaining a Muslim woman’s right to observe",
        "paragraph_id": "para_918"
      },
      {
        "text": "wearing a hijab in the workplace); Holt v. Hobbs, 574 U.S.",
        "paragraph_id": "para_919"
      },
      {
        "text": "352, 356, 364–65 (2015) (holding that a state department of",
        "paragraph_id": "para_920"
      },
      {
        "text": "corrections policy prohibiting inmates from growing beards",
        "paragraph_id": "para_921"
      },
      {
        "text": "burdened a Muslim man’s religious exercise and was not in",
        "paragraph_id": "para_922"
      },
      {
        "text": "furtherance of or the least restrictive means to achieve a",
        "paragraph_id": "para_923"
      },
      {
        "text": "compelling government interest); Singh v. Berger, 56 F.4th",
        "paragraph_id": "para_924"
      },
      {
        "text": "88, 110 (D.C. Cir. 2022) (remanding to “district court for the",
        "paragraph_id": "para_925"
      },
      {
        "text": "prompt entry of a preliminary injunction requiring the",
        "paragraph_id": "para_926"
      },
      {
        "text": "Marine Corps to allow [two Sikh men] to enlist without",
        "paragraph_id": "para_927"
      },
      {
        "text": "shaving their heads or beards”); Groff v. DeJoy, 600 U.S.",
        "paragraph_id": "para_928"
      },
      {
        "text": "447, 468, 470 (2023) (holding that a denial of an",
        "paragraph_id": "para_929"
      },
      {
        "text": "accommodation to a worker not to work on Sabbath for",
        "paragraph_id": "para_930"
      },
      {
        "text": "religious reasons requires a showing of “substantial",
        "paragraph_id": "para_931"
      },
      {
        "text": "increased costs” on the employer rather than “de minimis”",
        "paragraph_id": "para_932"
      },
      {
        "text": "costs); Food & Drug Admin. v. All. for Hippocratic Med.,",
        "paragraph_id": "para_933"
      },
      {
        "text": "602 U.S. 367, 369 (2024) (“Federal law protects doctors",
        "paragraph_id": "para_934"
      },
      {
        "text": "from repercussions when they have ‘refused’ to participate",
        "paragraph_id": "para_935"
      },
      {
        "text": "in an abortion.”) (quoting 42 U.S.C.A. § 300a-7(c)(1)). 7",

      {

        "text": "treatment that violated the doctor’s conscience.” All. for Hippocratic",

      {

        "paragraph_id": "para_941"
      },
      {
        "text": "These hypothetical defendants would thus have “fair notice”",
        "paragraph_id": "para_942"
      },
      {
        "text": "from Supreme Court and appellate case law that such denials",
        "paragraph_id": "para_943"
      },
      {
        "text": "are a potential constitutional religious violation such that",
        "paragraph_id": "para_944"
      },
      {
        "text": "qualified immunity may not apply.8",
        "paragraph_id": "para_945"
      },
      {
        "text": "For similar reasons, the dissent’s use of an unlikely",
        "paragraph_id": "para_946"
      },
      {
        "text": "hypothetical race-based policy to argue that the majority’s",
        "paragraph_id": "para_947"
      },
      {
        "text": "qualified immunity analysis in the context of religious",
        "paragraph_id": "para_948"
      },
      {
        "text": "discrimination is flawed. The dissent asserts that because a",
        "paragraph_id": "para_949"
      },
      {
        "text": "race-based policy that “prohibited COVID vaccine",
        "paragraph_id": "para_950"
      },
      {
        "text": "exemptions for Asian employees” would not entitle",
        "paragraph_id": "para_951"
      },
      {
        "text": "defendants to qualified immunity based on the “novel factual",
        "paragraph_id": "para_952"
      },
      {
        "text": "circumstances” of a global pandemic, the majority’s",
        "paragraph_id": "para_953"
      },
      {
        "text": "qualified immunity analysis in the context of religious",
        "paragraph_id": "para_954"
      },
      {
        "text": "discrimination is incorrect. Dissent at 51. Again, with",
        "paragraph_id": "para_955"
      },
      {
        "text": "regard to race, there is longstanding, “clearly established”",
        "paragraph_id": "para_956"
      },
      {
        "text": "law that would preclude qualified immunity to hypothetical",
        "paragraph_id": "para_957"
      },
      {
        "text": "defendants who denied an exemption request based on race",
        "paragraph_id": "para_958"
      },
      {
        "text": "because the defendants would have fair notice that doing so",
        "paragraph_id": "para_959"
      },
      {
        "text": "would violate an entire host of race discrimination laws.9",
        "paragraph_id": "para_960"
      },
      {
        "text": "Med., 602 U.S. at 388 (There was no “evidence in the record . . . of",
        "paragraph_id": "para_961"
      },
      {
        "text": "hospitals overriding or failing to accommodate doctors’ conscience",
        "paragraph_id": "para_962"
      },
      {
        "text": "objections” to abortion). Likewise, here, OHSU provided MacDonald",
        "paragraph_id": "para_963"
      },
      {
        "text": "an accommodation such that she did not have to assist in abortions.",
        "paragraph_id": "para_964"
      },
      {
        "text": "8 Whether qualified immunity would be available to these hypothetical",
        "paragraph_id": "para_965"
      },
      {
        "text": "defendants would also require a showing that the denial of an exemption",
        "paragraph_id": "para_966"
      },
      {
        "text": "request on these bases would not survive the applicable level of scrutiny",
        "paragraph_id": "para_967"
      },
      {
        "text": "such that there is a Free Exercise violation on the second prong of the",
        "paragraph_id": "para_968"
      },
      {
        "text": "qualified immunity analysis.",
        "paragraph_id": "para_969"
      },
      {

        "text": "certain religious beliefs such as stating that it would not provide religious",
        "paragraph_id": "para_973"
      },
      {
        "text": "exemptions to Seventh Day Adventists but would for other religious",
        "paragraph_id": "para_974"
      },
      {
        "text": "MACDONALD V. OR HEALTH & SCIENCE UNIVERSITY 31",

      },
      {
        "text": "See e.g., Yick Wo v. Hopkins, 118 U.S. 356, 370 (1886)",
        "paragraph_id": "para_976"
      },
      {
        "text": "(striking down local law as unenforceable because denial of",
        "paragraph_id": "para_977"
      },
      {
        "text": "permits solely to Chinese-owned laundries violated the",
        "paragraph_id": "para_978"
      },
      {
        "text": "Equal Protection Clause).",
        "paragraph_id": "para_979"
      },
      {
        "text": "Even if we set aside the specific factual context here of",
        "paragraph_id": "para_980"
      },
      {
        "text": "an ongoing deadly pandemic, there is no “clearly",
        "paragraph_id": "para_981"
      },
      {
        "text": "established” law before us on religious constitutional",
        "paragraph_id": "para_982"
      },
      {
        "text": "violations regarding denials of exemptions to vaccine",
        "paragraph_id": "para_983"
      },
      {
        "text": "mandates or objections to medical products based on “fetal",
        "paragraph_id": "para_984"
      },
      {
        "text": "cell” and “bodily sanctity” concerns or “divine guidance”",
        "paragraph_id": "para_985"
      },
      {
        "text": "from God. Nor is there clearly established Free Exercise",
        "paragraph_id": "para_986"
      },
      {
        "text": "case law concerning a religious accommodation process that",
        "paragraph_id": "para_987"
      },
      {
        "text": "would provide fair notice to the Individual Defendants that",
        "paragraph_id": "para_988"
      },
      {
        "text": "denying an exemption here would violate the Free Exercise",
        "paragraph_id": "para_989"
      },
      {
        "text": "Clause.",
        "paragraph_id": "para_990"
      },
      {
        "text": "Moreover, even if we disregard the specific factual",
        "paragraph_id": "para_991"
      },
      {
        "text": "circumstances here and erroneously define the infringed",
        "paragraph_id": "para_992"
      },
      {
        "text": "upon constitutional right at a higher level of generality,",
        "paragraph_id": "para_993"
      },
      {
        "text": "which both this Circuit and the Supreme Court have",
        "paragraph_id": "para_994"
      },
      {
        "text": "“repeatedly stressed” we may not do, Wesby, 583 U.S. at 63",
        "paragraph_id": "para_995"
      },
      {
        "text": "(citing Plumhoff, 572 U.S. at 779), it is not “clearly",
        "paragraph_id": "para_996"
      },
      {
        "text": "established” that the Free Exercise Clause confers a",
        "paragraph_id": "para_997"
      },
      {
        "text": "constitutional right to a religious exemption that would",
        "paragraph_id": "para_998"
      },
      {
        "text": "permit an individual to disregard a law enacted to protect",
        "paragraph_id": "para_999"
      },
      {
        "text": "public health and safety—an exemption that a person with",
        "paragraph_id": "para_1000"
      },
      {
        "text": "secular objections could neither apply for nor be granted. To",
        "paragraph_id": "para_1001"
      },
      {
        "text": "the contrary, the Supreme Court has stated that “to say that",
        "paragraph_id": "para_1002"
      },
      {
        "text": "a nondiscriminatory religious-practice exemption is",
        "paragraph_id": "para_1003"
      },
      {
        "text": "beliefs. But here, anyone with objections based on vaccine safety and",
        "paragraph_id": "para_1004"
      },
      {
        "text": "content was not eligible for an exemption to a legal mandate to be",
        "paragraph_id": "para_1005"
      },
      {
        "text": "vaccinated, no matter if those objections stem from secular, Roman",
        "paragraph_id": "para_1006"
      },
      {
        "text": "Catholic, Muslim or any other religion’s beliefs.",
        "paragraph_id": "para_1007"
      },
      {
        "text": "32 MACDONALD V. OR HEALTH & SCIENCE UNIVERSITY",
        "paragraph_id": "para_1008"
      },
      {
        "text": "permitted, or even that it is desirable, is not to say that it is",
        "paragraph_id": "para_1009"
      },
      {

        "text": "Lastly, denying the Individual Defendants, who had no",
        "paragraph_id": "para_1011"
      },
      {
        "text": "notice that their conduct could be unlawful, the benefit of",
        "paragraph_id": "para_1012"
      },
      {
        "text": "qualified immunity subjects such defendants to individual",
        "paragraph_id": "para_1013"
      },
      {
        "text": "liability and undermines the very purpose of qualified",
        "paragraph_id": "para_1014"
      },
      {
        "text": "immunity to “ensure that before [government officers] are",
        "paragraph_id": "para_1015"
      },
      {
        "text": "subjected to suit, officers are on notice that their conduct is",
        "paragraph_id": "para_1016"
      },
      {
        "text": "unlawful.” Pelzer, 536 U.S. at 739 (citation modified).",
        "paragraph_id": "para_1017"
      },
      {
        "text": "Denying qualified immunity may also destabilize and",
        "paragraph_id": "para_1018"
      },
      {
        "text": "undermine the public health and safety goals of laws,",
        "paragraph_id": "para_1019"
      },
      {
        "text": "regulations, and orders, like the Vaccine Mandate here, of",
        "paragraph_id": "para_1020"
      },
      {
        "text": "democratically elected legislators and executive officers. If",
        "paragraph_id": "para_1021"
      },
      {
        "text": "such laws require the religious exemption process urged by",
        "paragraph_id": "para_1022"
      },
      {
        "text": "MacDonald, individual government actors would be",
        "paragraph_id": "para_1023"
      },
      {
        "text": "incentivized to grant religious exemptions to these legal",
        "paragraph_id": "para_1024"
      },
      {
        "text": "mandates to avoid the risk of individual liability, even if",
        "paragraph_id": "para_1025"
      },
      {
        "text": "there was no “clearly established” law to provide notice that",
        "paragraph_id": "para_1026"
      },
      {
        "text": "denying a religious exemption request in the specific factual",
        "paragraph_id": "para_1027"
      },
      {
        "text": "circumstances at issue would violate the Constitution.10",
        "paragraph_id": "para_1028"
      },
      {
        "text": "Because no “clearly established” law provided the",
        "paragraph_id": "para_1029"
      },
      {
        "text": "Individual Defendants fair notice in 2021 such that it would",
        "paragraph_id": "para_1030"
      },
      {
        "text": "have “be[en] clear” that the Individual Defendants’ denial of",
        "paragraph_id": "para_1031"
      },
      {
        "text": "a vaccine exemption request “was unlawful in the",
        "paragraph_id": "para_1032"
      },
      {
        "text": "situation . . . confronted,” the district court correctly found",
        "paragraph_id": "para_1033"
      },
      {
        "text": "10 Denying qualified immunity here would also veer dangerously close",
        "paragraph_id": "para_1034"
      },
      {
        "text": "to asking the Courts to “deem[]” as “presumptively invalid, as applied to",
        "paragraph_id": "para_1035"
      },
      {
        "text": "[any] religious objector, every regulation of conduct that does not protect",
        "paragraph_id": "para_1036"
      },
      {
        "text": "an interest of the highest order”—a “luxury” the Supreme Court has",
        "paragraph_id": "para_1037"
      },
      {
        "text": "advised “we cannot afford” because “we are a cosmopolitan nation made",
        "paragraph_id": "para_1038"
      },
      {
        "text": "up of people of almost every conceivable religious preference.” Smith,",
        "paragraph_id": "para_1039"
      },
      {
        "text": "494 U.S. at 888 (citation modified).",
        "paragraph_id": "para_1040"
      },
      {
        "text": "MACDONALD V. OR HEALTH & SCIENCE UNIVERSITY 33",

      },
      {
        "text": "that the Individual Defendants were entitled to qualified",
        "paragraph_id": "para_1042"
      },
      {
        "text": "immunity. Saucier, 533 U.S. at 202.",
        "paragraph_id": "para_1043"
      },
      {
        "text": "II. MacDonald’s Title VII Failure to Accommodate",
        "paragraph_id": "para_1044"
      },
      {
        "text": "Claim and Undue Hardship",
        "paragraph_id": "para_1045"
      },
      {
        "text": "We agree with the district court’s granting of summary",
        "paragraph_id": "para_1046"
      },
      {
        "text": "judgment to OHSU on MacDonald’s Title VII failure to",
        "paragraph_id": "para_1047"
      },
      {
        "text": "accommodate claim because OHSU demonstrated that it",
        "paragraph_id": "para_1048"
      },
      {
        "text": "could not have accommodated Macdonald without undue",
        "paragraph_id": "para_1049"
      },
      {
        "text": "hardship.",
        "paragraph_id": "para_1050"
      },
      {
        "text": "A. Religious Discrimination Under Title VII and",
        "paragraph_id": "para_1051"
      },
      {
        "text": "Undue Hardship",
        "paragraph_id": "para_1052"
      },
      {
        "text": "As amended, Title VII precludes any employer from",
        "paragraph_id": "para_1053"
      },
      {
        "text": "“discharg[ing] any individual” or “discriminat[ing] against",
        "paragraph_id": "para_1054"
      },
      {
        "text": "any individual . . . because of such individual’s . . . religion.”",
        "paragraph_id": "para_1055"
      },
      {
        "text": "42 U.S.C. § 2000e-2(a)(1). This Circuit has repeatedly held",
        "paragraph_id": "para_1056"
      },
      {
        "text": "that “‘[a] claim for religious discrimination under Title VII",
        "paragraph_id": "para_1057"
      },
      {
        "text": "can be asserted under several different theories,",
        "paragraph_id": "para_1058"
      },
      {
        "text": "including . . . failure to accommodate.’” Petersen v.",
        "paragraph_id": "para_1059"
      },
      {
        "text": "Snohomish Reg’l Fire & Rescue, 150 F.4th 1211, 1216 (9th",
        "paragraph_id": "para_1060"
      },
      {
        "text": "Cir. 2025) (quoting Peterson v. Hewlett-Packard Co. 358",
        "paragraph_id": "para_1061"
      },
      {
        "text": "F.3d 599, 603 (9th Cir. 2004) (separately analyzing both",
        "paragraph_id": "para_1062"
      },
      {
        "text": "Title VII religious disparate treatment claim and Title VII",
        "paragraph_id": "para_1063"
      },
      {
        "text": "religious failure to accommodate claim)). MacDonald",
        "paragraph_id": "para_1064"
      },
      {
        "text": "alleges religious discrimination based on a failure to",
        "paragraph_id": "para_1065"
      },
      {
        "text": "accommodate theory and not a disparate treatment",
        "paragraph_id": "para_1066"
      },
      {
        "text": "intentional discrimination theory.11",
        "paragraph_id": "para_1067"
      },
      {
        "text": "11 On December 22, 2023, MacDonald moved to amend her complaint",
        "paragraph_id": "para_1068"
      },
      {
        "text": "to add a Title VII disparate treatment claim against OHSU but later",
        "paragraph_id": "para_1069"
      },
      {
        "text": "withdrew the motion. MacDonald conceded at oral argument that",
        "paragraph_id": "para_1070"
      },
      {
        "text": "MacDonald has not alleged a Title VII religious discrimination claim",
        "paragraph_id": "para_1071"
      },
      {
        "text": "based on disparate treatment.",
        "paragraph_id": "para_1072"
      },
      {

      },
      {
        "text": "“Claims of failure to accommodate a religious objection",
        "paragraph_id": "para_1074"
      },
      {
        "text": "are analyzed under a burden-shifting framework.” Detwiler",
        "paragraph_id": "para_1075"
      },
      {
        "text": "v. Mid-Columbia Med. Ctr., 156 F.4th 886, 893 (9th Cir.",
        "paragraph_id": "para_1076"
      },
      {
        "text": "2025). First, a plaintiff must demonstrate a prima facie case",
        "paragraph_id": "para_1077"
      },
      {
        "text": "that:",
        "paragraph_id": "para_1078"
      },
      {
        "text": "(1) he had a bona fide religious belief, the",
        "paragraph_id": "para_1079"
      },
      {
        "text": "practice of which conflicts with an",
        "paragraph_id": "para_1080"
      },
      {
        "text": "employment duty; (2) he informed his",
        "paragraph_id": "para_1081"
      },
      {
        "text": "employer of the belief and conflict; and",
        "paragraph_id": "para_1082"
      },
      {
        "text": "(3) the employer discharged, threatened, or",
        "paragraph_id": "para_1083"
      },
      {
        "text": "otherwise subjected him to an adverse",
        "paragraph_id": "para_1084"
      },
      {
        "text": "employment action because of his inability to",
        "paragraph_id": "para_1085"
      },
      {
        "text": "fulfill the job requirement.",
        "paragraph_id": "para_1086"
      },
      {
        "text": "Snohomish, 150 F.4th at 1216 (citation modified). The",
        "paragraph_id": "para_1087"
      },
      {
        "text": "burden then shifts to the employer to show either that “it",
        "paragraph_id": "para_1088"
      },
      {
        "text": "initiated good faith efforts to accommodate reasonably the",
        "paragraph_id": "para_1089"
      },
      {
        "text": "employee’s religious practices or that it could not reasonably",
        "paragraph_id": "para_1090"
      },
      {
        "text": "accommodate the employee without undue hardship.” Id.",
        "paragraph_id": "para_1091"
      },
      {
        "text": "OHSU did not challenge MacDonald’s ability to make out a",
        "paragraph_id": "para_1092"
      },
      {
        "text": "prima facie case or argue that OHSU “initiated good faith",
        "paragraph_id": "para_1093"
      },
      {
        "text": "efforts to accommodate reasonably the employee's religious",
        "paragraph_id": "para_1094"
      },
      {
        "text": "practices,” so the only defense before us is undue hardship.",
        "paragraph_id": "para_1095"
      },
      {
        "text": "Id.",
        "paragraph_id": "para_1096"
      },
      {
        "text": "“Undue hardship is an affirmative defense.” Bolden-",
        "paragraph_id": "para_1097"
      },
      {
        "text": "Hardge v. Off. of Cal. State Controller, 63 F.4th 1215, 1224",
        "paragraph_id": "para_1098"
      },
      {
        "text": "(9th Cir. 2023) (citation modified). In Groff v. DeJoy, the",
        "paragraph_id": "para_1099"
      },
      {
        "text": "Supreme Court clarified that the “undue hardship” defense",
        "paragraph_id": "para_1100"
      },
      {
        "text": "requires more than a showing of de minimis costs but a",
        "paragraph_id": "para_1101"
      },
      {
        "text": "showing of “substantial increased costs in relation to the",
        "paragraph_id": "para_1102"
      },
      {
        "text": "conduct of [the employer’s] particular business.” 600 U.S.",
        "paragraph_id": "para_1103"
      },
      {
        "text": "447, 470 (2023) (citation modified). Courts must account",
        "paragraph_id": "para_1104"
      },
      {

      {
        "text": "for “all relevant factors . . . including the particular",
        "paragraph_id": "para_1106"
      },
      {
        "text": "accommodations at issue and their practical impact in light",
        "paragraph_id": "para_1107"
      },
      {
        "text": "of the nature, size and operating cost of [an] employer.” Id.",
        "paragraph_id": "para_1108"
      },
      {
        "text": "at 470–71. The Supreme Court clarified that potential co-",
        "paragraph_id": "para_1109"
      },
      {
        "text": "worker “bias or hostility to a religious practice” could not be",
        "paragraph_id": "para_1110"
      },
      {
        "text": "considered an “undue hardship.” Id. at 472. Groff left “the",
        "paragraph_id": "para_1111"
      },
      {
        "text": "context-specific application of th[e] clarified [undue",
        "paragraph_id": "para_1112"
      },
      {
        "text": "hardship] standard to the lower courts in the first instance,”",
        "paragraph_id": "para_1113"
      },
      {
        "text": "id. at 473, and has not yet revisited the standard.",
        "paragraph_id": "para_1114"
      },
      {
        "text": "This Circuit recently applied Groff in affirming grants of",
        "paragraph_id": "para_1115"
      },
      {
        "text": "summary judgment to defendants on Title VII failure to",
        "paragraph_id": "para_1116"
      },
      {
        "text": "accommodate COVID-19 vaccine exemption claims",
        "paragraph_id": "para_1117"
      },
      {
        "text": "because the employers “cleared [Groff’s] substantial-burden",
        "paragraph_id": "para_1118"
      },
      {
        "text": "bar.” Williams v. Legacy Health, 174 F.4th 1201, 1206 (9th",
        "paragraph_id": "para_1119"
      },
      {
        "text": "Cir. 2026) (affirming grant of summary judgment on Title",
        "paragraph_id": "para_1120"
      },
      {
        "text": "VII failure to accommodate vaccine exemption claims",
        "paragraph_id": "para_1121"
      },
      {
        "text": "because the hospitals demonstrated that accommodating the",
        "paragraph_id": "para_1122"
      },
      {
        "text": "employees’ beliefs would have imposed an “undue",
        "paragraph_id": "para_1123"
      },
      {
        "text": "hardship”); see also Snohomish, 150 F.4th at 1220 (affirming",
        "paragraph_id": "para_1124"
      },
      {
        "text": "grant of summary judgment to a county defendant which",
        "paragraph_id": "para_1125"
      },
      {
        "text": "provided fire suppression and emergency medical services",
        "paragraph_id": "para_1126"
      },
      {
        "text": "because “allowing unvaccinated firefighters to continue",
        "paragraph_id": "para_1127"
      },
      {
        "text": "working, even with accommodations” would have resulted",
        "paragraph_id": "para_1128"
      },
      {
        "text": "in “significant health and safety costs”).",
        "paragraph_id": "para_1129"
      },
      {
        "text": "In doing so, we agreed with our sister courts, which have",
        "paragraph_id": "para_1130"
      },
      {
        "text": "consistently upheld grants of summary judgment to",
        "paragraph_id": "para_1131"
      },
      {
        "text": "healthcare related defendants on the basis that",
        "paragraph_id": "para_1132"
      },
      {
        "text": "accommodating requests for religious exemptions from",
        "paragraph_id": "para_1133"
      },
      {
        "text": "COVID-19 vaccine mandates posed an undue hardship",
        "paragraph_id": "para_1134"
      },
      {
        "text": "because of the health, safety, operational, and financial",
        "paragraph_id": "para_1135"
      },
      {
        "text": "burdens unvaccinated workers posed to patients and",
        "paragraph_id": "para_1136"
      },
      {
        "text": "healthcare staff. See, e.g., Melino v. Bos. Med. Ctr., 127",
        "paragraph_id": "para_1137"
      },
      {
        "text": "F.4th 391 (1st Cir. 2025) (affirming grant of summary",
        "paragraph_id": "para_1138"
      },
      {

      {
        "text": "The Ninth Circuit has also “crystalized several aspects of",
        "paragraph_id": "para_1155"
      },
      {
        "text": "the Groff test.” Legacy Health, 174 F.4th at 1206. First,",
        "paragraph_id": "para_1156"
      },
      {
        "text": "Groff’s “‘substantial additional costs’ . . . need not be",
        "paragraph_id": "para_1157"
      },
      {
        "text": "exclusively monetary but can extend to “‘health and safety",
        "paragraph_id": "para_1158"
      },
      {
        "text": "costs’ and ‘operational burdens’” as well as traditional",
        "paragraph_id": "para_1159"
      },
      {
        "text": "‘financial burdens.’” Id. (quoting Snohomish, 150 F.4th at",
        "paragraph_id": "para_1160"
      },
      {
        "text": "1218); see also Groff, 600 U.S. at 475 (Sotomayor, J.,",
        "paragraph_id": "para_1161"
      },
      {
        "text": "concurring) (clarifying that “undue hardship on the conduct",
        "paragraph_id": "para_1162"
      },
      {
        "text": "of a business may include undue hardship on the business’s",
        "paragraph_id": "para_1163"
      },
      {
        "text": "employees”). Groff’s “substantial increased costs” also",
        "paragraph_id": "para_1164"
      },
      {
        "text": "“need not be realized prior to raising an undue-hardship",
        "paragraph_id": "para_1165"
      },
      {
        "text": "defense;” instead, a “realistic” and not “hypothetical” risk of",
        "paragraph_id": "para_1166"
      },
      {
        "text": "undue hardship” is sufficient. Id. (citation modified).",
        "paragraph_id": "para_1167"
      },
      {
        "text": "Furthermore, this Court does not “‘judge [a given employer]",
        "paragraph_id": "para_1168"
      },
      {
        "text": "by the responses taken by other [employers]’” because “[t]he",
        "paragraph_id": "para_1169"
      },
      {
        "text": "test boils down to undue hardship in the context of the",
        "paragraph_id": "para_1170"
      },
      {
        "text": "‘particular business’ before us. Id. (emphasis in original)",
        "paragraph_id": "para_1171"
      },
      {

        "text": "(quoting Snohomish, 150 F.4th at 1222; Groff, 600 U.S. at",

      {
        "text": "470).",
        "paragraph_id": "para_1174"
      },
      {
        "text": "B. OHSU Demonstrated that Accommodating",
        "paragraph_id": "para_1175"
      },
      {
        "text": "MacDonald Posed an Undue Hardship",
        "paragraph_id": "para_1176"
      },
      {
        "text": "We consider OHSU’s assertion of undue hardship in",
        "paragraph_id": "para_1177"
      },
      {
        "text": "accommodating MacDonald’s request for a vaccine",
        "paragraph_id": "para_1178"
      },
      {
        "text": "exemption. In discovery, MacDonald outlined the",
        "paragraph_id": "para_1179"
      },
      {
        "text": "accommodations that were available: “wear[ing] a mask,",
        "paragraph_id": "para_1180"
      },
      {
        "text": "test[ing] daily, stay[ing] home if sick,” “[w]earing additional",
        "paragraph_id": "para_1181"
      },
      {
        "text": "[PPE] as required when taking care of patients with active",
        "paragraph_id": "para_1182"
      },
      {
        "text": "COVID 19 symptoms,” and “submit[ting] to all other health",
        "paragraph_id": "para_1183"
      },
      {
        "text": "precautions that applied to all nurses, vaccinated or",
        "paragraph_id": "para_1184"
      },
      {
        "text": "otherwise.” In OHSU’s motion for summary judgment,",
        "paragraph_id": "para_1185"
      },
      {
        "text": "OHSU identified substantial health and safety, operational,",
        "paragraph_id": "para_1186"
      },
      {
        "text": "and financial costs if it allowed MacDonald to continue",
        "paragraph_id": "para_1187"
      },
      {
        "text": "working in the MBU, while unvaccinated, in close contact",
        "paragraph_id": "para_1188"
      },
      {
        "text": "with vulnerable patients.12 Consistent with our prior panels",
        "paragraph_id": "para_1189"
      },
      {
        "text": "and sister courts, we agree with the district court that OHSU",
        "paragraph_id": "para_1190"
      },
      {
        "text": "would have faced undue hardship in accommodating",
        "paragraph_id": "para_1191"
      },
      {
        "text": "MacDonald’s request for a vaccine exemption.",
        "paragraph_id": "para_1192"
      },
      {
        "text": "i. Health and Safety Risks",
        "paragraph_id": "para_1193"
      },
      {
        "text": "Circuit courts agree that the direct risk unvaccinated",
        "paragraph_id": "para_1194"
      },
      {
        "text": "individuals posed to the health and safety of patients and",
        "paragraph_id": "para_1195"
      },
      {
        "text": "12 At summary judgment, OHSU relied on three extensive declarations",
        "paragraph_id": "para_1196"
      },
      {
        "text": "and one expert report: (i) a declaration from Dr. Renee Edwards,",
        "paragraph_id": "para_1197"
      },
      {
        "text": "OHSU’s Chief Medical Officer, (ii) a declaration from Dr. Marcel",
        "paragraph_id": "para_1198"
      },
      {
        "text": "Curlin, Medical Director of OHSU’s Occupational Health Department",
        "paragraph_id": "para_1199"
      },
      {
        "text": "in 2021, (iii) a declaration from Molly Blaser, who worked in the MBU",
        "paragraph_id": "para_1200"
      },
      {
        "text": "as a registered nurse and serves as OHSU’s Director of Nursing Services",
        "paragraph_id": "para_1201"
      },
      {
        "text": "which involves managing the MBU and its nurses, and (iv) an expert",
        "paragraph_id": "para_1202"
      },
      {
        "text": "report from Dr. Seth Cohen, an expert in the spread, mitigation, and",
        "paragraph_id": "para_1203"
      },
      {
        "text": "treatment of infectious diseases including COVID-19.",
        "paragraph_id": "para_1204"
      },
      {

      {
        "text": "other employees are “substantial additional costs”",
        "paragraph_id": "para_1206"
      },
      {
        "text": "demonstrating “undue hardship.” See e.g., Legacy Health,",
        "paragraph_id": "para_1207"
      },
      {
        "text": "174 F.4th at 1206, 1208; Snohomish, 150 F.4th at 1220;",
        "paragraph_id": "para_1208"
      },
      {
        "text": "Bushra, 2025 WL 1078135, at *2 (granting summary",
        "paragraph_id": "para_1209"
      },
      {
        "text": "judgment to hospital because “[Plaintiff-doctor] treated",
        "paragraph_id": "para_1210"
      },
      {
        "text": "vulnerable patients in the normal course of his clinical",
        "paragraph_id": "para_1211"
      },
      {
        "text": "duties,” and hospital “provided unrebutted expert testimony",
        "paragraph_id": "para_1212"
      },
      {
        "text": "that unvaccinated healthcare workers . . . presented an",
        "paragraph_id": "para_1213"
      },
      {
        "text": "increased risk of transmitting COVID-19 to others,",
        "paragraph_id": "para_1214"
      },
      {
        "text": "particularly when they interacted with vulnerable groups”).",
        "paragraph_id": "para_1215"
      },
      {
        "text": "OHSU also presented extensive, undisputed evidence",
        "paragraph_id": "para_1216"
      },
      {
        "text": "that unvaccinated individuals were more likely to contract",

        "text": "and spread COVID-19. In his declaration, OHSU’s Medical",
        "paragraph_id": "para_1218"
      },
      {
        "text": "Director of Occupational Health affirmed that in 2021,",
        "paragraph_id": "para_1219"
      },
      {
        "text": "OHSU concluded that mandatory vaccination would protect",
        "paragraph_id": "para_1220"
      },
      {
        "text": "both patients and employees because medical data and",
        "paragraph_id": "para_1221"
      },
      {
        "text": "science at that time showed that unvaccinated workers were",
        "paragraph_id": "para_1222"
      },
      {
        "text": "more likely to contract and spread COVID-19. Compared to",
        "paragraph_id": "para_1223"
      },
      {
        "text": "non-vaccination measures like PPE and social distancing,",
        "paragraph_id": "para_1224"
      },
      {
        "text": "vaccination provided additional, unique protection",
        "paragraph_id": "para_1225"
      },
      {
        "text": "uncompromised by human error. An expert in the spread,",
        "paragraph_id": "para_1226"
      },
      {
        "text": "mitigation, and treatment of infectious diseases including",
        "paragraph_id": "para_1227"
      },
      {
        "text": "COVID-19, opined that because of COVID-19’s “threat to",
        "paragraph_id": "para_1228"
      },
      {
        "text": "patients and healthcare workers in the summer and fall of",
        "paragraph_id": "para_1229"
      },
      {
        "text": "2021,” mandatory COVID-19 vaccination policies were",
        "paragraph_id": "para_1230"
      },
      {
        "text": "critical to protecting employees and patients because “no",
        "paragraph_id": "para_1231"
      },
      {
        "text": "single measure was 100% effective on its own in protecting",
        "paragraph_id": "para_1232"
      },
      {
        "text": "individuals from COVID-19.” A combination of",
        "paragraph_id": "para_1233"
      },
      {
        "text": "vaccination and other measures such as PPE, social",
        "paragraph_id": "para_1234"
      },
      {
        "text": "distancing, and testing would provide maximum protection",
        "paragraph_id": "para_1235"
      },
      {
        "text": "against COVID-19. MacDonald, moreover, worked in the",
        "paragraph_id": "para_1236"
      },
      {
        "text": "MBU where its patients—pregnant mothers, newborns,",
        "paragraph_id": "para_1237"
      },
      {
        "text": "cancer patients and other immunocompromised patients—",
        "paragraph_id": "para_1238"
      },
      {
        "text": "MACDONALD V. OR HEALTH & SCIENCE UNIVERSITY 39",
        "paragraph_id": "para_1239"
      },
      {
        "text": "were especially vulnerable to developing severe or critical",
        "paragraph_id": "para_1240"
      },
      {
        "text": "life-threatening COVID-19.",
        "paragraph_id": "para_1241"
      },
      {
        "text": "Because accommodating MacDonald would have",
        "paragraph_id": "para_1242"
      },
      {
        "text": "increased the risk of severe COVID-19 illness amongst",
        "paragraph_id": "para_1243"
      },
      {
        "text": "patients and illness amongst OHSU’s employees who",
        "paragraph_id": "para_1244"
      },
      {
        "text": "provided hands-on, lifesaving, essential medical services,",
        "paragraph_id": "para_1245"
      },
      {
        "text": "OHSU’s evidence thus established that the health and safety",
        "paragraph_id": "para_1246"
      },
      {
        "text": "risks posed to OHSU’s patients and employees presented a",
        "paragraph_id": "para_1247"
      },
      {
        "text": "“substantial [hardship] in the context of [OHSU]’s",
        "paragraph_id": "para_1248"
      },
      {
        "text": "business,” Groff, 600 U.S. at 471, “serv[ing] the people of",
        "paragraph_id": "para_1249"
      },
      {
        "text": "the State of Oregon” and “deliver[ing]” health care “in the",
        "paragraph_id": "para_1250"
      },
      {
        "text": "manner that . . . best promotes the public welfare of the",
        "paragraph_id": "para_1251"
      },
      {
        "text": "people of the State of Oregon.” Or. Rev. Stat. § 353.030(1),",
        "paragraph_id": "para_1252"
      },
      {
        "text": "(4); see also Wise, 2025 WL 1392209, at *5 (affirming",
        "paragraph_id": "para_1253"
      },
      {
        "text": "undue hardship finding because the “hospital cares for",
        "paragraph_id": "para_1254"
      },
      {
        "text": "particularly vulnerable patients whose lives could be placed",
        "paragraph_id": "para_1255"
      },
      {
        "text": "at risk if they were to contract the virus” and because “[i]t",
        "paragraph_id": "para_1256"
      },
      {
        "text": "was thus paramount that Defendant take the highest",
        "paragraph_id": "para_1257"
      },
      {
        "text": "precautions to ensure the safety of those patients”); Rodrique",
        "paragraph_id": "para_1258"
      },
      {
        "text": "v. Hearst Commc’ns, Inc., 126 F.4th 85, 91 (1st Cir. 2025)",
        "paragraph_id": "para_1259"
      },
      {
        "text": "(finding undue hardship for employer broadcast news station",
        "paragraph_id": "para_1260"
      },
      {
        "text": "where “the record demonstrate[d] that [defendant] relied ‘on",
        "paragraph_id": "para_1261"
      },
      {
        "text": "the objective, scientific information available to [it]’” in",
        "paragraph_id": "para_1262"
      },
      {
        "text": "denying COVID-19 vaccine exemption (quoting Bragdon v.",
        "paragraph_id": "para_1263"
      },
      {
        "text": "Abbott, 524 U.S. 624, 649–50 (1998))).",
        "paragraph_id": "para_1264"
      },
      {
        "text": "ii. Operational and Financial Costs",
        "paragraph_id": "para_1265"
      },
      {
        "text": "Accommodating MacDonald also would have imposed",
        "paragraph_id": "para_1266"
      },
      {
        "text": "substantial operational and financial costs on OHSU. In",
        "paragraph_id": "para_1267"
      },
      {
        "text": "2021, MBU faced an ongoing nurse shortage that was further",
        "paragraph_id": "para_1268"
      },
      {
        "text": "exacerbated by COVID-19. Not only would unvaccinated",
        "paragraph_id": "para_1269"
      },
      {
        "text": "nurses like MacDonald be more likely to contract COVID-",
        "paragraph_id": "para_1270"
      },
      {
        "text": "19 and miss work, but unvaccinated nurses would also be at",
        "paragraph_id": "para_1271"
      },
      {
        "text": "40 MACDONALD V. OR HEALTH & SCIENCE UNIVERSITY",
        "paragraph_id": "para_1272"
      },
      {
        "text": "higher risk of infecting other MBU nurses and OHSU",
        "paragraph_id": "para_1273"
      },
      {
        "text": "personnel, compounding existing staffing and care",
        "paragraph_id": "para_1274"
      },
      {
        "text": "shortages. Here, as in Snohomish, “allowing unvaccinated",
        "paragraph_id": "para_1275"
      },
      {
        "text": "[healthcare workers] to work—even if they were masked,",
        "paragraph_id": "para_1276"
      },
      {
        "text": "tested regularly, and maintained social distancing—put other",
        "paragraph_id": "para_1277"
      },
      {
        "text": "[healthcare workers] at risk.” 150 F. 4th at 1220. “[G]iven",
        "paragraph_id": "para_1278"
      },
      {
        "text": "the community-critical nature of [OHSU]’s mission,” OHSU",
        "paragraph_id": "para_1279"
      },
      {
        "text": "“could not afford” or “assume lightly” the risk of “hav[ing]",
        "paragraph_id": "para_1280"
      },
      {
        "text": "substantial numbers of its [healthcare workers] on sick",
        "paragraph_id": "para_1281"
      },
      {
        "text": "leave.” Id. Moreover, removing MacDonald from the MBU",
        "paragraph_id": "para_1282"
      },
      {
        "text": "would have required OHSU either to have other vaccinated",
        "paragraph_id": "para_1283"
      },
      {
        "text": "MBU nurses cover MacDonald’s work or hire and pay for a",
        "paragraph_id": "para_1284"
      },
      {
        "text": "replacement nurse on top of MacDonald’s original salary.",
        "paragraph_id": "para_1285"
      },
      {
        "text": "Because of the ongoing nursing shortage and the fact that",
        "paragraph_id": "para_1286"
      },
      {
        "text": "MBU nurses have specialized training, OHSU would have",
        "paragraph_id": "para_1287"
      },
      {
        "text": "incurred substantial costs if it removed or transferred",
        "paragraph_id": "para_1288"
      },
      {
        "text": "MacDonald from the MBU. Title VII does not require",
        "paragraph_id": "para_1289"
      },
      {
        "text": "OHSU to bear such “substantial costs” to operate its",
        "paragraph_id": "para_1290"
      },
      {
        "text": "business. See id at 1221; Legacy Health, 174 F.4th at 1206–",
        "paragraph_id": "para_1291"
      },
      {
        "text": "07.",
        "paragraph_id": "para_1292"
      },
      {
        "text": "The district court did not err in finding that MacDonald’s",
        "paragraph_id": "para_1293"
      },
      {
        "text": "evidence, submitted in opposition to OHSU’s motion for",
        "paragraph_id": "para_1294"
      },
      {
        "text": "summary judgment, was either inadmissible hearsay, lacked",
        "paragraph_id": "para_1295"
      },
      {
        "text": "personal knowledge, required an expert opinion which",
        "paragraph_id": "para_1296"
      },
      {
        "text": "MacDonald did not provide, or failed to provide support for",
        "paragraph_id": "para_1297"
      },
      {
        "text": "MacDonald’s claimed propositions. OHSU’s evidence",
        "paragraph_id": "para_1298"
      },
      {
        "text": "regarding the “undue hardship” it would have faced in",
        "paragraph_id": "para_1299"
      },
      {
        "text": "accommodating MacDonald is undisputed and “so one-sided",
        "paragraph_id": "para_1300"
      },
      {
        "text": "that [OHSU] must prevail as a matter of law.” Anderson v.",
        "paragraph_id": "para_1301"
      },
      {
        "text": "Liberty Lobby, Inc., 477 U.S. 242, 251–52 (1986).",
        "paragraph_id": "para_1302"
      },
      {
        "text": "Consistent with our prior panels and sister courts, we agree",
        "paragraph_id": "para_1303"
      },
      {
        "text": "with the district court that OHSU would have faced undue",
        "paragraph_id": "para_1304"
      },
      {
        "text": "MACDONALD V. OR HEALTH & SCIENCE UNIVERSITY 41",
        "paragraph_id": "para_1305"
      },
      {
        "text": "hardship in accommodating MacDonald’s request for a",
        "paragraph_id": "para_1306"
      },
      {
        "text": "vaccine exemption.",
        "paragraph_id": "para_1307"
      },
      {
        "text": "C. MacDonald’s Pretext Arguments",
        "paragraph_id": "para_1308"
      },
      {
        "text": "MacDonald does not dispute OHSU’s evidence of undue",
        "paragraph_id": "para_1309"
      },
      {
        "text": "hardship on appeal but instead argues that the district court",
        "paragraph_id": "para_1310"
      },
      {
        "text": "erred in discounting MacDonald’s evidence of",
        "paragraph_id": "para_1311"
      },
      {
        "text": "discriminatory animus as immaterial to the undue hardship",
        "paragraph_id": "para_1312"
      },
      {
        "text": "analysis because evidence of discriminatory motives goes to",
        "paragraph_id": "para_1313"
      },
      {
        "text": "OHSU’s credibility and should be submitted to the jury.",
        "paragraph_id": "para_1314"
      },
      {
        "text": "MacDonald, however, cites no Supreme Court, Ninth",
        "paragraph_id": "para_1315"
      },
      {
        "text": "Circuit, or other Circuit case that imports a “pretext” or",
        "paragraph_id": "para_1316"
      },
      {
        "text": "“discriminatory motives” analysis into the “undue hardship”",
        "paragraph_id": "para_1317"
      },
      {
        "text": "failure to accommodate analysis—because there is none.13",
        "paragraph_id": "para_1318"
      },
      {
        "text": "Even assuming, arguendo, that pretext is applicable in",
        "paragraph_id": "para_1319"
      },
      {
        "text": "the failure to accommodate undue hardship analysis,",
        "paragraph_id": "para_1320"
      },
      {
        "text": "MacDonald has not presented a triable issue of material fact",
        "paragraph_id": "para_1321"
      },
      {
        "text": "establishing that OHSU’s demonstrated substantial",
        "paragraph_id": "para_1322"
      },
      {
        "text": "economic and noneconomic costs in allowing MacDonald to",
        "paragraph_id": "para_1323"
      },
      {
        "text": "work while unvaccinated were mere pretext. MacDonald",
        "paragraph_id": "para_1324"
      },
      {
        "text": "proffers only two pieces of evidence to support her",
        "paragraph_id": "para_1325"
      },
      {
        "text": "contention that OHSU acted with discriminatory intent:",
        "paragraph_id": "para_1326"
      },
      {
        "text": "(i) OHSU’s September 30, 2021 email notice to employees",
        "paragraph_id": "para_1327"
      },
      {
        "text": "and supervisors of employees who had requested an",
        "paragraph_id": "para_1328"
      },
      {

        "text": "Ohio Dep’t of Youth Servs., 605 U.S. 303, 306 (2025). The McDonnell",
        "paragraph_id": "para_1332"
      },
      {
        "text": "Douglas burden-shifting framework does include a pretext element in its",
        "paragraph_id": "para_1333"
      },
      {
        "text": "burden-shifting framework in disparate treatment claims. McDonnell",
        "paragraph_id": "para_1334"
      },
      {
        "text": "Douglas, 411 U.S. at 802–04. MacDonald, however, conceded at oral",
        "paragraph_id": "para_1335"
      },
      {
        "text": "argument that she did not allege a Title VII religious discrimination",
        "paragraph_id": "para_1336"
      },
      {
        "text": "disparate treatment claim. See also supra n. 11.",
        "paragraph_id": "para_1337"
      },
      {
        "text": "42 MACDONALD V. OR HEALTH & SCIENCE UNIVERSITY",
        "paragraph_id": "para_1338"
      },
      {
        "text": "exemption, and (ii) OHSU’s October 7, 2021 email to",
        "paragraph_id": "para_1339"
      },
      {
        "text": "MacDonald denying her religious exemption request.",
        "paragraph_id": "para_1340"
      },
      {
        "text": "MacDonald argues that OHSU’s email notices show that it",
        "paragraph_id": "para_1341"
      },
      {
        "text": "was “MacDonald’s beliefs,” and “not her position as a",
        "paragraph_id": "para_1342"
      },
      {
        "text": "nurse” in the MBU that disqualified her from an exemption",
        "paragraph_id": "para_1343"
      },
      {
        "text": "because the notices “say nothing at all about any hardship,",
        "paragraph_id": "para_1344"
      },
      {
        "text": "undue or otherwise” if MacDonald were allowed to continue",
        "paragraph_id": "para_1345"
      },
      {
        "text": "working. MacDonald’s argument ignores that OHSU’s",
        "paragraph_id": "para_1346"
      },
      {
        "text": "communications with MacDonald repeatedly referred to the",
        "paragraph_id": "para_1347"
      },
      {
        "text": "hardships OHSU faced. For example, in OHSU’s October",
        "paragraph_id": "para_1348"
      },
      {
        "text": "7, 2021 email to MacDonald denying her exemption request,",
        "paragraph_id": "para_1349"
      },
      {
        "text": "OHSU stated:",
        "paragraph_id": "para_1350"
      },
      {
        "text": "OHSU firmly stands behind the community",
        "paragraph_id": "para_1351"
      },
      {
        "text": "benefit of vaccination against COVID-19.",
        "paragraph_id": "para_1352"
      },
      {
        "text": "The decision not to get vaccinated can have",
        "paragraph_id": "para_1353"
      },
      {
        "text": "negative consequences to the unvaccinated",
        "paragraph_id": "para_1354"
      },
      {
        "text": "person and to those around them. While we",
        "paragraph_id": "para_1355"
      },
      {
        "text": "acknowledge each individual’s right to their",
        "paragraph_id": "para_1356"
      },
      {
        "text": "opinion and choice about vaccination, we",
        "paragraph_id": "para_1357"
      },
      {
        "text": "also need to ensure OHSU sets policy to",
        "paragraph_id": "para_1358"
      },
      {
        "text": "protect our patients and our community.",
        "paragraph_id": "para_1359"
      },
      {
        "text": "Though OHSU did not expressly use the words “undue",
        "paragraph_id": "para_1360"
      },
      {
        "text": "hardship,” it described the hardship OHSU faced in keeping",
        "paragraph_id": "para_1361"
      },
      {
        "text": "its employees, patients, and general community safe during",
        "paragraph_id": "para_1362"
      },
      {
        "text": "a deadly pandemic if it allowed unvaccinated healthcare",
        "paragraph_id": "para_1363"
      },
      {
        "text": "workers to continue working.",
        "paragraph_id": "para_1364"
      },
      {
        "text": "MacDonald also asserts that OHSU’s concerns about",
        "paragraph_id": "para_1365"
      },
      {
        "text": "“staffing issues” and the “impair[ment] of critical",
        "paragraph_id": "para_1366"
      },
      {
        "text": "operations” were disingenuous because, if there truly were",
        "paragraph_id": "para_1367"
      },
      {
        "text": "staffing issues, OHSU should have accommodated",
        "paragraph_id": "para_1368"
      },
      {
        "text": "MacDonald instead of terminating her employment.",
        "paragraph_id": "para_1369"
      },
      {
        "text": "MACDONALD V. OR HEALTH & SCIENCE UNIVERSITY 43",
        "paragraph_id": "para_1370"
      },
      {
        "text": "MacDonald overlooks that if she were permitted to continue",
        "paragraph_id": "para_1371"
      },
      {
        "text": "working in the MBU with vulnerable populations without a",
        "paragraph_id": "para_1372"
      },
      {
        "text": "COVID-19 vaccine amidst a global pandemic, OHSU would",
        "paragraph_id": "para_1373"
      },
      {
        "text": "not only have to manage the risk to MacDonald’s own",
        "paragraph_id": "para_1374"
      },
      {
        "text": "health, but also the risk to the health of her co-workers,",
        "paragraph_id": "para_1375"
      },
      {
        "text": "patients, and anyone she encountered while working in the",
        "paragraph_id": "para_1376"
      },
      {
        "text": "MBU.",
        "paragraph_id": "para_1377"
      },
      {
        "text": "Accordingly, the district court correctly observed that",
        "paragraph_id": "para_1378"
      },
      {
        "text": "there was no “support[]” for “the inference that Plaintiff was",
        "paragraph_id": "para_1379"
      },
      {
        "text": "subjected to religious animus.” Even if pretext were a part",
        "paragraph_id": "para_1380"
      },
      {
        "text": "of the analysis, MacDonald failed to raise any genuine",
        "paragraph_id": "para_1381"
      },
      {
        "text": "material issue of triable fact that OHSU’s concern for the",
        "paragraph_id": "para_1382"
      },
      {
        "text": "health of its patients and healthcare workers was merely",
        "paragraph_id": "para_1383"
      },
      {
        "text": "pretext for engaging in religious discrimination when it",
        "paragraph_id": "para_1384"
      },
      {
        "text": "denied MacDonald’s vaccine exemption request. OHSU",
        "paragraph_id": "para_1385"
      },
      {
        "text": "thus “cleared [Groff’s] substantial-burden bar” and",
        "paragraph_id": "para_1386"
      },
      {
        "text": "demonstrated that accommodating MacDonald would pose",
        "paragraph_id": "para_1387"
      },
      {
        "text": "an undue hardship. Legacy Health, 174 F.4th at 1206.",
        "paragraph_id": "para_1388"
      },
      {
        "text": "CONCLUSION",
        "paragraph_id": "para_1389"
      },
      {
        "text": "In light of the foregoing, we affirm the district court’s",
        "paragraph_id": "para_1390"
      },
      {
        "text": "granting of (i) the Individual Defendants’ motion to dismiss",
        "paragraph_id": "para_1391"
      },
      {
        "text": "MacDonald’s Free Exercise Claim on qualified immunity",
        "paragraph_id": "para_1392"
      },
      {
        "text": "grounds and (ii) OHSU’s motion for summary judgment on",
        "paragraph_id": "para_1393"
      },
      {
        "text": "MacDonald’s Title VII failure to accommodate claim on",
        "paragraph_id": "para_1394"
      },
      {
        "text": "undue hardship grounds.",
        "paragraph_id": "para_1395"
      },
      {
        "text": "AFFIRMED.",
        "paragraph_id": "para_1396"
      },
      {
        "text": "44 MACDONALD V. OR HEALTH & SCIENCE UNIVERSITY",
        "paragraph_id": "para_1397"
      },
      {
        "text": "TUNG, Circuit Judge, dissenting:",
        "paragraph_id": "para_1398"
      },
      {
        "text": "The discrimination against the plaintiff’s religion here",
        "paragraph_id": "para_1399"
      },
      {
        "text": "was so obvious that qualified immunity should have been",
        "paragraph_id": "para_1400"
      },
      {
        "text": "denied. I respectfully dissent.",
        "paragraph_id": "para_1401"
      },
      {
        "text": "Board members of Oregon Health and Science",
        "paragraph_id": "para_1402"
      },
      {
        "text": "University Hospital adopted a policy that purported to offer",
        "paragraph_id": "para_1403"
      },
      {
        "text": "exemptions to employees who objected to the State’s",
        "paragraph_id": "para_1404"
      },
      {
        "text": "COVID vaccine mandate on religious grounds. That policy,",
        "paragraph_id": "para_1405"
      },
      {
        "text": "however, made clear that certain religious beliefs were",
        "paragraph_id": "para_1406"
      },
      {
        "text": "acceptable while other religious beliefs were not.",
        "paragraph_id": "para_1407"
      },
      {
        "text": "What did the policy say? The policy provided for",
        "paragraph_id": "para_1408"
      },
      {
        "text": "“[r]eligious exceptions” and stated that “[i]n accordance",
        "paragraph_id": "para_1409"
      },
      {
        "text": "with relevant federal and Oregon law, members who can",
        "paragraph_id": "para_1410"
      },
      {
        "text": "demonstrate a sincerely held religious belief and past",
        "paragraph_id": "para_1411"
      },
      {
        "text": "behavior consistent with that belief will be approved for an",
        "paragraph_id": "para_1412"
      },
      {
        "text": "exception.” 3-ER-551. But the policy then enumerated",
        "paragraph_id": "para_1413"
      },
      {
        "text": "“[e]xamples of beliefs that do not qualify for a religious",
        "paragraph_id": "para_1414"
      },
      {
        "text": "exception,” including “[a]n objection to the vaccine on the",
        "paragraph_id": "para_1415"
      },
      {
        "text": "basis of fetal cell concerns, either in the vaccines or in testing",
        "paragraph_id": "para_1416"
      },
      {
        "text": "and development.” Id. (bold and underline in original). The",
        "paragraph_id": "para_1417"
      },
      {
        "text": "policy explained that “[t]hese professed beliefs are personal",
        "paragraph_id": "para_1418"
      },
      {
        "text": "moral choices and/or conscientious objections rather than a",
        "paragraph_id": "para_1419"
      },
      {
        "text": "tenet of a religious faith.” Id.",
        "paragraph_id": "para_1420"
      },
      {
        "text": "Brittany MacDonald applied for an exemption based on",
        "paragraph_id": "para_1421"
      },
      {
        "text": "her sincerely held religious belief in the sanctity of human",
        "paragraph_id": "para_1422"
      },
      {
        "text": "life. In her application, she explained that she believed in",
        "paragraph_id": "para_1423"
      },
      {
        "text": "“God’s presence with all children, born or unborn, as set",
        "paragraph_id": "para_1424"
      },
      {
        "text": "forth in Jer[e]miah 1:5[,] ‘Before I formed you in the womb",
        "paragraph_id": "para_1425"
      },
      {
        "text": "I knew you, before you were born I set you apart[.]’” 3-ER-",
        "paragraph_id": "para_1426"
      },
      {
        "text": "546. As a result, she could not, in any way, participate in or",
        "paragraph_id": "para_1427"
      },
      {
        "text": "encourage abortion. Her Christian faith thus requires her “to",
        "paragraph_id": "para_1428"
      },
      {

      {

      },
      {
        "text": "vaccines, that are created using human cell lines derived",
        "paragraph_id": "para_1431"
      },
      {
        "text": "from abortion during any stage of the vaccine’s",
        "paragraph_id": "para_1432"
      },
      {
        "text": "development, including the testing phase of development of",
        "paragraph_id": "para_1433"
      },
      {
        "text": "a medical product.” 3-ER-543. But members of the Vaccine",
        "paragraph_id": "para_1434"
      },
      {
        "text": "Exemption Review Committee denied her request because,",
        "paragraph_id": "para_1435"
      },
      {
        "text": "under the State university’s policy, her religious belief was",
        "paragraph_id": "para_1436"
      },
      {
        "text": "not religious at all. 3-ER-549. She was told that her belief",
        "paragraph_id": "para_1437"
      },
      {
        "text": "was, rather, a mere “personal moral choice[]” and a",
        "paragraph_id": "para_1438"
      },
      {
        "text": "“conscientious objection[]”—not a “tenet of a religious",
        "paragraph_id": "para_1439"
      },
      {
        "text": "faith.” Id. at 549, 551. MacDonald was then fired for",
        "paragraph_id": "para_1440"
      },
      {
        "text": "refusing to take the vaccine, after which she sued the",
        "paragraph_id": "para_1441"
      },
      {
        "text": "members of the University hospital board and the review",
        "paragraph_id": "para_1442"
      },
      {
        "text": "committee who deemed her religious beliefs unworthy of",
        "paragraph_id": "para_1443"
      },
      {
        "text": "consideration.",
        "paragraph_id": "para_1444"
      },
      {
        "text": "It is hard to imagine a more offensive rejection of one’s",
        "paragraph_id": "para_1445"
      },
      {
        "text": "religious faith. To disagree with another person’s religious",
        "paragraph_id": "para_1446"
      },
      {
        "text": "belief is one thing. But to tell a person that her deeply held",
        "paragraph_id": "para_1447"
      },
      {
        "text": "religious conviction is, really, not religious at all—because",
        "paragraph_id": "para_1448"
      },
      {
        "text": "it has nothing to do with God or the supernatural—is not",
        "paragraph_id": "para_1449"
      },
      {
        "text": "only deceptive (a form of gaslighting), it is demeaning. And",
        "paragraph_id": "para_1450"
      },
      {
        "text": "for State university officials to disrespect (and discredit) a",
        "paragraph_id": "para_1451"
      },
      {
        "text": "person’s religious beliefs in that manner, and to terminate",
        "paragraph_id": "para_1452"
      },
      {
        "text": "her from her job as a result, runs afoul of the First",
        "paragraph_id": "para_1453"
      },
      {
        "text": "Amendment. The Defendants’ behavior here displays a",
        "paragraph_id": "para_1454"
      },
      {
        "text": "conceited rejection of a religious belief that the Supreme",
        "paragraph_id": "para_1455"
      },
      {
        "text": "Court has stridently admonished and found to be",
        "paragraph_id": "para_1456"
      },
      {
        "text": "unconstitutional. See Masterpiece Cakeshop, Ltd. v. Colo.",
        "paragraph_id": "para_1457"
      },
      {
        "text": "C.R. Comm’n, 584 U.S. 617, 634 (2018).",
        "paragraph_id": "para_1458"
      },
      {
        "text": "But even putting that animus aside, the Defendants’",
        "paragraph_id": "para_1459"
      },
      {
        "text": "“religious exception” policy violated the Free Exercise",
        "paragraph_id": "para_1460"
      },
      {
        "text": "Clause in another way. “[T]he protections of the Free",
        "paragraph_id": "para_1461"
      },
      {
        "text": "Exercise Clause pertain if the law at issue discriminates",
        "paragraph_id": "para_1462"
      },
      {

      },
      {
        "text": "against some or all religious beliefs or regulates or prohibits",
        "paragraph_id": "para_1464"
      },
      {
        "text": "conduct because it is undertaken for religious reasons.”",
        "paragraph_id": "para_1465"
      },
      {
        "text": "Church of Lukumi Babalu Aye, Inc. v. City of Hialeah, 508",
        "paragraph_id": "para_1466"
      },
      {
        "text": "U.S. 520, 532 (1993). Here, the policy targeted specific",
        "paragraph_id": "para_1467"
      },
      {
        "text": "religious beliefs as not worthy of consideration, while",
        "paragraph_id": "para_1468"
      },
      {
        "text": "purporting to be open to other bases for an exemption",
        "paragraph_id": "para_1469"
      },
      {
        "text": "(secular or religious). In particular, the policy singled out an",
        "paragraph_id": "para_1470"
      },
      {
        "text": "employee’s religious objection to abortion and the use of",
        "paragraph_id": "para_1471"
      },
      {
        "text": "fetal tissue as categorically undeserving of any",
        "paragraph_id": "para_1472"
      },
      {
        "text": "consideration. That is a classic case of the State “targeting",
        "paragraph_id": "para_1473"
      },
      {
        "text": "religious beliefs” and “is never permissible.” Id. at 533.",
        "paragraph_id": "para_1474"
      },
      {
        "text": "The Defendants cannot contend that they target no",
        "paragraph_id": "para_1475"
      },
      {
        "text": "“religious belief” since they do not consider that belief",
        "paragraph_id": "para_1476"
      },
      {
        "text": "(against the use of aborted fetal cells) to be “religious” in the",
        "paragraph_id": "para_1477"
      },
      {
        "text": "first place. That defense, as discussed, is untenable. We do",
        "paragraph_id": "para_1478"
      },
      {
        "text": "not take our direction from a State university or its officials",
        "paragraph_id": "para_1479"
      },
      {
        "text": "as to what is or is not “religious.” Just because State officials",
        "paragraph_id": "para_1480"
      },
      {
        "text": "say so, does not make it so. The Supreme Court teaches that",
        "paragraph_id": "para_1481"
      },
      {
        "text": "we must credit what the adherent says about her religion—",
        "paragraph_id": "para_1482"
      },
      {
        "text": "so long as it is sincerely held (a condition that the Defendants",
        "paragraph_id": "para_1483"
      },
      {
        "text": "do not question). See Thomas v. Rev. Bd. of Ind. Emp. Sec.",
        "paragraph_id": "para_1484"
      },
      {
        "text": "Div., 450 U.S. 707, 716 (1981); United States v. Seeger, 380",
        "paragraph_id": "para_1485"
      },
      {
        "text": "U.S. 163, 185 (1965). As the Supreme Court has instructed,",
        "paragraph_id": "para_1486"
      },
      {
        "text": "too, the Free Exercise Clause forbids “covert suppression of",
        "paragraph_id": "para_1487"
      },
      {
        "text": "particular religious beliefs,” Church of Lukumi, 508 U.S. at",
        "paragraph_id": "para_1488"
      },
      {
        "text": "534 (quoting Bowen v. Roy, 476 U.S. 693, 703 (1986))—",
        "paragraph_id": "para_1489"
      },
      {
        "text": "although the policy here was quite overt. We therefore must",
        "paragraph_id": "para_1490"
      },
      {
        "text": "reject the Orwellian word games played by the Defendants",
        "paragraph_id": "para_1491"
      },
      {
        "text": "where “religious” means not “religious” but “state",
        "paragraph_id": "para_1492"
      },
      {
        "text": "approved.”",
        "paragraph_id": "para_1493"
      },
      {
        "text": "If the Defendants were right that objection to the use of",
        "paragraph_id": "para_1494"
      },
      {
        "text": "aborted fetal cells is a mere “personal moral choice” and not",
        "paragraph_id": "para_1495"
      },
      {
        "text": "“religious,” it could deny religious exemptions to all manner",
        "paragraph_id": "para_1496"
      },
      {

      },
      {
        "text": "of adherents in other contexts: the Muslim woman who",
        "paragraph_id": "para_1498"
      },
      {
        "text": "wears a hijab is exercising a mere sartorial choice, not a",
        "paragraph_id": "para_1499"
      },
      {
        "text": "religious one, so she must remove it; a Sikh man who keeps",
        "paragraph_id": "para_1500"
      },
      {
        "text": "a beard has made a grooming decision, not a religious one,",
        "paragraph_id": "para_1501"
      },
      {
        "text": "so he must cut it; a Seventh-Day Adventist who wants to",
        "paragraph_id": "para_1502"
      },
      {
        "text": "keep his day of Sabbath free from labor seeks personal",
        "paragraph_id": "para_1503"
      },
      {
        "text": "relaxation, not religious observance, so he cannot excuse",
        "paragraph_id": "para_1504"
      },
      {
        "text": "himself from it; and a Catholic doctor who refuses to",
        "paragraph_id": "para_1505"
      },
      {
        "text": "perform an abortion is exercising a “personal moral choice”",
        "paragraph_id": "para_1506"
      },
      {
        "text": "and a “conscientious objection,” not a religious objection, so",
        "paragraph_id": "para_1507"
      },
      {
        "text": "she must perform it. If religious beliefs could be",
        "paragraph_id": "para_1508"
      },
      {
        "text": "transmogrified in this way, Free Exercise as we know it",
        "paragraph_id": "para_1509"
      },
      {
        "text": "would be dead.1",
        "paragraph_id": "para_1510"
      },
      {
        "text": "Even on its own terms, the Defendants’ logic folds in on",
        "paragraph_id": "para_1511"
      },
      {
        "text": "itself. Contrary to the Defendants’ rationale, a “personal",
        "paragraph_id": "para_1512"
      },
      {
        "text": "moral choice” is not exclusive of a “religious” choice. For",
        "paragraph_id": "para_1513"
      },
      {
        "text": "many, personal morals are defined by one’s religion. Nor",
        "paragraph_id": "para_1514"
      },
      {
        "text": "does a “conscientious objection” exclude a “religious”",
        "paragraph_id": "para_1515"
      },
      {
        "text": "objection. For many, personal conscience is formed by one’s",
        "paragraph_id": "para_1516"
      },
      {
        "text": "religion. Religion, morals, and conscience go hand in hand.",
        "paragraph_id": "para_1517"
      },
      {
        "text": "Only with a mindset steeped in a shallow secularism, so alien",
        "paragraph_id": "para_1518"
      },
      {
        "text": "1 The majority says that the perpetrators of religious discrimination in",
        "paragraph_id": "para_1519"
      },
      {
        "text": "the hypotheticals would violate clearly established law. Majority at 29–",
        "paragraph_id": "para_1520"
      },

        "text": "30. I agree. Just as they would violate clearly established law there, the",
        "paragraph_id": "para_1521"
      },
      {
        "text": "Defendants violate clearly established law here. The majority",
        "paragraph_id": "para_1522"
      },
      {
        "text": "nevertheless tries to distinguish the hypotheticals from our case, by citing",
        "paragraph_id": "para_1523"
      },
      {
        "text": "precedent that purportedly “clearly establishes” the prohibition. But not",
        "paragraph_id": "para_1524"
      },
      {
        "text": "only does that attempt fail, it confirms my point. None of the cited cases",
        "paragraph_id": "para_1525"
      },
      {
        "text": "addresses a violation of the Free Exercise Clause; all are statutory cases.",
        "paragraph_id": "para_1526"
      },
      {
        "text": "None, therefore, is analogous in the sense the majority would require to",
        "paragraph_id": "para_1527"
      },
      {
        "text": "deny qualified immunity. Yet the fact that the majority would still deny",
        "paragraph_id": "para_1528"
      },
      {
        "text": "qualified immunity in the hypotheticals demonstrates the obviousness of",
        "paragraph_id": "para_1529"
      },
      {
        "text": "the religious discrimination there, which is no different from its",
        "paragraph_id": "para_1530"
      },
      {
        "text": "obviousness here.",
        "paragraph_id": "para_1531"
      },
      {

        "text": "to our founding principles and removed from the values of",
        "paragraph_id": "para_1533"
      },
      {
        "text": "our people, can one fail to see the connection between a",
        "paragraph_id": "para_1534"
      },
      {
        "text": "person’s religion and her morals.2",
        "paragraph_id": "para_1535"
      },
      {
        "text": "The pall of secularism prevents the majority from seeing",
        "paragraph_id": "para_1536"
      },
      {
        "text": "and thus protecting the plaintiff’s obvious First Amendment",
        "paragraph_id": "para_1537"
      },
      {
        "text": "right here. The majority concludes that qualified immunity",
        "paragraph_id": "para_1538"
      },
      {
        "text": "must be granted to the Defendants because they faced “novel",
        "paragraph_id": "para_1539"
      },
      {
        "text": "factual circumstances” and there was “no case, much less a",
        "paragraph_id": "para_1540"
      },
      {
        "text": "body of case law, that clearly established a healthcare",
        "paragraph_id": "para_1541"
      },
      {
        "text": "worker’s Free Exercise right to an exemption from a state-",
        "paragraph_id": "para_1542"
      },
      {
        "text": "law mandated vaccine based on religious objections at the",
        "paragraph_id": "para_1543"
      },
      {
        "text": "height of a global pandemic.” Majority at 19, 24. But",
        "paragraph_id": "para_1544"
      },
      {

        "text": "concurring). And qualified immunity should not be",
        "paragraph_id": "para_1571"
      },

        "text": "extended when “a general constitutional rule already",
        "paragraph_id": "para_1572"
      },
      {
        "text": "identified in the decisional law . . . app[lies] with obvious",
        "paragraph_id": "para_1573"
      },
      {
        "text": "clarity to the specific conduct in question, even though the",
        "paragraph_id": "para_1574"
      },
      {
        "text": "very action in question has not previously been held",

        "paragraph_id": "para_1580"
      },
      {
        "text": "The Defendants’ conduct here plainly violated",
        "paragraph_id": "para_1581"
      },
      {
        "text": "established law prohibiting the targeting of a person’s",
        "paragraph_id": "para_1582"
      },
      {
        "text": "religious beliefs. Plaintiff had a right to be free from",
        "paragraph_id": "para_1583"
      },
      {
        "text": "religious discrimination—in particular, from the State’s",
        "paragraph_id": "para_1584"
      },
      {
        "text": "targeting of her religious belief (against the use of aborted",
        "paragraph_id": "para_1585"
      },
      {
        "text": "fetal cells) by deeming such a belief not “religious” at all and",
        "paragraph_id": "para_1586"
      },
      {
        "text": "thus not worthy of consideration for an exemption. And",
        "paragraph_id": "para_1587"
      },
      {
        "text": "contrary to the majority’s assertion, Majority at 20, that is",
        "paragraph_id": "para_1588"
      },
      {
        "text": "true even if the policy purported to give “favorable",
        "paragraph_id": "para_1589"
      },
      {
        "text": "treatment” to religion; the First Amendment prohibits the",
        "paragraph_id": "para_1590"
      },
      {
        "text": "State not only from treating religious beliefs less favorably",
        "paragraph_id": "para_1591"
      },
      {
        "text": "than secular beliefs but also from treating one religious",
        "paragraph_id": "para_1592"
      },
      {
        "text": "belief less favorably than another. See Larson v. Valente,",
        "paragraph_id": "para_1593"
      },
      {
        "text": "456 U.S. 228, 231–32, 245–46 (1982) (finding a First",
        "paragraph_id": "para_1594"
      },
      {
        "text": "Amendment violation when an exemption was extended to",
        "paragraph_id": "para_1595"
      },
      {
        "text": "some religions but not others). The Defendants violated that",
        "paragraph_id": "para_1596"
      },
      {
        "text": "right and should have been denied qualified immunity.",
        "paragraph_id": "para_1597"
      },
      {
        "text": "Perhaps the strongest argument for extending qualified",
        "paragraph_id": "para_1598"
      },
      {
        "text": "immunity is the majority’s assertion that no clearly",
        "paragraph_id": "para_1599"
      },
      {
        "text": "established law compels the conclusion that the State’s",
        "paragraph_id": "para_1600"
      },
      {
        "text": "policy fails strict scrutiny. Majority at 26. But this argument",
        "paragraph_id": "para_1601"
      },
      {

      },
      {
        "text": "fails. Where the Defendants acted with hostility in devising",
        "paragraph_id": "para_1603"
      },
      {
        "text": "and applying a policy that categorically discredited a",
        "paragraph_id": "para_1604"
      },
      {
        "text": "person’s religious views as not religious at all (supra 45–46),",
        "paragraph_id": "para_1605"
      },
      {
        "text": "such a policy can be “set aside” as clearly unconstitutional",
        "paragraph_id": "para_1606"
      },
      {
        "text": "without needing to conduct a “further [strict scrutiny]",
        "paragraph_id": "para_1607"
      },
      {
        "text": "inquiry.” Kennedy v. Bremerton Sch. Dist., 597 U.S. 507,",
        "paragraph_id": "para_1608"
      },
      {
        "text": "525 n.1 (2022) (quoting Masterpiece, 584 U.S. at 639).",
        "paragraph_id": "para_1609"
      },
      {
        "text": "Even so, strict scrutiny obviously cannot be satisfied. There",
        "paragraph_id": "para_1610"
      },
      {
        "text": "is no “compelling interest” in the Defendants’ targeting of",
        "paragraph_id": "para_1611"
      },
      {
        "text": "certain religious beliefs by deeming those beliefs not",
        "paragraph_id": "para_1612"
      },
      {
        "text": "religious at all. To be sure, the majority says that the",
        "paragraph_id": "para_1613"
      },
      {
        "text": "“compelling interest” here is in “[p]rotecting public health",
        "paragraph_id": "para_1614"
      },
      {
        "text": "and safety.” Majority at 21. But this “objective[]” is stated",
        "paragraph_id": "para_1615"
      },
      {
        "text": "“at a high level of generality” when “the First Amendment",
        "paragraph_id": "para_1616"
      },
      {
        "text": "demands a more precise analysis.” Fulton v. City of",
        "paragraph_id": "para_1617"
      },
      {
        "text": "Philadelphia, 593 U.S. 522, 541 (2021). “Rather than rely",
        "paragraph_id": "para_1618"
      },
      {
        "text": "on ‘broadly formulated interests,’ courts must ‘scrutinize[]”",
        "paragraph_id": "para_1619"
      },
      {
        "text": "whether the Defendants have “an interest in denying an",
        "paragraph_id": "para_1620"
      },
      {
        "text": "exception” to MacDonald on the ground that her belief is not",
        "paragraph_id": "para_1621"
      },
      {
        "text": "religious at all. Id. There is no compelling interest in that.",
        "paragraph_id": "para_1622"
      },
      {
        "text": "In any event, the Defendants’ policy is plainly not",
        "paragraph_id": "para_1623"
      },
      {
        "text": "“narrowly tailored” to advance any asserted interest in public",
        "paragraph_id": "para_1624"
      },
      {
        "text": "health or safety—the policy suffers from a substantial",
        "paragraph_id": "para_1625"
      },
      {
        "text": "“underinclusion.” Church of Lukumi, 508 U.S. at 531, 543.",
        "paragraph_id": "para_1626"
      },
      {
        "text": "Certain religious beliefs (e.g., religious objections to the use",
        "paragraph_id": "para_1627"
      },
      {
        "text": "of fetal cells from aborted babies) are disqualifying; whereas",
        "paragraph_id": "para_1628"
      },
      {
        "text": "other religious beliefs (e.g., a personal revelation to refuse",
        "paragraph_id": "para_1629"
      },
      {
        "text": "the vaccine from a supernatural being—not “God”—",
        "paragraph_id": "para_1630"
      },
      {
        "text": "belonging to a polytheistic tradition, or a belief that using",
        "paragraph_id": "para_1631"
      },
      {
        "text": "modern medicine demonstrates a lack of faith in God as",
        "paragraph_id": "para_1632"
      },
      {
        "text": "healer) are qualifying under the Defendants’ policy. That",
        "paragraph_id": "para_1633"
      },
      {
        "text": "disparate treatment among religious beliefs—clearly",
        "paragraph_id": "para_1634"
      },
      {
        "text": "unconstitutional in and of itself, see Epperson v. Arkansas,",
        "paragraph_id": "para_1635"
      },
      {

      {
        "text": "393 U.S. 97, 104 (1968)—undercuts any claim that the",
        "paragraph_id": "para_1637"
      },
      {
        "text": "Defendants’ policy survives strict scrutiny.3",

        "text": "The flaw in the majority’s qualified-immunity analysis",
        "paragraph_id": "para_1639"
      },
      {
        "text": "appears quite evident if we replaced the religious",
        "paragraph_id": "para_1640"
      },
      {
        "text": "discrimination at issue here with race discrimination. If the",
        "paragraph_id": "para_1641"
      },
      {
        "text": "Defendants’ policy had prohibited COVID vaccine",
        "paragraph_id": "para_1642"
      },
      {
        "text": "exemptions for Asian employees but permitted exemptions",
        "paragraph_id": "para_1643"
      },
      {
        "text": "for other employees, that policy would obviously violate the",
        "paragraph_id": "para_1644"
      },
      {
        "text": "Equal Protection Clause of our Constitution, and the State",
        "paragraph_id": "para_1645"
      },
      {
        "text": "officials perpetrating such a policy would be denied",
        "paragraph_id": "para_1646"
      },
      {
        "text": "qualified immunity. We would not say (as the majority",
        "paragraph_id": "para_1647"
      },
      {
        "text": "would here) that State officials faced “novel factual",
        "paragraph_id": "para_1648"
      },
      {
        "text": "circumstances” during “the height of a global pandemic” that",
        "paragraph_id": "para_1649"
      },
      {
        "text": "would justify qualified immunity for this",
        "paragraph_id": "para_1650"
      },
      {
        "text": "discrimination. Nor would we say (as the majority would",
        "paragraph_id": "para_1651"
      },
      {
        "text": "here) that the right not to be denied an exemption on",
        "paragraph_id": "para_1652"
      },
      {
        "text": "discriminatory grounds in this circumstance lacked clearly",
        "paragraph_id": "para_1653"
      },
      {
        "text": "established precedent. Instead, we would say that, despite",
        "paragraph_id": "para_1654"
      },
      {
        "text": "the novelty of the factual situation, the Defendants had clear",
        "paragraph_id": "para_1655"
      },
      {
        "text": "notice that it would be unlawful to deny an exemption on the",
        "paragraph_id": "para_1656"
      },
      {
        "text": "basis of race.",
        "paragraph_id": "para_1657"
      },
      {
        "text": "The same logic applies with equal force here: as with a",
        "paragraph_id": "para_1658"
      },
      {
        "text": "racially discriminatory exemption policy, it is obviously",
        "paragraph_id": "para_1659"
      },
      {
        "text": "unlawful to deny an exemption on religiously discriminatory",
        "paragraph_id": "para_1660"
      },
      {
        "text": "grounds, and it is religious discrimination to discredit",
        "paragraph_id": "para_1661"
      },
      {
        "text": "3 The majority raises an additional argument that is more easily dealt",
        "paragraph_id": "para_1662"
      },
      {
        "text": "with. The denial of MacDonald’s request for a religious exemption, the",
        "paragraph_id": "para_1663"
      },
      {
        "text": "majority states, was accompanied by statements meant to “combat[]",
        "paragraph_id": "para_1664"
      },
      {
        "text": "misinformation” about the use of fetal tissue in vaccines. Majority at 19.",
        "paragraph_id": "para_1665"
      },
      {
        "text": "But that does nothing to refute the point that MacDonald’s belief was",
        "paragraph_id": "para_1666"
      },
      {
        "text": "religious (however “misinform[ed]” the Defendants perceived that belief",
        "paragraph_id": "para_1667"
      },
      {
        "text": "to be) and that the Defendants refused to credit the belief’s religiosity in",
        "paragraph_id": "para_1668"
      },
      {
        "text": "denying her request.",
        "paragraph_id": "para_1669"
      },
      {

        "paragraph_id": "para_1670"
      },
      {
        "text": "categorically a particular set of religious beliefs as beneath",
        "paragraph_id": "para_1671"
      },
      {
        "text": "the State’s consideration. The majority’s attempt to resist",
        "paragraph_id": "para_1672"
      },
      {
        "text": "this straightforward parallel fails. The majority says, citing",
        "paragraph_id": "para_1673"
      },
      {
        "text": "Yick Wo v. Hopkins, 118 U.S. 356 (1886), that a racially",
        "paragraph_id": "para_1674"
      },
      {
        "text": "discriminatory exemption policy would violate “clearly",
        "paragraph_id": "para_1675"
      },
      {
        "text": "established” law. Majority at 30–31. But how Masterpiece",
        "paragraph_id": "para_1676"
      },
      {
        "text": "and Church of Lukumi are any less “clearly established” in",
        "paragraph_id": "para_1677"
      },
      {
        "text": "prohibiting religious discrimination than Yick Wo is in",
        "paragraph_id": "para_1678"
      },
      {
        "text": "prohibiting racial discrimination is a total mystery to me.",
        "paragraph_id": "para_1679"
      },
      {
        "text": "They are not. While neither set of cases addresses vaccine",
        "paragraph_id": "para_1680"
      },
      {
        "text": "exemptions, they establish clear rules (don’t discriminate on",
        "paragraph_id": "para_1681"
      },
      {
        "text": "the basis of religion; don’t discriminate on the basis of race),",
        "paragraph_id": "para_1682"
      },
      {
        "text": "the violation of which would be so obvious in our case and",
        "paragraph_id": "para_1683"
      },
      {
        "text": "in our hypothetical as to result in the denial of qualified",
        "paragraph_id": "para_1684"
      },
      {
        "text": "immunity to the perpetrators. The bottom line of all this is",
        "paragraph_id": "para_1685"
      },
      {
        "text": "clear: religious discrimination should not be tolerated any",
        "paragraph_id": "para_1686"
      },
      {
        "text": "more than racial discrimination. Yet the majority forgets",
        "paragraph_id": "para_1687"
      },
      {
        "text": "that truism. By our Founders’ constitutional design, the Free",
        "paragraph_id": "para_1688"
      },
      {
        "text": "Exercise Clause was meant to stand as our shield in the strife.",
        "paragraph_id": "para_1689"
      },
      {
        "text": "Too bad the court removes it here.",
        "paragraph_id": "para_1690"
      },
      {
        "text": "I respectfully dissent.*",
        "paragraph_id": "para_1691"
      },
      {
