        "text": "The panel affirmed the district court’s order granting",
        "paragraph_id": "para_31"
      },
      {
        "text": "class certification in Narguess Noohi’s putative class action",
        "paragraph_id": "para_32"
      },
      {
        "text": "against Johnson & Johnson Consumer Inc. (“JJCI”), alleging",
        "paragraph_id": "para_33"
      },
      {
        "text": "violations of California deceptive marketing and consumer",
        "paragraph_id": "para_34"
      },
      {
        "text": "protection laws.",
        "paragraph_id": "para_35"
      },
      {
        "text": "Noohi purchased JJCI’s Neutrogena Oil-Free Face",
        "paragraph_id": "para_36"
      },
      {
        "text": "Moisturizer for Sensitive Skin, which she alleged that,",
        "paragraph_id": "para_37"
      },
      {
        "text": "despite the name, contained oils and oil-based",
        "paragraph_id": "para_38"
      },
      {
        "text": "ingredients. The district court certified a class of California",
        "paragraph_id": "para_39"
      },
      {
        "text": "purchasers of the product.",
        "paragraph_id": "para_40"
      },
      {
        "text": "First, JJCI challenged the district court’s reliance on the",
        "paragraph_id": "para_41"
      },
      {
        "text": "proposed damages model of Noohi’s economic expert, Dr.",
        "paragraph_id": "para_42"
      },
      {
        "text": "Wade Roberts, who described his proposed process for",
        "paragraph_id": "para_43"
      },
      {
        "text": "measuring class members’ damages by calculating the",
        "paragraph_id": "para_44"
      },
      {
        "text": "economic value to consumers of the “oil-free”",
        "paragraph_id": "para_45"
      },
      {
        "text": "statement. The panel held that the district court did not",
        "paragraph_id": "para_46"
      },
      {

        "text": "abuse its discretion in finding that Dr. Roberts’ model could",
        "paragraph_id": "para_52"
      },
      {
        "text": "reliably measure damages on a classwide basis and",
        "paragraph_id": "para_53"
      },
      {
        "text": "adequately for present purposes matched Noohi’s theory of",
        "paragraph_id": "para_54"
      },
      {
        "text": "harm. However, JJCI must be given the opportunity to test",
        "paragraph_id": "para_55"
      },
      {
        "text": "the admissibility and reliability of Dr. Roberts’ model once",
        "paragraph_id": "para_56"
      },
      {
        "text": "it has been fully executed.",
        "paragraph_id": "para_57"
      },
      {
        "text": "Second, JJCI argued that the district court incorrectly",
        "paragraph_id": "para_58"
      },
      {
        "text": "determined that the elements of materiality and reliance were",
        "paragraph_id": "para_59"
      },
      {
        "text": "susceptible to common proof. The panel held that",
        "paragraph_id": "para_60"
      },
      {
        "text": "materiality, and therefore an inference of reliance, can be",
        "paragraph_id": "para_61"
      },
      {
        "text": "established by reference to an objective, reasonable",
        "paragraph_id": "para_62"
      },
      {
        "text": "consumer standard, and so in this case may be proven in a",
        "paragraph_id": "para_63"
      },
      {
        "text": "way common to the class. Although the inference of",
        "paragraph_id": "para_64"
      },
      {
        "text": "reliance is rebuttable, the district court did not abuse its",
        "paragraph_id": "para_65"
      },
      {
        "text": "discretion in determining that JJCI failed to rebut that",
        "paragraph_id": "para_66"
      },
      {
        "text": "inference.",

        "text": "Johnson & Johnson Consumer Inc. (“JJCI”) markets and",
        "paragraph_id": "para_83"
      },
      {
        "text": "sells a cosmetic product named “Neutrogena Oil-Free Face",
        "paragraph_id": "para_84"
      },
      {
        "text": "Moisturizer for Sensitive Skin” (“the Product”).1 In search",
        "paragraph_id": "para_85"
      },
      {
        "text": "of an oil-free skin moisturizer, Narguess Noohi purchased",
        "paragraph_id": "para_86"
      },
      {
        "text": "the Product. Noohi alleges that, despite the name,",
        "paragraph_id": "para_87"
      },
      {
        "text": "Neutrogena Oil-Free Face Moisturizer for Sensitive Skin",
        "paragraph_id": "para_88"
      },
      {
        "text": "contains oils and oil-based ingredients. After discovering",
        "paragraph_id": "para_89"
      },
      {
        "text": "that alleged deception, Noohi brought this putative",
        "paragraph_id": "para_90"
      },
      {
        "text": "consumer class action against JJCI, alleging violations of",
        "paragraph_id": "para_91"
      },
      {
        "text": "California deceptive marketing and consumer protection",
        "paragraph_id": "para_92"
      },
      {
        "text": "laws. The district court certified a class of California",
        "paragraph_id": "para_93"
      },
      {
        "text": "purchasers of the Product. JJCI now appeals that grant of",
        "paragraph_id": "para_94"
      },
      {
        "text": "class certification on two grounds.",
        "paragraph_id": "para_95"
      },
      {
        "text": "First, JJCI challenges the district court’s reliance on the",
        "paragraph_id": "para_96"
      },
      {
        "text": "proposed damages model of Noohi’s economic expert. JJCI",
        "paragraph_id": "para_97"
      },
      {
        "text": "maintains that the district court held Noohi to only a “prima",
        "paragraph_id": "para_98"
      },
      {
        "text": "facie” standard with regard to the damages model and",
        "paragraph_id": "para_99"
      },
      {
        "text": "unduly rejected its evidentiary challenges to the expert’s",
        "paragraph_id": "para_100"
      },
      {
        "text": "testimony. The result, JJCI contends, was that the approved",
        "paragraph_id": "para_101"
      },
      {
        "text": "model was too underdeveloped and preliminary to support",
        "paragraph_id": "para_102"
      },
      {
        "text": "the district court’s finding that common questions",
        "paragraph_id": "para_103"
      },
      {
        "text": "1 The parties refer to the Product as “Neutrogena Oil-Free Face",

      },
      {
        "text": "Moisturizer for Sensitive Skin.” That wording does not appear on the",
        "paragraph_id": "para_105"
      },
      {
        "text": "front of the bottle or the box it comes in. The back of the box includes",
        "paragraph_id": "para_106"
      },
      {
        "text": "the label “Neutrogena® Oil-Free Moisture for Sensitive Skin.” The",
        "paragraph_id": "para_107"
      },
      {
        "text": "largest, most prominently placed text on the front of the box and bottle",
        "paragraph_id": "para_108"
      },
      {
        "text": "reads simply “oil-free moisture.” “Sensitive skin” appears in smaller text",
        "paragraph_id": "para_109"
      },
      {
        "text": "below, and “ultra-gentle facial moisturizer” appears in even smaller text",
        "paragraph_id": "para_110"
      },
      {
        "text": "below that.",
        "paragraph_id": "para_111"
      },
      {
        "text": "NOOHI V. JOHNSON & JOHNSON CONSUMER, INC. 5",

      },
      {
        "text": "predominated as to injury. JJCI further contends that the",
        "paragraph_id": "para_113"
      },
      {
        "text": "model does not match Noohi’s theory of harm. We reject",
        "paragraph_id": "para_114"
      },
      {
        "text": "JJCI’s challenges to the damages model. In doing so, we",
        "paragraph_id": "para_115"
      },
      {
        "text": "rely on this Court’s recent holding that “class action",
        "paragraph_id": "para_116"
      },
      {
        "text": "plaintiffs may rely on a reliable though not-yet-executed",
        "paragraph_id": "para_117"
      },
      {
        "text": "damages model to demonstrate that damages are susceptible",
        "paragraph_id": "para_118"
      },
      {
        "text": "to common proof so long as the district court finds that the",
        "paragraph_id": "para_119"
      },
      {
        "text": "model is reliable and, if applied to the proposed class, will",
        "paragraph_id": "para_120"
      },
      {
        "text": "be able to calculate damages in a manner common to the",
        "paragraph_id": "para_121"
      },
      {
        "text": "class at trial.” Lytle v. Nutramax Lab’ys, Inc., 114 F.4th",
        "paragraph_id": "para_122"
      },
      {
        "text": "1011, 1019 (9th Cir. 2024). We also conclude that the",
        "paragraph_id": "para_123"
      },
      {
        "text": "district court did not abuse its discretion in finding the",
        "paragraph_id": "para_124"
      },
      {
        "text": "proposed damages model fit Noohi’s theory of harm and was",
        "paragraph_id": "para_125"
      },
      {
        "text": "sufficient for purposes of class certification.",
        "paragraph_id": "para_126"
      },
      {
        "text": "Second, JJCI argues that the district court incorrectly",
        "paragraph_id": "para_127"
      },
      {
        "text": "determined that the elements of materiality and reliance were",
        "paragraph_id": "para_128"
      },
      {
        "text": "susceptible to common proof. We disagree. Materiality, and",
        "paragraph_id": "para_129"
      },
      {
        "text": "therefore an inference of reliance, can be established by",
        "paragraph_id": "para_130"
      },
      {
        "text": "reference to an objective, reasonable consumer standard, and",
        "paragraph_id": "para_131"
      },
      {
        "text": "so in this case may be proven in a way common to the class.",
        "paragraph_id": "para_132"
      },
      {
        "text": "Although the inference of reliance is rebuttable, the district",
        "paragraph_id": "para_133"
      },
      {
        "text": "court did not abuse its discretion in determining that JJCI",
        "paragraph_id": "para_134"
      },
      {
        "text": "failed to rebut that inference.",
        "paragraph_id": "para_135"
      },
      {
        "text": "For these reasons, discussed more fully below, we affirm",
        "paragraph_id": "para_136"
      },
      {
        "text": "the district court’s grant of class certification.",
        "paragraph_id": "para_137"
      },
      {
        "text": "I. BACKGROUND",
        "paragraph_id": "para_138"
      },
      {
        "text": "JJCI develops, markets, and sells Neutrogena Oil-Free",
        "paragraph_id": "para_139"
      },
      {
        "text": "Face Moisturizer for Sensitive Skin. Plaintiff-Appellee",
        "paragraph_id": "para_140"
      },
      {
        "text": "Narguess Noohi purchased this Product because she wanted",
        "paragraph_id": "para_141"
      },
      {
        "text": "an oil-free moisturizer for her skin. Noohi alleges that,",
        "paragraph_id": "para_142"
      },
      {
        "text": "despite the title “oil-free,” the Product contains two",
        "paragraph_id": "para_143"
      },
      {
        "text": "ingredients—ethylhexyl palmitate and soybean sterols—that",
        "paragraph_id": "para_144"
      },
      {

        "text": "are oils or oil-based compounds. Noohi further alleges that",
        "paragraph_id": "para_146"
      },
      {
        "text": "she would not have purchased the Product had she known it",
        "paragraph_id": "para_147"
      },
      {
        "text": "contained oils.",
        "paragraph_id": "para_148"
      },
      {
        "text": "In her operative complaint, Noohi asserted four claims",
        "paragraph_id": "para_149"
      },
      {
        "text": "against JJCI: (1) violation of California’s False Advertising",
        "paragraph_id": "para_150"
      },
      {
        "text": "Law (“FAL”), Cal. Bus. & Prof. Code §§ 17500 et seq.;",
        "paragraph_id": "para_151"
      },
      {
        "text": "(2) violation of California’s Unfair Competition Law",
        "paragraph_id": "para_152"
      },
      {
        "text": "(“UCL”), id. §§ 17200 et seq.; (3) violation of California’s",
        "paragraph_id": "para_153"
      },
      {
        "text": "Consumers Legal Remedies Act (“CLRA”), Cal. Civ. Code",
        "paragraph_id": "para_154"
      },
      {
        "text": "§§ 1750 et seq.; and (4) common law fraud. Noohi moved",
        "paragraph_id": "para_155"
      },
      {
        "text": "to certify a class under Federal Rule of Civil Procedure",
        "paragraph_id": "para_156"
      },
      {
        "text": "23(b)(2) and 23(b)(3) as to her three statutory claims.",
        "paragraph_id": "para_157"
      },
      {
        "text": "In support of her motion for class certification, Noohi",
        "paragraph_id": "para_158"
      },
      {
        "text": "submitted declarations and reports from two experts—Dr.",
        "paragraph_id": "para_159"
      },
      {
        "text": "Michael Hickner, a professor of materials science and",
        "paragraph_id": "para_160"
      },
      {
        "text": "engineering, and Dr. Wade Roberts, an econometrics expert.",
        "paragraph_id": "para_161"
      },
      {
        "text": "In a declaration, Dr. Hickner explained the meaning and",
        "paragraph_id": "para_162"
      },
      {
        "text": "properties of “oil.” Dr. Hickner opined that, although “oil”",
        "paragraph_id": "para_163"
      },
      {
        "text": "lacks a standard scientific definition, the term generally",
        "paragraph_id": "para_164"
      },
      {
        "text": "refers to a “naturally-derived, chemically synthesized, or",
        "paragraph_id": "para_165"
      },
      {
        "text": "petrochemically-refined slippery . . . substance” that is",
        "paragraph_id": "para_166"
      },
      {
        "text": "hydrophobic—meaning that it does not mix with water—and",
        "paragraph_id": "para_167"
      },
      {
        "text": "more viscous than water, but less dense. Dr. Hickner stated",
        "paragraph_id": "para_168"
      },
      {
        "text": "that, based on their chemical structures and physical",
        "paragraph_id": "para_169"
      },
      {
        "text": "properties, ethylhexyl palmitate and soybean sterols are oils",
        "paragraph_id": "para_170"
      },
      {
        "text": "with oil-like physical properties.",
        "paragraph_id": "para_171"
      },
      {
        "text": "In an expert report, Dr. Roberts described his proposed",
        "paragraph_id": "para_172"
      },
      {
        "text": "process for measuring class members’ damages by",
        "paragraph_id": "para_173"
      },
      {
        "text": "calculating the economic value to consumers of the “oil-",
        "paragraph_id": "para_174"
      },
      {
        "text": "free” statement. Dr. Roberts described a two-step process.",
        "paragraph_id": "para_175"
      },
      {
        "text": "First, Dr. Roberts would conduct qualitative market research",
        "paragraph_id": "para_176"
      },
      {
        "text": "designed to uncover consumers’ understanding of and",
        "paragraph_id": "para_177"
      },
      {

      },
      {
        "text": "response to the “oil-free” label. Second, Dr. Roberts would",
        "paragraph_id": "para_179"
      },
      {
        "text": "conduct quantitative surveying and market analysis to",
        "paragraph_id": "para_180"
      },
      {
        "text": "measure the economic value to consumers of the “oil-free”",
        "paragraph_id": "para_181"
      },
      {
        "text": "statement. At the time of class certification, discovery was",
        "paragraph_id": "para_182"
      },
      {
        "text": "still ongoing, and Dr. Roberts had not yet fully developed or",
        "paragraph_id": "para_183"
      },
      {
        "text": "executed his proposed damages model.",
        "paragraph_id": "para_184"
      },
      {
        "text": "In opposition to class certification, JJCI submitted",
        "paragraph_id": "para_185"
      },
      {
        "text": "declarations from its own experts contesting Dr. Hickner’s",
        "paragraph_id": "para_186"
      },
      {
        "text": "classification of the ingredients as oils and raised evidentiary",
        "paragraph_id": "para_187"
      },
      {
        "text": "objections based on Dr. Hickner’s qualifications and",
        "paragraph_id": "para_188"
      },
      {
        "text": "methodology. JJCI also submitted declarations from its own",
        "paragraph_id": "para_189"
      },
      {
        "text": "economic experts contesting the design of Dr. Roberts’",
        "paragraph_id": "para_190"
      },
      {
        "text": "damages model and raised evidentiary objections based on",
        "paragraph_id": "para_191"
      },
      {
        "text": "Dr. Roberts’ qualifications and proposed methodology.",
        "paragraph_id": "para_192"
      },
      {
        "text": "After considering JJCI’s experts’ opinions and its",
        "paragraph_id": "para_193"
      },
      {
        "text": "evidentiary objections, the district court found both Dr.",
        "paragraph_id": "para_194"
      },
      {
        "text": "Hickner and Dr. Roberts qualified and their opinions",
        "paragraph_id": "para_195"
      },
      {
        "text": "sufficiently reliable to be considered for class certification",
        "paragraph_id": "para_196"
      },
      {
        "text": "purposes.2 The district court rejected JJCI’s evidentiary",
        "paragraph_id": "para_197"
      },
      {
        "text": "objections to Noohi’s experts’ qualifications and their",
        "paragraph_id": "para_198"
      },
      {
        "text": "opinions. The district court further found that Noohi",
        "paragraph_id": "para_199"
      },
      {
        "text": "satisfied the threshold class certification requirements of",
        "paragraph_id": "para_200"
      },
      {
        "text": "Federal Rule of Civil Procedure 23(a) and the specific",
        "paragraph_id": "para_201"
      },
      {
        "text": "requirements of both Federal Rule of Civil Procedure",
        "paragraph_id": "para_202"
      },
      {
        "text": "2 The district court found that Dr. Hickner’s declaration was inadmissible",
        "paragraph_id": "para_203"
      },
      {
        "text": "in its current form under Daubert v. Merrell Down Pharms., Inc., 509",
        "paragraph_id": "para_204"
      },
      {
        "text": "U.S. 579 (1993), as Dr. Hickner had failed to demonstrate that his",
        "paragraph_id": "para_205"
      },
      {
        "text": "conclusions were based on past research, peer reviewed, or otherwise",
        "paragraph_id": "para_206"
      },
      {
        "text": "supported by established scientific methods. The district court",
        "paragraph_id": "para_207"
      },
      {
        "text": "nevertheless found Dr. Hickner’s opinion sufficient for purposes of class",
        "paragraph_id": "para_208"
      },
      {
        "text": "certification because it was likely that his opinion could be presented in",
        "paragraph_id": "para_209"
      },
      {
        "text": "an admissible form at trial and would be useful to the trier of fact in",
        "paragraph_id": "para_210"
      },
      {
        "text": "determining whether the Product was deceptive.",
        "paragraph_id": "para_211"
      },
      {

      },
      {
        "text": "23(b)(2) and 23(b)(3). The district court therefore granted",
        "paragraph_id": "para_213"
      },
      {
        "text": "Noohi’s motion for class certification, certifying a class",
        "paragraph_id": "para_214"
      },
      {
        "text": "defined as “all consumers who purchased Neutrogena Oil-",
        "paragraph_id": "para_215"
      },
      {
        "text": "Free Moisture Sensitive Skin in California between April 17,",
        "paragraph_id": "para_216"
      },
      {
        "text": "2016 and November 30, 2022,” the date of class",
        "paragraph_id": "para_217"
      },
      {
        "text": "certification.",
        "paragraph_id": "para_218"
      },
      {
        "text": "JJCI timely sought and obtained permission to file this",
        "paragraph_id": "para_219"
      },
      {
        "text": "interlocutory appeal of the district court’s class certification",
        "paragraph_id": "para_220"
      },
      {
        "text": "order, pursuant to Federal Rule of Civil Procedure 23(f).",
        "paragraph_id": "para_221"
      },
      {
        "text": "II. DISCUSSION",
        "paragraph_id": "para_222"
      },
      {
        "text": "Before it can certify a class, a district court must conduct",
        "paragraph_id": "para_223"
      },
      {
        "text": "a “rigorous analysis” to ensure that the requirements of",
        "paragraph_id": "para_224"
      },
      {
        "text": "Federal Rule of Civil Procedure 23 are satisfied. Olean",
        "paragraph_id": "para_225"
      },
      {
        "text": "Wholesale Grocery Coop., Inc. v. Bumble Bee Foods LLC,",
        "paragraph_id": "para_226"
      },
      {
        "text": "31 F. 4th 651, 664 (9th Cir. 2022) (en banc) (quoting Gen.",
        "paragraph_id": "para_227"
      },
      {
        "text": "Tel. Co. of the Sw. v. Falcon, 457 U.S. 147, 161 (1982)).",
        "paragraph_id": "para_228"
      },
      {
        "text": "“[P]laintiffs wishing to proceed through a class action must",
        "paragraph_id": "para_229"
      },
      {
        "text": "actually prove—not simply plead—that their proposed class",
        "paragraph_id": "para_230"
      },
      {
        "text": "satisfies each requirement of Rule 23.” Halliburton Co. v.",
        "paragraph_id": "para_231"
      },
      {
        "text": "Erica P. John Fund, Inc., 573 U.S. 258, 275 (2014).",
        "paragraph_id": "para_232"
      },
      {
        "text": "The crux of the dispute here is whether Federal Rule of",
        "paragraph_id": "para_233"
      },
      {
        "text": "Civil Procedure 23(b)(3)’s requirement that “questions of",
        "paragraph_id": "para_234"
      },
      {
        "text": "law or fact common to class members predominate over any",
        "paragraph_id": "para_235"
      },
      {
        "text": "questions affecting only individual members” has been",
        "paragraph_id": "para_236"
      },
      {
        "text": "adequately met. Rule 23(b)(3)’s predominance requirement",
        "paragraph_id": "para_237"
      },
      {
        "text": "“presupposes satisfaction of the commonality requirement",
        "paragraph_id": "para_238"
      },
      {
        "text": "of [Rule] 23(a)(2), which itself tests ‘the capacity of a",
        "paragraph_id": "para_239"
      },
      {
        "text": "classwide proceeding to generate common answers apt to",
        "paragraph_id": "para_240"
      },
      {

      },
      {
        "text": "drive the resolution of the litigation.’”3 Lytle, 114 F.4th at",
        "paragraph_id": "para_242"
      },
      {
        "text": "1023 (quoting Alcantar v. Hobart Serv., 800 F.3d 1047, 1052",
        "paragraph_id": "para_243"
      },
      {
        "text": "(9th Cir. 2015)). “But the predominance inquiry goes further",
        "paragraph_id": "para_244"
      },
      {
        "text": "and ‘asks whether the common, aggregation-enabling, issues",
        "paragraph_id": "para_245"
      },
      {
        "text": "in the case are more prevalent or important than the non-",
        "paragraph_id": "para_246"
      },
      {
        "text": "common, aggregation-defeating, individual issues.’” Id.",
        "paragraph_id": "para_247"
      },
      {
        "text": "(quoting Tyson Foods, Inc. v. Bouaphakeo, 577 U.S. 442,",
        "paragraph_id": "para_248"
      },
      {
        "text": "453 (2016)).",
        "paragraph_id": "para_249"
      },
      {
        "text": "Importantly, the inquiry at the class certification stage",
        "paragraph_id": "para_250"
      },
      {
        "text": "differs from that at summary judgment. “A court, when",
        "paragraph_id": "para_251"
      },
      {
        "text": "asked to certify a class, is merely to decide a suitable method",
        "paragraph_id": "para_252"
      },
      {
        "text": "of adjudicating the case and should not ‘turn class",
        "paragraph_id": "para_253"
      },
      {
        "text": "certification into a mini-trial’ on the merits.” Edwards v.",
        "paragraph_id": "para_254"
      },
      {
        "text": "First Am. Corp., 798 F.3d 1172, 1178 (9th Cir. 2015)",
        "paragraph_id": "para_255"
      },
      {
        "text": "(quoting Ellis v. Costco Wholesale Corp., 657 F.3d 970, 983",
        "paragraph_id": "para_256"
      },
      {
        "text": "n.8 (9th Cir. 2011)). “In determining whether the ‘common",
        "paragraph_id": "para_257"
      },
      {
        "text": "question’ prerequisite is met, a district court is limited to",
        "paragraph_id": "para_258"
      },
      {
        "text": "resolving whether the evidence establishes that a common",
        "paragraph_id": "para_259"
      },
      {
        "text": "question is capable of class-wide resolution, not whether the",
        "paragraph_id": "para_260"
      },
      {
        "text": "evidence in fact establishes that plaintiffs would win at trial.”",
        "paragraph_id": "para_261"
      },
      {
        "text": "Olean, 31 F.4th at 666–67. “With respect to the",
        "paragraph_id": "para_262"
      },
      {
        "text": "predominance inquiry specifically, a district court must",
        "paragraph_id": "para_263"
      },
      {
        "text": "evaluate ‘the method or methods by which plaintiffs propose",
        "paragraph_id": "para_264"
      },
      {
        "text": "3 Federal Rule of Civil Procedure 23(b)(3) provides:",
        "paragraph_id": "para_265"
      },
      {
        "text": "A class action may be maintained if Rule 23(a) is",
        "paragraph_id": "para_266"
      },
      {
        "text": "satisfied and if . . . the court finds that the questions of",
        "paragraph_id": "para_267"
      },
      {
        "text": "law or fact common to class members predominate",
        "paragraph_id": "para_268"
      },
      {
        "text": "over any questions affecting only individual members,",
        "paragraph_id": "para_269"
      },
      {
        "text": "and that a class action is superior to other available",
        "paragraph_id": "para_270"
      },
      {
        "text": "methods for fairly and efficiently adjudicating the",
        "paragraph_id": "para_271"
      },
      {
        "text": "controversy.",
        "paragraph_id": "para_272"
      },
      {
        "text": "Fed. R. Civ. P. 23(b)(3).",
        "paragraph_id": "para_273"
      },
      {
        "text": "10 NOOHI V. JOHNSON & JOHNSON CONSUMER, INC.",
        "paragraph_id": "para_274"
      },
      {
        "text": "to use the class-wide evidence to prove the common question",
        "paragraph_id": "para_275"
      },
      {
        "text": "in one stroke.’” Lytle, 114 F.4th at 1023 (alteration omitted)",
        "paragraph_id": "para_276"
      },
      {
        "text": "(quoting Olean, 31 F.4th at 666).",
        "paragraph_id": "para_277"
      },
      {
        "text": "“We review the decision to certify a class and ‘any",
        "paragraph_id": "para_278"
      },
      {
        "text": "particular underlying Rule 23 determination involving a",
        "paragraph_id": "para_279"
      },
      {
        "text": "discretionary determination’ for an abuse of discretion.”",
        "paragraph_id": "para_280"
      },
      {
        "text": "Olean, 31 F.4th at 663 (quoting Yokoyama v. Midland Nat’l",
        "paragraph_id": "para_281"
      },
      {
        "text": "Life Ins. Co., 594 F.3d 1087, 1091 (9th Cir. 2010)). We",
        "paragraph_id": "para_282"
      },
      {
        "text": "review de novo “the district court’s determination of",
        "paragraph_id": "para_283"
      },
      {
        "text": "underlying legal questions” and review for clear error “its",
        "paragraph_id": "para_284"
      },
      {
        "text": "determination of underlying factual questions.” Id. “A",
        "paragraph_id": "para_285"
      },
      {
        "text": "district court applying the correct legal standard abuses its",
        "paragraph_id": "para_286"
      },
      {
        "text": "discretion only if ‘it (1) relies on an improper factor,",
        "paragraph_id": "para_287"
      },
      {
        "text": "(2) omits a substantial factor, or (3) commits a clear error of",
        "paragraph_id": "para_288"
      },
      {
        "text": "judgment in weighing the correct mix of factors.’” Sali v.",
        "paragraph_id": "para_289"
      },
      {
        "text": "Corona Reg’l Med. Ctr., 909 F.3d 996, 1002 (9th Cir. 2018)",
        "paragraph_id": "para_290"
      },
      {
        "text": "(quoting Abdullah v. U.S. Sec. Assocs., Inc., 731 F.3d 952,",
        "paragraph_id": "para_291"
      },
      {
        "text": "956 (9th Cir. 2013)). “We review evidentiary rulings for an",
        "paragraph_id": "para_292"
      },
      {

      },
      {
        "text": "JJCI’s first argument on appeal is that Dr. Roberts’",
        "paragraph_id": "para_295"
      },
      {
        "text": "proposed damages model was too underdeveloped at the",
        "paragraph_id": "para_296"
      },
      {
        "text": "time of class certification to be admissible or reliable under",
        "paragraph_id": "para_297"
      },
      {
        "text": "Daubert and Federal Rule of Evidence 702. JJCI further",
        "paragraph_id": "para_298"
      },
      {
        "text": "maintains that the district court, in rejecting its evidentiary",
        "paragraph_id": "para_299"
      },
      {
        "text": "challenges to the damages model and finding that the model",
        "paragraph_id": "para_300"
      },
      {
        "text": "demonstrated that damages were capable of measurement on",
        "paragraph_id": "para_301"
      },
      {
        "text": "a classwide basis, failed to engage in the “rigorous analysis”",
        "paragraph_id": "para_302"
      },
      {
        "text": "required under Rule 23. We disagree.",
        "paragraph_id": "para_303"
      },
      {
        "text": "This Court’s recent decision in Lytle, in which the",
        "paragraph_id": "para_304"
      },
      {
        "text": "defendants raised objections similar to those put forward by",
        "paragraph_id": "para_305"
      },
      {
        "text": "JJCI, describes the appropriate inquiry into a damages model",
        "paragraph_id": "para_306"
      },
      {
        "text": "NOOHI V. JOHNSON & JOHNSON CONSUMER, INC. 11",
        "paragraph_id": "para_307"
      },
      {
        "text": "at class certification. As an initial matter, Lytle holds that",
        "paragraph_id": "para_308"
      },
      {
        "text": "“there is no categorical prohibition on a district court relying",
        "paragraph_id": "para_309"
      },
      {
        "text": "on an unexecuted damages model to certify a class.” 114",
        "paragraph_id": "para_310"
      },
      {
        "text": "F.4th at 1029. Lytle further makes clear “there is no",
        "paragraph_id": "para_311"
      },
      {
        "text": "requirement that the evidence relied upon by Plaintiffs to",
        "paragraph_id": "para_312"
      },
      {
        "text": "support class certification be presented in an admissible form",
        "paragraph_id": "para_313"
      },
      {
        "text": "at the class certification stage.” Id. at 1024–25. Instead, “an",
        "paragraph_id": "para_314"
      },
      {
        "text": "inquiry into the evidence’s ultimate admissibility should go",
        "paragraph_id": "para_315"
      },
      {
        "text": "to the weight that evidence is given at the class certification",
        "paragraph_id": "para_316"
      },
      {
        "text": "stage.” Id. at 1025 (quoting Sali, 909 F.3d at 1006). But",
        "paragraph_id": "para_317"
      },
      {
        "text": "“‘[n]either the possibility that a plaintiff will be unable to",
        "paragraph_id": "para_318"
      },
      {
        "text": "prove his allegations, nor the possibility that the later course",
        "paragraph_id": "para_319"
      },
      {
        "text": "of the suit might unforeseeably prove the original decision",
        "paragraph_id": "para_320"
      },
      {
        "text": "to certify the class wrong, is a basis for declining to certify a",
        "paragraph_id": "para_321"
      },
      {
        "text": "class which apparently satisfies’ Rule 23.” Id. (alteration in",
        "paragraph_id": "para_322"
      },
      {
        "text": "original) (quoting Sali, 909 F.3d at 1004–05).",
        "paragraph_id": "para_323"
      },
      {
        "text": "Additionally, evaluation of an unexecuted damages",
        "paragraph_id": "para_324"
      },
      {
        "text": "model at class certification “requires determining whether",
        "paragraph_id": "para_325"
      },
      {
        "text": "the expert’s methodology is reliable, so that a limited",
        "paragraph_id": "para_326"
      },
      {
        "text": "Daubert analysis may be necessary, but the more full-blown",
        "paragraph_id": "para_327"
      },
      {
        "text": "Daubert assessment of the results of the application of the",
        "paragraph_id": "para_328"
      },
      {
        "text": "model would be premature.” Id. at 1031. Instead, “the court",
        "paragraph_id": "para_329"
      },
      {
        "text": "considers only if expert evidence is useful in evaluating",
        "paragraph_id": "para_330"
      },
      {
        "text": "whether class certification requirements have been met.” Id.",
        "paragraph_id": "para_331"
      },
      {
        "text": "As Lytle emphasizes, in applying this standard to an",
        "paragraph_id": "para_332"
      },
      {
        "text": "unexecuted damages model, “the ultimate inquiry is whether",
        "paragraph_id": "para_333"
      },
      {
        "text": "a proposed model is likely to provide common answers at",
        "paragraph_id": "para_334"
      },
      {
        "text": "trial.” Id. at 1032 n.8.",
        "paragraph_id": "para_335"
      },
      {
        "text": "Here, as in Lytle, the district court’s application of",
        "paragraph_id": "para_336"
      },
      {
        "text": "Daubert at the class certification stage was not an abuse of",
        "paragraph_id": "para_337"
      },
      {
        "text": "12 NOOHI V. JOHNSON & JOHNSON CONSUMER, INC.",
        "paragraph_id": "para_338"
      },
      {
        "text": "discretion.4 The district court correctly recognized that the",
        "paragraph_id": "para_339"
      },
      {
        "text": "Plaintiffs were required to “show that damages are capable",
        "paragraph_id": "para_340"
      },
      {
        "text": "of measurement on a class-wide basis.” The court then",
        "paragraph_id": "para_341"
      },
      {
        "text": "considered and explained how Dr. Roberts proposed to do",
        "paragraph_id": "para_342"
      },
      {
        "text": "so, while noting that Noohi “need not show the actual",
        "paragraph_id": "para_343"
      },
      {
        "text": "amount of damages incurred” at the time of class",
        "paragraph_id": "para_344"
      },
      {
        "text": "certification. In determining that Dr. Roberts’ model was",
        "paragraph_id": "para_345"
      },
      {
        "text": "reliable and capable of measuring damages on a classwide",
        "paragraph_id": "para_346"
      },
      {
        "text": "basis, the district court found Dr. Roberts qualified as an",
        "paragraph_id": "para_347"
      },
      {
        "text": "expert in econometrics and relied on the fact that other courts",
        "paragraph_id": "para_348"
      },
      {
        "text": "have approved similar damages models in other CLRA",
        "paragraph_id": "para_349"
      },
      {
        "text": "cases.",
        "paragraph_id": "para_350"
      },
      {
        "text": "JJCI contends that Dr. Roberts’ survey question design",
        "paragraph_id": "para_351"
      },
      {
        "text": "and selection of the final survey population was incomplete",
        "paragraph_id": "para_352"
      },
      {
        "text": "and preliminary, and when further developed and executed,",
        "paragraph_id": "para_353"
      },
      {
        "text": "may bias the results of his model. The contention that Dr.",
        "paragraph_id": "para_354"
      },
      {
        "text": "Roberts’ model was not sufficiently developed to support the",
        "paragraph_id": "para_355"
      },
      {
        "text": "district court’s approval of class certification is",
        "paragraph_id": "para_356"
      },
      {
        "text": "unpersuasive. To be sure, “[m]erely gesturing at a model or",
        "paragraph_id": "para_357"
      },
      {
        "text": "4 Noohi argues that JJCI did not challenge Dr. Roberts’ expert testimony",
        "paragraph_id": "para_358"
      },
      {
        "text": "under Daubert before the district court and so may not raise a Daubert",
        "paragraph_id": "para_359"
      },
      {
        "text": "challenge now. We do not agree. In the district court, JJCI filed",
        "paragraph_id": "para_360"
      },
      {
        "text": "“Defendant [JJCI’s] Evidentiary Objections to Plaintiff’s Experts Dr.",
        "paragraph_id": "para_361"
      },
      {
        "text": "Hickner and Dr. Roberts in Support of Opposition to Class",
        "paragraph_id": "para_362"
      },
      {
        "text": "Certification,” in which it argued that Dr. Roberts’ analysis did not",
        "paragraph_id": "para_363"
      },
      {
        "text": "“survive[] scrutiny under Daubert” and “should be excluded.” JJCI did",
        "paragraph_id": "para_364"
      },
      {
        "text": "not request a Daubert hearing and none was held. But the district court",
        "paragraph_id": "para_365"
      },
      {
        "text": "did consider JJCI’s evidentiary objections under the Daubert standard to",
        "paragraph_id": "para_366"
      },
      {
        "text": "the extent appropriate at class certification, noting that JJCI’s critiques",
        "paragraph_id": "para_367"
      },
      {
        "text": "did not establish that Dr. Roberts’ model was “inadequate.” See Lytle,",
        "paragraph_id": "para_368"
      },
      {
        "text": "114 F.4th 1024–25, 1031. As the district court’s consideration of JJCI’s",
        "paragraph_id": "para_369"
      },
      {
        "text": "evidentiary objections constituted a discretionary determination, we",
        "paragraph_id": "para_370"
      },
      {
        "text": "review that determination for an abuse of discretion. See Olean, 31 F.4th",
        "paragraph_id": "para_371"
      },
      {
        "text": "at 663.",
        "paragraph_id": "para_372"
      },
      {
        "text": "NOOHI V. JOHNSON & JOHNSON CONSUMER, INC. 13",
        "paragraph_id": "para_373"
      },
      {
        "text": "describing a general method will not suffice . . . . Rather,",
        "paragraph_id": "para_374"
      },
      {
        "text": "plaintiffs—or their expert—must chart out a path to obtain",
        "paragraph_id": "para_375"
      },
      {
        "text": "all necessary data and demonstrate that the proposed method",
        "paragraph_id": "para_376"
      },
      {
        "text": "will be viable as applied to the facts of a given case.” Lytle,",
        "paragraph_id": "para_377"
      },
      {
        "text": "114 F.4th at 1032.",
        "paragraph_id": "para_378"
      },
      {
        "text": "Dr. Roberts did so here. Dr. Roberts is qualified as an",
        "paragraph_id": "para_379"
      },
      {
        "text": "expert in econometrics with experience in survey design and",
        "paragraph_id": "para_380"
      },
      {
        "text": "execution. His expert report explains how, through a",
        "paragraph_id": "para_381"
      },
      {
        "text": "combination of qualitative and quantitative surveying, he",
        "paragraph_id": "para_382"
      },
      {
        "text": "will measure classwide damages. Like the expert in Lytle,",
        "paragraph_id": "para_383"
      },
      {
        "text": "see 114 F.4th at 1032, Dr. Roberts had not yet finally worded",
        "paragraph_id": "para_384"
      },
      {
        "text": "the questions or executed the survey, but he had designed the",
        "paragraph_id": "para_385"
      },
      {
        "text": "survey methodology and identified target respondent",
        "paragraph_id": "para_386"
      },
      {
        "text": "populations.",
        "paragraph_id": "para_387"
      },
      {
        "text": "Lytle held that there was no abuse of discretion where the",
        "paragraph_id": "para_388"
      },
      {
        "text": "district court relied on an expert who presented a model but",
        "paragraph_id": "para_389"
      },
      {
        "text": "“had not yet collected” data, over the defendant’s objection",
        "paragraph_id": "para_390"
      },
      {
        "text": "that “the precise wording of a questionnaire is critical.” Id.",
        "paragraph_id": "para_391"
      },
      {
        "text": "at 1032–33. Similarly, the district court in this case did not",
        "paragraph_id": "para_392"
      },
      {
        "text": "abuse its discretion in finding that JJCI’s challenges to Dr.",
        "paragraph_id": "para_393"
      },
      {
        "text": "Roberts’ opinion evidence were “not ripe” at the class",
        "paragraph_id": "para_394"
      },
      {
        "text": "certification stage. As the Lytle panel explained, “[t]he",
        "paragraph_id": "para_395"
      },
      {
        "text": "speculative possibility that [Dr. Roberts] might slip up in",
        "paragraph_id": "para_396"
      },
      {
        "text": "executing his model, standing alone, is insufficient to defeat",
        "paragraph_id": "para_397"
      },
      {
        "text": "class certification.” Id. at 1033.",
        "paragraph_id": "para_398"
      },
      {
        "text": "JJCI further argues that Dr. Roberts’ proposed damages",
        "paragraph_id": "para_399"
      },
      {
        "text": "model is not consistent with Noohi’s theory of harm, thus",
        "paragraph_id": "para_400"
      },
      {
        "text": "contravening Comcast Corp. v. Behrend, 569 U.S. 27",
        "paragraph_id": "para_401"
      },
      {
        "text": "(2013). We are not persuaded.",
        "paragraph_id": "para_402"
      },
      {
        "text": "Comcast requires that plaintiffs “be able to show that",
        "paragraph_id": "para_403"
      },
      {
        "text": "their damages stemmed from the defendant’s actions that",
        "paragraph_id": "para_404"
      },
      {
        "text": "created the legal liability.” Levya v. Medline Indus. Inc., 716",
        "paragraph_id": "para_405"
      },
      {
        "text": "14 NOOHI V. JOHNSON & JOHNSON CONSUMER, INC.",
        "paragraph_id": "para_406"
      },
      {
        "text": "F.3d 510, 514 (9th Cir. 2013) (citing Comcast, 569 U.S. at",
        "paragraph_id": "para_407"
      },
      {
        "text": "38). Noohi alleges that JJCI misled consumers, in violation",
        "paragraph_id": "para_408"
      },
      {
        "text": "of the CLRA, UCL, and FAL, by labeling the Product “oil-",
        "paragraph_id": "para_409"
      },
      {
        "text": "free.” Noohi’s theory of harm is that class members paid",
        "paragraph_id": "para_410"
      },
      {
        "text": "more for the Product than they would have absent the",
        "paragraph_id": "para_411"
      },
      {
        "text": "misleading title “oil-free.” Under that theory of harm, the",
        "paragraph_id": "para_412"
      },
      {
        "text": "amount of overpayment attributable to the challenged",
        "paragraph_id": "para_413"
      },
      {
        "text": "term—the “price premium”—is the standard measure of",
        "paragraph_id": "para_414"
      },
      {
        "text": "damages under the CLRA and of restitution under the FAL",
        "paragraph_id": "para_415"
      },
      {
        "text": "and UCL.5 See, e.g., Pulaski & Middleman, LLC v. Google,",
        "paragraph_id": "para_416"
      },
      {
        "text": "Inc., 802 F.3d 979, 988–89 (9th Cir. 2015); Nguyen v. Nissan",
        "paragraph_id": "para_417"
      },
      {
        "text": "N. Am., Inc., 932 F.3d 811, 817–818 (9th Cir. 2019); In re",
        "paragraph_id": "para_418"
      },
      {
        "text": "Vioxx Class Cases, 180 Cal. App. 4th 116, 130–31 (2009).",
        "paragraph_id": "para_419"
      },
      {
        "text": "Dr. Roberts proposed to measure that overpayment. The",
        "paragraph_id": "para_420"
      },
      {
        "text": "quantitative portion of Dr. Roberts’ analysis would involve",
        "paragraph_id": "para_421"
      },
      {
        "text": "a “Van Westendorp price elasticity test.” As Dr. Roberts",
        "paragraph_id": "para_422"
      },
      {
        "text": "described in his expert report, survey participants—a",
        "paragraph_id": "para_423"
      },
      {
        "text": "representative sample of consumers whose selection will be",
        "paragraph_id": "para_424"
      },
      {
        "text": "informed in part by the qualitative survey and JJCI’s internal",
        "paragraph_id": "para_425"
      },
      {
        "text": "data—will be shown the Product and asked at what prices",
        "paragraph_id": "para_426"
      },
      {
        "text": "they would find the Product “too inexpensive to be",
        "paragraph_id": "para_427"
      },
      {
        "text": "considered, a good value, expensive but still worth",
        "paragraph_id": "para_428"
      },
      {
        "text": "considering, and finally, too expensive to be considered.”",
        "paragraph_id": "para_429"
      },
      {
        "text": "Next, Dr. Roberts will introduce information “challenging",
        "paragraph_id": "para_430"
      },
      {
        "text": "the ‘oil-free’ claim.” For example, Dr. Roberts proposed",
        "paragraph_id": "para_431"
      },
      {
        "text": "informing the survey participants that some of the Product’s",
        "paragraph_id": "para_432"
      },
      {
        "text": "ingredients contained extracts of soybean and palm oil.",
        "paragraph_id": "para_433"
      },
      {
        "text": "5 Plaintiffs may seek damages under the CLRA. Under the FAL and",
        "paragraph_id": "para_434"
      },
      {
        "text": "UCL, plaintiffs are limited to equitable relief, including restitution. See",
        "paragraph_id": "para_435"
      },
      {
        "text": "Colgan v. Leatherman Tool Grp., Inc., 135 Cal. App. 4th 663, 695",
        "paragraph_id": "para_436"
      },
      {
        "text": "(2006).",
        "paragraph_id": "para_437"
      },
      {

      },
      {
        "text": "After sharing that information, Dr. Roberts will again ask the",
        "paragraph_id": "para_439"
      },
      {
        "text": "survey participants the same pricing questions.",
        "paragraph_id": "para_440"
      },
      {
        "text": "Using the difference between participants’ two “good",
        "paragraph_id": "para_441"
      },
      {
        "text": "value” prices—before and after the “exposure” to",
        "paragraph_id": "para_442"
      },
      {
        "text": "information challenging the “oil-free” label—Dr. Roberts",
        "paragraph_id": "para_443"
      },
      {
        "text": "will use regression analysis to determine the percent of the",
        "paragraph_id": "para_444"
      },
      {
        "text": "product’s overall price associated with the phrase “oil-free.”",
        "paragraph_id": "para_445"
      },
      {
        "text": "That coefficient will then be multiplied by the Product’s",
        "paragraph_id": "para_446"
      },
      {
        "text": "actual market price from the class period to calculate the",
        "paragraph_id": "para_447"
      },
      {
        "text": "class members’ “damages (financial losses) directly",
        "paragraph_id": "para_448"
      },
      {
        "text": "measurable from changes in the perceived value of the",
        "paragraph_id": "para_449"
      },
      {
        "text": "product.” As the district court found, courts have approved",
        "paragraph_id": "para_450"
      },
      {
        "text": "of similar “benefit-of-the-bargain” damages models in",
        "paragraph_id": "para_451"
      },
      {
        "text": "deceptive marketing cases under California law. See",
        "paragraph_id": "para_452"
      },
      {
        "text": "Nguyen, 932 F.3d at 818 (collecting cases).",
        "paragraph_id": "para_453"
      },
      {
        "text": "Dr. Roberts also proposed to measure “softer” kinds of",
        "paragraph_id": "para_454"
      },
      {
        "text": "harms consumers might experience, such as changes to",
        "paragraph_id": "para_455"
      },
      {
        "text": "“overall consumer satisfaction, brand loyalty, willingness to",
        "paragraph_id": "para_456"
      },
      {
        "text": "recommend [the Product], and repurchase intent.” To",
        "paragraph_id": "para_457"
      },
      {
        "text": "measure these less “concrete” damages, Dr. Roberts",
        "paragraph_id": "para_458"
      },
      {
        "text": "proposed to ask the survey participants questions about their",
        "paragraph_id": "para_459"
      },
      {
        "text": "attitudes towards and impressions of the Product before and",
        "paragraph_id": "para_460"
      },
      {
        "text": "after the “exposure.” Dr. Roberts will then use “multivariate",
        "paragraph_id": "para_461"
      },
      {
        "text": "statistic[al]” analysis to quantify the changes in respondents’",
        "paragraph_id": "para_462"
      },
      {
        "text": "perceptions of the Product.",
        "paragraph_id": "para_463"
      },
      {
        "text": "Dr. Roberts’ proposal to quantify “soft” damages will",
        "paragraph_id": "para_464"
      },
      {
        "text": "include damages beyond those reflecting Noohi’s theory of",
        "paragraph_id": "para_465"
      },
      {
        "text": "overpayment. According to Dr. Roberts’ own description of",
        "paragraph_id": "para_466"
      },
      {
        "text": "his methodology, the damages associated with changes in a",
        "paragraph_id": "para_467"
      },
      {
        "text": "decline in consumers’ satisfaction, brand loyalty,",
        "paragraph_id": "para_468"
      },
      {
        "text": "willingness to recommend the product, and repurchase intent",
        "paragraph_id": "para_469"
      },
      {
        "text": "would be calculated in addition to the price premium",
        "paragraph_id": "para_470"
      },
      {

      },
      {
        "text": "measured via the Van Westendorp pricing exercise.",
        "paragraph_id": "para_472"
      },
      {
        "text": "Including an economic value associated with those attributes",
        "paragraph_id": "para_473"
      },
      {
        "text": "in the ultimate damages calculation would inflate damages",
        "paragraph_id": "para_474"
      },
      {
        "text": "beyond the price premium. But that fact alone does not mean",
        "paragraph_id": "para_475"
      },
      {
        "text": "that Dr. Roberts’ model violates Comcast.",
        "paragraph_id": "para_476"
      },
      {
        "text": "The concern in Comcast was not only that the damages",
        "paragraph_id": "para_477"
      },
      {
        "text": "model there proposed to measure damages not associated",
        "paragraph_id": "para_478"
      },
      {
        "text": "with the plaintiffs’ theory of harm, but also that the model",
        "paragraph_id": "para_479"
      },
      {
        "text": "was incapable of separating out those damages from",
        "paragraph_id": "para_480"
      },
      {
        "text": "damages tied to the plaintiff’s theory. 569 U.S. at 36–37.",
        "paragraph_id": "para_481"
      },
      {
        "text": "That problem—key to the Court’s holding in Comcast—is",
        "paragraph_id": "para_482"
      },
      {
        "text": "not present here. The price premium measurement will be",
        "paragraph_id": "para_483"
      },
      {
        "text": "informed by different survey questions than those associated",
        "paragraph_id": "para_484"
      },
      {
        "text": "with the “softer” damages and will be calculated separately",
        "paragraph_id": "para_485"
      },
      {
        "text": "from those harms. No extra work is needed to, in the words",
        "paragraph_id": "para_486"
      },
      {
        "text": "of Comcast, “bridge the difference[]” between the",
        "paragraph_id": "para_487"
      },
      {
        "text": "cognizable and non-cognizable damage measurements. Id.",
        "paragraph_id": "para_488"
      },
      {
        "text": "at 38. Dr. Roberts need only calculate the price premium",
        "paragraph_id": "para_489"
      },
      {
        "text": "without including his separate measurement of the “softer”",
        "paragraph_id": "para_490"
      },
      {
        "text": "damages to produce a measure of damages consistent with",
        "paragraph_id": "para_491"
      },
      {
        "text": "the theory of the class claims.",
        "paragraph_id": "para_492"
      },
      {
        "text": "JJCI further takes issue with Dr. Roberts’ particular",
        "paragraph_id": "para_493"
      },
      {
        "text": "proposed methodology for measuring the price premium.",
        "paragraph_id": "para_494"
      },
      {
        "text": "Rather than comparing what consumers are willing to pay",
        "paragraph_id": "para_495"
      },
      {
        "text": "before and after they learn that the Product is not “oil-fee,”",
        "paragraph_id": "para_496"
      },
      {
        "text": "JJCI argues, Dr. Roberts should compare “what consumers",
        "paragraph_id": "para_497"
      },
      {
        "text": "paid for ‘Neutrogena’s Oil-Free Face Moisturizer for",
        "paragraph_id": "para_498"
      },
      {
        "text": "Sensitive Skin’ and what they would have been willing to",
        "paragraph_id": "para_499"
      },
      {
        "text": "pay for ‘Neutrogena’s Face Moisturizer for Sensitive Skin,’",
        "paragraph_id": "para_500"
      },
      {
        "text": "holding everything else about the product’s performance and",
        "paragraph_id": "para_501"
      },
      {
        "text": "packaging (other than the ‘oil-free’ claim) constant.”",
        "paragraph_id": "para_502"
      },
      {
        "text": "Otherwise, JJCI maintains, Dr. Roberts’ model will",
        "paragraph_id": "para_503"
      },
      {
        "text": "improperly include the “emotional value” that consumers",
        "paragraph_id": "para_504"
      },
      {
        "text": "NOOHI V. JOHNSON & JOHNSON CONSUMER, INC. 17",
        "paragraph_id": "para_505"
      },
      {
        "text": "associate with learning that the “Product’s label contains a",
        "paragraph_id": "para_506"
      },
      {
        "text": "lie.”",
        "paragraph_id": "para_507"
      },
      {
        "text": "JJCI’s contention relies on an improper understanding of",

      },
      {
        "text": "the measure of the price premium under California consumer",
        "paragraph_id": "para_509"
      },
      {
        "text": "protection law. California law does not prescribe any",
        "paragraph_id": "para_510"
      },
      {
        "text": "specific means of measuring a price premium for purposes",
        "paragraph_id": "para_511"
      },
      {
        "text": "of actual damages or restitution. In fact, “[c]lass wide",
        "paragraph_id": "para_512"
      },
      {
        "text": "damages calculations under the UCL, FAL, and CLRA are",
        "paragraph_id": "para_513"
      },
      {
        "text": "particularly forgiving.” Lambert v. Nutraceutical Corp., 870",
        "paragraph_id": "para_514"
      },
      {
        "text": "F.3d 1170, 1183 (9th Cir. 2017), rev’d on other grounds, 586",
        "paragraph_id": "para_515"
      },
      {
        "text": "U.S. 188 (2019). “California law ‘requires only that some",
        "paragraph_id": "para_516"
      },
      {
        "text": "reasonable basis of computation of damages be used, and the",
        "paragraph_id": "para_517"
      },
      {
        "text": "damages may be computed even if the result reached is an",
        "paragraph_id": "para_518"
      },
      {
        "text": "approximation.’” Id. (quoting Pulaski, 802 F.3d at 989).",
        "paragraph_id": "para_519"
      },
      {
        "text": "There is no talismanic means of measuring damages for",
        "paragraph_id": "para_520"
      },
      {
        "text": "deceptive marketing claims under California consumer",
        "paragraph_id": "para_521"
      },
      {
        "text": "protection law. For example, courts have approved damages",
        "paragraph_id": "para_522"
      },
      {
        "text": "models that use conjoint analysis, which asks survey",
        "paragraph_id": "para_523"
      },
      {
        "text": "respondents to select from a range of similar products that",
        "paragraph_id": "para_524"
      },
      {
        "text": "vary in characteristics like price, labeling, and design. See",
        "paragraph_id": "para_525"
      },
      {
        "text": "Lytle, 114 F.4th at 1033 (collecting cases). Courts have also",
        "paragraph_id": "para_526"
      },
      {
        "text": "deemed “contingent valuation analysis” a “reliable survey",
        "paragraph_id": "para_527"
      },
      {
        "text": "based methodology to determine price premium damages.”",
        "paragraph_id": "para_528"
      },
      {
        "text": "Hilsley v. Ocean Spray Cranberries, Inc., No. 17-CV-2335,",
        "paragraph_id": "para_529"
      },
      {
        "text": "2019 WL 3006465, *3 (S.D. Cal. July 10, 2019) (collecting",
        "paragraph_id": "para_530"
      },
      {
        "text": "cases). That approach, similar to Dr. Roberts’ proposed",
        "paragraph_id": "para_531"
      },
      {
        "text": "methodology, varies the features of a single product by",
        "paragraph_id": "para_532"
      },
      {
        "text": "presenting new information about the product and asks",
        "paragraph_id": "para_533"
      },
      {
        "text": "survey participants to “directly report what they are willing",
        "paragraph_id": "para_534"
      },
      {
        "text": "to pay for it.” Id.",
        "paragraph_id": "para_535"
      },
      {
        "text": "To be sure, a poorly conducted survey might produce",
        "paragraph_id": "para_536"
      },
      {
        "text": "responses that inflate damages. For instance, poorly worded",
        "paragraph_id": "para_537"
      },
      {

      },
      {
        "text": "survey questions might induce bias in respondents, see Lytle,",
        "paragraph_id": "para_539"
      },
      {
        "text": "114 F.4th at 1033, or survey conditions might not accurately",
        "paragraph_id": "para_540"
      },
      {
        "text": "replicate the conditions faced by consumers in stores, see",
        "paragraph_id": "para_541"
      },
      {
        "text": "Hadley v. Kellogg Sales Co., 324 F. Supp. 3d 1084, 1107–",
        "paragraph_id": "para_542"
      },
      {
        "text": "08 (N.D. Cal. 2018). But Dr. Roberts recognized those risks.",
        "paragraph_id": "para_543"
      },
      {
        "text": "In his deposition, Dr. Roberts stated that leading or",
        "paragraph_id": "para_544"
      },
      {
        "text": "otherwise poorly framed prompts—for example, telling",
        "paragraph_id": "para_545"
      },
      {
        "text": "survey participants “you were lied to”—could lead to",
        "paragraph_id": "para_546"
      },
      {
        "text": "skewed responses. Dr. Roberts also emphasized the need to",
        "paragraph_id": "para_547"
      },
      {
        "text": "conduct the pricing survey in a “neutral” manner. Should",
        "paragraph_id": "para_548"
      },
      {
        "text": "Dr. Roberts’ execution of the survey fall short of that mark,",
        "paragraph_id": "para_549"
      },
      {
        "text": "JJCI may explore that failure at summary judgment, in a",
        "paragraph_id": "para_550"
      },
      {
        "text": "renewed Daubert motion, or during cross-examination at",
        "paragraph_id": "para_551"
      },
      {
        "text": "trial. See, e.g., Lytle, 114 F.4th at 1033–34; Hadley, 324 F.",
        "paragraph_id": "para_552"
      },
      {
        "text": "Supp. 3d at 1108. At the class certification stage, the key",
        "paragraph_id": "para_553"
      },
      {
        "text": "inquiry under Comcast is simply whether Noohi has",
        "paragraph_id": "para_554"
      },
      {
        "text": "“demonstrated the nexus between [her] legal theory . . . and",
        "paragraph_id": "para_555"
      },
      {
        "text": "[her] damages model.” Nguyen, 932 F.3d at 821. As",
        "paragraph_id": "para_556"
      },
      {
        "text": "explained, Dr. Roberts’ proposed damages model was",
        "paragraph_id": "para_557"
      },
      {
        "text": "designed to measure a price premium associated with the",
        "paragraph_id": "para_558"
      },
      {
        "text": "misleading label at the heart of Noohi’s claims. Whether the",
        "paragraph_id": "para_559"
      },
      {
        "text": "proposed calculation of the price premium will prove",
        "paragraph_id": "para_560"
      },
      {
        "text": "accurate is a “merits inquir[y] unrelated to class",
        "paragraph_id": "para_561"
      },
      {
        "text": "certification.” Id.",
        "paragraph_id": "para_562"
      },
      {
        "text": "In sum, the district court did not abuse its discretion in",
        "paragraph_id": "para_563"
      },
      {
        "text": "finding that Dr. Roberts’ model could reliably measure",
        "paragraph_id": "para_564"
      },
      {
        "text": "damages on a classwide basis and adequately for present",
        "paragraph_id": "para_565"
      },
      {
        "text": "purposes matched Noohi’s theory of harm. That said, we",
        "paragraph_id": "para_566"
      },
      {
        "text": "reiterate Lytle’s warning that a “plaintiff may not avoid",
        "paragraph_id": "para_567"
      },
      {
        "text": "ultimate scrutiny of the admissibility of their experts’ final",
        "paragraph_id": "para_568"
      },
      {
        "text": "opinions simply by declining to develop those opinions in",
        "paragraph_id": "para_569"
      },
      {
        "text": "advance of class certification.” 114 F.4th at 1034.",
        "paragraph_id": "para_570"
      },
      {
        "text": "Accordingly, JJCI must be given the opportunity to test the",
        "paragraph_id": "para_571"
      },
      {
        "text": "NOOHI V. JOHNSON & JOHNSON CONSUMER, INC. 19",
        "paragraph_id": "para_572"
      },
      {
        "text": "admissibility and reliability of Dr. Roberts’ model once it",
        "paragraph_id": "para_573"
      },
      {
        "text": "has been fully executed.",
        "paragraph_id": "para_574"
      },
      {
        "text": "B.",
        "paragraph_id": "para_575"
      },
      {
        "text": "JJCI’s second argument on appeal is that the district",
        "paragraph_id": "para_576"
      },
      {
        "text": "court abused its discretion in finding that common issues",
        "paragraph_id": "para_577"
      },
      {
        "text": "predominate with respect to the elements of materiality and",
        "paragraph_id": "para_578"
      },
      {
        "text": "reliance. Because materiality and reliance are substantive",
        "paragraph_id": "para_579"
      },
      {
        "text": "components of Noohi’s claims, answering whether they",
        "paragraph_id": "para_580"
      },
      {
        "text": "present common issues necessarily requires some overlap",
        "paragraph_id": "para_581"
      },
      {
        "text": "with the merits. We consider such merits questions “to the",
        "paragraph_id": "para_582"
      },
      {
        "text": "extent—but only to the extent—that they are relevant to",
        "paragraph_id": "para_583"
      },
      {
        "text": "determining whether the Rule 23 prerequisites for class",
        "paragraph_id": "para_584"
      },
      {
        "text": "certification are satisfied.” Amgen Inc. v. Conn. Ret. Plans",
        "paragraph_id": "para_585"
      },
      {
        "text": "& Tr. Funds, 568 U.S. 455, 466 (2013).",
        "paragraph_id": "para_586"
      },
      {
        "text": "The UCL prohibits any “unlawful, unfair or fraudulent",
        "paragraph_id": "para_587"
      },
      {
        "text": "business act or practice and unfair, deceptive, untrue or",
        "paragraph_id": "para_588"
      },
      {
        "text": "misleading advertising.” Cal. Bus. & Prof. Code § 17200.",
        "paragraph_id": "para_589"
      },
      {
        "text": "The FAL prohibits “untrue or misleading” statements in the",
        "paragraph_id": "para_590"
      },
      {
        "text": "course of business. Id. § 17500. The UCL and FAL are",
        "paragraph_id": "para_591"
      },
      {
        "text": "“‘broad’ and ‘sweeping’ to ‘protect both consumers and",
        "paragraph_id": "para_592"
      },
      {
        "text": "competitors by promoting fair competition in commercial",
        "paragraph_id": "para_593"
      },
      {
        "text": "markets for goods and services.’” Pulaski, 802 F.3d at 985",
        "paragraph_id": "para_594"
      },
      {
        "text": "(quoting Kwikset Corp. v. Superior Ct., 51 Cal. 4th 310, 320",
        "paragraph_id": "para_595"
      },
      {
        "text": "(2011)). Accordingly, to state a claim under the UCL or the",
        "paragraph_id": "para_596"
      },
      {
        "text": "FAL “based on false advertising or promotional practices, it",
        "paragraph_id": "para_597"
      },
      {
        "text": "is necessary only to show that members of the public are",
        "paragraph_id": "para_598"
      },
      {
        "text": "likely to be deceived.” Id. (quoting In re Tobacco II Cases,",
        "paragraph_id": "para_599"
      },
      {
        "text": "46 Cal. 4th 298, 312 (2009)). Whether a statement is likely",
        "paragraph_id": "para_600"
      },
      {
        "text": "to deceive members of the public is decided by reference to",
        "paragraph_id": "para_601"
      },
      {
        "text": "an objective “reasonable consumer” standard. Ebner v.",
        "paragraph_id": "para_602"
      },
      {
        "text": "Fresh, Inc., 838 F.3d 958, 965 (9th Cir. 2016).",
        "paragraph_id": "para_603"
      },
      {
        "text": "20 NOOHI V. JOHNSON & JOHNSON CONSUMER, INC.",
        "paragraph_id": "para_604"
      },
      {
        "text": "The CLRA prohibits “unfair methods of competition and",
        "paragraph_id": "para_605"
      },
      {
        "text": "unfair or deceptive acts or practices.” Cal. Civ. Code § 770.",
        "paragraph_id": "para_606"
      },
      {
        "text": "To state a claim under the CLRA, “a plaintiff must show",
        "paragraph_id": "para_607"
      },
      {
        "text": "(1) the defendant engaged in deceptive conduct and (2) the",
        "paragraph_id": "para_608"
      },
      {
        "text": "deception caused [the] plaintiff harm.” Lytle, 114 F.4th at",
        "paragraph_id": "para_609"
      },
      {
        "text": "1034. “[U]nder the CLRA, ‘[c]ausation, on a classwide",
        "paragraph_id": "para_610"
      },
      {
        "text": "basis, may be established by materiality. If the trial court",
        "paragraph_id": "para_611"
      },
      {
        "text": "finds that material misrepresentations have been made to the",
        "paragraph_id": "para_612"
      },
      {
        "text": "entire class, an inference of reliance arises as to the class.’”",
        "paragraph_id": "para_613"
      },
      {
        "text": "Id. (second alteration in original) (quoting Stearns v.",
        "paragraph_id": "para_614"
      },
      {
        "text": "Ticketmaster Corp., 655 F.3d 1013, 1022 (9th Cir. 2011)).",
        "paragraph_id": "para_615"
      },
      {
        "text": "Materiality under the CLRA is determined using a",
        "paragraph_id": "para_616"
      },
      {
        "text": "reasonable consumer standard: a misrepresentation is",
        "paragraph_id": "para_617"
      },
      {
        "text": "material “if a reasonable [consumer] would attach",
        "paragraph_id": "para_618"
      },
      {
        "text": "importance to its existence or nonexistence in determining",
        "paragraph_id": "para_619"
      },
      {
        "text": "his choice of action in the transaction in question.” Stearns,",
        "paragraph_id": "para_620"
      },
      {
        "text": "655 F.3d at 1022 (quoting Steroid Hormone Prod. Cases,",
        "paragraph_id": "para_621"
      },
      {
        "text": "181 Cal. App. 4th 145, 157 (2010)).",
        "paragraph_id": "para_622"
      },
      {
        "text": "“Because materiality (and, hence, in this case reliance)",
        "paragraph_id": "para_623"
      },
      {
        "text": "may be proved by reference to an objective, reasonable",
        "paragraph_id": "para_624"
      },
      {
        "text": "consumer standard, reliance under the CLRA is generally",
        "paragraph_id": "para_625"
      },
      {
        "text": "susceptible to common proof.” Lytle, 114 F.4th at 1034.",
        "paragraph_id": "para_626"
      },
      {
        "text": "The same is true as to whether a statement is likely to deceive",
        "paragraph_id": "para_627"
      },
      {
        "text": "“members of the public” under the FAL and UCL. Pulaski,",
        "paragraph_id": "para_628"
      },
      {
        "text": "902 F.3d at 985 (emphasis added) (quoting In re Tobacco II",
        "paragraph_id": "para_629"
      },
      {
        "text": "Cases, 46 Cal. 4th at 312). Accordingly, deceptive",
        "paragraph_id": "para_630"
      },
      {
        "text": "marketing claims under these California consumer",
        "paragraph_id": "para_631"
      },
      {
        "text": "protection statutes are generally “ideal for class",
        "paragraph_id": "para_632"
      },
      {
        "text": "certification.” Id. (quoting Bradach v. Pharmavite, LLC,",
        "paragraph_id": "para_633"
      },
      {
        "text": "735 F. App’x 251, 255 (9th Cir. 2018)).",
        "paragraph_id": "para_634"
      },
      {
        "text": "There is an important caveat to this reasoning: “while",
        "paragraph_id": "para_635"
      },
      {
        "text": "materiality can support an inference of reliance, that does not",
        "paragraph_id": "para_636"
      },
      {
        "text": "necessarily mean that the inference will hold as to the entire",
        "paragraph_id": "para_637"
      },
      {

      },
      {
        "text": "class, such that common questions predominate.” Lytle, 114",
        "paragraph_id": "para_639"
      },
      {
        "text": "F.4th at 1034–35. “If the misrepresentation or omission is",
        "paragraph_id": "para_640"
      },
      {
        "text": "not material as to all class members, the issue of reliance",
        "paragraph_id": "para_641"
      },
      {
        "text": "‘would vary from consumer to consumer’ and the class",
        "paragraph_id": "para_642"
      },
      {
        "text": "should not be certified.” Stearns, 655 F.3d at 1022–23",
        "paragraph_id": "para_643"
      },
      {
        "text": "(quoting In re Vioxx Class Cases, 180 Cal. App. 4th at 129).",
        "paragraph_id": "para_644"
      },
      {
        "text": "JJCI contends that the district court ignored the caveat to",
        "paragraph_id": "para_645"
      },
      {
        "text": "the inference of reliance and found materiality and reliance",
        "paragraph_id": "para_646"
      },
      {
        "text": "to be “automatically common questions in false-advertising",
        "paragraph_id": "para_647"
      },
      {
        "text": "cases under California law.” The district court here did not",
        "paragraph_id": "para_648"
      },
      {
        "text": "explicitly mention and apply the caveat to the inference of",
        "paragraph_id": "para_649"
      },
      {
        "text": "reliance. Nevertheless, our review of the district court’s",
        "paragraph_id": "para_650"
      },
      {
        "text": "decision and the record at class certification confirms that",
        "paragraph_id": "para_651"
      },
      {
        "text": "the district court did not abuse its discretion in finding that",
        "paragraph_id": "para_652"
      },
      {
        "text": "the materiality and reliance elements of Noohi’s claims",
        "paragraph_id": "para_653"
      },
      {
        "text": "could be resolved on a classwide basis and that common",
        "paragraph_id": "para_654"
      },
      {
        "text": "issues therefore predominate.",
        "paragraph_id": "para_655"
      },
      {
        "text": "In granting class certification, the district court relied on",
        "paragraph_id": "para_656"
      },
      {
        "text": "the fact that materiality, and therefore reliance, can be shown",
        "paragraph_id": "para_657"
      },
      {
        "text": "by reference to a reasonable consumer standard, avoiding the",
        "paragraph_id": "para_658"
      },
      {
        "text": "need for individualized inquiries. The district court also",
        "paragraph_id": "para_659"
      },
      {
        "text": "relied on the undisputed evidence of classwide exposure to",
        "paragraph_id": "para_660"
      },
      {
        "text": "the “oil-free” language, specifically the fact that the “oil-",
        "paragraph_id": "para_661"
      },
      {
        "text": "free” term appears in the Product’s name prominently",
        "paragraph_id": "para_662"
      },
      {
        "text": "displayed on the front of the packaging. In determining",
        "paragraph_id": "para_663"
      },
      {
        "text": "whether a statement is materially misleading under",
        "paragraph_id": "para_664"
      },
      {
        "text": "California law, “the primary evidence . . . is the advertising",
        "paragraph_id": "para_665"
      },
      {
        "text": "itself.” Colgan v. Leatherman Tool Grp., Inc., 135 Cal. App.",
        "paragraph_id": "para_666"
      },
      {
        "text": "4th 663, 679 (2006) (citation omitted). It is hard to imagine",
        "paragraph_id": "para_667"
      },
      {
        "text": "that consumers would purchase a product labeled “Oil-Free",
        "paragraph_id": "para_668"
      },
      {
        "text": "Moisture” without regard to whether the product was free",
        "paragraph_id": "para_669"
      },
      {
        "text": "from oil. If, somehow, the evidence later shows that a",
        "paragraph_id": "para_670"
      },
      {
        "text": "reasonable consumer would not have found the product’s",
        "paragraph_id": "para_671"
      },
      {

      },
      {
        "text": "name to be material to their purchase decision, “the failure",
        "paragraph_id": "para_673"
      },
      {
        "text": "of proof on the element of materiality would end the case for",
        "paragraph_id": "para_674"
      },
      {
        "text": "one and for all; no claim would remain in which individual",
        "paragraph_id": "para_675"
      },
      {
        "text": "reliance issues could potentially predominate.” Amgen, 568",
        "paragraph_id": "para_676"
      },
      {
        "text": "U.S. at 468.",
        "paragraph_id": "para_677"
      },
      {
        "text": "Given the objective standard for materiality and the",
        "paragraph_id": "para_678"
      },
      {
        "text": "undisputed evidence of classwide exposure, Noohi is",
        "paragraph_id": "para_679"
      },
      {
        "text": "entitled to the inference that reliance can be shown via",
        "paragraph_id": "para_680"
      },
      {
        "text": "common proof. See In re Vioxx Class Cases, 180 Cal. App.",
        "paragraph_id": "para_681"
      },
      {
        "text": "4th at 129.",
        "paragraph_id": "para_682"
      },
      {
        "text": "JJCI’s arguments for why it has rebutted that inference",
        "paragraph_id": "para_683"
      },
      {
        "text": "are not persuasive. JJCI first maintains that materiality is not",
        "paragraph_id": "para_684"
      },
      {
        "text": "subject to common proof here because the understanding of",
        "paragraph_id": "para_685"
      },
      {
        "text": "the phrase “oil-free” may differ across the class. In JJCI’s",
        "paragraph_id": "para_686"
      },
      {
        "text": "telling, consumers might interpret “oil-free” as meaning that",
        "paragraph_id": "para_687"
      },
      {
        "text": "the Product does not contain oils, does not contain",
        "paragraph_id": "para_688"
      },
      {
        "text": "ingredients derived from oils, or does not perform in a way",
        "paragraph_id": "para_689"
      },
      {
        "text": "consumers consider “oily.” Because the materiality of the",
        "paragraph_id": "para_690"
      },
      {
        "text": "phrase “oil-free” depends on what meaning consumers",
        "paragraph_id": "para_691"
      },
      {
        "text": "attach to it, JJCI argues materiality cannot be determined on",
        "paragraph_id": "para_692"
      },
      {
        "text": "a classwide basis. This argument fails for two reasons.",
        "paragraph_id": "para_693"
      },
      {
        "text": "First, JJCI did not offer persuasive evidence to the",
        "paragraph_id": "para_694"
      },
      {
        "text": "district court that the meaning of “oil-free” in fact varies",
        "paragraph_id": "para_695"
      },
      {
        "text": "across the class. Instead, relying on Noohi’s testimony as to",
        "paragraph_id": "para_696"
      },
      {
        "text": "her motivations for purchasing the Product and the expert",
        "paragraph_id": "para_697"
      },
      {
        "text": "report of a dermatologist as to the dermatologic uses of oil-",
        "paragraph_id": "para_698"
      },
      {
        "text": "free products, JJCI contends—without any empirical",
        "paragraph_id": "para_699"
      },
      {
        "text": "evidence—that “‘oil-free’ can be interpreted in multiple",
        "paragraph_id": "para_700"
      },
      {
        "text": "ways by consumers” and that consumers generally",
        "paragraph_id": "para_701"
      },
      {
        "text": "“understand and seek out ‘oil-free’ products for a multitude",
        "paragraph_id": "para_702"
      },
      {
        "text": "of reasons.” Beyond that ipse dixit argument, JJCI presents",
        "paragraph_id": "para_703"
      },
      {
        "text": "NOOHI V. JOHNSON & JOHNSON CONSUMER, INC. 23",
        "paragraph_id": "para_704"
      },
      {
        "text": "no evidence that materiality or reliance actually varies across",
        "paragraph_id": "para_705"
      },
      {
        "text": "the class.",
        "paragraph_id": "para_706"
      },
      {
        "text": "Second, even if JJCI had presented evidence that the",
        "paragraph_id": "para_707"
      },
      {
        "text": "understanding of the phrase “oil-free” varies across the class,",
        "paragraph_id": "para_708"
      },
      {
        "text": "JJCI has not demonstrated why that fact would undermine",
        "paragraph_id": "para_709"
      },
      {
        "text": "the commonality of materiality based on a reasonable",
        "paragraph_id": "para_710"
      },
      {
        "text": "consumer standard, or rebut the inference of reliance. In",
        "paragraph_id": "para_711"
      },
      {
        "text": "Lytle, this Court discussed Stearns, 655 F.3d 1017, In re",
        "paragraph_id": "para_712"
      },
      {
        "text": "Vioxx Class Cases, 180 Cal. App. 4th 116, and Fairbanks v.",
        "paragraph_id": "para_713"
      },
      {
        "text": "Farmers New World Life Insurance Co., 197 Cal. App. 4th",
        "paragraph_id": "para_714"
      },
      {
        "text": "544 (2011), three cases in which courts found materiality",
        "paragraph_id": "para_715"
      },
      {
        "text": "differed across a class and so defeated the inference of",
        "paragraph_id": "para_716"
      },
      {
        "text": "reliance and class certification. See Lytle, 114 F.4th at 1037–",
        "paragraph_id": "para_717"
      },
      {
        "text": "38. JJCI relies on all three cases here. Lytle determined that",
        "paragraph_id": "para_718"
      },
      {
        "text": "the “common theme unifying each of these cases is that a",
        "paragraph_id": "para_719"
      },
      {
        "text": "sizable portion of the class either were not misled by the",
        "paragraph_id": "para_720"
      },
      {

        "text": "to be material had they known the truth.” Id. at 1038.",
        "paragraph_id": "para_722"
      },
      {
        "text": "For example, in Fairbanks, the plaintiffs alleged that the",
        "paragraph_id": "para_723"
      },
      {
        "text": "defendant’s marketing of life insurance policies was",
        "paragraph_id": "para_724"
      },
      {
        "text": "misleading because the defendant marketed the policies as",
        "paragraph_id": "para_725"
      },
      {
        "text": "“permanent” when in fact the policies were not permanent",
        "paragraph_id": "para_726"
      },
      {
        "text": "and were “systematically underfunded.” 197 Cal. App. 4th",
        "paragraph_id": "para_727"
      },
      {
        "text": "at 553. The court found that the materiality of the",
        "paragraph_id": "para_728"
      },
      {
        "text": "“permanent” policy claim was not subject to common proof",
        "paragraph_id": "para_729"
      },
      {
        "text": "because “many, if not most” policy purchasers did not intend",
        "paragraph_id": "para_730"
      },
      {
        "text": "for the policy to be permanent or had no expectation one way",
        "paragraph_id": "para_731"
      },
      {
        "text": "or the other. Id. at 907. For those purchasers, the fact that",
        "paragraph_id": "para_732"
      },
      {
        "text": "the policy was marketed as permanent was immaterial to",
        "paragraph_id": "para_733"
      },
      {
        "text": "their decision to buy it. Id.",
        "paragraph_id": "para_734"
      },
      {
        "text": "In In re Vioxx Class Cases, the plaintiffs alleged Merck",
        "paragraph_id": "para_735"
      },
      {
        "text": "“hid ‘an increased risk of death,’ associated with [the anti-",
        "paragraph_id": "para_736"
      },
      {
        "text": "24 NOOHI V. JOHNSON & JOHNSON CONSUMER, INC.",
        "paragraph_id": "para_737"
      },
      {
        "text": "inflammatory drug] Vioxx.” 180 Cal. App. 4th at 133. The",
        "paragraph_id": "para_738"
      },
      {
        "text": "court found class treatment inappropriate because of",
        "paragraph_id": "para_739"
      },
      {
        "text": "“overwhelming evidence” that Vioxx did not increase the",
        "paragraph_id": "para_740"
      },
      {
        "text": "risk of death for all patients, and that some patients would",
        "paragraph_id": "para_741"
      },
      {
        "text": "“still take Vioxx today” if it was prescribed and they were",
        "paragraph_id": "para_742"
      },
      {
        "text": "told of the risks. 180 Cal. App. 4th at 103, 133–34. The key",
        "paragraph_id": "para_743"
      },
      {
        "text": "to the courts’ decisions in Fairbanks and Vioxx was that the",
        "paragraph_id": "para_744"
      },
      {
        "text": "class at issue was shown to include a substantial number of",
        "paragraph_id": "para_745"
      },
      {
        "text": "individuals for whom the allegedly deceptive statements",
        "paragraph_id": "para_746"
      },
      {
        "text": "would not have affected their purchase decision and so were",
        "paragraph_id": "para_747"
      },
      {
        "text": "not material.",
        "paragraph_id": "para_748"
      },
      {
        "text": "JJCI’s contention, in contrast, is not that the “oil-free”",
        "paragraph_id": "para_749"
      },
      {
        "text": "title did not affect the purchase decision of—and so was",
        "paragraph_id": "para_750"
      },
      {
        "text": "immaterial to—a portion of the class, but that it affected the",
        "paragraph_id": "para_751"
      },
      {
        "text": "purchase decision of class members—and so was material—",
        "paragraph_id": "para_752"
      },
      {
        "text": "for different reasons. That is, JJCI does not suggest, let alone",
        "paragraph_id": "para_753"
      },
      {
        "text": "point to evidence demonstrating that, a consumer who",
        "paragraph_id": "para_754"
      },
      {
        "text": "thought “oil-free” meant “without oils” was any more or less",
        "paragraph_id": "para_755"
      },
      {
        "text": "likely to be affected in their purchase decision than someone",
        "paragraph_id": "para_756"
      },
      {
        "text": "who thought it meant “without oil derivatives” or not",
        "paragraph_id": "para_757"
      },
      {
        "text": "tactilely “oily.”",
        "paragraph_id": "para_758"
      },
      {
        "text": "So understood, JJCI’s argument, even if true, does not",
        "paragraph_id": "para_759"
      },
      {
        "text": "raise the same concerns regarding the susceptibility of",
        "paragraph_id": "para_760"
      },
      {
        "text": "materiality to common proof as does a showing that a",
        "paragraph_id": "para_761"
      },
      {
        "text": "contested statement was not material at all to some class",
        "paragraph_id": "para_762"
      },
      {
        "text": "members. The baseline inquiry is whether the statement was",
        "paragraph_id": "para_763"
      },
      {
        "text": "material to a reasonable person. An affirmative answer to",
        "paragraph_id": "para_764"
      },
      {
        "text": "that question gives rise to an inference of reliance. A",
        "paragraph_id": "para_765"
      },
      {
        "text": "showing that for some portion of a class that statement was",
        "paragraph_id": "para_766"
      },
      {
        "text": "not in fact material upsets that inference. But a showing that",
        "paragraph_id": "para_767"
      },
      {
        "text": "a statement was material to different class members in",
        "paragraph_id": "para_768"
      },
      {
        "text": "different ways does not.",
        "paragraph_id": "para_769"
      },
      {
        "text": "NOOHI V. JOHNSON & JOHNSON CONSUMER, INC. 25",
        "paragraph_id": "para_770"
      },
      {
        "text": "Courts addressing CLRA, UCL, and FAL claims have",
        "paragraph_id": "para_771"
      },
      {
        "text": "consistently held that a plaintiff need not establish at the",
        "paragraph_id": "para_772"
      },
      {
        "text": "class certification stage that class members share a uniform",
        "paragraph_id": "para_773"
      },
      {
        "text": "understanding of the contested term. See, e.g., Lytle v.",
        "paragraph_id": "para_774"
      },
      {
        "text": "Nutramax Lab’ys, Inc., No. ED CV 19-0835, 2022 WL",
        "paragraph_id": "para_775"
      },
      {
        "text": "1600047, at *15 (C.D. Cal. May 6, 2022); Bailey v. Rite Aid",
        "paragraph_id": "para_776"
      },
      {
        "text": "Corp., 338 F.R.D. 390, 402 n.12 (N.D. Cal. 2021);",
        "paragraph_id": "para_777"
      },
      {
        "text": "Fitzhenry-Russell v. Dr. Pepper Snapple Grp., Inc., 326",
        "paragraph_id": "para_778"
      },
      {
        "text": "F.R.D. 592, 613 (N.D. Cal. 2018); Elkies v. Johnson &",
        "paragraph_id": "para_779"
      },
      {
        "text": "Johnson Servs., Inc., No. CV 17-7320, 2018 WL 11223465,",
        "paragraph_id": "para_780"
      },
      {
        "text": "at *4 (C.D. Cal. Oct. 18, 2018).6 For example, the district",
        "paragraph_id": "para_781"
      },
      {
        "text": "court in Lytle (which we affirmed) rejected the argument that",
        "paragraph_id": "para_782"
      },
      {
        "text": "the plaintiff there had to show the class shared a common",
        "paragraph_id": "para_783"
      },
      {
        "text": "understanding of the term “Joint Health Supplement” at the",
        "paragraph_id": "para_784"
      },
      {
        "text": "class certification stage. Lytle, 2022 WL 1600047, at *15.",
        "paragraph_id": "para_785"
      },
      {
        "text": "Similarly, the district court in Bailey found “no controlling",
        "paragraph_id": "para_786"
      },
      {
        "text": "authority” to support the contention that class members had",
        "paragraph_id": "para_787"
      },
      {
        "text": "to share a common definition of the term “rapid release.”",
        "paragraph_id": "para_788"
      },
      {
        "text": "Bailey, 338 F.R.D. at 402 n.12.",
        "paragraph_id": "para_789"
      },
      {
        "text": "6 JJCI cites In re 5-Hour Energy Mktg. & Sales Pracs. Litig., No. ML",
        "paragraph_id": "para_790"
      },
      {
        "text": "13-2438, 2017 WL 2559615, at *8–9 (C.D. Cal. June 7, 2017), in support",
        "paragraph_id": "para_791"
      },
      {
        "text": "of its argument that the lack of a common definition for an allegedly",
        "paragraph_id": "para_792"
      },
      {
        "text": "deceptive term undermines predominance as to materiality. In re 5-Hour",
        "paragraph_id": "para_793"
      },
      {
        "text": "Energy is neither controlling nor persuasive. The plaintiffs in In re 5-",
        "paragraph_id": "para_794"
      },
      {
        "text": "Hour Energy alleged that the term at issue there, “energy,” was material",
        "paragraph_id": "para_795"
      },
      {
        "text": "based on a narrow definition of the term as “caloric energy.” In re 5-",
        "paragraph_id": "para_796"
      },
      {
        "text": "Hour Energy, 2017 WL 2559615, at *9. The district court determined",
        "paragraph_id": "para_797"
      },
      {
        "text": "that evidence showed that a reasonable consumer would not share the",
        "paragraph_id": "para_798"
      },
      {
        "text": "plaintiffs’ particular understanding of the inherently ambiguous term—",
        "paragraph_id": "para_799"
      },
      {
        "text": "the only understanding under which the plaintiffs argued the term was",
        "paragraph_id": "para_800"
      },
      {
        "text": "material. Id. JJCI has not suggested that a portion of the class here—or",
        "paragraph_id": "para_801"
      },
      {
        "text": "a hypothetical reasonable consumer—would understand “oil-free” in a",
        "paragraph_id": "para_802"
      },
      {
        "text": "way that would make that phrase immaterial to their purchase decision.",
        "paragraph_id": "para_803"
      },
      {
        "text": "26 NOOHI V. JOHNSON & JOHNSON CONSUMER, INC.",
        "paragraph_id": "para_804"
      },
      {
        "text": "In sum, the district court’s decision that materiality, and",
        "paragraph_id": "para_805"
      },
      {
        "text": "so the inference of reliance therefrom, are subject to",
        "paragraph_id": "para_806"
      },
      {
        "text": "common proof even if the class understood “oil-fee” in",
        "paragraph_id": "para_807"
      },
      {
        "text": "slightly different ways was not an abuse of discretion.",
        "paragraph_id": "para_808"
      },
      {
        "text": "JJCI further contends that it rebutted the inference of",
        "paragraph_id": "para_809"
      },
      {
        "text": "reliance by pointing to its positive customer reviews and",
        "paragraph_id": "para_810"
      },
      {
        "text": "internal purchasing data demonstrating that 30% of the",
        "paragraph_id": "para_811"
      },
      {
        "text": "Products’ purchasers were repeat buyers. The existence of",
        "paragraph_id": "para_812"
      },
      {
        "text": "repeat purchasers does not defeat the inference of reliance.",
        "paragraph_id": "para_813"
      },
      {
        "text": "There is no indication that the repeat purchasers knew that",
        "paragraph_id": "para_814"
      },
      {
        "text": "the Product was not oil-free and purchased it anyway. Cf. In",
        "paragraph_id": "para_815"
      },
      {
        "text": "re Vioxx Class Cases, 180 Cal. App. 4th at 133–34. The",
        "paragraph_id": "para_816"
      },
      {
        "text": "existence of positive reviews or other product attributes that",
        "paragraph_id": "para_817"
      },
      {
        "text": "purchasers found desirable is similarly insufficient to defeat",
        "paragraph_id": "para_818"
      },
      {
        "text": "materiality or the inference of reliance. To establish reliance",
        "paragraph_id": "para_819"
      },
      {
        "text": "under the CLRA, UCL, and FAL, a misrepresentation need",
        "paragraph_id": "para_820"
      },
      {
        "text": "not be “the sole or even the decisive cause of the injury-",
        "paragraph_id": "para_821"
      },
      {
        "text": "producing conduct.” Moore v. Mars Petcare US, Inc., 966",
        "paragraph_id": "para_822"
      },
      {
        "text": "F.3d 1007, 1020 (9th Cir. 2020) (quoting Kwikset, 51 Cal.",
        "paragraph_id": "para_823"
      },
      {
        "text": "4th at 327).",
        "paragraph_id": "para_824"
      },
      {
        "text": "For all these reasons, the district court did not abuse its",
        "paragraph_id": "para_825"
      },
      {
        "text": "discretion in finding that common issues predominate with",
        "paragraph_id": "para_826"
      },
      {
        "text": "respect to materiality and reliance.7",
        "paragraph_id": "para_827"
      },
      {
        "text": "7 JJCI argues that should we find materiality susceptible to common",
        "paragraph_id": "para_828"
      },
      {
        "text": "proof, we must decide whether Stearns’ holding that UCL plaintiffs need",
        "paragraph_id": "para_829"
      },
      {
        "text": "not show reliance as to absent class members is good law in light of the",
        "paragraph_id": "para_830"
      },
      {
        "text": "Supreme Court’s holding in TransUnion LLC v. Ramirez, 594 U.S. 413",
        "paragraph_id": "para_831"
      },
      {
        "text": "(2021), that all class members must have standing to recover damages.",
        "paragraph_id": "para_832"
      },
      {
        "text": "We need not decide that point here. Our holding is that Noohi has",
        "paragraph_id": "para_833"
      },
      {
        "text": "demonstrated that reliance is susceptible to common proof as to the entire",
        "paragraph_id": "para_834"
      },
      {
        "text": "class. We do not rely on the contested portion of Stearns to conclude",
        "paragraph_id": "para_835"
      },
      {
        "text": "that class certification was appropriate.",
        "paragraph_id": "para_836"
      },
      {

        "text": "CONCLUSION",
        "paragraph_id": "para_838"
      },
      {
        "text": "For the foregoing reasons, we affirm the district court’s",
        "paragraph_id": "para_839"
      },
      {
        "text": "grant of class certification.",
        "paragraph_id": "para_840"
      },
      {
        "text": "AFFIRMED.",
