        "text": "he pleaded guilty to Possession of a Firearm and Ammunition by a Felon in violation",

      },
      {
        "text": "of 18 U.S.C. §§ 922(g)(1) and 924 (a)(8). Phillips argues that the district court erred",
        "paragraph_id": "para_23"
      },
      {

        "text": "unreasonable because the requirement that state law apply in determining the",
        "paragraph_id": "para_29"
      },
      {
        "text": "§ 2K2.1(b)(6)(B) enhancement creates unwarranted disparities among offenders in",
        "paragraph_id": "para_30"

        "text": "different States that unconstitutionally violates 18 U.S.C. § 3553(a)(6). We affirm.",

        "text": "I. Background",
        "paragraph_id": "para_32"
      },
      {
        "text": "In late June 2023, law enforcement in Waterloo, Iowa observed social media",
        "paragraph_id": "para_33"
      },
      {
        "text": "posts by Jeremy Phillips, a convicted felon then on probation, showing Phillips",
        "paragraph_id": "para_34"
      },
      {
        "text": "possessing a black and silver semiautomatic pistol and marijuana. On July 3, a",
        "paragraph_id": "para_35"
      },
      {
        "text": "Waterloo police officer attempted to stop Phillips as he was riding his bicycle.",
        "paragraph_id": "para_36"
      },
      {
        "text": "Phillips fled, first on his bike and then on foot. During the attempted escape, Phillips",
        "paragraph_id": "para_37"
      },
      {
        "text": "dropped a firearm in the middle of a residential street and continued fleeing. After",
        "paragraph_id": "para_38"
      },
      {
        "text": "Phillips was apprehended with the help of a taser, the officer found a black and silver",
        "paragraph_id": "para_39"
      },
      {
        "text": "pistol in the street, loaded but with no round in the chamber. A warrant search of",
        "paragraph_id": "para_40"
      },
      {
        "text": "Phillips’s residence found firearm ammunition. He was charged with Possession of",
        "paragraph_id": "para_41"
      },
      {
        "text": "a Firearm and Ammunition by a Felon. Pending state court charges were dismissed.",
        "paragraph_id": "para_42"
      },
      {
        "text": "Phillips pleaded guilty to the federal charges in early 2024. The Presentence",
        "paragraph_id": "para_43"
      },
      {
        "text": "Investigation Report (PSR) determined an adjusted base offense level of 20 because",
        "paragraph_id": "para_44"
      },
      {
        "text": "Phillips committed the felon-in-possession offense after sustaining a qualifying prior",
        "paragraph_id": "para_45"
      },
      {
        "text": "felony conviction, see USSG § 2K2.1(a)(4)(A), resulting in an advisory guidelines",
        "paragraph_id": "para_46"
      },
      {
        "text": "sentencing range of 30 to 37 months imprisonment. The government objected that",
        "paragraph_id": "para_47"
      },
      {
        "text": "the total offense level should be increased and the advisory guidelines range adjusted",
        "paragraph_id": "para_48"
      },
      {
        "text": "accordingly -- by 4 levels under § 2K2.1(b)(6)(B) because Phillips used the firearm",
        "paragraph_id": "para_49"
      },
      {
        "text": "2This provision was subsequently moved to § 2K2.1(b)(7)(B), but we will refer",
        "paragraph_id": "para_50"
      },
      {
        "text": "to it by its former guidelines location for clarity.",
        "paragraph_id": "para_51"
      },
      {
        "text": "-2-",

      },
      {
        "text": "in connection with another felony offense, Iowa Code § 719.1(1)(f), and by 2 levels",
        "paragraph_id": "para_53"
      },
      {
        "text": "under § 3C1.2 because he “discarded a loaded firearm in a public area.” The",
        "paragraph_id": "para_54"
      },
      {
        "text": "Probation Officer replied that “the Court will need to resolve [those] issues.”",
        "paragraph_id": "para_55"
      },
      {
        "text": "At the conclusion of the sentencing hearing, the district court applied the",
        "paragraph_id": "para_56"
      },
      {
        "text": "§ 2K2.1(b)(6)(B) enhancement because Phillips possessed the firearm in connection",
        "paragraph_id": "para_57"
      },
      {
        "text": "with the Iowa felony offense of “Interference with Official Acts” under Iowa Code",
        "paragraph_id": "para_58"
      },
      {
        "text": "§ 719.1(1)(a) and (f), and the firearm “was capable of facilitating interference with",
        "paragraph_id": "para_59"
      },
      {
        "text": "official acts.”3 The court explained that our previous cases applying the enhancement",
        "paragraph_id": "para_60"
      },
      {
        "text": "have “facts that are almost identical to what’s present here.” However, the court",
        "paragraph_id": "para_61"
      },
      {
        "text": "denied the government’s § 3C1.2 objection because “the only evidence I have is that",
        "paragraph_id": "para_62"
      },
      {
        "text": "the gun accidentally dropped out of his pants or his pocket, and all he did is keep",
        "paragraph_id": "para_63"
      },
      {
        "text": "fleeing from the officers at that point.”4 This resulted in an advisory guidelines range",
        "paragraph_id": "para_64"
      },
      {
        "text": "of 46-57 months imprisonment. Finding both the offense conduct and his understated",
        "paragraph_id": "para_65"
      },
      {
        "text": "criminal history to be aggravating, the court imposed a within-range 57 month",
        "paragraph_id": "para_66"
      },
      {
        "text": "sentence. The court explained, “I have considered all the factors at [18 U.S.C.",
        "paragraph_id": "para_67"
      },
      {
        "text": "§ 3553(a)] even if I don’t mention each of them in my comments here.”",
        "paragraph_id": "para_68"
      },
      {
        "text": "II. Discussion",
        "paragraph_id": "para_69"
      },
      {
        "text": "A. The § 2K2.1(b)(6)(B) Enhancement. Phillips first argues the district",
        "paragraph_id": "para_70"
      },
      {
        "text": "court erred in applying the four-level enhancement under § 2K2.1(b)(6)(B). In",
        "paragraph_id": "para_71"
      },
      {
        "text": "3§ 719.1(1)(a) provides, as relevant here, that “A person commits interference",
        "paragraph_id": "para_72"
      },
      {
        "text": "with official acts when the person knowingly resists or obstructs anyone known by",
        "paragraph_id": "para_73"
      },
      {
        "text": "the person to be a peace officer . . . in the performance of any act which is within the",
        "paragraph_id": "para_74"
      },
      {
        "text": "scope of [the officer’s] lawful duty or authority.” Subsection (f) provides that if a",
        "paragraph_id": "para_75"
      },
      {
        "text": "person who commits interference with official acts “is armed with a firearm, that",
        "paragraph_id": "para_76"
      },
      {
        "text": "person commits a class ‘D’ felony.”",
        "paragraph_id": "para_77"
      },
      {
        "text": "4This is an unsettled issue. The court’s ruling is not challenged on appeal so",
        "paragraph_id": "para_78"
      },
      {
        "text": "we decline to address it.",
        "paragraph_id": "para_79"
      },
      {
        "text": "-3-",

      },
      {
        "text": "reviewing alleged guidelines enhancement errors, “we review the district court’s legal",
        "paragraph_id": "para_81"
      },
      {
        "text": "conclusions de novo and its factual findings for clear error.” United States v. Green,",
        "paragraph_id": "para_82"
      },
      {
        "text": "70 F.4th 478, 481 (8th Cir. 2023).",
        "paragraph_id": "para_83"
      },
      {
        "text": "Section 2K2.1 of the Guidelines governs unlawful firearm and ammunition",
        "paragraph_id": "para_84"
      },
      {
        "text": "offenses. Subsection 2K2.1(a)(4) provides for a base offense level of 20 if the",
        "paragraph_id": "para_85"
      },
      {
        "text": "defendant has a prior crime of violence or controlled substance conviction, as Phillips",
        "paragraph_id": "para_86"
      },
      {
        "text": "has. Subsection 2K2.1(b)(6)(B) provides for a four-level enhancement of the base",
        "paragraph_id": "para_87"
      },
      {
        "text": "offense level if “the defendant used or possessed any firearm or ammunition in",
        "paragraph_id": "para_88"
      },
      {
        "text": "connection with another felony offense.” In United States v. Walker, we held that",
        "paragraph_id": "para_89"
      },
      {
        "text": "“another felony offense” includes any federal, state, or local felony offense,",
        "paragraph_id": "para_90"
      },
      {
        "text": "regardless of whether charges were filed or a conviction secured. 771 F.3d 449, 451",
        "paragraph_id": "para_91"
      },
      {
        "text": "(8th Cir. 2014), quoting § 2K2.1 comment. (n.14(c)), cert. denied, 575 U.S. 906",
        "paragraph_id": "para_92"
      },
      {
        "text": "(2015). The district court determined that Phillips’s armed flight from law",
        "paragraph_id": "para_93"
      },
      {
        "text": "enforcement constituted “Interference with Official Acts” under Iowa law, a class “D”",
        "paragraph_id": "para_94"
      },
      {
        "text": "felony if done while armed. § 719.1(1)(a), (f).",
        "paragraph_id": "para_95"
      },
      {
        "text": "On appeal, Phillips implicitly concedes that his fleeing from and forceful",
        "paragraph_id": "para_96"
      },
      {
        "text": "resistance to the attempted stop was “Interference with Official Acts” under Iowa",
        "paragraph_id": "para_97"
      },
      {
        "text": "Code § 719.1(1)(a). But he argues, as he did to the district court, that § 719.1(1)(f)",
        "paragraph_id": "para_98"
      },
      {
        "text": "does not apply because he did not possess a firearm “in connection with” another",
        "paragraph_id": "para_99"
      },
      {
        "text": "felony offense -- his possession of the firearm he dropped while fleeing was merely",
        "paragraph_id": "para_100"
      },
      {
        "text": "“coincidental” to his interference and did not in any way facilitate his flight. Like the",
        "paragraph_id": "para_101"
      },
      {
        "text": "district court, we conclude this contention is contrary to prior Eighth Circuit cases",
        "paragraph_id": "para_102"
      },
      {
        "text": "applying the § 2K2.1(b)(6)(B) enhancement.",
        "paragraph_id": "para_103"
      },
      {
        "text": "We observed in United States v. Nilsen that, as used in § 2K2.1(b)(6)(B), “in",
        "paragraph_id": "para_104"
      },
      {
        "text": "connection with” means that “at a minimum, the firearm had a purpose or effect with",
        "paragraph_id": "para_105"
      },
      {
        "text": "respect to the other felony offense because its presence facilitated or had the potential",
        "paragraph_id": "para_106"
      },
      {
        "text": "to facilitate the offense, as opposed to being the result of mere accident or",
        "paragraph_id": "para_107"
      },
      {
        "text": "-4-",
        "paragraph_id": "para_108"
      },
      {
        "text": "coincidence.” 18 F.4th 587, 589 (8th Cir. 2021) (quotation omitted, emphasis added).",
        "paragraph_id": "para_109"
      },
      {
        "text": "Applying this principle, we have repeatedly held that resisting arrest while armed is",
        "paragraph_id": "para_110"
      },
      {
        "text": "sufficient to apply the enhancement, even if the gun does not actually facilitate the",
        "paragraph_id": "para_111"
      },
      {

        "text": "from a car that had a gun underneath the driver’s seat); United States v. Clark, No.",

      },
      {
        "text": "22-1875, 2023 WL 3300962 (8th Cir. May 8, 2023) (defendant fled a police officer",
        "paragraph_id": "para_114"
      },
      {
        "text": "on foot with gun in his waistband that he discarded); United States v. Broomfield, No.",
        "paragraph_id": "para_115"
      },
      {
        "text": "23-1311, 2024 WL 2814669, at *3 (8th Cir. June 3, 2024) (defendant suspected of",
        "paragraph_id": "para_116"
      },
      {
        "text": "assault refused officers’ direction to come outside a bar, pulled away from an officer’s",
        "paragraph_id": "para_117"
      },
      {
        "text": "grasp, and fled when a gun fell from his person). As we noted in United States v.",
        "paragraph_id": "para_118"
      },
      {
        "text": "Guiheen, “[k]eeping the firearm at an easily accessible location while committing",
        "paragraph_id": "para_119"
      },
      {
        "text": "another felony permits the inference that the firearm emboldened the defendant to",
        "paragraph_id": "para_120"
      },
      {
        "text": "engage in the illegal act.” 594 F.3d 589, 591 (8th Cir. 2010).",
        "paragraph_id": "para_121"
      },
      {
        "text": "Here, Phillips pleaded guilty to facts that are more than sufficient to establish",
        "paragraph_id": "para_122"
      },
      {
        "text": "that the firearm he dropped while fleeing had the “potential to facilitate” his felony",
        "paragraph_id": "para_123"
      },
      {
        "text": "offense of interference with the officers’ official act in attempting the stop. He",
        "paragraph_id": "para_124"
      },
      {
        "text": "pleaded guilty to knowingly possessing the black and silver 9x19mm pistol while",
        "paragraph_id": "para_125"
      },
      {
        "text": "fleeing law enforcement. Green, Clark, and Broomfield squarely foreclose his",
        "paragraph_id": "para_126"
      },
      {
        "text": "“coincidental” possession argument. His possession at the very least had the",
        "paragraph_id": "para_127"
      },
      {
        "text": "“potential to facilitate” the felony offense by being on his person. Nilsen, 18 F.4th",
        "paragraph_id": "para_128"
      },
      {
        "text": "at 589. It is true he did not use the firearm or threaten the officers with it before or",
        "paragraph_id": "para_129"
      },
      {
        "text": "during his flight. But as the district court stated, “The test is whether it facilitated or",
        "paragraph_id": "para_130"
      },
      {
        "text": "was capable of facilitating interference with official acts. And [the firearm] was",
        "paragraph_id": "para_131"
      },
      {
        "text": "capable. . . . [T]he defendant could have used the gun, brandished it to the police to",
        "paragraph_id": "para_132"
      },
      {
        "text": "get them to back off, give him a better way of escaping and so forth.” The district",
        "paragraph_id": "para_133"
      },
      {
        "text": "court did not err in applying the § 2K2.1(b)(6)(B) enhancement.",
        "paragraph_id": "para_134"
      },
      {
        "text": "B. The Unwarranted Disparities Issue. Phillips argues for the first time on",
        "paragraph_id": "para_135"
      },
      {
        "text": "appeal that his sentence is substantively unreasonable because the 4 level",
        "paragraph_id": "para_136"
      },
      {
        "text": "-5-",
        "paragraph_id": "para_137"
      },
      {
        "text": "§ 2K2.1(b)(6)(B) enhancement creates an unwarranted sentence disparity. Because",
        "paragraph_id": "para_138"
      },
      {
        "text": "it requires use of state law to determine whether a prior state court conviction was a",
        "paragraph_id": "para_139"
      },
      {
        "text": "felony, it creates a disparity that violates 18 U.S.C. § 3553(a)(6) when the laws of",
        "paragraph_id": "para_140"
      },
      {
        "text": "different States produce different answers. As the laws of more than half the States",
        "paragraph_id": "para_141"
      },
      {
        "text": "in the Eighth Circuit provide that fleeing from police while armed is not in an of itself",
        "paragraph_id": "para_142"
      },
      {
        "text": "a felony, “a defendant who does the exact same thing that Mr. Phillips did would be",
        "paragraph_id": "para_143"
      },
      {
        "text": "sentenced to a lesser sentence, solely because the events did not take place in Iowa.”5",
        "paragraph_id": "para_144"
      },
      {
        "text": "This contention is without merit. First, it was not properly preserved for",
        "paragraph_id": "para_145"
      },
      {
        "text": "appeal. Early in the sentencing hearing, the district court stated: “I have considered",
        "paragraph_id": "para_146"
      },
      {
        "text": "all the factors at Title 18 United States Code section 3553(a) even if I don’t mention",
        "paragraph_id": "para_147"
      },
      {
        "text": "each of them in my comments here.” It then went on to discuss and apply many of",
        "paragraph_id": "para_148"
      },
      {
        "text": "the factors and imposed a top-of-the-advisory-range sentence, explaining the offense",
        "paragraph_id": "para_149"
      },
      {
        "text": "conduct, including Phillips dropping a gun in the middle of a residential street, and",
        "paragraph_id": "para_150"
      },
      {
        "text": "his criminal history outweighed the mitigating circumstances the court acknowledged.",
        "paragraph_id": "para_151"
      },
      {
        "text": "While the court never mentioned the “unwarranted disparities” factor in § 3553(a)(6),",
        "paragraph_id": "para_152"
      },
      {
        "text": "“[w]e presume that district judges know the law and understand their obligation to",
        "paragraph_id": "para_153"
      },
      {
        "text": "consider all the § 3553(a) factors.” United States v. Masood, 133 F.4th 799, 809 (8th",
        "paragraph_id": "para_154"
      },
      {
        "text": "Cir. 2025) (quotation omitted), cert. denied, 146 S. Ct. 1514 (2026). District courts",
        "paragraph_id": "para_155"
      },
      {
        "text": "are not “required to mechanically recite [the § 3553(a) factors].” United States v.",
        "paragraph_id": "para_156"
      },
      {
        "text": "Jones, 89 F.4th 681, 686 (8th Cir. 2023) (citation omitted).",
        "paragraph_id": "para_157"
      },
      {
        "text": "After the court announced the sentence it would impose, Phillips orally moved",
        "paragraph_id": "para_158"
      },
      {
        "text": "for a downward variance to 37 months, the top of the PSR-recommended range,",
        "paragraph_id": "para_159"
      },
      {
        "text": "“because as the Court has stated, it was a close call to apply the four-level",
        "paragraph_id": "para_160"
      },
      {
        "text": "[§ 2K2.1(b)(6)(B)] enhancement. . . . [T]hat four-level enhancement is beyond the",
        "paragraph_id": "para_161"
      },
      {
        "text": "5For example, Phillips argues, in Nebraska resisting arrest is only a felony if",
        "paragraph_id": "para_162"
      },
      {
        "text": "the individual does so “through the use of a deadly or dangerous weapon,” which",
        "paragraph_id": "para_163"
      },
      {
        "text": "Phillips did not do. Neb. Rev. Stat. § 28-904 (2011). In contrast, in Iowa, the very",
        "paragraph_id": "para_164"
      },
      {
        "text": "act of fleeing from law enforcement while armed constitutes a felony.",
        "paragraph_id": "para_165"
      },
      {
        "text": "-6-",
        "paragraph_id": "para_166"
      },
      {
        "text": "scope of the conduct here.” No mention of “unwarranted disparities.” No mention",
        "paragraph_id": "para_167"
      },
      {
        "text": "of the court’s failure to address the § 3553(a)(6) sentencing factor. Thus, we have no",
        "paragraph_id": "para_168"
      },
      {
        "text": "way of knowing if the court considered the substantively unreasonable disparity",
        "paragraph_id": "para_169"
      },
      {
        "text": "theory Phillips raises on appeal. When the defendant raises on appeal a sentencing",
        "paragraph_id": "para_170"
      },
      {
        "text": "factor argument not raised at sentencing, we review the contention, if at all, for plain",
        "paragraph_id": "para_171"
      },
      {
        "text": "error. See United States v. O’Connor, 567 F.3d 395, 397 (8th Cir. 2009). Here, we",
        "paragraph_id": "para_172"
      },
      {
        "text": "know the district court considered “all the factors” in § 3553(a). Even on appeal,",
        "paragraph_id": "para_173"
      },
      {
        "text": "Phillips cites no authority directly supporting his substantively unreasonable disparity",
        "paragraph_id": "para_174"
      },
      {
        "text": "theory. As he did not urge the court to consider this unsupported theory, it would not",
        "paragraph_id": "para_175"
      },
      {
        "text": "be error, much less plain error, if the court only considered the § 3553(a)(6)",
        "paragraph_id": "para_176"
      },
      {
        "text": "sentencing factor in the context of our reported cases applying that factor.",
        "paragraph_id": "para_177"
      },
      {
        "text": "Even more important, the theory as articulated is ill-conceived, and the",
        "paragraph_id": "para_178"
      },
      {
        "text": "sentencing record simply would not support a substantively unreasonable argument",
        "paragraph_id": "para_179"
      },
      {
        "text": "based on this theory that might be plausible. Section 3553(a)(6) provides that a",
        "paragraph_id": "para_180"
      },
      {
        "text": "sentencing court “shall consider” “(6) the need to avoid unwarranted sentence",
        "paragraph_id": "para_181"
      },
      {
        "text": "disparities among defendants with similar records who have been found guilty of",
        "paragraph_id": "para_182"
      },
      {
        "text": "similar conduct.” (Emphasis added.) As its plain language and our many cases make",
        "paragraph_id": "para_183"
      },
      {
        "text": "clear, the statute’s directive “refers to national disparities, not differences among co-",
        "paragraph_id": "para_184"
      },
      {
        "text": "conspirators.” United States v. Fry, 792 F.3d 884, 892 (8th Cir. 2015) (emphasis in",
        "paragraph_id": "para_185"
      },
      {
        "text": "original). Its application is specific, not general -- there must be proof of an",
        "paragraph_id": "para_186"
      },
      {
        "text": "unwarranted disparity among specific defendants with “similar records” convicted of",
        "paragraph_id": "para_187"
      },
      {
        "text": "“similar conduct.” National statistics of sentences imposed by different judges",
        "paragraph_id": "para_188"
      },
      {
        "text": "provide a court “no principled basis to say which defendants received the appropriate",
        "paragraph_id": "para_189"
      },
      {
        "text": "sentence.” United States v. Hill, 8 F.4th 757, 761 (8th Cir. 2021) (quotation omitted,",
        "paragraph_id": "para_190"
      },
      {
        "text": "cleaned up). Thus, a hypothetical disparity theory based on general differences in",
        "paragraph_id": "para_191"
      },
      {
        "text": "state law does not establish a specific sentence is substantively unreasonable unless",
        "paragraph_id": "para_192"
      },
      {
        "text": "supported by at least one concrete example of a defendant in the other State with a",
        "paragraph_id": "para_193"
      },
      {
        "text": "similar record convicted of similar conduct.",
        "paragraph_id": "para_194"
      },
      {
        "text": "-7-",
        "paragraph_id": "para_195"
      },
      {
        "text": "Here, the guideline range disparity posited by Phillips is hypothetical and",
        "paragraph_id": "para_196"
      },
      {
        "text": "speculative. The § 2K2.1(b)(6)(B) enhancement affects only the total offense level,",
        "paragraph_id": "para_197"
      },
      {
        "text": "one part of the advisory guidelines range determination. Phillips failed to provide",
        "paragraph_id": "para_198"
      },
      {
        "text": "concrete evidence -- specific sentencing examples -- of how the differences in state",
        "paragraph_id": "para_199"
      },
      {
        "text": "sentencing law he cites are applied by federal sentencing courts to produce the",
        "paragraph_id": "para_200"
      },
      {
        "text": "disparate sentences he alleges. Thus, he failed to prove his theory that the differing",
        "paragraph_id": "para_201"
      },
      {
        "text": "state sentencing laws cause unwarranted federal sentence disparities that make an",
        "paragraph_id": "para_202"
      },
      {
        "text": "“unfavored” defendant’s sentence substantively unreasonable.",
        "paragraph_id": "para_203"
      },
      {
        "text": "Here, the district court thoroughly analyzed the § 3553(a) factors and arrived",
        "paragraph_id": "para_204"
      },
      {
        "text": "at a reasonable sentence that was well within its discretion. By correctly calculating",
        "paragraph_id": "para_205"
      },
      {
        "text": "and carefully reviewing the Guidelines range, which Phillips does not contest, the",
        "paragraph_id": "para_206"
      },
      {
        "text": "district court “necessarily [gave] significant weight and consideration” to the",
        "paragraph_id": "para_207"
      },
      {
        "text": "§ 3553(a)(6) issue of unwarranted disparities. United States v. Castillo, 117 F.4th",
        "paragraph_id": "para_208"
      },
      {
        "text": "1021, 1024 (8th Cir. 2024) (quotation omitted). “[A] district court may choose to",
        "paragraph_id": "para_209"
      },
      {
        "text": "deviate from the guidelines because of a policy disagreement . . . [but] is not required",
        "paragraph_id": "para_210"
      },
      {
        "text": "to do so.” United States v. Manning, 738 F.3d 937, 947 (8th Cir.) (quotation",
        "paragraph_id": "para_211"
      },
      {
        "text": "omitted), cert denied, 574 U.S. 858 (2014).",
        "paragraph_id": "para_212"
      },
      {
        "text": "Had he presented this issue to the district court, Phillips doubtless would have",
        "paragraph_id": "para_213"
      },
      {
        "text": "preferred the court to give more weight to the alleged unwarranted disparities caused",
        "paragraph_id": "para_214"
      },
      {
        "text": "by differing state laws and grant a downward variance. But if pressed on appeal, that",
        "paragraph_id": "para_215"
      },
      {
        "text": "argument would fail to establish a substantively unreasonable abuse of discretion.",
        "paragraph_id": "para_216"
      },
      {
        "text": "“[M]ere disagreement with how the court chose to weigh the relevant factors does not",
        "paragraph_id": "para_217"
      },
      {
        "text": "alone justify reversal.” United States v. Nesdahl, 140 F.4th 474, 478 (8th Cir. 2025)",
        "paragraph_id": "para_218"
      },
      {
        "text": "(quotation omitted). “An argument that non-conspirator defendants received shorter",
        "paragraph_id": "para_219"
      },
      {
        "text": "-8-",
        "paragraph_id": "para_220"
      },
      {
        "text": "sentences for comparable offenses is at base a disagreement with the weighing of the",
        "paragraph_id": "para_221"
      },
      {
        "text": "§ 3553(a) factors.” United States v. Soliz, 857 F.3d 781, 783 (8th Cir. 2017).",

      },
      {
        "text": "The judgment of the district court is affirmed.",
