        "text": "agree is needed, expresses strongly-felt views on how this",
        "paragraph_id": "para_45"

        "text": "appeal ultimately should have been decided after full en banc",

      },

        "text": "detailed and sound factual findings supporting application of",
        "paragraph_id": "para_52"
      },
      {
        "text": "the long-recognized bad-faith exception to Younger",
        "paragraph_id": "para_53"
      },
      {
        "text": "abstention. American Academy of Pediatrics v. Uthmeier, 2026",
        "paragraph_id": "para_54"
      },
      {
        "text": "WL 1552734, *17–25 (N.D. Ill. June 2, 2026). No one seriously",
        "paragraph_id": "para_55"
      },
      {
        "text": "challenges those facts. As the panel majority explained,",
        "paragraph_id": "para_56"
      },
      {
        "text": "federal courts do not apply the bad-faith exception lightly, or",
        "paragraph_id": "para_57"
      },
      {
        "text": "often. The exception is, however, a critical feature—a",
        "paragraph_id": "para_58"
      },
      {
        "text": "constitutional safety valve, if you will—in the federalism",
        "paragraph_id": "para_59"
      },

        "text": "ings weigh two principles that have towered over the Ameri-",

      },
      {
        "text": "can experiment since our founding: federalism and the pro-",
        "paragraph_id": "para_92"
      },
      {
        "text": "tection of constitutional rights. The concurrence and partial",
        "paragraph_id": "para_93"
      },
      {
        "text": "dissent eloquently make the case that one principle or the",
        "paragraph_id": "para_94"
      },
      {
        "text": "other might rise a bit higher in this case.",

        "text": "At its core, federalism protects state sovereignty against",

        "text": "powers delegated by the proposed Constitution to the Federal",

        "text": "Government are few and defined … [and] will be exercised",
        "paragraph_id": "para_101"
      },
      {
        "text": "principally on external objects as war, peace, negotiation, and",
        "paragraph_id": "para_102"
      },
      {
        "text": "foreign commerce.”); The Federalist No. 51, at 322 (James",

      },
      {
        "text": "eral government. Younger v. Harris, 401 U.S. 37, 42–45 (1971)",

      },
      {
        "text": "(noting that “the National Government, anxious though it",
        "paragraph_id": "para_110"
      },
      {
        "text": "may be to vindicate and protect federal rights and federal in-",
        "paragraph_id": "para_111"
      },
      {
        "text": "terests, always endeavors to do so in ways that will not un-",
        "paragraph_id": "para_112"
      },
      {
        "text": "duly interfere with the legitimate activities of the States”).",
        "paragraph_id": "para_113"
      },
      {
        "text": "This does not mean federal courts are powerless to protect",
        "paragraph_id": "para_114"
      },
      {
        "text": "constitutional rights against rogue state prosecutors. And this",
        "paragraph_id": "para_115"
      },
      {

        "text": "is where Younger’s bad-faith exception comes in, which as my",
        "paragraph_id": "para_117"
      },
      {
        "text": "colleagues note finds its roots in an earlier Supreme Court",
        "paragraph_id": "para_118"
      },
      {
        "text": "case, Dombrowski v. Pfister, which involved state officials’",
        "paragraph_id": "para_119"
      },
      {
        "text": "egregious threats to bring charges against civil rights activists",
        "paragraph_id": "para_120"
      },
      {
        "text": "even after evidence was suppressed and arrest warrants were",
        "paragraph_id": "para_121"
      },
      {
        "text": "quashed. 389 U.S. 479, 487–89 (1965). It also finds support in",
        "paragraph_id": "para_122"
      },
      {
        "text": "Younger itself, which did not purport to impose a blanket ban",
        "paragraph_id": "para_123"
      },
      {
        "text": "against all injunctions of state enforcement actions, but rather",
        "paragraph_id": "para_124"
      },
      {
        "text": "only against “good-faith attempts to enforce” a state statute.",
        "paragraph_id": "para_125"
      },
      {
        "text": "Younger, 401 U.S. at 54 (emphasis added).",
        "paragraph_id": "para_126"
      },
      {
        "text": "II",
        "paragraph_id": "para_127"
      },
      {
        "text": "Of course, the bad-faith exception cannot swallow",
        "paragraph_id": "para_128"
      },
      {
        "text": "Younger’s general prohibition against federal encroachment",
        "paragraph_id": "para_129"
      },
      {
        "text": "on state enforcement actions without eviscerating federalism",
        "paragraph_id": "para_130"
      },
      {
        "text": "protections and enfeebling state courts. This case demon-",
        "paragraph_id": "para_131"
      },
      {
        "text": "strates the need for a limiting principle to Younger’s bad-faith",
        "paragraph_id": "para_132"
      },
      {
        "text": "exception that accounts for the federalism concerns set forth",
        "paragraph_id": "para_133"
      },
      {
        "text": "in the partial dissent. One such principle may be to cabin",
        "paragraph_id": "para_134"
      },
      {
        "text": "Dombrowski to its facts. But this is not the way we typically",
        "paragraph_id": "para_135"
      },
      {
        "text": "apply Supreme Court precedent. See, e.g., City of Timber Lake",
        "paragraph_id": "para_136"
      },
      {
        "text": "v. Cheyenne River Sioux Tribe, 10 F.3d 554, 557 (8th Cir. 1993)",
        "paragraph_id": "para_137"
      },
      {
        "text": "(“Federal courts ... are not ‘free to limit Supreme Court opin-",
        "paragraph_id": "para_138"
      },
      {
        "text": "ions precisely to the facts of each case’”) (quoting McCoy v.",

      {

        "text": "narrow reading is sometimes appropriate, especially when",

        "text": "the Supreme Court historically refuses to extend a principle",
        "paragraph_id": "para_144"
      },
      {
        "text": "and later admonishes that such expansion is a “disfavored ju-",
        "paragraph_id": "para_145"
      },
      {
        "text": "dicial activity.” Egbert v. Boule, 596 U.S. 482, 491 (2022) (cita-",
        "paragraph_id": "para_146"
      },
      {
        "text": "tion omitted).",
        "paragraph_id": "para_147"
      },
      {

        "text": "The Supreme Court has neither indicated that Dombrowski",
        "paragraph_id": "para_149"
      },
      {
        "text": "is limited to its facts, nor labeled application of the bad-faith",
        "paragraph_id": "para_150"
      },
      {
        "text": "exception to Younger a disfavored judicial activity. Yet it has",
        "paragraph_id": "para_151"
      },
      {
        "text": "not applied the bad-faith exception in over 60 years. See 17B",
        "paragraph_id": "para_152"
      },
      {
        "text": "Charles Alan Wright & Arthur Miller, Federal Practice and Pro-",
        "paragraph_id": "para_153"
      },
      {
        "text": "cedure § 4255 (3d ed. 2026). Perhaps this decades-long hiatus",
        "paragraph_id": "para_154"
      },
      {
        "text": "suggests that Younger’s bad-faith exception is withering on",
        "paragraph_id": "para_155"
      },
      {
        "text": "the vine. Or perhaps it is simply laying fallow, remaining",
        "paragraph_id": "para_156"
      },
      {
        "text": "available to protect against bad-faith state prosecutions when",
        "paragraph_id": "para_157"
      },
      {
        "text": "the need arises.",
        "paragraph_id": "para_158"
      },
      {
        "text": "III",
        "paragraph_id": "para_159"
      },
      {
        "text": "When the Supreme Court decided Dombrowski, and fash-",
        "paragraph_id": "para_160"
      },
      {
        "text": "ioned Younger to require abstention only when there are",
        "paragraph_id": "para_161"
      },
      {
        "text": "“good-faith attempts” to enforce a state statute, Justice Robert",
        "paragraph_id": "para_162"
      },
      {
        "text": "Jackson’s observations about prosecutors would have been",
        "paragraph_id": "para_163"
      },
      {
        "text": "well known:",
        "paragraph_id": "para_164"
      },
      {
        "text": "The prosecutor has more control over life, lib-",
        "paragraph_id": "para_165"
      },
      {
        "text": "erty, and reputation than any other person in",
        "paragraph_id": "para_166"
      },
      {
        "text": "America. His discretion is tremendous. He can",
        "paragraph_id": "para_167"
      },
      {
        "text": "have citizens investigated and, if he is that kind",
        "paragraph_id": "para_168"
      },
      {
        "text": "of person, he can have this done to the tune of",
        "paragraph_id": "para_169"
      },
      {
        "text": "public statements and veiled or unveiled inti-",
        "paragraph_id": "para_170"
      },
      {
        "text": "mations. Or the prosecutor may choose a more",
        "paragraph_id": "para_171"
      },
      {
        "text": "subtle course and simply have a citizen’s friends",
        "paragraph_id": "para_172"
      },
      {
        "text": "interviewed. The prosecutor can order arrests,",
        "paragraph_id": "para_173"
      },
      {
        "text": "present cases to the grand jury in secret session,",
        "paragraph_id": "para_174"
      },
      {
        "text": "and on the basis of his one-sided presentation of",
        "paragraph_id": "para_175"
      },
      {
        "text": "the facts, can cause the citizen to be indicted and",
        "paragraph_id": "para_176"
      },
      {
        "text": "held for trial. He may dismiss the case before",
        "paragraph_id": "para_177"
      },
      {
        "text": "trial, in which case the defense never has a",
        "paragraph_id": "para_178"
      },
      {
        "text": "chance to be heard. Or he may go on with a",
        "paragraph_id": "para_179"
      },
      {

        "text": "public trial …. While the prosecutor at his best",
        "paragraph_id": "para_181"
      },
      {
        "text": "is one of the most beneficent forces in our soci-",
        "paragraph_id": "para_182"

        "text": "ety, when he acts from malice or other base mo-",
        "paragraph_id": "para_183"
      },
      {
        "text": "tives, he is one of the worst.†",
        "paragraph_id": "para_184"
      },
      {

        "text": "Federal courts are not in the business of drafting perfor-",
        "paragraph_id": "para_188"
      },
      {
        "text": "mance reviews for prosecutors. Rather, we apply constitu-",
        "paragraph_id": "para_189"
      },
      {
        "text": "tional and legislative mandates, and I do not suggest that Jus-",
        "paragraph_id": "para_190"
      },
      {
        "text": "tice Robert Jackson’s view of a prosecutor is such a legal man-",
        "paragraph_id": "para_191"
      },
      {
        "text": "date. That said, Justice Jackson’s observations ring as true to-",
        "paragraph_id": "para_192"
      },
      {
        "text": "day as they did in the 1940s. And while those comments pri-",
        "paragraph_id": "para_193"
      },
      {
        "text": "marily centered on the application of criminal law, with all of",
        "paragraph_id": "para_194"
      },
      {
        "text": "its attendant safeguards, today’s state prosecutors also have",
        "paragraph_id": "para_195"
      },
      {
        "text": "at their disposal a litany of civil enforcement options. These",
        "paragraph_id": "para_196"
      },
      {
        "text": "civil enforcement options are often aimed at organizations,",
        "paragraph_id": "para_197"
      },
      {
        "text": "and appropriately so. See, e.g., LG Display Co. v. Madigan, 665",
        "paragraph_id": "para_198"
      },
      {
        "text": "F.3d 768, 770 (7th Cir. 2011)",
        "paragraph_id": "para_199"
      },
      {
        "text": "Without a live controversy, I hesitate to come to any con-",
        "paragraph_id": "para_200"
      },
      {
        "text": "clusion on the proper scope of Younger’s bad-faith exception.",
        "paragraph_id": "para_201"
      },
      {
        "text": "We are starting to see more cases involving allegations that",
        "paragraph_id": "para_202"
      },
      {
        "text": "state prosectors are acting in bad faith. See Yelp Inc. v. Paxton,",
        "paragraph_id": "para_203"
      },
      {
        "text": "137 F.4th 944, 951–52 (9th Cir. 2025); Netflix, Inc. v. Babin, 88",
        "paragraph_id": "para_204"
      },
      {
        "text": "F.4th 1080, 1099–1100 (5th Cir. 2023). Perhaps this is because",
        "paragraph_id": "para_205"
      },
      {
        "text": "of a change in how state prosecutors operate. Or maybe these",
        "paragraph_id": "para_206"
      },
      {

        "text": "allegations are nothing more than litigants’ last-ditch efforts",
        "paragraph_id": "para_212"
      },
      {
        "text": "to convince federal courts to intrude on the province of state",
        "paragraph_id": "para_213"
      },
      {
        "text": "courts. Whatever the proper limiting principle for determin-",
        "paragraph_id": "para_214"
      },
      {
        "text": "ing bad faith, we must consider that prosecutors can use ex-",
        "paragraph_id": "para_215"
      },
      {
        "text": "pensive litigation to impose a heckler’s veto. In the right case,",
        "paragraph_id": "para_216"
      },
      {
        "text": "after all, a court could conclude that a state prosecutor has",
        "paragraph_id": "para_217"
      },
      {
        "text": "gone too far. See Babin, 88 F.4th at 1100.",
        "paragraph_id": "para_218"
      },
      {
        "text": "IV",
        "paragraph_id": "para_219"
      },
      {
        "text": "The partial dissent and concurrence agree this case is moot",
        "paragraph_id": "para_220"
      },
      {
        "text": "and the injunction below should be vacated. For today, we",
        "paragraph_id": "para_221"
      },
      {
        "text": "need say no more. Certainly, as the partial dissent argues, we",
        "paragraph_id": "para_222"
      },
      {
        "text": "could provide more detail about where our court stands on the",
        "paragraph_id": "para_223"
      },
      {
        "text": "current scope of the bad-faith exception to Younger absten-",
        "paragraph_id": "para_224"
      },
      {
        "text": "tion. And should the issue come before us in a live contro-",
        "paragraph_id": "para_225"
      },
      {
        "text": "versy, we will no doubt do so. In the meantime, while prose-",
        "paragraph_id": "para_226"
      },
      {
        "text": "cutors must at times strike hard blows and take on challeng-",
        "paragraph_id": "para_227"
      },
      {
        "text": "ing cases, adherence to Justice Robert Jackson’s view of the",
        "paragraph_id": "para_228"
      },
      {
        "text": "model prosecutor can steer them far away from the line where",
        "paragraph_id": "para_229"
      },
      {
        "text": "we might question their good faith.",
        "paragraph_id": "para_230"
      },
      {

        "text": "cated. So it may be tempting to see the appeal as a short-lived",
        "paragraph_id": "para_237"
      },
      {
        "text": "blip of little consequence. Law and life move on.",
        "paragraph_id": "para_238"
      },
      {
        "text": "Yes and no. I agree that we should close the book on this",
        "paragraph_id": "para_239"
      },
      {
        "text": "appeal. But our mistake, in my respectful view, is not saying",
        "paragraph_id": "para_240"
      },
      {
        "text": "a few words about what brought the appeal to us in the first",
        "paragraph_id": "para_241"
      },
      {
        "text": "instance: a district court in Illinois preliminarily enjoined Flor-",
        "paragraph_id": "para_242"
      },
      {
        "text": "ida’s Attorney General from litigating claims under Florida",
        "paragraph_id": "para_243"
      },
      {
        "text": "law in a Florida state court. The injunction worked a grievous",
        "paragraph_id": "para_244"
      },
      {
        "text": "blow to a cornerstone principle of our constitutional design—",
        "paragraph_id": "para_245"
      },
      {
        "text": "federalism—and all but cast a vote of no confidence in state",
        "paragraph_id": "para_246"
      },
      {
        "text": "courts. We have clear authority to say this and have bypassed",
        "paragraph_id": "para_247"
      },
      {
        "text": "an important opportunity to do so, all at a time when the fed-",
        "paragraph_id": "para_248"
      },
      {
        "text": "eral judiciary’s enforcement of neutral structural constitu-",
        "paragraph_id": "para_249"
      },
      {
        "text": "tional principles remains as important as ever.",
        "paragraph_id": "para_250"
      },
      {
        "text": "I",

      },
      {
        "text": "My dissent at the panel level conveys these views in much",
        "paragraph_id": "para_252"
      },
      {

        "text": "Recall that the district court attempted to justify the entry",

        "text": "of a preliminary injunction by relying on the so-called “bad",
        "paragraph_id": "para_257"
      },

        "text": "faith” exception to the abstention doctrine recognized in",
        "paragraph_id": "para_258"
      },
      {
        "text": "Younger v. Harris, 401 U.S. 37 (1971). That exception is “nar-",
        "paragraph_id": "para_259"
      },
      {
        "text": "row.” Huffman v. Pursue, Ltd., 420 U.S. 592, 602 (1975). So nar-",
        "paragraph_id": "para_260"
      },
      {
        "text": "row, in fact, that “[t]here is no case since Younger was decided",
        "paragraph_id": "para_261"
      },
      {

        "text": "Indeed, the Supreme Court has found an occurrence of",
        "paragraph_id": "para_266"
      },
      {
        "text": "bad faith just once—in Dombrowski v. Pfister, 380 U.S. 479, 492",
        "paragraph_id": "para_267"
      },
      {
        "text": "(1965). The situation there was night-and-day different than",
        "paragraph_id": "para_268"
      },
      {
        "text": "the one here. In 1963 Louisiana police repeatedly “raided and",
        "paragraph_id": "para_269"
      },
      {
        "text": "ransacked” the homes and offices of civil rights activists “[a]t",
        "paragraph_id": "para_270"
      },
      {
        "text": "gunpoint,” and threatened charges even after a state judge",
        "paragraph_id": "para_271"
      },
      {
        "text": "had quashed the arrest warrants and suppressed the seized",
        "paragraph_id": "para_272"
      },
      {
        "text": "evidence. Id. at 487–88 & n.4. The reinstitution of similar crim-",
        "paragraph_id": "para_273"
      },
      {
        "text": "inal charges, brought under a state statute “unconstitutional",
        "paragraph_id": "para_274"
      },
      {
        "text": "on its face,” led the Supreme Court to prescribe the unusually",
        "paragraph_id": "para_275"
      },
      {
        "text": "strong medicine of a federal court injunction. Id. at 496–97.",
        "paragraph_id": "para_276"
      },
      {
        "text": "In Dombrowski’s wake, “commentators have observed that",
        "paragraph_id": "para_277"
      },
      {
        "text": "‘the universe of bad-faith-harassment claims that can be es-",
        "paragraph_id": "para_278"
      },
      {
        "text": "tablished is virtually empty.’” Erwin Chemerinsky, Federal Ju-",
        "paragraph_id": "para_279"
      },
      {
        "text": "risdiction § 13.5 (9th ed. 2025). The bad-faith doctrine “appears",
        "paragraph_id": "para_280"
      },
      {
        "text": "limited to facts such as those present in Dombrowski,” id., and",
        "paragraph_id": "para_281"
      },
      {
        "text": "the Supreme Court’s clear commitment to rigorous enforce-",
        "paragraph_id": "para_282"
      },
      {
        "text": "ment of principles of federalism in the decades since Younger",
        "paragraph_id": "para_283"
      },
      {
        "text": "can only further curtail this eye-of-the-needle exception. It",
        "paragraph_id": "para_284"
      },
      {
        "text": "cannot support the preliminary injunction entered by the dis-",
        "paragraph_id": "para_285"
      },
      {
        "text": "trict court here.",
        "paragraph_id": "para_286"
      },
      {
        "text": "Our mistake today is not saying so as a full court. The",
        "paragraph_id": "para_287"
      },
      {
        "text": "Academy made a strategic and calculated decision to volun-",
        "paragraph_id": "para_288"
      },
      {
        "text": "tarily dismiss this case. That decision rendered this appeal",
        "paragraph_id": "para_289"
      },
      {
        "text": "moot, but we had the choice to vacate the injunction ourselves",
        "paragraph_id": "para_290"

        "text": "portunity will prove constitutionally expensive another time.",

        "paragraph_id": "para_300"
      },
      {
        "text": "In no way is the Academy’s position lost on me. Repre-",
        "paragraph_id": "para_301"
      },
      {
        "text": "sented by very able counsel, the Academy has been crystal",
        "paragraph_id": "para_302"
      },
      {
        "text": "clear from the beginning that it believes the Florida Attorney",
        "paragraph_id": "para_303"
      },
      {
        "text": "General’s state court claims violate the organization’s First",
        "paragraph_id": "para_304"
      },
      {
        "text": "Amendment rights. The Academy deserves its day in court on",
        "paragraph_id": "para_305"
      },
      {
        "text": "that defense, and the record shows it is receiving it. The state",
        "paragraph_id": "para_306"
      },
      {
        "text": "court proceedings in St. Lucie County, Florida, if once stalled,",
        "paragraph_id": "para_307"
      },
      {
        "text": "are now moving forward. Indeed, the state court recently de-",
        "paragraph_id": "para_308"
      },
      {
        "text": "nied the Academy’s motion to dismiss the state claims.",
        "paragraph_id": "para_309"
      },
      {
        "text": "Time will tell whether the Academy prevails on its defense",
        "paragraph_id": "para_310"
      },
      {
        "text": "or falls short. All we can observe today is that, if the Academy",
        "paragraph_id": "para_311"
      },
      {
        "text": "does not prevail at the trial court level, it can seek further re-",
        "paragraph_id": "para_312"
      },
      {
        "text": "view in the Florida appellate courts, even the Florida Su-",
        "paragraph_id": "para_313"
      },
      {
        "text": "preme Court. The U.S. Constitution presumes parity and",
        "paragraph_id": "para_314"
      },
      {
        "text": "comity between the federal and state courts. As Justice Bren-",
        "paragraph_id": "para_315"
      },
      {
        "text": "nan explained more than 50 years ago for a unanimous Su-",
        "paragraph_id": "para_316"
      },
      {
        "text": "preme Court, “a pending state proceeding, in all but unusual",
        "paragraph_id": "para_317"
      },
      {
        "text": "cases, would provide the federal plaintiff with the necessary",
        "paragraph_id": "para_318"
      },
      {
        "text": "vehicle for vindicating his constitutional rights.” Steffel v.",
        "paragraph_id": "para_319"
      },
      {
        "text": "Thompson, 415 U.S. 452, 460 (1974). Remember, too, that “all",
        "paragraph_id": "para_320"
      },
      {
        "text": "executive and judicial officers, both of the United States and",
        "paragraph_id": "para_321"
      },
      {
        "text": "of the several states, shall be bound by oath or affirmation, to",
        "paragraph_id": "para_322"
      },
      {
        "text": "support this Constitution.” U.S. Const. art. VI cl. 3; see also",
        "paragraph_id": "para_323"
      },
      {
        "text": "Martin v. Hunter’s Lessee, 14 U.S. (1 Wheat.) 304, 346 (1816)",
        "paragraph_id": "para_324"
      },
      {
        "text": "(emphasizing that “the judges of the state courts are, and",
        "paragraph_id": "para_325"
      },
      {
        "text": "No. 26-2238 13",
        "paragraph_id": "para_326"
      },
      {
        "text": "always will be, of as much learning, integrity, and wisdom, as",
        "paragraph_id": "para_327"
      },
      {
        "text": "those of the courts of the United States”). The Florida courts,",
        "paragraph_id": "para_328"
      },
      {
        "text": "in short, are fully and equally capable of resolving the Acad-",
        "paragraph_id": "para_329"
      },
      {
        "text": "emy’s First Amendment defense. Much of our judicial design",
        "paragraph_id": "para_330"
      },
      {
        "text": "rests on that structural view.",
        "paragraph_id": "para_331"
      },
      {

        "text": "Our order granting initial hearing en banc reflected the",
        "paragraph_id": "para_333"
      },
      {
        "text": "gravity of the federalism interests at stake. In dismissing this",

        "text": "appeal, we should have taken one more step by vacating the",
        "paragraph_id": "para_335"
      },
      {
        "text": "preliminary injunction ourselves and articulating why it",
        "paragraph_id": "para_336"
      },
      {
        "text": "never should have issued in the first place. Because the court",
        "paragraph_id": "para_337"
      },
      {
        "text": "today rejects the opportunity to do so, I respectfully dissent",
        "paragraph_id": "para_338"
      },
