        "text": "After a jury convicted Abraham Augustin of six federal offenses, he unsuccessfully",
        "paragraph_id": "para_29"
      },
      {
        "text": "moved under 28 U.S.C. § 2255 to vacate his convictions and set aside his sentence. His second",
        "paragraph_id": "para_30"
      },
      {
        "text": "§ 2255 motion, filed in the wake of United States v. Davis, 588 U.S. 445 (2019), was more",
        "paragraph_id": "para_31"
      },
      {
        "text": "successful. As a result, the district court vacated his 18 U.S.C. § 924(c) conviction, corrected his",
        "paragraph_id": "para_32"
      },
      {
        "text": "sentence accordingly, and issued an amended judgment.",
        "paragraph_id": "para_33"
      },
      {

        "text": "Augustin then moved again to vacate his five other convictions and set aside his sentence",
        "paragraph_id": "para_36"

        "text": "under § 2255. But the district court transferred the motion to this court, as § 2255 requires for",
        "paragraph_id": "para_37"
      },
      {
        "text": "“second or successive” motions. Augustin asks us to remand, arguing that the motion challenges",
        "paragraph_id": "para_38"
      },
      {
        "text": "his amended judgment, not the original judgment, so it is not “second or successive.” We agree.",
        "paragraph_id": "para_39"
      },
      {
        "text": "I.",
        "paragraph_id": "para_40"
      },
      {
        "text": "In 2010, a jury found Augustin guilty of discharging a firearm during and in relation to a",
        "paragraph_id": "para_41"
      },
      {
        "text": "crime of violence, in violation of 18 U.S.C. § 924(c), and of five other offenses. The district",
        "paragraph_id": "para_42"
      },
      {
        "text": "court sentenced him to 120 months of imprisonment for the § 924(c) conviction, to run",
        "paragraph_id": "para_43"
      },
      {
        "text": "consecutive to 380 months of imprisonment for the other convictions. We affirmed. United",
        "paragraph_id": "para_44"
      },
      {
        "text": "States v. Dais, 559 F. App’x 438 (6th Cir. 2014).",
        "paragraph_id": "para_45"
      },
      {
        "text": "Augustin then filed his first § 2255 motion to vacate his six convictions and set aside his",
        "paragraph_id": "para_46"
      },
      {
        "text": "sentence. The district court denied the motion, and we denied a certificate of appealability.",
        "paragraph_id": "para_47"
      },
      {
        "text": "Augustin v. United States, 2019 WL 11892157 (6th Cir. Feb. 1, 2019) (order). In 2019, however,",
        "paragraph_id": "para_48"
      },
      {
        "text": "we granted Augustin leave to file a “second or successive” § 2255 motion challenging his §",
        "paragraph_id": "para_49"
      },
      {
        "text": "924(c) conviction based on United States v. Davis, 588 U.S. 445 (2019), which held that",
        "paragraph_id": "para_50"
      },
      {
        "text": "§ 924(c)(3)(B)’s residual clause is unconstitutionally vague. In re Augustin, No. 19-5717, 2019",
        "paragraph_id": "para_51"
      },
      {
        "text": "U.S. App. LEXIS 33946 (6th Cir. Nov. 13, 2019) (order). In 2020, the district court granted this",
        "paragraph_id": "para_52"
      },
      {
        "text": "motion, vacated Augustin’s § 924(c) conviction, corrected his sentence by reducing it by 120",
        "paragraph_id": "para_53"
      },
      {
        "text": "months, left unaltered the 380 months of imprisonment for the remaining five counts, and issued",
        "paragraph_id": "para_54"
      },
      {
        "text": "an amended judgment to reflect the reduced sentence. We affirmed over Augustin’s objection",
        "paragraph_id": "para_55"
      },
      {
        "text": "that the district court abused its discretion by simply correcting his sentence rather than",
        "paragraph_id": "para_56"
      },
      {
        "text": "conducting a full resentencing. United States v. Augustin, 16 F.4th 227, 233 (6th Cir. 2021).",
        "paragraph_id": "para_57"
      },
      {
        "text": "In 2023, Augustin filed the instant § 2255 motion, again challenging these five",
        "paragraph_id": "para_58"
      },
      {
        "text": "convictions. In 2025, the district court transferred the motion to us after construing it to be",
        "paragraph_id": "para_59"
      },
      {
        "text": "“second or successive” under § 2255.",
        "paragraph_id": "para_60"
      },
      {

        "text": "II.",
        "paragraph_id": "para_62"
      },
      {
        "text": "Augustin moves to remand his § 2255 motion to the district court. He argues that,",
        "paragraph_id": "para_63"
      },
      {
        "text": "because the order vacating his § 924(c) conviction and sentence created a new judgment, the",
        "paragraph_id": "para_64"
      },
      {
        "text": "motion is not “second or successive.” He also asks that we reassign the motion to a different",
        "paragraph_id": "para_65"
      },
      {
        "text": "district court judge on remand because the district court took over two years to transfer the",
        "paragraph_id": "para_66"
      },
      {
        "text": "motion to us.",
        "paragraph_id": "para_67"
      },
      {
        "text": "A.",
        "paragraph_id": "para_68"
      },
      {
        "text": "Generally, a federal defendant has one opportunity, as of right, to collaterally attack his",
        "paragraph_id": "para_69"
      },
      {
        "text": "criminal judgment under 28 U.S.C. § 2255. Before a defendant may file a “second or",
        "paragraph_id": "para_70"
      },
      {
        "text": "successive” § 2255 motion, he must first receive certification from the appropriate court of",
        "paragraph_id": "para_71"
      },
      {
        "text": "appeals that the motion satisfies one of two gatekeeping requirements. 28 U.S.C. § 2255(h)",
        "paragraph_id": "para_72"
      },
      {
        "text": "(citing 28 U.S.C. § 2244); In re Sims, 111 F.3d 45, 46–47 (6th Cir. 1997) (per curiam). But a",
        "paragraph_id": "para_73"
      },
      {
        "text": "motion filed later in time is not necessarily “second or successive.” In re Hill, 81 F.4th 560, 568",
        "paragraph_id": "para_74"
      },
      {
        "text": "(6th Cir. 2023) (en banc). This is because “second or successive” is a “term of art,” not a self-",
        "paragraph_id": "para_75"
      },
      {
        "text": "defining, chronological label. Banister v. Davis, 590 U.S. 504, 511 (2020) (citation modified).",
        "paragraph_id": "para_76"
      },
      {
        "text": "The Supreme Court has carved out discrete circumstances to determine when a § 2255",
        "paragraph_id": "para_77"
      },
      {
        "text": "motion filed later in time is not “second or successive.” Hill, 81 F.4th at 568 (collecting cases).",
        "paragraph_id": "para_78"
      },
      {
        "text": "As relevant here, when a second motion challenges a new judgment—not the judgment already",
        "paragraph_id": "para_79"
      },
      {
        "text": "challenged in a prior § 2255 motion—the motion is not “second or successive.” Id.1 And “[t]his",
        "paragraph_id": "para_80"
      },
      {
        "text": "judgment-based reasoning naturally applies to all new judgments, whether they capture new",
        "paragraph_id": "para_81"
      },
      {
        "text": "sentences or new convictions or merely reinstate one or the other.” King v. Morgan, 807 F.3d",
        "paragraph_id": "para_82"
      },
      {
        "text": "154, 157 (6th Cir. 2015); see also In re Stansell, 828 F.3d 412, 418 (6th Cir. 2016) (holding that",
        "paragraph_id": "para_83"
      },
      {
        "text": "partially vacating a sentence creates an intervening judgment and permits that defendant to",
        "paragraph_id": "para_84"
      },
      {
        "text": "challenge his undisturbed conviction and term of imprisonment). Accordingly, when a prisoner",
        "paragraph_id": "para_85"
      },
      {
        "text": "challenges a new judgment, he does not need to overcome § 2255(h)’s strict limits before filing",
        "paragraph_id": "para_86"
      },
      {
        "text": "1Although Hill discussed habeas petitions brought by state prisoners under 28 U.S.C. § 2254, its analysis",
        "paragraph_id": "para_87"
      },
      {
        "text": "applies equally to § 2255 motions. See Ajan v. United States, 731 F.3d 629, 631 (6th Cir. 2013).",
        "paragraph_id": "para_88"
      },
      {

        "text": "his motion. See Magwood v. Patterson, 561 U.S. 320, 334 (2010); see also King, 807 F.3d at",
        "paragraph_id": "para_90"
      },
      {
        "text": "158.",
        "paragraph_id": "para_91"
      },
      {
        "text": "Equally relevant, if a court grants a defendant’s motion collaterally attacking his criminal",
        "paragraph_id": "para_92"
      },
      {
        "text": "judgment, § 2255(b) requires the court to first “vacate and set the judgment aside” before, among",
        "paragraph_id": "para_93"
      },
      {
        "text": "other things, resentencing or correcting the sentence. Thus, when the district court granted",
        "paragraph_id": "para_94"
      },
      {
        "text": "Augustin’s § 2255 motion in 2020, it first vacated and set aside the original judgment before",
        "paragraph_id": "para_95"
      },
      {
        "text": "correcting Augustin’s sentence to reduce it by 120 months and then issuing an amended",
        "paragraph_id": "para_96"
      },
      {
        "text": "judgment to reflect this reduction. And when a judgment is vacated, “the law acts as though the",
        "paragraph_id": "para_97"
      },
      {
        "text": "vacated [judgment] never occurred.” Hewitt v. United States, 606 U.S. 419, 431 (2025). What",
        "paragraph_id": "para_98"
      },
      {
        "text": "stands in its place is the intervening judgment, which may be challenged as of right under § 2255",
        "paragraph_id": "para_99"
      },
      {
        "text": "without implicating the second or successive bar. See Magwood, 561 U.S. at 341–42; King, 807",
        "paragraph_id": "para_100"
      },
      {
        "text": "F.3d at 157.",
        "paragraph_id": "para_101"
      },
      {
        "text": "We have concluded the same in several unpublished orders. See, e.g., In re Johnson,",
        "paragraph_id": "para_102"
      },
      {
        "text": "No. 22-3613, 2023 U.S. App. LEXIS 2267, at *2–3 (6th Cir. Jan. 27, 2023) (order); In re Daniel,",
        "paragraph_id": "para_103"
      },
      {
        "text": "No. 22-5917, 2023 U.S. App. LEXIS 415, at *2–3 (6th Cir. Jan. 6, 2023) (order); In re Racey,",
        "paragraph_id": "para_104"
      },
      {
        "text": "No. 22-5029, 2022 U.S. App. LEXIS 9767, at *2–3 (6th Cir. Apr. 12, 2022) (order); In re Cain,",
        "paragraph_id": "para_105"
      },
      {
        "text": "No. 17-6249, 2018 U.S. App. LEXIS 6936, at *2–3 (6th Cir. Mar. 19, 2018) (order). Although",
        "paragraph_id": "para_106"
      },
      {
        "text": "many of those cases involved a full resentencing, we do not see that as a distinguishing feature.",
        "paragraph_id": "para_107"
      },
      {
        "text": "Whether the district court corrects the sentence or fully resentences the defendant after vacating",
        "paragraph_id": "para_108"
      },
      {
        "text": "the judgment is irrelevant—the previous judgment is void ab initio, and the intervening judgment",
        "paragraph_id": "para_109"
      },
      {
        "text": "is new and challengeable in the first instance, regardless of the remedial measure selected.2 See",
        "paragraph_id": "para_110"
      },
      {
        "text": "Hewitt, 606 U.S. at 431.",
        "paragraph_id": "para_111"
      },
      {
        "text": "In sum, Augustin’s motion challenging his amended judgment for the first time is not",
        "paragraph_id": "para_112"
      },
      {
        "text": "“second or successive” under § 2255. Thus, we remand the motion to the district court.",
        "paragraph_id": "para_113"
      },
      {
        "text": "2We note that not every change to a sentence creates a new judgment. Sentence reductions under 18",
        "paragraph_id": "para_114"
      },
      {
        "text": "U.S.C. § 3582(c) or Criminal Rule 35(b) do not create a new judgment. Freeman v. Wainwright, 959 F.3d 226, 229",
        "paragraph_id": "para_115"
      },
      {
        "text": "(6th Cir. 2020) (citation modified). Nor have we found that a nunc pro tunc order striking a post-release control",
        "paragraph_id": "para_116"
      },
      {
        "text": "condition under state law creates a new judgment. Id. at 230.",
        "paragraph_id": "para_117"
      },
      {

      {
        "text": "B.",
        "paragraph_id": "para_119"
      },
      {
        "text": "On remand, Augustin argues that we should return the case to a different district court",
        "paragraph_id": "para_120"
      },
      {
        "text": "judge. Under 28 U.S.C. § 2106, we have the authority to do so. But “reassignment is an",
        "paragraph_id": "para_121"
      },
      {
        "text": "‘extraordinary power and should be rarely invoked . . . and with the greatest reluctance.’”",
        "paragraph_id": "para_122"
      },
      {
        "text": "Sagan v. United States, 342 F.3d 493, 501 (6th Cir. 2003) (quoting Armco, Inc. v. United",
        "paragraph_id": "para_123"
      },
      {
        "text": "Steelworkers of Am., AFL–CIO, Local 169, 280 F.3d 669, 683 (6th Cir. 2002)); see also Solomon",
        "paragraph_id": "para_124"
      },
      {
        "text": "v. United States, 467 F.3d 928, 935 (6th Cir. 2006).",
        "paragraph_id": "para_125"
      },
      {
        "text": "Although the district court waited two years to transfer Augustin’s motion to this court,",
        "paragraph_id": "para_126"
      },
      {
        "text": "we do not find the delay in this case sufficient to warrant reassignment because other",
        "paragraph_id": "para_127"
      },
      {
        "text": "postconviction litigation was also ongoing before the district court. The district court judge,",
        "paragraph_id": "para_128"
      },
      {
        "text": "moreover, has handled the case for over a decade and reassigning the case would no doubt",
        "paragraph_id": "para_129"
      },
      {
        "text": "further delay its resolution. Nor do we find any credence in Augustin’s allegation that the",
        "paragraph_id": "para_130"
      },
      {
        "text": "district court’s decision not to conduct a full sentencing after vacating his previous judgment",
        "paragraph_id": "para_131"
      },
      {
        "text": "demonstrates bias or improper motive. As we already held, that decision was properly within the",
        "paragraph_id": "para_132"
      },
      {
        "text": "district court’s discretion. See Augustin, 16 F.4th at 233. In sum, reassignment is unwarranted.",
        "paragraph_id": "para_133"
      },
      {
        "text": "III.",
        "paragraph_id": "para_134"
      },
      {
        "text": "The motion to remand is GRANTED for further proceedings consistent with this opinion.",
