      {
        "text": "Jamaal Howard, a convicted murderer, is scheduled for execution on",
        "paragraph_id": "para_17"
      },
      {
        "text": "October 7, 2026. Facing impending execution, Howard moves for this court",
        "paragraph_id": "para_18"
      },
      {
        "text": "to authorize the district court to consider his second 28 U.S.C. § 2254. He",
        "paragraph_id": "para_19"
      },
      {
        "text": "argues that new clinical standards—updated after the denial of his first",
        "paragraph_id": "para_20"
      },
      {
        "text": "habeas petition—would deem him mentally disabled and therefore ineligible",
        "paragraph_id": "para_21"
      },
      {
        "text": "to face execution under the Eighth Amendment, see Atkins v. Virginia,",
        "paragraph_id": "para_22"
      },
      {
        "text": "536 U.S. 304, 317–19 (2002). Howard further reasons that his second peti-",
        "paragraph_id": "para_23"
      },
      {
        "text": "tion’s reliance on new clinical standards is tantamount to reliance on a new,",
        "paragraph_id": "para_24"
      },
      {
        "text": "retroactive, and previously unavailable rule of constitutional law. He also",
        "paragraph_id": "para_25"
      },
      {
        "text": "claims that his second petition does not advance claims presented in his prior",
        "paragraph_id": "para_26"
      },
      {
        "text": "habeas application. So, Howard concludes that consideration of his second",
        "paragraph_id": "para_27"
      },
      {

        "text": "petition is proper. In the alternative, Howard asks that this court stay his",
        "paragraph_id": "para_37",
        "court_paragraph": 2

      {
        "text": "execution pending the Supreme Court’s decision in Guerrero v. Johnson.",
        "paragraph_id": "para_38"
      },
      {
        "text": "We deny Howard’s motions. His second habeas application is barred",
        "paragraph_id": "para_39"
      },
      {
        "text": "by the statute of limitations, and he cannot overcome limitations via equitable",
        "paragraph_id": "para_40"
      },
      {
        "text": "tolling. Even if limitations proved no obstacle, Howard’s second petition",
        "paragraph_id": "para_41"
      },
      {
        "text": "makes a previously presented claim, foreclosing consideration in turn.",
        "paragraph_id": "para_42"
      },
      {
        "text": "Nor is a stay of his execution proper. Howard has no likelihood of",
        "paragraph_id": "para_43"
      },
      {
        "text": "success on the merits. The balance of the equities militates against a stay.",
        "paragraph_id": "para_44"
      },
      {
        "text": "And the mere speculative possibility of the Supreme Court’s holding to the",
        "paragraph_id": "para_45"
      },
      {
        "text": "contrary proves insufficient to warrant a stay.",
        "paragraph_id": "para_46"
      },
      {
        "text": "I.",
        "paragraph_id": "para_47"
      },
      {
        "text": "We have jurisdiction under 28 U.S.C. § 2244(b)(3)(A).",
        "paragraph_id": "para_48"
      },
      {
        "text": "II.",
        "paragraph_id": "para_49"
      },
      {
        "text": "Consider the procedural history. On May 12, 2000, Howard shot and",
        "paragraph_id": "para_50"
      },
      {
        "text": "killed Vickie Swartout at a gas station in Silsbee, Texas. In 2001, he was con-",
        "paragraph_id": "para_51"
      },
      {
        "text": "victed and sentenced to death. Howard appealed, contending that his mental",
        "paragraph_id": "para_52"
      },
      {
        "text": "illness precluded his execution under the Eighth Amendment. The Texas",
        "paragraph_id": "para_53"
      },
      {
        "text": "Court of Criminal Appeals (“CCA”) disagreed and upheld his conviction",
        "paragraph_id": "para_54"
      },
      {
        "text": "and sentence. Howard v. State, 153 S.W.3d 382, 383–84 (Tex. Crim. App.",
        "paragraph_id": "para_55"
      },
      {
        "text": "2004).",
        "paragraph_id": "para_56"
      },
      {
        "text": "In 2002, the Supreme Court decided Atkins, which held that the",
        "paragraph_id": "para_57"
      },
      {
        "text": "intellectually disabled are constitutionally barred from execution.",
        "paragraph_id": "para_58"
      },
      {
        "text": "While his direct appeal was pending, Howard filed a state habeas",
        "paragraph_id": "para_59"
      },
      {
        "text": "petition. The trial court recommended that the CCA deny relief. The CCA",
        "paragraph_id": "para_60"
      },
      {
        "text": "agreed.",
        "paragraph_id": "para_61"
      },
      {
        "text": "Subsequently, on December 12, 2012, Howard filed a federal habeas",
        "paragraph_id": "para_62"
      },
      {

        "text": "petition. His team, advancing an Atkins claim, tested him for an intellectual",
        "paragraph_id": "para_66",
        "court_paragraph": 3
      },
      {
        "text": "disability. It concluded in 2017 that he did not have an intellectual disability.",
        "paragraph_id": "para_67"
      },
      {
        "text": "And after the Supreme Court concluded that the CCA erred by applying",
        "paragraph_id": "para_68"
      },
      {
        "text": "“superseded medical standards” to rule on Atkins claims, Moore v. Texas,",
        "paragraph_id": "para_69"
      },
      {
        "text": "581 U.S. 1, 11–12 (2017), Howard abandoned his Atkins claim.",
        "paragraph_id": "para_70"
      },
      {
        "text": "Two years later, the district court denied Howard’s remaining claims,",
        "paragraph_id": "para_71"
      },
      {
        "text": "Howard v. Stevens, No. 1:13-cv-256, 2019 WL 4573640 (E.D. Tex. 2019).",
        "paragraph_id": "para_72"
      },
      {
        "text": "Howard applied for a Certificate of Appealability (“COA”), which this court",
        "paragraph_id": "para_73"
      },
      {
        "text": "denied. Howard v. Davis, 959 F.3d 168 (5th Cir. 2020).",
        "paragraph_id": "para_74"
      },
      {
        "text": "On March 26, 2026, Howard’s execution was scheduled for Octo-",
        "paragraph_id": "para_75"
      },
      {
        "text": "ber 7, 2026. On September 28, 2026, Howard, reviving his abandoned Atkins",
        "paragraph_id": "para_76"
      },
      {
        "text": "claim, sought a writ of habeas corpus in the CCA. While that writ lay pend-",
        "paragraph_id": "para_77"
      },
      {
        "text": "ing, Howard moved in this court on October 1 to authorize consideration of",
        "paragraph_id": "para_78"
      },
      {
        "text": "a second petition and to stay his execution.",
        "paragraph_id": "para_79"
      },
      {
        "text": "III.",
        "paragraph_id": "para_80"
      },
      {
        "text": "The statute of limitations precludes Howard’s second habeas",
        "paragraph_id": "para_81"
      },
      {
        "text": "application.",
        "paragraph_id": "para_82"
      },
      {
        "text": "A.",
        "paragraph_id": "para_83"
      },
      {
        "text": "The statute provides a “1-year period of limitation” to “an applica-",
        "paragraph_id": "para_84"
      },
      {
        "text": "tion for a writ of habeas corpus by a person in custody pursuant to the",
        "paragraph_id": "para_85"
      },
      {
        "text": "judgment of a State court.” 28 U.S.C. § 2244(d)(1).",
        "paragraph_id": "para_86"
      },
      {
        "text": "The limitation runs “from the latest of . . .",
        "paragraph_id": "para_87"
      },
      {
        "text": "(A) the date on which the judgment became final by the conclusion of",
        "paragraph_id": "para_88"
      },
      {
        "text": "direct review or the expiration of the time for seeking such review;",
        "paragraph_id": "para_89"
      },
      {
        "text": "(B) the date on which the impediment to filing an application created",
        "paragraph_id": "para_90"
      },
      {
        "text": "by State action in violation of the Constitution or laws of the United States is",
        "paragraph_id": "para_91"
      },
      {

      {
        "text": "(C) the date on which the constitutional right asserted was initially",
        "paragraph_id": "para_96"
      },
      {
        "text": "recognized by the Supreme Court, if the right has been newly recognized by",
        "paragraph_id": "para_97"
      },
      {
        "text": "the Supreme Court and made retroactively applicable to cases on collateral",
        "paragraph_id": "para_98"
      },
      {
        "text": "review; or",
        "paragraph_id": "para_99"
      },
      {
        "text": "(D) the date on which the factual predicate of the claim or claims",
        "paragraph_id": "para_100"
      },
      {
        "text": "presented could have been discovered through the exercise of due diligence.”",
        "paragraph_id": "para_101"
      },
      {
        "text": "28 U.S.C. § 2244(d)(1)(A)–(D).",
        "paragraph_id": "para_102"
      },
      {
        "text": "B.",
        "paragraph_id": "para_103"
      },
      {
        "text": "Either subsection C or D could supply the latest date for the beginning",
        "paragraph_id": "para_104"
      },
      {
        "text": "of the limitation period. But no matter how one construes the statute of lim-",
        "paragraph_id": "para_105"
      },
      {
        "text": "itations or the facts at bar, the one-year period has elapsed.",
        "paragraph_id": "para_106"
      },
      {
        "text": "Subsection C provides Howard no relief. He claims the constitutional",
        "paragraph_id": "para_107"
      },
      {
        "text": "right not be executed owing to his mental disability. But the “right” was",
        "paragraph_id": "para_108"
      },
      {
        "text": "“initially recognized by the Supreme Court,” § 2244(d)(1)(C), in 2002.",
        "paragraph_id": "para_109"
      },
      {
        "text": "Atkins, 536 U.S. at 317. Twenty-four years have elapsed.",
        "paragraph_id": "para_110"
      },
      {
        "text": "Subsection D fares no better. Howard’s second application relies on",
        "paragraph_id": "para_111"
      },
      {
        "text": "five events that he avers “finally rendered his claim discoverable.” “(1) the",
        "paragraph_id": "para_112"
      },
      {
        "text": "AAIDD-12’s publication on January 11, 2021; (2) the DSM-5-TR’s publi-",
        "paragraph_id": "para_113"
      },
      {
        "text": "cation on March 18, 2022; (3) the CCA’s acknowledgement in Ex parte",
        "paragraph_id": "para_114"
      },
      {
        "text": "Estrada1 that the AAIDD extended the developmental period to 22 in April",
        "paragraph_id": "para_115"
      },
      {
        "text": "2025; (4) the CCA’s acknowledgement in Ex parte Mays2 that the DSM-5-",
        "paragraph_id": "para_116"
      },
      {
        "text": "TR abandoned the relatedness requirement in March 2024; and, finally,",
        "paragraph_id": "para_117"
      },
      {
        "text": "(5) the APA’s [American Psychological Association] issuance of its guide-",
        "paragraph_id": "para_118"
      },
      {

        "paragraph_id": "para_125",

      {
        "text": "Only the APA’s issuance of its guidelines was discoverable within a",
        "paragraph_id": "para_126"
      },
      {
        "text": "year of the instant application, which was filed on October 1, 2026. The other",
        "paragraph_id": "para_127"
      },
      {
        "text": "events transpired and were discoverable with reasonable diligence over a year",
        "paragraph_id": "para_128"
      },
      {
        "text": "before October 1, 2026.",
        "paragraph_id": "para_129"
      },
      {
        "text": "And the new APA guidelines do not generate newly discoverable fac-",
        "paragraph_id": "para_130"
      },
      {
        "text": "tual predicates that support Howard’s successive application. The new",
        "paragraph_id": "para_131"
      },
      {
        "text": "guidelines suggest that fulfilling the adaptive-deficit prong for intellectual",
        "paragraph_id": "para_132"
      },
      {
        "text": "disability requires “observation of deficits at multiple points in the develop-",
        "paragraph_id": "para_133"
      },
      {
        "text": "mental period.”3 But as Howard notes, so did Dr. Patton, one of the doctors",
        "paragraph_id": "para_134"
      },
      {
        "text": "who concluded in 2017 that Howard was not intellectually disabled. Id. So,",
        "paragraph_id": "para_135"
      },
      {
        "text": "the new guidance substantiates Dr. Patton’s methods and conclusions, rather",
        "paragraph_id": "para_136"
      },
      {
        "text": "than uncovering a previously undiscoverable factual predicate. It does not",
        "paragraph_id": "para_137"
      },
      {
        "text": "fall within the ambit of § 2244(d)(1)(D) because it is not a “factual predicate",
        "paragraph_id": "para_138"
      },
      {
        "text": "of the claim.” Accordingly, the period of limitation has elapsed.",
        "paragraph_id": "para_139"
      },
      {
        "text": "C.",
        "paragraph_id": "para_140"
      },
      {
        "text": "Howard postulates that he is entitled to equitable tolling because he",
        "paragraph_id": "para_141"
      },
      {
        "text": "was seeking to exhaust state court remedies and was diligent with his rights.",
        "paragraph_id": "para_142"
      },
      {
        "text": "Not so. Howard was not diligent with his rights, and there was no “extra-",
        "paragraph_id": "para_143"
      },
      {
        "text": "ordinary circumstance that stood in his way and prevented timely filing.”",
        "paragraph_id": "para_144"
      },
      {
        "text": "Holland v. Florida, 506 U.S. 631, 649 (2010). To the contrary, he slept on his",
        "paragraph_id": "para_145"
      },
      {
        "text": "rights. He filed his successive habeas application in state court on Septem-",
        "paragraph_id": "para_146"
      },
      {
        "text": "ber 28, 2026, half a year after his execution was scheduled and less than two",
        "paragraph_id": "para_147"
      },
      {
        "text": "weeks before his scheduled execution. He filed his motions before this court",
        "paragraph_id": "para_148"
      },
      {
        "text": "three days later. This was even though many of the events that Howard",
        "paragraph_id": "para_149"
      },
      {

        "text": "ble tolling, an equitable remedy. A party’s hands are unclean when they are",

        "text": "“dirtied . . . in acquiring the right he now asserts, or that the manner of",

      {
        "text": "dirtying renders inequitable the assertion of such rights against the defen-",
        "paragraph_id": "para_161"
      },
      {
        "text": "dant.”5 Examples include “transferring property to evade suit by credi-",
        "paragraph_id": "para_162"
      },
      {
        "text": "tors,” “abusing a legal right or power,”6 and unreasonable delays to improve",
        "paragraph_id": "para_163"
      },
      {
        "text": "a party’s litigating position, see LULAC v. Abbott, 809 F. Supp. 3d 502, 620",
        "paragraph_id": "para_164"
      },
      {
        "text": "(W.D. Tex. 2025) (Smith, J., dissenting). Equity disfavors parties with",
        "paragraph_id": "para_165"
      },
      {
        "text": "unclean hands. Id.",
        "paragraph_id": "para_166"
      },
      {
        "text": "Howard acted with unclean hands. By waiting until the eleventh hour",
        "paragraph_id": "para_167"
      },
      {
        "text": "to file his application and motion—when he had the opportunity to file these",
        "paragraph_id": "para_168"
      },
      {
        "text": "motions years before—Howard afforded this court minimal time to respond",
        "paragraph_id": "para_169"
      },
      {
        "text": "to his arguments. And by moving at the eleventh hour, Howard manufac-",
        "paragraph_id": "para_170"
      },
      {
        "text": "tured a sense of urgency that could have been averted by an earlier filing.",
        "paragraph_id": "para_171"
      },
      {
        "text": "Given equity’s consciousness toward the (in)equitable behavior of the par-",
        "paragraph_id": "para_172"
      },
      {
        "text": "ties, equitable tolling in Howard’s favor is unwarranted.",
        "paragraph_id": "para_173"
      },
      {
        "text": "IV.",
        "paragraph_id": "para_174"
      },
      {
        "text": "But assume that limitations raises no obstacle. Even then, Howard’s",

      },

        "text": "tion under section 2254 that was presented in a prior application shall be",

        "text": "dismissed.” § 2244(b)(1). In other words, even if a second habeas applica-",
        "paragraph_id": "para_190"
      },
      {
        "text": "tion satisfies the prima facie requirement for consideration under",
        "paragraph_id": "para_191"
      },
      {
        "text": "§ 2244(b)(3)(C), it could still be dismissed if it was presented in a prior",
        "paragraph_id": "para_192"
      },
      {
        "text": "application.",

      },
      {
        "text": "B.",

      {
        "text": "Howard’s claim was presented in his prior habeas application, fore-",
        "paragraph_id": "para_195"
      },
      {
        "text": "closing consideration under § 2244(b)(1).",
        "paragraph_id": "para_196"
      },
      {
        "text": "Howard offers two reasons why his instant Atkins claim was not “pre-",
        "paragraph_id": "para_197"
      },
      {
        "text": "sented in a prior application,” § 2244(b)(1). First, he maintains that his",
        "paragraph_id": "para_198"
      },
      {
        "text": "Atkins claim was not presented in a prior application because he had aban-",
        "paragraph_id": "para_199"
      },
      {
        "text": "doned it; no court has adjudicated it. Second, he posits that his current Atkins",
        "paragraph_id": "para_200"
      },
      {
        "text": "claim is fundamentally different from his first petition’s claim because it",
        "paragraph_id": "para_201"
      },
      {
        "text": "relies on a new factual predicate: updated clinical standards.",
        "paragraph_id": "para_202"
      },
      {
        "text": "Both arguments prove unavailing. Howard’s first argument does vio-",
        "paragraph_id": "para_203"
      },
      {
        "text": "lence to the text of § 2244. It requires the dismissal of claims that were “pre-",
        "paragraph_id": "para_204"
      },
      {
        "text": "sented in a prior application.” § 2244(b)(1). Presentation is distinct from",
        "paragraph_id": "para_205"
      },
      {
        "text": "adjudication: Indeed, § 2244 contemplates the distinction.7 Howard plainly",
        "paragraph_id": "para_206"
      },
      {
        "text": "presented an Atkins claim in his first habeas petition. His Atkins claim was",
        "paragraph_id": "para_207"
      },
      {
        "text": "funded, developed, and briefed before it was abandoned.8 In turn, this Atkins",
        "paragraph_id": "para_208"
      },
      {

        "text": "Precedent easily forecloses Howard’s second argument. His argu-",
        "paragraph_id": "para_220"
      },
      {
        "text": "ment proceeds that his current Atkins claim is “fundamentally different”",
        "paragraph_id": "para_221"
      },
      {
        "text": "from his previous claim because it relies on new clinical standards. In other",
        "paragraph_id": "para_222"
      },
      {
        "text": "words, the clinical standards provide new factual support for his Atkins claim:",
        "paragraph_id": "para_223"
      },
      {
        "text": "Howard is relying on the same legal standards for determining intellectual",
        "paragraph_id": "para_224"
      },
      {
        "text": "disability as set out in Atkins. But in In re Coleman, 768 F.3d 367 (5th Cir.",
        "paragraph_id": "para_225"
      },
      {
        "text": "2014), we found that § 2244(b)(1) bars the use of new facts to support the",
        "paragraph_id": "para_226"
      },
      {
        "text": "same legal claim. As we wrote, Coleman raised “essentially the same claim .",
        "paragraph_id": "para_227"
      },
      {
        "text": ". . albeit with additional affidavits, and thus her claim is barred as previously",
        "paragraph_id": "para_228"
      },
      {
        "text": "raised in under section 2244(b)(1).” Id. at 373. As did the petitioner in",
        "paragraph_id": "para_229"
      },
      {
        "text": "Coleman, Howard relies on new facts to satisfy old law. And as in Coleman,",
        "paragraph_id": "para_230"
      },
      {
        "text": "§ 2244(b)(1) bars consideration of Howard’s application.",
        "paragraph_id": "para_231"
      },
      {
        "text": "C.",
        "paragraph_id": "para_232"
      },
      {
        "text": "We need not address the issue of whether the new diagnostic stan-",
        "paragraph_id": "para_233"
      },
      {
        "text": "dards generated a new, retroactive, and previously unavailable rule of consti-",
        "paragraph_id": "para_234"
      },
      {
        "text": "tutional law. Howard’s prior presentation of an Atkins claim independently",
        "paragraph_id": "para_235"
      },
      {
        "text": "precludes consideration of the instant application.9",
        "paragraph_id": "para_236"
      },
      {
        "text": "V.",
        "paragraph_id": "para_237"
      },
      {
        "text": "Howard is not entitled to a stay of execution. He has no likelihood of",
        "paragraph_id": "para_238"
      },
      {
        "text": "success on the merits. His behavior weighs against this court’s granting him",
        "paragraph_id": "para_239"
      },
      {
        "text": "the equitable remedy of a stay. And the mere speculative possibility of a",
        "paragraph_id": "para_240"
      },
      {

        "text": "favorable Supreme Court ruling proves insufficient to warrant a stay.",
        "paragraph_id": "para_250",

      {
        "text": "To begin, this court has foreclosed stays premised on the fact that the",
        "paragraph_id": "para_251"
      },
      {
        "text": "Supreme Court granted certiorari. Howard’s argument to the contrary is",
        "paragraph_id": "para_252"
      },
      {
        "text": "unavailing. As this court repeatedly held, “[t]he Court’s grant of certiorari",
        "paragraph_id": "para_253"
      },
      {
        "text": "in a capital case does not allow us to deviate from circuit law, nor is it grounds",
        "paragraph_id": "para_254"
      },
      {
        "text": "for a stay of execution.”10",
        "paragraph_id": "para_255"
      },
      {
        "text": "But even if we apply the Nken factors for a discretionary stay,11 How-",
        "paragraph_id": "para_256"
      },
      {
        "text": "ard’s motion for a stay still fails. Howard has not demonstrated a likelihood",
        "paragraph_id": "para_257"
      },
      {
        "text": "of success on the merits. As aforementioned, his successive habeas petition",
        "paragraph_id": "para_258"
      },
      {
        "text": "is barred by the statute of limitations. And it is barred by the fact that it makes",
        "paragraph_id": "para_259"
      },
      {
        "text": "a previously presented claim.",
        "paragraph_id": "para_260"
      },
      {
        "text": "The state’s and the public’s interests also weigh against a stay. A stay",
        "paragraph_id": "para_261"
      },
      {
        "text": "“is not available as a matter of right, and equity must be sensitive to the",
        "paragraph_id": "para_262"
      },
      {
        "text": "State’s strong interest in enforcing its criminal judgments without undue",
        "paragraph_id": "para_263"
      },
      {
        "text": "interference from the federal courts.” Hill v. McDonough, 547 U.S. 573, 584",
        "paragraph_id": "para_264"
      },
      {
        "text": "(2006) (citation omitted). Indeed, “[b]oth the State and the victims of",
        "paragraph_id": "para_265"
      },
      {
        "text": "crimes have an important interest in the timely enforcement of a sentence.”",
        "paragraph_id": "para_266"
      },
      {
        "text": "Id.",

      },
      {
        "text": "And because a stay is an equitable remedy, see id., the equitable",
        "paragraph_id": "para_268"
      },
      {
        "text": "defenses of laches and unclean hands apply. As aforementioned, Howard",
