He filed a habeas petition in the Northern District of Texas challeng-","paragraph_id":"para_38"},{"text":"ing his continued detention and seeking an injunction against third-country","paragraph_id":"para_39"},{"text":"removal pending further litigation of his Convention Against Torture","paragraph_id":"para_40"},{"text":"claims. The district court denied all relief and declined to enter a stay of","paragraph_id":"para_41"},{"text":"removal. He moves for an emergency stay of removal pending appeal. We","paragraph_id":"para_42"},{"text":"deny his motion.","paragraph_id":"para_43"},{"text":"A stay pending appeal “is not a matter of right, even if irreparable","paragraph_id":"para_44"},{"text":"injury might otherwise result to the appellant.” Virginian Ry. Co. v. United","paragraph_id":"para_45"},{"text":"States, 272 U.S. 658, 672 (1926) (citing In re Haberman Mfg. Co., 147 U.S.","paragraph_id":"para_46"},{"text":"525, 530 (1893)). “We consider four factors in deciding whether to grant a","paragraph_id":"para_47"},{"text":"stay pending appeal: ‘(1) whether the stay applicant has made a strong show-","paragraph_id":"para_48"},{"text":"ing that he is likely to succeed on the merits; (2) whether the applicant will","paragraph_id":"para_49"},{"text":"be irreparably injured absent a stay; (3) whether issuance of the stay will","paragraph_id":"para_50"},{"text":"substantially injure the other parties interested in the proceeding; and","paragraph_id":"para_51"},{"text":"(4) where the public interest lies.’” Veasey v. Abbott, 870 F.3d 387, 391 (5th","paragraph_id":"para_52"},{"text":"Cir. 2017) (per curiam) (quoting Nken v. Holder, 556 U.S. 418, 425–26","paragraph_id":"para_53"},{"text":"(2009)). Because we determine that Gakou is deeply unlikely to prevail on","paragraph_id":"para_54"},{"text":"the merits of his claims, we do not consider any of the three remaining","paragraph_id":"para_55"},{"text":"factors.","paragraph_id":"para_56"},{"text":"Subject to limited enumerated exceptions, “no court shall have jur-","paragraph_id":"para_57"},{"text":"isdiction to hear any cause or claim by or on behalf of any alien arising from","paragraph_id":"para_58"},{"text":"the decision or action by the Attorney General to commence proceedings,","paragraph_id":"para_59"},{"text":"adjudicate cases, or execute removal orders against any alien under this chap-","paragraph_id":"para_60"},{"text":"ter.” 8 U.S.C. § 1252(g) (emphasis added). Additionally, courts are barred","paragraph_id":"para_61"},{"text":"from hearing “claims connected directly and immediately with” these mat-","paragraph_id":"para_62"},{"text":"ters. Humphries v. Various Fed. USINS Emps., 164 F.3d 936, 943 (5th Cir.","paragraph_id":"para_63"},{"text":"1999). “A request for stay of removal is a challenge to a removal order”","paragraph_id":"para_64"},{"text":"Case: 26-10925 Document: 31-2 Page: 2 Date Filed: 10/10/2026","paragraph_id":"para_65"},{"text":"No. 26-10925","paragraph_id":"para_66"},{"text":"3","paragraph_id":"para_67"},{"text":"within the ambit of § 1252(g)’s jurisdiction-stripping effect. Imran v. Harper,","paragraph_id":"para_68","court_paragraph":3},{"text":"No. 25-30370, 2026 WL 93131, at *1 (5th Cir. Jan. 13, 2026) (per curiam)","paragraph_id":"para_69"},{"text":"(unpublished) (citing In re Asemani, No. 25-1513, 2025 WL 1823953, at *1","paragraph_id":"para_70"},{"text":"(4th Cir. July 2, 2025) (per curiam)). Therefore, we lack the power to","paragraph_id":"para_71"},{"text":"entertain Gakou’s motion. Cf. Fabuluje v. Immigration & Naturalization","paragraph_id":"para_72"},{"text":"Agency, 244 F.3d 133, 133 (5th Cir. 2000) (unpublished) (table) (holding that","paragraph_id":"para_73"},{"text":"courts are without jurisdiction to grant stays of removal under § 1252(g));","paragraph_id":"para_74"},{"text":"Idokogi v. Ashcroft, 66 F. App’x 526, 526 (5th Cir. 2003) (same).","paragraph_id":"para_75"},{"text":"Separately, the Supreme Court has effectively ratified third-country","paragraph_id":"para_76"},{"text":"removal of the sort that Gakou faces when it granted certiorari in a case","paragraph_id":"para_77"},{"text":"raising the issue while still explicitly permitting the government to continue","paragraph_id":"para_78"},{"text":"with third-country removals unabated pending full resolution on the","paragraph_id":"para_79"},{"text":"merits. See DHS v. D.V.D., Nos. 26-426, 26A406 (U.S. Sept. 29, 2026) (per","paragraph_id":"para_80"},{"text":"curiam). As a result, Gakou’s claim to an injunction against his removal to a","paragraph_id":"para_81"},{"text":"country besides Senegal is unavailing and cannot be used to support the stay","paragraph_id":"para_82"},{"text":"he currently seeks.","paragraph_id":"para_83"},{"text":"Because Gakou has not demonstrated any meaningful probability of","paragraph_id":"para_84"},{"text":"success on the merits, he is not entitled to a stay. The emergency motion for","paragraph_id":"para_85"},{"text":"a stay pending appeal is DENIED.","paragraph_id":"para_86"},{"text":"Therefore, IT IS ORDERED that Gakou’s opposed motion for an","paragraph_id":"para_87"},{"text":"administrative stay prohibiting respondents from removing him from the","paragraph_id":"para_88"},{"text":"United States while this court considers this emergency motion is","paragraph_id":"para_89"},{"text":"DENIED.
