        "text": "Byrd. Burns’ office door was open, and he had the phone on speaker.",

        "text": "Crawford began recording the conversation, believing it to be proof of",
        "paragraph_id": "para_38"
      },
      {
        "text": "retaliation, and walked towards the area near Burns’ office. He then reported",
        "paragraph_id": "para_39"
      },
      {
        "text": "this conversation and the recording.",
        "paragraph_id": "para_40"
      },
      {
        "text": "Burns suspended Crawford for recording the conversation and",
        "paragraph_id": "para_41"
      },
      {
        "text": "initiated an investigation conducted by police chiefs from other system",
        "paragraph_id": "para_42"
      },
      {
        "text": "schools. They recommended Crawford be fired and dishonorably discharged",
        "paragraph_id": "para_43"
      },
      {
        "text": "from his peace officer’s license. Burns agreed and issued the dishonorable",
        "paragraph_id": "para_44"
      },
      {
        "text": "discharge, but Crawford quit before he could be fired. He then filed a",
        "paragraph_id": "para_45"
      },
      {
        "text": "complaint with the Equal Employment Opportunity Commission (EEOC)",
        "paragraph_id": "para_46"
      },
      {
        "text": "which issued him a right to sue letter.",
        "paragraph_id": "para_47"
      },
      {
        "text": "Crawford sued for retaliation under Title VII. The district court",
        "paragraph_id": "para_48"
      },
      {
        "text": "concluded that he could not establish a prima facie case and granted",
        "paragraph_id": "para_49"
      },
      {
        "text": "WTAMU summary judgment. Crawford appealed. We REVERSE.",
        "paragraph_id": "para_50"
      },
      {
        "text": "I. Background",
        "paragraph_id": "para_51"
      },
      {
        "text": "Crawford began working as a WTAMU police officer in 2015. He was",
        "paragraph_id": "para_52"
      },
      {
        "text": "generally considered a good officer. In August 2021, officer Allison Munsell",
        "paragraph_id": "para_53"
      },
      {
        "text": "told Crawford that sergeant Aaron Price had engaged in sexual misconduct,",
        "paragraph_id": "para_54"
      },
      {
        "text": "and he told her that he had to report it to the Title IX office. However, she",
        "paragraph_id": "para_55"
      },
      {
        "text": "initiated a Title IX complaint against Price herself in which several female",
        "paragraph_id": "para_56"
      },
      {
        "text": "officers filed complaints against him. Crawford thus believed he had no",
        "paragraph_id": "para_57"
      },
      {
        "text": "independent reporting responsibility but participated in the initial",
        "paragraph_id": "para_58"
      },
      {
        "text": "investigation and corroborated the allegations. However, he was concerned",
        "paragraph_id": "para_59"
      },
      {
        "text": "about possible retaliation because Price was perceived to be close to Burns.",
        "paragraph_id": "para_60"
      },
      {
        "text": "In response to earlier workplace concerns, Burns told officers that if they",
        "paragraph_id": "para_61"
      },
      {

        "text": "continued to make complaints, “careers and bodies would be left in the",
        "paragraph_id": "para_65"
      },
      {
        "text": "wake.”",
        "paragraph_id": "para_66"
      },
      {
        "text": "As the Price investigation continued, Burns vented his frustration",
        "paragraph_id": "para_67"
      },
      {
        "text": "with the number of complainants and the amount of time it was costing him.",
        "paragraph_id": "para_68"
      },
      {
        "text": "He told officers that he “was ready to start stacking bodies,” and clarified",
        "paragraph_id": "para_69"
      },
      {
        "text": "that he meant “firing people that need to be fired.” In the same recording,",
        "paragraph_id": "para_70"
      },
      {
        "text": "he complained that Crawford failed to report Title IX violations and said that",
        "paragraph_id": "para_71"
      },
      {
        "text": "all the officers that failed to do so initially, but took part in the investigation,",
        "paragraph_id": "para_72"
      },
      {
        "text": "should be punished. He also told lieutenant Barbara Ferrara that he would",
        "paragraph_id": "para_73"
      },
      {
        "text": "have fired her if he thought she had made a complaint.",
        "paragraph_id": "para_74"
      },
      {
        "text": "In the aftermath of Crawford participating in the Price investigation,",
        "paragraph_id": "para_75"
      },
      {
        "text": "he was accused of violating quarantine procedures, which he believed to be",
        "paragraph_id": "para_76"
      },
      {
        "text": "retaliatory. Also, lieutenant Kyle Hawbaker and sergeant Brandon Johnson",
        "paragraph_id": "para_77"
      },
      {
        "text": "“made sweeping changes to [his] daily work routine” at the behest of Burns.",
        "paragraph_id": "para_78"
      },
      {
        "text": "Crawford later spoke with Hawbaker about a possible promotion to sergeant,",
        "paragraph_id": "para_79"
      },
      {
        "text": "but Hawbaker told him that after speaking with Burns, he “had no chance of",
        "paragraph_id": "para_80"
      },
      {
        "text": "making sergeant because [he] was ‘lumped in with the others’ from the",
        "paragraph_id": "para_81"
      },
      {
        "text": "Aaron Price TIX investigation.” The Title IX investigator, Georganna",
        "paragraph_id": "para_82"
      },
      {
        "text": "Ecker, was fired shortly after the Price investigation and testified that Burns",
        "paragraph_id": "para_83"
      },
      {
        "text": "had significant influence over WTAMU leadership.",
        "paragraph_id": "para_84"
      },
      {
        "text": "In the aftermath of the Price investigation, Burns filed an internal",
        "paragraph_id": "para_85"
      },
      {
        "text": "complaint against Crawford for failing to report the sexual harassment",
        "paragraph_id": "para_86"
      },
      {
        "text": "against Munsell. Crawford then filed an internal complaint against Burns,",
        "paragraph_id": "para_87"
      },
      {
        "text": "alleging that Burns’ complaint was only in retaliation for Crawford taking",
        "paragraph_id": "para_88"
      },
      {
        "text": "part in the initial investigation. Crawford was disciplined for failure to report.",
        "paragraph_id": "para_89"
      },
      {
        "text": "The new Title IX director, Jeremie Middleton, had a meeting with",
        "paragraph_id": "para_90"
      },
      {
        "text": "Crawford that Crawford recorded. He shared his concerns about retaliation",
        "paragraph_id": "para_91"
      },
      {

        "text": "and advised Crawford to find another job if possible. Shortly thereafter,",
        "paragraph_id": "para_95"
      },
      {
        "text": "Middleton was also fired.",
        "paragraph_id": "para_96"
      },
      {
        "text": "One day, Crawford was sitting at his desk when he heard Burns in his",
        "paragraph_id": "para_97"
      },
      {
        "text": "office on the phone with Byrd discussing his failure to report. The office door",
        "paragraph_id": "para_98"
      },
      {
        "text": "was open, and Burns had the call on speakerphone. Crawford heard the",
        "paragraph_id": "para_99"
      },
      {
        "text": "conversation from his desk and went to stand outside Burns’ door to record",
        "paragraph_id": "para_100"
      },
      {
        "text": "the conversation. He emailed the recording to the System Ethics and",
        "paragraph_id": "para_101"
      },
      {
        "text": "Compliance Office stating that he made the recording from his desk.",
        "paragraph_id": "para_102"
      },
      {
        "text": "Byrd began an investigation into whether Crawford had broken the law",
        "paragraph_id": "para_103"
      },
      {
        "text": "by recording a private conversation and whether he had lied about it.",
        "paragraph_id": "para_104"
      },
      {
        "text": "Crawford also initiated an investigation into whether Byrd’s investigation",
        "paragraph_id": "para_105"
      },
      {
        "text": "was retaliatory. Byrd subsequently retired and was replaced by Hawbaker.",
        "paragraph_id": "para_106"
      },
      {
        "text": "Burns recused himself from the Byrd investigation, assigned that",
        "paragraph_id": "para_107"
      },
      {
        "text": "investigation to Hawbaker, and asked the WTAMU System Administrators",
        "paragraph_id": "para_108"
      },
      {
        "text": "to appoint an independent panel, which directed Bryan Vaughn and Matt",
        "paragraph_id": "para_109"
      },
      {
        "text": "Welch to lead the investigation into Crawford’s recording of Burns’ call with",
        "paragraph_id": "para_110"
      },
      {
        "text": "Byrd.",
        "paragraph_id": "para_111"
      },
      {
        "text": "Vaughn and Welch reviewed the Byrd investigation, conducted an",
        "paragraph_id": "para_112"
      },
      {
        "text": "independent inquiry, and then recommended that Crawford be fired and",
        "paragraph_id": "para_113"
      },
      {
        "text": "receive a dishonorable discharge. Crawford resigned before he could be fired",
        "paragraph_id": "para_114"
      },
      {
        "text": "but still received a dishonorable discharge.1 The investigation into whether",
        "paragraph_id": "para_115"
      },
      {
        "text": "Burns retaliated against Crawford cleared Burns of wrongdoing.",
        "paragraph_id": "para_116"
      },
      {
        "text": "Crawford filed a charge of discrimination with the EEOC, which",
        "paragraph_id": "para_117"
      },
      {
        "text": "issued him a right to sue letter. He sued WTAMU, but the district court",
        "paragraph_id": "para_118"
      },
      {
        "text": "granted WTAMU’s motion for summary judgment. It concluded that he",
        "paragraph_id": "para_119"
      },
      {
        "text": "_____________________",

        "text": "failed to show that he had suffered an adverse employment action or a causal",
        "paragraph_id": "para_126"
      },
      {
        "text": "link and so could not establish a prima facie case.",
        "paragraph_id": "para_127"
      },
      {
        "text": "II. Standard of Review",
        "paragraph_id": "para_128"
      },
      {
        "text": "Courts “shall grant summary judgment if the movant shows that there",
        "paragraph_id": "para_129"
      },
      {
        "text": "is no genuine dispute as to any material fact and the movant is entitled to",
        "paragraph_id": "para_130"
      },
      {
        "text": "judgment as a matter of law.” Fed. R. Civ. P. 56(a). We review denials of",
        "paragraph_id": "para_131"
      },
      {
        "text": "summary judgment de novo. Solano v. Gulf King 55, 212 F.3d 902, 905 (5th",
        "paragraph_id": "para_132"
      },
      {
        "text": "Cir. 2000). And we view the record in the light most favorable to the non-",
        "paragraph_id": "para_133"
      },
      {
        "text": "moving party and draw all reasonable inferences in its favor. Carmona v. Sw.",
        "paragraph_id": "para_134"
      },
      {
        "text": "Airlines Co., 604 F.3d 848, 854 (5th Cir. 2010).",
        "paragraph_id": "para_135"
      },
      {
        "text": "III. Analysis",
        "paragraph_id": "para_136"
      },
      {
        "text": "A. Direct Versus Circumstantial Evidence",
        "paragraph_id": "para_137"
      },
      {
        "text": "A plaintiff in an employment retaliation case may prevail by showing",
        "paragraph_id": "para_138"
      },
      {
        "text": "either direct or circumstantial evidence. See Sandstad v. CB Richard Ellis,",
        "paragraph_id": "para_139"
      },
      {
        "text": "Inc., 309 F.3d 893, 896 (5th Cir. 2002). If a plaintiff relies only on",
        "paragraph_id": "para_140"
      },
      {
        "text": "circumstantial evidence, the McDonnell Douglas test applies. See id.",
        "paragraph_id": "para_141"
      },
      {
        "text": "Direct evidence is “evidence which, if believed, proves the fact in",
        "paragraph_id": "para_142"
      },
      {
        "text": "question without inference or presumption.” Fabela v. Socorro Indep. Sch.",
        "paragraph_id": "para_143"
      },
      {
        "text": "Dist., 329 F.3d 409, 415 (5th Cir. 2003) (citation modified), overruled in part",
        "paragraph_id": "para_144"
      },
      {
        "text": "on other grounds, Smith v. Xerox Corp., 602 F.3d 320, 330 (5th Cir. 2010); see",
        "paragraph_id": "para_145"
      },
      {
        "text": "Liedtke v. City of Austin, -- F.4th --, No. 25-50717, 2026 WL 2225275, at *17",
        "paragraph_id": "para_146"
      },
      {
        "text": "(5th Cir. Aug. 3, 2026). All the evidence that Crawford points to still requires",
        "paragraph_id": "para_147"
      },
      {
        "text": "some inference that WTAMU investigators’ retaliatory animus was applied",
        "paragraph_id": "para_148"
      },
      {
        "text": "to him or that the adverse employment actions were taken as a result of his",
        "paragraph_id": "para_149"
      },
      {
        "text": "protected activity. Thus, he has not succeeded on a direct evidence theory",
        "paragraph_id": "para_150"
      },
      {
        "text": "and must proceed under the McDonnell Douglas test.",
        "paragraph_id": "para_151"
      },
      {
        "text": "B. Prima Facie Case",
        "paragraph_id": "para_152"
      },
      {

        "text": "To establish a Title VII retaliation claim, a plaintiff must show that (1)",
        "paragraph_id": "para_156"
      },
      {
        "text": "he engaged in a protected activity, (2) the employer took an adverse",
        "paragraph_id": "para_157"
      },
      {
        "text": "employment action, and “(3) a causal link exists between the protected",
        "paragraph_id": "para_158"
      },
      {
        "text": "activity and the adverse employment action.” Haire v. Bd. of Supervisors of",
        "paragraph_id": "para_159"
      },
      {
        "text": "La. State Univ. Agric. & Mech. Coll., 719 F.3d 356, 367 (5th Cir. 2013). If a",
        "paragraph_id": "para_160"
      },
      {
        "text": "plaintiff meets this burden, it shifts to the employer to “articulate a legitimate",
        "paragraph_id": "para_161"
      },
      {
        "text": ". . . non-retaliatory reason for its employment action.” Aryain v. Wal-Mart",
        "paragraph_id": "para_162"
      },
      {
        "text": "Stores Tex. LP, 534 F.3d 473, 484 (5th Cir. 2008) (alteration in original)",
        "paragraph_id": "para_163"
      },
      {
        "text": "(quoting McCoy v. City of Shreveport, 492 F.3d 551, 557 (5th Cir. 2007),",
        "paragraph_id": "para_164"
      },
      {
        "text": "overruled in part on other grounds by Hamilton v. Dallas Cnty., 79 F.4th 494",
        "paragraph_id": "para_165"
      },
      {
        "text": "(5th Cir. 2023)). Then, a plaintiff must demonstrate that the reason offered",
        "paragraph_id": "para_166"
      },
      {
        "text": "was pretextual. Id.",
        "paragraph_id": "para_167"
      },
      {
        "text": "1. Protected Activity",
        "paragraph_id": "para_168"
      },
      {
        "text": "Both parties agree that participating in a sexual misconduct",
        "paragraph_id": "para_169"
      },
      {
        "text": "investigation is a protected activity. Hockman v. Westward Commc’ns, LLC,",
        "paragraph_id": "para_170"
      },
      {
        "text": "407 F.3d 317, 330 (5th Cir. 2004).",
        "paragraph_id": "para_171"
      },
      {
        "text": "2. Adverse Employment Action",
        "paragraph_id": "para_172"
      },
      {
        "text": "Crawford complains of multiple instances of retaliation, but can only",
        "paragraph_id": "para_173"
      },
      {
        "text": "recover based on acts that happened within 300 days of filing a charge of",
        "paragraph_id": "para_174"
      },
      {
        "text": "discrimination with the EEOC. Ikossi-Anastasiou v. Bd. of Supervisors of La.",
        "paragraph_id": "para_175"
      },
      {
        "text": "State Univ., 579 F.3d 546, 549 (5th Cir. 2009).",
        "paragraph_id": "para_176"
      },
      {
        "text": "Crawford points to three adverse employment actions that occurred",
        "paragraph_id": "para_177"
      },
      {
        "text": "within 300 days of his EEOC charge: his placement on paid administrative",
        "paragraph_id": "para_178"
      },
      {
        "text": "leave, the investigation into his recording of Burns’ conversation with Byrd,",
        "paragraph_id": "para_179"
      },
      {
        "text": "and his dishonorable discharge. The dishonorable discharge was certainly an",
        "paragraph_id": "para_180"
      },
      {

        "text": "adverse employment action though the parties dispute whether it is properly",
        "paragraph_id": "para_184"
      },
      {
        "text": "before the court. We assume, without deciding, that it is.2",
        "paragraph_id": "para_185"
      },
      {
        "text": "An employment action is adverse if “it well might have dissuaded a",
        "paragraph_id": "para_186"
      },
      {
        "text": "reasonable worker from making or supporting a charge of discrimination.”",
        "paragraph_id": "para_187"
      },
      {
        "text": "Burlington N. & Santa Fe Ry. Co. v. White, 548 U.S. 53, 68 (2006) (quotation",
        "paragraph_id": "para_188"
      },
      {
        "text": "omitted) (quoting Rochon v. Gonzales, 438 F.3d 1211, 1219 (D.C. Cir.",
        "paragraph_id": "para_189"
      },
      {
        "text": "2006)). In that case, the Court explicitly rejected the “ultimate decision",
        "paragraph_id": "para_190"
      },
      {
        "text": "test” employed by the Fifth Circuit. Id. at 67.",

        "text": "Thus, the district court’s analysis was flawed.",
        "paragraph_id": "para_197"
      },
      {
        "text": "Whether the phone recording investigation and suspension are",
        "paragraph_id": "para_198"
      },
      {
        "text": "adverse employment actions is a closer call. After all, “[t]he purpose of this",
        "paragraph_id": "para_199"
      },
      {
        "text": "objective standard is to separate significant from trivial harms and filter out",
        "paragraph_id": "para_200"
      },
      {
        "text": "complaints attacking the ordinary tribulations of the workplace,” including",
        "paragraph_id": "para_201"
      },
      {
        "text": "mere “petty slights.” Stewart v. Miss. Transp. Comm’n, 586 F.3d 321, 331–32",
        "paragraph_id": "para_202"
      },
      {
        "text": "(5th Cir. 2009) (citation modified).",

      },
      {

        "text": "But our precedents make clear that “[p]lacing an employee on paid",
        "paragraph_id": "para_217"
      },
      {
        "text": "administrative leave, however, cannot be said to be a ‘petty slight.’ Indeed,",
        "paragraph_id": "para_218"
      },
      {
        "text": "depending on the circumstances, it may range from a completely benign",
        "paragraph_id": "para_219"
      },
      {
        "text": "measure to one that stigmatizes an employee and causes significant emotional",
        "paragraph_id": "para_220"
      },
      {
        "text": "distress.” Id. at 332. “Forced leave may even affect an employee’s",
        "paragraph_id": "para_221"
      },
      {
        "text": "opportunities for future advancement.” Id. Critically, a court must consider",
        "paragraph_id": "para_222"
      },
      {
        "text": "the context of the forced leave. Id. (citing Burlington N. & Santa Fe Ry. Co.,",
        "paragraph_id": "para_223"
      },
      {
        "text": "548 U.S. at 69).",
        "paragraph_id": "para_224"
      },
      {
        "text": "Whether being placed on leave pending investigation is adverse is",
        "paragraph_id": "para_225"
      },
      {
        "text": "ultimately a context-specific question. But since Crawford was undoubtedly",
        "paragraph_id": "para_226"
      },
      {
        "text": "put on leave for disciplinary reasons, a jury could conclude that he suffered",
        "paragraph_id": "para_227"
      },
      {
        "text": "an adverse employment action.",
        "paragraph_id": "para_228"
      },
      {
        "text": "In Stewart, the court determined that the plaintiff did not suffer an",
        "paragraph_id": "para_229"
      },
      {
        "text": "adverse employment action because she was not placed on leave pending an",
        "paragraph_id": "para_230"
      },
      {
        "text": "investigation and there was no disciplinary dimension to the leave. See id.",
        "paragraph_id": "para_231"
      },
      {
        "text": "Here, the opposite is true. And being put on administrative leave pending an",
        "paragraph_id": "para_232"
      },
      {
        "text": "investigation would “effect[] a ‘diminution in prestige or change in standing",
        "paragraph_id": "para_233"
      },
      {
        "text": "among . . . co-workers.’” Hudson v. Lincare, Inc., 58 F.4th 222, 231 (5th Cir.",
        "paragraph_id": "para_234"
      },
      {
        "text": "2023) (alteration in original) (quoting Stewart, 586 F.3d at 332). Thus, the",
        "paragraph_id": "para_235"
      },
      {
        "text": "suspension along with the phone recording investigation is a sufficiently",
        "paragraph_id": "para_236"
      },
      {
        "text": "adverse employment action to satisfy a prima facie case. Cf. id. at 231–32",
        "paragraph_id": "para_237"
      },
      {
        "text": "(finding no adverse employment action when plaintiff was only put on a",
        "paragraph_id": "para_238"
      },
      {
        "text": "“formal action plan” to improve performance).",
        "paragraph_id": "para_239"
      },
      {
        "text": "3. Causal Link",
        "paragraph_id": "para_240"
      },
      {
        "text": "Next, Crawford must show a causal link between his protected activity",
        "paragraph_id": "para_241"
      },
      {
        "text": "and the adverse employment action. But a plaintiff is not required to show",
        "paragraph_id": "para_242"
      },
      {
        "text": "that the protected activity was a but-for cause of the termination at this stage.",
        "paragraph_id": "para_243"
      },
      {
        "text": "Garcia v. Pro. Cont. Servs., Inc., 938 F.3d 236, 242 (5th Cir. 2019). When the",

        "text": "adverse action was taken shortly after protected activity, particularly within",
        "paragraph_id": "para_248"
      },
      {
        "text": "three months, that by itself can establish causation. Id. at 243.",
        "paragraph_id": "para_249"
      },
      {
        "text": "The parties dispute when Crawford engaged in protected activity.",
        "paragraph_id": "para_250"
      },
      {
        "text": "Crawford seems to posit that it happened in August 2022 when Burns first",
        "paragraph_id": "para_251"
      },
      {
        "text": "reviewed the Title IX report naming Crawford as a witness. WTAMU",
        "paragraph_id": "para_252"
      },
      {
        "text": "argues that it was when he initially provided testimony in August 2021. As a",
        "paragraph_id": "para_253"
      },
      {
        "text": "general rule, “[a]n employee has engaged in activity protected by Title VII if",
        "paragraph_id": "para_254"
      },
      {
        "text": "she has either (1) ‘opposed any practice made an unlawful employment",
        "paragraph_id": "para_255"
      },
      {
        "text": "practice’ by Title VII or (2) ‘made a charge, testified, assisted, or participated",
        "paragraph_id": "para_256"
      },
      {
        "text": "in any manner in an investigation, proceeding, or hearing’ under Title VII.”",
        "paragraph_id": "para_257"
      },
      {
        "text": "Grimes v. Tex. Dep’t of Mental Health & Mental Retardation, 102 F.3d 137, 140",
        "paragraph_id": "para_258"
      },
      {
        "text": "(5th Cir. 1996) (quoting 42 U.S.C. § 2000e–3(a)).",
        "paragraph_id": "para_259"
      },
      {
        "text": "The record indicates that Burns knew that Crawford had given",
        "paragraph_id": "para_260"
      },
      {
        "text": "testimony months earlier than August 2022. Crawford alleges various acts of",
        "paragraph_id": "para_261"
      },
      {
        "text": "retaliation that took place shortly after his testimony, including being accused",
        "paragraph_id": "para_262"
      },
      {
        "text": "of failing to follow quarantine procedures and receiving “sweeping changes",
        "paragraph_id": "para_263"
      },
      {
        "text": "to [his] daily work routine that . . . were coming from Shawn Burns.”",
        "paragraph_id": "para_264"
      },
      {
        "text": "Hawbaker even told him in July 2022 that, after speaking to Burns, Crawford",
        "paragraph_id": "para_265"
      },
      {
        "text": "“had no chance of making sergeant because [he] was ‘lumped in with the",
        "paragraph_id": "para_266"
      },
      {
        "text": "others’ from the Aaron Price TIX investigation.” So, timing alone is not",
        "paragraph_id": "para_267"
      },
      {
        "text": "enough to establish causation.",
        "paragraph_id": "para_268"
      },
      {
        "text": "“But this court has also held that an employee can establish a causal",
        "paragraph_id": "para_269"
      },
      {
        "text": "link at the prima facie stage when evidence demonstrates that the adverse",
        "paragraph_id": "para_270"
      },
      {
        "text": "action was based in part on knowledge of the employee’s protected activity.”",
        "paragraph_id": "para_271"
      },
      {
        "text": "Saketkoo v. Adm’rs of Tulane Educ. Fund, 31 F.4th 990, 1001 (5th Cir. 2022)",
        "paragraph_id": "para_272"
      },
      {
        "text": "(citation modified). Thus, when a manager takes an adverse employment",
        "paragraph_id": "para_273"
      },
      {
        "text": "action but “ha[s] knowledge about his protected activity,” the causal link",
        "paragraph_id": "para_274"
      },
      {
        "text": "requirement is met “because the evidence demonstrate[s] that the manager’s",
        "paragraph_id": "para_275"
      },
      {

        "text": "knowledge” is at least partially related to the adverse action. Id. (citing",
        "paragraph_id": "para_279"
      },
      {
        "text": "Medina v. Ramsey Steel Co., 238 F.3d 674, 684 (5th Cir. 2001)).",
        "paragraph_id": "para_280"
      },
      {
        "text": "There is ample evidence to satisfy the causation element regarding the",
        "paragraph_id": "para_281"
      },
      {
        "text": "suspension and investigation. See id. at 1001–02 (noting that plaintiff had met",
        "paragraph_id": "para_282"
      },
      {
        "text": "causation element to make a prima facie case but concluding that plaintiff",
        "paragraph_id": "para_283"
      },
      {
        "text": "failed to create a genuine dispute of material fact at the pretext stage). Burns",
        "paragraph_id": "para_284"
      },
      {
        "text": "knew about Crawford’s involvement in the Title IX investigation and",
        "paragraph_id": "para_285"
      },
      {
        "text": "resented it. And a jury could conclude that he admitted that he would try to",
        "paragraph_id": "para_286"
      },
      {
        "text": "get rid of those involved in it. Though WTAMU argues that the",
        "paragraph_id": "para_287"
      },
      {
        "text": "independent panel made the disciplinary decisions and so Burns did not",
        "paragraph_id": "para_288"
      },
      {
        "text": "cause any adverse employment action, it was Burns who made the decision",
        "paragraph_id": "para_289"
      },
      {
        "text": "to suspend Crawford and launch the investigation. So, this likely clears the",
        "paragraph_id": "para_290"
      },
      {
        "text": "bar for the causal link in a prima facie case as to the suspension and",
        "paragraph_id": "para_291"
      },
      {
        "text": "investigation.",
        "paragraph_id": "para_292"
      },
      {
        "text": "However, Crawford cannot show causation for the dishonorable",
        "paragraph_id": "para_293"
      },
      {
        "text": "discharge because the recommendation was made by the independent",
        "paragraph_id": "para_294"
      },
      {
        "text": "investigative panel who, in sworn statements, stated that they did not know",
        "paragraph_id": "para_295"
      },
      {
        "text": "about his involvement in the Title IX investigation. Crawford has offered no",
        "paragraph_id": "para_296"
      },
      {
        "text": "evidence to rebut this.",
        "paragraph_id": "para_297"
      },
      {
        "text": "Ordinarily, a plaintiff can show a causal link when the ultimate",
        "paragraph_id": "para_298"
      },
      {
        "text": "decision was made by a supervisor with no retaliatory motive if the process",
        "paragraph_id": "para_299"
      },
      {
        "text": "was tainted by an intermediate supervisor with a retaliatory motive. Long v.",
        "paragraph_id": "para_300"
      },
      {
        "text": "Eastfield Coll., 88 F.3d 300, 307 (5th Cir. 1996). Conversely, the causal chain",
        "paragraph_id": "para_301"
      },
      {
        "text": "is broken when the ultimate decisionmaker was also the independent",
        "paragraph_id": "para_302"
      },
      {
        "text": "investigator. Id. This case, where Burns was the ultimate decisionmaker and",
        "paragraph_id": "para_303"
      },
      {
        "text": "had a retaliatory motive, but he relied and acted on the results of an",
        "paragraph_id": "para_304"
      },
      {
        "text": "independent investigation, presents a new scenario.",
        "paragraph_id": "para_305"
      },
      {

        "text": "While this is slightly different than cases in the past, we conclude that",
        "paragraph_id": "para_309"
      },
      {
        "text": "it breaks the causal chain. The ultimate decision was made by Burns but he",
        "paragraph_id": "para_310"
      },
      {
        "text": "followed the recommendations of an independent board. Crawford argues at",
        "paragraph_id": "para_311"
      },
      {
        "text": "length that the decision was flawed because Burns called for the investigation,",
        "paragraph_id": "para_312"
      },
      {
        "text": "the involvement of Hawbaker, and that the investigation only focused on",
        "paragraph_id": "para_313"
      },
      {
        "text": "Crawford’s actions, not on Burns’ alleged retaliation. The involvement of",
        "paragraph_id": "para_314"
      },
      {
        "text": "Hawbaker is potentially problematic because he knew about the protected",
        "paragraph_id": "para_315"
      },
      {
        "text": "activity, but Crawford generally offers no evidence, merely accusations, that",
        "paragraph_id": "para_316"
      },
      {
        "text": "the panel members were biased against him. And the investigation was",
        "paragraph_id": "para_317"
      },
      {
        "text": "opened into his recording of Burns, not into Burns himself, so it is",
        "paragraph_id": "para_318"
      },
      {
        "text": "unreasonable to expect the panel to investigate beyond their remit.",
        "paragraph_id": "para_319"
      },
      {
        "text": "Turning to the investigation itself, both panel members, Welch and",
        "paragraph_id": "para_320"
      },
      {
        "text": "Vaughn, testified that they reviewed the Internal Affairs report, watched",
        "paragraph_id": "para_321"
      },
      {
        "text": "security camera footage, and investigated the allegations. This demonstrates",
        "paragraph_id": "para_322"
      },
      {
        "text": "that they “did not merely ‘rubber stamp’ the recommendation . . . [from",
        "paragraph_id": "para_323"
      },
      {
        "text": "Hawbaker], but conducted an independent investigation into the",
        "paragraph_id": "para_324"
      },
      {
        "text": "circumstances surrounding” the complaint. Sherrod v. Am. Airlines, Inc., 132",
        "paragraph_id": "para_325"
      },
      {
        "text": "F.3d 1112, 1122 (5th Cir. 1998). Critically, Crawford does not argue anything",
        "paragraph_id": "para_326"
      },
      {
        "text": "in their report was false.",
        "paragraph_id": "para_327"
      },
      {
        "text": "So, since Burns relied on an independent investigation, Crawford has",
        "paragraph_id": "para_328"
      },
      {
        "text": "failed to show a prima facie case as to the dishonorable discharge. But he has",
        "paragraph_id": "para_329"
      },
      {
        "text": "established a prima facie case as to the suspension and phone recording",
        "paragraph_id": "para_330"
      },
      {
        "text": "investigation.",
        "paragraph_id": "para_331"
      },
      {
        "text": "C. Legitimate Non-Retaliatory Reason",
        "paragraph_id": "para_332"
      },
      {
        "text": "After a plaintiff shows a prima facie case, an employer must show a",
        "paragraph_id": "para_333"
      },
      {
        "text": "legitimate, non-retaliatory reason for the alleged adverse action. But this is",
        "paragraph_id": "para_334"
      },
      {
        "text": "only a burden of production, so WTAMU easily meets it here. Russell v.",
        "paragraph_id": "para_335"
      },
      {
        "text": "McKinney Hosp. Venture, 235 F.3d 219, 222 (5th Cir. 2000). Crawford at least",
        "paragraph_id": "para_336"
      },
      {

        "text": "potentially broke the law by secretly recording Burns’ conversation and lying",
        "paragraph_id": "para_340"
      },
      {
        "text": "about how he recorded it. And while Crawford has a legitimate argument that",
        "paragraph_id": "para_341"
      },
      {
        "text": "Burns had no reasonable expectation of privacy because the door was open,",
        "paragraph_id": "para_342"
      },
      {
        "text": "we also agree with WTAMU that Crawford at least possibly lied about the",
        "paragraph_id": "para_343"
      },
      {
        "text": "recording.4 So, WTAMU has met its burden.",
        "paragraph_id": "para_344"
      },
      {
        "text": "D. Pretext",
        "paragraph_id": "para_345"
      },
      {
        "text": "Finally, Crawford must show that WTAMU’s non-retaliatory",
        "paragraph_id": "para_346"
      },
      {
        "text": "reasoning is pretextual. To meet this standard, Crawford must show a",
        "paragraph_id": "para_347"
      },
      {
        "text": "genuine dispute of material fact exists that the protected activity was the but-",
        "paragraph_id": "para_348"
      },
      {
        "text": "for cause of the adverse employment action. Univ. of Tex. Sw. Med. Ctr. v.",
        "paragraph_id": "para_349"
      },
      {
        "text": "Nassar, 570 U.S. 338, 360 (2013). This “requires a plaintiff to produce",
        "paragraph_id": "para_350"
      },
      {
        "text": "substantial evidence indicating that the proffered legitimate",
        "paragraph_id": "para_351"
      },
      {
        "text": "nondiscriminatory reason is a pretext.” Smith v. Bd. of Supervisors of S. Univ.,",
        "paragraph_id": "para_352"
      },
      {
        "text": "656 F. App’x 30, 33 (5th Cir. 2016) (per curiam). This can be done “where",
        "paragraph_id": "para_353"
      },
      {
        "text": "an employer has provided inconsistent or conflicting explanations for its",
        "paragraph_id": "para_354"
      },
      {
        "text": "conduct,” and courts should consider “numerous factors, including the",
        "paragraph_id": "para_355"
      },
      {
        "text": "strength of the plaintiff's prima facie case, the probative value of the proof",
        "paragraph_id": "para_356"
      },
      {
        "text": "that the employer’s explanation is false, and any other evidence that supports",
        "paragraph_id": "para_357"
      },
      {
        "text": "the employer’s case.” Alkhawaldeh v. Dow Chem. Co., 851 F.3d 422, 428 (5th",
        "paragraph_id": "para_358"
      },
      {
        "text": "Cir. 2017) (citation modified).",
        "paragraph_id": "para_359"
      },
      {
        "text": "There is a genuine dispute of material fact regarding whether Burns’",
        "paragraph_id": "para_360"
      },
      {
        "text": "rationale was pretextual. While we agree with WTAMU that a jury could",
        "paragraph_id": "para_361"
      },
      {
        "text": "believe that Burns initiated the investigation and suspension into Crawford",
        "paragraph_id": "para_362"
      },
      {
        "text": "_____________________",
        "paragraph_id": "para_363"
      },
      {
        "text": "4 Crawford argues that a jury could infer that, when he said that he recorded the",
        "paragraph_id": "para_364"
      },
      {
        "text": "audio from his desk, he meant he began recording it from his desk and moved closer.",
        "paragraph_id": "para_365"
      },
      {
        "text": "However, he stated in his email that he recorded the conversation from his desk which was,",
        "paragraph_id": "para_366"
      },
      {
        "text": "at the very least, not the whole truth.",
        "paragraph_id": "para_367"
      },
      {

        "text": "solely based on his recording the conversation, a jury could also find his",
        "paragraph_id": "para_371"
      },
      {
        "text": "justification implausible given the evidence in the record.",
        "paragraph_id": "para_372"
      },
      {
        "text": "There is ample evidence that Burns was upset by the continued",
        "paragraph_id": "para_373"
      },
      {
        "text": "investigations into the department and, on several occasions, made",
        "paragraph_id": "para_374"
      },
      {
        "text": "statements that seemingly indicate he would retaliate against those he",
        "paragraph_id": "para_375"
      },
      {
        "text": "perceived as continuing to perpetuate the investigations. And, though",
        "paragraph_id": "para_376"
      },
      {
        "text": "WTAMU disputes those interpretations of his statements, if statements can",
        "paragraph_id": "para_377"
      },
      {
        "text": "be construed multiple ways, it is a question of fact for the jury to resolve. See",
        "paragraph_id": "para_378"
      },
      {
        "text": "A.I. Credit Corp. v. Legion Ins. Co., 265 F.3d 630, 637 (7th Cir. 2001).",
        "paragraph_id": "para_379"
      },
      {
        "text": "Indeed, these cryptic statements can be especially probative at the",
        "paragraph_id": "para_380"
      },
      {
        "text": "pretext stage. See EEOC v. Rite Way Serv., Inc., 819 F.3d 235, 245 (5th Cir.",
        "paragraph_id": "para_381"
      },
      {
        "text": "2016) (collecting cases). In Rite Way, the court found a genuine dispute of",
        "paragraph_id": "para_382"
      },
      {
        "text": "material fact when a manager told the plaintiff that “you know what they do",
        "paragraph_id": "para_383"
      },
      {
        "text": "to people who do stuff like this,” and reminded her that Mississippi was an",
        "paragraph_id": "para_384"
      },
      {
        "text": "at-will employment state and that she could lose benefits if she was fired. Id.",
        "paragraph_id": "para_385"
      },
      {
        "text": "Those threats were more subtle than in this case where Burns admitted to",
        "paragraph_id": "para_386"
      },
      {
        "text": "telling officers that he “was ready to start stacking bodies” in the wake of the",
        "paragraph_id": "para_387"
      },
      {
        "text": "Title IX investigations.",
        "paragraph_id": "para_388"
      },
      {
        "text": "The jury can also consider the relatively quick sequence of events",
        "paragraph_id": "para_389"
      },
      {
        "text": "from when Crawford began participating in the Title IX investigation to when",
        "paragraph_id": "para_390"
      },
      {
        "text": "Burns ordered changes to his daily work and indicated that he would have no",
        "paragraph_id": "para_391"
      },
      {
        "text": "chance at promotion. Id. at 244 (noting temporal proximity is relevant). Even",

        "text": "letter, “these actions serve as relevant background and can provide the basis",

        "text": "for a retaliatory act.” Awe v. Harris Health Sys., 163 F.4th 969, 973–74 (5th",

      },
      {
        "text": "Cir. 2026) (per curiam). And Crawford received generally positive reviews",

      },
      {

        "text": "before the investigations began.5 Rite Way Serv. Inc., 819 F.3d at 244–45",

        "text": "(noting that plaintiff had an “unimpeached” employment record).",

      },
      {
        "text": "On this record, Crawford has successfully created a genuine dispute",
        "paragraph_id": "para_402"
      },
      {
        "text": "of material fact that Burns’ rationale was pretextual and that he retaliated",
        "paragraph_id": "para_403"
      },
      {
        "text": "against Crawford for participating in a Title IX investigation. See Harris v.",
        "paragraph_id": "para_404"
      },
      {
        "text": "FedEx Corp. Servs., 92 F.4th 286, 298 (5th Cir. 2024) (noting that a manager",
        "paragraph_id": "para_405"
      },
      {
        "text": "complaining about an employee could support a finding of pretext). And",
        "paragraph_id": "para_406"
      },
      {
        "text": "here, there are audio recordings of Burns admitting to making statements that",
        "paragraph_id": "para_407"
      },
      {
        "text": "a jury could conclude indicated retaliatory motive. So, WTAMU should",
        "paragraph_id": "para_408"
      },
      {
        "text": "have been denied summary judgment.",
        "paragraph_id": "para_409"
      },
      {
        "text": "IV. Conclusion",
        "paragraph_id": "para_410"
      },
      {
        "text": "For the foregoing reasons, we REVERSE the district court’s grant of",
        "paragraph_id": "para_411"
      },
      {
        "text": "summary judgment and REMAND for further proceedings consistent with",
        "paragraph_id": "para_412"
      },
      {
        "text": "this opinion.",
        "paragraph_id": "para_413"

        "text": "5 WTAMU devotes significant space in its brief discussing Crawford’s previous",

        "text": "“checkered” disciplinary record. But later in the brief, WTAMU states that its non-",

      },
      {
        "text": "retaliatory reason was “that Crawford violated university policy and state law by lurking",
        "paragraph_id": "para_417"
      },
      {
        "text": "near his superior’s office door, recording a private conversation, and then l[ied] about it.”",
        "paragraph_id": "para_418"
      },
      {
        "text": "Indeed, though Burns discussed complaints against Crawford from 2021 in his",
        "paragraph_id": "para_419"
      },
      {
        "text": "Declaration, Crawford was given an “exceeds expectations” rating in 2022. And",
        "paragraph_id": "para_420"
      },
      {
        "text": "WTAMU does not point to anywhere in the record that he was suspended or investigated",
        "paragraph_id": "para_421"
      },
      {
        "text": "for anything other than the recording incident.",

        "text": "I agree with the majority that genuine disputes of material fact",
        "paragraph_id": "para_427"
      },
      {
        "text": "preclude summary judgment in this case. I write separately because",
        "paragraph_id": "para_428"
      },
      {
        "text": "Crawford’s dishonorable discharge was not properly preserved as a basis for",
        "paragraph_id": "para_429"
      },
      {
        "text": "his retaliation claim. So I would not analyze the prima facia elements of his",
        "paragraph_id": "para_430"
      },
      {
        "text": "claim through the lens of his discharge, particularly as to the “new scenario”",
        "paragraph_id": "para_431"
      },
      {
        "text": "we confront regarding the causal link between Crawford’s protected activity",
        "paragraph_id": "para_432"
      },
      {
        "text": "and his discharge. Cf. ante, at 10–11.",
        "paragraph_id": "para_433"
      },
      {
        "text": "The reason is straightforward: Crawford did not raise his",
        "paragraph_id": "para_434"
      },
      {
        "text": "dishonorable discharge as a basis for relief in either his EEOC charge or his",
        "paragraph_id": "para_435"
      },
      {
        "text": "complaint in this action. See Ernst v. Methodist Hosp. Sys., 1 F.4th 333, 337",
        "paragraph_id": "para_436"
      },
      {
        "text": "(5th Cir. 2021) (“To satisfy exhaustion, a claim generally must arise out of",
        "paragraph_id": "para_437"
      },
      {
        "text": "the plaintiff’s EEOC charge.”). He belatedly raised his discharge only in",
        "paragraph_id": "para_438"
      },
      {
        "text": "opposition to WTAMU’s motion for summary judgment. Cf. Cutrera v. Bd.",
        "paragraph_id": "para_439"
      },
      {
        "text": "of Sup’rs of La. State Univ., 429 F.3d 108, 113 (5th Cir. 2005) (“A claim which",
        "paragraph_id": "para_440"
      },
      {
        "text": "is not raised in the complaint but, rather, is raised only in response to a",
        "paragraph_id": "para_441"
      },
      {
        "text": "motion for summary judgment is not properly before the court.” (citing",
        "paragraph_id": "para_442"
      },
      {
        "text": "Fisher v. Metro. Life Ins. Co., 895 F.2d 1073, 1078 (5th Cir. 1990))). Because",
        "paragraph_id": "para_443"
      },
      {
        "text": "Crawford did not properly preserve his discharge as a basis for his claim, the",
        "paragraph_id": "para_444"
      },
      {
        "text": "district court correctly declined to consider it. I would do likewise and end",
        "paragraph_id": "para_445"
      },
      {
        "text": "the analysis there.",
        "paragraph_id": "para_446"
      },
      {
        "text": "That said, I agree that we should reverse the district court’s summary",
        "paragraph_id": "para_447"
      },
      {
        "text": "judgment. It is uncontested that Crawford engaged in protected activity.",
        "paragraph_id": "para_448"
      },
      {
        "text": "While there is some question whether the investigation into Crawford’s",
        "paragraph_id": "para_449"
      },
      {
        "text": "actions or his paid suspension would rise to an adverse employment action,",
        "paragraph_id": "para_450"
      },
      {
        "text": "considering them in tandem with the record before us, there is at least a",
        "paragraph_id": "para_451"
      },
      {
        "text": "material fact dispute regarding that “context-specific” question, as the",
        "paragraph_id": "para_452"
      },
      {
        "text": "majority notes. Finally, considering Chief Burns’s knowledge that Crawford",

        "text": "IX investigation, there is likewise at least a fact dispute over a causal link",
        "paragraph_id": "para_459"
      },
      {
        "text": "between Crawford’s protected activity and his suspension and investigation.",
        "paragraph_id": "para_460"
      },
      {
        "text": "Accordingly, the district court erred in concluding that Crawford could not",
        "paragraph_id": "para_461"
      },
      {
        "text": "establish a prima facie Title VII retaliation claim.",
        "paragraph_id": "para_462"
      },
      {
        "text": "Continuing with the McDonnell Douglas analysis, WTAMU satisfied",
        "paragraph_id": "para_463"
      },
      {
        "text": "its burden to produce a legitimate non-retaliatory reason for its actions. But",
        "paragraph_id": "para_464"
      },
      {
        "text": "the same evidence that substantiates a causal link between Crawford’s",
        "paragraph_id": "para_465"
      },
      {
        "text": "protected activity and the adverse employment actions he suffered supports,",
        "paragraph_id": "para_466"
      },

        "text": "at least at summary judgment, Crawford’s assertion that WTAMU’s reasons",

        "text": "for disciplining and discharging Crawford were pretextual.",
