        "text": "Methylene chloride (“MC”) is a volatile liquid chemical used widely",
        "paragraph_id": "para_41"
      },
      {
        "text": "and for decades as a solvent in consumer and commercial applications",
        "paragraph_id": "para_42"
      },
      {
        "text": "including adhesives and sealants, automotive products, and paint and coating",
        "paragraph_id": "para_43"
      },
      {
        "text": "removers. Some of its essential uses are in the furniture refinishing business",
        "paragraph_id": "para_44"
      },
      {
        "text": "and the manufacture of energy efficient air conditioner coolants and EV",
        "paragraph_id": "para_45"
      },
      {
        "text": "batteries. Methylene chloride’s particular advantage as a solvent is that it",
        "paragraph_id": "para_46"
      },
      {
        "text": "removes paint or coatings without damaging underlying surfaces.",
        "paragraph_id": "para_47"
      },
      {
        "text": "But over-exposure to methylene chloride can cause injury or even",
        "paragraph_id": "para_48"
      },
      {
        "text": "death, and it has carcinogenic properties. Acting under the Toxic Substances",
        "paragraph_id": "para_49"
      },
      {
        "text": "Control Act (“TSCA”), EPA recently determined that almost all uses of",
        "paragraph_id": "para_50"
      },
      {
        "text": "methylene chloride pose an “unreasonable risk of injury to health.” 15",
        "paragraph_id": "para_51"
      },
      {
        "text": "U.S.C. § 2605(a). The agency promulgated a rule that nearly eliminates the",
        "paragraph_id": "para_52"
      },
      {
        "text": "market for MC. See Methylene Chloride; Regulation Under the Toxic",
        "paragraph_id": "para_53"
      },
      {
        "text": "Substances Control Act (TSCA), 89 Fed. Reg. 39254 (May 8, 2024) (codified",
        "paragraph_id": "para_54"
      },
      {
        "text": "at 40 C.F.R. § 751) [hereinafter MC Rule].",

        "text": "Finding that errors of law occurred and substantial evidence did not",

        "text": "A. The Toxic Substances Control Act",
        "paragraph_id": "para_66"
      },
      {
        "text": "The Toxic Substances Control Act was enacted in 1976. Section 6(a)",
        "paragraph_id": "para_67"
      },
      {
        "text": "of the TSCA authorizes EPA to enact regulations “prohibiting or otherwise",
        "paragraph_id": "para_68"
      },
      {
        "text": "restricting” “the manufacture, processing, distribution in commerce, use, or",
        "paragraph_id": "para_69"
      },
      {
        "text": "disposal” of chemicals that EPA determines to pose “an unreasonable risk of",
        "paragraph_id": "para_70"
      },
      {
        "text": "injury to health or the environment.” 15 U.S.C. § 2605(a). EPA may do so",
        "paragraph_id": "para_71"
      },
      {
        "text": "“to the extent necessary so that the chemical substance or mixture no longer",
        "paragraph_id": "para_72"
      },
      {
        "text": "presents such [unreasonable] risk.” Id. Historically, EPA enacted few rules",
        "paragraph_id": "para_73"
      },
      {
        "text": "under § 6(a).1",
        "paragraph_id": "para_74"
      },
      {
        "text": "Notably, in 1989, EPA published a rule that banned the use of asbestos",
        "paragraph_id": "para_75"
      },
      {
        "text": "in most products. See Asbestos: Manufacture, Importation, Processing, and",
        "paragraph_id": "para_76"
      },
      {
        "text": "Distribution in Commerce Prohibitions; Final Rule, 54 Fed. Reg. 29460 (July",
        "paragraph_id": "para_77"
      },
      {
        "text": "12, 1989) (codified at 40 C.F.R. § 763). This court vacated that rule for lack",
        "paragraph_id": "para_78"
      },
      {
        "text": "of substantial evidence that EPA adequately considered less burdensome",
        "paragraph_id": "para_79"
      },
      {
        "text": "regulatory options. See Corrosion Proof Fittings v. EPA, 947 F.2d 1201, 1229–",
        "paragraph_id": "para_80"
      },
      {
        "text": "30 (5th Cir. 1991). Almost a decade later, EPA published a narrower asbestos",
        "paragraph_id": "para_81"
      },
      {
        "text": "rule aimed at protecting state and local government workers. See Asbestos",
        "paragraph_id": "para_82"
      },
      {
        "text": "Worker Protection, 65 Fed. Reg. 69210 (Nov. 15, 2000) (codified at 40",
        "paragraph_id": "para_83"
      },
      {
        "text": "C.F.R. § 763).",
        "paragraph_id": "para_84"
      },
      {
        "text": "After more than a decade of regulatory silence, Congress amended the",
        "paragraph_id": "para_85"
      },
      {
        "text": "TSCA in 2016 to require EPA to begin priority risk evaluations for certain",
        "paragraph_id": "para_86"
      },
      {
        "text": "chemicals. The amendments articulated comprehensive new provisions",
        "paragraph_id": "para_87"
      },
      {

        "paragraph_id": "para_98",

        "text": "to regulate the chemicals’ use “to the extent necessary” to eliminate such",
        "paragraph_id": "para_99"
      },
      {
        "text": "risks. The following outline describes pertinent provisions.",
        "paragraph_id": "para_100"
      },
      {
        "text": "EPA must first determine whether each chemical “presents an",
        "paragraph_id": "para_101"
      },
      {
        "text": "unreasonable risk of injury . . . under the conditions of use.” 15",
        "paragraph_id": "para_102"
      },
      {
        "text": "U.S.C. § 2605(b)(4)(A) (emphasis added). The “conditions of use,” a",
        "paragraph_id": "para_103"
      },
      {
        "text": "recurring statutory phrase, is broadly defined as “the circumstances . . .under",
        "paragraph_id": "para_104"
      },
      {
        "text": "which a chemical substance is intended, known, or reasonably foreseen to be",
        "paragraph_id": "para_105"
      },
      {
        "text": "manufactured, processed, distributed in commerce, used, or disposed of.”",
        "paragraph_id": "para_106"
      },
      {
        "text": "15 U.S.C. § 2602(4). EPA’s “unreasonable risk” determination must not",
        "paragraph_id": "para_107"
      },
      {
        "text": "“consider[] costs or other nonrisk factors,” but it must “take into account,",
        "paragraph_id": "para_108"
      },
      {
        "text": "where relevant, the likely duration, intensity, frequency, and number of",
        "paragraph_id": "para_109"
      },
      {
        "text": "exposures under the conditions of use of the chemical substance.” 15",
        "paragraph_id": "para_110"
      },
      {
        "text": "U.S.C. § 2605(b)(4)(A), (b)(4)(F)(iv) (emphasis added). “Unreasonable",
        "paragraph_id": "para_111"
      },
      {
        "text": "risk” must also take into account “a potentially exposed or susceptible",
        "paragraph_id": "para_112"
      },
      {
        "text": "subpopulation identified as relevant to the risk evaluation by the",
        "paragraph_id": "para_113"
      },
      {
        "text": "Administrator [of EPA], under the conditions of use,” 15 U.S.C.",
        "paragraph_id": "para_114"
      },
      {
        "text": "§ 2605(b)(4)(A), and it must reflect the weight of scientific evidence in",
        "paragraph_id": "para_115"
      },
      {
        "text": "identifying risks and hazards, 15 U.S.C. § 2605(b)(4)(F)(v).",
        "paragraph_id": "para_116"
      },
      {
        "text": "Second, if a chemical poses an “unreasonable risk,” EPA is to “apply",
        "paragraph_id": "para_117"
      },
      {
        "text": "one or more” mitigation measures “to the extent necessary so that the",
        "paragraph_id": "para_118"
      },
      {
        "text": "chemical substance . . . no longer presents such [unreasonable] risk.” Id.",
        "paragraph_id": "para_119"
      },
      {
        "text": "§ 2605(a).2 Allowed mitigation measures range from modest notice and",
        "paragraph_id": "para_120"
      },
      {
        "text": "recordkeeping obligations to outright prohibitions on a chemical’s",
        "paragraph_id": "para_121"
      },
      {
        "text": "manufacture or sale. See id. § 2605(a)(1)–(7). When choosing among these",
        "paragraph_id": "para_122"
      },
      {

        "text": "measures, EPA must “factor in, to the extent practicable,” the “benefits of",
        "paragraph_id": "para_131",
        "court_paragraph": 5
      },
      {
        "text": "the chemical substance or mixture for various uses” and “the reasonably",
        "paragraph_id": "para_132"
      },
      {
        "text": "ascertainable economic consequences of the rule.” Id. § 2605(c)(2)(A)–(B).",
        "paragraph_id": "para_133"
      },
      {
        "text": "EPA must also compare its preferred measure to an alternative. Id. If EPA’s",
        "paragraph_id": "para_134"
      },
      {
        "text": "preferred measure would “substantially prevent[] a specific condition of use",
        "paragraph_id": "para_135"
      },
      {
        "text": "of a chemical,” EPA must consider “whether technically and economically",
        "paragraph_id": "para_136"
      },
      {
        "text": "feasible alternatives that benefit health or the environment, compared to the",
        "paragraph_id": "para_137"
      },
      {
        "text": "use so proposed to be prohibited or restricted, will be reasonably available as",
        "paragraph_id": "para_138"
      },
      {
        "text": "a substitute.” Id. § 2605(c)(2)(C).",
        "paragraph_id": "para_139"
      },
      {
        "text": "Overarching these requirements are significant methodological",
        "paragraph_id": "para_140"
      },
      {
        "text": "parameters. Thus, “to the extent that [EPA] makes a decision based on",
        "paragraph_id": "para_141"
      },
      {
        "text": "science, [EPA] shall use scientific information, technical procedures,",
        "paragraph_id": "para_142"
      },
      {
        "text": "measures, methods, protocols, methodologies, or models, employed in a",
        "paragraph_id": "para_143"
      },
      {
        "text": "manner consistent with the best available science.” 15 U.S.C. § 2625(h).",
        "paragraph_id": "para_144"
      },
      {
        "text": "EPA must consider factors bearing on the reliability of its findings. Id. EPA",
        "paragraph_id": "para_145"
      },
      {
        "text": "must also base its conclusions on the “weight of the scientific evidence,” and",
        "paragraph_id": "para_146"
      },
      {
        "text": "it must apply “reasonably available” information bearing on the hazards of",
        "paragraph_id": "para_147"
      },
      {
        "text": "or exposure to the substance “under the conditions of use.” Id. § 2625(i)–",
        "paragraph_id": "para_148"
      },
      {
        "text": "(k).",
        "paragraph_id": "para_149"
      },
      {
        "text": "In a similar context, the Supreme Court interpreted a statutory",
        "paragraph_id": "para_150"
      },
      {
        "text": "provision that an agency must “use the best scientific and commercial data",
        "paragraph_id": "para_151"
      },
      {
        "text": "available,” 16 U.S.C. § 1536(a)(2), as an empirical mandate to ensure that the",
        "paragraph_id": "para_152"
      },
      {
        "text": "law is not “implemented haphazardly, on the basis of speculation or",
        "paragraph_id": "para_153"
      },
      {
        "text": "surmise . . . .” Bennett v. Spear, 520 U.S. 154, 176–77, 117 S. Ct. 1154, 1168",
        "paragraph_id": "para_154"
      },
      {
        "text": "(1997). Here, too, EPA’s risk evaluations and rules under TSCA § 6(a) must",
        "paragraph_id": "para_155"
      },
      {
        "text": "comply with important procedural and substantive requirements “to prevent",
        "paragraph_id": "para_156"
      },
      {
        "text": "zealous[] but unintelligent pursui[t] [of] environmental objectives.” Id. EPA",
        "paragraph_id": "para_157"
      },
      {
        "text": "has no freewheeling authority.",

        "text": "Congress’s 2016 amendments authorized EPA to bypass its new",
        "paragraph_id": "para_164"
      },
      {
        "text": "evaluation process and proceed directly to rulemaking for any risk",
        "paragraph_id": "para_165"
      },
      {
        "text": "evaluations that the agency had completed before 2016. 15 U.S.C.",
        "paragraph_id": "para_166"
      },
      {
        "text": "§ 2625(l)(4). As of 2016, EPA had already completed a limited risk",
        "paragraph_id": "para_167"
      },
      {
        "text": "evaluation of MC. Accordingly, EPA published a final rule (not challenged",
        "paragraph_id": "para_168"
      },
      {
        "text": "here) in March 2019 that prohibited the manufacturing, processing, and",
        "paragraph_id": "para_169"
      },
      {
        "text": "distribution of MC solely for purposes of consumer paint and coating",
        "paragraph_id": "para_170"
      },
      {
        "text": "removal. See Methylene Chloride; Regulation of Paint and Coating Removal",
        "paragraph_id": "para_171"
      },
      {
        "text": "for Consumer Use Under TSCA Section 6(a), 84 Fed. Reg. 11420, 11435",
        "paragraph_id": "para_172"
      },
      {
        "text": "(Mar. 27, 2019) (codified at 40 C.F.R. § 751); see also Lab. Council for Latin",

        "text": "volume of methylene chloride was between 100 million to 500 million pounds",
        "paragraph_id": "para_180"
      },

        "text": "between 2016 and 2019,” although up to about 35% of that volume was for",
        "paragraph_id": "para_181"
      },
      {
        "text": "pharmaceutical uses, which are not regulated by the TSCA. MC Rule, 89",

        "text": "risk to health for forty-seven conditions of use; but (3) does not pose an",

        "text": "did not amend any of its fundamental findings or scientific analysis, it",
        "paragraph_id": "para_213"
      },

        "text": "changed the policies underlying its risk determination in two significant",
        "paragraph_id": "para_214"
      },
      {
        "text": "respects. First, instead of relying on separate risk determinations for each",
        "paragraph_id": "para_215"
      },
      {
        "text": "condition of use, EPA issued a single “whole chemical” determination that",
        "paragraph_id": "para_216"
      },
      {
        "text": "all but one of the fifty-three conditions of use posed an unreasonable risk to",
        "paragraph_id": "para_217"
      },
      {
        "text": "human health. Id. at 3, 25. This meant that all conditions of use must be",
        "paragraph_id": "para_218"
      },
      {
        "text": "regulated. Second, EPA assumed in the revised risk determination that",
        "paragraph_id": "para_219"
      },
      {
        "text": "employees exposed to MC do not ever wear personal protective equipment",
        "paragraph_id": "para_220"
      },
      {
        "text": "(“PPE”). Id. at 4, 10. The June 2020 final risk evaluation, on the other hand,",
        "paragraph_id": "para_221"
      },
      {
        "text": "had incorporated the assumption, fortified by a longstanding Occupational",
        "paragraph_id": "para_222"
      },
      {
        "text": "Safety and Health Administration (“OSHA”) regulation, that employees",

        "text": "Based on the revised risk determination, EPA proposed a “risk-",
        "paragraph_id": "para_230"
      },
      {
        "text": "management rule” for MC in May 2023. See Methylene Chloride;",
        "paragraph_id": "para_231"
      },
      {
        "text": "Regulation Under the Toxic Substances Control Act (TSCA), 88 Fed. Reg.",
        "paragraph_id": "para_232"
      },
      {
        "text": "28284 (May 3, 2023) (codified at 40 C.F.R. § 751). Thousands of comments",
        "paragraph_id": "para_233"
      },
      {
        "text": "were submitted, explaining the importance of MC and criticizing EPA’s",
        "paragraph_id": "para_234"
      },
      {
        "text": "regulatory proposal. Rejecting most of the objections, EPA published its final",
        "paragraph_id": "para_235"
      },
      {
        "text": "MC Rule in May 2024. See Methylene Chloride; Regulation Under the",
        "paragraph_id": "para_236"
      },
      {
        "text": "Toxic Substances Control Act (TSCA), 89 Fed. Reg. 39254 (May 8, 2024)",
        "paragraph_id": "para_237"
      },
      {
        "text": "(codified at 40 C.F.R. § 751). Under the MC Rule, forty of the fifty-three",
        "paragraph_id": "para_238"
      },
      {
        "text": "conditions of use (including products that contain MC) are prohibited,",
        "paragraph_id": "para_239"
      },
      {
        "text": "covering using, manufacturing, importing, processing, and distribution. 40",
        "paragraph_id": "para_240"
      },
      {
        "text": "C.F.R. § 751.105–108 (2026). Thirteen commercial or industrial conditions",
        "paragraph_id": "para_241"
      },
      {
        "text": "of use are allowed, subject to rigid exposure limits. Id. §751.109. Those",
        "paragraph_id": "para_242"
      },
      {
        "text": "thirteen are: (1) manufacturing (domestic); (2) manufacturing (import);",
        "paragraph_id": "para_243"
      },
      {
        "text": "(3) processing: as a reactant; (4) processing: incorporation into a",
        "paragraph_id": "para_244"
      },
      {
        "text": "formulation, mixture, or reaction product; (5) processing: repackaging;",
        "paragraph_id": "para_245"
      },
      {
        "text": "(6) processing: recycling; (7) laboratory chemical; (8) paint or coating",
        "paragraph_id": "para_246"
      },
      {
        "text": "removal from certain aircraft or spacecraft components; (9) bonding agent",
        "paragraph_id": "para_247"
      },
      {
        "text": "for solvent welding; (10) processing aid; (11) plastic and rubber products",
        "paragraph_id": "para_248"
      },
      {
        "text": "manufacturing; (12) solvent that becomes part of a formulation or mixture",
        "paragraph_id": "para_249"
      },
      {
        "text": "(where the formulation or mixture will be used inside a manufacturing",
        "paragraph_id": "para_250"
      },
      {
        "text": "process and MC will be reclaimed); and (13) disposal. Id. § 751.109(a). The",
        "paragraph_id": "para_251"
      },
      {
        "text": "thirteen uses are subject to a Workplace Chemical Protection Program",
        "paragraph_id": "para_252"
      },
      {
        "text": "(“WCPP”) that comprises exposure limits, monitoring and reporting, and",
        "paragraph_id": "para_253"
      },
      {
        "text": "respiratory and dermal protection. Id. § 751.109(c)–(g). For a few",
        "paragraph_id": "para_254"
      },
      {
        "text": "commercial or industrial uses, prohibition under the Rule is deferred for a",

      },

        "text": "have a very severe impact on the business of antique architectural work and",
        "paragraph_id": "para_261"
      },
      {
        "text": "commercial furniture refinishing. MC Rule, 89 Fed. Reg. at 39264–67.",
        "paragraph_id": "para_262"
      },
      {
        "text": "For the few remaining authorized conditions of use, the WCPP",
        "paragraph_id": "para_263"
      },
      {
        "text": "imposes strict exposure limits for “acute” or “short-term” and “chronic”",
        "paragraph_id": "para_264"
      },
      {
        "text": "or “existing” events. 40 C.F.R. § 751.109(c) (2026). No more than 16 parts",
        "paragraph_id": "para_265"
      },
      {
        "text": "per million (“ppm”) is allowed for fifteen minutes’ “acute” exposure, and",
        "paragraph_id": "para_266"
      },
      {
        "text": "for “chronic” exposure, a time-weighted average of only 2 ppm is permitted",
        "paragraph_id": "para_267"
      },
      {
        "text": "for eight hours of exposure time. Id. § 751.109(c)(1)–(2). These exposure",
        "paragraph_id": "para_268"
      },
      {
        "text": "limits coupled with exposure monitoring are intended to regulate a worker’s",
        "paragraph_id": "para_269"
      },
      {
        "text": "MC exposure over a career of many years. Id. § 751.109(c)–(d). In contrast,",
        "paragraph_id": "para_270"
      },
      {
        "text": "since 1997, OSHA has enforced MC exposure limits almost ten times greater:",
        "paragraph_id": "para_271"
      },
      {
        "text": "125 ppm for “acute” exposure and 25 ppm for “chronic” exposure. See",
        "paragraph_id": "para_272"
      },
      {
        "text": "Occupational Exposure to Methylene Chloride, 62 Fed. Reg. 1494 (Jan. 10,",
        "paragraph_id": "para_273"
      },
      {
        "text": "1997) (codified at 29 C.F.R. § 1910.1052(c)).",
        "paragraph_id": "para_274"
      },
      {
        "text": "C. Procedural History",
        "paragraph_id": "para_275"
      },
      {
        "text": "The American Chemistry Council, East Fork Enterprises, and Epic",
        "paragraph_id": "para_276"
      },
      {
        "text": "Paint Company (together, “Industry Petitioners”) filed a petition for review,",
        "paragraph_id": "para_277"
      },
      {
        "text": "arguing that EPA exceeded its authority, and that EPA’s conclusions are",
        "paragraph_id": "para_278"
      },
      {
        "text": "arbitrary and capricious and unsupported by substantial evidence. East Fork",
        "paragraph_id": "para_279"
      },
      {
        "text": "and Epic Paint manufacture products that contain MC. The Council’s",
        "paragraph_id": "para_280"
      },
      {
        "text": "_____________________",

      },
      {

        "text": "MC-containing products.” MC Rule, 89 Fed. Reg. at 39282. The Rule defines “retailer”",
        "paragraph_id": "para_285"
      },
      {
        "text": "to include any person that “distributes” or “makes available” products to “at least one",
        "paragraph_id": "para_286"
      },
      {
        "text": "consumer.” 40 C.F.R. § 751.5 (2026). “Product” is defined to include a “chemical",
        "paragraph_id": "para_287"
      },
      {
        "text": "substance” or “mixture.” Id.",

        "text": "members include MC manufacturers. The Sierra Club filed a separate",
        "paragraph_id": "para_293",
        "court_paragraph": 10
      },
      {
        "text": "petition for review, arguing that EPA did not go far enough in protecting its",
        "paragraph_id": "para_294"
      },
      {
        "text": "members who live in fenceline communities (i.e., communities adjacent to",
        "paragraph_id": "para_295"
      },
      {
        "text": "factories that emit MC), have cancer-favoring genetics, or live at altitudes",
        "paragraph_id": "para_296"
      },
      {
        "text": "where ozone depletion is a concern. Conferring Article III standing, a Sierra",
        "paragraph_id": "para_297"
      },
      {
        "text": "Club member lives two miles from a facility that releases MC. The petitions",
        "paragraph_id": "para_298"
      },
      {
        "text": "for review were consolidated. The Council also intervened in opposition to",
        "paragraph_id": "para_299"
      },
      {
        "text": "the Sierra Club’s petition.",
        "paragraph_id": "para_300"
      },
      {
        "text": "II. STANDARD OF REVIEW",
        "paragraph_id": "para_301"
      },
      {
        "text": "Generally, the TSCA provides for judicial review under the",
        "paragraph_id": "para_302"
      },
      {
        "text": "framework of the Administrative Procedure Act (“APA”). 15 U.S.C.",
        "paragraph_id": "para_303"
      },
      {
        "text": "§ 2618(c)(1)(B). The APA directs courts to “hold unlawful and set aside",
        "paragraph_id": "para_304"
      },
      {
        "text": "agency action, findings, and conclusions found to be arbitrary, capricious, an",
        "paragraph_id": "para_305"
      },
      {
        "text": "abuse of discretion, or otherwise not in accordance with law.” 5 U.S.C.",
        "paragraph_id": "para_306"
      },
      {
        "text": "§ 706(2)(A). The TSCA, however, modifies the APA substantial-evidence",
        "paragraph_id": "para_307"
      },
      {
        "text": "standard: EPA actions must be “supported by substantial evidence in the",
        "paragraph_id": "para_308"
      },
      {
        "text": "rulemaking record taken as a whole.” Compare 15 U.S.C.",
        "paragraph_id": "para_309"
      },
      {
        "text": "§ 2618(c)(1)(B)(i)(I), with 5 U.S.C. § 706(2)(E) (providing that courts shall",
        "paragraph_id": "para_310"
      },
      {
        "text": "“hold unlawful and set aside agency action . . . found to be . . . unsupported",
        "paragraph_id": "para_311"
      },
      {
        "text": "by substantial evidence.”). The TSCA standard “requires (1) that the",
        "paragraph_id": "para_312"
      },
      {
        "text": "agency’s decision be based upon the entire record, taking into account",
        "paragraph_id": "para_313"
      },
      {
        "text": "whatever in the record detracts from the weight of the agency’s decision; and",
        "paragraph_id": "para_314"
      },
      {
        "text": "(2) that the agency’s decision be what a reasonable mind might accept as",
        "paragraph_id": "para_315"
      },
      {
        "text": "adequate to support [its] conclusion.” Corrosion Proof Fittings, 947 F.2d",
        "paragraph_id": "para_316"
      },
      {
        "text": "1201, 1213 (5th Cir. 1991) (alteration in original) (footnote and internal",
        "paragraph_id": "para_317"
      },
      {
        "text": "quotation marks omitted). Although the two statutes’ substantial evidence",
        "paragraph_id": "para_318"
      },
      {
        "text": "standards are similar textually, it is understood that the TSCA’s substantial",
        "paragraph_id": "para_319"
      },
      {
        "text": "evidence standard is “fairly rigorous and more searching than the APA",
        "paragraph_id": "para_320"
      },
      {
        "text": "standard.” Vinyl Inst., Inc. v. EPA, 106 F.4th 1118, 1124 (D.C. Cir. 2024)",

      {
        "text": "III. DISCUSSION",
        "paragraph_id": "para_329"
      },
      {
        "text": "The Industry Petitioners’ challenges to the MC Rule broadly critique",
        "paragraph_id": "para_330"
      },
      {
        "text": "EPA’s assumptions and conclusions regarding its determination of",
        "paragraph_id": "para_331"
      },
      {
        "text": "“unreasonable risk to human health” under MC’s fifty-three “conditions of",
        "paragraph_id": "para_332"
      },
      {
        "text": "use,” and the agency’s correlated measures to eliminate any such risk “to",
        "paragraph_id": "para_333"
      },
      {
        "text": "the extent necessary.” Industry Petitioners contend the agency",
        "paragraph_id": "para_334"
      },
      {
        "text": "determinations are contrary to law, arbitrary and capricious, and without",
        "paragraph_id": "para_335"
      },
      {
        "text": "support in substantial evidence. Preliminarily, it makes sense to appraise the",
        "paragraph_id": "para_336"
      },
      {
        "text": "new legal interpretations EPA brought to bear on “unreasonable risk” when",
        "paragraph_id": "para_337"
      },
      {
        "text": "it re-assessed the June 2020 final risk evaluation. To reiterate, EPA’s 2022",
        "paragraph_id": "para_338"
      },
      {
        "text": "revised risk determination abandoned the individual analysis of “conditions",
        "paragraph_id": "para_339"
      },
      {
        "text": "of use” in favor of a “whole chemical” basis for the MC Rule, and it",
        "paragraph_id": "para_340"
      },
      {
        "text": "eliminated the assumption that workers wear PPE when exposed to MC.4",
        "paragraph_id": "para_341"
      },
      {
        "text": "Subsequently, we address both the legal standards and the scientific",
        "paragraph_id": "para_342"
      },
      {
        "text": "background for the agency’s unreasonable risk determination and its",
        "paragraph_id": "para_343"
      },
      {
        "text": "remedial measures to eliminate unreasonable risk.",
        "paragraph_id": "para_344"
      },
      {
        "text": "Finally, we address Sierra Club’s distinct challenges to the MC Rule.",
        "paragraph_id": "para_345"
      },
      {

        "text": "governing the few remaining non-prohibited conditions of use.",

        "text": "A. Industry Petitioners’ Challenges",
        "paragraph_id": "para_356",

        "text": "“Whole Chemical” Risk Determination",
        "paragraph_id": "para_357"
      },
      {
        "text": "In the November 2022 revised risk determination, EPA characterized",
        "paragraph_id": "para_358"
      },
      {
        "text": "MC as posing unreasonable risk “as a whole chemical substance” regardless",
        "paragraph_id": "para_359"
      },
      {
        "text": "of the fact that not all conditions of use posed unreasonable risk according to",
        "paragraph_id": "para_360"
      },
      {
        "text": "the June 2020 final risk evaluation, and regardless of the variability of the",
        "paragraph_id": "para_361"
      },
      {
        "text": "unreasonable risk under individual conditions of use. This modification",
        "paragraph_id": "para_362"
      },
      {
        "text": "resulted in EPA’s recharacterizing six uses as posing unreasonable risk that",
        "paragraph_id": "para_363"
      },
      {
        "text": "had previously been deemed not to present such risk.5 Compare June 2020",
        "paragraph_id": "para_364"
      },
      {
        "text": "Final Risk Evaluation at 517–18 (concluding that manufacture of MC does",
        "paragraph_id": "para_365"
      },
      {
        "text": "not pose unreasonable risk), with November 2022 Revised Risk",
        "paragraph_id": "para_366"
      },
      {
        "text": "Determination at 25 (concluding that MC poses an unreasonable risk as a",
        "paragraph_id": "para_367"
      },
      {
        "text": "whole substance). Industry Petitioners contend that a “whole chemical",
        "paragraph_id": "para_368"
      },
      {
        "text": "determination” was unlawful because the TSCA and agency procedural rules",
        "paragraph_id": "para_369"
      },
      {
        "text": "both required EPA to publish a separate risk determination for each condition",
        "paragraph_id": "para_370"
      },
      {
        "text": "of use.",
        "paragraph_id": "para_371"
      },
      {
        "text": "The Industry Petitioners have the edge legally. The TSCA provides",
        "paragraph_id": "para_372"
      },
      {
        "text": "that EPA must determine whether the manufacture, processing,",
        "paragraph_id": "para_373"
      },
      {
        "text": "distribution . . . use, or disposal of a chemical substance . . . or . . . any",
        "paragraph_id": "para_374"
      },
      {
        "text": "combination of such activities, presents an unreasonable risk . . . .” 15 U.S.C.",
        "paragraph_id": "para_375"
      },
      {

        "text": "change was by no means “harmless,” as EPA either prohibited or regulated stringently",

        "text": "those conditions of use which previously had been deemed not to present “unreasonable",
        "paragraph_id": "para_381"
      },
      {
        "text": "risk.” This whole chemical risk determination was all the more unreasonable insofar as",
        "paragraph_id": "para_382"
      },
      {
        "text": "EPA explicitly did not change its scientific assessment for the non-risky conditions of use.",

      },
      {

        "text": "Consequently, “unreasonable risk” may be “presented” by activities",

      {
        "text": "concerning the chemical, not simply the chemical. And as will be seen, the",
        "paragraph_id": "para_395"
      },
      {
        "text": "remainder of the TSCA makes it obvious that if such activities are",
        "paragraph_id": "para_396"
      },
      {
        "text": "individually determined to present unreasonable risk, EPA may regulate",
        "paragraph_id": "para_397"
      },
      {
        "text": "those activities while leaving unregulated other activities that are not",
        "paragraph_id": "para_398"
      },
      {
        "text": "unreasonably risky.",
        "paragraph_id": "para_399"
      },
      {
        "text": "With this preface, § 2605(b) goes on to set criteria by which EPA will",
        "paragraph_id": "para_400"
      },
      {
        "text": "“conduct risk evaluations . . . to determine whether a chemical substance",
        "paragraph_id": "para_401"
      },
      {
        "text": "presents an unreasonable risk . . . under the conditions of use.” Id.",
        "paragraph_id": "para_402"
      },
      {
        "text": "§ 2605(b)(4)(A). Bear in mind that “conditions of use” means “the",
        "paragraph_id": "para_403"
      },
      {
        "text": "circumstances . . . under which a chemical substance is intended, known, or",
        "paragraph_id": "para_404"
      },
      {
        "text": "reasonably foreseen to be . . . used.” 15 U.S.C. § 2602(4). Multiple risk",
        "paragraph_id": "para_405"
      },
      {
        "text": "evaluations are required for multiple “conditions of use” of a chemical",
        "paragraph_id": "para_406"
      },
      {
        "text": "substance. Further, under § 2605(b)(4)(D), EPA must “publish the scope",
        "paragraph_id": "para_407"
      },
      {
        "text": "of the risk evaluation to be conducted, including the . . . conditions of use . . .",
        "paragraph_id": "para_408"
      },
      {
        "text": "[EPA] expects to consider” (emphasis added). Under § 2605(b)(4)(F),",
        "paragraph_id": "para_409"
      },
      {
        "text": "EPA’s determination must “assess . . . the likely . . . exposures under the",
        "paragraph_id": "para_410"
      },
      {
        "text": "conditions of use” (emphasis added), and consider “aggregate or sentinel",
        "paragraph_id": "para_411"
      },
      {
        "text": "exposures . . . under the conditions of use . . . ” (emphasis added). Section",

      },
      {
        "text": "2605, in fact, mentions “conditions of use” in no less than thirteen",

        "text": "subsections. Summarizing Congress’s instruction for the scope of EPA",

        "text": "authority, the TSCA prescribes that EPA decisions preempt state law with",

      },
      {
        "text": "respect to the “conditions of use . . . included in the scope of the risk evaluation",

      {

        "text": "a given chemical or substance. The agency lacked legal authority under the",
        "paragraph_id": "para_424"
      },
      {
        "text": "TSCA to determine that a chemical or substance poses unreasonable risk “as",
        "paragraph_id": "para_425"
      },
      {
        "text": "a whole” rather than to evaluate each of its conditions of use.",
        "paragraph_id": "para_426"
      },
      {
        "text": "Although the statutory language is clear, this conclusion is reinforced",
        "paragraph_id": "para_427"
      },
      {
        "text": "by EPA’s own consistent interpretation, even at the time that it published the",
        "paragraph_id": "para_428"
      },
      {
        "text": "revised risk determination in November 2022. At that time, EPA was still",
        "paragraph_id": "para_429"
      },
      {
        "text": "operating under the 2017 procedural rule requiring EPA to “determine",
        "paragraph_id": "para_430"
      },
      {
        "text": "whether the chemical substance presents an unreasonable risk . . . under each",
        "paragraph_id": "para_431"
      },
      {
        "text": "condition of uses within the scope of the risk evaluation.” Procedures for",
        "paragraph_id": "para_432"
      },
      {
        "text": "Chemical Substance Risk Evaluations Under the Amended Toxic Substances",
        "paragraph_id": "para_433"
      },
      {
        "text": "Control Act, 82 Fed. Reg. 33726, 33752 (July 20, 2017) (codified at 40 C.F.R.",
        "paragraph_id": "para_434"
      },
      {
        "text": "§ 702 but amended by Procedures for Chemical Risk Evaluation Under the",
        "paragraph_id": "para_435"
      },
      {
        "text": "Toxic Substances Control Act (TSCA), 89 Fed. Reg. 37028, 37052 (May 3,",
        "paragraph_id": "para_436"
      },
      {
        "text": "2024) (emphasis added)); see also id. at 33744 (noting that “EPA will make",
        "paragraph_id": "para_437"
      },
      {
        "text": "individual risk determinations for all uses identified in the scope” and “each",
        "paragraph_id": "para_438"
      },
      {
        "text": "condition of use covered by the risk evaluation” [will receive] a risk",
        "paragraph_id": "para_439"
      },
      {
        "text": "determination” in the Rules’s preamble); Wyo. Outdoor Council v. U.S. Forest",
        "paragraph_id": "para_440"
      },
      {
        "text": "Serv., 165 F.3d 43, 53 (D.C. Cir. 1999) (“[T]he preamble to a regulation is",
        "paragraph_id": "para_441"
      },
      {
        "text": "evidence of an agency’s contemporaneous understanding of its proposed",
        "paragraph_id": "para_442"
      },
      {
        "text": "rules.”). Further, EPA pledged that “[a]ny [§ 6(a)] rule would apply only to",
        "paragraph_id": "para_443"
      },
      {
        "text": "the condition(s) of use that present an unreasonable risk, and those",
        "paragraph_id": "para_444"
      },
      {
        "text": "[conditions of use] that do not present an unreasonable risk will not be subject",
        "paragraph_id": "para_445"
      },
      {
        "text": "to risk management.” 89 Fed. Reg. at 33744. The TSCA also provides that",
        "paragraph_id": "para_446"
      },
      {
        "text": "EPA’s risk determinations must comply with EPA’s operative procedural",
        "paragraph_id": "para_447"
      },
      {
        "text": "rule. See 15 U.S.C. § 2605(b)(4)(C) (EPA “shall conduct and publish risk",
        "paragraph_id": "para_448"
      },
      {
        "text": "evaluations, in accordance with the rule promulgated under subparagraph",
        "paragraph_id": "para_449"
      },
      {
        "text": "(B). . . .”); see also DOJ v. Fed. Lab. Rels. Auth., 991 F.2d 285, 291 n.4 (5th",

      },
      {

        "text": "contradicted its procedural rule and the TSCA’s procedural requirement.",
        "paragraph_id": "para_457"
      },
      {
        "text": "To justify abandoning a use-by-use determination, EPA construed its",
        "paragraph_id": "para_458"
      },
      {
        "text": "procedural rule as ambiguous with respect to whether a whole-chemical",
        "paragraph_id": "para_459"
      },
      {
        "text": "determination was prohibited. Methylene Chloride; Revision to Toxic",
        "paragraph_id": "para_460"
      },
      {
        "text": "Substances Control Act (TSCA) Risk Determination; Notice of Availability,",
        "paragraph_id": "para_461"
      },
      {
        "text": "87 Fed. Reg. 67901, 67904 (“[EPA] is . . . to determine whether a chemical",
        "paragraph_id": "para_462"
      },
      {
        "text": "substance—not just individual uses or activities—presents an unreasonable",
        "paragraph_id": "para_463"
      },
      {
        "text": "risk.” (quoting the preamble of the procedural rule at 82 Fed. Reg. 33726,",
        "paragraph_id": "para_464"
      },
      {
        "text": "33729)). Then, EPA “interpret[ed] its risk evaluation regulation to also allow",
        "paragraph_id": "para_465"
      },
      {
        "text": "the Agency to issue whole-chemical risk determinations.” Id. (emphasis",
        "paragraph_id": "para_466"
      },
      {
        "text": "added). This was wrong. Without even seeking deference for its reading of",
        "paragraph_id": "para_467"
      },
      {
        "text": "the procedural rule’s preamble, EPA can hardly deny that (1) the text of the",
        "paragraph_id": "para_468"
      },
      {
        "text": "operative procedural rule is clear and unambiguous with respect to the",
        "paragraph_id": "para_469"
      },
      {
        "text": "requirement that EPA issue risk determinations for each use; and (2) EPA",
        "paragraph_id": "para_470"
      },
      {
        "text": "issued risk determinations in that manner for several years before it",
        "paragraph_id": "para_471"
      },
      {
        "text": "discovered a different interpretation of that rule.",
        "paragraph_id": "para_472"
      },
      {
        "text": "In sum, the TSCA required EPA to issue a separate risk determination",
        "paragraph_id": "para_473"
      },
      {
        "text": "for each condition of use that it considered, and EPA’s regulations followed",
        "paragraph_id": "para_474"
      },
      {
        "text": "that mandate—until EPA chose not to do so. EPA lacked authority to issue",
        "paragraph_id": "para_475"
      },
      {
        "text": "a novel “whole-chemical” revised risk determination in November 2022.",
        "paragraph_id": "para_476"
      },
      {
        "text": "Assumption that Workers do not Wear PPE",
        "paragraph_id": "para_477"
      },
      {
        "text": "EPA’s revised risk determination also assumed that workers who",
        "paragraph_id": "para_478"
      },
      {
        "text": "work with MC do not use PPE. See MC Rule, 89 Fed. Reg. at 39257 (issuing",
        "paragraph_id": "para_479"
      },
      {
        "text": "a “clarification that the risk determination does not reflect an assumption",
        "paragraph_id": "para_480"
      },
      {
        "text": "that all workers are always provided and appropriately wear PPE”). Industry",
        "paragraph_id": "para_481"
      },
      {
        "text": "Petitioners argue that by reversing its contrary assumption in the June 2020",
        "paragraph_id": "para_482"
      },
      {

        "text": "final risk evaluation, EPA violated the TSCA and acted without supporting",
        "paragraph_id": "para_487",

      {
        "text": "evidence. We agree.",
        "paragraph_id": "para_488"
      },
      {
        "text": "According to the TSCA, EPA must account for PPE in its risk",
        "paragraph_id": "para_489"
      },
      {
        "text": "evaluations as a “condition of use” if evidence reflects that PPE is actually",
        "paragraph_id": "para_490"
      },
      {
        "text": "used. See 15 U.S.C. § 2605(b)(4)(A); 15 U.S.C. § 2602(4) (“The term",
        "paragraph_id": "para_491"
      },
      {
        "text": "‘conditions of use’ means the circumstances. . . under which a chemical",
        "paragraph_id": "para_492"
      },
      {
        "text": "substance is intended, known, or reasonably foreseen to be manufactured,",
        "paragraph_id": "para_493"
      },
      {
        "text": "processed, distributed in commerce, used, or disposed of.”) (emphasis",
        "paragraph_id": "para_494"
      },
      {
        "text": "added). The use of PPE is plainly a critical “condition” or “circumstance”",
        "paragraph_id": "para_495"
      },
      {
        "text": "regarding the use of MC. PPE dramatically reduces workers’ exposure",
        "paragraph_id": "para_496"
      },
      {
        "text": "through respirators that protect the respiratory tract; gloves and apparel that",
        "paragraph_id": "para_497"
      },
      {
        "text": "prevent skin contact; and protective glasses that ward off eye contact with",
        "paragraph_id": "para_498"
      },
      {
        "text": "MC. The June 2020 final risk evaluation, which complied with TSCA’s",
        "paragraph_id": "para_499"
      },
      {
        "text": "definition of “conditions of use,” reflected much lower workplace exposures",
        "paragraph_id": "para_500"
      },
      {
        "text": "with the assumed use of PPE.",
        "paragraph_id": "para_501"
      },
      {
        "text": "EPA’s only statutory rationale for abandoning its previous",
        "paragraph_id": "para_502"
      },
      {
        "text": "consideration of PPE as a condition of use is that it decided to factor PPE use",
        "paragraph_id": "para_503"
      },
      {
        "text": "instead as a limit on the intensity of the exposure in the “risk management”",
        "paragraph_id": "para_504"
      },
      {
        "text": "phase of regulation (i.e., after determining unreasonable risk by assuming no",
        "paragraph_id": "para_505"
      },
      {
        "text": "use of PPE). November 2022 Revised Risk Determination at 3–4. That is",
        "paragraph_id": "para_506"
      },
      {
        "text": "contrary not only to the definition of “conditions of use,” but also to EPA’s",
        "paragraph_id": "para_507"
      },
      {
        "text": "duty to formulate its unreasonable risk determination by considering the",
        "paragraph_id": "para_508"
      },
      {
        "text": "“intensity . . . of exposures under the conditions of use.” 15 U.S.C.",
        "paragraph_id": "para_509"
      },
      {
        "text": "§ 2605(b)(4)(F)(iv).",
        "paragraph_id": "para_510"
      },
      {
        "text": "EPA fares no better in supporting its new assumption factually. To",
        "paragraph_id": "para_511"
      },
      {
        "text": "begin, the agency speculated in the revised risk determination that some",
        "paragraph_id": "para_512"
      },
      {
        "text": "subpopulations of workers may not be covered by OSHA standards, or their",
        "paragraph_id": "para_513"
      },
      {
        "text": "employers failed to comply with OSHA requirements. November 2022",

      },

        "text": "the 2020 final risk evaluation that PPE use is a “condition of use” for",
        "paragraph_id": "para_520"
      },
      {
        "text": "commercial and industrial applications. The agency then explained:",
        "paragraph_id": "para_521"
      },
      {
        "text": "EPA used reasonably available information, including public",
        "paragraph_id": "para_522"
      },
      {
        "text": "comments, indicating that some employers, particularly in the",
        "paragraph_id": "para_523"
      },
      {
        "text": "industrial setting, are providing appropriate engineering or",
        "paragraph_id": "para_524"
      },
      {
        "text": "administrative controls or PPE to their employees consistent",
        "paragraph_id": "para_525"
      },
      {
        "text": "with OSHA requirements. While EPA does not have similar",
        "paragraph_id": "para_526"
      },
      {
        "text": "information to support this assumption for each condition of",
        "paragraph_id": "para_527"
      },
      {
        "text": "use, EPA does not believe that the Agency must presume, in",
        "paragraph_id": "para_528"
      },
      {
        "text": "the absence of such information, a lack of compliance with",
        "paragraph_id": "para_529"
      },
      {
        "text": "existing regulatory programs and practices. Rather, EPA",
        "paragraph_id": "para_530"
      },
      {
        "text": "assumes there is compliance with worker protection standards",
        "paragraph_id": "para_531"
      },
      {
        "text": "unless case-specific facts indicate otherwise . . . EPA believes",
        "paragraph_id": "para_532"
      },
      {
        "text": "this is a reasonable and appropriate approach that reflects real-",
        "paragraph_id": "para_533"
      },
      {
        "text": "world scenarios, accounts for reasonably available information",
        "paragraph_id": "para_534"
      },
      {
        "text": "related to worker protection practices, and addresses",
        "paragraph_id": "para_535"
      },
      {
        "text": "uncertainties regarding availability and use of PPE.",
        "paragraph_id": "para_536"
      },
      {
        "text": "June 2020 Final Risk Evaluation at 27.",
        "paragraph_id": "para_537"
      },
      {
        "text": "Two noteworthy points emerge from this statement in the June 2020",
        "paragraph_id": "para_538"
      },
      {
        "text": "final risk evaluation. First, as it was required to do in evaluating unreasonable",
        "paragraph_id": "para_539"
      },
      {
        "text": "risk, EPA took account of “reasonably available information” about the",
        "paragraph_id": "para_540"
      },
      {
        "text": "exposure under the “case-specific” “conditions of use.” 15 U.S.C.",
        "paragraph_id": "para_541"
      },
      {
        "text": "§ 2625(k). In so doing, EPA accepted information from the users of MC.",
        "paragraph_id": "para_542"
      },
      {
        "text": "Additionally, EPA found that PPE usage was reasonably foreseeable because",
        "paragraph_id": "para_543"
      },
      {
        "text": "EPA had no basis for assuming that employers were not complying with",
        "paragraph_id": "para_544"
      },
      {
        "text": "OSHA requirements. 29 C.F.R. § 1910.1052 (2026) (OSHA requirements",
        "paragraph_id": "para_545"
      },
      {
        "text": "for covered employers to control occupational exposure to MC).",
        "paragraph_id": "para_546"
      },
      {
        "text": "“Conditions of use,” after all, include “reasonably foreseen” circumstances",
        "paragraph_id": "para_547"
      },
      {
        "text": "such as compliance with other federal, state, and local mandates. 15 U.S.C.",
        "paragraph_id": "para_548"
      },
      {

        "paragraph_id": "para_555"
      },
      {
        "text": "that EPA believes . . . there is widespread noncompliance with applicable",
        "paragraph_id": "para_556"
      },
      {
        "text": "OSHA standards.” November 2022 Revised Risk Determination at 4. And",
        "paragraph_id": "para_557"
      },
      {
        "text": "contrary to its supposition that many workers are not covered by OSHA",
        "paragraph_id": "para_558"
      },
      {
        "text": "standards, the final MC Rule acknowledges that “[b]ecause of its adverse",
        "paragraph_id": "para_559"
      },
      {
        "text": "health effects, methylene chloride is subject to numerous State, Federal, and",
        "paragraph_id": "para_560"
      },
      {
        "text": "international regulations . . . .” MC Rule, 89 Fed. Reg. at 39256. If one also",
        "paragraph_id": "para_561"
      },
      {
        "text": "considers EPA’s decision not to alter the exposure assessments when it",
        "paragraph_id": "para_562"
      },
      {
        "text": "revised its risk determination, these “explanations” for assuming non-use of",
        "paragraph_id": "para_563"
      },
      {
        "text": "PPE are remarkably self-contradictory.",
        "paragraph_id": "para_564"
      },
      {
        "text": "In sum, EPA’s turnabout on the use of PPE not only refused to",
        "paragraph_id": "para_565"
      },
      {
        "text": "consider a significant “condition of use,” but the agency also pivoted without",
        "paragraph_id": "para_566"
      },
      {
        "text": "“reasoned explanation . . . for disregarding facts and circumstances that",
        "paragraph_id": "para_567"
      },
      {
        "text": "underlay . . . [the] prior policy.” BNSF Ry. Co. v. Fed. R.R. Admin., 105 F.4th",
        "paragraph_id": "para_568"
      },
      {
        "text": "691, 700 (5th Cir. 2024) (quoting FCC v. Fox Television Stations, Inc., 556",
        "paragraph_id": "para_569"
      },
      {
        "text": "U.S. 502, 515–16, 129 S. Ct. 1800, 1811 (2009)). Further, its speculation that",
        "paragraph_id": "para_570"
      },
      {
        "text": "workers may not be using PPE lacked evidence, contrary to the TSCA’s",
        "paragraph_id": "para_571"
      },
      {
        "text": "“particularly demanding” standard of substantial evidence. See 15 U.S.C.",
        "paragraph_id": "para_572"
      },
      {
        "text": "§ 2618(c)(1)(B)(i); Corrosion Proof Fittings v. EPA, 947 F.2d 1201, 1213–14",
        "paragraph_id": "para_573"
      },
      {
        "text": "(5th Cir. 1991); Chem. Mfrs. Ass’n, 859 F.2d 977, 991–92; Ausimont U.S.A.,",
        "paragraph_id": "para_574"
      },
      {
        "text": "Inc. v. EPA, 838 F.2d 93, 96 (3d Cir. 1988). This new assumption was",
        "paragraph_id": "para_575"
      },
      {
        "text": "contrary to law, arbitrary and capricious, and lacked substantial evidence.",
        "paragraph_id": "para_576"
      },
      {
        "text": "EPA’s Legal Approach to “Unreasonable Risk”",
        "paragraph_id": "para_577"
      },
      {
        "text": "Industry Petitioners also submit that EPA’s approach to evaluating",
        "paragraph_id": "para_578"
      },
      {
        "text": "risk did not square with its statutory mandate to identify only",
        "paragraph_id": "para_579"
      },
      {
        "text": "“unreasonable” risks and to regulate to “to the extent necessary” to",
        "paragraph_id": "para_580"
      },
      {
        "text": "eliminate “such [unreasonable] risks.” According to the Petitioners, EPA",

      },

        "text": "similarity raises a real question whether EPA properly distinguished between",

        "text": "“unreasonable risk” in regulating under the TSCA and the precautionary",

        "text": "principle adopted by other statutes. “Unreasonable risk” does not",

        "text": "As the D.C. Circuit held, courts must not infer a precautionary",

        "text": "baseline set by the statute. Here, Congress insisted that the baseline be",
        "paragraph_id": "para_656"
      },
      {
        "text": "determined in light of numerous additional statutory provisions that",
        "paragraph_id": "para_657"
      },
      {
        "text": "expressly counsel EPA, inter alia, how to apply the science, how to gauge",
        "paragraph_id": "para_658"
      },
      {
        "text": "reliability of findings, and how to maintain transparency of agency",
        "paragraph_id": "para_659"
      },
      {
        "text": "decisionmaking. See 15 U.S.C. § 2625. “Unreasonable risk” summarizes the",
        "paragraph_id": "para_660"
      },
      {
        "text": "legal conclusion that must be drawn from those parameters; it is not a cover",
        "paragraph_id": "para_661"
      },
      {
        "text": "for whatever numerical estimates EPA generates using the parameters.",
        "paragraph_id": "para_662"
      },

        "text": "After Loper Bright, of course, courts are the “independent”",
        "paragraph_id": "para_663"
      },

        "text": "interpreters of statutory language. Loper Bright, 603 U.S. at 406, 144 S. Ct.",

        "text": "at 2269. In that capacity, the Supreme Court had no trouble construing the",

        "text": "statutory term “undue hardship” in Title VII. Groff v. DeJoy, 600 U.S. 447,",

      {
        "text": "risk-avoidance measures operate “to the extent necessary” to eliminate",

      },
      {
        "text": "unreasonable risks. 15 U.S.C. § 2605(a).",
        "paragraph_id": "para_684"
      },
      {
        "text": "EPA’s Methodological Approach to “Unreasonable Risk”",
        "paragraph_id": "para_685"
      },
      {
        "text": "The Industry Petitioners also take aim at the agency’s assumptions",
        "paragraph_id": "para_686"
      },
      {
        "text": "and findings in the final risk determination and the menu of regulatory",
        "paragraph_id": "para_687"
      },
      {
        "text": "measures required to eliminate “unreasonable risk” “to the extent",
        "paragraph_id": "para_688"
      },
      {
        "text": "necessary.” Id. For these issues, the question is whether EPA’s decisions",
        "paragraph_id": "para_689"
      },
      {
        "text": "are arbitrary and capricious under the APA and supported by substantial",
        "paragraph_id": "para_690"
      },
      {
        "text": "evidence on the record as a whole under the TSCA.",
        "paragraph_id": "para_691"
      },
      {
        "text": "As has been noted, EPA followed its standard methodology for",
        "paragraph_id": "para_692"
      },
      {
        "text": "regulation of toxic substances in estimating whether MC poses an",
        "paragraph_id": "para_693"
      },
      {
        "text": "unreasonable risk to human health. See 15 U.S.C. § 2605(b)(4); 40 C.F.R.",
        "paragraph_id": "para_694"
      },
      {
        "text": "702.39(a) (2026). It undertook a four-part study, including a “[h]azard",
        "paragraph_id": "para_695"
      },
      {
        "text": "[a]ssessment,” an “[e]xposure [a]ssessment,” a “[r]isk [c]haracterization”",
        "paragraph_id": "para_696"
      },
      {
        "text": "and a “[r]isk [d]etermination.” 40 C.F.R. 702.39(a) (2026).",

        "text": "Oversimplifying a description of the methodology for present",

        "text": "The “exposure assessment” estimated, for each condition of use, the",
        "paragraph_id": "para_702"
      },
      {
        "text": "amount of MC to which workers and “occupational non-users” (including",
        "paragraph_id": "para_703"
      },
      {
        "text": "men and women of reproductive age, and adolescents) may be exposed in",
        "paragraph_id": "para_704"
      },
      {

        "text": "with points of departure (“PODs”), the estimates of the exposure that would",

        "text": "yield a lowest-observed-adverse-effect level (“LOAEL”) in humans or a no-",

        "text": "The result of that comparison was deemed the “margin of exposure,” and it",

        "text": "estimated exposure to parts per million of MC in the air inhaled by workers.",

        "text": "The “margin of exposure” comparison, in turn, was divided by an",
        "paragraph_id": "para_721"
      },
      {
        "text": "estimated “benchmark margin of exposure.” This is a fudge factor. The",
        "paragraph_id": "para_722"
      },
      {
        "text": "benchmark MOE constituted a “composite uncertainty factor” reducing the",
        "paragraph_id": "para_723"
      },
      {
        "text": "estimated “points of departure.” The benchmark margin of error was the",
        "paragraph_id": "para_724"
      },
      {
        "text": "product of multiplying a series of numbers designed to account for various",
        "paragraph_id": "para_725"
      },
      {
        "text": "scientific uncertainties ranging from potential shortcomings in the data and",
        "paragraph_id": "para_726"
      },
      {
        "text": "intraspecies and interspecies variations in sensitivity, as well as “the",
        "paragraph_id": "para_727"
      },
      {
        "text": "uncertainty in extrapolating from a [LOAEL] rather than from a NOAEL.”9",

      {

        "text": "benchmark margin of error, whatever its size, reduced the “points of",

        "text": "EPA applied this comparative process, inter alia, to characterize the",
        "paragraph_id": "para_732"
      },
      {
        "text": "human health risks associated with specific exposure scenarios, principally",
        "paragraph_id": "para_733"
      },
      {

        "text": "How this methodology, rife with estimates and uncertainties, applied",

      },

        "text": "in practice to MC, and the Industry Petitioners’ challenges, must be",

      },
      {
        "text": "discussed separately for acute and chronic levels of exposure.",
        "paragraph_id": "para_754"
      },
      {
        "text": "Acute Exposure Limit",
        "paragraph_id": "para_755"
      },
      {
        "text": "When EPA issued the MC Rule, it fixed a fifteen-minute acute",
        "paragraph_id": "para_756"
      },
      {
        "text": "exposure limit at 16 ppm for the few conditions of use that it continued to",
        "paragraph_id": "para_757"
      },
      {
        "text": "allow. OSHA’s comparable limit, as noted, is 125 ppm. How did EPA arrive",
        "paragraph_id": "para_758"
      },
      {
        "text": "at this low figure?",
        "paragraph_id": "para_759"
      },
      {
        "text": "EPA began with a fifteen-minute point of departure at 478 ppm. This",
        "paragraph_id": "para_760"
      },
      {
        "text": "figure was based on a double-blind study of twelve humans (the “Putz",
        "paragraph_id": "para_761"
      },
      {
        "text": "study”) who suffered temporary modest impairment (around 7% reduction)",
        "paragraph_id": "para_762"
      },
      {
        "text": "to their peripheral vision about ninety minutes after they were exposed to 195",
        "paragraph_id": "para_763"
      },
      {
        "text": "ppm MC. EPA used an equation to convert 195 ppm over ninety minutes to",
        "paragraph_id": "para_764"
      },
      {
        "text": "a comparable fifteen-minute amount. The Putz study’s points of departure,",

        "text": "and the anticipated exposure levels under each condition of use, were used",

        "text": "to calculate the margins of error for acute inhalation.",

        "text": "For the benchmark margin of error for acute inhalation, EPA chose an",

        "text": "uncertainty factor of ten to account for variability among humans (i.e.,",

        "text": "studies producing an LOAEL, which EPA considers to be less accurate than",

        "text": "an NOAEL.11 EPA multiplied these individual uncertainty factors to arrive",
        "paragraph_id": "para_784"
      },
      {
        "text": "at a composite uncertainty factor (and thus benchmark margin of error) of",
        "paragraph_id": "para_785"

      {

        "text": "In the June 2020 final risk evaluation, these numbers yielded",

        "text": "use that it allowed to continue.",

        "text": "As the Industry Petitioners explain, extrapolating its acute exposure",
        "paragraph_id": "para_793"
      },
      {
        "text": "limit from the Putz study involved three critical assumptions that",
        "paragraph_id": "para_794"
      },
      {
        "text": "dramatically affected the overall risk assessment. First, Putz’s study found",
        "paragraph_id": "para_795"
      },
      {
        "text": "minimal impairments to its participants—a temporary 7% decrease in",
        "paragraph_id": "para_796"
      },
      {
        "text": "peripheral vision—after four hours’ exposure to 195 ppm MC. Far from",
        "paragraph_id": "para_797"
      },
      {
        "text": "being an “unreasonably risky” exposure, the adverse health effects observed",
        "paragraph_id": "para_798"
      },
      {
        "text": "in the study were small to begin with, as the EPA acknowledges. Second, in",
        "paragraph_id": "para_799"
      },
      {
        "text": "adjusting the 15-minute exposure by a benchmark margin of error, the agency",
        "paragraph_id": "para_800"
      },
      {
        "text": "decreased it by a factor of 3 based on the difference between the LOAEL",
        "paragraph_id": "para_801"
      },
      {
        "text": "result in the Putz study and the EPA’s favored NOAEL method. In other",

        "text": "again decreased the 15-minute exposure by a benchmark factor of 10 to",

        "text": "account for “interspecies variability,” that is, the possibility that extremely",
        "paragraph_id": "para_815"
      },
      {
        "text": "sensitive individuals like smokers or people with heart disease might",
        "paragraph_id": "para_816"
      },
      {
        "text": "experience the temporary limit in peripheral vision at much lower MC",
        "paragraph_id": "para_817"
      },
      {
        "text": "concentrations. On their face, it is hard to reconcile these downward",
        "paragraph_id": "para_818"
      },
      {
        "text": "extrapolations with this court’s reminder that “[r]educing risk to",
        "paragraph_id": "para_819"
      },
      {
        "text": "zero . . . was not the task that Congress set for the EPA in enacting TSCA.”",
        "paragraph_id": "para_820"
      },
      {
        "text": "Corrosion Proof Fittings, 947 F.2d at 1217.",
        "paragraph_id": "para_821"
      },
      {
        "text": "EPA’s acute exposure conclusion runs afoul of the TSCA’s more",
        "paragraph_id": "para_822"
      },
      {
        "text": "stringent substantial evidence standard. Recall that the standard, reflecting",
        "paragraph_id": "para_823"
      },
      {
        "text": "the parameters placed on the agency to determine “unreasonable risk of",
        "paragraph_id": "para_824"
      },
      {
        "text": "injury to health,” 15 U.S.C. § 2605(b)(4)(A), requires the agency decision to",
        "paragraph_id": "para_825"
      },
      {
        "text": "be “based upon the entire record, taking into account whatever in the record",
        "paragraph_id": "para_826"
      },
      {
        "text": "detracts from the weight of the agency’s decision.” Corrosion Proof Fittings,",
        "paragraph_id": "para_827"
      },
      {
        "text": "947 F.2d at 1213. Yet EPA relied exclusively on the Putz study, which",
        "paragraph_id": "para_828"
      },
      {
        "text": "observed twelve humans who were exposed to 195 ppm MC for four hours.",
        "paragraph_id": "para_829"
      },
      {
        "text": "EPA maintains that vision impairments observed in the Putz study indicate",
        "paragraph_id": "para_830"
      },
      {
        "text": "nervous-system depression, which is a “precursor” to incapacitation and",
        "paragraph_id": "para_831"
      },
      {
        "text": "death. In plain language, a “precursor” is not in itself an “adverse health",
        "paragraph_id": "para_832"
      },
      {
        "text": "effect.” Moreover, EPA even admitted this was a “small magnitude” effect",
        "paragraph_id": "para_833"
      },
      {
        "text": "and never explained how that risk could be unreasonable.",
        "paragraph_id": "para_834"
      },
      {
        "text": "In addition, EPA discounted another relevant study, the “Winneke",
        "paragraph_id": "para_835"
      },
      {
        "text": "study,” which observed minimal adverse health effects in individuals who",
        "paragraph_id": "para_836"
      },
      {
        "text": "were exposed to 500 ppm MC for 3.8 hours. EPA criticizes the Winneke",
        "paragraph_id": "para_837"
      },
      {
        "text": "study on various grounds and emphasizes other results from the Putz study",
        "paragraph_id": "para_838"
      },
      {
        "text": "that it interprets as evidence of risks to human health: after four hours of",
        "paragraph_id": "para_839"
      },

        "text": "exposure, the participants exhibited a thirty-six-percent reduction in hand-",

        "text": "EPA’s response does not alleviate concerns that its analysis",
        "paragraph_id": "para_847"
      },
      {
        "text": "overlooked important information undermining its conclusions. This is not",
        "paragraph_id": "para_848"
      },
      {
        "text": "to say that the Putz study should not have factored into EPA’s risk",
        "paragraph_id": "para_849"
      },
      {
        "text": "determination or other conclusions. The problem is that EPA placed",
        "paragraph_id": "para_850"
      },
      {
        "text": "exclusive reliance on a study of twelve people just because it deemed that",
        "paragraph_id": "para_851"
      },
      {
        "text": "study the “best.” Yet EPA has not shown that the Winneke study was so",
        "paragraph_id": "para_852"
      },
      {
        "text": "worthless as to be properly excluded. Indeed, Winneke’s participants were",
        "paragraph_id": "para_853"
      },
      {
        "text": "exposed to as much as 800 ppm MC without experiencing severe health",
        "paragraph_id": "para_854"
      },
      {
        "text": "effects. Common sense suggests that as researchers, neither Putz nor",
        "paragraph_id": "para_855"
      },
      {
        "text": "Winneke would have knowingly subjected humans to MC concentrations of",
        "paragraph_id": "para_856"
      },
      {
        "text": "195 or 500 ppm for several hours if they had expected serious health effects.",
        "paragraph_id": "para_857"
      },
      {
        "text": "Another study by Soden involved workers who were subject to 475 ppm for",
        "paragraph_id": "para_858"
      },
      {
        "text": "8 hours daily over at least ten years. Soden reported no deaths or adverse",
        "paragraph_id": "para_859"
      },
      {
        "text": "health effects. Ignoring all these commonsense indicators of exposures",
        "paragraph_id": "para_860"
      },
      {
        "text": "amounting to less than “unreasonable risk,” EPA concluded that a mere 16",
        "paragraph_id": "para_861"
      },
      {
        "text": "ppm is the maximum exposure allowed for 15 minutes.",
        "paragraph_id": "para_862"
      },
      {
        "text": "A few workers have perished when exposed to MC in much higher",
        "paragraph_id": "para_863"
      },
      {
        "text": "concentrations. EPA’s final risk evaluation listed about a dozen fatalities in",
        "paragraph_id": "para_864"
      },
      {
        "text": "situations involving exposure to concentrations of at least 1711 ppm, near the",
        "paragraph_id": "para_865"
      },
      {
        "text": "2,300 ppm concentration level rated “immediately dangerous to life or",
        "paragraph_id": "para_866"
      },
      {
        "text": "health.” And OSHA has had a standard in place for a quarter century setting",
        "paragraph_id": "para_867"
      },
      {
        "text": "a maximum MC exposure of 125 ppm for acute exposure. Indeed, OSHA",
        "paragraph_id": "para_868"
      },
      {
        "text": "ratified this limit after reconsidering it in 2010. EPA paid no attention to the",
        "paragraph_id": "para_869"
      },
      {
        "text": "OSHA standard in selecting its own acute exposure limit at nearly one-tenth",
        "paragraph_id": "para_870"
      },
      {
        "text": "of the OSHA standard.",

        "paragraph_id": "para_876",

        "text": "the actual “immediately dangerous” standard compel the conclusion that",
        "paragraph_id": "para_877"
      },
      {
        "text": "EPA’s ratcheting the maximum acute exposure down to 16 ppm was",
        "paragraph_id": "para_878"
      },
      {
        "text": "substantially below the base for an “unreasonable risk” to human health.",
        "paragraph_id": "para_879"
      },
      {
        "text": "Because EPA’s methodological assumptions were excessively conservative,",
        "paragraph_id": "para_880"
      },
      {
        "text": "and it failed to sufficiently account for contradictory evidence, we hold that",
        "paragraph_id": "para_881"
      },
      {
        "text": "its fifteen-minute exposure limit is not supported by substantial evidence.",
        "paragraph_id": "para_882"
      },
      {
        "text": "Chronic Exposure Limit",
        "paragraph_id": "para_883"
      },
      {
        "text": "Based on one rat study, and discounting several studies of humans",
        "paragraph_id": "para_884"
      },
      {
        "text": "exposed to MC in the workplace, EPA arrived at a maximum chronic",
        "paragraph_id": "para_885"
      },
      {
        "text": "exposure limit of 2 ppm/8-hour working day. OSHA’s comparable limit has",
        "paragraph_id": "para_886"
      },
      {
        "text": "been 25 ppm—over ten times higher—for over a quarter century.",
        "paragraph_id": "para_887"
      },
      {
        "text": "Characterizing the risks from chronic inhalation of MC proved less",
        "paragraph_id": "para_888"
      },
      {
        "text": "straightforward and even more attenuated than its process to determine the",
        "paragraph_id": "para_889"
      },
      {
        "text": "acute exposure limit.",
        "paragraph_id": "para_890"
      },
      {
        "text": "For acute exposures, EPA extrapolated the point of departure from a",
        "paragraph_id": "para_891"
      },
      {
        "text": "study of 180 female rats (the “Nitschke study”) that exhibited liver",
        "paragraph_id": "para_892"
      },
      {
        "text": "irregularities, such as lesions, after being exposed to 500 ppm MC for six",
        "paragraph_id": "para_893"
      },
      {
        "text": "hours a day for two years. They experienced no such irregularities, however,",
        "paragraph_id": "para_894"
      },
      {
        "text": "when exposure was capped at 200 ppm. To fix the point of departure, EPA",
        "paragraph_id": "para_895"
      },
      {
        "text": "started with the Nitschke study, estimating the amount of MC that might",
        "paragraph_id": "para_896"
      },
      {
        "text": "generate a ten-percent risk of liver irregularities in rats. Then, EPA applied",
        "paragraph_id": "para_897"
      },
      {
        "text": "a “physiological-based pharmacokinetic model” to its most conservative",
        "paragraph_id": "para_898"
      },
      {
        "text": "estimate (i.e., the first percentile) to calculate a “human-equivalent",
        "paragraph_id": "para_899"
      },
      {
        "text": "concentration” of MC that might produce similar liver irregularities in",
        "paragraph_id": "para_900"
      },
      {
        "text": "humans over a working lifetime of exposure.",
        "paragraph_id": "para_901"
      },
      {
        "text": "Next, EPA calculated a margin of error by dividing the human-",
        "paragraph_id": "para_902"
      },
      {
        "text": "equivalent concentration by the estimated actual exposure to MC over a",
        "paragraph_id": "para_903"
      },
      {

        "paragraph_id": "para_908",

        "text": "error was calculated by multiplying individual uncertainty factors. EPA",
        "paragraph_id": "para_909"
      },
      {
        "text": "chose two uncertainty factors of three to account for both intraspecies",
        "paragraph_id": "para_910"
      },
      {
        "text": "(between rats and humans) and interspecies variability.12 There was no",
        "paragraph_id": "para_911"
      },
      {
        "text": "reason to apply an LOAEL-to-NOAEL uncertainty factor for chronic",
        "paragraph_id": "para_912"
      },
      {
        "text": "inhalation because the Nitschke study produced an NOAEL. The ultimate",
        "paragraph_id": "para_913"
      },
      {
        "text": "result was a composite uncertainty factor (or benchmark margin of error) of",
        "paragraph_id": "para_914"
      },
      {
        "text": "ten (i.e., 3 x 3 rounded up). Had EPA fixed the maximum exposure limit in",
        "paragraph_id": "para_915"
      },
      {
        "text": "the conventional way, by dividing the point of departure by the benchmark",
        "paragraph_id": "para_916"
      },
      {
        "text": "margin of error, it would have yielded an impossible limit of less than 0.5",
        "paragraph_id": "para_917"
      },
      {
        "text": "ppm. Instead, the agency increased the exposure limit to 2 ppm.13",
        "paragraph_id": "para_918"
      },
      {
        "text": "The Industry Petitioners contend that EPA’s reliance on a single",
        "paragraph_id": "para_919"
      },
      {
        "text": "flawed rat study was arbitrary and capricious. They point to three different",
        "paragraph_id": "para_920"
      },
      {
        "text": "epidemiological studies of humans that evaluated possible liver toxicity from",
        "paragraph_id": "para_921"
      },
      {
        "text": "sustained MC exposure. These studies, submitted during the notice and",
        "paragraph_id": "para_922"
      },
      {
        "text": "comment phase of proceedings, observed workers who were exposed to MC",
        "paragraph_id": "para_923"
      },
      {
        "text": "on a regular basis. In two of the studies, the median exposures were as high",
        "paragraph_id": "para_924"
      },
      {
        "text": "as 475 ppm, which is 240 times the level of EPA’s newly minted eight-hour",
        "paragraph_id": "para_925"
      },
      {
        "text": "exposure limit. EPA rated all three studies “medium quality” and described",
        "paragraph_id": "para_926"
      },
      {
        "text": "them as “acceptable.” This is not surprising, because EPA’s eight-hour",
        "paragraph_id": "para_927"
      },
      {
        "text": "exposure limit was also based on a study that EPA rated medium quality. One",
        "paragraph_id": "para_928"
      },
      {
        "text": "public commenter retained Dr. Jonathon Borak, Clinical Professor of",
        "paragraph_id": "para_929"
      },
      {
        "text": "Medicine at Yale University and a faculty member of the Yale Occupational",
        "paragraph_id": "para_930"
      },
      {
        "text": "_____________________",

        "text": "exposure to MC causes liver toxicity in workers. Dr. Borak concluded from",
        "paragraph_id": "para_944"
      },
      {
        "text": "his review that “the three studies . . . provide no evidence of hepatic effects,",
        "paragraph_id": "para_945"
      },
      {
        "text": "even at exposures for longer than 10 years at levels nearly 20-fold greater than",
        "paragraph_id": "para_946"
      },
      {
        "text": "the current OSHA [eight-hour exposure limit] of 25 ppm. They also contain",
        "paragraph_id": "para_947"
      },
      {
        "text": "no evidence of dose-related hepatic effects of exposures.”",
        "paragraph_id": "para_948"
      },
      {
        "text": "EPA’s response to the human epidemiological studies is inadequate.",
        "paragraph_id": "para_949"
      },
      {
        "text": "It contends that two of the studies showed increased bilirubin in blood, and",
        "paragraph_id": "para_950"
      },
      {
        "text": "that such increases are a biological concern that could indicate the potential",
        "paragraph_id": "para_951"
      },
      {
        "text": "for liver disease in humans. But increased bilirubin is not a necessary or",
        "paragraph_id": "para_952"
      },
      {
        "text": "sufficient marker for adverse liver conditions, and it has many possible",
        "paragraph_id": "para_953"
      },
      {
        "text": "causes. Increased bilirubin therefore does not signal unreasonable risk to",
        "paragraph_id": "para_954"
      },
      {
        "text": "human health. EPA also argues that it need not factor any of the human",
        "paragraph_id": "para_955"
      },
      {
        "text": "epidemiological studies into its exposure limits because it found “these data",
        "paragraph_id": "para_956"
      },
      {
        "text": "don’t provide clear evidence of adverse liver effects.” But isn’t that a finding",
        "paragraph_id": "para_957"
      },
      {
        "text": "worthy of note? It was irrational for EPA to ignore evidence contrary to its",
        "paragraph_id": "para_958"
      },
      {
        "text": "presuppositions. Third, and closely related to this non-finding that it chose",
        "paragraph_id": "para_959"
      },
      {
        "text": "to ignore, EPA did not respond to (much less wrestle with) Dr. Borak’s",
        "paragraph_id": "para_960"
      },
      {
        "text": "analysis. See Perez v. Mortg. Bankers Ass’n, 575 U.S. 92, 96, 135 S. Ct. 1199,",
        "paragraph_id": "para_961"
      },
      {
        "text": "1203 (2015) (“An agency must consider and respond to significant comments",
        "paragraph_id": "para_962"
      },
      {
        "text": "received during the period for public comment”).",
        "paragraph_id": "para_963"
      },
      {
        "text": "Instead, EPA relied exclusively on the Nitschke study involving rats,",
        "paragraph_id": "para_964"
      },
      {
        "text": "but the Nitschke study was far from perfect. In addition, the rats suffered no",
        "paragraph_id": "para_965"
      },
      {
        "text": "adverse effect (NOAEL) when exposed to 200 ppm, far in excess of what",
        "paragraph_id": "para_966"
      },
      {
        "text": "EPA purports to permit for humans. And just as elevated bilirubin has little",
        "paragraph_id": "para_967"
      },
      {
        "text": "bearing on unreasonable risk, likewise the “liver vacuolation” that Nitschke",
        "paragraph_id": "para_968"
      },
      {
        "text": "observed—at 500 ppm exposure in a small rodent rather than a smaller dose",
        "paragraph_id": "para_969"
      },
      {
        "text": "in a human—was considered by EPA only a “precursor of toxicity.” These",

        "text": "ideal rat study could hardly justify EPA in entirely discarding three",
        "paragraph_id": "para_976"
      },
      {
        "text": "“acceptable” human epidemiological studies.",
        "paragraph_id": "para_977"
      },
      {
        "text": "We have encountered this sort of issue before. See Gulf S. Insulation",
        "paragraph_id": "para_978"
      },
      {
        "text": "v. U.S. Consumer Prod. Safety Comm’n, 701 F.2d 1137 (5th Cir. 1983). There,",
        "paragraph_id": "para_979"
      },
      {
        "text": "the Consumer Product Safety Commission (“CPSC”), charged with",
        "paragraph_id": "para_980"
      },
      {
        "text": "addressing “unreasonable risk of injury,” 15 U.S.C. § 2058(f)(3)(A),",
        "paragraph_id": "para_981"
      },
      {
        "text": "promulgated a prohibition on urea-formaldehyde foam insulation based on a",
        "paragraph_id": "para_982"
      },
      {
        "text": "determination that the material posed unreasonable risk of irritation and",
        "paragraph_id": "para_983"
      },
      {
        "text": "cancer. Gulf S. Insulation, 701 F.2d at 1139. “While the [CPSC] correctly",
        "paragraph_id": "para_984"
      },
      {
        "text": "note[d] that the epidemiologic evidence [was] not conclusive, its exclusive",
        "paragraph_id": "para_985"
      },
      {
        "text": "reliance on the Chemical Institute study [of 240 rats] . . . [was] equally",
        "paragraph_id": "para_986"
      },
      {
        "text": "unsupportable.” Id. at 1146 (emphasis added). That is because “in a study",
        "paragraph_id": "para_987"
      },
      {

        "text": "study’s results, and only those results.” Id. Especially relevant here, it made",

        "text": "no difference that “the epidemiologic studies cited by the industry [did] not",
        "paragraph_id": "para_991"
      },
      {
        "text": "demonstrate conclusively that formaldehyde poses no cancer risk to man”",
        "paragraph_id": "para_992"
      },
      {
        "text": "because “it is not good science to rely on a single experiment.” Id. For these",
        "paragraph_id": "para_993"
      },
      {
        "text": "reasons, the court vacated CPSC’s prohibition on urea-formaldehyde foam",
        "paragraph_id": "para_994"
      },
      {
        "text": "insulation as unsupported by substantial evidence; the CPSC substantial-",
        "paragraph_id": "para_995"
      },
      {
        "text": "evidence standard was identical to the TSCA substantial-evidence standard.",
        "paragraph_id": "para_996"
      },
      {
        "text": "Id. at 1150. Industry Petitioners discussed this circuit precedent in their brief.",

      },
      {
        "text": "EPA did not respond.",
        "paragraph_id": "para_998"
      },
      {
        "text": "EPA’s eight-hour exposure limit is unsupported by substantial",
        "paragraph_id": "para_999"
      },
      {
        "text": "evidence and arbitrary and capricious for several reasons. First, EPA made",
        "paragraph_id": "para_1000"
      },
      {
        "text": "the same mistake as the CPSC. See also Johnson v. Arkema, Inc., 685 F.3d",

        "text": "human epidemiological studies, our case law has made clear that the",

        "text": "substantial evidence standard did not allow EPA to completely exclude those",
        "paragraph_id": "para_1014"
      },
      {
        "text": "results when it developed its exposure limits. See also Ctr. for Biological",
        "paragraph_id": "para_1015"
      },
      {
        "text": "Diversity v. Zinke, 900 F.3d 1053, 1068 (9th Cir. 2018) (invalidating an",
        "paragraph_id": "para_1016"
      },
      {
        "text": "endangered species listing because the agency “failed to account for” a",
        "paragraph_id": "para_1017"
      },
      {
        "text": "particular study). Significantly, the studies undermine EPA’s decision",
        "paragraph_id": "para_1018"
      },
      {
        "text": "because the observed workers, who were chronically exposed to MC,",
        "paragraph_id": "para_1019"
      },
      {
        "text": "showed, at most, potential, inconclusive hepatic effects without any serious",
        "paragraph_id": "para_1020"
      },
      {
        "text": "complications and without any signs of impaired liver function compared to",
        "paragraph_id": "para_1021"
      },
      {
        "text": "other employees. See Kenneth R. Foster, et al., Phantom Risk:",
        "paragraph_id": "para_1022"
      },
      {
        "text": "Scientific Inference and the Law 12 (1993) (“[H]igh-dose animal",
        "paragraph_id": "para_1023"
      },
      {
        "text": "studies are only one part of the toxicologic puzzle and their relevance to low",
        "paragraph_id": "para_1024"
      },
      {
        "text": "environmental exposures is indirect at best and possibly nil.”). EPA failed in",
        "paragraph_id": "para_1025"
      },
      {
        "text": "its duty to respond to “significant comments received during the period for",
        "paragraph_id": "para_1026"
      },
      {
        "text": "public comment.” Perez, 575 U.S. at 96, 135 S. Ct. at 1203; Chamber of Comm.",
        "paragraph_id": "para_1027"
      },
      {
        "text": "of U.S. v. SEC, 85 F.4th 760, 774 (5th Cir. 2023). And EPA failed to heed",
        "paragraph_id": "para_1028"
      },
      {
        "text": "the TSCA’s “more stringent” test for substantial evidence when it failed to",
        "paragraph_id": "para_1029"
      },
      {
        "text": "discuss conflicting evidence on the record.",
        "paragraph_id": "para_1030"
      },
      {
        "text": "EPA’s Conclusion on Unreasonable Risk",
        "paragraph_id": "para_1031"
      },
      {
        "text": "EPA’s risk analysis yielded extraordinarily small limits for both acute",
        "paragraph_id": "para_1032"
      },
      {
        "text": "and chronic exposures to MC. As the above discussion indicates, the",
        "paragraph_id": "para_1033"
      },
      {
        "text": "agency’s results lack epidemiological support, reflect selective use of data",
        "paragraph_id": "para_1034"
      },
      {
        "text": "and failures to consider alternative acceptable data, and were based on",
        "paragraph_id": "para_1035"
      },
      {
        "text": "unrealistic benchmark margins of error. In sum, the risk analysis did not",

        "text": "more closely approximate the precautionary principle than the statute’s",

      },
      {
        "text": "“unreasonable risk” standard. In sum, this analysis was arbitrary and",
        "paragraph_id": "para_1043"
      },
      {
        "text": "capricious, lacking substantial evidence, and contrary to law.",
        "paragraph_id": "para_1044"
      },
      {
        "text": "Regulating “To the Extent Necessary” to Remove Unreasonable Risk",
        "paragraph_id": "para_1045"
      },
      {
        "text": "Although it would be sufficient to vacate the MC Rule and remand to",
        "paragraph_id": "para_1046"
      },
      {
        "text": "EPA because of the Rule’s many shortcomings, we must also address the",
        "paragraph_id": "para_1047"
      },
      {
        "text": "agency’s aggressive decision to largely prohibit MC’s uses, rather than",
        "paragraph_id": "para_1048"
      },
      {
        "text": "approve or modestly revise the OSHA standards. The Industry Petitioners",
        "paragraph_id": "para_1049"
      },
      {
        "text": "do not assert that MC presents no “unreasonable risk.” Once legally",
        "paragraph_id": "para_1050"
      },
      {
        "text": "compliant standards of unreasonable risk are determined, EPA must follow",
        "paragraph_id": "para_1051"
      },
      {
        "text": "the menu of permissible regulations under the TSCA. The Industry",
        "paragraph_id": "para_1052"
      },
      {
        "text": "Petitioners properly raised issues concerning the limits of the agency’s",
        "paragraph_id": "para_1053"
      },
      {
        "text": "authority.",
        "paragraph_id": "para_1054"
      },
      {
        "text": "The TSCA outlines the limits of EPA authority after it has made an",
        "paragraph_id": "para_1055"
      },
      {
        "text": "unreasonable risk determination for a chemical in the conditions of use. EPA",
        "paragraph_id": "para_1056"
      },
      {
        "text": "“shall . . . apply” one or more of seven itemized measures “to the extent",
        "paragraph_id": "para_1057"
      },
      {
        "text": "necessary so that the chemical substance or mixture no longer presents",
        "paragraph_id": "para_1058"
      },
      {
        "text": "[unreasonable] risk . . . .” 15 U.S.C. § 2605(a) (emphasis added). Those",
        "paragraph_id": "para_1059"
      },
      {
        "text": "measures range from recordkeeping and notification duties to regulation of",
        "paragraph_id": "para_1060"
      },
      {
        "text": "the chemical or even outright prohibition. Id. § 2605(a)(1)-(7). Further, in",
        "paragraph_id": "para_1061"
      },
      {
        "text": "promulgating the requisite rule, EPA “shall consider” and “shall factor in,",
        "paragraph_id": "para_1062"
      },
      {
        "text": "to the extent practicable,” in addition to the chemical’s health and",
        "paragraph_id": "para_1063"
      },
      {
        "text": "environmental effects, the chemical’s “benefits” and the “reasonably",
        "paragraph_id": "para_1064"
      },
      {
        "text": "ascertainable economic consequences” of its rule. Id. § 2605(c)(2)(A), (B).",
        "paragraph_id": "para_1065"
      },
      {
        "text": "The statute twice states the necessity of considering one or more primary",
        "paragraph_id": "para_1066"
      },
      {
        "text": "alternatives to the regulated chemical as well as “technically and",
        "paragraph_id": "para_1067"
      },
      {
        "text": "economically feasible” and “reasonably available” substitute alternatives",
        "paragraph_id": "para_1068"
      },

        "text": "Thus, although the unreasonable risk determination itself must be",
        "paragraph_id": "para_1074"
      },
      {
        "text": "undertaken without considering costs or other nonrisk factors, 15 U.S.C.",
        "paragraph_id": "para_1075"
      },
      {
        "text": "§ 2605(b)(4), EPA’s available menu of options following that determination",
        "paragraph_id": "para_1076"
      },
      {
        "text": "reflects significant cost-benefit considerations. As the D.C. Circuit",
        "paragraph_id": "para_1077"
      },
      {
        "text": "emphasized in Maine Lobstermen’s, “[n]o more, no less” regulation is",
        "paragraph_id": "para_1078"
      },
      {
        "text": "authorized than “to the extent necessary” to relieve unreasonable risk. 70",
        "paragraph_id": "para_1079"
      },
      {
        "text": "F.4th at 595.",
        "paragraph_id": "para_1080"
      },
      {
        "text": "EPA misconceived its ameliorative role in two ways. First, EPA’s",
        "paragraph_id": "para_1081"
      },
      {
        "text": "stated basis for declaring a near-complete prohibition of MC, as opposed to",
        "paragraph_id": "para_1082"
      },
      {
        "text": "any more modest exposure limit, was unauthorized. Even if its unreasonable",
        "paragraph_id": "para_1083"
      },
      {
        "text": "risk determinations had not been unsound, EPA justified extraordinary",
        "paragraph_id": "para_1084"
      },
      {
        "text": "restriction of MC because its exposure limits “are significantly lower than",
        "paragraph_id": "para_1085"
      },
      {
        "text": "the [existing] OSHA [exposure limits], [and] there is a high degree of",
        "paragraph_id": "para_1086"
      },
      {
        "text": "uncertainty as to whether most industrial and commercial users will be able",
        "paragraph_id": "para_1087"
      },
      {
        "text": "to comply with such a level and thus whether the unreasonable risk would be",
        "paragraph_id": "para_1088"
      },
      {
        "text": "addressed.” EPA also expressed concern that without a ban, MC users",
        "paragraph_id": "para_1089"
      },
      {
        "text": "would continue trying unsuccessfully to satisfy the agency’s dramatically",
        "paragraph_id": "para_1090"
      },
      {
        "text": "reduced exposure limits, thereby risking harm to workers, and it regretted",
        "paragraph_id": "para_1091"
      },
      {
        "text": "“the potential for use of MC to increase in a sector that has already moved",
        "paragraph_id": "para_1092"
      },
      {
        "text": "away from it.” All of these speculative rationales misconstrue EPA’s",
        "paragraph_id": "para_1093"
      },
      {
        "text": "statutory authority. EPA cannot simply ban a chemical substance whenever",
        "paragraph_id": "para_1094"
      },
      {
        "text": "it is “uncertain” whether a risk will remain reasonable. Instead, EPA is",
        "paragraph_id": "para_1095"
      },
      {
        "text": "authorized to regulate “to the extent necessary” to eliminate actual,",
        "paragraph_id": "para_1096"
      },
      {
        "text": "identified “unreasonable risk.” 15 U.S.C. § 2605(a). See also Corrosion Proof",
        "paragraph_id": "para_1097"
      },
      {
        "text": "Fittings, 947 F.2d at 1227 (“Musings and conjecture are ‘not the stuff of",
        "paragraph_id": "para_1098"
      },
      {
        "text": "which substantial evidence is made.’” (quoting Aqua Slide ‘N’ Dive Corp. v.",
        "paragraph_id": "para_1099"
      },
      {

        "text": "To be sure, EPA offered companies a chance to comment and show",
        "paragraph_id": "para_1105",
        "court_paragraph": 35
      },
      {
        "text": "that they could meet its newly promulgated exposure limits, and many",
        "paragraph_id": "para_1106"
      },
      {
        "text": "regulated parties did not comment. But allowing an absence of comments to",
        "paragraph_id": "para_1107"
      },
      {
        "text": "support EPA’s prohibition improperly shifted the burden to the regulated",
        "paragraph_id": "para_1108"
      },
      {
        "text": "entities to prove that they could comply. The TSCA, however, plainly",
        "paragraph_id": "para_1109"
      },
      {
        "text": "requires EPA itself to bear the burden of showing a risk is unreasonable or a",
        "paragraph_id": "para_1110"
      },
      {
        "text": "remedial measure “to the extent necessary” eliminates unreasonable risk. 15",
        "paragraph_id": "para_1111"
      },
      {
        "text": "U.S.C. § 2605(a). An absence of comments is also not particularly probative",
        "paragraph_id": "para_1112"
      },
      {
        "text": "given EPA’s admission that “there may be some . . . facilities that could . . .",
        "paragraph_id": "para_1113"
      },
      {
        "text": "ensure that exposures remain below the [exposure limits].” The agency",
        "paragraph_id": "para_1114"
      },
      {
        "text": "similarly falters in relying on OSHA’s issuance of forty-four citations",
        "paragraph_id": "para_1115"
      },
      {
        "text": "between October 2022 and September 2023 for violations of OSHA’s MC",
        "paragraph_id": "para_1116"
      },
      {
        "text": "exposure limits. The citations, EPA avers, show that “high” non-",
        "paragraph_id": "para_1117"
      },
      {
        "text": "compliance rates with the new exposure limits would fail to eliminate",
        "paragraph_id": "para_1118"
      },
      {
        "text": "unreasonable risk. But bare proof of citations demonstrates nothing because",
        "paragraph_id": "para_1119"
      },
      {
        "text": "EPA failed to discuss their nature (e.g., degree, willfulness, failure to keep",
        "paragraph_id": "para_1120"
      },
      {
        "text": "records, etc.).",
        "paragraph_id": "para_1121"
      },
      {
        "text": "Second, when EPA “decid[es] whether to prohibit or restrict in a",
        "paragraph_id": "para_1122"
      },
      {
        "text": "manner that substantially prevents a specific condition of use of a chemical",
        "paragraph_id": "para_1123"
      },
      {
        "text": "substance,” the TSCA requires it to “consider, to the extent practicable,",
        "paragraph_id": "para_1124"
      },
      {
        "text": "whether technically and economically feasible alternatives . . . will be",
        "paragraph_id": "para_1125"
      },
      {
        "text": "reasonably available as a substitute.” Id. § 2605(c)(2)(C). Industry",
        "paragraph_id": "para_1126"
      },
      {
        "text": "Petitioners contend, and the record corroborates, that when considering",
        "paragraph_id": "para_1127"
      },
      {
        "text": "alternatives, EPA tended to focus exclusively on whether a chemical or",
        "paragraph_id": "para_1128"
      },
      {
        "text": "process performs the same or similar function as MC. More generally, EPA",
        "paragraph_id": "para_1129"
      },
      {
        "text": "admitted that it “did not find it practicable to consider alternative processes",
        "paragraph_id": "para_1130"
      },
      {
        "text": "that may be reasonably available as a substitute for methylene chloride when",
        "paragraph_id": "para_1131"
      },
      {
        "text": "the proposed prohibitions or restrictions would take effect.” But it was",
        "paragraph_id": "para_1132"
      },
      {
        "text": "“practicable” for EPA to take seriously numerous specific comments",
        "paragraph_id": "para_1133"
      },
      {

        "text": "explaining that there are no feasible alternatives to MC for many conditions",

        "text": "of use. Moreover, the agency repeatedly ignored tackling the economic",
        "paragraph_id": "para_1139"
      },
      {
        "text": "feasibility of alternative chemicals or processes. EPA did not account for",
        "paragraph_id": "para_1140"
      },
      {
        "text": "much higher costs and lower productivity, in addition to adverse",
        "paragraph_id": "para_1141"
      },
      {
        "text": "environmental consequences, associated with the adoption of alternatives to",
        "paragraph_id": "para_1142"
      },
      {
        "text": "MC. In this context, the “practicability” of alternatives bears on exactly",
        "paragraph_id": "para_1143"
      },
      {
        "text": "what remedial regulation EPA should formulate, given the wide range",
        "paragraph_id": "para_1144"
      },
      {
        "text": "permitted by the TSCA and the severe consequences of its draconian limits",
        "paragraph_id": "para_1145"
      },
      {
        "text": "on MC’s uses.",
        "paragraph_id": "para_1146"
      },
      {
        "text": "B. Sierra Club’s Challenges",
        "paragraph_id": "para_1147"
      },
      {
        "text": "The Sierra Club challenges the MC Rule from a different angle. It",
        "paragraph_id": "para_1148"
      },
      {
        "text": "argues that the MC Rule does not go far enough to eliminate unreasonable",
        "paragraph_id": "para_1149"
      },
      {
        "text": "risks because EPA’s risk analysis failed to adequately address risks to",
        "paragraph_id": "para_1150"
      },
      {
        "text": "(1) fenceline communities, (2) people whose genes make them more",
        "paragraph_id": "para_1151"
      },
      {
        "text": "susceptible to cancer, and (3) people who live at high elevation and are",
        "paragraph_id": "para_1152"
      },
      {
        "text": "subjected to ozone depletion. The agency’s principal response to these",
        "paragraph_id": "para_1153"
      },
      {
        "text": "challenges is that the MC Rule adequately protects vulnerable",
        "paragraph_id": "para_1154"
      },
      {
        "text": "subpopulations. Our vacating and remanding the MC Rule vitiates EPA’s",
        "paragraph_id": "para_1155"
      },
      {
        "text": "response to Sierra Club’s issues. We assess the group’s issues differently but",
        "paragraph_id": "para_1156"
      },
      {
        "text": "conclude that Sierra Club’s petition lacks merit.",
        "paragraph_id": "para_1157"
      },
      {
        "text": "1.",
        "paragraph_id": "para_1158"
      },
      {
        "text": "The Sierra Club argues that EPA violated the TSCA by failing to",
        "paragraph_id": "para_1159"
      },
      {
        "text": "“determine and eliminate unreasonable risks to fenceline communities,”",
        "paragraph_id": "para_1160"
      },
      {
        "text": "which might be exposed to MC through the water and air surrounding a",
        "paragraph_id": "para_1161"
      },
      {
        "text": "facility that emits MC. Some background is necessary. The TSCA requires",
        "paragraph_id": "para_1162"
      },
      {
        "text": "EPA, when developing the scope of a risk evaluation, to identify the hazards,",
        "paragraph_id": "para_1163"
      },
      {
        "text": "exposures, conditions of use, and potentially exposed subpopulations it",
        "paragraph_id": "para_1164"
      },
      {
        "text": "“expects to consider.” 15 U.S.C. § 2605(b)(4)(D) (emphasis added). The",

      },

        "paragraph_id": "para_1171"
      },
      {
        "text": "order to focus its analytical efforts on those exposures that are likely to",
        "paragraph_id": "para_1172"
      },
      {
        "text": "present the greatest concern.” 82 Fed. Reg. at 33729; see also 15 U.S.C.",
        "paragraph_id": "para_1173"
      },
      {
        "text": "§ 2605(b)(4)(B); 40 C.F.R. § 702 (2026). Accordingly, EPA excluded air",
        "paragraph_id": "para_1174"
      },
      {
        "text": "and drinking-water exposures from the scope of its initial risk evaluation.",
        "paragraph_id": "para_1175"
      },
      {
        "text": "In July 2020, the Sierra Club and other organizations filed suit to",
        "paragraph_id": "para_1176"
      },
      {
        "text": "challenge EPA’s initial determination that six of MC’s conditions of use pose",
        "paragraph_id": "para_1177"
      },
      {
        "text": "no unreasonable risk. Neighbors for Env’t Just v. EPA, No. 20-72091 (9th",
        "paragraph_id": "para_1178"
      },
      {
        "text": "Cir.). A year later, under the new Administration, EPA agreed to a remand",
        "paragraph_id": "para_1179"
      },
      {
        "text": "for the agency to reconsider its risk determination. EPA then followed a June",
        "paragraph_id": "para_1180"
      },
      {
        "text": "2021 policy document criticizing the risk evaluation for “failing to",
        "paragraph_id": "para_1181"
      },
      {
        "text": "consistently and comprehensively address potential exposures to potentially",
        "paragraph_id": "para_1182"
      },
      {
        "text": "exposed or susceptible subpopulations, including fenceline communities.”",

        "text": "Despite having previously excluded air and water exposure pathways",

        "text": "from the scope of its risk evaluation, EPA tried to allay Sierra Club’s and",
        "paragraph_id": "para_1185"
      },
      {
        "text": "others’ concerns by conducting a “screening-level” assessment to consider",
        "paragraph_id": "para_1186"
      },
      {
        "text": "whether MC might “present unreasonable risks to these communities.”",
        "paragraph_id": "para_1187"
      },
      {
        "text": "First, EPA prepared a Fenceline Assessment Methodology (“FAM”) to",
        "paragraph_id": "para_1188"
      },
      {
        "text": "govern its analysis of those potential risks. The FAM “uses reasonably",
        "paragraph_id": "para_1189"
      },
      {
        "text": "available data, information, and models to quantify environmental releases,",
        "paragraph_id": "para_1190"
      },
      {
        "text": "evaluate exposures to fenceline communities and characterize risks.” Then,",
        "paragraph_id": "para_1191"
      },
      {
        "text": "applying the FAM, EPA compared its fenceline risk estimates with tentative",
        "paragraph_id": "para_1192"
      },
      {
        "text": "benchmark levels to characterize fenceline risk. This research ultimately",
        "paragraph_id": "para_1193"
      },
      {
        "text": "demonstrated that most risk was adequately addressed by the MC Rule and",
        "paragraph_id": "para_1194"
      },
      {
        "text": "other statutes like the Clean Air Act, which regulates MC emissions.",
        "paragraph_id": "para_1195"
      },
      {
        "text": "EPA did not, however, amend the scope of its TSCA risk evaluation",
        "paragraph_id": "para_1196"
      },
      {
        "text": "to directly address whether such risks (including risk from “aggregate",
        "paragraph_id": "para_1197"
      },
      {

      {
        "text": "preferred to focus its evaluation on areas where it expected the most risk to",

        "text": "occur. See 15 U.S.C. § 2605(b)(4)(F)(ii) (requiring EPA to “describe whether",
        "paragraph_id": "para_1205"
      },
      {
        "text": "aggregate . . . exposures to a chemical substance . . . were considered”",
        "paragraph_id": "para_1206"
      },
      {
        "text": "(emphasis added)). When finalizing the MC Rule, EPA reiterated that the",
        "paragraph_id": "para_1207"
      },
      {
        "text": "FAM “was not developed for th[e] purpose” of making a TSCA",
        "paragraph_id": "para_1208"
      },
      {
        "text": "unreasonable-risk determination. MC Rule, 89 Fed. Reg. at 39284.",
        "paragraph_id": "para_1209"
      },
      {
        "text": "The Sierra Club argues that this truncated analysis is inadequate.",
        "paragraph_id": "para_1210"
      },
      {
        "text": "According to the Sierra Club, EPA cannot exclude an actual exposure",
        "paragraph_id": "para_1211"
      },
      {
        "text": "pathway from the risk evaluation because the TSCA requires EPA to",
        "paragraph_id": "para_1212"
      },
      {
        "text": "“conduct risk evaluations . . . to determine whether a chemical substance",
        "paragraph_id": "para_1213"
      },
      {
        "text": "presents an unreasonable risk of injury . . . to a potentially exposed or",
        "paragraph_id": "para_1214"
      },
      {
        "text": "susceptible subpopulation identified as relevant to the risk evaluation by the",
        "paragraph_id": "para_1215"
      },
      {
        "text": "Administrator, under the conditions of use.” 15 U.S.C. § 2605(b)(4)(A).",
        "paragraph_id": "para_1216"
      },
      {
        "text": "Responding to one of EPA’s arguments, the Sierra Club contends that EPA",
        "paragraph_id": "para_1217"
      },
      {
        "text": "need only state what it “expects to consider” in a risk evaluation because it",
        "paragraph_id": "para_1218"
      },
      {
        "text": "might not be possible for EPA to account for every condition of use at the",
        "paragraph_id": "para_1219"
      },
      {
        "text": "outset—not because EPA can exclude exposure pathways whenever it",
        "paragraph_id": "para_1220"
      },
      {
        "text": "chooses. See id. § 2605(b)(4)(D) (emphasis added). The Sierra Club relies",
        "paragraph_id": "para_1221"
      },
      {
        "text": "on Safer Chems., Healthy Fams. v. EPA, 943 F.3d 397, 419 (9th Cir. 2019), in",
        "paragraph_id": "para_1222"
      },
      {
        "text": "which the court held that language like “plans to consider” in EPA’s",
        "paragraph_id": "para_1223"
      },
      {
        "text": "procedural rule, no different from language like “expects to consider” in the",
        "paragraph_id": "para_1224"
      },
      {
        "text": "TSCA, “simply refers to the Agency’s role in determining what the",
        "paragraph_id": "para_1225"
      },
      {

        "text": "The Ninth Circuit’s decision is inapposite.15 First, that decision",

      {
        "text": "involved a challenge to EPA’s procedural rule, not a challenge to a specific",
        "paragraph_id": "para_1238"
      },
      {
        "text": "TSCA risk evaluation. Id. at 405. Also, “the words of a statute must be read",
        "paragraph_id": "para_1239"
      },
      {
        "text": "in their context and with a view to their place in the overall statutory",
        "paragraph_id": "para_1240"
      },
      {
        "text": "scheme.” West Virginia v. EPA, 597 U.S. 697, 721, 142 S. Ct. 2587, 2607",

      },
      {
        "text": "(2022) (internal quotation marks). For present purposes, EPA was required",
        "paragraph_id": "para_1242"
      },
      {
        "text": "to conclude its risk evaluation based on “reasonably available information.”",
        "paragraph_id": "para_1243"
      },
      {
        "text": "15 U.S.C. § 2625(k). Other TSCA provisions require EPA to carry out its",
        "paragraph_id": "para_1244"
      },
      {
        "text": "responsibilities using “scientific information, technical procedures,",
        "paragraph_id": "para_1245"
      },
      {
        "text": "measures, methods, protocols, methodologies, or models, employed in a",
        "paragraph_id": "para_1246"
      },
      {
        "text": "manner consistent with the best available science.” Id. § 2625(h). EPA must",
        "paragraph_id": "para_1247"
      },
      {
        "text": "consider, inter alia, the extent to which its methodologies are “reasonable for",
        "paragraph_id": "para_1248"
      },
      {
        "text": "and consistent with the intended use of the information,” whether",
        "paragraph_id": "para_1249"
      },
      {
        "text": "information is “relevant” for EPA’s decision, and the extent to which",
        "paragraph_id": "para_1250"
      },
      {
        "text": "“variability and uncertainty” are “evaluated and characterized.” Id.",
        "paragraph_id": "para_1251"
      },
      {
        "text": "The TSCA gave EPA a statutory deadline to conduct the risk",
        "paragraph_id": "para_1252"
      },
      {
        "text": "evaluation, and the Risk Evaluation Rule did not allow EPA to stop the clock",
        "paragraph_id": "para_1253"
      },
      {
        "text": "to gather more data. We cannot say that EPA is prohibited from excluding",
        "paragraph_id": "para_1254"
      },
      {
        "text": "exposure pathways and exposure types that it does not have a methodology",
        "paragraph_id": "para_1255"
      },
      {
        "text": "to accurately assess. EPA explained significant uncertainties inherent in the",
        "paragraph_id": "para_1256"
      },
      {
        "text": "_____________________",

      {
        "text": "15 This is not to say whether we agree with the Ninth Circuit’s reading of the",

      {
        "text": "Administrator expects to consider . . . ,” 15 U.S.C. § 2605(b)(4)(B), the more general",

      {
        "text": "statutory directives refer to such a group “identified as relevant . . . by the Administrator",
        "paragraph_id": "para_1262"
      },
      {
        "text": "under the conditions of use.” See, e.g., 15 U.S.C. § 2605(b)(4)(A). We leave this debate",

        "paragraph_id": "para_1270"
      },
      {
        "text": "that it acknowledged “likely overestimate[] actual air emissions.” A fair",
        "paragraph_id": "para_1271"
      },
      {
        "text": "reading of the TSCA leaves ample latitude for EPA to exclude certain",
        "paragraph_id": "para_1272"
      },
      {
        "text": "exposure pathways when the science or methodology is not developed.",
        "paragraph_id": "para_1273"
      },
      {
        "text": "The Sierra Club’s other arguments concerning fenceline communities",
        "paragraph_id": "para_1274"
      },
      {
        "text": "likewise fail. First, the Sierra Club claims that EPA violated the TSCA by",
        "paragraph_id": "para_1275"
      },
      {
        "text": "“fail[ing] to eliminate the elevated risks it identified in its fenceline",
        "paragraph_id": "para_1276"
      },
      {
        "text": "assessment.” But EPA is not authorized to address “elevated” risk, only",
        "paragraph_id": "para_1277"
      },
      {
        "text": "“unreasonable” risk. 15 U.S.C. § 2605(b)(4)(A). This court’s case law is",
        "paragraph_id": "para_1278"
      },
      {
        "text": "clear that “unreasonable” risk is not “no risk” because Congress “did not",
        "paragraph_id": "para_1279"
      },
      {
        "text": "enact TSCA as a zero-risk statute.” Corrosion Proof Fittings, 947 F.2d at 1215.",
        "paragraph_id": "para_1280"
      },
      {
        "text": "Second, the Sierra Club argues that EPA arbitrarily retreated from “past",
        "paragraph_id": "para_1281"
      },
      {
        "text": "positions and current guidance” on evaluating fenceline risk, because EPA",
        "paragraph_id": "para_1282"
      },
      {
        "text": "identified some risk, but it did not pursue one of five proposed options for",
        "paragraph_id": "para_1283"
      },
      {
        "text": "following up on potential risks outlined in the FAM. But the FAM is not a",
        "paragraph_id": "para_1284"
      },
      {
        "text": "“settled policy” for which EPA must give a “reasoned explanation” before",
        "paragraph_id": "para_1285"
      },
      {
        "text": "departing from it. See Noranda Alumina, L.L.C. v. Perez, 841 F.3d 661, 665",
        "paragraph_id": "para_1286"
      },
      {
        "text": "(5th Cir. 2016) (internal quotation marks). The FAM is marked “Public",
        "paragraph_id": "para_1287"
      },
      {
        "text": "Comment Draft — Do Not Cite or Quote,” and EPA has not finalized a",
        "paragraph_id": "para_1288"
      },
      {
        "text": "“proposed methodology.”",
        "paragraph_id": "para_1289"
      },
      {
        "text": "2.",
        "paragraph_id": "para_1290"
      },
      {
        "text": "The Sierra Club argues that EPA failed to consider whether MC poses",
        "paragraph_id": "para_1291"
      },
      {
        "text": "an unreasonable risk to people whose genetics make them more susceptible",
        "paragraph_id": "para_1292"
      },
      {
        "text": "to cancer from MC exposure. This issue fails. EPA acknowledged that",
        "paragraph_id": "para_1293"
      },
      {
        "text": "roughly one-third of the U.S. population is similarly genetically susceptible",
        "paragraph_id": "para_1294"
      },
      {
        "text": "to cancer. To account for that vulnerable subpopulation, EPA “rel[ied] on a",
        "paragraph_id": "para_1295"
      },
      {
        "text": "conservative [cancer risk] estimate for the general population” by basing its",
        "paragraph_id": "para_1296"
      },
      {

        "text": "“it is reasonable to expect that risk to the subpopulation is reflected within",
        "paragraph_id": "para_1302"
      },
      {
        "text": "the risks to the general population.” The Sierra Club offers no significant",
        "paragraph_id": "para_1303"
      },
      {
        "text": "response other than to resist EPA’s characterization of its estimate as",
        "paragraph_id": "para_1304"
      },
      {
        "text": "“conservative.” To the extent that Sierra Club argues EPA should have been",
        "paragraph_id": "para_1305"
      },
      {
        "text": "bound by the cancer risk quantification specified in the Clean Air Act (a 1 in",
        "paragraph_id": "para_1306"
      },
      {
        "text": "1-million risk), 42 U.S.C. § 7412(f)(2), it is wrong. The TSCA contains no",
        "paragraph_id": "para_1307"
      },
      {
        "text": "such directive. Moreover, the Clean Air Act’s rigid precautionary standard",
        "paragraph_id": "para_1308"
      },
      {
        "text": "is far afield of addressing no more than “unreasonable risk.” That said, we",
        "paragraph_id": "para_1309"
      },
      {
        "text": "do not opine on what level of carcinogenic risk coincides with an",
        "paragraph_id": "para_1310"
      },
      {
        "text": "“unreasonable risk.”",
        "paragraph_id": "para_1311"
      },
      {
        "text": "3.",
        "paragraph_id": "para_1312"
      },
      {
        "text": "The Sierra Club argues that EPA violated its obligations under the",
        "paragraph_id": "para_1313"
      },
      {
        "text": "TSCA to evaluate MC’s risks to health and the environment, 15 U.S.C.",
        "paragraph_id": "para_1314"
      },
      {
        "text": "§ 2605(b)(4)(A), and to “integrate and assess available information on",
        "paragraph_id": "para_1315"
      },
      {
        "text": "hazards and exposures,” id. § 2605(b)(4)(F)(i), because it did not evaluate",
        "paragraph_id": "para_1316"
      },
      {
        "text": "MC’s depletion of the ozone layer. Sierra Club lacks standing to challenge",
        "paragraph_id": "para_1317"
      },
      {
        "text": "EPA’s conclusions with respect to this alleged risk.",
        "paragraph_id": "para_1318"
      },
      {
        "text": "“Under Article III, federal courts do not adjudicate hypothetical or",
        "paragraph_id": "para_1319"
      },
      {
        "text": "abstract disputes.” TransUnion LLC v. Ramirez, 594 U.S. 413, 423, 141 S. Ct.",
        "paragraph_id": "para_1320"
      },
      {
        "text": "2190, 2203 (2021). To establish standing to sue, “a plaintiff must show (i)",
        "paragraph_id": "para_1321"
      },
      {
        "text": "that he suffered an injury in fact that is concrete, particularized, and actual or",
        "paragraph_id": "para_1322"
      },
      {
        "text": "imminent; (ii) that the injury was likely caused by the defendant; and (iii) that",
        "paragraph_id": "para_1323"
      },
      {
        "text": "the injury would likely be redressed by judicial relief.” Id. In particular, we",
        "paragraph_id": "para_1324"
      },
      {
        "text": "have noted that “[i]ncreased-risk [of harm] claims . . . often cannot satisfy",
        "paragraph_id": "para_1325"
      },
      {
        "text": "the ‘actual or imminent’ requirement” of standing.” Shrimpers & Fishermen",

      },
      {

        "text": "That is the problem for the Sierra Club’s claim. At bottom, the Sierra",

        "text": "Club argues that EPA’s allegedly inadequate regulation might lead to an",
        "paragraph_id": "para_1333"
      },
      {
        "text": "insufficient decrease in emissions of MC, which might survive long enough",
        "paragraph_id": "para_1334"
      },
      {
        "text": "in the atmosphere to break down atmospheric ozone, which might increase",
        "paragraph_id": "para_1335"
      },
      {
        "text": "the amount of ultraviolet radiation to which Sierra Club’s members are",
        "paragraph_id": "para_1336"
      },
      {
        "text": "exposed over a lifetime, which in turn might increase those members’ risk of",
        "paragraph_id": "para_1337"
      },
      {
        "text": "developing cancer. Each step in that causal chain is conjectural and even",
        "paragraph_id": "para_1338"
      },
      {
        "text": "unlikely because EPA already regulates MC emissions as a hazardous air",
        "paragraph_id": "para_1339"
      },
      {
        "text": "pollutant. See Clapper v. Amnesty Int’l USA, 568 U.S. 398, 410, 133 S. Ct.",
        "paragraph_id": "para_1340"
      },
      {
        "text": "1138, 1148 (2013) (“highly attenuated chain of possibilities” is not enough",
        "paragraph_id": "para_1341"
      },
      {
        "text": "for standing) (citations omitted). In short, the Sierra Club has failed to show",
        "paragraph_id": "para_1342"
      },
      {
        "text": "that there is a “substantial probability” that any of its members might be",
        "paragraph_id": "para_1343"
      },
      {
        "text": "injured. Nat. Res. Def. Council v. EPA, 464 F.3d 1, 6 (D.C. Cir. 2006).",
        "paragraph_id": "para_1344"
      },
      {
        "text": "The Sierra Club argues that its members have suffered a procedural",
        "paragraph_id": "para_1345"
      },
      {
        "text": "injury. “Procedural injury occurs when a plaintiff is deprived of a procedural",
        "paragraph_id": "para_1346"
      },
      {
        "text": "right to protect its concrete interests.” Nat’l Infusion Ctr. Ass’n v. Becerra,",
        "paragraph_id": "para_1347"
      },
      {
        "text": "116 F.4th 488, 497 (5th Cir. 2024). But even then, a litigant only “has",
        "paragraph_id": "para_1348"
      },
      {
        "text": "standing if there is ‘some possibility’ that enforcing the procedural right ‘will",
        "paragraph_id": "para_1349"
      },
      {
        "text": "prompt the [defendant] to reconsider the decision.’” Id. at 503 (quoting",
        "paragraph_id": "para_1350"
      },
      {
        "text": "Massachusetts v. E.P.A., 549 U.S. 497, 518, 127 S. Ct. 1438, 1453 (2007)). See",

        "text": "show that “the procedural step was connected to the substantive result”",

        "text": "because EPA has consistently found that MC is not an ozone-depleting",
        "paragraph_id": "para_1357"
      },
      {
        "text": "substance. Sugar Cane Growers Coop. of Fla. v. Veneman, 289 F.3d 89, 94–95",

      },
      {
        "text": "(D.C. Cir. 2002). EPA first made such a finding in 1994 when it listed MC",

      {

      {
        "text": "industrial sources have been increasing and could have a detectible impact on",
        "paragraph_id": "para_1372"
      },

        "text": "maintains that it determined here, consistent with previous findings, that its",

        "text": "regulation adequately addresses any potential unreasonable risk of ozone",
        "paragraph_id": "para_1376"
      },
      {
        "text": "depletion. The Sierra Club does not explain how its preferred evaluation",
        "paragraph_id": "para_1377"
      },
      {
        "text": "procedure would have resulted in a more restrictive rule, so it does not have",
        "paragraph_id": "para_1378"
      },
      {
        "text": "standing.",

        "text": "At every juncture of its scientific analysis, EPA has gone with the most",
        "paragraph_id": "para_1381"
      },
      {
        "text": "extreme position: (1) it discounted relevant human studies despite decades",
        "paragraph_id": "para_1382"
      },
      {
        "text": "of MC’s use without significant adverse epidemiological findings; (2) it",
        "paragraph_id": "para_1383"
      },
      {
        "text": "assumed (contrary to law) no PPE use by workers, the most “at risk”",
        "paragraph_id": "para_1384"
      },
      {
        "text": "subpopulation, despite OSHA requirements; (3) it relied on a rat study with",
        "paragraph_id": "para_1385"
      },
      {
        "text": "extreme exposures, questionable results, and gross extrapolation; and (4) it",
        "paragraph_id": "para_1386"
      },
      {
        "text": "used the smallest temporary impacts on humans’ peripheral vision or",
        "paragraph_id": "para_1387"
      },
      {
        "text": "bilirubin for its point of departure. Then the agency applied inflated",
        "paragraph_id": "para_1388"
      },
      {
        "text": "benchmark exposure measures. In addition to finding exaggerated",
        "paragraph_id": "para_1389"
      },
      {
        "text": "unreasonable risk for the conditions of use, the agency applied the (legally",
        "paragraph_id": "para_1390"
      },
      {
        "text": "unauthorized) “whole chemical” risk determination to regulate every use of",
        "paragraph_id": "para_1391"
      },
      {
        "text": "MC and ignored widespread PPE use. The results are unsurprising. EPA’s",

        "text": "ultimate exposure limits are approximately ten times smaller than those that",

        "text": "OSHA has enforced for twenty-five years. What is more, EPA",

        "text": "(impermissibly) shifted the burden on regulated entities to prove they could",
        "paragraph_id": "para_1399"
      },
      {
        "text": "comply with the MC Rule, and it failed to adequately consider profound",
        "paragraph_id": "para_1400"
      },
      {
        "text": "economic consequences of its regulation or the limited availability of",
        "paragraph_id": "para_1401"
      },
      {
        "text": "alternatives that are economically and technically feasible. EPA cannot",
        "paragraph_id": "para_1402"
      },
      {
        "text": "justify the MC Rule in light of the TSCA’s requirements, the more",
        "paragraph_id": "para_1403"
      },
      {
        "text": "demanding substantial-evidence standard that the TSCA requires, and the",
        "paragraph_id": "para_1404"
      },
      {
        "text": "arbitrary and capricious standard.",
        "paragraph_id": "para_1405"
      },
      {
        "text": "For the foregoing reasons, we GRANT the Industry’s Petitioners’",
        "paragraph_id": "para_1406"
      },
      {
        "text": "petition for review, VACATE the challenged rule and associated risk",
        "paragraph_id": "para_1407"
      },
      {
        "text": "determination, DENY the Sierra Club’s petition for review, and",
        "paragraph_id": "para_1408"
