        "text": "(Matsumoto, J.), entered on April 9, 2025, upon Ceasar’s guilty plea, and",
        "paragraph_id": "para_33"
      },
      {
        "text": "sentencing her principally to a total of 230 months’ imprisonment: 34 months for",
        "paragraph_id": "para_34"
      },
      {
        "text": "failure to appear (in violation of 18 U.S.C. § 3146(a)(1)), plus an additional two",
        "paragraph_id": "para_35"
      },
      {
        "text": "months pursuant to § 3147 for committing this offense while on release under",
        "paragraph_id": "para_36"
      },
      {
        "text": "Chapter 207; 192 months for conspiracy to provide material support to a",
        "paragraph_id": "para_37"
      },
      {
        "text": "designated foreign terrorist organization (in violation of 18 U.S.C. §§ 2339B(a)(1)",
        "paragraph_id": "para_38"
      },
      {
        "text": "and (d)); and 45 months for obstruction of an official proceeding (in violation of 18",
        "paragraph_id": "para_39"
      },
      {
        "text": "U.S.C. § 1512(c)(1)), plus two additional months pursuant to § 3147 for committing",
        "paragraph_id": "para_40"
      },
      {
        "text": "this offense while on Chapter 207 release.1 Ceasar appeals only the § 3146",
        "paragraph_id": "para_41"
      },
      {
        "text": "1 The district court specified that the 45-month sentence for obstruction of an official proceeding",
        "paragraph_id": "para_42"
      },
      {
        "text": "would run concurrently with Ceasar’s 192-month sentence for material support. Ceasar’s sentence for",
        "paragraph_id": "para_43"
      },
      {
        "text": "failure to appear and her sentences pursuant to § 3147 are to run consecutively to all other terms, for a total",
        "paragraph_id": "para_44"
      },
      {
        "text": "of 230 months’ imprisonment.",
        "paragraph_id": "para_45"
      },
      {
        "text": "conviction and her two-month § 3147 sentence for violating § 3146 while on release",
        "paragraph_id": "para_46"
      },
      {
        "text": "under Chapter 207. For the following reasons, we dismiss Ceasar’s appeal in part",
        "paragraph_id": "para_47"
      },
      {
        "text": "and otherwise affirm the district court’s judgment.",
        "paragraph_id": "para_48"
      },
      {
        "text": "In 2017, Ceasar pleaded guilty to one count of conspiracy to provide",
        "paragraph_id": "para_49"
      },
      {
        "text": "material support to the Islamic State of Iraq and Syria (“ISIS”) and, two years later,",
        "paragraph_id": "para_50"
      },
      {
        "text": "she pleaded guilty to obstruction of an official proceeding. See United States v.",
        "paragraph_id": "para_51"
      },
      {
        "text": "Ceasar, 10 F.4th 66, 68 (2d Cir. 2021). Initially sentenced to 48 months’",
        "paragraph_id": "para_52"
      },
      {
        "text": "imprisonment for both offenses, Ceasar was discharged from prison in 2020 and",
        "paragraph_id": "para_53"
      },
      {
        "text": "placed on supervised release. Ceasar soon violated her supervision conditions,",
        "paragraph_id": "para_54"
      },
      {
        "text": "however, and she thereafter pleaded guilty to two violations. While Ceasar was",
        "paragraph_id": "para_55"
      },
      {
        "text": "awaiting sentence on these violations, this Court determined that Ceasar’s",
        "paragraph_id": "para_56"
      },
      {
        "text": "sentence of 48 months’ imprisonment on the underlying convictions “was",
        "paragraph_id": "para_57"
      },
      {
        "text": "shockingly low and unsupportable as a matter of law” and we vacated the",
        "paragraph_id": "para_58"
      },
      {
        "text": "judgment, remanding for resentencing. Ceasar, 10 F.4th at 70. Ceasar then",
        "paragraph_id": "para_59"
      },
      {
        "text": "absconded, but was apprehended.",
        "paragraph_id": "para_60"
      },
      {
        "text": "Negotiations with the Government commenced after Ceasar’s rearrest, and",
        "paragraph_id": "para_61"
      },
      {
        "text": "Ceasar agreed to plead guilty to one count of failing to appear while on release",
        "paragraph_id": "para_62"
      },
      {
        "text": "under the Bail Reform Act, in violation of 18 U.S.C. § 3146. During negotiations",
        "paragraph_id": "para_63"
      },
      {
        "text": "Ceasar’s counsel raised with the Government a potential legal argument that",
        "paragraph_id": "para_64"
      },
      {
        "text": "Ceasar’s conduct did not fall under § 3146 on the theory that she was not released",
        "paragraph_id": "para_65"
      },
      {
        "text": "pursuant to the Bail Reform Act. Ceasar abandoned this argument, however, after",
        "paragraph_id": "para_66"
      },
      {
        "text": "the Government explained both its basis for concluding that Ceasar’s conduct fell",
        "paragraph_id": "para_67"
      },
      {
        "text": "within the Act and its willingness to have Ceasar instead plead to an additional",
        "paragraph_id": "para_68"
      },
      {
        "text": "obstruction of justice charge, one that carried a higher sentence. Ceasar thereafter",
        "paragraph_id": "para_69"
      },
      {
        "text": "pleaded guilty to violating § 3146 pursuant to a plea agreement in which she",
        "paragraph_id": "para_70"
      },
      {
        "text": "waived, inter alia, her “right to raise on appeal or on collateral review any",
        "paragraph_id": "para_71"
      },
      {
        "text": "argument that . . . [her] admitted conduct does not fall within the scope of the",
        "paragraph_id": "para_72"
      },
      {
        "text": "statute[].” More than two years later, however, Ceasar sought to withdraw her",
        "paragraph_id": "para_73"
      },
      {
        "text": "plea, pressing the very argument she had earlier abandoned. The district court",
        "paragraph_id": "para_74"
      },
      {
        "text": "rejected her plea withdrawal motion.",
        "paragraph_id": "para_75"
      },
      {
        "text": "On appeal, Ceasar first argues that the district court abused its discretion in",
        "paragraph_id": "para_76"
      },
      {
        "text": "denying the plea withdrawal motion because it should have accepted her",
        "paragraph_id": "para_77"
      },
      {
        "text": "argument that her conduct falls outside the scope of § 3146. We conclude that",
        "paragraph_id": "para_78"
      },
      {
        "text": "Ceasar waived this argument. Ceasar’s second argument—expressly preserved in",
        "paragraph_id": "para_79"
      },
      {
        "text": "her plea agreement—is that the consecutive two-month term of imprisonment she",
        "paragraph_id": "para_80"
      },
      {
        "text": "received pursuant to 18 U.S.C. § 3147 violates the Double Jeopardy Clause when",
        "paragraph_id": "para_81"
      },
      {
        "text": "applied to a § 3146 conviction.2 We disagree. Every court of appeals to consider",
        "paragraph_id": "para_82"
      },
      {
        "text": "the question has held that § 3147 does not violate the Double Jeopardy Clause",
        "paragraph_id": "para_83"
      },
      {
        "text": "when applied to a failure to appear under § 3146, and we agree that Congress has",
        "paragraph_id": "para_84"
      },
      {
        "text": "unambiguously mandated the additional penalty in § 3147 for § 3146 offenses.",
        "paragraph_id": "para_85"
      },
      {
        "text": "Because Ceasar’s arguments are all waived or unmeritorious, we DISMISS",
        "paragraph_id": "para_86"
      },
      {
        "text": "Ceasar’s appeal in part and otherwise AFFIRM the judgment of the district court.3",
        "paragraph_id": "para_87"
      },
      {
        "text": "BACKGROUND",
        "paragraph_id": "para_88"
      },
      {
        "text": "I. Factual Background",
        "paragraph_id": "para_89"
      },
      {
        "text": "Beginning in January 2016, Ceasar “conspired to provide material support",
        "paragraph_id": "para_90"
      },
      {
        "text": "to the Islamic State of Iraq and Syria (‘ISIS’), in violation of 18 U.S.C. § 2339B(a).”",
        "paragraph_id": "para_91"
      },
      {
        "text": "Ceasar, 10 F.4th at 68 (citation modified). Using social media and Telegram, an",
        "paragraph_id": "para_92"
      },
      {
        "text": "encrypted messaging application, she “expressed her support for ISIS, encouraged",
        "paragraph_id": "para_93"
      },
      {
        "text": "others to join ISIS abroad, and helped individuals in the United States contact ISIS",
        "paragraph_id": "para_94"
      },
      {
        "text": "members overseas,” who “then facilitated U.S.-based ISIS supporters’ travel to",
        "paragraph_id": "para_95"
      },
      {
        "text": "ISIS-controlled territory.” Id. Ceasar used her contacts with ISIS facilitators to",

        "text": "2 Section 3147 provides, in relevant part, that “[a] person convicted of an offense committed while",
        "paragraph_id": "para_97"
      },
      {
        "text": "released under [Chapter 207] shall be sentenced, in addition to the sentence prescribed for the offense, to []",
        "paragraph_id": "para_98"
      },
      {
        "text": "a term of imprisonment of not more than ten years if the offense is a felony . . . . A term of imprisonment",
        "paragraph_id": "para_99"
      },
      {
        "text": "imposed under this section shall be consecutive to any other sentence of imprisonment.” 18 U.S.C.",
        "paragraph_id": "para_100"
      },
      {
        "text": "§ 3147(1).",
        "paragraph_id": "para_101"
      },
      {
        "text": "3 Accordingly, we also GRANT the Government’s pending motion to dismiss Ceasar’s appeal as",
        "paragraph_id": "para_102"
      },
      {
        "text": "to her § 3146 conviction.",
        "paragraph_id": "para_103"
      },
      {
        "text": "help at least four people join ISIS abroad, before deciding herself “to travel to ISIS",
        "paragraph_id": "para_104"
      },
      {
        "text": "territory by way of Sweden, where she planned to marry another ISIS supporter.”",
        "paragraph_id": "para_105"
      },
      {
        "text": "Id. In November 2016, Ceasar was arrested at John F. Kennedy International",
        "paragraph_id": "para_106"
      },
      {
        "text": "Airport, at the start of her anticipated journey. She thereafter entered into a",
        "paragraph_id": "para_107"
      },
      {
        "text": "cooperation agreement with the Government. Pursuant to its terms, Ceasar",
        "paragraph_id": "para_108"
      },
      {
        "text": "pleaded guilty to one count of conspiring to provide material support to a",
        "paragraph_id": "para_109"
      },
      {
        "text": "designated foreign terrorist organization, in violation of 18 U.S.C. §§ 2339B(a)(1)",
        "paragraph_id": "para_110"
      },
      {
        "text": "and (d). In April 2018, in response to her claim that her health was deteriorating",
        "paragraph_id": "para_111"
      },
      {
        "text": "in confinement, the district court (Weinstein, J.) ordered her released on bail.",
        "paragraph_id": "para_112"
      },
      {
        "text": "Ceasar then breached her cooperation agreement and repeatedly violated",
        "paragraph_id": "para_113"
      },
      {
        "text": "her conditions of presentence release, which “prohibited her from contacting",
        "paragraph_id": "para_114"
      },
      {
        "text": "individuals or organizations affiliated with foreign terrorist groups.” Id. She took",
        "paragraph_id": "para_115"
      },
      {
        "text": "steps to hide from law enforcement her efforts to contact individuals “known to",
        "paragraph_id": "para_116"
      },
      {
        "text": "be supporters of ISIS or other extremist groups,” and she lied to the Federal Bureau",
        "paragraph_id": "para_117"
      },
      {
        "text": "of Investigation (“FBI”) about her conduct. Id. at 69. The district court revoked",
        "paragraph_id": "para_118"
      },
      {
        "text": "her release, and she pleaded guilty to obstruction of an official proceeding, in",
        "paragraph_id": "para_119"
      },
      {
        "text": "violation of 18 U.S.C. § 1512(c)(1). At the June, 2019 sentencing, the district court",
        "paragraph_id": "para_120"
      },
      {
        "text": "nonetheless expressed the view that Ceasar was “well on her way towards",
        "paragraph_id": "para_121"
      },
      {
        "text": "rehabilitation” and varied downward from the Sentencing Guidelines range of 30",
        "paragraph_id": "para_122"
      },
      {
        "text": "to 50 years in prison, imposing a 48-month prison term, to be followed by eight",
        "paragraph_id": "para_123"
      },
      {
        "text": "years’ supervised release. Ceasar, 10 F.4th at 77. The Government appealed the",
        "paragraph_id": "para_124"
      },
      {
        "text": "sentence as substantively unreasonable.",
        "paragraph_id": "para_125"
      },
      {
        "text": "In July 2020, while the Government’s appeal was pending, Ceasar was",
        "paragraph_id": "para_126"
      },
      {
        "text": "released from the custody of the Bureau of Prisons and began her eight-year term",
        "paragraph_id": "para_127"
      },
      {
        "text": "of supervised release. Although Ceasar was subject to strict release conditions,",
        "paragraph_id": "para_128"
      },
      {
        "text": "she began almost immediately to violate them: she downloaded unauthorized",
        "paragraph_id": "para_129"
      },
      {
        "text": "mobile applications, withheld account login credentials, and knowingly",
        "paragraph_id": "para_130"
      },
      {
        "text": "corresponded with felons. The Probation Department (“Probation”) submitted a",
        "paragraph_id": "para_131"
      },
      {
        "text": "report to the district court detailing three separate violations and, on November",
        "paragraph_id": "para_132"
      },
      {
        "text": "20, 2020, Ceasar pleaded not guilty at a virtual arraignment before Judge",
        "paragraph_id": "para_133"
      },
      {
        "text": "Matsumoto.4 At the conclusion of the hearing, the court addressed Ceasar:",
        "paragraph_id": "para_134"
      },
      {
        "text": "So, Ms. Ceasar, you must continue to report to your Probation officer",
        "paragraph_id": "para_135"
      },
      {
        "text": "as directed. Please, given these charges let me caution you that you",
        "paragraph_id": "para_136"
      },
      {
        "text": "should not open any new accounts or access the internet using any",
        "paragraph_id": "para_137"
      },
      {
        "text": "accounts. If you are planning to do so, you need to disclose that to",
        "paragraph_id": "para_138"
      },
      {
        "text": "your officer, do you understand that, ma’am?",
        "paragraph_id": "para_139"
      },
      {
        "text": "4 The case was assigned to Judge Matsumoto after Judge Weinstein passed away. The Government",
        "paragraph_id": "para_140"
      },
      {
        "text": "did not seek detention at arraignment, but indicated that the violations were concerning because of their",
        "paragraph_id": "para_141"
      },
      {
        "text": "similarity to the conduct underlying the offenses to which Ceasar had pleaded guilty, and that it would",
        "paragraph_id": "para_142"
      },
      {
        "text": "revisit the question of Ceasar’s release after further investigation.",
        "paragraph_id": "para_143"
      },
      {
        "text": "App’x 84. Ceasar confirmed that she understood.",
        "paragraph_id": "para_144"
      },
      {
        "text": "At another virtual hearing at little over six weeks later, on January 5, 2021,",
        "paragraph_id": "para_145"
      },
      {
        "text": "Ceasar pleaded guilty to two of the charged violations pursuant to an agreement",
        "paragraph_id": "para_146"
      },
      {
        "text": "with the Government. On consent of both parties, the district court “continue[d]",
        "paragraph_id": "para_147"
      },
      {
        "text": "the condition of [her] home confinement with location monitoring up until the",
        "paragraph_id": "para_148"
      },
      {
        "text": "date of sentencing.” App’x at 110. In the intervening months, Ceasar repeatedly",
        "paragraph_id": "para_149"
      },
      {
        "text": "sought and obtained delays of the final revocation hearing at which she would be",
        "paragraph_id": "para_150"
      },
      {
        "text": "sentenced, while the Government repeatedly highlighted her continued",
        "paragraph_id": "para_151"
      },
      {
        "text": "noncompliance with the conditions of her release.",
        "paragraph_id": "para_152"
      },
      {
        "text": "Then, before sentencing on the release violations had taken place, a panel of",
        "paragraph_id": "para_153"
      },
      {
        "text": "this Court held on August 18, 2021, that the original sentence “was shockingly low",
        "paragraph_id": "para_154"
      },
      {
        "text": "and unsupportable as a matter of law” because it “placed more emphasis on",
        "paragraph_id": "para_155"
      },
      {
        "text": "Ceasar’s need for rehabilitation than that sentencing factor could bear, and failed",
        "paragraph_id": "para_156"
      },
      {
        "text": "adequately to weigh § 3553(a) factors that balance the needs and circumstances of",
        "paragraph_id": "para_157"
      },
      {
        "text": "an individual defendant against, among other things, the goals of protecting the",
        "paragraph_id": "para_158"
      },
      {
        "text": "public, deterring criminal behavior, and engendering respect for the law.” Ceasar,",
        "paragraph_id": "para_159"
      },
      {
        "text": "10 F.4th at 70. See also 18 U.S.C. § 3553(a)(2). The panel vacated the judgment and",
        "paragraph_id": "para_160"
      },
      {
        "text": "remanded for resentencing, and the Government moved in the district court that",
        "paragraph_id": "para_161"
      },
      {
        "text": "Ceasar be detained. Ceasar, 10 F.4th at 70, 87; see also App’x at 116-23.",
        "paragraph_id": "para_162"
      },
      {
        "text": "On August 24, Probation submitted a supplemental violation of supervised",
        "paragraph_id": "para_163"
      },
      {
        "text": "release report (“VOSR”) to Judge Matsumoto, detailing evidence that in the",
        "paragraph_id": "para_164"
      },
      {
        "text": "months following Ceasar’s November 2020 appearance, she had continued to",
        "paragraph_id": "para_165"
      },
      {
        "text": "violate multiple conditions of her supervised release. That same day, the district",
        "paragraph_id": "para_166"
      },
      {
        "text": "court entered an order on the docket reminding the parties that they were to",
        "paragraph_id": "para_167"
      },
      {
        "text": "appear for a status conference scheduled for the next day.",
        "paragraph_id": "para_168"
      },
      {
        "text": "On August 25, 2021, Ceasar removed her monitoring device and absconded,",
        "paragraph_id": "para_169"
      },
      {
        "text": "failing to appear at the scheduled conference. Ceasar later said she intended to",
        "paragraph_id": "para_170"
      },
      {
        "text": "flee the United States for Russia, or another country that would not extradite her,",
        "paragraph_id": "para_171"
      },
      {
        "text": "motivated at least in part by a desire to eventually travel to Afghanistan and",
        "paragraph_id": "para_172"
      },
      {
        "text": "continue her support for ISIS. On August 27, after what the government called “a",
        "paragraph_id": "para_173"
      },
      {
        "text": "nationwide fugitive investigation,” FBI agents took Ceasar into custody in New",
        "paragraph_id": "para_174"
      },
      {
        "text": "Mexico. App’x at 131. In September 2021, Probation filed additional charges of",
        "paragraph_id": "para_175"
      },
      {
        "text": "supervised release violations in connection with Ceasar’s flight to New Mexico.",
        "paragraph_id": "para_176"
      },
      {
        "text": "The parties commenced plea negotiations to resolve both the outstanding",
        "paragraph_id": "para_177"
      },
      {
        "text": "violations and the new criminal conduct committed by Ceasar in her effort to",
        "paragraph_id": "para_178"
      },
      {
        "text": "abscond.",
        "paragraph_id": "para_179"
      },
      {
        "text": "In an email exchange with defense counsel in September 2022, the",
        "paragraph_id": "para_180"
      },
      {
        "text": "Government proposed resolving the potential new charges against Ceasar by",
        "paragraph_id": "para_181"
      },
      {
        "text": "having her waive indictment and plead guilty to 18 U.S.C. § 3146, which carries a",
        "paragraph_id": "para_182"
      },
      {
        "text": "ten-year maximum term.5 Defense counsel replied:",
        "paragraph_id": "para_183"
      },
      {
        "text": "I . . . need to do some digging into the question of whether [Ceasar]",
        "paragraph_id": "para_184"
      },
      {
        "text": "was actually on bail at the time of her flight (or just on supervised",
        "paragraph_id": "para_185"
      },
      {
        "text": "release) and somewhat relatedly, whether as a technical matter she",
        "paragraph_id": "para_186"
      },
      {
        "text": "was on supervised release once her original sentence was vacated . . . .",
        "paragraph_id": "para_187"
      },
      {
        "text": "App’x at 256. Later that month defense counsel stated that counsel was “still",
        "paragraph_id": "para_188"
      },
      {
        "text": "digging in but it doesn’t look like she was ever released on bail so as to trigger the",
        "paragraph_id": "para_189"
      },
      {
        "text": "bail jumping statute. Let me know if you have a different view on that issue.” Id.",
        "paragraph_id": "para_190"
      },
      {
        "text": "at 255. The Government replied as follows:",
        "paragraph_id": "para_191"
      },
      {
        "text": "Fed. R. Crim. P. 32.1(a)(6) provides that at the defendant’s initial",
        "paragraph_id": "para_192"
      },
      {
        "text": "appearance for violation of supervised release “The magistrate judge",
        "paragraph_id": "para_193"
      },
      {
        "text": "may release or detain the person under 18 U.S.C. § 3143(a)(1) pending",
        "paragraph_id": "para_194"
      },
      {
        "text": "further proceedings.” Ceasar made her initial appearance before",
        "paragraph_id": "para_195"
      },
      {
        "text": "5 Section 3146, part of the Bail Reform Act, provides in relevant part as follows:",
        "paragraph_id": "para_196"
      },
      {
        "text": "(a) Offense. – Whoever, having been released under this chapter knowingly –",
        "paragraph_id": "para_197"
      },
      {
        "text": "(1) fails to appear before a court as required by the conditions of release; or",
        "paragraph_id": "para_198"
      },
      {
        "text": "(2) fails to surrender for service of sentence pursuant to a court order;",
        "paragraph_id": "para_199"
      },
      {
        "text": "shall be punished as provided in subsection (b) of this section.",
        "paragraph_id": "para_200"
      },
      {
        "text": "Judge Matsumoto on the VOSR on 11/20/2020 and was released.",
        "paragraph_id": "para_201"
      },
      {
        "text": "Pursuant to Rule 32.1(a)(6) that release was “under 18 U.S.C.",
        "paragraph_id": "para_202"
      },
      {
        "text": "§ 3143(a)(1)” which, as you know, is within Chapter 207, making",
        "paragraph_id": "para_203"
      },
      {
        "text": "Ceasar a person “released under this chapter” for purposes of 18",
        "paragraph_id": "para_204"
      },
      {
        "text": "U.S.C. § 3146.",
        "paragraph_id": "para_205"
      },
      {
        "text": "Id. In the same email, the Government advised defense counsel that “if you",
        "paragraph_id": "para_206"
      },
      {
        "text": "prefer,” the Government would also accept a plea to an obstruction of justice",
        "paragraph_id": "para_207"
      },
      {
        "text": "offense that carried a higher maximum sentence.",
        "paragraph_id": "para_208"
      },
      {
        "text": "Thereafter, on October 14, 2022, the Government filed a one-count",
        "paragraph_id": "para_209"
      },
      {
        "text": "information charging Ceasar with failure to appear in violation of 18 U.S.C.",
        "paragraph_id": "para_210"
      },
      {
        "text": "§§ 3146(a)(1), (b)(1)(A)(i), (b)(2), 3147, and 3551. That same day, pursuant to a",
        "paragraph_id": "para_211"
      },
      {
        "text": "superseding plea agreement, Ceasar waived indictment and pleaded guilty to the",
        "paragraph_id": "para_212"
      },
      {
        "text": "failure-to-appear count.6 The plea agreement stated that the failure-to-appear",
        "paragraph_id": "para_213"
      },
      {
        "text": "count carried a maximum sentence of 10 years and noted that, “[a]dditionally,",
        "paragraph_id": "para_214"
      },
      {
        "text": "pursuant to 18 U.S.C. § 3147(1), because the defendant committed the Obstruction",
        "paragraph_id": "para_215"
      },
      {
        "text": "Offense and the Failure to Appear Offense while on pretrial release, the",
        "paragraph_id": "para_216"
      },
      {
        "text": "government believes that the defendant will face additional terms of",
        "paragraph_id": "para_217"
      },
      {
        "text": "imprisonment of up to ten years for each offense.” App’x at 147–48.",
        "paragraph_id": "para_218"
      },
      {
        "text": "6 Pursuant to the plea agreement, Ceasar also allocuted to committing two additional violations of",
        "paragraph_id": "para_219"
      },
      {
        "text": "supervised release lodged by Probation in August and September 2021, for a total of four violations,",
        "paragraph_id": "para_220"
      },
      {
        "text": "including those to which she pleaded guilty in January 2021.",
        "paragraph_id": "para_221"
      },
      {
        "text": "In the plea agreement, Ceasar “reserve[d] the right to argue at sentencing",
        "paragraph_id": "para_222"
      },
      {
        "text": "and on appeal that 18 U.S.C. § 3147(1) does not apply to her commission of the",
        "paragraph_id": "para_223"
      },
      {
        "text": "Failure to Appear Offense.” Id. at 151. But Ceasar “agree[d] not to file an appeal",
        "paragraph_id": "para_224"
      },
      {
        "text": "or otherwise challenge, by petition pursuant to 28 U.S.C. § 2255 or any other",
        "paragraph_id": "para_225"
      },
      {
        "text": "provision, the conviction or sentence imposed for the Material Support Offense,",
        "paragraph_id": "para_226"
      },
      {
        "text": "Obstruction Offense or Failure to Appear Offense in the event that the Court",
        "paragraph_id": "para_227"
      },
      {
        "text": "imposes a total term of imprisonment of 386 months or below for the Material",
        "paragraph_id": "para_228"
      },
      {
        "text": "Support Offense, Obstruction Offense, Failure to Appear Offense and 18 U.S.C.",
        "paragraph_id": "para_229"
      },
      {
        "text": "§ 3147(1).” Id. And Ceasar “further waive[d] the right to raise on appeal or on",
        "paragraph_id": "para_230"
      },
      {
        "text": "collateral review any argument that . . . the admitted conduct does not fall within",
        "paragraph_id": "para_231"
      },
      {
        "text": "the scope of the statutes.” Id. at 152. In exchange, the Government agreed, inter",
        "paragraph_id": "para_232"
      },
      {
        "text": "alia, not to bring additional charges for Ceasar’s failure to appear and for her",
        "paragraph_id": "para_233"
      },
      {
        "text": "obstructive conduct during her August 2021 flight from New York.7",
        "paragraph_id": "para_234"
      },
      {
        "text": "During the plea hearing on October 14, 2022, the district court confirmed",
        "paragraph_id": "para_235"
      },
      {
        "text": "that Ceasar understood the charges and the rights she was giving up by pleading",
        "paragraph_id": "para_236"
      },
      {
        "text": "guilty, that her “mind [was] clear,” that she pleaded guilty “voluntarily and of",
        "paragraph_id": "para_237"
      },
      {
        "text": "[her] own free will,” and that her counsel had no doubt “as to whether or not Ms.",
        "paragraph_id": "para_238"
      },
      {
        "text": "7 In the earlier email exchange with Ceasar’s defense counsel, the Government had advised that",
        "paragraph_id": "para_239"
      },
      {
        "text": "these other potential charges included not only obstruction of justice, but conspiracy.",
        "paragraph_id": "para_240"
      },
      {
        "text": "Ceasar [was] competent to plead at [the] time” of the proceeding. App’x at 159–",
        "paragraph_id": "para_241"
      },
      {
        "text": "60, 181. The court confirmed that Ceasar had read the plea agreement, that she",
        "paragraph_id": "para_242"
      },
      {
        "text": "had discussed it with her counsel, and that she understood the agreement and, in",
        "paragraph_id": "para_243"
      },
      {
        "text": "particular, the appeal waiver—that she had “given up [her] right to bring an",
        "paragraph_id": "para_244"
      },
      {
        "text": "appeal for a sentence if it is 386 months or less.” Id. at 167, 177. Ceasar also",
        "paragraph_id": "para_245"
      },
      {
        "text": "confirmed that she understood she could not withdraw her guilty plea were she",
        "paragraph_id": "para_246"
      },
      {
        "text": "to “receive a sentence that is not what [she] would hope for or what [she] would",
        "paragraph_id": "para_247"
      },
      {
        "text": "expect.” Id. at 180.",
        "paragraph_id": "para_248"
      },
      {
        "text": "The district court specifically inquired of Ceasar’s counsel whether counsel",
        "paragraph_id": "para_249"
      },
      {
        "text": "knew “of any reason why your client should not plead guilty to the information,”",
        "paragraph_id": "para_250"
      },
      {
        "text": "or “of any viable legal defenses that are causing you to counsel Ms. Ceasar not to",
        "paragraph_id": "para_251"
      },
      {
        "text": "plead guilty,” to which counsel responded, “No.” Id. at 181. Counsel was also",
        "paragraph_id": "para_252"
      },
      {
        "text": "asked, “[A]re you satisfied that your client understands her waiver of appellate",
        "paragraph_id": "para_253"
      },
      {
        "text": "rights?”, and responded, “Yes.” Id. at 178.",
        "paragraph_id": "para_254"
      },
      {
        "text": "After making inquiry of Ceasar to ensure that her plea was entered",
        "paragraph_id": "para_255"
      },
      {
        "text": "“voluntarily and of [her] own free will,” the district court asked Ceasar to describe",
        "paragraph_id": "para_256"
      },
      {
        "text": "what she did. She stated:",
        "paragraph_id": "para_257"
      },
      {
        "text": "THE DEFENDANT: While my violations of supervised release were",
        "paragraph_id": "para_258"
      },
      {
        "text": "pending, I was released on supervision with . . . electronic",
        "paragraph_id": "para_259"
      },
      {
        "text": "monitoring. I knew I had a court appearance scheduled for August",
        "paragraph_id": "para_260"
      },
      {
        "text": "25th, 2021 in the Eastern District of New York. I removed my GPS",
        "paragraph_id": "para_261"
      },
      {
        "text": "monitoring device without permission from Probation or the Judge.",
        "paragraph_id": "para_262"
      },
      {
        "text": "I knowingly failed to appear in court as required.",
        "paragraph_id": "para_263"
      },
      {
        "text": "THE COURT: All right. So you knew that because of the prior",
        "paragraph_id": "para_264"
      },
      {
        "text": "violations of supervised release, you had been permitted to remain on",
        "paragraph_id": "para_265"
      },
      {
        "text": "release with certain conditions; is that correct?",
        "paragraph_id": "para_266"
      },
      {
        "text": "THE DEFENDANT: Yes.",
        "paragraph_id": "para_267"
      },
      {
        "text": "THE COURT: And you knew one of those conditions involved",
        "paragraph_id": "para_268"
      },
      {
        "text": "returning to court when ordered, correct?",
        "paragraph_id": "para_269"
      },
      {
        "text": "THE DEFENDANT: Yes.",
        "paragraph_id": "para_270"
      },
      {
        "text": "THE COURT: And you also knew that you were wearing a GPS",
        "paragraph_id": "para_271"
      },
      {
        "text": "device that would assist the Probation Department with monitoring",
        "paragraph_id": "para_272"
      },
      {
        "text": "your whereabouts, correct?",
        "paragraph_id": "para_273"
      },
      {
        "text": "THE DEFENDANT: Yes.",
        "paragraph_id": "para_274"
      },
      {
        "text": "THE COURT: And you knew that on August 25th, or approximately",
        "paragraph_id": "para_275"
      },
      {
        "text": "that date, you had a court date here in this courthouse; is that correct?",
        "paragraph_id": "para_276"
      },
      {
        "text": "THE DEFENDANT: Yes.",
        "paragraph_id": "para_277"
      },
      {
        "text": "THE COURT: Yet you decided to remove your bracelet, your anklet,",
        "paragraph_id": "para_278"
      },
      {
        "text": "and knowingly did not appear in court on the day as ordered; is that",
        "paragraph_id": "para_279"
      },
      {
        "text": "correct?",
        "paragraph_id": "para_280"
      },
      {
        "text": "THE DEFENDANT: Yes.",
        "paragraph_id": "para_281"
      },
      {
        "text": "Id. at 182–83. The Government confirmed Ceasar did not need to add anything to",
        "paragraph_id": "para_282"
      },
      {
        "text": "her allocution, saying that it “believe[s] that satisfies the elements of the offense.”",
        "paragraph_id": "para_283"
      },
      {
        "text": "Id. at 183–84. Defense counsel said there was nothing needed “to add to clarify.”",
        "paragraph_id": "para_284"
      },
      {
        "text": "Id. at 184. The district court then accepted Ceasar’s plea. Ceasar awaited",
        "paragraph_id": "para_285"
      },
      {
        "text": "sentencing on the failure-to-appear charge and the four violations of supervised",
        "paragraph_id": "para_286"
      },
      {
        "text": "release, as well as resentencing on the material support and obstruction charges.",
        "paragraph_id": "para_287"
      },
      {
        "text": "II. Procedural History",
        "paragraph_id": "para_288"
      },
      {
        "text": "A sentencing proceeding was scheduled for December 12, 2024. On",
        "paragraph_id": "para_289"
      },
      {
        "text": "December 9, Probation requested to withdraw all the violations of supervised",
        "paragraph_id": "para_290"
      },
      {
        "text": "release, on the ground that the August 2021 panel decision vacating the judgment",
        "paragraph_id": "para_291"
      },
      {
        "text": "had “essentially nullif[ied] the custodial and supervised release sentence,”",
        "paragraph_id": "para_292"
      },
      {
        "text": "rendering “the violation of supervised release . . . void.”8 Id. at 189. The district",
        "paragraph_id": "para_293"
      },
      {
        "text": "court directed the parties to address Probation’s filing. In a letter to the district",
        "paragraph_id": "para_294"
      },
      {
        "text": "court on December 12, Ceasar for the first time informed the district court of her",
        "paragraph_id": "para_295"
      },
      {
        "text": "view that “there is real reason to question whether her conduct in traveling to New",
        "paragraph_id": "para_296"
      },
      {
        "text": "Mexico on August 25, 2021, rather than appearing by video for a status conference",
        "paragraph_id": "para_297"
      },
      {
        "text": "constitutes a ‘failure to appear’ within the meaning of 18 U.S.C. § 3146.” Id. at 192.",
        "paragraph_id": "para_298"
      },
      {
        "text": "Ceasar requested an adjournment of the sentencing.",
        "paragraph_id": "para_299"
      },
      {
        "text": "Ceasar thereafter moved to withdraw her guilty plea, arguing that there was",
        "paragraph_id": "para_300"
      },
      {
        "text": "a fair and just reason for withdrawal pursuant to FED. R. CRIM. P. 11(d)(2)(B)",
        "paragraph_id": "para_301"
      },
      {
        "text": "8 Ceasar contends that this motion was “based on the Fifth Circuit’s recent decision in United States",
        "paragraph_id": "para_302"
      },
      {
        "text": "v. Lipscomb, 66 F.4th 604, 612 (5th Cir. 2023),” Ceasar Br. at 15–16, but Probation did not cite the case in its",
        "paragraph_id": "para_303"
      },
      {
        "text": "motion.",
        "paragraph_id": "para_304"
      },
      {
        "text": "because, among other things, the plea “lacked a factual basis for three reasons:",
        "paragraph_id": "para_305"
      },
      {
        "text": "first, because she was never released under Chapter 207 (as required for",
        "paragraph_id": "para_306"
      },
      {
        "text": "conviction); second, because the Court did not set ‘conditions of release’ requiring",
        "paragraph_id": "para_307"
      },
      {
        "text": "her to appear; and third, because her conviction would impermissibly give effect",
        "paragraph_id": "para_308"
      },
      {
        "text": "to a vacated sentence.” Id. at 236. The Government opposed the motion and also",
        "paragraph_id": "para_309"
      },
      {
        "text": "provided the district court with its September 2022 email exchange with defense",
        "paragraph_id": "para_310"
      },
      {
        "text": "counsel.",
        "paragraph_id": "para_311"
      },
      {
        "text": "On April 1, 2025, the district court denied Ceasar’s motion to withdraw her",
        "paragraph_id": "para_312"
      },
      {
        "text": "guilty plea.9 The district court observed that the factors affecting whether a",
        "paragraph_id": "para_313"
      },
      {
        "text": "defendant has a “fair and just” reason to withdraw a plea include: “(1) the amount",
        "paragraph_id": "para_314"
      },
      {
        "text": "of time between the guilty plea and motion to withdraw; (2) whether the",
        "paragraph_id": "para_315"
      },
      {
        "text": "defendant asserted legal innocence in the motion to withdraw; and (3) whether",
        "paragraph_id": "para_316"
      },
      {
        "text": "withdrawal would prejudice the Government.” App’x at 312 The district court",
        "paragraph_id": "para_317"
      },
      {
        "text": "determined that the timing and prejudice factors weighed against Ceasar because",
        "paragraph_id": "para_318"
      },
      {
        "text": "9 As to the violations, the district court determined that it would not sentence Ceasar on the",
        "paragraph_id": "para_319"
      },
      {
        "text": "violations “because they arise from a supervised release term included in a vacated judgment.” App’x 297.",
        "paragraph_id": "para_320"
      },
      {
        "text": "The district court denied a motion by Ceasar to withdraw the VOSR reports, however, and to preclude",
        "paragraph_id": "para_321"
      },
      {
        "text": "consideration of her post-release conduct, noting that it “can and must consider Ms. Ceasar’s conduct",
        "paragraph_id": "para_322"
      },
      {
        "text": "during her supervised release term in determining her sentences,” and that Ceasar’s conduct in contacting",
        "paragraph_id": "para_323"
      },
      {
        "text": "an apparent ISIS supporter to obtain money, downloading and using applications to contact known ISIS",
        "paragraph_id": "para_324"
      },
      {
        "text": "members and supporters, and then deleting many of her communications to prevent detection, all while",
        "paragraph_id": "para_325"
      },
      {
        "text": "on supervised release, raised “concerns about her deterrence, respect for the law, and rehabilitation.”",
        "paragraph_id": "para_326"
      },
      {
        "text": "App’x at 301, 305–06.",
        "paragraph_id": "para_327"
      },
      {
        "text": "of the two-plus years between her guilty plea and her motion and “because the",
        "paragraph_id": "para_328"
      },
      {
        "text": "passage of time risks that witnesses’ memories may fade and evidence may be lost",
        "paragraph_id": "para_329"
      },
      {
        "text": "or destroyed.” Id. at 312–13, 315.",
        "paragraph_id": "para_330"
      },
      {
        "text": "As for the legal innocence factor, the district court interpreted Ceasar’s",
        "paragraph_id": "para_331"
      },
      {
        "text": "supposed factual basis argument “as an argument asserting legal innocence.” Id.",
        "paragraph_id": "para_332"
      },
      {
        "text": "at 313. It then rejected each of Ceasar’s three arguments on the merits. The district",
        "paragraph_id": "para_333"
      },
      {
        "text": "court determined that Ceasar was on release under the Bail Reform Act at the time",
        "paragraph_id": "para_334"
      },
      {
        "text": "of her flight to New Mexico; that the district court had issued multiple orders",
        "paragraph_id": "para_335"
      },
      {
        "text": "requiring her appearance on August 25, 2021, and Ceasar’s “own sworn",
        "paragraph_id": "para_336"
      },
      {
        "text": "statements following her failure to appear . . . establish that she knew she had to",
        "paragraph_id": "para_337"
      },
      {
        "text": "appear in court on August 25, 2021, and chose not to do so”; and that vacatur of",
        "paragraph_id": "para_338"
      },
      {
        "text": "the judgment did not “require[ ] that the Court ignore Ms. Ceasar’s conduct as if",
        "paragraph_id": "para_339"
      },
      {
        "text": "it simply did not occur.” App’x at 318, 330–31, 333.",
        "paragraph_id": "para_340"
      },
      {
        "text": "The following week, on April 9, 2025, the district court sentenced Ceasar to",
        "paragraph_id": "para_341"
      },
      {
        "text": "230 months in prison, which included 36 months (running consecutively) for",
        "paragraph_id": "para_342"
      },
      {
        "text": "failure to appear under § 3146, two months of which were under the § 3147",
        "paragraph_id": "para_343"
      },
      {
        "text": "enhancement.",
        "paragraph_id": "para_344"
      },
      {
        "text": "Ceasar timely appealed. The Government moved to dismiss the appeal as",
        "paragraph_id": "para_345"
      },
      {
        "text": "barred by the appeal waiver, which Ceasar opposed. The Government then",
        "paragraph_id": "para_346"
      },
      {
        "text": "moved to withdraw its motion as to Ceasar’s § 3147 challenge and to consolidate",
        "paragraph_id": "para_347"
      },
      {
        "text": "its reply to Ceasar in its merits brief. An applications judge of this Court granted",
        "paragraph_id": "para_348"
      },
      {
        "text": "the motion to withdraw and referred the remaining portion of the motion to",
        "paragraph_id": "para_349"
      },
      {
        "text": "dismiss to this merits panel.",
        "paragraph_id": "para_350"
      },
      {
        "text": "DISCUSSION",
        "paragraph_id": "para_351"
      },
      {
        "text": "On appeal, Ceasar argues that the district court abused its discretion in",
        "paragraph_id": "para_352"
      },
      {
        "text": "failing to grant her plea withdrawal motion because her conduct does not fall",
        "paragraph_id": "para_353"
      },
      {
        "text": "within the scope of § 3146’s failure-to-appear provision. She also argues that the",
        "paragraph_id": "para_354"
      },
      {
        "text": "mandatory consecutive sentence imposed by § 3147 cannot apply to her § 3146",
        "paragraph_id": "para_355"
      },
      {
        "text": "conviction without violating the Double Jeopardy Clause.",
        "paragraph_id": "para_356"
      },
      {
        "text": "We reject both arguments. Ceasar waived her current challenge to the",
        "paragraph_id": "para_357"
      },
      {
        "text": "§ 3146 conviction by agreeing in her plea agreement not to raise it. As to § 3147,",
        "paragraph_id": "para_358"
      },
      {
        "text": "Congress unambiguously authorized multiple punishments for defendants",
        "paragraph_id": "para_359"
      },
      {
        "text": "convicted of failing to appear in violation of § 3146, so imposing both the § 3147",
        "paragraph_id": "para_360"
      },
      {
        "text": "consecutive sentence and the § 3146 sentence does not violate the Double Jeopardy",
        "paragraph_id": "para_361"
      },
      {
        "text": "Clause.",
        "paragraph_id": "para_362"
      },
      {
        "text": "I",
        "paragraph_id": "para_363"
      },
      {
        "text": "We review the denial of a motion to withdraw a guilty plea for abuse of",
        "paragraph_id": "para_364"
      },
      {
        "text": "discretion. United States v. Overton, 24 F.4th 870, 874 (2d Cir. 2022); see FED. R. CRIM.",
        "paragraph_id": "para_365"
      },
      {
        "text": "P. 11(d)(2). But we do not review a defendant’s arguments at all when they have",
        "paragraph_id": "para_366"
      },
      {
        "text": "been waived. “A defendant’s knowing and voluntary waiver of the right to appeal",
        "paragraph_id": "para_367"
      },
      {
        "text": "or collaterally attack his conviction and/or sentence is enforceable.” Sanford v.",
        "paragraph_id": "para_368"
      },
      {
        "text": "United States, 841 F.3d 578, 580 (2d Cir. 2016) (citation omitted). We decline to",
        "paragraph_id": "para_369"
      },
      {
        "text": "enforce appeal waivers “only in certain exceptional circumstances that ‘occupy a",
        "paragraph_id": "para_370"
      },
      {
        "text": "very circumscribed area of our jurisprudence,’” because if waivers are not",
        "paragraph_id": "para_371"
      },
      {
        "text": "generally enforced, “‘the covenant . . . becomes meaningless and would cease to",
        "paragraph_id": "para_372"
      },
      {
        "text": "have value as a bargaining chip in the hands of defendants.’” United States v.",
        "paragraph_id": "para_373"
      },
      {
        "text": "Matos, No. 22-1561, 2026 WL 2339567 at *5 (2d Cir. Aug. 13, 2026) (first quoting",
        "paragraph_id": "para_374"
      },
      {
        "text": "United States v. Borden, 16 F.4th 351, 354–55 (2d Cir. 2021); and then quoting United",
        "paragraph_id": "para_375"
      },
      {
        "text": "States v. Yemitan, 70 F.3d 746, 748 (2d Cir. 1995)); accord United States v. Hunter, 146",
        "paragraph_id": "para_376"
      },
      {
        "text": "S. Ct. 1702, 1713 (2026) (permitting “standard-fare errors” to “cancel an appeal",
        "paragraph_id": "para_377"
      },
      {
        "text": "waiver” could cause “the utility of waivers in plea negotiations” to “plummet,”",
        "paragraph_id": "para_378"
      },
      {
        "text": "resulting in “fewer concessions to a defendant”). We have thus upheld appellate",
        "paragraph_id": "para_379"
      },
      {
        "text": "waivers “even in circumstances where the sentence was conceivably imposed in",
        "paragraph_id": "para_380"
      },
      {
        "text": "an illegal fashion or in violation of the [Sentencing] Guidelines, but yet was still",
        "paragraph_id": "para_381"
      },
      {
        "text": "within the range contemplated in the plea agreement.” United States v. Gomez-",
        "paragraph_id": "para_382"
      },
      {
        "text": "Perez, 215 F.3d 315, 319 (2d Cir. 2000).",
        "paragraph_id": "para_383"
      },
      {
        "text": "We conclude that the appellate waiver in Ceasar’s plea agreement bars this",
        "paragraph_id": "para_384"
      },
      {
        "text": "appeal of her § 3146 conviction. In addition to agreeing “not to file an appeal or",
        "paragraph_id": "para_385"
      },
      {
        "text": "otherwise challenge” her failure-to-appear conviction in the event the district",
        "paragraph_id": "para_386"
      },
      {
        "text": "court imposed a total term of imprisonment of 386 months or less, Ceasar",
        "paragraph_id": "para_387"
      },
      {
        "text": "expressly “waive[d] the right to raise on appeal or on collateral review any",
        "paragraph_id": "para_388"
      },
      {
        "text": "argument that . . . the admitted conduct does not fall within the scope of the",
        "paragraph_id": "para_389"
      },
      {
        "text": "statutes” pursuant to which she was charged. App’x at 151–52. But this is",
        "paragraph_id": "para_390"
      },
      {
        "text": "precisely the argument she now raises, on appeal, as to why the district court",
        "paragraph_id": "para_391"
      },
      {
        "text": "abused its discretion in denying her plea withdrawal motion.10 See Ceasar Br. at",
        "paragraph_id": "para_392"
      },
      {
        "text": "28 (“Most importantly, the court incorrectly held that Ceasar’s conduct satisfied",
        "paragraph_id": "para_393"
      },
      {
        "text": "the elements of § 3146 . . . .”). Because Ceasar knowingly and voluntarily agreed",
        "paragraph_id": "para_394"
      },
      {
        "text": "not to bring this argument on appeal, she is held to that agreement. See Sanford,",
        "paragraph_id": "para_395"
      },
      {
        "text": "10 Ceasar argues that her “plea agreement did not unambiguously waive her right",
        "paragraph_id": "para_396"
      },
      {
        "text": "to move to withdraw her plea before sentencing on the ground that her admitted conduct",
        "paragraph_id": "para_397"
      },
      {
        "text": "did not legally violate the failure to appear statute.” Ceasar Br. at 55. But even assuming",
        "paragraph_id": "para_398"
      },
      {
        "text": "arguendo that her plea agreement does not prohibit a motion to withdraw a plea, its terms",
        "paragraph_id": "para_399"
      },
      {
        "text": "do cover “any argument [on appeal] that . . . the admitted conduct does not fall within the",
        "paragraph_id": "para_400"
      },
      {
        "text": "scope of the statutes.” App’x at 152 (emphasis added). The agreement on its face thus",
        "paragraph_id": "para_401"
      },
      {
        "text": "precludes her from relying on this argument as a basis for asserting on appeal that the",
        "paragraph_id": "para_402"
      },
      {
        "text": "district court abused its discretion in denying the plea withdrawal motion.",
        "paragraph_id": "para_403"
      },
      {
        "text": "841 F.3d at 580. See also In re Sealed Case, 40 F.4th 605, 607 (D.C. Cir. 2022)",
        "paragraph_id": "para_404"
      },
      {
        "text": "(dismissing appeal where appeal waiver contained express provision “waiv[ing]",
        "paragraph_id": "para_405"
      },
      {
        "text": "any argument that . . . [appellant’s] admitted conduct [did] not fall within the",
        "paragraph_id": "para_406"
      },
      {
        "text": "scope of the statute,” precluding “his ability to present the exact claim he now",
        "paragraph_id": "para_407"
      },
      {
        "text": "seeks to raise on appeal”).",
        "paragraph_id": "para_408"
      },
      {
        "text": "Ceasar raises two arguments to avoid this result. She first suggests she fits",
        "paragraph_id": "para_409"
      },
      {
        "text": "within an exception to the presumption of the enforceability of appeal waivers on",
        "paragraph_id": "para_410"
      },
      {
        "text": "the theory that the district court supposedly failed to establish a factual basis for",
        "paragraph_id": "para_411"
      },
      {
        "text": "the plea pursuant to Rule 11(b)(3) of the Federal Rules of Criminal Procedure.",
        "paragraph_id": "para_412"
      },
      {
        "text": "Alternatively, she argues that the appellate waiver is unenforceable “as a",
        "paragraph_id": "para_413"
      },
      {
        "text": "miscarriage of justice in this case,” because she allegedly “pled guilty to an act that",
        "paragraph_id": "para_414"
      },
      {
        "text": "did not satisfy the elements of the offense.” Ceasar Br. at 57. We disagree on both",
        "paragraph_id": "para_415"
      },
      {
        "text": "points.",
        "paragraph_id": "para_416"
      },
      {
        "text": "As to her first argument, Ceasar relies principally on United States v. Adams,",
        "paragraph_id": "para_417"
      },
      {
        "text": "448 F.3d 492 (2d Cir. 2006), for the proposition that “a challenge to a plea’s factual",
        "paragraph_id": "para_418"
      },
      {
        "text": "basis survives an appellate waiver.” Ceasar Br. at 57. But Ceasar misreads Adams.",
        "paragraph_id": "para_419"
      },
      {
        "text": "In Adams, this Court entertained Adams’s appeal and vacated his conviction",
        "paragraph_id": "para_420"
      },
      {
        "text": "despite Adams having signed an appeal waiver, reasoning that review of “all of",
        "paragraph_id": "para_421"
      },
      {
        "text": "the evidence that existed on the record at the time of the plea,” including the Rule",
        "paragraph_id": "para_422"
      },
      {
        "text": "11 colloquy, revealed no evidence that “it was at least reasonably foreseeable to",
        "paragraph_id": "para_423"
      },
      {
        "text": "Adams,” who had allocuted to participating in a conspiracy to distribute",
        "paragraph_id": "para_424"
      },
      {
        "text": "marijuana, “that he was involved in a conspiracy to distribute at least five",
        "paragraph_id": "para_425"
      },
      {
        "text": "kilograms of cocaine.”11 448 F.3d at 501–02. We concluded that the lack of factual",
        "paragraph_id": "para_426"
      },
      {
        "text": "basis in that case was not a technical defect, but “a substantial defect” of a type",
        "paragraph_id": "para_427"
      },
      {
        "text": "“’so fundamental as to cast serious doubt on the voluntariness of the plea.’” Id. at",
        "paragraph_id": "para_428"
      },
      {
        "text": "502 (quoting Godwin v. United States, 687 F.2d 585, 591 (2d Cir. 1982)).",
        "paragraph_id": "para_429"
      },
      {
        "text": "To be sure, “[i]f we are not assured that a defendant’s plea was voluntary",
        "paragraph_id": "para_430"
      },
      {
        "text": "and knowing, we will not enforce any waivers provided in the related plea",
        "paragraph_id": "para_431"
      },
      {
        "text": "agreement.” United States v. Lloyd, 901 F.3d 111, 118 (2d Cir. 2018); see also Sanford,",
        "paragraph_id": "para_432"
      },
      {
        "text": "841 F.3d at 580 (recognizing circumstance where “waiver was not made",
        "paragraph_id": "para_433"
      },
      {
        "text": "knowingly, voluntarily, and competently” as an exception to the “presumption of",
        "paragraph_id": "para_434"
      },
      {
        "text": "the enforceability” of appeal waiver) (quoting United States v. Gomez-Perez, 215",
        "paragraph_id": "para_435"
      },
      {
        "text": "F.3d 315, 319 (2d Cir. 2000)).12 But Adams is not applicable here. In her allocution,",
        "paragraph_id": "para_436"
      },
      {
        "text": "11 As the Adams panel noted, the marijuana conspiracy to which Adams allocuted carried “no",
        "paragraph_id": "para_437"
      },
      {
        "text": "mandatory minimum and a maximum of no more than five years imprisonment,” while the cocaine",
        "paragraph_id": "para_438"
      },
      {
        "text": "conspiracy carried “a mandatory minimum sentence of no less than ten years and a maximum of life",
        "paragraph_id": "para_439"
      },
      {
        "text": "imprisonment.” Id. at 499.",
        "paragraph_id": "para_440"
      },
      {
        "text": "12 We “have recognized only five circumstances where we will not enforce” an appeal waiver:",
        "paragraph_id": "para_441"
      },
      {
        "text": "Ceasar affirmed that, while “released on supervision,” she “knowingly failed to",
        "paragraph_id": "para_442"
      },
      {
        "text": "appear in court as required.” App’x at 182. She “knew [she] had a court",
        "paragraph_id": "para_443"
      },
      {
        "text": "appearance scheduled for August 25th, 2021 in the Eastern District of New York”",
        "paragraph_id": "para_444"
      },
      {
        "text": "and yet “knowingly did not appear in court . . . as ordered.” App’x at 182–83. In",
        "paragraph_id": "para_445"
      },
      {
        "text": "other words, and despite Ceasar’s argument to the contrary, there was ample",
        "paragraph_id": "para_446"
      },
      {
        "text": "factual basis for her plea. The record confounds at the start any argument that her",
        "paragraph_id": "para_447"
      },
      {
        "text": "plea was not knowing, voluntary, and competent.",
        "paragraph_id": "para_448"
      },
      {
        "text": "Ceasar challenges the factual basis for her plea as a backdoor way in which",
        "paragraph_id": "para_449"
      },
      {
        "text": "to urge that her conduct does not fall within the Bail Reform Act on the theory that",
        "paragraph_id": "para_450"
      },
      {
        "text": "she did not knowingly fail to appear “having been released” under its provisions.",
        "paragraph_id": "para_451"
      },
      {
        "text": "18 U.S.C. § 3146(a). But, to satisfy Rule 11, the district court need not rely",
        "paragraph_id": "para_452"
      },
      {
        "text": "exclusively on a defendant’s allocution to conclude that her admitted conduct falls",
        "paragraph_id": "para_453"
      },
      {
        "text": "within the scope of the statute to which she is pleading guilty. See United States v.",
        "paragraph_id": "para_454"
      },
      {
        "text": "Smith, 160 F.3d 117, 121 (2d Cir. 1998) (noting that a plea’s factual basis “need not",
        "paragraph_id": "para_455"
      },
      {
        "text": "“(1) where the waiver was not made knowingly, voluntarily, and competently; (2) where",
        "paragraph_id": "para_456"
      },
      {
        "text": "the sentence was based on constitutionally impermissible factors, such as ethnic, racial[,]",
        "paragraph_id": "para_457"
      },
      {
        "text": "or other prohibited biases; (3) where the government breached the agreement containing",
        "paragraph_id": "para_458"
      },
      {
        "text": "the waiver, . . . (4) where the district court failed to enunciate any rationale for the",
        "paragraph_id": "para_459"
      },
      {
        "text": "defendant’s sentence,” and (5) where the waiver “was unsupported by consideration.”",
        "paragraph_id": "para_460"
      },
      {
        "text": "Cook v. United States, 84 F.4th 118, 122 (2d Cir. 2023) (citation modified). In addition, as discussed infra, we",
        "paragraph_id": "para_461"
      },
      {
        "text": "have recently recognized, following the Supreme Court’s decision in Hunter, that when a miscarriage of",
        "paragraph_id": "para_462"
      },
      {
        "text": "justice would result, “’an appeal waiver is unenforceable.’” Matos, 2026 WL 2339567 at *5 (quoting Hunter,",
        "paragraph_id": "para_463"
      },
      {
        "text": "146 S. Ct. at 1713).",
        "paragraph_id": "para_464"
      },
      {
        "text": "be drawn directly from the defendant,” and that the judge “may look,” inter alia,",
        "paragraph_id": "para_465"
      },
      {
        "text": "“to answers provided by counsel for the defense and government”). And Ceasar’s",
        "paragraph_id": "para_466"
      },
      {
        "text": "counsel was specifically asked by the district court whether counsel knew “of any",
        "paragraph_id": "para_467"
      },
      {
        "text": "reason why your client should not plead guilty to the information” or of “any",
        "paragraph_id": "para_468"
      },
      {
        "text": "viable legal defenses,” to which counsel responded, “No.” App’x at 180-81. The",
        "paragraph_id": "para_469"
      },
      {
        "text": "district court was entitled to rely on those answers, in determining that there was",
        "paragraph_id": "para_470"
      },
      {
        "text": "a factual basis for the plea.",
        "paragraph_id": "para_471"
      },
      {
        "text": "More to the point, the argument that Ceasar actually makes—that her",
        "paragraph_id": "para_472"
      },
      {
        "text": "admitted conduct does not fall within the Act’s scope—is the argument expressly",
        "paragraph_id": "para_473"
      },
      {
        "text": "prohibited by the provision in the plea agreement in which Ceasar “waive[d] the",
        "paragraph_id": "para_474"
      },
      {
        "text": "right to raise on appeal . . . any argument that . . . [her] admitted conduct does not",
        "paragraph_id": "para_475"
      },
      {
        "text": "fall within the scope of the statutes” to which she pleaded guilty. App’x at 152.",

        "text": "This case is thus analogous to In re Sealed Case, in the D.C. Circuit, in which a",
        "paragraph_id": "para_477"
      },
      {
        "text": "defendant, having stipulated to the very same waiver, nonetheless sought to argue",
        "paragraph_id": "para_478"
      },
      {
        "text": "on appeal that his conviction could not be “sustained under the relevant statutes",
        "paragraph_id": "para_479"
      },
      {
        "text": "because shipping chemicals intending or knowing that they will stop in the United",
        "paragraph_id": "para_480"
      },
      {
        "text": "States on their way to South America does not constitute importation into the",
        "paragraph_id": "para_481"
      },
      {
        "text": "United States (or knowledge of such importation).” 40 F.4th at 607. As Chief Judge",
        "paragraph_id": "para_482"
      },
      {
        "text": "Srinivasan concluded in that case:",
        "paragraph_id": "para_483"
      },
      {
        "text": "In his “Appeal Waiver,” appellant “waive[d] any argument that . . .",
        "paragraph_id": "para_484"
      },
      {
        "text": "his admitted conduct does not fall within the scope of the statute” to",
        "paragraph_id": "para_485"
      },
      {
        "text": "“which he is pleading guilty.” Plea Agreement ¶ 7. J.A. 257.",
        "paragraph_id": "para_486"
      },
      {
        "text": "Appellant thereby expressly waived his ability to present the exact",
        "paragraph_id": "para_487"
      },
      {
        "text": "claim he now seeks to raise on appeal.",
        "paragraph_id": "para_488"
      },
      {
        "text": "Appellant contends that, while his appeal waiver precludes",
        "paragraph_id": "para_489"
      },
      {
        "text": "him from disputing the nature of his admitted conduct, it does not bar",
        "paragraph_id": "para_490"
      },
      {
        "text": "him from making a purely interpretive argument about the scope of",
        "paragraph_id": "para_491"
      },
      {
        "text": "the applicable statutes. That reading contradicts the plain terms of",
        "paragraph_id": "para_492"
      },
      {
        "text": "appellant’s appeal waiver. The waiver takes “his admitted conduct”",
        "paragraph_id": "para_493"
      },
      {
        "text": "as a given and bars any claim alleging that the conduct falls outside",
        "paragraph_id": "para_494"
      },
      {
        "text": "the relevant statutes. That is precisely what appellant seeks to do.",
        "paragraph_id": "para_495"
      },
      {
        "text": "In re Sealed Case, 40 F.4th at 607–08. So, too, with respect to Ceasar’s argument on",
        "paragraph_id": "para_496"
      },
      {
        "text": "appeal.",
        "paragraph_id": "para_497"
      },
      {
        "text": "Ceasar next argues that even assuming Adams is inapposite, the appellate",
        "paragraph_id": "para_498"
      },
      {
        "text": "waiver here is unenforceable “as a miscarriage of justice . . . because Ceasar pled",
        "paragraph_id": "para_499"
      },
      {
        "text": "guilty to an act that did not satisfy the elements of the offense.” Ceasar Br. at 57.",
        "paragraph_id": "para_500"
      },
      {
        "text": "We disagree. The record is clear that in correspondence before Ceaser signed the",
        "paragraph_id": "para_501"
      },
      {
        "text": "plea agreement, her counsel expressed the view that “it doesn’t look like she was",
        "paragraph_id": "para_502"
      },
      {
        "text": "ever released on bail so as to trigger the bail jumping statute.” App’x at 255. The",
        "paragraph_id": "para_503"
      },
      {
        "text": "Government then explained why it concluded the statute covered Ceasar’s",
        "paragraph_id": "para_504"
      },
      {
        "text": "conduct, but offered to switch out the failure-to-appear charge for an obstruction",
        "paragraph_id": "para_505"
      },
      {
        "text": "charge “if you prefer.” Id.; see also id. at 256 (offering to highlight in the plea",
        "paragraph_id": "para_506"
      },
      {
        "text": "agreement “the other charges [Ceasar] is avoiding by pleading guilty to [failure to",
        "paragraph_id": "para_507"
      },
      {
        "text": "appear],” including “obstruction and conspiracy”). Ceasar thereafter signed the",
        "paragraph_id": "para_508"
      },
      {
        "text": "plea agreement, gaining the benefit of avoiding an obstruction charge that would",
        "paragraph_id": "para_509"
      },
      {
        "text": "have carried a higher sentence, while expressly waiving the chance to press a",
        "paragraph_id": "para_510"
      },
      {
        "text": "potential argument that the failure-to-appear statute did not apply. She asserts",
        "paragraph_id": "para_511"
      },
      {
        "text": "now that “there is no evidence that [she] was aware of [the] email exchange”",
        "paragraph_id": "para_512"
      },
      {
        "text": "between the Government and defense counsel. Reply Br. at 11 (emphasis added).",
        "paragraph_id": "para_513"
      },
      {
        "text": "Notably, however, Ceasar has never asserted that she lacked knowledge of",
        "paragraph_id": "para_514"
      },
      {
        "text": "counsel’s negotiations on her behalf.",
        "paragraph_id": "para_515"
      },
      {
        "text": "The Supreme Court said in Hunter that the miscarriage of justice limit on the",
        "paragraph_id": "para_516"
      },
      {
        "text": "enforceability of appeal waivers “sets a high bar,” necessitating that a waiver be",
        "paragraph_id": "para_517"
      },
      {
        "text": "set aside only in the face of “egregious error that would bring the judicial system",
        "paragraph_id": "para_518"
      },
      {
        "text": "into disrepute.” 146 S. Ct. at 1713. “The error must be obvious – not one a judge",
        "paragraph_id": "para_519"
      },
      {
        "text": "could reasonably make.” Id. This “hard-to-meet standard” does not extend to",
        "paragraph_id": "para_520"
      },
      {
        "text": "errors that are “uncertain,” but operates as “a safety valve for extreme cases – a",
        "paragraph_id": "para_521"
      },
      {
        "text": "way out of a waiver when the justice system’s basic integrity is at stake.” Id. at",
        "paragraph_id": "para_522"
      },
      {
        "text": "1714.",
        "paragraph_id": "para_523"
      },
      {
        "text": "Simply put, that is not this case. Ceasar refrained from litigating a potential",
        "paragraph_id": "para_524"
      },
      {
        "text": "legal defense and in exchange for giving up her right to do so, she obtained a",
        "paragraph_id": "para_525"
      },
      {
        "text": "favorable plea arrangement. She complains on appeal that “at the time of the plea",
        "paragraph_id": "para_526"
      },
      {
        "text": "agreement and plea, the legal support” for her claim, which she identifies as United",
        "paragraph_id": "para_527"
      },
      {
        "text": "States v. Lipscomb, 66 F.4th at 604, a Fifth Circuit case, “had not yet come down.”",
        "paragraph_id": "para_528"
      },
      {
        "text": "Reply Br. at 11. But a Fifth Circuit case is not binding in this Circuit. And even if",
        "paragraph_id": "para_529"
      },
      {
        "text": "it were, intervening precedent that may strengthen an argument does not",
        "paragraph_id": "para_530"
      },
      {
        "text": "transform enforcement of a knowing, voluntary, and competent waiver into a",
        "paragraph_id": "para_531"
      },
      {
        "text": "miscarriage of justice—particularly given that Ceasar invoked the very same",
        "paragraph_id": "para_532"
      },
      {
        "text": "argument in plea negotiations she now suggests was unavailable prior to this",
        "paragraph_id": "para_533"
      },
      {
        "text": "decision.",
        "paragraph_id": "para_534"
      },
      {
        "text": "In sum, Ceasar waived the argument she now makes on appeal. And she",
        "paragraph_id": "para_535"
      },
      {
        "text": "offers no sound reason that her appeal waiver should not be enforced. The",
        "paragraph_id": "para_536"
      },
      {
        "text": "argument that Ceasar makes on appeal for why the district court should have",
        "paragraph_id": "para_537"
      },
      {
        "text": "granted the plea withdrawal motion is that “her conduct did not violate the",
        "paragraph_id": "para_538"
      },
      {
        "text": "elements of 18 U.S.C. § 3146.” Ceasar Br. at 2. We do not reach the merits of this",
        "paragraph_id": "para_539"
      },
      {
        "text": "argument but conclude, instead, that it is foreclosed by the appeal waiver and by",
        "paragraph_id": "para_540"
      },
      {
        "text": "Ceasar’s express agreement to “waive the right to raise on appeal . . . any argument",
        "paragraph_id": "para_541"
      },
      {
        "text": "that . . . [her] admitted conduct does not fall within the scope of the statute[ ].”",
        "paragraph_id": "para_542"
      },
      {
        "text": "App’x at 152.",
        "paragraph_id": "para_543"
      },
      {
        "text": "II",
        "paragraph_id": "para_544"
      },
      {
        "text": "Ceasar did preserve her second argument, that “the mandatory consecutive",
        "paragraph_id": "para_545"
      },
      {
        "text": "sentence pursuant to § 3147 does not apply to failure to appear,” requiring both",
        "paragraph_id": "para_546"
      },
      {
        "text": "vacatur of her two-month consecutive sentence for violating this provision, and",
        "paragraph_id": "para_547"
      },
      {
        "text": "resentencing.13 Ceasar Br. at 58. We review sentences for abuse of discretion, see",
        "paragraph_id": "para_548"
      },
      {
        "text": "Gall v. United States, 552 U.S. 38, 51 (2007), a standard that “incorporates de novo",
        "paragraph_id": "para_549"
      },
      {
        "text": "review of questions of law,” such as those presented here. United States v. Bonilla,",
        "paragraph_id": "para_550"
      },
      {
        "text": "618 F.3d 102, 108 (2d Cir. 2010) (quoting United States v. Legros, 529 F.3d 470, 474",
        "paragraph_id": "para_551"
      },
      {
        "text": "(2d Cir. 2008)).",
        "paragraph_id": "para_552"
      },
      {
        "text": "The failure-to-appear offense in § 3146 provides that its penalty “shall be",
        "paragraph_id": "para_553"
      },
      {
        "text": "consecutive to the sentence of imprisonment for any other offense.” 18 U.S.C.",
        "paragraph_id": "para_554"
      },
      {
        "text": "§§ 3146(b)(2). Section 3147 provides that the penalty for any offense committed",
        "paragraph_id": "para_555"
      },
      {
        "text": "while on Chapter 207 release (including violation of § 3146) carries an additional",
        "paragraph_id": "para_556"
      },
      {
        "text": "potential sentence, which “shall be consecutive to any other sentence of",
        "paragraph_id": "para_557"
      },
      {
        "text": "13 Ceasar further contends that the district court erred in imposing a three-level enhancement under",
        "paragraph_id": "para_558"
      },
      {
        "text": "the U.S. Sentencing Guidelines that is applicable when a statutory sentencing enhancement under 18 U.S.C.",
        "paragraph_id": "para_559"
      },
      {
        "text": "§ 3147 applies. Ceasar Br. at 58. Ceasar’s Guidelines argument rises or falls with her statutory argument.",
        "paragraph_id": "para_560"
      },
      {
        "text": "Given our rejection of her statutory argument here, we need not further address this purported Guidelines",
        "paragraph_id": "para_561"
      },
      {
        "text": "error.",
        "paragraph_id": "para_562"
      },
      {
        "text": "imprisonment.” 18 U.S.C. § 3147. Ceasar argues that interpreting § 3147 to apply",
        "paragraph_id": "para_563"
      },
      {
        "text": "in the context of a violation of § 3146 provides “separate consecutive punishments",
        "paragraph_id": "para_564"
      },
      {
        "text": "for the same offense,” implicating the Double Jeopardy Clause; that for this reason,",
        "paragraph_id": "para_565"
      },
      {
        "text": "“a clear statement of Congressional intent to impose double punishment” is",
        "paragraph_id": "para_566"
      },
      {
        "text": "required; and that the statute is “at least ambiguous on this point,” so that “the",
        "paragraph_id": "para_567"
      },
      {
        "text": "rule of lenity should preclude application of § 3147 to an offense under § 3146.”",
        "paragraph_id": "para_568"
      },
      {
        "text": "Ceasar Br. at 59 (citing Rutledge v. United States, 517 U.S. 292, 297 (1996)). We",
        "paragraph_id": "para_569"
      },
      {
        "text": "disagree.",
        "paragraph_id": "para_570"
      },
      {
        "text": "Our inquiry begins—and indeed ends—with § 3147’s plain and",
        "paragraph_id": "para_571"
      },
      {
        "text": "unambiguous language. As the First Circuit said in United States v. Chuoun Van",
        "paragraph_id": "para_572"
      },
      {
        "text": "Duong, “Section 3147 provides, without exception, that a defendant ‘convicted of",
        "paragraph_id": "para_573"
      },
      {
        "text": "an offense committed while released under [Chapter 207] shall be sentenced, in",
        "paragraph_id": "para_574"
      },
      {
        "text": "addition to the sentence prescribed for that offense to . . . a term of imprisonment",
        "paragraph_id": "para_575"
      },
      {
        "text": "for not more than ten years if the crime is a felony.’”14 665 F.3d 364, 366–67 (1st",
        "paragraph_id": "para_576"
      },
      {
        "text": "Cir. 2012) (emphases omitted). Failure to appear under § 3146 constitutes “an",
        "paragraph_id": "para_577"
      },
      {
        "text": "offense” and, by definition, it is “committed while released” under Chapter 207.",
        "paragraph_id": "para_578"
      },
      {
        "text": "Consistent with at least six courts of appeals to have considered the question, we",
        "paragraph_id": "para_579"
      },
      {
        "text": "14 The provision then goes on to make clear that “[a] term of imprisonment imposed under this",
        "paragraph_id": "para_580"
      },
      {
        "text": "section shall be consecutive to any other sentence of imprisonment.” 18 U.S.C. § 3147.",
        "paragraph_id": "para_581"
      },
      {
        "text": "discern no ambiguity in this provision. See id; see also United States v. Benson, 134",
        "paragraph_id": "para_582"
      },
      {
        "text": "F.3d 787, 788 (6th Cir. 1998); United States v. Clemendor, 237 F. App’x 473, 478 (11th",
        "paragraph_id": "para_583"
      },
      {
        "text": "Cir. 2007) (per curiam); United States v. Fitzgerald, 435 F.3d 484, 487 (4th Cir. 2006);",
        "paragraph_id": "para_584"
      },
      {
        "text": "United States v. Dison, 573 F.3d 204, 208 (5th Cir. 2009); United States v. Rosas, 615",
        "paragraph_id": "para_585"
      },
      {
        "text": "F.3d 1058, 1064 (9th Cir. 2010).",
        "paragraph_id": "para_586"
      },
      {
        "text": "Ceasar relies primarily on United States v. Tavares, 166 F.Supp.2d 903, 907",
        "paragraph_id": "para_587"
      },
      {
        "text": "(S.D.N.Y. 2001), to argue that despite § 3147’s plain language, the rule of lenity",
        "paragraph_id": "para_588"
      },
      {
        "text": "“precludes application of § 3147 to an offense under § 3146.” Ceasar Br. at 59. But",
        "paragraph_id": "para_589"
      },
      {
        "text": "this is incorrect. The rule of lenity, as we have said before, “has no application",
        "paragraph_id": "para_590"
      },
      {
        "text": "where the meaning of the provision at issue is clear.” United States v. Gitten, 231",
        "paragraph_id": "para_591"
      },
      {
        "text": "F.3d 77, 81 (2d Cir. 2000). See also Pulsifer v. United States, 601 U.S. 124, 152–53",
        "paragraph_id": "para_592"
      },
      {
        "text": "(2024) (noting that where a provision is not “genuinely ambiguous,” the rule of",
        "paragraph_id": "para_593"
      },
      {
        "text": "lenity has “no role . . . to play”); Shular v. United States, 589 U.S. 154, 165 (2020)",
        "paragraph_id": "para_594"
      },
      {
        "text": "(rule of lenity has no application where “we are left with no ambiguity for the rule",
        "paragraph_id": "para_595"
      },
      {
        "text": ". . . to resolve”). In fact, it applies “only if, ‘after considering text, structure, history",
        "paragraph_id": "para_596"
      },
      {
        "text": "and purpose, there remains a grievous ambiguity or uncertainty in the statute such",
        "paragraph_id": "para_597"
      },
      {
        "text": "that [a court] must simply guess as to what Congress intended.’” Abramski v.",
        "paragraph_id": "para_598"
      },
      {
        "text": "United States, 573 U.S. 169, 188 n.10 (2014) (quoting Maracich v. Spears, 570 U.S. 48,",
        "paragraph_id": "para_599"
      },
      {
        "text": "76 (2013)). That is simply not this case.",
        "paragraph_id": "para_600"
      },
      {
        "text": "To the extent that Ceasar claims that subjecting her to punishment pursuant",
        "paragraph_id": "para_601"
      },
      {
        "text": "to § 3147 would violate the Double Jeopardy Clause, moreover, this argument, too,",
        "paragraph_id": "para_602"
      },
      {
        "text": "is unavailing, and has been rejected by at least four courts of appeals. See, e.g.,",
        "paragraph_id": "para_603"
      },
      {
        "text": "United States v. Fitzgerald, 435 F.3d at 487; United States v. Dison, 573 F.3d at 208;",
        "paragraph_id": "para_604"
      },
      {
        "text": "United States v. Rojas, 615 F.3d at 1064; United States v. Clemendor, 237 F. App’x at",
        "paragraph_id": "para_605"
      },
      {
        "text": "478–79. Section 3147, as the Fifth Circuit held in Dison, is a “sentence",
        "paragraph_id": "para_606"
      },
      {
        "text": "enhancement,” 573 F.3d at 208 & n.21, and with respect to cumulative sentences",
        "paragraph_id": "para_607"
      },
      {
        "text": "imposed in a single proceeding, the Supreme Court has affirmed that “the Double",
        "paragraph_id": "para_608"
      },
      {
        "text": "Jeopardy Clause does no more than prevent the sentencing court from prescribing",
        "paragraph_id": "para_609"
      },
      {
        "text": "greater punishment than the legislature intended.“ Missouri v. Hunter, 459 U.S.",
        "paragraph_id": "para_610"
      },
      {
        "text": "359, 366 (1983); see Dison, 573 F.3d at 208 (applying this precept to § 3147); accord",
        "paragraph_id": "para_611"
      },
      {
        "text": "United States v. Fitzgerald, 435 F.3d at 487 (noting the Supreme Court “has",
        "paragraph_id": "para_612"
      },
      {
        "text": "‘[h]istorically . . . found double jeopardy protections inapplicable to sentencing",
        "paragraph_id": "para_613"
      },
      {
        "text": "proceedings’ and has refused to construe sentence enhancements as additional",
        "paragraph_id": "para_614"
      },
      {
        "text": "punishments” (alterations in original) (quoting Monge v. California, 524 U.S. 721,",
        "paragraph_id": "para_615"
      },
      {
        "text": "728 (1998))).",
        "paragraph_id": "para_616"
      },
      {
        "text": "And even assuming arguendo that § 3147 should not be construed as a",
        "paragraph_id": "para_617"
      },
      {
        "text": "sentencing enhancement, and that §§ 3146 and 3147 involve the same offense",
        "paragraph_id": "para_618"
      },
      {
        "text": "under Blockburger v. United States, 284 U.S. 299 (1932), Ceasar’s argument would",
        "paragraph_id": "para_619"
      },
      {
        "text": "still fail. Here, there is “a clear manifestation of Congress’s intent to authorize",
        "paragraph_id": "para_620"
      },
      {
        "text": "more than one punishment.” Barrett v. United States, 607 U.S. 128, 139 (2026).",
        "paragraph_id": "para_621"
      },
      {
        "text": "Congress mandated penalties under § 3147 “in addition to the sentence prescribed.”",
        "paragraph_id": "para_622"
      },
      {
        "text": "18 U.S.C. § 3147 (emphasis added). And “such ‘in addition to’ language,” the",
        "paragraph_id": "para_623"
      },
      {
        "text": "Supreme Court has held, is “‘crystal clear’ evidence of a legislature’s intent to",
        "paragraph_id": "para_624"
      },
      {
        "text": "overcome Blockburger.” Barrett, 607 U.S. at 140 (quoting Hunter, 459 U.S. at 368).",
        "paragraph_id": "para_625"
      },
      {
        "text": "Like the Fifth Circuit, “we too are persuaded by Congress’s unambiguous",
        "paragraph_id": "para_626"
      },
      {
        "text": "language to conclude that a defendant who commits the offense of failure to",
        "paragraph_id": "para_627"
      },
      {
        "text": "appear is subject to the § 3147 enhancement for committing that offense while on",
        "paragraph_id": "para_628"
      },
      {
        "text": "release.” Dison, 573 F.3d at 207.",
        "paragraph_id": "para_629"
      },
      {
        "text": "CONCLUSION",
        "paragraph_id": "para_630"
      },
      {
        "text": "For the foregoing reasons, we DISMISS the appeal in part and otherwise",
        "paragraph_id": "para_631"
      },
      {
        "text": "AFFIRM the district court’s judgment.",
        "paragraph_id": "para_632"
      }
