        "text": "knowingly makes under oath . . . any false statement with",
        "paragraph_id": "para_24"
      },

        "text": "respect to a material fact in any application, affidavit, or",
        "paragraph_id": "para_25"
      },
      {
        "text": "other document required by the immigration laws or",
        "paragraph_id": "para_26"
      },
      {
        "text": "regulations prescribed thereunder, or knowingly",
        "paragraph_id": "para_27"
      },
      {
        "text": "presents any such application, affidavit, or other",
        "paragraph_id": "para_28"
      },
      {
        "text": "document which contains any such false statement or",
        "paragraph_id": "para_29"
      },
      {
        "text": "which fails to contain any reasonable basis in law or fact.",

        "text": "Applying the categorical approach, we conclude that Nemis",
        "paragraph_id": "para_31"
      },
      {
        "text": "was convicted of conspiracy to commit a CIMT. As the parties agree,",
        "paragraph_id": "para_32"
      },
      {
        "text": "knowingly making or presenting materially false statements to",
        "paragraph_id": "para_33"
      },
      {
        "text": "immigration authorities categorically constitutes a CIMT. The final",
        "paragraph_id": "para_34"
      },
      {
        "text": "subclause of § 1546(a), which addresses knowingly presenting a",
        "paragraph_id": "para_35"
      },
      {
        "text": "required immigration document lacking any reasonable basis in law",
        "paragraph_id": "para_36"
      },
      {
        "text": "or fact, also categorically describes a CIMT. Knowingly presenting",
        "paragraph_id": "para_37"
      },
      {
        "text": "to immigration authorities required materials that lack any",
        "paragraph_id": "para_38"
      },
      {
        "text": "reasonable legal or factual basis is deceitful conduct that impairs or",
        "paragraph_id": "para_39"
      },
      {
        "text": "obstructs an important government function. That type of",
        "paragraph_id": "para_40"
      },
      {
        "text": "misconduct falls within the BIA’s definition of a CIMT, which we here",
        "paragraph_id": "para_41"
      },
      {
        "text": "adopt as our own. The BIA correctly concluded that Nemis is",
        "paragraph_id": "para_42"
      },

        "text": "removable, so we DENY his petition for review.",

      {
        "text": "removable, so we deny his petition for review.",
        "paragraph_id": "para_78"
      },
      {
        "text": "I. BACKGROUND",
        "paragraph_id": "para_79"
      },
      {
        "text": "A. Nemis’s Conviction",
        "paragraph_id": "para_80"
      },
      {
        "text": "Nemis, a native and citizen of the Philippines, entered the",
        "paragraph_id": "para_81"
      },
      {
        "text": "United States on a temporary work visa in 2001 and adjusted to lawful",
        "paragraph_id": "para_82"
      },
      {
        "text": "permanent resident status in 2010.",
        "paragraph_id": "para_83"
      },
      {
        "text": "In 2016, Nemis was indicted in the Southern District of New",
        "paragraph_id": "para_84"
      },
      {
        "text": "York for conspiracy to commit immigration fraud in violation of 18",
        "paragraph_id": "para_85"
      },
      {
        "text": "U.S.C. §§ 371 and 1546(a). Section 371 imposes liability on persons",
        "paragraph_id": "para_86"
      },
      {
        "text": "who “conspire either to commit any offense against the United States”",
        "paragraph_id": "para_87"
      },
      {
        "text": "or “to defraud the United States,” where “one or more of such persons",
        "paragraph_id": "para_88"
      },
      {
        "text": "do any act to effect the object of the conspiracy.”",
        "paragraph_id": "para_89"
      },
      {
        "text": "Section 1546(a) provides for imprisonment of whomever",
        "paragraph_id": "para_90"
      },
      {
        "text": "“knowingly makes under oath, or as permitted under penalty of",
        "paragraph_id": "para_91"
      },
      {
        "text": "perjury . . . , knowingly subscribes as true, any false statement with",
        "paragraph_id": "para_92"
      },
      {
        "text": "respect to a material fact in any application, affidavit, or other",
        "paragraph_id": "para_93"
      },
      {
        "text": "document required by the immigration laws or regulations",
        "paragraph_id": "para_94"
      },
      {
        "text": "prescribed thereunder, or knowingly presents any such application,",
        "paragraph_id": "para_95"
      },
      {
        "text": "affidavit, or other document which contains any such false statement",
        "paragraph_id": "para_96"
      },
      {
        "text": "or which fails to contain any reasonable basis in law or fact.”",
        "paragraph_id": "para_97"
      },
      {
        "text": "The one-count indictment charged that “[i]t was a part and",
        "paragraph_id": "para_98"
      },
      {
        "text": "object of the conspiracy that” Nemis “and others prepared and",
        "paragraph_id": "para_99"
      },
      {
        "text": "submitted fraudulent applications in support of H-1B visa",
        "paragraph_id": "para_100"
      },
      {
        "text": "applications.” Certified Admin. Rec. (“CAR”) at 725–26. It alleged",
        "paragraph_id": "para_101"
      },
      {
        "text": "that, “[i]n furtherance of the conspiracy and to effect the illegal object",
        "paragraph_id": "para_102"
      },
      {
        "text": "thereof,” Nemis sent emails to a co-conspirator (“CC-1”) in which",
        "paragraph_id": "para_103"
      },
      {
        "text": "5",
        "paragraph_id": "para_104"
      },
      {
        "text": "Nemis “instructed CC-1 to provide false information to consular",
        "paragraph_id": "para_105",
        "court_paragraph": 5
      },
      {
        "text": "officials during CC-1’s interview in support of CC-1’s application to",
        "paragraph_id": "para_106"
      },
      {
        "text": "obtain an H-1B visa.” Id. at 726.",
        "paragraph_id": "para_107"
      },
      {
        "text": "Nemis pleaded guilty. During the plea colloquy, he admitted",
        "paragraph_id": "para_108"
      },
      {
        "text": "that he “did conspire with others to commit immigration fraud by",
        "paragraph_id": "para_109"
      },
      {
        "text": "submitting documents in support of H-1B visas to the United States",
        "paragraph_id": "para_110"
      },
      {
        "text": "government which [he] knew contained information which was false",
        "paragraph_id": "para_111"
      },
      {
        "text": "and misleading.” Id. at 320. Nemis and his counsel explained that",
        "paragraph_id": "para_112"
      },
      {
        "text": "the visa applications falsely represented applicants’ job qualifications",
        "paragraph_id": "para_113"
      },
      {
        "text": "or contained information about fake jobs. In 2017, the district court",
        "paragraph_id": "para_114"
      },
      {
        "text": "entered a judgment of conviction and sentenced Nemis to two years’",
        "paragraph_id": "para_115"
      },
      {
        "text": "probation.",
        "paragraph_id": "para_116"
      },
      {
        "text": "B. Immigration Proceedings",
        "paragraph_id": "para_117"
      },
      {
        "text": "In 2018, Nemis traveled outside the United States and tried to",
        "paragraph_id": "para_118"
      },
      {
        "text": "reenter. The Department of Homeland Security placed him in",
        "paragraph_id": "para_119"
      },
      {
        "text": "removal proceedings, charging that he had been convicted of a CIMT",
        "paragraph_id": "para_120"
      },
      {
        "text": "or conspiracy to commit a CIMT. 1 Nemis denied the charges of",
        "paragraph_id": "para_121"
      },
      {
        "text": "removability.",
        "paragraph_id": "para_122"
      },
      {
        "text": "1 Under the Immigration and Nationality Act (“INA”), an “alien",
        "paragraph_id": "para_123"
      },
      {
        "text": "lawfully admitted for permanent residence . . . shall not be regarded as",
        "paragraph_id": "para_124"
      },
      {
        "text": "seeking an admission into the United States for purposes of the immigration",
        "paragraph_id": "para_125"
      },
      {

        "text": "1182(a)(2) of this title.” 8 U.S.C. § 1101(a)(13)(C)(v). Section 1182(a)(2), in",
        "paragraph_id": "para_127"
      },
      {
        "text": "turn, provides that any “alien convicted of . . . a crime involving moral",
        "paragraph_id": "para_128"
      },
      {
        "text": "turpitude . . . or an attempt or conspiracy to commit such a crime . . . is",
        "paragraph_id": "para_129"
      },
      {
        "text": "inadmissible.” Id. § 1182(a)(2)(A)(i). “[A]liens who are inadmissible",
        "paragraph_id": "para_130"
      },
      {
        "text": "under [§ 1182(a)(2)] are” generally “ineligible to receive visas and ineligible",
        "paragraph_id": "para_131"
      },
      {
        "text": "to be admitted to the United States.” Id. § 1182(a).",
        "paragraph_id": "para_132"
      },
      {

      },
      {
        "text": "After a hearing, an immigration judge (“IJ”) ordered Nemis’s",
        "paragraph_id": "para_134",
        "court_paragraph": 6
      },
      {
        "text": "removal. The IJ reasoned that Nemis pleaded guilty to committing",
        "paragraph_id": "para_135"
      },
      {
        "text": "fraud over an extended period, which “is clearly behavior that",
        "paragraph_id": "para_136"
      },
      {
        "text": "constitutes a crime involving moral turpitude.” CAR at 149. The",
        "paragraph_id": "para_137"
      },
      {
        "text": "BIA dismissed Nemis’s appeal. See Matter of Nemis, 28 I. & N. Dec.",
        "paragraph_id": "para_138"
      },
      {
        "text": "250, 261 (B.I.A. 2021).",
        "paragraph_id": "para_139"
      },
      {
        "text": "In 2024, we granted Nemis’s petition for review and remanded",
        "paragraph_id": "para_140"
      },
      {
        "text": "to the BIA because the agency had misapplied the categorical",
        "paragraph_id": "para_141"
      },
      {
        "text": "approach. Nemis v. Garland, No. 21-6151-ag, 2024 WL 1252947, at *2",
        "paragraph_id": "para_142"
      },
      {
        "text": "(2d Cir. Mar. 25, 2024). We explained that, to “determine whether a",
        "paragraph_id": "para_143"
      },
      {
        "text": "petitioner was convicted of a CIMT, we apply the categorical",
        "paragraph_id": "para_144"
      },
      {
        "text": "approach and look to whether the ‘criminal category must by",
        "paragraph_id": "para_145"
      },
      {
        "text": "definition, and in all instances, contain each of those elements that",
        "paragraph_id": "para_146"
      },
      {
        "text": "constitute a CIMT.’” Id. at *1. And if “a statute is divisible—that is,",
        "paragraph_id": "para_147"
      },
      {
        "text": "if it ‘sets out one or more elements of the offense in the alternative and",
        "paragraph_id": "para_148"
      },
      {
        "text": "thereby defines multiple crimes’—we apply a ‘modified’ categorical",
        "paragraph_id": "para_149"
      },
      {
        "text": "approach,” which “permits us to review a limited class of documents",
        "paragraph_id": "para_150"
      },
      {
        "text": "from the record of conviction to determine which of the alternate",
        "paragraph_id": "para_151"
      },
      {
        "text": "offenses was the crime of conviction that serves as the alleged CIMT.”",
        "paragraph_id": "para_152"
      },
      {
        "text": "Id.",
        "paragraph_id": "para_153"
      },
      {
        "text": "The parties did not dispute that the conspiracy statute (§ 371) is",
        "paragraph_id": "para_154"
      },
      {
        "text": "divisible and that the modified categorical approach applies. See id.",
        "paragraph_id": "para_155"
      },
      {
        "text": "After reviewing “the record documents underlying Nemis’s prior",
        "paragraph_id": "para_156"
      },
      {
        "text": "conviction,” we determined that “he was convicted of conspiring to",
        "paragraph_id": "para_157"
      },
      {
        "text": "violate § 1546(a).” Id. And § 1546(a), “which contains four",
        "paragraph_id": "para_158"
      },
      {
        "text": "paragraphs, is itself divisible because at least two of its paragraphs",
        "paragraph_id": "para_159"
      },
      {
        "text": "define distinct offenses.” Id. “Paragraph three ‘clearly requires",
        "paragraph_id": "para_160"
      },
      {
        "text": "proof of a fact that paragraph four does not, namely false identity,",
        "paragraph_id": "para_161"
      },
      {
        "text": "7",
        "paragraph_id": "para_162"
      },
      {
        "text": "while paragraph four requires proof of knowing presentment of a",
        "paragraph_id": "para_163",
        "court_paragraph": 7
      },
      {
        "text": "false statement in an immigration document.’” Id. at *2 (alterations",
        "paragraph_id": "para_164"
      },
      {
        "text": "omitted). Applying the modified categorical approach to § 1546(a),",
        "paragraph_id": "para_165"
      },
      {
        "text": "we determined that “Nemis was charged with and ultimately",
        "paragraph_id": "para_166"
      },
      {
        "text": "convicted of violating only paragraph four.” Id.",
        "paragraph_id": "para_167"
      },
      {
        "text": "We concluded that the BIA misapplied the categorical",
        "paragraph_id": "para_168"
      },
      {
        "text": "approach in deciding whether paragraph four qualifies as a CIMT.",
        "paragraph_id": "para_169"
      },
      {
        "text": "Rather than evaluating the “minimum conduct” necessary to support",
        "paragraph_id": "para_170"
      },
      {
        "text": "a conviction under paragraph four, as the categorical approach",
        "paragraph_id": "para_171"
      },
      {
        "text": "requires, the BIA analyzed whether Nemis’s actual conduct",
        "paragraph_id": "para_172"
      },
      {
        "text": "constituted a CIMT. Id. We remanded for the BIA to consider",
        "paragraph_id": "para_173"
      },
      {
        "text": "whether paragraph four necessarily sets forth a CIMT under the",
        "paragraph_id": "para_174"
      },
      {
        "text": "categorical approach. Id.",
        "paragraph_id": "para_175"
      },
      {
        "text": "On remand, the BIA again dismissed Nemis’s appeal,",
        "paragraph_id": "para_176"
      },
      {
        "text": "concluding that paragraph four of § 1546(a) categorically describes a",
        "paragraph_id": "para_177"
      },
      {
        "text": "CIMT. Nemis timely petitioned for review.",
        "paragraph_id": "para_178"
      },
      {
        "text": "II. DISCUSSION",
        "paragraph_id": "para_179"
      },
      {
        "text": "We conclude that paragraph four of § 1546(a) categorically",
        "paragraph_id": "para_180"
      },
      {
        "text": "describes a CIMT.2 The first part of the paragraph makes it a crime",
        "paragraph_id": "para_181"
      },
      {
        "text": "2 The parties initially briefed whether paragraph four categorically",
        "paragraph_id": "para_182"
      },
      {
        "text": "sets forth a CIMT. At our request, the parties filed supplemental briefs",
        "paragraph_id": "para_183"
      },
      {
        "text": "discussing whether paragraph four is divisible into multiple crimes based",
        "paragraph_id": "para_184"
      },
      {
        "text": "on whether the submitted document contained knowing falsehoods or",
        "paragraph_id": "para_185"
      },
      {
        "text": "knowingly lacked any reasonable basis in law or fact. In light of our",
        "paragraph_id": "para_186"
      },
      {
        "text": "conclusion that paragraph four, however committed, categorically",
        "paragraph_id": "para_187"
      },
      {
        "text": "describes a CIMT, we do not decide whether paragraph four is divisible.",
        "paragraph_id": "para_188"
      },
      {
        "text": "See Stankiewicz v. Garland, 103 F.4th 119, 129 (2d Cir. 2024) (“Where . . . there",
        "paragraph_id": "para_189"
      },
      {
        "text": "is no categorical match, we must determine whether the . . . statute of",
        "paragraph_id": "para_190"
      },
      {
        "text": "conviction is ‘divisible.’”).",
        "paragraph_id": "para_191"
      },
      {

      },
      {
        "text": "knowingly to make or to present a materially false statement in a",
        "paragraph_id": "para_193",
        "court_paragraph": 8
      },
      {
        "text": "required immigration document. All agree that this is a CIMT. The",
        "paragraph_id": "para_194"
      },
      {
        "text": "remaining subclause, which covers the knowing presentment of a",
        "paragraph_id": "para_195"
      },
      {
        "text": "required immigration document that the presenter knows lacks any",
        "paragraph_id": "para_196"
      },
      {
        "text": "reasonable basis in law or fact, also categorically sets forth a CIMT.",
        "paragraph_id": "para_197"
      },
      {
        "text": "Such conduct requires that an individual knowingly and intentionally",
        "paragraph_id": "para_198"
      },
      {
        "text": "engage in deceitful behavior that impairs or obstructs an important",
        "paragraph_id": "para_199"
      },
      {
        "text": "government function—the enforcement of immigration laws and",
        "paragraph_id": "para_200"
      },
      {
        "text": "regulations. This combination of reprehensible conduct and a",
        "paragraph_id": "para_201"
      },
      {
        "text": "culpable mental state makes the reasonable-basis subclause a",
        "paragraph_id": "para_202"
      },
      {
        "text": "categorical match with the definition of a CIMT.",
        "paragraph_id": "para_203"
      },
      {
        "text": "A. Legal Framework",
        "paragraph_id": "para_204"
      },
      {
        "text": "Whether Nemis’s “conviction falls within the definition of a",
        "paragraph_id": "para_205"
      },
      {
        "text": "CIMT is a question of law that we review de novo.” Cupete v.",
        "paragraph_id": "para_206"
      },
      {
        "text": "Garland, 29 F.4th 53, 57 (2d Cir. 2022). “In considering whether a",
        "paragraph_id": "para_207"
      },
      {
        "text": "conviction is for a crime involving moral turpitude, the agency and",
        "paragraph_id": "para_208"
      },
      {
        "text": "the courts apply a ‘categorical approach,’ under which the focus is ‘on",
        "paragraph_id": "para_209"
      },
      {
        "text": "the intrinsic nature of the offense rather than on the factual",
        "paragraph_id": "para_210"
      },
      {
        "text": "circumstances surrounding any particular violation.’” Ottey v. Barr,",
        "paragraph_id": "para_211"
      },
      {
        "text": "965 F.3d 84, 94 (2d Cir. 2020). “A crime qualifies as a CIMT only if",
        "paragraph_id": "para_212"
      },
      {
        "text": "‘by definition, and in all instances, it contains those elements that",
        "paragraph_id": "para_213"
      },
      {
        "text": "constitute a CIMT.’” Giron-Molina v. Garland, 86 F.4th 515, 519 (2d",
        "paragraph_id": "para_214"
      },
      {
        "text": "Cir. 2023) (alterations omitted). “Thus, ‘we look only to the",
        "paragraph_id": "para_215"
      },
      {
        "text": "minimum criminal conduct necessary to satisfy the essential elements",
        "paragraph_id": "para_216"
      },
      {
        "text": "of the crime, not the particular circumstances of the defendant’s",
        "paragraph_id": "para_217"
      },
      {
        "text": "conduct.’” Ottey, 965 F.3d at 94.",
        "paragraph_id": "para_218"
      },
      {
        "text": "The INA does not define “crime involving moral turpitude.”",
        "paragraph_id": "para_219"
      },
      {
        "text": "Jang v. Garland, 42 F.4th 56, 60 (2d Cir. 2022). The BIA has construed",
        "paragraph_id": "para_220"
      },
      {

      },
      {
        "text": "CIMTs as crimes requiring “two essential elements: reprehensible",
        "paragraph_id": "para_222",
        "court_paragraph": 9
      },
      {
        "text": "conduct and a culpable mental state.” Mota v. Barr, 971 F.3d 96, 99",
        "paragraph_id": "para_223"
      },
      {
        "text": "(2d Cir. 2020). As to the first element, the BIA has stated that a",
        "paragraph_id": "para_224"
      },
      {
        "text": "“crime involves reprehensible conduct if that conduct is ‘inherently",
        "paragraph_id": "para_225"
      },
      {
        "text": "base, vile, or depraved, and contrary to the accepted rules of morality",
        "paragraph_id": "para_226"
      },
      {
        "text": "and the duties owed between persons or to society in general.’” Id.",
        "paragraph_id": "para_227"
      },
      {
        "text": "“As to a culpable mental state, ‘crimes committed knowingly or",
        "paragraph_id": "para_228"
      },
      {
        "text": "intentionally generally have been found, on the categorical approach,",
        "paragraph_id": "para_229"
      },
      {
        "text": "to be CIMTs.’” Id. (alterations omitted).3 While in the past we have",
        "paragraph_id": "para_230"
      },
      {
        "text": "deferred to the BIA construction, we today clarify that, on our own",
        "paragraph_id": "para_231"
      },
      {
        "text": "review of the statutory text, we adopt this construction. See Loper",
        "paragraph_id": "para_232"
      },
      {
        "text": "Bright Enters. v. Raimondo, 603 U.S. 369, 406 (2024). We also adopt as",
        "paragraph_id": "para_233"
      },
      {
        "text": "our own the BIA’s recognition that, in the context of crimes against",
        "paragraph_id": "para_234"
      },
      {
        "text": "the government, “crimes ‘impairing or obstructing an important",
        "paragraph_id": "para_235"
      },
      {
        "text": "function of a department of the government by defeating its efficiency",
        "paragraph_id": "para_236"
      },
      {
        "text": "or destroying the value of its lawful operations by deceit, graft,",
        "paragraph_id": "para_237"
      },
      {
        "text": "trickery, or dishonest means involve moral turpitude.’” Cupete, 29",
        "paragraph_id": "para_238"
      },
      {
        "text": "F.4th at 58 (alterations omitted). 4 We thus consider whether",
        "paragraph_id": "para_239"
      },
      {
        "text": "paragraph four of § 1546(a) is a “categorical match” with this",
        "paragraph_id": "para_240"
      },
      {
        "text": "standard. Id.",
        "paragraph_id": "para_241"
      },
      {
        "text": "3 “Likewise, crimes committed recklessly (where recklessness is",
        "paragraph_id": "para_242"
      },
      {
        "text": "defined as a conscious disregard of substantial and unjustifiable risk) have,",
        "paragraph_id": "para_243"
      },
      {
        "text": "in certain aggravated circumstances, been found to express a sufficiently",
        "paragraph_id": "para_244"
      },
      {
        "text": "corrupt mental state to constitute a CIMT.” Gill v. INS, 420 F.3d 82, 89 (2d",
        "paragraph_id": "para_245"
      },
      {
        "text": "Cir. 2005).",
        "paragraph_id": "para_246"
      },
      {

      {

        "text": "B. Paragraph Four of 18 U.S.C. § 1546(a) Categorically Describes a",
        "paragraph_id": "para_250",
        "court_paragraph": 10

      {
        "text": "CIMT",
        "paragraph_id": "para_251"
      },
      {
        "text": "Paragraph four covers (1) knowingly making or presenting a",
        "paragraph_id": "para_252"
      },
      {
        "text": "materially false statement in a required immigration document and",
        "paragraph_id": "para_253"
      },
      {
        "text": "(2) knowingly presenting a required immigration document that lacks",
        "paragraph_id": "para_254"
      },
      {
        "text": "any reasonable basis in law or fact. These offenses are categorically",
        "paragraph_id": "para_255"
      },
      {
        "text": "CIMTs.",
        "paragraph_id": "para_256"
      },
      {
        "text": "1. False-Statement Subclauses",
        "paragraph_id": "para_257"
      },
      {
        "text": "Paragraph four first addresses knowingly making or",
        "paragraph_id": "para_258"
      },
      {
        "text": "presenting materially false statements in required immigration",
        "paragraph_id": "para_259"
      },
      {
        "text": "documents. It covers “[w]hoever knowingly makes under oath,” or",
        "paragraph_id": "para_260"
      },
      {
        "text": "“knowingly subscribes as true” “under penalty of perjury,” “any false",
        "paragraph_id": "para_261"
      },
      {
        "text": "statement with respect to a material fact in any application, affidavit,",
        "paragraph_id": "para_262"
      },
      {
        "text": "or other document required by the immigration laws or regulations",
        "paragraph_id": "para_263"
      },
      {
        "text": "prescribed thereunder,” or whoever “knowingly presents any such",
        "paragraph_id": "para_264"
      },
      {
        "text": "application, affidavit, or other document which contains any such",
        "paragraph_id": "para_265"
      },
      {
        "text": "false statement.” 18 U.S.C. § 1546(a).5",
        "paragraph_id": "para_266"
      },
      {
        "text": "The parties agree that the false-statement subclauses",
        "paragraph_id": "para_267"
      },
      {
        "text": "categorically describe a CIMT. Knowingly making a materially false",
        "paragraph_id": "para_268"
      },
      {

        "paragraph_id": "para_273"
      },
      {
        "text": "refers to something that has already been ‘described’ or that is ‘implied or",
        "paragraph_id": "para_274"
      },
      {
        "text": "intelligible from the context or circumstances.’”); Such, BLACK’S LAW",
        "paragraph_id": "para_275"
      },
      {
        "text": "DICTIONARY (6th ed. 1990) (defining “[s]uch” as “[o]f that kind, having",
        "paragraph_id": "para_276"
      },
      {
        "text": "particular quality or character specified,” “[i]dentical with, being the same",
        "paragraph_id": "para_277"
      },
      {
        "text": "as what has been mentioned,” and “[a]like, similar, of the like kind”).",
        "paragraph_id": "para_278"
      },
      {

      },
      {
        "text": "statement to the government is a CIMT. See Cupete, 29 F.4th at 58",
        "paragraph_id": "para_280",
        "court_paragraph": 11
      },
      {
        "text": "(holding that 18 U.S.C. § 1001(a), which requires “knowingly and",
        "paragraph_id": "para_281"
      },
      {
        "text": "willfully” making a materially false statement to, or concealing a",
        "paragraph_id": "para_282"
      },
      {
        "text": "material fact from, the government, categorically sets forth a CIMT).",
        "paragraph_id": "para_283"
      },
      {
        "text": "The false-statement provisions here similarly require knowingly",
        "paragraph_id": "para_284"
      },
      {
        "text": "making or presenting a materially false statement to the government,",
        "paragraph_id": "para_285"
      },
      {
        "text": "so they categorically set forth a CIMT.",
        "paragraph_id": "para_286"
      },
      {
        "text": "2. Reasonable-Basis Subclause",
        "paragraph_id": "para_287"
      },
      {
        "text": "The last subclause of paragraph four makes it a crime to",
        "paragraph_id": "para_288"
      },
      {
        "text": "“knowingly present[] any” “application, affidavit, or other document",
        "paragraph_id": "para_289"
      },
      {
        "text": "required by the immigration laws or regulations” “which fails to",
        "paragraph_id": "para_290"
      },
      {
        "text": "contain any reasonable basis in law or fact.” 18 U.S.C. § 1546(a).6",
        "paragraph_id": "para_291"
      },
      {
        "text": "To determine whether this subclause categorically describes a CIMT,",
        "paragraph_id": "para_292"
      },
      {
        "text": "we first identify “the minimum criminal conduct necessary to satisfy",
        "paragraph_id": "para_293"
      },
      {
        "text": "Thus, “any such application, affidavit, or other document” means “any",
        "paragraph_id": "para_294"
      },
      {
        "text": "application, affidavit, or other document required by the immigration laws",
        "paragraph_id": "para_295"
      },
      {
        "text": "or regulations,” and “any such false statement” means “any false statement",
        "paragraph_id": "para_296"
      },
      {
        "text": "with respect to a material fact.”",
        "paragraph_id": "para_297"
      },
      {

      {
        "text": "This amendment expanded the scope of paragraph four, which previously",
        "paragraph_id": "para_301"
      },
      {
        "text": "included only the false-statement provisions. See, e.g., 18 U.S.C. § 1546(a)",
        "paragraph_id": "para_302"
      },
      {
        "text": "(1995) (covering “[w]hoever knowingly makes under oath, or as permitted",
        "paragraph_id": "para_303"
      },
      {
        "text": "under penalty of perjury . . . knowingly subscribes as true, any false",
        "paragraph_id": "para_304"
      },
      {
        "text": "statement with respect to a material fact in any application, affidavit, or",
        "paragraph_id": "para_305"
      },
      {
        "text": "other document required by the immigration laws or regulations prescribed",
        "paragraph_id": "para_306"
      },
      {
        "text": "thereunder, or knowingly presents any such application, affidavit, or other",
        "paragraph_id": "para_307"
      },
      {
        "text": "document containing any such false statement”).",
        "paragraph_id": "para_308"
      },
      {

      },
      {
        "text": "the essential elements of the crime,” and then assess whether that",
        "paragraph_id": "para_310",
        "court_paragraph": 12
      },
      {
        "text": "conduct constitutes a CIMT. Ottey, 965 F.3d at 94.",
        "paragraph_id": "para_311"
      },
      {
        "text": "i. Minimum Conduct",
        "paragraph_id": "para_312"
      },
      {
        "text": "At a minimum, the reasonable-basis subclause requires the",
        "paragraph_id": "para_313"
      },
      {
        "text": "following: (1) an individual presents a document to immigration",
        "paragraph_id": "para_314"
      },
      {
        "text": "authorities to satisfy a legal requirement; (2) the document contains",
        "paragraph_id": "para_315"
      },
      {
        "text": "no materially false statements but lacks any reasonable basis in law or",
        "paragraph_id": "para_316"
      },
      {
        "text": "fact; (3) the individual knows that he is presenting a legally required",
        "paragraph_id": "para_317"
      },
      {
        "text": "document to immigration authorities; and (4) he knows that the",
        "paragraph_id": "para_318"
      },
      {
        "text": "document lacks any reasonable basis in law or fact.",
        "paragraph_id": "para_319"
      },
      {
        "text": "First, the reasonable-basis subclause requires that the",
        "paragraph_id": "para_320"
      },
      {
        "text": "individual “present[]” a document “required by the immigration",
        "paragraph_id": "para_321"
      },
      {
        "text": "laws or regulations.” 18 U.S.C. § 1546(a). “In common usage, the",
        "paragraph_id": "para_322"
      },
      {
        "text": "verb ‘present’ means ‘to bring or introduce into the presence of",
        "paragraph_id": "para_323"
      },
      {
        "text": "someone.’” Collins v. United States, 996 F.3d 102, 110 (2d Cir. 2021)",
        "paragraph_id": "para_324"
      },
      {
        "text": "(quoting WEBSTER’S THIRD NEW INTERNATIONAL DICTIONARY 1793",
        "paragraph_id": "para_325"
      },
      {
        "text": "(1986)). Likewise, “at law, ‘presentment’ is understood as ‘[t]he act",
        "paragraph_id": "para_326"
      },
      {
        "text": "of presenting or laying before a court or other tribunal a formal",
        "paragraph_id": "para_327"
      },
      {
        "text": "statement about a matter to be dealt with legally.’” Id. (quoting",
        "paragraph_id": "para_328"
      },
      {
        "text": "Presentment, BLACK’S LAW DICTIONARY (11th ed. 2019)). “We assume",
        "paragraph_id": "para_329"
      },
      {

        "text": "reasonable-basis subclause to paragraph four. Id. Further, the fact",
        "paragraph_id": "para_331"
      },
      {
        "text": "that the document is “required by the immigration laws or",
        "paragraph_id": "para_332"
      },
      {
        "text": "regulations,” see 18 U.S.C. § 1546(a), means that the individual must",
        "paragraph_id": "para_333"
      },
      {
        "text": "present it to immigration authorities to satisfy a legal requirement.",
        "paragraph_id": "para_334"
      },
      {
        "text": "The Fourth Circuit recently explained that a “requirement” is",
        "paragraph_id": "para_335"
      },
      {
        "text": "“something an entity sets as a necessary qualification.” United States",
        "paragraph_id": "para_336"
      },
      {
        "text": "v. Aborisade, 163 F.4th 856, 861 (4th Cir. 2026) (alterations omitted)",
        "paragraph_id": "para_337"
      },
      {
        "text": "13",
        "paragraph_id": "para_338"
      },
      {
        "text": "(quoting Requirement, BLACK’S LAW DICTIONARY (12th ed. 2024)). It",
        "paragraph_id": "para_339",
        "court_paragraph": 13
      },
      {
        "text": "then concluded that “the plain language of” paragraph four “clearly",
        "paragraph_id": "para_340"
      },
      {
        "text": "incorporates” the presentment of “false statements to [U.S.",
        "paragraph_id": "para_341"
      },
      {
        "text": "Citizenship and Immigration Services (‘USCIS’)] in . . . visa",
        "paragraph_id": "para_342"
      },
      {
        "text": "applications.” Id. at 860, 862. The reasonable-basis provision thus",
        "paragraph_id": "para_343"
      },
      {
        "text": "requires that the individual submit a legally required document to",
        "paragraph_id": "para_344"
      },
      {
        "text": "immigration authorities.",
        "paragraph_id": "para_345"
      },
      {
        "text": "Second, the document must lack “any reasonable basis in law",
        "paragraph_id": "para_346"
      },
      {
        "text": "or fact.” 18 U.S.C. § 1546(a). The term “basis” means the “support”",
        "paragraph_id": "para_347"
      },
      {
        "text": "or “foundation” for the document. Basis, BLACK’S LAW DICTIONARY",
        "paragraph_id": "para_348"
      },
      {
        "text": "(6th ed. 1990). And “[r]ead naturally, the word ‘any’ has an",
        "paragraph_id": "para_349"
      },
      {
        "text": "expansive meaning, that is, one or some indiscriminately of whatever",
        "paragraph_id": "para_350"
      },
      {
        "text": "kind.” Ali v. Fed. Bureau of Prisons, 552 U.S. 214, 219 (2008) (quotation",
        "paragraph_id": "para_351"
      },
      {
        "text": "marks omitted).7 The reasonable-basis subclause therefore requires",
        "paragraph_id": "para_352"
      },
      {
        "text": "that the document, while not containing any false statements of",
        "paragraph_id": "para_353"
      },
      {
        "text": "material fact, lack any reasonable legal or factual support or",
        "paragraph_id": "para_354"
      },
      {
        "text": "foundation.",
        "paragraph_id": "para_355"
      },
      {
        "text": "Third, the individual must “know[]” that he is presenting a",
        "paragraph_id": "para_356"
      },
      {
        "text": "document required by immigration laws or regulations. 18",
        "paragraph_id": "para_357"
      },
      {
        "text": "U.S.C. § 1546(a). “An individual acts ‘knowingly’ when he acts with",
        "paragraph_id": "para_358"
      },
      {
        "text": "awareness of the nature of his conduct.” Knowingly, BLACK’S LAW",
        "paragraph_id": "para_359"
      },
      {
        "text": "7 The parties agree that the subclause excludes the knowing",

      },
      {
        "text": "presentment of immigration documents with materially false statements",
        "paragraph_id": "para_361"
      },

        "text": "because that conduct is covered by the preceding false-statement",

      },
      {
        "text": "subclauses. See Conn. Fair Hous. Ctr. v. CoreLogic Rental Prop. Sols., LLC,",

      },
      {
        "text": "167 F.4th 605, 623 (2d Cir. 2026) (“We avoid interpretations of statutes under",
        "paragraph_id": "para_364"
      },
      {
        "text": "which some provisions ‘would be superfluous.’”).",
        "paragraph_id": "para_365"
      },
      {

      },
      {
        "text": "DICTIONARY (6th ed. 1990). So, he must be aware that he is",
        "paragraph_id": "para_367",
        "court_paragraph": 14
      },
      {
        "text": "submitting a legally required document to immigration authorities.",
        "paragraph_id": "para_368"
      },
      {
        "text": "Finally, the individual must know that the document he is",
        "paragraph_id": "para_369"
      },
      {
        "text": "presenting to the government lacks any reasonable basis in law or",
        "paragraph_id": "para_370"
      },
      {
        "text": "fact. “As a matter of ordinary English grammar, we normally read",
        "paragraph_id": "para_371"
      },
      {
        "text": "the statutory term ‘knowingly’ as applying to all the subsequently",
        "paragraph_id": "para_372"
      },
      {
        "text": "listed elements of the crime.” Rehaif v. United States, 588 U.S. 225, 230",
        "paragraph_id": "para_373"
      },
      {
        "text": "(2019) (quotation marks omitted). “This is notably not a case where",
        "paragraph_id": "para_374"
      },
      {
        "text": "the modifier ‘knowingly’ introduces a long statutory phrase, such that",
        "paragraph_id": "para_375"
      },
      {
        "text": "questions may reasonably arise about how far into the statute the",
        "paragraph_id": "para_376"
      },
      {
        "text": "modifier extends.” Id. The knowledge requirement thus applies",
        "paragraph_id": "para_377"
      },
      {
        "text": "both to the phrase “presents any [document required by immigration",
        "paragraph_id": "para_378"
      },
      {
        "text": "laws or regulations]” and to the subsequent phrase “fails to contain",
        "paragraph_id": "para_379"
      },
      {
        "text": "any reasonable basis in law or fact.” 18 U.S.C. § 1546(a).",
        "paragraph_id": "para_380"
      },
      {
        "text": "ii. Categorical Analysis",
        "paragraph_id": "para_381"
      },
      {
        "text": "The minimum conduct covered by the reasonable-basis",
        "paragraph_id": "para_382"
      },
      {
        "text": "subclause of § 1546(a)’s fourth paragraph constitutes a CIMT because",
        "paragraph_id": "para_383"
      },
      {
        "text": "it necessarily involves deceit and impairment or obstruction of an",
        "paragraph_id": "para_384"
      },
      {
        "text": "important government function. See Cupete, 29 F.4th at 58. The",
        "paragraph_id": "para_385"
      },
      {
        "text": "conduct is deceitful because an individual who presents an",
        "paragraph_id": "para_386"
      },
      {
        "text": "immigration document that he knows is legally required but is",
        "paragraph_id": "para_387"
      },
      {
        "text": "without basis in law or fact implicitly represents that it satisfies the",
        "paragraph_id": "para_388"
      },
      {
        "text": "legal requirement while knowing that it does not. The presenter",
        "paragraph_id": "para_389"
      },
      {
        "text": "thus purposefully endeavors to mislead the government into thinking",
        "paragraph_id": "para_390"
      },
      {
        "text": "the document is supported by at least a good-faith basis in law and",
        "paragraph_id": "para_391"
      },
      {
        "text": "fact when the presenter knows that is not the case. See Kawashima v.",
        "paragraph_id": "para_392"
      },
      {
        "text": "Holder, 565 U.S. 478, 484 (2012) (defining “deceit” as “the act or",
        "paragraph_id": "para_393"
      },
      {
        "text": "practice of deceiving (as by falsification, concealment, or cheating)”",
        "paragraph_id": "para_394"
      },
      {
        "text": "15",
        "paragraph_id": "para_395"
      },
      {
        "text": "(quoting WEBSTER’S THIRD NEW INTERNATIONAL DICTIONARY 584",
        "paragraph_id": "para_396",
        "court_paragraph": 15
      },
      {
        "text": "(1993))). Moreover, such deceit impairs or obstructs an important",
        "paragraph_id": "para_397"
      },
      {
        "text": "government function—the enforcement of immigration laws and",
        "paragraph_id": "para_398"
      },
      {
        "text": "regulations. The conduct causes the government to rely on a",
        "paragraph_id": "para_399"
      },
      {
        "text": "document that has no basis in law or fact in its immigration",
        "paragraph_id": "para_400"
      },
      {
        "text": "operations. Even where it does not so rely, it causes the government",
        "paragraph_id": "para_401"
      },
      {
        "text": "to waste time and resources reviewing that document and",
        "paragraph_id": "para_402"
      },
      {
        "text": "discovering for itself the lack of merit known to its presenter. Thus,",
        "paragraph_id": "para_403"
      },
      {
        "text": "regardless of the individual’s motive in knowingly submitting the",
        "paragraph_id": "para_404"
      },
      {
        "text": "baseless document, by doing so, he employs “dishonest means” that",
        "paragraph_id": "para_405"
      },
      {
        "text": "can “destroy[] the value of [the government’s] lawful operations,”",
        "paragraph_id": "para_406"
      },
      {
        "text": "Cupete, 29 F.4th at 58. Such conduct by deceit amounts to an",
        "paragraph_id": "para_407"
      },
      {
        "text": "intentional abuse of process reflective of a CIMT.",
        "paragraph_id": "para_408"
      },
      {
        "text": "We are unpersuaded by Nemis’s arguments to the contrary.",
        "paragraph_id": "para_409"
      },
      {
        "text": "First, he argues that the reasonable-basis subclause criminalizes at",
        "paragraph_id": "para_410"
      },
      {
        "text": "least some conduct that is not a CIMT, but the two examples he gives",
        "paragraph_id": "para_411"
      },
      {
        "text": "show the opposite. In the first example, an alien files a meritless",
        "paragraph_id": "para_412"
      },
      {
        "text": "asylum application so that he can be placed in removal proceedings",
        "paragraph_id": "para_413"
      },
      {
        "text": "and then seek cancellation of removal. This sort of strategic misuse",
        "paragraph_id": "para_414"
      },
      {
        "text": "of the asylum process to pursue a collateral immigration benefit",
        "paragraph_id": "para_415"
      },
      {
        "text": "plainly constitutes a CIMT under the BIA’s standard. See Matters of",
        "paragraph_id": "para_416"
      },
      {
        "text": "Jaso & Ayala, 27 I. & N. Dec. 557, 558–59 (B.I.A. 2019) (affirming IJ’s",
        "paragraph_id": "para_417"
      },
      {
        "text": "finding that respondents engaged in “an abuse of the asylum process”",
        "paragraph_id": "para_418"
      },
      {
        "text": "where the “asylum applications they submitted to the USCIS lacked",
        "paragraph_id": "para_419"
      },
      {
        "text": "merit” and “were filed for the sole purpose of securing a hearing on",
        "paragraph_id": "para_420"
      },
      {
        "text": "their cancellation [of removal] applications before an [IJ]”). The",
        "paragraph_id": "para_421"
      },
      {
        "text": "conduct is deceitful because the alien submits a knowingly meritless",
        "paragraph_id": "para_422"
      },
      {
        "text": "asylum application to pursue cancellation of removal. Those",
        "paragraph_id": "para_423"
      },
      {
        "text": "proceedings are available to him only on submission of an application",
        "paragraph_id": "para_424"
      },
      {
        "text": "16",
        "paragraph_id": "para_425"
      },
      {
        "text": "supported by at least a reasonable basis in law and fact.8 As even",
        "paragraph_id": "para_426",
        "court_paragraph": 16
      },
      {
        "text": "Nemis admits, that conduct “is dishonest in a colloquial sense.”",
        "paragraph_id": "para_427"
      },
      {
        "text": "Reply Br. at 6. Although he maintains that it is “not legally",
        "paragraph_id": "para_428"
      },
      {
        "text": "fraudulent or deceitful,” id., he cannot explain how dishonest",
        "paragraph_id": "para_429"
      },
      {
        "text": "behavior “in a colloquial sense” is not deceitful. See Dishonest,",
        "paragraph_id": "para_430"
      },
      {
        "text": "MERRIAM-WEBSTER, https://www.merriam-webster.com/dictionary/",
        "paragraph_id": "para_431"
      },
      {
        "text": "dishonest (last visited Aug. 3, 2026) (defining “dishonest” as",
        "paragraph_id": "para_432"
      },
      {
        "text": "“characterized by lack of truth, honesty, or trustworthiness: unfair,",
        "paragraph_id": "para_433"
      },
      {
        "text": "deceptive” (capitalization omitted)); see also Cupete, 29 F.4th at 58",
        "paragraph_id": "para_434"
      },
      {
        "text": "(stating that a CIMT may “destroy the value of [the government’s]",
        "paragraph_id": "para_435"
      },
      {
        "text": "lawful operations by . . . dishonest means”). The conduct also",
        "paragraph_id": "para_436"
      },
      {
        "text": "involves impairment or obstruction of an important government",
        "paragraph_id": "para_437"
      },
      {
        "text": "function as explained above.",
        "paragraph_id": "para_438"
      },
      {
        "text": "In Nemis’s second example, an alien files a frivolous appeal of",
        "paragraph_id": "para_439"
      },
      {
        "text": "a removal order “to buy time to remain in the United States.” Pet’r",
        "paragraph_id": "para_440"
      },
      {
        "text": "Br. at 17. But this conduct also qualifies as a CIMT. It is deceitful",
        "paragraph_id": "para_441"
      },
      {
        "text": "because the alien, by pursuing an appeal that he knows is meritless,",
        "paragraph_id": "para_442"
      },
      {
        "text": "8 Under the INA, if “the Attorney General determines that an alien",
        "paragraph_id": "para_443"
      },
      {
        "text": "has knowingly made a frivolous application for asylum and the alien has",
        "paragraph_id": "para_444"
      },
      {
        "text": "received [notice of the consequences of doing so], the alien shall be",
        "paragraph_id": "para_445"
      },
      {
        "text": "permanently ineligible for any benefits under [the INA], effective as of the",
        "paragraph_id": "para_446"
      },
      {
        "text": "date of a final determination on such application.” 8 U.S.C. § 1158(d)(6).",
        "paragraph_id": "para_447"
      },
      {
        "text": "As of January 11, 2021, frivolous asylum applications include applications",
        "paragraph_id": "para_448"
      },
      {
        "text": "that are “filed without regard to the merits of the claim” or “clearly",
        "paragraph_id": "para_449"
      },
      {
        "text": "foreclosed by applicable law.” 8 C.F.R. § 208.20(c). And the “benefits” at",
        "paragraph_id": "para_450"
      },
      {
        "text": "issue include cancellation of removal. See Albu v. Holder, 761 F.3d 817, 819",
        "paragraph_id": "para_451"
      },
      {
        "text": "(7th Cir. 2014) (denying petition for review of BIA decision that denied",
        "paragraph_id": "para_452"
      },
      {
        "text": "cancellation of removal under § 1158(d)(6)). So, as long as the alien",
        "paragraph_id": "para_453"
      },
      {
        "text": "receives the required notice and the government determines that he",
        "paragraph_id": "para_454"
      },
      {
        "text": "knowingly submitted a frivolous asylum application, he would be",
        "paragraph_id": "para_455"
      },
      {
        "text": "permanently ineligible for cancellation of removal.",
        "paragraph_id": "para_456"
      },
      {
        "text": "17",
        "paragraph_id": "para_457"
      },
      {
        "text": "looks to deceive the court and immigration authorities as to the good-",
        "paragraph_id": "para_458",
        "court_paragraph": 17
      },
      {
        "text": "faith basis of his appeal to secure something to which he would not",
        "paragraph_id": "para_459"
      },
      {
        "text": "otherwise be entitled, i.e., more time in this country. And his",
        "paragraph_id": "para_460"
      },
      {
        "text": "deception involves an intent to impair or obstruct an important",
        "paragraph_id": "para_461"
      },
      {
        "text": "government function because his purpose is to delay removal.",
        "paragraph_id": "para_462"
      },
      {
        "text": "Nemis thus fails to identify a single example of conduct that is",
        "paragraph_id": "para_463"
      },
      {
        "text": "covered by the reasonable-basis subclause but does not qualify as a",
        "paragraph_id": "para_464"
      },
      {
        "text": "CIMT.",
        "paragraph_id": "para_465"
      },
      {
        "text": "Second, Nemis’s reliance on our decisions in Mendez v. Barr, 960",
        "paragraph_id": "para_466"
      },
      {
        "text": "F.3d 80 (2d Cir. 2020), and Jang fares no better. In Mendez, we held",
        "paragraph_id": "para_467"
      },
      {
        "text": "that misprision of a felony is not categorically a CIMT. 9 We",
        "paragraph_id": "para_468"
      },
      {
        "text": "explained that nothing in the federal misprision statute, “either",
        "paragraph_id": "para_469"
      },
      {
        "text": "expressly or by reasonable inference,” “speaks to intent.” 960 F.3d",
        "paragraph_id": "para_470"
      },
      {
        "text": "at 84. We thus hypothesized that misprision had the potential to",
        "paragraph_id": "para_471"
      },
      {
        "text": "reach an innocent bystander who witnesses a gang shooting and",
        "paragraph_id": "para_472"
      },
      {
        "text": "falsely denies to the police knowledge of those involved for fear of",
        "paragraph_id": "para_473"
      },
      {
        "text": "gang retaliation, or a parent who discovers drugs in a teenage child’s",
        "paragraph_id": "para_474"
      },
      {
        "text": "room and flushes them down the toilet. See id. at 85. Responding",
        "paragraph_id": "para_475"
      },
      {
        "text": "to the dissent’s argument that “misprision qualifies as a CIMT",
        "paragraph_id": "para_476"
      },
      {
        "text": "because it involves ‘dishonest and deceitful behavior,’” we stated that",
        "paragraph_id": "para_477"
      },
      {
        "text": "“almost all crimes involve . . . some dishonest and deceitful behavior,”",
        "paragraph_id": "para_478"
      },
      {
        "text": "so we “require more to hold that a crime categorically constitutes a",
        "paragraph_id": "para_479"
      },
      {
        "text": "CIMT.” Id. at 86. The reasonable-basis subclause of § 1546(a)",
        "paragraph_id": "para_480"
      },
      {
        "text": "demands that “more”—specifically, requiring knowing and",
        "paragraph_id": "para_481"
      },
      {
        "text": "9 Mendez interpreted the federal misprision statute, 18 U.S.C. § 4,",
        "paragraph_id": "para_482"
      },
      {
        "text": "which requires the government to “prove that (1) the principal committed",
        "paragraph_id": "para_483"
      },
      {
        "text": "and completed the alleged felony, (2) the defendant had full knowledge of",
        "paragraph_id": "para_484"
      },
      {
        "text": "that fact, (3) the defendant failed to notify the authorities, and (4) the",
        "paragraph_id": "para_485"
      },
      {
        "text": "defendant took steps to conceal the crime.” 960 F.3d at 84.",
        "paragraph_id": "para_486"
      },
      {
        "text": "18",
        "paragraph_id": "para_487"
      },
      {
        "text": "intentional deceit in filing a document required by law. The",
        "paragraph_id": "para_488",
        "court_paragraph": 18
      },
      {
        "text": "subclause provides that the individual must present a required",
        "paragraph_id": "para_489"
      },
      {
        "text": "immigration document to the government, knowing it to lack any",
        "paragraph_id": "para_490"
      },
      {
        "text": "reasonable basis in law or fact. 18 U.S.C. § 1546(a). Such deception",
        "paragraph_id": "para_491"
      },
      {
        "text": "“committed knowingly or intentionally” is “reprehensible” and thus,",
        "paragraph_id": "para_492"
      },
      {
        "text": "“on the categorical approach,” constitutes a CIMT. Mota, 971 F.3d at",
        "paragraph_id": "para_493"
      },
      {
        "text": "99.",
        "paragraph_id": "para_494"
      },
      {
        "text": "Jang is also inapplicable. We held that the New York crime of",
        "paragraph_id": "para_495"
      },
      {
        "text": "second-degree money laundering is not categorically a CIMT because",
        "paragraph_id": "para_496"
      },
      {
        "text": "“it does not require that the offender act with the ‘evil intent’ that the",
        "paragraph_id": "para_497"
      },
      {
        "text": "BIA has considered to be inherent in a CIMT: that is, an intention to",
        "paragraph_id": "para_498"
      },
      {
        "text": "conceal the underlying criminal activity that created the proceeds, to",
        "paragraph_id": "para_499"
      },
      {
        "text": "impair government function, or to deceive the government.” Jang, 42",
        "paragraph_id": "para_500"
      },
      {
        "text": "F.4th at 63 (citation omitted). Here, by contrast, the reasonable-basis",
        "paragraph_id": "para_501"
      },
      {
        "text": "subclause requires knowing involvement in deceitful conduct that",
        "paragraph_id": "para_502"
      },
      {
        "text": "impairs or obstructs an important government function, which makes",
        "paragraph_id": "para_503"
      },
      {
        "text": "it a categorical match with the CIMT standard.",
        "paragraph_id": "para_504"
      },
      {
        "text": "Third, Nemis attempts to analogize the reasonable-basis",
        "paragraph_id": "para_505"
      },
      {
        "text": "subclause to Federal Rule of Civil Procedure 11, which “permits",
        "paragraph_id": "para_506"
      },
      {
        "text": "sanctions to be imposed for [civil] filings that . . . lack a reasonable",
        "paragraph_id": "para_507"
      },
      {
        "text": "basis in law or fact.” Lawrence v. Richman Grp. of CT LLC, 620 F.3d",
        "paragraph_id": "para_508"
      },
      {
        "text": "153, 158 n.2 (2d Cir. 2010). But Rule 11 liability is evaluated “under",
        "paragraph_id": "para_509"
      },
      {
        "text": "an objective standard of reasonableness,” Morley v. Ciba-Geigy Corp.,",
        "paragraph_id": "para_510"
      },
      {
        "text": "66 F.3d 21, 25 (2d Cir. 1995), not the actual-knowledge standard of the",
        "paragraph_id": "para_511"
      },
      {
        "text": "reasonable-basis subclause, which is more indicative of deceit. Rule",
        "paragraph_id": "para_512"
      },
      {
        "text": "11 is thus inapposite.",
        "paragraph_id": "para_513"
      },
      {
        "text": "Finally, Nemis invokes the rule of lenity. Even if the rule of",
        "paragraph_id": "para_514"
      },
      {
        "text": "lenity in the immigration context survived Loper Bright—which we",
        "paragraph_id": "para_515"
      },
      {
        "text": "19",
        "paragraph_id": "para_516"
      },
      {
        "text": "need not decide—the rule would not apply here. We “turn[] to the",
        "paragraph_id": "para_517",
        "court_paragraph": 19
      },
      {
        "text": "rule of lenity only ‘after applying the ordinary rules of statutory",
        "paragraph_id": "para_518"
      },
      {
        "text": "construction’ and finding ‘an ambiguous statute.’” Vasquez v.",
        "paragraph_id": "para_519"
      },
      {
        "text": "Garland, 80 F.4th 422, 435 n.10 (2d Cir. 2023) (alteration omitted). As",
        "paragraph_id": "para_520"
      },
      {
        "text": "explained above, there is no ambiguity about whether the reasonable-",
        "paragraph_id": "para_521"
      },
      {
        "text": "basis subclause categorically sets forth a CIMT—it does.",
        "paragraph_id": "para_522"
      },
      {
        "text": "We thus conclude that all of paragraph four—the false-",
        "paragraph_id": "para_523"
      },
      {
        "text": "statement subclauses as well as the reasonable-basis subclause—",
        "paragraph_id": "para_524"
      },
      {
        "text": "categorically matches the BIA’s CIMT standard. Nemis’s conviction",
        "paragraph_id": "para_525"
      },
      {
        "text": "for conspiracy to violate paragraph four is therefore a conviction for",
        "paragraph_id": "para_526"
      },
      {
        "text": "conspiracy to commit a CIMT, so the BIA correctly dismissed his",
        "paragraph_id": "para_527"
      },
      {
        "text": "appeal from the IJ’s removal order.",
        "paragraph_id": "para_528"
      },
      {
        "text": "III. CONCLUSION",
        "paragraph_id": "para_529"
      },
      {
        "text": "For the foregoing reasons, we deny the petition for review.",
