        "text": "vicemember, was arrested in Randolph County, Alabama. At the",
        "paragraph_id": "para_30"
      },
      {
        "text": "time, Randolph County allowed arrestees to be immediately re-",
        "paragraph_id": "para_31"
      },
      {
        "text": "leased from jail only if they could pay a predetermined bail amount",
        "paragraph_id": "para_32"
      },
      {
        "text": "tied to the charged crime. This meant that someone like Edwards,",
        "paragraph_id": "para_33"
      },
      {
        "text": "who could not afford the predetermined bail amount, could wait",
        "paragraph_id": "para_34"
      },
      {
        "text": "for days or weeks before receiving a hearing to determine whether",
        "paragraph_id": "para_35"
      },
      {
        "text": "she would be released.",
        "paragraph_id": "para_36"
      },
      {
        "text": "After Edwards was arrested, she filed a class action alleging",
        "paragraph_id": "para_37"
      },
      {
        "text": "that Randolph County’s bail practices unconstitutionally discrimi-",
        "paragraph_id": "para_38"
      },
      {
        "text": "nated against indigent individuals. While this case was pending in",
        "paragraph_id": "para_39"
      },
      {
        "text": "the district court, Randolph County issued a new, more permissive",
        "paragraph_id": "para_40"
      },
      {
        "text": "bail policy. Randolph County moved to dismiss the case based, in",
        "paragraph_id": "para_41"
      },
      {
        "text": "part, on a lack of subject matter jurisdiction. The district court",
        "paragraph_id": "para_42"
      },
      {
        "text": "granted the motion, concluding that the action was largely moot.",
        "paragraph_id": "para_43"
      },
      {
        "text": "But our caselaw is clear that a defendant cannot circumvent",
        "paragraph_id": "para_44"
      },
      {
        "text": "a lawsuit simply by terminating the allegedly wrongful conduct—",
        "paragraph_id": "para_45"
      },
      {
        "text": "which is exactly what Randolph County attempted to do in this",
        "paragraph_id": "para_46"
      },
      {
        "text": "case. We therefore reverse the district court’s mootness dismissal",
        "paragraph_id": "para_47"
      },
      {
        "text": "and conclude that the class may proceed with facial and as-applied",
        "paragraph_id": "para_48"
      },
      {
        "text": "challenges to Randolph County’s prior bail practices, as well as as-",
        "paragraph_id": "para_49"
      },
      {
        "text": "applied challenges to the current bail practices. We take no position",
        "paragraph_id": "para_50"
      },
      {
        "text": "as to the merits of those claims. But our precedent precludes the",
        "paragraph_id": "para_51"
      },
      {

        "paragraph_id": "para_54"
      },
      {
        "text": "bail policy, so we affirm the dismissal of those claims.",
        "paragraph_id": "para_55"
      },
      {
        "text": "I. BACKGROUND",
        "paragraph_id": "para_56"
      },
      {
        "text": "A. Randolph County’s Former Bail System",
        "paragraph_id": "para_57"
      },
      {
        "text": "Prior to September 2017, a person arrested in Randolph",
        "paragraph_id": "para_58"
      },
      {
        "text": "County, Alabama, would be eligible to be released from jail after",
        "paragraph_id": "para_59"
      },
      {
        "text": "paying a predetermined bail amount. The predetermined amounts",
        "paragraph_id": "para_60"
      },
      {
        "text": "were listed on a “bail schedule”—a document that paired a charged",
        "paragraph_id": "para_61"
      },
      {
        "text": "offense with an amount of money the person would have to post.",
        "paragraph_id": "para_62"
      },
      {
        "text": "The county’s district judge and clerk of court implemented the bail",
        "paragraph_id": "para_63"
      },
      {
        "text": "schedule.",
        "paragraph_id": "para_64"
      },
      {
        "text": "Although the bail schedule provided “that a bail amount",
        "paragraph_id": "para_65"
      },
      {
        "text": "may be increased or reduced ‘on a case by case basis,’” Randolph",
        "paragraph_id": "para_66"
      },
      {
        "text": "County officials “d[id] not deviate from [it]” “in practice.” Those",
        "paragraph_id": "para_67"
      },
      {
        "text": "who could afford to post bail were immediately released, while",
        "paragraph_id": "para_68"
      },
      {
        "text": "those who could not post bail remained in jail until their initial ap-",
        "paragraph_id": "para_69"
      },
      {
        "text": "pearance before either the county’s magistrate or district judge.",
        "paragraph_id": "para_70"
      },
      {
        "text": "The initial appearance had to occur no later than three days after",
        "paragraph_id": "para_71"
      },
      {
        "text": "an arrest.",
        "paragraph_id": "para_72"
      },
      {
        "text": "Despite the initial-appearance requirement, Randolph",
        "paragraph_id": "para_73"
      },
      {
        "text": "County’s “general practice [was] to refuse to determine an ar-",
        "paragraph_id": "para_74"
      },
      {
        "text": "restee’s conditions of release at the initial appearance.” Instead, the",
        "paragraph_id": "para_75"
      },
      {
        "text": "court deferred release determinations until a preliminary hearing,",
        "paragraph_id": "para_76"
      },
      {
        "text": "which could occur up to four weeks from the date of arrest.",
        "paragraph_id": "para_77"
      },
      {

        "text": "B. Kandace Edwards’s Arrest and the Filing of the Instant Case",
        "paragraph_id": "para_80"
      },
      {
        "text": "On May 17, 2017, Kandace Edwards, the named plaintiff in",
        "paragraph_id": "para_81"
      },
      {
        "text": "this case, was arrested under the original bail system for forging a",
        "paragraph_id": "para_82"
      },
      {
        "text": "$75 check. Edwards served in the Army National Guard, and at the",
        "paragraph_id": "para_83"
      },
      {
        "text": "time of her arrest, she was 29 years old, a mother of two young",
        "paragraph_id": "para_84"
      },
      {
        "text": "children, and seven-and-a-half months pregnant. She was charged",
        "paragraph_id": "para_85"
      },
      {
        "text": "with possession of a forged instrument in the second degree and",
        "paragraph_id": "para_86"
      },
      {
        "text": "told that she would be released from jail prior to a June 6 court date",
        "paragraph_id": "para_87"
      },
      {
        "text": "only if she could post the $7,500 bond specified in the bail schedule.",
        "paragraph_id": "para_88"
      },
      {
        "text": "But Edwards had fallen on hard times, was dealing with mental",
        "paragraph_id": "para_89"
      },
      {
        "text": "health concerns, and was unable to “afford to buy her release from",
        "paragraph_id": "para_90"
      },
      {
        "text": "jail.”",
        "paragraph_id": "para_91"
      },
      {
        "text": "The day following her arrest, Edwards, acting on behalf of",
        "paragraph_id": "para_92"
      },
      {
        "text": "herself and similarly situated pretrial detainees, filed a class action",
        "paragraph_id": "para_93"
      },
      {
        "text": "complaint in federal court pursuant to 28 U.S.C. § 2201 and",
        "paragraph_id": "para_94"
      },
      {
        "text": "42 U.S.C. § 1983, naming four Randolph County officials. The com-",
        "paragraph_id": "para_95"
      },
      {
        "text": "plaint alleged that Randolph County’s bail practices violated de-",
        "paragraph_id": "para_96"
      },
      {
        "text": "tainees’ rights to (1) due process and equal protection by imposing",
        "paragraph_id": "para_97"
      },
      {

        "text": "Along with the initial complaint, Edwards moved for a tem-",

        "text": "C. Changes to Randolph County’s Bail System and Defendants’",

      },
      {
        "text": "Motions to Dismiss",
        "paragraph_id": "para_110"
      },
      {
        "text": "In September 2017, while the parties were litigating the pre-",
        "paragraph_id": "para_111"
      },
      {
        "text": "liminary injunction in federal court, Randolph County’s sole dis-",
        "paragraph_id": "para_112"
      },
      {
        "text": "trict judge issued a “Standing Order Regarding Pre-Trial Appear-",
        "paragraph_id": "para_113"
      },
      {
        "text": "ance, Establishment of Bonds in Advance of Initial Appearance,",
        "paragraph_id": "para_114"
      },
      {
        "text": "and Individualized Determinations of the Necessity and Ability to",
        "paragraph_id": "para_115"
      },
      {
        "text": "Post Bond.” We will refer to this document as the “2017 Standing",
        "paragraph_id": "para_116"
      },
      {
        "text": "Order.” In short, the 2017 Standing Order adopted a new bail sched-",
        "paragraph_id": "para_117"
      },
      {
        "text": "ule that lowered the secured bail amounts for many offenses and",
        "paragraph_id": "para_118"
      },
      {
        "text": "standardized the procedures for determining the conditions of pre-",
        "paragraph_id": "para_119"
      },
      {
        "text": "trial release. It also “supersede[d] any previous policies or proce-",
        "paragraph_id": "para_120"
      },
      {
        "text": "dures that were in place regarding the posting of bail and” specified",
        "paragraph_id": "para_121"
      },
      {
        "text": "that “any such previous procedures [were] no longer [to] be en-",
        "paragraph_id": "para_122"
      },
      {
        "text": "forced.”",
        "paragraph_id": "para_123"
      },
      {
        "text": "The same day the 2017 Standing Order was issued, Defend-",
        "paragraph_id": "para_124"
      },
      {
        "text": "ants moved to dismiss Edwards’s federal complaint as moot, assert-",
        "paragraph_id": "para_125"
      },
      {
        "text": "ing that Randolph County had terminated the challenged practices.",
        "paragraph_id": "para_126"
      },
      {
        "text": "The district court below denied this request because it was reason-",
        "paragraph_id": "para_127"
      },
      {
        "text": "ably likely that Defendants would “revert to their earlier chal-",
        "paragraph_id": "para_128"
      },
      {
        "text": "lenged conduct if their motion . . . [wa]s granted.”",
        "paragraph_id": "para_129"
      },
      {
        "text": "The district court certified the following class under Federal",
        "paragraph_id": "para_130"
      },
      {
        "text": "Rule of Civil Procedure 23(a) and (b)(2): “all state-court arrestees",
        "paragraph_id": "para_131"
      },
      {
        "text": "who are or who will be jailed in Randolph County who are unable",
        "paragraph_id": "para_132"
      },
      {

        "text": "to pay the secured money bail amount required for their release.”",
        "paragraph_id": "para_135"
      },
      {
        "text": "Shortly after class certification, Plaintiffs amended their complaint,",
        "paragraph_id": "para_136"
      },
      {
        "text": "substituting a defendant and adding a fourth claim challenging the",
        "paragraph_id": "para_137"
      },
      {
        "text": "bail practices under the Sixth Amendment.",
        "paragraph_id": "para_138"
      },
      {
        "text": "While this case was proceeding in district court, our Court",
        "paragraph_id": "para_139"
      },
      {
        "text": "was considering a similar case in a different Alabama county. See",
        "paragraph_id": "para_140"
      },
      {
        "text": "Schultz v. Alabama, 42 F.4th 1298 (11th Cir. 2022). The parties took",
        "paragraph_id": "para_141"
      },
      {
        "text": "note of this fact, and the district court granted their motions to stay",
        "paragraph_id": "para_142"
      },
      {
        "text": "the case pending resolution of Schultz. Schultz subsequently held",
        "paragraph_id": "para_143"
      },
      {
        "text": "that a county’s mid-litigation bail-policy change jurisdictionally",
        "paragraph_id": "para_144"
      },
      {
        "text": "limited the intervenor plaintiff, who had been detained under a pre-",
        "paragraph_id": "para_145"
      },
      {
        "text": "vious system, to challenging only the facial constitutionality of the",
        "paragraph_id": "para_146"
      },
      {
        "text": "operative policy. Id. at 1318–22. Schultz then determined that the",
        "paragraph_id": "para_147"
      },
      {
        "text": "plaintiff’s facial equal-protection and due-process claims to the ex-",
        "paragraph_id": "para_148"
      },
      {
        "text": "isting policy failed on the merits. Id. at 1322–35.",
        "paragraph_id": "para_149"
      },
      {
        "text": "After the Supreme Court denied certiorari in Schultz, see Hes-",
        "paragraph_id": "para_150"
      },
      {
        "text": "ter v. Gentry, 143 S. Ct. 2610 (2023), the district court lifted the stay",
        "paragraph_id": "para_151"
      },
      {
        "text": "in this case and Defendants moved to dismiss the amended com-",
        "paragraph_id": "para_152"
      },
      {
        "text": "plaint under Federal Rule of Civil Procedure 12(b)(1) and (b)(6).",
        "paragraph_id": "para_153"
      },
      {
        "text": "The district court granted Defendants’ motions.",
        "paragraph_id": "para_154"
      },
      {
        "text": "Relying on Schultz, the district court concluded that it was",
        "paragraph_id": "para_155"
      },
      {
        "text": "“required to jurisdictionally limit,” in part, Plaintiffs’ challenge. It,",
        "paragraph_id": "para_156"
      },
      {
        "text": "therefore, dismissed as moot the following: (1) “all as-applied and",
        "paragraph_id": "para_157"
      },
      {
        "text": "facial challenges [to] Randolph County’s bail system that existed",
        "paragraph_id": "para_158"
      },
      {
        "text": "prior to” the 2017 Standing Order; (2) “all as-applied challenges, ei-",
        "paragraph_id": "para_159"
      },
      {

        "paragraph_id": "para_162"
      },
      {
        "text": "ing . . . Order”; and (3) “any and all pattern, practice, policy, or pro-",
        "paragraph_id": "para_163"
      },
      {
        "text": "cedure claims to the bail system that do not directly target the facial",
        "paragraph_id": "para_164"
      },
      {
        "text": "terms of the” 2017 Standing Order. The district court then con-",
        "paragraph_id": "para_165"
      },
      {
        "text": "cluded that any facial constitutional challenges to the 2017 Standing",
        "paragraph_id": "para_166"
      },
      {
        "text": "Order that remained in the complaint failed to state a plausible",
        "paragraph_id": "para_167"
      },
      {
        "text": "claim for relief.",
        "paragraph_id": "para_168"
      },
      {
        "text": "This appeal followed.",
        "paragraph_id": "para_169"
      },
      {
        "text": "II. STANDARD OF REVIEW",
        "paragraph_id": "para_170"
      },
      {
        "text": "We review de novo questions of Article III justiciability.",
        "paragraph_id": "para_171"
      },
      {
        "text": "Cook v. Bennett, 792 F.3d 1294, 1298 (11th Cir. 2015). “When evalu-",
        "paragraph_id": "para_172"
      },
      {
        "text": "ating a district court’s conclusions on a Rule 12(b)(1) motion [to",
        "paragraph_id": "para_173"
      },
      {
        "text": "dismiss for lack of subject matter jurisdiction], we review the dis-",
        "paragraph_id": "para_174"
      },
      {
        "text": "trict court’s legal conclusions de novo and its factual findings for",
        "paragraph_id": "para_175"
      },
      {
        "text": "clear error.” Zinni v. ER Sols., Inc., 692 F.3d 1162, 1166 (11th Cir.",
        "paragraph_id": "para_176"
      },
      {
        "text": "2012) (citation omitted). We also review de novo the grant of a",
        "paragraph_id": "para_177"
      },
      {
        "text": "Rule 12(b)(6) motion to dismiss for failure to state a claim. Baker v.",
        "paragraph_id": "para_178"
      },
      {
        "text": "City of Madison, 67 F.4th 1268, 1276 (11th Cir. 2023).",
        "paragraph_id": "para_179"
      },
      {
        "text": "III. DISCUSSION",
        "paragraph_id": "para_180"
      },
      {
        "text": "Our discussion proceeds in two parts. We begin by explain-",
        "paragraph_id": "para_181"
      },
      {
        "text": "ing why the district court erroneously dismissed a majority of",
        "paragraph_id": "para_182"
      },
      {
        "text": "Plaintiffs’ action as moot. We then outline why, to the extent they",
        "paragraph_id": "para_183"
      },
      {
        "text": "seek to do so in the operative complaint, Plaintiffs cannot maintain",
        "paragraph_id": "para_184"
      },
      {
        "text": "facial challenges to the 2017 Standing Order.",
        "paragraph_id": "para_185"

        "text": "A. Randolph County’s Mid-Litigation Bail-Policy Change Does",
        "paragraph_id": "para_188"
      },
      {
        "text": "Not Moot Plaintiffs’ Action",
        "paragraph_id": "para_189"
      },
      {
        "text": "Article III of the Constitution limits the jurisdiction of the",
        "paragraph_id": "para_190"
      },
      {
        "text": "federal courts to “Cases” and “Controversies.” U.S. CONST. art. III,",
        "paragraph_id": "para_191"
      },
      {
        "text": "§ 2. Two crucial and “closely related” justiciability principles are at",
        "paragraph_id": "para_192"
      },
      {
        "text": "play in this appeal—standing and mootness. Cambridge Christian",
        "paragraph_id": "para_193"
      },
      {
        "text": "Sch., Inc. v. Fla. High Sch. Athletic Ass’n, 115 F.4th 1266, 1280 (11th",
        "paragraph_id": "para_194"
      },
      {
        "text": "Cir. 2024), cert. denied, 146 S. Ct. 607 (2025).",
        "paragraph_id": "para_195"
      },
      {
        "text": "To establish Article III standing, “[a] plaintiff must have",
        "paragraph_id": "para_196"
      },
      {
        "text": "(1) suffered an injury in fact, (2) that is fairly traceable to the chal-",
        "paragraph_id": "para_197"
      },
      {
        "text": "lenged conduct of the defendant[s], and (3) that is likely to be re-",
        "paragraph_id": "para_198"
      },
      {
        "text": "dressed by a favorable judicial decision.” Spokeo, Inc. v. Robins,",
        "paragraph_id": "para_199"
      },
      {
        "text": "578 U.S. 330, 338 (2016). “Standing is determined at the time",
        "paragraph_id": "para_200"
      },
      {
        "text": "the . . . complaint is filed.” Arcia v. Fla. Sec’y of State, 772 F.3d 1335,",
        "paragraph_id": "para_201"
      },
      {
        "text": "1340 (11th Cir. 2014).",
        "paragraph_id": "para_202"
      },
      {
        "text": "But, “[w]hen events subsequent to the commencement of a",
        "paragraph_id": "para_203"
      },
      {
        "text": "lawsuit create a situation in which the court can no longer give the",
        "paragraph_id": "para_204"
      },
      {
        "text": "plaintiff meaningful relief,” the question then becomes whether a",
        "paragraph_id": "para_205"
      },
      {
        "text": "case must be dismissed as moot. Fla. Ass’n of Rehab. Facilities, Inc. v.",
        "paragraph_id": "para_206"
      },
      {
        "text": "Fla. Dep’t of Health and Rehab. Servs., 225 F.3d 1208, 1217 (11th Cir.",
        "paragraph_id": "para_207"
      },
      {
        "text": "2000). “[I]f a suit is moot, it cannot present an Article III case or",
        "paragraph_id": "para_208"
      },
      {
        "text": "controversy and the federal courts lack subject matter jurisdiction",
        "paragraph_id": "para_209"
      },
      {
        "text": "to entertain it.” Coral Springs St. Sys., Inc. v. City of Sunrise, 371 F.3d",
        "paragraph_id": "para_210"
      },
      {
        "text": "1320, 1328 (11th Cir. 2004); see also Fla. Ass’n of Rehab. Facilities,",
        "paragraph_id": "para_211"
      },
      {
        "text": "225 F.3d at 1217 (“Any decision on the merits of a moot case or",
        "paragraph_id": "para_212"
      },
      {
        "text": "issue would be an impermissible advisory opinion.”).",
        "paragraph_id": "para_213"
      },
      {

        "text": "The district court relied on Schultz to conclude that, because",
        "paragraph_id": "para_216"
      },
      {
        "text": "Edwards was not detained under the 2017 Standing Order and",
        "paragraph_id": "para_217"
      },
      {
        "text": "could not bring an as-applied challenge to that order, justiciability",
        "paragraph_id": "para_218"
      },
      {
        "text": "principles required Edwards to be limited to challenging the facial",
        "paragraph_id": "para_219"
      },
      {
        "text": "constitutionality of the 2017 Standing Order (Randolph County’s",
        "paragraph_id": "para_220"
      },
      {
        "text": "current bail policy). And because Edwards was so limited as the",
        "paragraph_id": "para_221"
      },
      {
        "text": "named plaintiff, the entire class was so limited.",
        "paragraph_id": "para_222"
      },
      {
        "text": "On appeal, the parties disagree as to whether Schultz’s juris-",
        "paragraph_id": "para_223"
      },
      {
        "text": "dictional holding applies to this case. For reasons we will explain",
        "paragraph_id": "para_224"
      },
      {
        "text": "below, we conclude that Schultz does not apply to the facts of this",
        "paragraph_id": "para_225"
      },
      {
        "text": "case. Rather, we conclude that the voluntary-cessation doctrine",
        "paragraph_id": "para_226"
      },
      {
        "text": "saves all of Plaintiffs’ claims from mootness.",
        "paragraph_id": "para_227"
      },
      {
        "text": "1. Schultz’s Jurisdictional Holding Is Inapplicable to",
        "paragraph_id": "para_228"
      },
      {
        "text": "This Case",
        "paragraph_id": "para_229"
      },
      {
        "text": "In Schultz, a group of arrestees filed a class action complaint",
        "paragraph_id": "para_230"
      },
      {
        "text": "challenging the constitutionality of the bail system in Cullman",
        "paragraph_id": "para_231"
      },
      {
        "text": "County, Alabama. 42 F.4th at 1310. Bradley Hester intervened in",
        "paragraph_id": "para_232"
      },
      {
        "text": "the case after filing. Id. While the case was pending, but after Hes-",
        "paragraph_id": "para_233"
      },
      {
        "text": "ter was released from jail, Cullman County issued a standing order",
        "paragraph_id": "para_234"
      },
      {
        "text": "setting a new bail schedule and revising the bail procedures. Id. at",
        "paragraph_id": "para_235"
      },
      {
        "text": "1306, 1308, 1310. Just sixteen days later, the district court held an",
        "paragraph_id": "para_236"
      },
      {
        "text": "evidentiary hearing and granted Hester a preliminary injunction.",
        "paragraph_id": "para_237"
      },
      {
        "text": "Id. at 1310–11. The court issued two written orders concluding that",
        "paragraph_id": "para_238"
      },
      {
        "text": "the bail system “unconstitutionally discriminated against the indi-",
        "paragraph_id": "para_239"
      },
      {
        "text": "gent by absolutely depriving them of immediate pretrial release",
        "paragraph_id": "para_240"
      },
      {
        "text": "and by denying them procedural due process at their bail hearings”",
        "paragraph_id": "para_241"
      },
      {

        "text": "and specifying the steps Cullman County would have to take to",
        "paragraph_id": "para_244"
      },
      {
        "text": "make its bail system constitutionally compliant. Id.",
        "paragraph_id": "para_245"
      },
      {
        "text": "On appeal, Schultz reasoned that Hester could not pursue an",
        "paragraph_id": "para_246"
      },
      {
        "text": "as-applied challenge to the existing standing order because he could",
        "paragraph_id": "para_247"
      },
      {
        "text": "not “trace his injury to the current operative bail system.” Id. at",
        "paragraph_id": "para_248"
      },
      {
        "text": "1319 (citing Pugh v. Rainwater, 572 F.2d 1053, 1058–59 (5th Cir. 1978)",
        "paragraph_id": "para_249"
      },
      {
        "text": "(en banc), and Walker v. City of Calhoun, 901 F.3d 1245, 1267 n.13",
        "paragraph_id": "para_250"
      },
      {
        "text": "(11th Cir. 2018)). Schultz emphasized that the limited factual devel-",
        "paragraph_id": "para_251"
      },
      {
        "text": "opment on the county’s implementation of the standing order was",
        "paragraph_id": "para_252"
      },
      {
        "text": "problematic to an as-applied challenge, which “necessarily requires",
        "paragraph_id": "para_253"
      },
      {
        "text": "the development of a factual record for the court to consider.” Id.",
        "paragraph_id": "para_254"
      },
      {
        "text": "(citation omitted). It explained that the facts of Hester’s case",
        "paragraph_id": "para_255"
      },
      {
        "text": "“[we]re tied to the now-defunct bail scheme,” so allowing him to",
        "paragraph_id": "para_256"
      },
      {
        "text": "pursue “an as-applied challenge to the new bail scheme, given the",
        "paragraph_id": "para_257"
      },
      {
        "text": "record before [it], would violate core justiciability principles.” Id.",
        "paragraph_id": "para_258"
      },
      {
        "text": "Schultz ultimately concluded that, because Hester possessed Article",
        "paragraph_id": "para_259"
      },
      {
        "text": "III standing when he became a party, the case was not moot as to",
        "paragraph_id": "para_260"
      },
      {
        "text": "his facial challenge to the existing standing bail order. Id. at",
        "paragraph_id": "para_261"
      },
      {
        "text": "1320–22.",
        "paragraph_id": "para_262"
      },
      {
        "text": "The district court construed Schultz to “[stand] for the prop-",
        "paragraph_id": "para_263"
      },
      {
        "text": "osition that when there is a new standing bail order that purports",
        "paragraph_id": "para_264"
      },
      {
        "text": "to be the real bail policy of a county . . . court[s] must approach the",
        "paragraph_id": "para_265"
      },
      {
        "text": "case singularly from the new standing bail order’s explicit language",
        "paragraph_id": "para_266"
      },
      {
        "text": "without probing into any other policies, patterns, practices, or pro-",
        "paragraph_id": "para_267"
      },
      {
        "text": "cedures that are alleged and from which a developed record may",
        "paragraph_id": "para_268"
      },
      {

        "text": "or may not confirm.” (citation modified.). In other words, the dis-",
        "paragraph_id": "para_271"
      },
      {
        "text": "trict court viewed Schultz as mandating that, when there is a mid-",
        "paragraph_id": "para_272"
      },
      {
        "text": "litigation policy change, “constitutional challenges to a bail deten-",
        "paragraph_id": "para_273"
      },
      {
        "text": "tion program—regardless of the nature of those challenges—are",
        "paragraph_id": "para_274"
      },
      {
        "text": "limited to facial constitutional challenges to the operative standing",
        "paragraph_id": "para_275"
      },
      {
        "text": "bail order.” (citation modified.).",
        "paragraph_id": "para_276"
      },
      {
        "text": "We find no indication that Schultz intended to introduce",
        "paragraph_id": "para_277"
      },
      {
        "text": "such a broad jurisdictional rule. Additionally, Plaintiffs point us to",
        "paragraph_id": "para_278"
      },
      {
        "text": "two key factors that distinguish Schultz from the instant case.",
        "paragraph_id": "para_279"
      },
      {
        "text": "a. Class Certification",
        "paragraph_id": "para_280"
      },
      {
        "text": "Plaintiffs first note that Schultz did not involve a certified",
        "paragraph_id": "para_281"
      },
      {
        "text": "class, which exists in this case. The district court rejected this dis-",
        "paragraph_id": "para_282"
      },
      {
        "text": "tinction because Edwards “did not suffer an injury under the 2017",
        "paragraph_id": "para_283"
      },
      {
        "text": "Standing . . . Order,” and the class members “[step] into [her]",
        "paragraph_id": "para_284"
      },
      {
        "text": "shoes . . . and ha[ve] standing to bring only those claims that be-",
        "paragraph_id": "para_285"
      },
      {
        "text": "longed to [her].” The district court’s conclusions merge the distinct",
        "paragraph_id": "para_286"
      },
      {
        "text": "doctrines of standing and mootness, and Defendants perpetuate",
        "paragraph_id": "para_287"
      },
      {
        "text": "this confusion in their arguments on appeal.",
        "paragraph_id": "para_288"
      },
      {
        "text": "Notably, prior to class certification, a “district court must de-",
        "paragraph_id": "para_289"
      },
      {
        "text": "termine that at least one named class representative has Article III",
        "paragraph_id": "para_290"
      },
      {
        "text": "standing to raise each class subclaim.” Prado-Steiman ex rel. Prado v.",
        "paragraph_id": "para_291"
      },
      {
        "text": "Bush, 221 F.3d 1266, 1279 (11th Cir. 2000). “This individual injury",
        "paragraph_id": "para_292"
      },
      {
        "text": "requirement is not met by alleging that injury has been suffered by",
        "paragraph_id": "para_293"
      },
      {
        "text": "other, unidentified members of the class to which the plaintiff be-",
        "paragraph_id": "para_294"
      },
      {
        "text": "longs and which he purports to represent.” Griffin v. Dugger,",
        "paragraph_id": "para_295"
      },
      {
        "text": "823 F.2d 1476, 1483 (11th Cir. 1987) (citation modified).",

        "text": "Randolph County’s pre-September 2017 bail policy. See Arcia,",
        "paragraph_id": "para_301"
      },
      {
        "text": "772 F.3d at 1340. Edwards suffered an injury in the form of her pre-",
        "paragraph_id": "para_302"
      },
      {
        "text": "trial detention, she could trace that injury to Defendants, and a ju-",
        "paragraph_id": "para_303"
      },
      {
        "text": "dicial determination that those practices were unconstitutional",
        "paragraph_id": "para_304"
      },
      {
        "text": "could redress her injury. See Spokeo, 578 U.S. at 338. Randolph",
        "paragraph_id": "para_305"
      },
      {
        "text": "County’s mid-litigation issuance of the 2017 Standing Order re-",
        "paragraph_id": "para_306"
      },
      {
        "text": "quires us to ask whether Edwards’s claims have become moot, not",
        "paragraph_id": "para_307"
      },
      {
        "text": "whether she lacked standing to bring this case altogether. See Cook,",
        "paragraph_id": "para_308"
      },
      {
        "text": "792 F.3d at 1299 n.3 (“Because standing is measured at the time a",
        "paragraph_id": "para_309"
      },
      {
        "text": "lawsuit is filed, subsequent changes in the law are properly consid-",
        "paragraph_id": "para_310"
      },
      {
        "text": "ered under mootness doctrine.” (citation modified)); see also L.E. ex",
        "paragraph_id": "para_311"
      },
      {
        "text": "rel. Cavorley v. Scamihorn, No. 23-11741, 2026 WL 2249000, at *4",
        "paragraph_id": "para_312"
      },
      {
        "text": "(11th Cir. Aug. 5, 2026) (explaining that “[p]ost-filing events might",
        "paragraph_id": "para_313"
      },
      {
        "text": "well bear on mootness—but not standing”).",
        "paragraph_id": "para_314"
      },
      {
        "text": "Defendants insist that all class members are “locked in” to",
        "paragraph_id": "para_315"
      },
      {
        "text": "Edwards’s standing “for all time,” so they cannot pursue any claims",
        "paragraph_id": "para_316"
      },
      {
        "text": "that Edwards herself cannot maintain. Not so.",
        "paragraph_id": "para_317"
      },
      {
        "text": "When a class is certified, it “acquire[s] a legal status separate",
        "paragraph_id": "para_318"
      },
      {
        "text": "from the interest asserted by” the named plaintiff. Sosna v. Iowa,",
        "paragraph_id": "para_319"
      },
      {
        "text": "419 U.S. 393, 399 (1975). That certification “significantly affects the",
        "paragraph_id": "para_320"
      },
      {
        "text": "mootness determination,” as a live “controversy may exist . . . be-",
        "paragraph_id": "para_321"
      },
      {
        "text": "tween a named defendant and a member of the class repre-",
        "paragraph_id": "para_322"
      },
      {
        "text": "sented . . . even though the claim of the named plaintiff has become",
        "paragraph_id": "para_323"
      },
      {
        "text": "moot.” Id. at 399, 402; see also Gerstein v. Pugh, 420 U.S. 103, 110 n.11",
        "paragraph_id": "para_324"
      },
      {

        "text": "cases in which the termination of a class representative’s claim does",
        "paragraph_id": "para_329"
      },
      {
        "text": "not moot the claims of the unnamed members of the class”); cf. Bd.",

      {
        "text": "case was moot where the named plaintiffs lacked a stake in the out-",
        "paragraph_id": "para_332"
      },
      {
        "text": "come and the case was never properly certified as a class action).",
        "paragraph_id": "para_333"
      },
      {
        "text": "We recognize that the cases providing this proposition often",
        "paragraph_id": "para_334"
      },
      {
        "text": "address a named plaintiff’s change in status rather than an altera-",
        "paragraph_id": "para_335"
      },
      {
        "text": "tion or repeal of the challenged law. See, e.g., Franks v. Bowman",
        "paragraph_id": "para_336"
      },
      {
        "text": "Transp. Co., 424 U.S. 747, 752–53, 755–56 (1976) (holding that the",
        "paragraph_id": "para_337"
      },
      {
        "text": "named plaintiff’s ineligibility for seniority status did not moot the",
        "paragraph_id": "para_338"
      },
      {
        "text": "certified class’s challenges to a trucking company’s employment",
        "paragraph_id": "para_339"
      },
      {
        "text": "policies); Sosna, 419 U.S. at 397–402 (holding that the named plain-",
        "paragraph_id": "para_340"
      },
      {
        "text": "tiff’s satisfaction of Iowa’s one-year residency rule for filing for di-",
        "paragraph_id": "para_341"
      },
      {
        "text": "vorce by the time the case was before the U.S. Supreme Court did",
        "paragraph_id": "para_342"
      },
      {
        "text": "not moot the claims brought by the certified class); Dunn v. Blum-",
        "paragraph_id": "para_343"
      },
      {
        "text": "stein, 405 U.S. 330, 333 n.2 (1972) (noting that the named plaintiff’s",
        "paragraph_id": "para_344"
      },
      {
        "text": "satisfaction of a voting residency requirement did not moot the cer-",
        "paragraph_id": "para_345"
      },
      {
        "text": "tified class’s case). Nevertheless, the Supreme Court’s reasoning",
        "paragraph_id": "para_346"
      },
      {
        "text": "underlying those cases applies with equal force to this case.",
        "paragraph_id": "para_347"
      },
      {
        "text": "Whether due to a change in circumstances or a change in the law,",
        "paragraph_id": "para_348"
      },
      {
        "text": "a controversy that is “no longer live as to” the named plaintiff may",
        "paragraph_id": "para_349"
      },
      {
        "text": "“[remain] very much alive for the class of persons she has been cer-",
        "paragraph_id": "para_350"
      },
      {
        "text": "tified to represent.” Sosna, 419 U.S. at 401.",
        "paragraph_id": "para_351"
      },
      {

        "text": "We also note that the class certified in this case does not dif-",
        "paragraph_id": "para_354"
      },
      {
        "text": "ferentiate between those detained before and after the 2017 Stand-",
        "paragraph_id": "para_355"
      },
      {
        "text": "ing Order’s implementation, despite the certification order post-da-",
        "paragraph_id": "para_356"
      },
      {
        "text": "ting the policy change. Accordingly, the fact that Edwards herself",
        "paragraph_id": "para_357"
      },
      {
        "text": "was not detained under the 2017 Standing Order does not automat-",
        "paragraph_id": "para_358"
      },
      {
        "text": "ically doom the as-applied challenges of her fellow class members.",
        "paragraph_id": "para_359"
      },
      {
        "text": "Cf. Stein v. Buccaneers Ltd. P’ship, 772 F.3d 698, 707 (11th Cir. 2014)",
        "paragraph_id": "para_360"
      },
      {
        "text": "(“The relation-back doctrine allows a named plaintiff whose indi-",
        "paragraph_id": "para_361"
      },
      {
        "text": "vidual claims are moot to represent class members not because the",
        "paragraph_id": "para_362"
      },
      {
        "text": "named plaintiff has moved to certify a class[,] but because the",
        "paragraph_id": "para_363"
      },
      {
        "text": "named plaintiff will adequately present the class claims[,] and un-",
        "paragraph_id": "para_364"
      },
      {
        "text": "less the named plaintiff is allowed to do so the class claims will be",
        "paragraph_id": "para_365"
      },
      {
        "text": "capable of repetition, yet evading review.”).",
        "paragraph_id": "para_366"
      },
      {
        "text": "b. Procedural Posture",
        "paragraph_id": "para_367"
      },
      {
        "text": "Plaintiffs also correctly note that Schultz resolved an appeal",
        "paragraph_id": "para_368"
      },
      {
        "text": "from the grant of a preliminary injunction, which further distin-",
        "paragraph_id": "para_369"
      },
      {
        "text": "guishes it from the instant case. See Schultz, 42 F.4th at 1306, 1311.",
        "paragraph_id": "para_370"
      },
      {
        "text": "Notably, in reaching its jurisdictional holding, Schultz emphasized",
        "paragraph_id": "para_371"
      },
      {
        "text": "the “minimal findings of fact concerning” Cullman County’s bail",
        "paragraph_id": "para_372"
      },
      {
        "text": "practices and that its conclusions were based on “the undisputed",
        "paragraph_id": "para_373"
      },
      {
        "text": "background below.” Id. at 1322 n.5. In Schultz, however, the district",
        "paragraph_id": "para_374"
      },
      {
        "text": "court held a two-day evidentiary hearing at which the parties were",
        "paragraph_id": "para_375"
      },
      {
        "text": "able to litigate the issues presented in the request for injunctive re-",
        "paragraph_id": "para_376"
      },
      {
        "text": "lief. See id. at 1310; see also id. at 1344 (Rosenbaum, J., dissenting in",
        "paragraph_id": "para_377"
      },
      {

        "text": "part). It was therefore clear that the parties had at least some op-",
        "paragraph_id": "para_380"
      },
      {
        "text": "portunity to develop a factual record as to the implementation of",
        "paragraph_id": "para_381"
      },
      {
        "text": "Cullman County’s operative bail policy.",
        "paragraph_id": "para_382"
      },
      {
        "text": "Indeed, many cases resolving mootness issues arise from",
        "paragraph_id": "para_383"
      },
      {
        "text": "more developed records. See, e.g., Keohane v. Fla. Dep’t of Corr. Sec’y,",
        "paragraph_id": "para_384"
      },
      {
        "text": "952 F.3d 1257, 1263, 1268–70 (11th Cir. 2020) (finding that a change",
        "paragraph_id": "para_385"
      },
      {
        "text": "in policy mooted a constitutional challenge on appeal from a bench",
        "paragraph_id": "para_386"
      },
      {
        "text": "trial); Troiano v. Supervisor of Elections, 382 F.3d 1276, 1278, 1283–86",
        "paragraph_id": "para_387"
      },
      {
        "text": "(11th Cir. 2004) (remarking, on appeal from a summary judgment",
        "paragraph_id": "para_388"
      },
      {
        "text": "order, that “all of the available evidence (and it [was] considera-",
        "paragraph_id": "para_389"
      },
      {
        "text": "ble)—and the square finding of fact by the district court—sug-",
        "paragraph_id": "para_390"
      },
      {
        "text": "gest[ed]” mootness); Cambridge Christian, 115 F.4th at 1279–81,",
        "paragraph_id": "para_391"
      },
      {
        "text": "1283–86 (finding certain claims moot following a change in law that",
        "paragraph_id": "para_392"
      },
      {
        "text": "occurred while the appeal of a summary judgment order was pend-",
        "paragraph_id": "para_393"
      },
      {
        "text": "ing with this Court).",
        "paragraph_id": "para_394"
      },
      {
        "text": "By contrast, the record in this case was not fully developed",
        "paragraph_id": "para_395"
      },
      {
        "text": "as to how the 2017 Standing Order has been implemented in prac-",
        "paragraph_id": "para_396"
      },
      {
        "text": "tice. The district court took judicial notice of the 2017 Standing Or-",
        "paragraph_id": "para_397"
      },
      {
        "text": "der’s existence and language, Fed. R. Evid. 201, but it never an-",
        "paragraph_id": "para_398"
      },
      {
        "text": "swered a key question—whether the implementation of the 2017",
        "paragraph_id": "para_399"
      },
      {
        "text": "Standing Order actually terminated the conduct challenged by",
        "paragraph_id": "para_400"
      },
      {
        "text": "Plaintiffs. While a district court “may consider extrinsic evidence”",
        "paragraph_id": "para_401"
      },
      {
        "text": "in resolving factual challenges to subject matter jurisdiction, Car-",
        "paragraph_id": "para_402"
      },
      {
        "text": "michael v. Kellogg, Brown & Root Servs., Inc., 572 F.3d 1271, 1279",
        "paragraph_id": "para_403"
      },
      {
        "text": "(11th Cir. 2009), it may not rely solely on Defendants’ bare asser-",
        "paragraph_id": "para_404"
      },
      {
        "text": "tion that the complained-of bail practices have come to an end. Cf.",
        "paragraph_id": "para_405"
      },
      {

        "text": "“that a court may take judicial notice of a document filed in another",
        "paragraph_id": "para_409"
      },
      {
        "text": "court not for the truth of the matters asserted in the other litiga-",
        "paragraph_id": "para_410"
      },
      {
        "text": "tion, but rather to establish the fact of such litigation and related",
        "paragraph_id": "para_411"
      },
      {
        "text": "filings” (citation modified)).",
        "paragraph_id": "para_412"
      },
      {
        "text": "In summary, we conclude that Schultz does not mandate",
        "paragraph_id": "para_413"
      },
      {
        "text": "that Plaintiffs be limited to pursuing only facial challenges to the",
        "paragraph_id": "para_414"
      },
      {
        "text": "2017 Standing Order. Accordingly, the district court erred in rely-",
        "paragraph_id": "para_415"
      },
      {
        "text": "ing on Schultz to reach its jurisdictional determination.",
        "paragraph_id": "para_416"
      },
      {
        "text": "2. The Voluntary-Cessation Doctrine is the Proper",
        "paragraph_id": "para_417"
      },
      {
        "text": "Vehicle for Determining Whether Plaintiffs’",
        "paragraph_id": "para_418"
      },
      {
        "text": "Claims Are Moot",
        "paragraph_id": "para_419"
      },
      {
        "text": "We must still determine whether Randolph County’s mid-",
        "paragraph_id": "para_420"
      },
      {
        "text": "litigation issuance of the 2017 Standing Order affected the justicia-",
        "paragraph_id": "para_421"
      },
      {
        "text": "bility of the instant case.",
        "paragraph_id": "para_422"
      },
      {
        "text": "“Mootness can occur due to a change in circumstances,",
        "paragraph_id": "para_423"
      },
      {
        "text": "or . . . a change in the law.” Coral Springs, 371 F.3d at 1328. Im-",
        "paragraph_id": "para_424"
      },
      {
        "text": "portantly, however, defendants cannot “automatically moot a case",
        "paragraph_id": "para_425"
      },
      {
        "text": "by the simple expedient of suspending [their] challenged conduct",
        "paragraph_id": "para_426"
      },
      {
        "text": "after [they are] sued.” FBI v. Fikre, 144 S. Ct. 771, 777 (2024) (citation",
        "paragraph_id": "para_427"
      },
      {
        "text": "modified). Indeed, “[t]he doctrine of voluntary cessation provides",
        "paragraph_id": "para_428"
      },
      {
        "text": "an important exception to the general rule that a case is mooted by",
        "paragraph_id": "para_429"
      },
      {
        "text": "the end of the offending behavior.” Troiano, 382 F.3d at 1282. “The",
        "paragraph_id": "para_430"
      },
      {
        "text": "basis for th[is] . . . exception is the commonsense concern that a de-",
        "paragraph_id": "para_431"
      },
      {
        "text": "fendant might willingly change its behavior in the hope of avoiding",
        "paragraph_id": "para_432"
      },
      {

      {
        "text": "Notably, “the voluntary cessation exception . . . does not ap-",
        "paragraph_id": "para_437"
      },
      {
        "text": "ply where subsequent events ma[ke] it absolutely clear that the al-",
        "paragraph_id": "para_438"
      },
      {
        "text": "legedly wrongful behavior could not reasonably be expected to re-",
        "paragraph_id": "para_439"
      },
      {
        "text": "cur.” Flanigan’s Enters., Inc. of Ga. v. City of Sandy Springs, 868 F.3d",
        "paragraph_id": "para_440"
      },
      {
        "text": "1248, 1255 (11th Cir. 2017) (en banc) (citation modified), abrogated",
        "paragraph_id": "para_441"
      },
      {
        "text": "on other grounds by Uzuegbunam v. Preczewski, 141 S. Ct. 792 (2021).",
        "paragraph_id": "para_442"
      },
      {
        "text": "“The heavy burden of persuading the court that the challenged",
        "paragraph_id": "para_443"
      },
      {
        "text": "conduct cannot reasonably be expected to start up again lies with",
        "paragraph_id": "para_444"
      },
      {
        "text": "the party asserting mootness.” Cambridge Christian, 115 F.4th at",
        "paragraph_id": "para_445"
      },
      {
        "text": "1284 (quoting Friends of the Earth, Inc. v. Laidlaw Env’t Servs. (TOC),",
        "paragraph_id": "para_446"
      },
      {
        "text": "Inc., 528 U.S. 167, 189 (2000)).",
        "paragraph_id": "para_447"
      },
      {
        "text": "Government defendants, who are “given considerably more",
        "paragraph_id": "para_448"
      },
      {
        "text": "leeway . . . in the presumption that they are unlikely to resume il-",
        "paragraph_id": "para_449"
      },
      {
        "text": "legal activities,” Coral Springs, 371 F.3d at 1328–29, can generally",
        "paragraph_id": "para_450"
      },
      {
        "text": "meet their burden by rescinding the challenged law or policy, Keo-",
        "paragraph_id": "para_451"
      },
      {
        "text": "hane, 952 F.3d at 1268. And “once the repeal of a policy has",
        "paragraph_id": "para_452"
      },
      {
        "text": "caused . . . jurisdiction to be questioned,” the burden shifts to the",
        "paragraph_id": "para_453"
      },
      {
        "text": "plaintiff to “[show] a reasonable expectation—or . . . a substantial",
        "paragraph_id": "para_454"
      },
      {
        "text": "likelihood—that the government defendant will reverse course and",
        "paragraph_id": "para_455"
      },
      {
        "text": "reenact the repealed rule.” Id. (citation modified).",
        "paragraph_id": "para_456"
      },
      {
        "text": "Sitting en banc, our Court outlined “three broad factors” to",
        "paragraph_id": "para_457"
      },
      {
        "text": "guide this inquiry. Flanigan’s, 868 F.3d at 1257. First, a court should",
        "paragraph_id": "para_458"
      },
      {
        "text": "“ask whether the change in conduct resulted from substantial de-",
        "paragraph_id": "para_459"
      },
      {
        "text": "liberation or is merely an attempt to manipulate . . . jurisdiction.”",
        "paragraph_id": "para_460"
      },
      {

        "text": "Id. In answering this question, it should “examine the timing of the",
        "paragraph_id": "para_463"
      },
      {
        "text": "repeal, the procedures used in enacting it, and any explanations in-",
        "paragraph_id": "para_464"
      },
      {
        "text": "dependent of [the] litigation which may have motivated it.” Id. Sec-",
        "paragraph_id": "para_465"
      },
      {
        "text": "ond, a court should “ask whether the government’s decision to ter-",
        "paragraph_id": "para_466"
      },
      {
        "text": "minate the challenged conduct was unambiguous.” Id. (citation",
        "paragraph_id": "para_467"
      },
      {
        "text": "modified). This requires an inquiry into “whether the actions that",
        "paragraph_id": "para_468"
      },
      {
        "text": "have been taken to allegedly moot the case reflect a rejection of the",
        "paragraph_id": "para_469"
      },
      {
        "text": "challenged conduct that is both permanent and complete.” Id.",
        "paragraph_id": "para_470"
      },
      {
        "text": "Third, a court should ask “whether the government has consist-",
        "paragraph_id": "para_471"
      },
      {
        "text": "ently maintained its commitment to the new policy or legislative",
        "paragraph_id": "para_472"
      },
      {
        "text": "scheme.” Id.",
        "paragraph_id": "para_473"
      },
      {
        "text": "In Walker v. City of Calhoun, we applied this analysis to an-",
        "paragraph_id": "para_474"
      },
      {
        "text": "other case presenting a constitutional challenge to a bail system.",
        "paragraph_id": "para_475"
      },
      {
        "text": "There, the plaintiff brought a class action challenging the city’s se-",
        "paragraph_id": "para_476"
      },
      {
        "text": "cured-money bail system as unconstitutionally discriminatory.",
        "paragraph_id": "para_477"
      },
      {
        "text": "901 F.3d at 1251–52. After the suit was filed and the plaintiff was",
        "paragraph_id": "para_478"
      },
      {
        "text": "released from jail, the city issued a new standing bail order “al-",
        "paragraph_id": "para_479"
      },
      {
        "text": "ter[ing] the prevailing bail policy.” Id. at 1252. The district court en-",
        "paragraph_id": "para_480"
      },
      {
        "text": "tered a preliminary injunction in favor of the plaintiff but did not",
        "paragraph_id": "para_481"
      },
      {
        "text": "make any factual findings as to the county’s implementation of its",
        "paragraph_id": "para_482"
      },
      {
        "text": "new bail procedures. Id. at 1252–54; see also Schultz, 42 F.4th at 1322",
        "paragraph_id": "para_483"
      },
      {
        "text": "n.5 (noting that the district court in Walker “did not make factual",
        "paragraph_id": "para_484"
      },
      {
        "text": "findings on the new bail procedures”). On appeal from the prelim-",
        "paragraph_id": "para_485"
      },
      {
        "text": "inary-injunction order, the plaintiff argued that the city’s original",
        "paragraph_id": "para_486"
      },
      {
        "text": "bail policy was “plainly unconstitutional,” and the district court had",
        "paragraph_id": "para_487"
      },
      {
        "text": "the “equitable discretion” to cure constitutional violations that",
        "paragraph_id": "para_488"
      },
      {

      },
      {
        "text": "901 F.3d at 1269. Our Court agreed. Id. at 1270–71.",

      },
      {
        "text": "Walker first noted that the city was “unnecessarily secretive”",
        "paragraph_id": "para_493"
      },
      {
        "text": "in adopting the standing bail order, as it refused to explain its pro-",
        "paragraph_id": "para_494"
      },
      {
        "text": "cess, and the abandonment of the original bail policy was “not un-",
        "paragraph_id": "para_495"
      },
      {
        "text": "ambiguous” because a single judge order changed it rather than a",
        "paragraph_id": "para_496"
      },
      {

      },
      {
        "text": "[this] lack of transparency surrounding the issuance of the” new",
        "paragraph_id": "para_499"
      },
      {
        "text": "order. Id. Walker noted, however, that it was unclear “whether the",
        "paragraph_id": "para_500"
      },
      {
        "text": "government . . . consistently maintained its commitment to the",
        "paragraph_id": "para_501"
      },
      {
        "text": "new policy or legislative scheme” because enforcement of the",
        "paragraph_id": "para_502"
      },
      {
        "text": "standing order was enjoined only two months after its issuance. Id.",
        "paragraph_id": "para_503"
      },
      {
        "text": "Plaintiffs contend that Walker governs this case, and we",
        "paragraph_id": "para_504"
      },
      {
        "text": "agree. Schultz does not purport to overrule or undermine Walker.",
        "paragraph_id": "para_505"
      },
      {
        "text": "Rather, Schultz relied considerably on Walker to support its jurisdic-",
        "paragraph_id": "para_506"
      },
      {
        "text": "tional conclusion. See Schultz, 42 F.4th at 1321–22 (finding that",
        "paragraph_id": "para_507"
      },
      {
        "text": "Walker supported its jurisdictional analysis because our Court “ad-",
        "paragraph_id": "para_508"
      },
      {
        "text": "dressed the facial constitutionality of the city’s new bail policy in-",
        "paragraph_id": "para_509"
      },
      {
        "text": "stead of determining that the plaintiff lacked standing” and “the",
        "paragraph_id": "para_510"
      },
      {
        "text": "‘reasonable expectation’ factors for mootness” in each case “ha[d]",
        "paragraph_id": "para_511"
      },
      {
        "text": "key factual similarities”). To the extent that the holdings of these",
        "paragraph_id": "para_512"
      },
      {
        "text": "two cases conflict, Walker governs our analysis because it is “the",
        "paragraph_id": "para_513"
      },
      {
        "text": "earliest precedent that reached a binding decision on the issue.”",
        "paragraph_id": "para_514"
      },
      {
        "text": "Rodemaker v. City of Valdosta Bd. of Educ., 110 F.4th 1318, 1326 (11th",

        "text": "Walker leads us to conclude that Defendants cannot circum-",
        "paragraph_id": "para_519"
      },
      {
        "text": "vent this lawsuit by voluntarily enacting a new bail policy. Indeed,",
        "paragraph_id": "para_520"
      },
      {
        "text": "the district court recognized the applicability of the voluntary-ces-",
        "paragraph_id": "para_521"
      },
      {
        "text": "sation doctrine when rejecting Defendants’ motion to dismiss filed",
        "paragraph_id": "para_522"
      },
      {
        "text": "pre-Schultz. In that previous order, the district court walked",
        "paragraph_id": "para_523"
      },
      {
        "text": "through the Flanigan’s factors and found that Defendants were rea-",
        "paragraph_id": "para_524"
      },
      {
        "text": "sonably likely to “revert to their earlier challenged conduct” if",
        "paragraph_id": "para_525"
      },
      {
        "text": "Plaintiffs’ complaint were dismissed. The court noted, among",
        "paragraph_id": "para_526"
      },
      {
        "text": "other things, that (1) the 2017 Standing Order was issued the very",
        "paragraph_id": "para_527"
      },
      {
        "text": "same day Defendants moved to dismiss the case as moot; (2) the",
        "paragraph_id": "para_528"
      },
      {
        "text": "2017 Standing Order was unilaterally issued by Randolph County’s",
        "paragraph_id": "para_529"
      },
      {
        "text": "single district judge; (3) Defendants did not provide a clear reason",
        "paragraph_id": "para_530"
      },
      {
        "text": "for the order’s implementation other than the fact that it “obvi-",
        "paragraph_id": "para_531"
      },
      {
        "text": "ate[d] the need for a preliminary injunction”; and (4) Defendants",
        "paragraph_id": "para_532"
      },
      {
        "text": "failed to admit to any wrongdoing with their previous bail prac-",
        "paragraph_id": "para_533"
      },
      {
        "text": "tices.",
        "paragraph_id": "para_534"
      },
      {
        "text": "All these facts remain true. Indeed, the district court noted",
        "paragraph_id": "para_535"
      },
      {
        "text": "in its instant dismissal order that “[b]ut for” its (mistaken) view of",
        "paragraph_id": "para_536"
      },
      {
        "text": "“Schultz’s directive . . . [it] would be inclined to revisit . . . the vol-",
        "paragraph_id": "para_537"
      },
      {
        "text": "untary-cessation doctrine,” and potentially “permit challenges to",
        "paragraph_id": "para_538"
      },
      {
        "text": "the pre-[2017] Standing . . . Order system that seek an injunction",
        "paragraph_id": "para_539"
      },
      {
        "text": "preventing Defendants from returning to that system.” And despite",
        "paragraph_id": "para_540"
      },
      {
        "text": "that Plaintiffs pointed out the district court’s previous mootness",
        "paragraph_id": "para_541"
      },
      {
        "text": "findings in its briefing on appeal, Defendants do not meaningfully",
        "paragraph_id": "para_542"
      },
      {
        "text": "contest these determinations before our Court.",
        "paragraph_id": "para_543"
      },
      {

        "text": "As such, we conclude that, at this stage, it is not “absolutely",
        "paragraph_id": "para_546"
      },
      {
        "text": "clear that [Defendants’] allegedly wrongful behavior could not rea-",
        "paragraph_id": "para_547"
      },
      {
        "text": "sonably be expected to recur.” See Flanigan’s, 868 F.3d at 1255 (cita-",
        "paragraph_id": "para_548"
      },
      {
        "text": "tion modified); see also Fikre, 144 S. Ct. at 779 (classifying a moot-",
        "paragraph_id": "para_549"
      },
      {
        "text": "ness determination as “provisional” because “[a]s the case unfolds,",
        "paragraph_id": "para_550"
      },
      {
        "text": "the complaint’s allegations will be tested rather than taken as true,",
        "paragraph_id": "para_551"
      },
      {
        "text": "and different facts may emerge that may call for a different conclu-",
        "paragraph_id": "para_552"
      },
      {
        "text": "sion”). And we find that Plaintiffs’ alleged constitutional injuries",
        "paragraph_id": "para_553"
      },
      {
        "text": "can still be favorably redressed by some form of relief—such as an",
        "paragraph_id": "para_554"
      },
      {
        "text": "injunction preventing Defendants from reverting to their previous",
        "paragraph_id": "para_555"
      },
      {
        "text": "bail policy. See Cambridge Christian, 115 F.4th at 1283.",
        "paragraph_id": "para_556"
      },
      {
        "text": "Plaintiffs may therefore proceed with their facial and as-ap-",
        "paragraph_id": "para_557"
      },
      {
        "text": "plied claims against the Randolph County officials as they relate to",
        "paragraph_id": "para_558"
      },
      {
        "text": "the original bail schedule. Plaintiffs seek redress for, among other",
        "paragraph_id": "para_559"
      },
      {
        "text": "things, injuries to their constitutional rights of due process and",
        "paragraph_id": "para_560"
      },
      {
        "text": "equal protection under the Fourteenth Amendment for Randolph",
        "paragraph_id": "para_561"
      },
      {
        "text": "County’s pre-2017-Standing-Order practice of holding those who",
        "paragraph_id": "para_562"
      },
      {
        "text": "could not afford bail until their preliminary hearing in county",
        "paragraph_id": "para_563"
      },
      {
        "text": "court.",
        "paragraph_id": "para_564"
      },
      {
        "text": "We hold that this case is not moot and we reverse the district",
        "paragraph_id": "para_565"
      },
      {
        "text": "court’s dismissal of Plaintiffs’ challenges on that jurisdictional ba-",
        "paragraph_id": "para_566"
      },
      {
        "text": "sis.",
        "paragraph_id": "para_567"
      },
      {
        "text": "B. Plaintiffs Cannot Maintain Plausible Facial Challenges to the",
        "paragraph_id": "para_568"
      },
      {
        "text": "2017 Standing Order",
        "paragraph_id": "para_569"
      },
      {
        "text": "Although we conclude that the district court erroneously",
        "paragraph_id": "para_570"
      },
      {
        "text": "dismissed many of Plaintiffs’ claims on mootness grounds, we still",
        "paragraph_id": "para_571"
      },
      {

        "paragraph_id": "para_574"
      },
      {
        "text": "seeks to do so, any class member can maintain a plausible facial",
        "paragraph_id": "para_575"
      },
      {
        "text": "challenge to the 2017 Standing Order.",
        "paragraph_id": "para_576"
      },
      {
        "text": "Generally, “[t]o survive a [Rule 12(b)(6)] motion to dismiss,",
        "paragraph_id": "para_577"
      },
      {
        "text": "a complaint must contain sufficient factual matter, accepted as",
        "paragraph_id": "para_578"
      },
      {
        "text": "true, to ‘state a claim to relief that is plausible on its face.’” Ashcroft",
        "paragraph_id": "para_579"
      },
      {
        "text": "v. Iqbal, 556 U.S. 662, 678 (2009) (quoting Bell Atl. Corp. v. Twombly,",
        "paragraph_id": "para_580"
      },
      {
        "text": "550 U.S. 544, 570 (2007)). “A claim has facial plausibility when the",
        "paragraph_id": "para_581"
      },
      {
        "text": "plaintiff pleads factual content that allows the court to draw the",
        "paragraph_id": "para_582"
      },
      {
        "text": "reasonable inference that the defendant is liable for the misconduct",
        "paragraph_id": "para_583"
      },
      {
        "text": "alleged.” Id. Ordinarily, at this stage, courts are limited to consid-",
        "paragraph_id": "para_584"
      },
      {
        "text": "ering “the pleadings and any exhibits attached to it.” Baker, 67 F.4th",
        "paragraph_id": "para_585"
      },
      {
        "text": "at 1276. But a court may consider material outside of the com-",
        "paragraph_id": "para_586"
      },
      {
        "text": "plaint, if it is material “of which [it] may take judicial notice,” Tell-",
        "paragraph_id": "para_587"
      },
      {
        "text": "abs, Inc. v. Makor Issues & Rts., Ltd., 551 U.S. 308, 322 (2007), such as",
        "paragraph_id": "para_588"
      },
      {
        "text": "information that “can be accurately and readily determined from",
        "paragraph_id": "para_589"
      },
      {
        "text": "sources whose accuracy cannot reasonably be questioned,” Fed. R.",
        "paragraph_id": "para_590"
      },
      {
        "text": "Evid. 201(b)(2). The 2017 Standing Order is such a document.",
        "paragraph_id": "para_591"
      },
      {
        "text": "As an initial matter, Plaintiffs appear to concede that Schultz",
        "paragraph_id": "para_592"
      },
      {
        "text": "forecloses their facial equal-protection and substantive-due-process",
        "paragraph_id": "para_593"
      },
      {
        "text": "challenges to the 2017 Standing Order. See Schultz, 42 F.4th at",
        "paragraph_id": "para_594"
      },
      {
        "text": "1322–32. And if they do not concede the issue, we find that they",
        "paragraph_id": "para_595"
      },
      {
        "text": "have abandoned their claims because they fail to adequately brief",
        "paragraph_id": "para_596"
      },
      {
        "text": "any challenges to the dismissal of those claims. See Sapuppo v. All-",
        "paragraph_id": "para_597"
      },
      {
        "text": "state Floridian Ins. Co., 739 F.3d 678, 681 (11th Cir. 2014). But Plain-",
        "paragraph_id": "para_598"
      },
      {
        "text": "tiffs have preserved their remaining facial challenges.",
        "paragraph_id": "para_599"
      },
      {

        "text": "Plaintiffs maintain that they can allege plausible facial proce-",
        "paragraph_id": "para_602"
      },
      {
        "text": "dural-due-process and Sixth-Amendment challenges to the 2017",
        "paragraph_id": "para_603"
      },
      {
        "text": "Standing Order. But Plaintiffs have a steep hill to climb because “[a]",
        "paragraph_id": "para_604"
      },
      {
        "text": "facial challenge . . . is . . . the most difficult challenge to mount suc-",
        "paragraph_id": "para_605"
      },
      {
        "text": "cessfully.” United States v. Salerno, 481 U.S. 739, 745 (1987). Indeed,",
        "paragraph_id": "para_606"
      },
      {
        "text": "they “must establish that no set of circumstances exists under",
        "paragraph_id": "para_607"
      },
      {
        "text": "which the [2017 Standing Order] would be valid.” Id. We conclude",
        "paragraph_id": "para_608"
      },
      {
        "text": "that they cannot do so here.",
        "paragraph_id": "para_609"
      },
      {
        "text": "1. Procedural Due Process",
        "paragraph_id": "para_610"
      },
      {
        "text": "Plaintiffs argue “that Randolph County’s bail system does",
        "paragraph_id": "para_611"
      },
      {
        "text": "not provide adequate procedural safeguards.” Specifically, they con-",
        "paragraph_id": "para_612"
      },
      {
        "text": "tend that the 2017 Standing Order does not provide arrestees with",
        "paragraph_id": "para_613"
      },
      {
        "text": "either “constitutionally adequate notice” of their initial appearance",
        "paragraph_id": "para_614"
      },
      {
        "text": "hearing or “a meaningful opportunity to be heard” at said hearing.",
        "paragraph_id": "para_615"
      },
      {
        "text": "“Procedural due process imposes constraints on govern-",
        "paragraph_id": "para_616"
      },
      {
        "text": "mental decisions which deprive individuals of ‘liberty’ or ‘property’",
        "paragraph_id": "para_617"
      },
      {
        "text": "interests within the meaning of the Due Process Clause of",
        "paragraph_id": "para_618"
      },
      {
        "text": "the . . . Fourteenth Amendment.” Mathews v. Eldridge, 424 U.S. 319,",
        "paragraph_id": "para_619"
      },
      {
        "text": "332 (1976). “The fundamental requirement of due process is the",
        "paragraph_id": "para_620"
      },
      {
        "text": "opportunity to be heard at a meaningful time and in a meaningful",
        "paragraph_id": "para_621"
      },
      {
        "text": "manner.” Id. at 333 (citation modified). In conducting a due-process",
        "paragraph_id": "para_622"
      },
      {
        "text": "inquiry, “[w]e first ask whether there exists a liberty or property",
        "paragraph_id": "para_623"
      },
      {
        "text": "interest of which a person has been deprived, and if so we ask",
        "paragraph_id": "para_624"
      },
      {
        "text": "whether the procedures followed by the State were constitutionally",
        "paragraph_id": "para_625"
      },
      {
        "text": "sufficient.” Swarthout v. Cooke, 562 U.S. 216, 219 (2011).",

      },
      {

        "text": "“In the pretrial detention context, procedural due process re-",
        "paragraph_id": "para_629"
      },
      {
        "text": "quires that the procedures used be ‘adequate to authorize the pre-",
        "paragraph_id": "para_630"
      },
      {
        "text": "trial detention of at least some persons charged with crimes,’",
        "paragraph_id": "para_631"
      },
      {
        "text": "whether or not they might be insufficient in some other circum-",
        "paragraph_id": "para_632"
      },
      {
        "text": "stances.” Schultz, 42 F.4th at 1332 (alteration omitted) (quoting Sa-",
        "paragraph_id": "para_633"
      },
      {
        "text": "lerno, 481 U.S. at 751). “Answering that question requires two sepa-",
        "paragraph_id": "para_634"
      },
      {
        "text": "rate inquiries: First, does preventive detention serve a legitimate",
        "paragraph_id": "para_635"
      },
      {
        "text": "state objective? And, second, are the procedural safeguards ade-",
        "paragraph_id": "para_636"
      },
      {
        "text": "quate to authorize the pretrial detention?” Id. (citation modified).",
        "paragraph_id": "para_637"
      },
      {
        "text": "There is “no question about the first inquiry,” as “states",
        "paragraph_id": "para_638"
      },
      {
        "text": "maintain not only a legitimate, but a ‘compelling interest in assur-",
        "paragraph_id": "para_639"
      },
      {
        "text": "ing the presence at trial of persons charged with crime.’” Id. (quot-",
        "paragraph_id": "para_640"
      },
      {
        "text": "ing Rainwater, 572 F.2d at 1056). We therefore turn to our consid-",
        "paragraph_id": "para_641"
      },
      {
        "text": "eration of whether the 2017 Standing Order’s “procedural safe-",
        "paragraph_id": "para_642"
      },
      {
        "text": "guards” are sufficient to pass facial constitutional muster.",
        "paragraph_id": "para_643"
      },
      {
        "text": "In relevant part, the 2017 Standing Order provides that any",
        "paragraph_id": "para_644"
      },
      {
        "text": "arrestee who can post the scheduled bail typically is entitled to re-",
        "paragraph_id": "para_645"
      },
      {
        "text": "lease after booking is completed. Anyone unable to post the bond",
        "paragraph_id": "para_646"
      },
      {
        "text": "is “entitled to a judicial determination of the conditions of their",
        "paragraph_id": "para_647"
      },
      {
        "text": "release . . . no later than 72 hours after arrest.” Before the initial ap-",
        "paragraph_id": "para_648"
      },
      {
        "text": "pearance before a judge, arrestees “complete an affidavit of sub-",
        "paragraph_id": "para_649"
      },
      {
        "text": "stantial hardship” detailing their financial situations. At the initial",
        "paragraph_id": "para_650"
      },
      {
        "text": "appearance, the presiding judge must determine whether pretrial",
        "paragraph_id": "para_651"
      },
      {
        "text": "release is appropriate, and if so, what conditions should be im-",
        "paragraph_id": "para_652"
      },
      {
        "text": "posed.",
        "paragraph_id": "para_653"
      },
      {

        "text": "When making a detention decision, Alabama Rule of Crim-",
        "paragraph_id": "para_656"
      },
      {
        "text": "inal Procedure 7.2(a) instructs judges to consider fourteen listed",
        "paragraph_id": "para_657"
      },
      {
        "text": "factors. The Rule 7.2(a) factors include the defendant’s back-",
        "paragraph_id": "para_658"
      },
      {
        "text": "ground, reputation, criminal history, ties to the community, em-",
        "paragraph_id": "para_659"
      },
      {
        "text": "ployment status, and financial condition. In accordance with the",
        "paragraph_id": "para_660"
      },
      {
        "text": "Rule 7.2(a) factors, the 2017 Standing Order states that a judge “will",
        "paragraph_id": "para_661"
      },
      {
        "text": "consider a defendant’s ability to post a bond in determining [a] de-",
        "paragraph_id": "para_662"
      },
      {
        "text": "fendant’s conditions of release.” The judge will also “consider the",
        "paragraph_id": "para_663"
      },
      {
        "text": "defendant’s affidavit of substantial hardship and may elicit testi-",
        "paragraph_id": "para_664"
      },
      {
        "text": "mony about the defendant’s financial condition.” If, after consider-",
        "paragraph_id": "para_665"
      },
      {
        "text": "ing these factors, the judge “determines that there is no less oner-",
        "paragraph_id": "para_666"
      },
      {
        "text": "ous condition for securing the defendant’s appearance or protect-",
        "paragraph_id": "para_667"
      },
      {
        "text": "ing the public,” the judge shall “make a written finding as to why",
        "paragraph_id": "para_668"
      },
      {
        "text": "the posting of a bond is reasonably necessary to assure the defend-",
        "paragraph_id": "para_669"
      },
      {
        "text": "ant’s presence at trial in such a case.”",
        "paragraph_id": "para_670"
      },
      {
        "text": "While Schultz does not inform our jurisdictional inquiry, see",
        "paragraph_id": "para_671"
      },
      {
        "text": "supra Part III.A, it does guide our merits analysis of this constitu-",
        "paragraph_id": "para_672"
      },
      {
        "text": "tional challenge because the Schultz panel upheld bail procedures",
        "paragraph_id": "para_673"
      },
      {
        "text": "that were materially identical to those included in the 2017 Stand-",
        "paragraph_id": "para_674"
      },
      {
        "text": "ing Order. See Schultz, 42 F.4th at 1333 (explaining that “there is",
        "paragraph_id": "para_675"
      },
      {
        "text": "nothing inherently unattainable about a prediction of flight risk or",
        "paragraph_id": "para_676"
      },
      {
        "text": "danger to the community” (quoting Salerno, 481 U.S. at 751)).",
        "paragraph_id": "para_677"
      },
      {
        "text": "We recognize that in Schultz, the arrestees were presented",
        "paragraph_id": "para_678"
      },
      {
        "text": "both an affidavit of substantial hardship and a “Release Question-",
        "paragraph_id": "para_679"
      },
      {
        "text": "naire,” which the panel determined collectively “provide[d] pretrial",
        "paragraph_id": "para_680"
      },
      {
        "text": "detainees notice of the hearing to take place and g[ave] them an",
        "paragraph_id": "para_681"
      },
      {

        "paragraph_id": "para_684"
      },
      {
        "text": "tion.” Id. By contrast, the 2017 Standing Order requires only that",
        "paragraph_id": "para_685"
      },
      {
        "text": "arrestees receive the affidavit of substantial hardship—which does",
        "paragraph_id": "para_686"
      },
      {
        "text": "not notify an arrestee of any upcoming hearing or outline the fac-",
        "paragraph_id": "para_687"
      },
      {
        "text": "tors that will be considered in determining whether pretrial release",
        "paragraph_id": "para_688"
      },
      {
        "text": "is warranted. But, nothing in the 2017 Standing Order precludes",
        "paragraph_id": "para_689"
      },
      {
        "text": "Randolph County from using the release questionnaire in its bail",
        "paragraph_id": "para_690"
      },
      {
        "text": "proceedings, and the questionnaire is made publicly available by",
        "paragraph_id": "para_691"
      },
      {
        "text": "the Alabama Administrative Office of Courts.1",
        "paragraph_id": "para_692"
      },
      {
        "text": "We also acknowledge that the 2017 Standing Order does not",
        "paragraph_id": "para_693"
      },
      {
        "text": "mandate that the presiding judge elicit financial information from",
        "paragraph_id": "para_694"
      },
      {
        "text": "the arrestee or dictate what specific findings the judge must make",
        "paragraph_id": "para_695"
      },
      {
        "text": "by written order upon completion of the hearing, as was the case",
        "paragraph_id": "para_696"
      },
      {
        "text": "in Schultz. See id. Nevertheless, the 2017 Standing Order requires",
        "paragraph_id": "para_697"
      },
      {

        "text": "an arrest, at which time the presiding judge may consider several",

      },
      {
        "text": "factors that relate to an arrestee’s ability to post bail. Comparable",
        "paragraph_id": "para_700"
      },
      {
        "text": "judicial hearings “[are] treated as the most extensive form of pro-",
        "paragraph_id": "para_701"
      },
      {
        "text": "cess that can be required.” Walker, 901 F.3d at 1268. And from the",
        "paragraph_id": "para_702"
      },
      {
        "text": "face of the 2017 Standing Order, we are not left with the impression",
        "paragraph_id": "para_703"
      },
      {
        "text": "“that [the judge] ‘automatically’ impose[s] monetary bail condi-",
        "paragraph_id": "para_704"
      },
      {
        "text": "tions on indigent arrestees.” See Schultz, 42 F.4th at 1335.",

        "text": "Perhaps most importantly, if an arrestee is unhappy with the",
        "paragraph_id": "para_711"
      },
      {
        "text": "outcome of the bail decision, the arrestee may move to “modify",
        "paragraph_id": "para_712"
      },
      {
        "text": "the conditions of release.” Ala. R. Crim. P. 7.4(b). “[I]ndigent ar-",
        "paragraph_id": "para_713"
      },
      {
        "text": "restees are entitled to the aid of counsel in the filing of that mo-",
        "paragraph_id": "para_714"
      },
      {
        "text": "tion,” which “may be granted upon a showing of mere ‘good",
        "paragraph_id": "para_715"
      },
      {
        "text": "cause.’” Schultz, 42 F.4th at 1334 (quoting Ala. R. Crim. P. 7.4(b)).",
        "paragraph_id": "para_716"
      },
      {
        "text": "For these reasons, we find that, on its face, the 2017 Standing",
        "paragraph_id": "para_717"
      },
      {
        "text": "Order’s procedures are “adequate to authorize the pretrial deten-",
        "paragraph_id": "para_718"
      },
      {
        "text": "tion of at least some persons charged with crimes.” Salerno,",
        "paragraph_id": "para_719"
      },
      {
        "text": "481 U.S. at 751 (citation modified).",
        "paragraph_id": "para_720"
      },
      {
        "text": "2. Sixth Amendment",
        "paragraph_id": "para_721"
      },
      {
        "text": "“Once the adversary judicial process has been initiated, the",
        "paragraph_id": "para_722"
      },
      {
        "text": "Sixth Amendment guarantees a defendant the right to have counsel",
        "paragraph_id": "para_723"
      },
      {
        "text": "present at all critical stages of the criminal proceedings.” Montejo v.",
        "paragraph_id": "para_724"
      },
      {
        "text": "Louisiana, 556 U.S. 778, 786 (2009) (citation modified). “Critical",
        "paragraph_id": "para_725"
      },
      {
        "text": "stages are ‘trial-like confrontations’ between the State and the ac-",
        "paragraph_id": "para_726"
      },
      {
        "text": "cused.” Mills v. Hamm, 102 F.4th 1245, 1249 (11th Cir. 2024) (quoting",
        "paragraph_id": "para_727"
      },
      {
        "text": "Rothgery v. Gillespie Cnty., 554 U.S. 191, 212 n.16 (2008)).",
        "paragraph_id": "para_728"
      },
      {
        "text": "Plaintiffs contend that Randolph County’s failure to provide",
        "paragraph_id": "para_729"
      },
      {
        "text": "the assistance of counsel for indigent arrestees at the initial appear-",
        "paragraph_id": "para_730"
      },
      {
        "text": "ance—when the court determines the conditions of release—vio-",
        "paragraph_id": "para_731"
      },
      {
        "text": "lates the Sixth Amendment. We have not determined whether a",
        "paragraph_id": "para_732"
      },
      {
        "text": "state initial appearance is a “critical stage” at which the Sixth",
        "paragraph_id": "para_733"
      },
      {
        "text": "Amendment requires the right to counsel. Cf. United States v. Men-",
        "paragraph_id": "para_734"
      },
      {
        "text": "doza-Cecelia, 963 F.2d 1467, 1473–74 (11th Cir. 1992) (concluding",
        "paragraph_id": "para_735"
      },
      {
        "text": "that a defendant’s “initial appearance before a [federal] magistrate",
        "paragraph_id": "para_736"
      },
      {

        "text": "judge” was not “a critical proceeding” because it “is largely admin-",
        "paragraph_id": "para_739"
      },
      {
        "text": "istrative” and “[a] defendant in seeking bail is not required to reveal",
        "paragraph_id": "para_740"
      },
      {
        "text": "the facts of his case”), abrogated on other grounds by Coleman v. Sin-",
        "paragraph_id": "para_741"
      },
      {
        "text": "gletary, 30 F.3d 1420 (11th Cir. 1994). And we decline to do so here.",
        "paragraph_id": "para_742"
      },
      {
        "text": "Even if we assume that the state initial appearance is a criti-",
        "paragraph_id": "para_743"
      },
      {
        "text": "cal hearing, Plaintiffs nevertheless would be unable to mount a",
        "paragraph_id": "para_744"
      },
      {
        "text": "Sixth Amendment facial challenge to the 2017 Standing Order. The",
        "paragraph_id": "para_745"
      },
      {
        "text": "reason is simple: While the 2017 Standing Order does not directly",
        "paragraph_id": "para_746"
      },
      {
        "text": "contemplate the appointment of counsel for indigent defendants,",
        "paragraph_id": "para_747"
      },
      {
        "text": "it also does not explicitly forbid the presence of counsel at the initial",
        "paragraph_id": "para_748"
      },
      {
        "text": "appearance. As such, the 2017 Standing Order would not be uncon-",
        "paragraph_id": "para_749"
      },
      {
        "text": "stitutionally applied in every potential scenario, such as when an",
        "paragraph_id": "para_750"
      },
      {
        "text": "arrestee independently obtains counsel for the initial appearance or",
        "paragraph_id": "para_751"
      },
      {
        "text": "if the court were to appoint counsel sua sponte. See Salerno,",
        "paragraph_id": "para_752"
      },
      {
        "text": "481 U.S. at 745.",
        "paragraph_id": "para_753"
      },
      {
        "text": "In short, “[t]he fact that the [2017 Standing Order] might op-",
        "paragraph_id": "para_754"
      },
      {
        "text": "erate unconstitutionally under some conceivable set of circum-",
        "paragraph_id": "para_755"
      },
      {
        "text": "stances is insufficient to render it wholly invalid.” See id. As such,",
        "paragraph_id": "para_756"
      },
      {
        "text": "we affirm the district court’s dismissal of Plaintiff’s challenges to",
        "paragraph_id": "para_757"
      },
      {
        "text": "the facial constitutionality of the 2017 Standing Order.",
        "paragraph_id": "para_758"
      },
      {
        "text": "IV. CONCLUSION",
        "paragraph_id": "para_759"
      },
      {
        "text": "The district court’s dismissal order is AFFIRMED IN PART",
        "paragraph_id": "para_760"
      },
      {
        "text": "and VACATED IN PART. We REVERSE the dismissal of any",
        "paragraph_id": "para_761"
      },
      {
        "text": "claims the district court resolved on mootness grounds. But we",
        "paragraph_id": "para_762"
      },
      {
        "text": "AFFIRM the dismissal of Plaintiffs’ facial challenges to the 2017",
        "paragraph_id": "para_763"
      },
      {
