        "paragraph_id": "para_51"

        "text": "noncitizens with final removal orders who, pursuant to DHS policy",
        "paragraph_id": "para_52"
      },
      {
        "text": "documents issued in March and July of 2025 (collectively, \"the",
        "paragraph_id": "para_53"
      },
      {
        "text": "Guidance\"), face removal to countries neither designated in their",
        "paragraph_id": "para_54"
      },
      {
        "text": "removal orders nor identified in writing during prior removal",
        "paragraph_id": "para_55"
      },
      {
        "text": "proceedings as potential countries of removal.1 Following the",
        "paragraph_id": "para_56"
      },
      {
        "text": "parties' lead, we call these removals \"third-country removals.\"",
        "paragraph_id": "para_57"
      },
      {
        "text": "The final judgment contains five declarations that,",
        "paragraph_id": "para_58"
      },
      {
        "text": "together, construe applicable law to require DHS to take three",
        "paragraph_id": "para_59"
      },
      {
        "text": "actions when executing third-country removals that are not",
        "paragraph_id": "para_60"
      },
      {
        "text": "contemplated by the Guidance: (1) to seek first to remove class",
        "paragraph_id": "para_61"
      },
      {
        "text": "members to countries they have designated or of which they are",
        "paragraph_id": "para_62"
      },
      {
        "text": "subjects, nationals, or citizens; (2) to provide class members",
        "paragraph_id": "para_63"
      },
      {
        "text": "with effective notice of DHS's intention to remove them to a",
        "paragraph_id": "para_64"
      },
      {
        "text": "specified third country; and (3) to provide class members with a",
        "paragraph_id": "para_65"
      },
      {
        "text": "meaningful opportunity to contest removal to that third country on",
        "paragraph_id": "para_66"
      },
      {
        "text": "the ground that they have a reasonable fear of being persecuted or",
        "paragraph_id": "para_67"
      },
      {
        "text": "tortured there. See 28 U.S.C. § 2201(a). The judgment also",
        "paragraph_id": "para_68"
      },
      {

        "text": "vacates and sets aside the Guidance as unlawful under the",
        "paragraph_id": "para_76"
      },
      {
        "text": "Administrative Procedure Act (\"APA\"). 5 U.S.C. § 706(2)(A), (C).",
        "paragraph_id": "para_77"
      },
      {
        "text": "For reasons we shall explain, the representative",
        "paragraph_id": "para_78"
      },
      {
        "text": "plaintiffs lack Article III standing as to their \"sequencing\"",
        "paragraph_id": "para_79"
      },
      {
        "text": "claim. This requires us to vacate the two declarations regarding",
        "paragraph_id": "para_80"
      },
      {
        "text": "DHS's obligation first to seek to remove class members to countries",
        "paragraph_id": "para_81"
      },
      {
        "text": "they have designated for removal or of which they are subjects,",
        "paragraph_id": "para_82"
      },
      {
        "text": "nationals, or citizens. Otherwise, we affirm the judgment.",
        "paragraph_id": "para_83"
      },
      {
        "text": "I.",
        "paragraph_id": "para_84"
      },
      {
        "text": "The district court has published three thorough",
        "paragraph_id": "para_85"
      },
      {
        "text": "memoranda and orders addressing the many issues involved in this",
        "paragraph_id": "para_86"
      },
      {
        "text": "litigation. D.V.D. v. U.S. Dep't of Homeland Sec. (\"D.V.D. III\"),",
        "paragraph_id": "para_87"
      },
      {
        "text": "821 F. Supp. 3d 102 (D. Mass. 2026); D.V.D. v. U.S. Dep't of",
        "paragraph_id": "para_88"
      },
      {
        "text": "Homeland Sec. (\"D.V.D. II\"), 786 F. Supp. 3d 223 (D. Mass. 2025);",
        "paragraph_id": "para_89"
      },
      {
        "text": "D.V.D. v. Dep't of Homeland Sec. (\"D.V.D. I\"), 778 F. Supp. 3d 355",

        "text": "for additional background. Here, we confine our discussion to",

      },
      {
        "text": "matters relevant to our disposition of this appeal.",
        "paragraph_id": "para_93"
      },
      {
        "text": "On March 23, 2025, four noncitizens -- D.V.D., M.M.,",
        "paragraph_id": "para_94"
      },
      {
        "text": "E.F.D., and O.C.G. -- filed this lawsuit as a putative class action",
        "paragraph_id": "para_95"
      },
      {
        "text": "under, as is relevant here, the APA. See 5 U.S.C. § 706(2)(A),",
        "paragraph_id": "para_96"
      },
      {
        "text": "(C). The complaint principally alleged that DHS had adopted a",
        "paragraph_id": "para_97"
      },
      {
        "text": "new, unlawful policy of removing noncitizens with final removal",
        "paragraph_id": "para_98"
      },
      {
        "text": "orders to \"third countries\" -- i.e., countries not mentioned in",
        "paragraph_id": "para_99"
      },
      {
        "text": "- 5 -",
        "paragraph_id": "para_100"
      },
      {
        "text": "their final removal orders -- without providing them with",
        "paragraph_id": "para_101"
      },
      {
        "text": "effective notice and a meaningful opportunity to claim that they",
        "paragraph_id": "para_102"
      },
      {
        "text": "reasonably feared persecution or torture in those countries. We",
        "paragraph_id": "para_103"
      },
      {
        "text": "refer to such claims collectively as \"fear-based claims.\"",
        "paragraph_id": "para_104"
      },
      {
        "text": "In support of this allegation, the plaintiffs relied",
        "paragraph_id": "para_105"
      },
      {
        "text": "upon, inter alia, a February 18, 2025, directive issued by U.S.",
        "paragraph_id": "para_106"
      },
      {
        "text": "Immigration and Customs Enforcement (\"ICE\"), an agency housed",
        "paragraph_id": "para_107"
      },
      {
        "text": "within DHS. The directive, which was attached to the complaint,",
        "paragraph_id": "para_108"
      },
      {
        "text": "instructed ICE officers to \"review for removal\" cases involving",
        "paragraph_id": "para_109"
      },
      {
        "text": "noncitizens who had been granted protection from removal to one or",
        "paragraph_id": "para_110"
      },
      {
        "text": "more specific countries based on a fear-based claim. The directive",
        "paragraph_id": "para_111"
      },
      {
        "text": "ordered officers to \"determine the viability of removal to a third",
        "paragraph_id": "para_112"
      },
      {
        "text": "country and accordingly whether the alien should be re-detained.\"",
        "paragraph_id": "para_113"
      },
      {
        "text": "The plaintiffs sought class certification and",
        "paragraph_id": "para_114"
      },
      {
        "text": "provisional relief. On March 28, 2025, the district court granted",
        "paragraph_id": "para_115"
      },
      {
        "text": "the plaintiffs a temporary restraining order, which DHS promptly",
        "paragraph_id": "para_116"
      },
      {
        "text": "appealed and moved this Court to stay. Two days later, on March",
        "paragraph_id": "para_117"
      },
      {
        "text": "30, 2025, while that appeal and motion to stay were pending, DHS",
        "paragraph_id": "para_118"
      },
      {
        "text": "issued a policy document titled \"Guidance Regarding Third Country",
        "paragraph_id": "para_119"
      },
      {
        "text": "Removals.\" Under this policy document, prior to any third-country",
        "paragraph_id": "para_120"
      },
      {
        "text": "removal,",
        "paragraph_id": "para_121"
      },
      {
        "text": "DHS must determine whether that country has",
        "paragraph_id": "para_122"
      },
      {
        "text": "provided diplomatic assurances that aliens",
        "paragraph_id": "para_123"
      },
      {
        "text": "removed from the United States will not be",
        "paragraph_id": "para_124"
      },
      {
        "text": "persecuted or tortured. If the United States",
        "paragraph_id": "para_125"
      },
      {
        "text": "has received such assurances, and if the",
        "paragraph_id": "para_126"
      },
      {
        "text": "- 6 -",
        "paragraph_id": "para_127"
      },
      {
        "text": "Department of State believes those assurances",
        "paragraph_id": "para_128"
      },
      {
        "text": "to be credible, the alien may be removed",
        "paragraph_id": "para_129"
      },
      {
        "text": "without the need for further procedures. If",
        "paragraph_id": "para_130"
      },
      {
        "text": "the United States has not received those",
        "paragraph_id": "para_131"
      },
      {
        "text": "assurances, or if the Department of State does",
        "paragraph_id": "para_132"
      },
      {
        "text": "not believe them to be credible, DHS must",
        "paragraph_id": "para_133"
      },
      {
        "text": "follow the procedures below.",
        "paragraph_id": "para_134"
      },
      {
        "text": "DHS will first inform the alien of removal to",
        "paragraph_id": "para_135"
      },
      {
        "text": "that country. Immigration officers will not",
        "paragraph_id": "para_136"
      },
      {
        "text": "affirmatively ask whether the alien is afraid",
        "paragraph_id": "para_137"
      },
      {
        "text": "of being removed to that country. . . .",
        "paragraph_id": "para_138"
      },
      {
        "text": "Immigration officers will refer any alien who",
        "paragraph_id": "para_139"
      },
      {
        "text": "affirmatively states a fear of removal to U.S.",
        "paragraph_id": "para_140"
      },
      {
        "text": "Citizenship and Immigration Services (USCIS)",
        "paragraph_id": "para_141"
      },
      {
        "text": "for a screening for eligibility for protection",
        "paragraph_id": "para_142"
      },
      {
        "text": "under INA § 241(b)(3) and the Convention",
        "paragraph_id": "para_143"
      },
      {
        "text": "Against Torture (CAT) for the country of",
        "paragraph_id": "para_144"
      },
      {
        "text": "removal.",

      {

        "text": "a fear, USCIS will generally screen the alien",
        "paragraph_id": "para_147"
      },
      {
        "text": "within 24 hours of referral from the",
        "paragraph_id": "para_148"
      },
      {
        "text": "immigration officer. This screening may be",
        "paragraph_id": "para_149"
      },
      {
        "text": "done remotely. USCIS will determine whether",
        "paragraph_id": "para_150"
      },
      {
        "text": "the alien would more likely than not be",
        "paragraph_id": "para_151"
      },
      {
        "text": "persecuted on a statutorily protected ground",
        "paragraph_id": "para_152"
      },
      {
        "text": "or tortured in the country of removal. If",
        "paragraph_id": "para_153"
      },
      {
        "text": "USCIS determines that the alien has not met",
        "paragraph_id": "para_154"
      },
      {
        "text": "this standard, the alien will be removed.",
        "paragraph_id": "para_155"
      },
      {
        "text": "If USCIS determines that the alien has met this",
        "paragraph_id": "para_156"
      },
      {
        "text": "standard . . . , USCIS will refer the matter",
        "paragraph_id": "para_157"
      },
      {
        "text": "to the Immigration Court [either in the first",
        "paragraph_id": "para_158"
      },
      {
        "text": "instance or through a motion to reopen, as",
        "paragraph_id": "para_159"
      },
      {
        "text": "appropriate] . . . . Alternatively, ICE may",
        "paragraph_id": "para_160"
      },
      {
        "text": "choose to designate another country for",
        "paragraph_id": "para_161"
      },
      {
        "text": "removal.",
        "paragraph_id": "para_162"
      },
      {
        "text": "Thus, the March 30, 2025, policy document does not",
        "paragraph_id": "para_163"
      },
      {
        "text": "require DHS to give noncitizens notice before their removal to a",
        "paragraph_id": "para_164"
      },
      {
        "text": "third country from which the State Department believes it has",
        "paragraph_id": "para_165"
      },
      {
        "text": "received credible diplomatic assurances that noncitizens removed",
        "paragraph_id": "para_166"
      },
      {
        "text": "- 7 -",
        "paragraph_id": "para_167"
      },
      {
        "text": "to that country will not be persecuted or tortured.2 And it",
        "paragraph_id": "para_168"
      },
      {
        "text": "contemplates only minimal notice before removal to a third country",
        "paragraph_id": "para_169"
      },
      {
        "text": "which has not given the State Department such assurances. After",
        "paragraph_id": "para_170"
      },
      {
        "text": "DHS issued the March 30, 2025, policy document, this case largely",
        "paragraph_id": "para_171"
      },
      {
        "text": "focused on that document's lawfulness and on certain",
        "paragraph_id": "para_172"
      },
      {
        "text": "jurisdictional and remedial issues implicated by the plaintiffs'",
        "paragraph_id": "para_173"
      },
      {
        "text": "challenge.",
        "paragraph_id": "para_174"
      },
      {
        "text": "On April 7, 2025, this Court denied DHS's motion for a",
        "paragraph_id": "para_175"
      },
      {
        "text": "stay of the temporary restraining order pending appeal. On",
        "paragraph_id": "para_176"
      },
      {
        "text": "April 18, 2025, the district court granted the plaintiffs' motion",
        "paragraph_id": "para_177"
      },
      {
        "text": "for class certification and granted in part their motion for a",
        "paragraph_id": "para_178"
      },
      {
        "text": "preliminary injunction. The court certified the following class:",
        "paragraph_id": "para_179"
      },
      {
        "text": "2 Nor does the March 30, 2025, policy document provide",
        "paragraph_id": "para_180"
      },
      {
        "text": "protection against \"chain refoulement.\" Chain refoulement occurs",
        "paragraph_id": "para_181"
      },
      {
        "text": "when a country removes someone to a second country, which, in turn,",
        "paragraph_id": "para_182"
      },
      {
        "text": "sends the person to a third country to which the original removing",
        "paragraph_id": "para_183"
      },
      {
        "text": "country could not, often because of a finding that the person",
        "paragraph_id": "para_184"
      },
      {
        "text": "likely would be persecuted or tortured if removed there. The class",
        "paragraph_id": "para_185"
      },
      {
        "text": "alleges that many of its members have been subject to chain",
        "paragraph_id": "para_186"
      },
      {
        "text": "refoulement. See generally S. Comm. on Foreign Rels., Minority",
        "paragraph_id": "para_187"
      },
      {
        "text": "Rep., At What Cost? Inside the Trump Administration's Secret",
        "paragraph_id": "para_188"
      },
      {
        "text": "Deportation Deals 5 (2026) (stating that \"[a]s of January 2026,",
        "paragraph_id": "para_189"
      },
      {
        "text": "more than eighty percent of the migrants sent to third countries",
        "paragraph_id": "para_190"
      },
      {
        "text": "paid by the United States to take them in have already returned to",
        "paragraph_id": "para_191"
      },
      {
        "text": "their country of origin or are in the process of doing so\"). For",
        "paragraph_id": "para_192"
      },
      {
        "text": "example, the class points to named plaintiff O.C.G. as an example",
        "paragraph_id": "para_193"
      },
      {
        "text": "of chain refoulement under DHS's third-country removal policy. An",
        "paragraph_id": "para_194"
      },
      {
        "text": "immigration judge granted O.C.G. withholding of removal to",
        "paragraph_id": "para_195"
      },
      {
        "text": "Guatemala, his country of citizenship, meaning U.S. immigration",
        "paragraph_id": "para_196"
      },
      {
        "text": "authorities could not remove him to Guatemala based on a likelihood",
        "paragraph_id": "para_197"
      },
      {
        "text": "that he would be persecuted there. Under DHS's third-country",
        "paragraph_id": "para_198"
      },
      {
        "text": "removal policy, O.C.G. was removed to Mexico, and from there Mexico",
        "paragraph_id": "para_199"
      },
      {
        "text": "deported him to Guatemala.",
        "paragraph_id": "para_200"
      },
      {
        "text": "- 8 -",
        "paragraph_id": "para_201"
      },
      {
        "text": "All individuals who have a final removal order",
        "paragraph_id": "para_202"
      },
      {
        "text": "issued in proceedings under Section 240",
        "paragraph_id": "para_203"
      },
      {
        "text": "[8 U.S.C. § 1229a], 241(a)(5) [8 U.S.C.",
        "paragraph_id": "para_204"
      },
      {
        "text": "§ 1231(a)(5)], or 238(b) [8 U.S.C. § 1228(b)]",
        "paragraph_id": "para_205"
      },
      {
        "text": "of the [Immigration and Nationality Act",
        "paragraph_id": "para_206"
      },
      {
        "text": "(\"INA\")] (including withholding-only",
        "paragraph_id": "para_207"
      },
      {
        "text": "proceedings) whom DHS has deported or will",
        "paragraph_id": "para_208"
      },
      {
        "text": "deport on or after February 18, 2025, to a",
        "paragraph_id": "para_209"
      },
      {
        "text": "country (a) not previously designated as the",
        "paragraph_id": "para_210"
      },
      {
        "text": "country or alternative country of removal, and",
        "paragraph_id": "para_211"
      },
      {
        "text": "(b) not identified in writing in the prior",
        "paragraph_id": "para_212"
      },
      {
        "text": "proceedings as a country to which the",
        "paragraph_id": "para_213"
      },
      {
        "text": "individual would be removed.",
        "paragraph_id": "para_214"
      },
      {
        "text": "The court also imposed on DHS several requirements designed to",
        "paragraph_id": "para_215"
      },
      {
        "text": "provide class members, prior to any third-country removal, with",
        "paragraph_id": "para_216"
      },
      {
        "text": "written notice that they face removal to a specified third country",
        "paragraph_id": "para_217"
      },
      {
        "text": "and a meaningful opportunity to raise certain fear-based claims",
        "paragraph_id": "para_218"
      },
      {
        "text": "about their removal to that country.",
        "paragraph_id": "para_219"
      },
      {
        "text": "On April 22, 2025, DHS appealed the preliminary",
        "paragraph_id": "para_220"
      },
      {
        "text": "injunction and moved this Court to stay the injunction pending",
        "paragraph_id": "para_221"
      },
      {
        "text": "appeal. On May 16, 2025, we denied the motion for a stay. About",
        "paragraph_id": "para_222"
      },
      {
        "text": "a month later, however, the U.S. Supreme Court granted DHS a stay",
        "paragraph_id": "para_223"
      },
      {
        "text": "pending our disposition of the preliminary-injunction appeal and",
        "paragraph_id": "para_224"
      },
      {
        "text": "its disposition of any subsequent petition for a writ of",
        "paragraph_id": "para_225"
      },
      {
        "text": "certiorari. Following the Supreme Court's action, on July 9, 2025,",
        "paragraph_id": "para_226"
      },
      {
        "text": "DHS reaffirmed by memorandum its intention to follow the March 30,",
        "paragraph_id": "para_227"
      },
      {
        "text": "2025, policy document. See Memorandum from Todd M. Lyons, Acting",
        "paragraph_id": "para_228"
      },
      {
        "text": "Director, ICE, to All ICE Employees, Third Country Removals",
        "paragraph_id": "para_229"
      },
      {
        "text": "Following the Supreme Court's Order in Department of Homeland",
        "paragraph_id": "para_230"
      },
      {
        "text": "Security v. D.V.D., No. 24A1153 (U.S. June 23, 2025) (\"ICE must",
        "paragraph_id": "para_231"
      },
      {
        "text": "- 9 -",
        "paragraph_id": "para_232"
      },
      {
        "text": "adhere to [former] Secretary of Homeland Security Kristi Noem's",
        "paragraph_id": "para_233"
      },
      {
        "text": "[policy document.]\"). The memorandum also clarified that ICE \"will",
        "paragraph_id": "para_234"
      },
      {
        "text": "generally wait at least 24 hours following service of the Notice",
        "paragraph_id": "para_235"
      },
      {
        "text": "of Removal before effectuating removal\" of a noncitizen to a third",
        "paragraph_id": "para_236"
      },
      {
        "text": "country from which the State Department has not received credible",
        "paragraph_id": "para_237"
      },
      {
        "text": "diplomatic assurances that individuals removed from the United",
        "paragraph_id": "para_238"
      },
      {
        "text": "States would not be persecuted or tortured. As mentioned above,",
        "paragraph_id": "para_239"
      },
      {
        "text": "we refer to the March 30, 2025, and July 9, 2025, policy documents",
        "paragraph_id": "para_240"
      },
      {
        "text": "together as \"the Guidance.\"",
        "paragraph_id": "para_241"
      },
      {
        "text": "On February 3, 2026, this Court held oral argument on",
        "paragraph_id": "para_242"
      },
      {
        "text": "DHS's appeal of the preliminary injunction. At argument, the class",
        "paragraph_id": "para_243"
      },
      {
        "text": "renewed an earlier request that we terminate the appeal and remand",
        "paragraph_id": "para_244"
      },
      {
        "text": "for the district court to dissolve the preliminary injunction, in",
        "paragraph_id": "para_245"
      },
      {
        "text": "accordance with the district court's indicative order, and issue",
        "paragraph_id": "para_246"
      },
      {
        "text": "merits rulings on pending motions to dismiss filed by DHS and for",
        "paragraph_id": "para_247"
      },
      {
        "text": "partial summary judgment filed by the class. On February 20, 2026,",
        "paragraph_id": "para_248"
      },
      {
        "text": "we granted the class's request, terminated DHS's appeal of the",
        "paragraph_id": "para_249"
      },
      {
        "text": "preliminary injunction, and remanded.",
        "paragraph_id": "para_250"
      },
      {
        "text": "On February 25, 2026, the district court entered a",
        "paragraph_id": "para_251"
      },
      {
        "text": "memorandum and order dissolving the preliminary injunction and",
        "paragraph_id": "para_252"
      },
      {
        "text": "resolving the class's claims. As is relevant here, the court first",
        "paragraph_id": "para_253"
      },
      {
        "text": "rejected several challenges to its jurisdiction. The court then",
        "paragraph_id": "para_254"
      },
      {
        "text": "held that, under applicable law, third-country removals pursuant",
        "paragraph_id": "para_255"
      },
      {
        "text": "to the Guidance are unlawful in three ways.",
        "paragraph_id": "para_256"
      },
      {
        "text": "- 10 -",
        "paragraph_id": "para_257"
      },
      {
        "text": "First, third-country removals under the Guidance are",
        "paragraph_id": "para_258"
      },
      {
        "text": "inconsistent with the requirements of",
        "paragraph_id": "para_259"
      },
      {
        "text": "8 U.S.C. § 1231(b)(2)(A)-(D), and related regulations, which",
        "paragraph_id": "para_260"
      },
      {
        "text": "require DHS first to seek to remove class members to a class",
        "paragraph_id": "para_261"
      },
      {
        "text": "member's designated country of removal and subsequently to a",
        "paragraph_id": "para_262"
      },
      {
        "text": "country of which they are a subject, national, or citizen, before",
        "paragraph_id": "para_263"
      },
      {
        "text": "removing them to third countries under 8 U.S.C. § 1231(b)(2)(E),",
        "paragraph_id": "para_264"
      },
      {
        "text": "the statutory provision authorizing third-country removals. We",
        "paragraph_id": "para_265"
      },
      {
        "text": "refer to compliance with this statutory hierarchy as \"sequencing.\"",
        "paragraph_id": "para_266"
      },
      {
        "text": "Second, third-country removals under the Guidance do not",
        "paragraph_id": "para_267"
      },
      {
        "text": "comport with the notice-and-hearing requirements implicit in",
        "paragraph_id": "para_268"
      },
      {
        "text": "8 U.S.C. § 1231(b)(3), and related regulations, which require DHS",
        "paragraph_id": "para_269"
      },
      {
        "text": "to withhold the removal of eligible class members to countries,",
        "paragraph_id": "para_270"
      },
      {
        "text": "including third countries, where their \"life or freedom would be",
        "paragraph_id": "para_271"
      },
      {
        "text": "threatened . . . because of [their] race, religion, nationality,",
        "paragraph_id": "para_272"
      },
      {
        "text": "membership in a particular social group, or political opinion.\"",
        "paragraph_id": "para_273"
      },
      {
        "text": "We refer to the claims of class members who would",
        "paragraph_id": "para_274"
      },
      {
        "text": "invoke § 1231(b)(3), and related regulations, as",
        "paragraph_id": "para_275"
      },
      {
        "text": "\"fear-of-persecution claims.\"",
        "paragraph_id": "para_276"
      },
      {
        "text": "Third, third-country removals under the Guidance do not",
        "paragraph_id": "para_277"
      },
      {
        "text": "comport with the notice-and-hearing requirements imposed by the",
        "paragraph_id": "para_278"
      },
      {
        "text": "Fifth Amendment's Due Process Clause with respect to the rights of",
        "paragraph_id": "para_279"
      },
      {
        "text": "those seeking relief under the Foreign Affairs Reform and",
        "paragraph_id": "para_280"
      },
      {
        "text": "Restructuring Act of 1998 (\"FARRA\"), Pub. L. No. 105-277, div. G,",
        "paragraph_id": "para_281"
      },
      {
        "text": "- 11 -",
        "paragraph_id": "para_282"
      },
      {
        "text": "Title XXII, § 2242, 112 Stat. 2681, 2681-822 (codified as Note to",
        "paragraph_id": "para_283"
      },
      {
        "text": "8 U.S.C. § 1231), and related regulations, which implement",
        "paragraph_id": "para_284"
      },
      {
        "text": "Article 3 of the international Convention Against Torture (\"CAT\")",
        "paragraph_id": "para_285"
      },
      {
        "text": "by prohibiting removal of all class members to countries where",
        "paragraph_id": "para_286"
      },
      {
        "text": "they likely would be tortured. We refer to claims of class members",
        "paragraph_id": "para_287"
      },
      {
        "text": "who would invoke the FARRA/CAT, and related regulations, as",
        "paragraph_id": "para_288"
      },
      {
        "text": "\"fear-of-torture claims.\" As noted already, we refer collectively",
        "paragraph_id": "para_289"
      },
      {
        "text": "to these claims as \"fear-based claims.\"",
        "paragraph_id": "para_290"
      },
      {
        "text": "Based on these determinations, the district court issued",
        "paragraph_id": "para_291"
      },
      {
        "text": "a final judgment containing the declaratory and APA-based relief",
        "paragraph_id": "para_292"
      },
      {
        "text": "described above. Reduced to its essence, the judgment declared",
        "paragraph_id": "para_293"
      },
      {
        "text": "applicable law to require DHS to engage in statutory sequencing",
        "paragraph_id": "para_294"
      },
      {
        "text": "when removing all class members and to provide every class member",
        "paragraph_id": "para_295"
      },
      {
        "text": "with effective notice and a meaningful opportunity to raise any",
        "paragraph_id": "para_296"
      },
      {
        "text": "fear-based claim regarding their removal to a third country. The",
        "paragraph_id": "para_297"
      },
      {
        "text": "judgment also set aside the Guidance as unlawful under the APA",
        "paragraph_id": "para_298"
      },
      {
        "text": "insofar as it authorizes removals that do not comply with these",
        "paragraph_id": "para_299"
      },
      {
        "text": "requirements.",
        "paragraph_id": "para_300"
      },
      {
        "text": "This appeal followed.",
        "paragraph_id": "para_301"
      },
      {
        "text": "II.",
        "paragraph_id": "para_302"
      },
      {
        "text": "In its briefing, DHS first contests the scope of the",
        "paragraph_id": "para_303"
      },
      {
        "text": "district court's remedial order and then challenges the court's",
        "paragraph_id": "para_304"
      },
      {
        "text": "jurisdictional, merits, and class-certification rulings. To",
        "paragraph_id": "para_305"
      },
      {
        "text": "facilitate our analysis, we address the issues in a different",
        "paragraph_id": "para_306"
      },
      {
        "text": "- 12 -",
        "paragraph_id": "para_307"
      },
      {
        "text": "order. We start with class certification, next discuss the",
        "paragraph_id": "para_308"
      },
      {
        "text": "jurisdictional challenges, then address the merits, and conclude",
        "paragraph_id": "para_309"
      },
      {
        "text": "with questions of remedy.",
        "paragraph_id": "para_310"
      },
      {
        "text": "A. Class Certification",
        "paragraph_id": "para_311"
      },
      {
        "text": "DHS argues that the district court erred in certifying",
        "paragraph_id": "para_312"
      },
      {
        "text": "the class. We review that decision for abuse of discretion. See,",
        "paragraph_id": "para_313"
      },
      {
        "text": "e.g., Nightingale v. Nat'l Grid USA Serv. Co., 107 F.4th 1, 11",
        "paragraph_id": "para_314"
      },
      {
        "text": "(1st Cir. 2024) (class-certification orders are reviewed for an",
        "paragraph_id": "para_315"
      },
      {
        "text": "abuse of discretion). While this case was pending in the district",
        "paragraph_id": "para_316"
      },
      {
        "text": "court, DHS did not seek an interlocutory appeal of the court's",
        "paragraph_id": "para_317"
      },
      {
        "text": "class-certification order, see Fed. R. Civ. P. 23(f) (authorizing",
        "paragraph_id": "para_318"
      },
      {
        "text": "petitions for permission from a court of appeals to challenge an",
        "paragraph_id": "para_319"
      },
      {
        "text": "order granting or denying class certification), or a prejudgment",
        "paragraph_id": "para_320"
      },
      {
        "text": "decertification of the class, see Fed. R. Civ. P. 23(c)(1)(C)",
        "paragraph_id": "para_321"
      },
      {
        "text": "(authorizing amendment of an order granting or denying class",
        "paragraph_id": "para_322"
      },
      {
        "text": "certification before final judgment). We now face an appeal of a",
        "paragraph_id": "para_323"
      },
      {
        "text": "final judgment providing class-based relief. We therefore focus",
        "paragraph_id": "para_324"
      },
      {
        "text": "on whether the class-based relief provided in that judgment meets",
        "paragraph_id": "para_325"
      },
      {
        "text": "the requirements of Federal Rule of Civil Procedure 23.",
        "paragraph_id": "para_326"
      },
      {
        "text": "Rule 23 imposes several requirements for class",
        "paragraph_id": "para_327"
      },
      {
        "text": "certification. First, under Rule 23(a), the party seeking",
        "paragraph_id": "para_328"
      },
      {
        "text": "certification must establish that",
        "paragraph_id": "para_329"
      },
      {
        "text": "(1) the class is so numerous that joinder of",
        "paragraph_id": "para_330"
      },
      {
        "text": "all members is impracticable; (2) there are",
        "paragraph_id": "para_331"
      },
      {
        "text": "questions of law or fact common to the class;",
        "paragraph_id": "para_332"
      },
      {
        "text": "- 13 -",
        "paragraph_id": "para_333"
      },
      {
        "text": "(3) the claims or defenses of the",
        "paragraph_id": "para_334"
      },
      {
        "text": "representative parties are typical of the",
        "paragraph_id": "para_335"
      },
      {
        "text": "claims or defenses of the class; and (4) the",
        "paragraph_id": "para_336"
      },
      {
        "text": "representative parties will fairly and",
        "paragraph_id": "para_337"
      },
      {
        "text": "adequately protect the interests of the class.",
        "paragraph_id": "para_338"
      },
      {
        "text": "Fed. R. Civ. P. 23(a). Additionally, the class must satisfy at",
        "paragraph_id": "para_339"
      },
      {
        "text": "least one of Rule 23(b)'s requirements. Wal-Mart Stores, Inc. v.",
        "paragraph_id": "para_340"
      },
      {
        "text": "Dukes, 564 U.S. 338, 345 (2011). Here, the plaintiffs sought class",
        "paragraph_id": "para_341"
      },
      {
        "text": "certification pursuant to Rule 23(b)(2), which requires that \"the",
        "paragraph_id": "para_342"
      },
      {
        "text": "party opposing the class has acted or refused to act on grounds",
        "paragraph_id": "para_343"
      },
      {
        "text": "that apply generally to the class, so that final injunctive relief",
        "paragraph_id": "para_344"
      },
      {
        "text": "or corresponding declaratory relief is appropriate respecting the",
        "paragraph_id": "para_345"
      },
      {
        "text": "class as a whole.\" As the Supreme Court has explained:",
        "paragraph_id": "para_346"
      },
      {
        "text": "The key to the [Rule 23](b)(2) class is the",
        "paragraph_id": "para_347"
      },
      {
        "text": "indivisible nature of the injunctive or",
        "paragraph_id": "para_348"
      },
      {
        "text": "declaratory remedy warranted -- the notion",
        "paragraph_id": "para_349"
      },
      {
        "text": "that the conduct is such that it can be",
        "paragraph_id": "para_350"
      },
      {
        "text": "enjoined or declared unlawful only as to all",
        "paragraph_id": "para_351"
      },
      {
        "text": "of the class members or as to none of them",
        "paragraph_id": "para_352"
      },
      {
        "text": ". . . . In other words, Rule 23(b)(2) applies",
        "paragraph_id": "para_353"
      },
      {
        "text": "only when a single injunction or declaratory",
        "paragraph_id": "para_354"
      },
      {
        "text": "judgment would provide relief to each member",
        "paragraph_id": "para_355"
      },
      {
        "text": "of the class. It does not authorize class",
        "paragraph_id": "para_356"
      },
      {
        "text": "certification when each individual class",
        "paragraph_id": "para_357"
      },
      {
        "text": "member would be entitled to a different",
        "paragraph_id": "para_358"
      },
      {
        "text": "injunction or declaratory judgment against",
        "paragraph_id": "para_359"
      },
      {
        "text": "the defendant.",
        "paragraph_id": "para_360"
      },
      {
        "text": "Id. at 360 (citation modified).",
        "paragraph_id": "para_361"
      },
      {
        "text": "The district court certified the class after finding",
        "paragraph_id": "para_362"
      },
      {
        "text": "that it met all four requirements of Rule 23(a) and satisfied the",
        "paragraph_id": "para_363"
      },
      {
        "text": "requirements of Rule 23(b)(2). The court concluded that numerosity",
        "paragraph_id": "para_364"
      },
      {
        "text": "was uncontested, that commonality and typicality were satisfied by",
        "paragraph_id": "para_365"
      },
      {
        "text": "- 14 -",
        "paragraph_id": "para_366"
      },
      {
        "text": "the fact that all putative class members were asserting a common",
        "paragraph_id": "para_367"
      },
      {
        "text": "right to notice and a meaningful opportunity to present a",
        "paragraph_id": "para_368"
      },
      {
        "text": "fear-based claim before removal to a third country, and that the",
        "paragraph_id": "para_369"
      },
      {
        "text": "identified representatives would fairly and adequately represent",
        "paragraph_id": "para_370"
      },
      {
        "text": "the class. Then, following the development of a summary-judgment",
        "paragraph_id": "para_371"

      },
      {
        "text": "explained, declared DHS's legal obligations to engage in statutory",
        "paragraph_id": "para_373"
      },
      {
        "text": "sequencing and to provide class members with notice and a",
        "paragraph_id": "para_374"
      },
      {
        "text": "meaningful opportunity to raise fear-based claims. The court",
        "paragraph_id": "para_375"
      },
      {
        "text": "provided this relief, along with vacatur of the Guidance, to all",
        "paragraph_id": "para_376"
      },
      {
        "text": "class members after determining that all class members were",
        "paragraph_id": "para_377"
      },
      {
        "text": "entitled to such relief and that no class member was entitled to",
        "paragraph_id": "para_378"
      },
      {
        "text": "any relief that differed from that provided to all other class",
        "paragraph_id": "para_379"
      },
      {
        "text": "members. The district court thus acted consistently with Rule 23,",
        "paragraph_id": "para_380"
      },
      {
        "text": "given the class's claims and the remedies sought. Id.",
        "paragraph_id": "para_381"
      },
      {
        "text": "DHS's principal arguments to the contrary present",
        "paragraph_id": "para_382"
      },
      {
        "text": "variants of two underlying assertions. The first is that all class",
        "paragraph_id": "para_383"
      },
      {
        "text": "members do not have the same downstream procedural rights and the",
        "paragraph_id": "para_384"
      },
      {
        "text": "same entitlement to assert the same fear-based claims. The second",
        "paragraph_id": "para_385"
      },
      {
        "text": "is that the representative parties are not identically situated to",
        "paragraph_id": "para_386"
      },
      {
        "text": "each other and the class in terms of whether they have been awarded",
        "paragraph_id": "para_387"
      },
      {
        "text": "relief based on a fear-based claim and whether they will raise",
        "paragraph_id": "para_388"
      },
      {
        "text": "such claims concerning removal to a third country. But as the",
        "paragraph_id": "para_389"
      },
      {
        "text": "district court recognized, whether all class members are similarly",
        "paragraph_id": "para_390"
      },
      {
        "text": "- 15 -",
        "paragraph_id": "para_391"
      },
      {
        "text": "situated along these lines does not matter for class-certification",
        "paragraph_id": "para_392"
      },
      {
        "text": "purposes. What matters is that all class members are similarly",
        "paragraph_id": "para_393"
      },
      {
        "text": "situated as to the specific allegations at the heart of this case:",
        "paragraph_id": "para_394"
      },
      {
        "text": "(1) entitlement to sequencing, and (2) entitlement to notice and",
        "paragraph_id": "para_395"
      },
      {
        "text": "an opportunity to assert fear-based claims before removal to a",
        "paragraph_id": "para_396"
      },
      {
        "text": "third country.3 That some may claim fear of persecution",
        "paragraph_id": "para_397"
      },
      {
        "text": "under § 1231(b), others fear of torture under the FARRA/CAT, and",
        "paragraph_id": "para_398"
      },
      {
        "text": "still others fear of both does not affect the uniform relief",
        "paragraph_id": "para_399"
      },
      {
        "text": "granted by the district court.",
        "paragraph_id": "para_400"
      },
      {
        "text": "DHS offers two additional class-certification arguments",
        "paragraph_id": "para_401"
      },
      {
        "text": "that warrant only brief discussion. The first is premised on the",
        "paragraph_id": "para_402"
      },
      {
        "text": "fact that the class includes noncitizens who have expedited removal",
        "paragraph_id": "para_403"
      },
      {
        "text": "orders, see 8 U.S.C. § 1225(b)(1), that have been reinstated,",
        "paragraph_id": "para_404"
      },
      {
        "text": "see § 1231(a)(5). DHS seeks to establish the divisibility of the",
        "paragraph_id": "para_405"
      },
      {
        "text": "class, and thus its impropriety, see Wal-Mart Stores, 564 U.S. at",
        "paragraph_id": "para_406"
      },
      {
        "text": "360, by observing that expedited removal orders cannot be",
        "paragraph_id": "para_407"
      },
      {
        "text": "3 DHS observes, correctly, that the class includes some",
        "paragraph_id": "para_408"
      },
      {
        "text": "members who are ineligible to assert fear-of-persecution claims",
        "paragraph_id": "para_409"
      },
      {
        "text": "under § 1231(b)(3). That is because certain individuals are",
        "paragraph_id": "para_410"
      },
      {
        "text": "statutorily ineligible for such protection based on their history",
        "paragraph_id": "para_411"
      },
      {
        "text": "of engaging in persecution themselves, their criminal history, or",
        "paragraph_id": "para_412"
      },
      {
        "text": "the danger they pose to national security, among other factors.",
        "paragraph_id": "para_413"
      },
      {
        "text": "See 8 U.S.C. § 1231(b)(3)(B) (listing groups of noncitizens who",
        "paragraph_id": "para_414"
      },
      {
        "text": "are ineligible to raise a claim of likely persecution). But DHS",
        "paragraph_id": "para_415"
      },
      {
        "text": "does not dispute that every member of the class is entitled to",
        "paragraph_id": "para_416"
      },
      {
        "text": "assert a fear-of-torture claim under the FARRA/CAT. See",
        "paragraph_id": "para_417"
      },
      {
        "text": "8 C.F.R. §§ 208.16(c), 208.17, 1208.16(c), 1208.17. Thus, while",
        "paragraph_id": "para_418"
      },
      {
        "text": "some class members may not assert fear-of-persecution claims, all",
        "paragraph_id": "para_419"
      },
      {
        "text": "class members may assert a fear-based claim of some sort.",
        "paragraph_id": "para_420"
      },
      {
        "text": "- 16 -",
        "paragraph_id": "para_421"
      },
      {
        "text": "challenged in a class action for declaratory relief because",
        "paragraph_id": "para_422"
      },
      {
        "text": "of § 1252(e)(1)(A). That provision prevents a court from",
        "paragraph_id": "para_423"
      },
      {
        "text": "granting declaratory relief with respect to expedited removal",
        "paragraph_id": "para_424"
      },
      {
        "text": "orders under § 1225(b)(1). DHS also points to the more general",
        "paragraph_id": "para_425"
      },
      {
        "text": "limits contained in § 1252(e)(1)(B), which circumscribe a court's",
        "paragraph_id": "para_426"
      },
      {
        "text": "power to certify classes of noncitizens with expedited removal",
        "paragraph_id": "para_427"
      },
      {
        "text": "orders. But the premise of this argument is incorrect. The class",
        "paragraph_id": "para_428"
      },
      {
        "text": "does not include noncitizens whose operative removal orders are",
        "paragraph_id": "para_429"
      },
      {
        "text": "expedited removal orders under § 1225(b)(1); it includes only",
        "paragraph_id": "para_430"
      },
      {
        "text": "noncitizens with such orders that have been reinstated pursuant to",
        "paragraph_id": "para_431"
      },
      {
        "text": "§ 1231(a)(5). And § 1252(e)(1)(A) and (B) do not apply to",
        "paragraph_id": "para_432"
      },
      {
        "text": "reinstated removal orders under § 1231(a)(5). See",
        "paragraph_id": "para_433"
      },
      {
        "text": "8 U.S.C. § 1252(e) (\"Judicial review of orders under section",
        "paragraph_id": "para_434"
      },
      {
        "text": "1225(b)(1)\").",
        "paragraph_id": "para_435"
      },
      {
        "text": "DHS also contests the adequacy of the representative",
        "paragraph_id": "para_436"
      },
      {
        "text": "parties because \"the class is not limited to a defined set of",
        "paragraph_id": "para_437"
      },
      {
        "text": "aliens . . . but instead purports to include '[a]ll' aliens in the",
        "paragraph_id": "para_438"
      },
      {
        "text": "future who will be removed to a third country.\" DHS asserts,",
        "paragraph_id": "para_439"
      },
      {
        "text": "without further elaboration, that this fact renders the",
        "paragraph_id": "para_440"
      },
      {
        "text": "representative parties inadequate because \"if this Court or the",
        "paragraph_id": "para_441"
      },
      {
        "text": "Supreme Court rules against [the plaintiffs] on the merits, every",
        "paragraph_id": "para_442"
      },
      {
        "text": "alien in the future will be bound by the judgment and thus",
        "paragraph_id": "para_443"
      },
      {
        "text": "precluded from bringing his own challenge to the Guidance or",
        "paragraph_id": "para_444"
      },
      {
        "text": "similar third-country removal policy in the future.\" But because",
        "paragraph_id": "para_445"
      },
      {
        "text": "- 17 -",
        "paragraph_id": "para_446"
      },
      {
        "text": "final judgments rarely bind non-parties to a lawsuit, see Smith v.",
        "paragraph_id": "para_447"
      },
      {
        "text": "Bayer Corp., 564 U.S. 299, 312-13 (2011), it is difficult to see",
        "paragraph_id": "para_448"
      },
      {
        "text": "how future parties would be bound by a judgment for DHS. In any",
        "paragraph_id": "para_449"
      },
      {
        "text": "event, DHS neither presented this argument to the district court",
        "paragraph_id": "para_450"
      },
      {
        "text": "nor argues to this Court that the alleged mistake constitutes plain",
        "paragraph_id": "para_451"
      },
      {
        "text": "error. Accordingly, we regard the argument as waived. See, e.g.,",
        "paragraph_id": "para_452"
      },
      {
        "text": "United States v. Martínez-Mercado, 132 F.4th 61, 68-69 (1st Cir.",
        "paragraph_id": "para_453"
      },
      {
        "text": "2025).",
        "paragraph_id": "para_454"
      },
      {
        "text": "B. Jurisdictional Issues",
        "paragraph_id": "para_455"
      },
      {
        "text": "DHS argues that the district court lacked jurisdiction",
        "paragraph_id": "para_456"
      },
      {
        "text": "over the class's APA claims pursuant to several provisions of the",
        "paragraph_id": "para_457"
      },
      {
        "text": "INA that either strip or channel federal-court jurisdiction. We",
        "paragraph_id": "para_458"
      },
      {
        "text": "address the applicability of these provisions seriatim.",
        "paragraph_id": "para_459"
      },
      {
        "text": "1. 8 U.S.C. § 1252(g)",
        "paragraph_id": "para_460"
      },
      {
        "text": "DHS first argues that this lawsuit is entirely precluded",
        "paragraph_id": "para_461"
      },
      {
        "text": "by § 1252(g), a jurisdiction-stripping provision added to the INA",
        "paragraph_id": "para_462"
      },
      {
        "text": "by the Illegal Immigration Reform and Immigrant Responsibility Act",
        "paragraph_id": "para_463"
      },
      {
        "text": "of 1996 (\"IIRIRA\"). See Reno v. Am.-Arab Anti-Discrimination Comm.",
        "paragraph_id": "para_464"
      },
      {
        "text": "525 U.S. 471, 472-73 (1999) (\"AADC\"). Section 1252(g), captioned",
        "paragraph_id": "para_465"
      },
      {
        "text": "\"Exclusive jurisdiction,\" states in relevant part that \"[e]xcept",
        "paragraph_id": "para_466"
      },
      {
        "text": "as provided in [§ 1252] . . . no court shall have jurisdiction to",
        "paragraph_id": "para_467"
      },
      {
        "text": "hear any cause or claim by or on behalf of any alien arising from",
        "paragraph_id": "para_468"
      },
      {
        "text": "the decision or action . . . to commence proceedings, adjudicate",
        "paragraph_id": "para_469"
      },
      {
        "text": "cases, or execute removal orders.\" 8 U.S.C. § 1252(g).",
        "paragraph_id": "para_470"
      },
      {
        "text": "- 18 -",
        "paragraph_id": "para_471"
      },
      {
        "text": "The district court rejected DHS's § 1252(g) argument,",
        "paragraph_id": "para_472"
      },
      {
        "text": "reasoning that this section reaches only claims based on DHS's",
        "paragraph_id": "para_473"
      },
      {
        "text": "exercise of prosecutorial discretion and not policy challenges",
        "paragraph_id": "para_474"
      },
      {
        "text": "such as those brought by the class. DHS contests this ruling by",
        "paragraph_id": "para_475"
      },
      {
        "text": "advancing the same but-for reading of the statute that it",
        "paragraph_id": "para_476"
      },
      {
        "text": "unsuccessfully pressed below. DHS starts with an assertion that",
        "paragraph_id": "para_477"
      },
      {
        "text": "the class's claims are barred by the statute because \"a claim about",
        "paragraph_id": "para_478"
      },
      {
        "text": "where an alien will be removed is, ipso facto, a 'claim' 'arising",
        "paragraph_id": "para_479"
      },
      {
        "text": "from the decision or action' to 'execute [a] removal order[].'\"",
        "paragraph_id": "para_480"
      },
      {
        "text": "\"Indeed,\" the argument continues, \"if the government were not",
        "paragraph_id": "para_481"
      },
      {
        "text": "'execut[ing a] removal order' against an alien, the alien would",
        "paragraph_id": "para_482"
      },
      {
        "text": "not even be a member of the class here, much less have standing to",
        "paragraph_id": "para_483"
      },
      {
        "text": "challenge the Guidance.\" \"By definition then,\" the argument",
        "paragraph_id": "para_484"
      },
      {
        "text": "concludes, \"each and every class member necessarily is raising a",
        "paragraph_id": "para_485"
      },
      {
        "text": "claim arising out of the government's action to execute his removal",
        "paragraph_id": "para_486"
      },
      {
        "text": "order.\"",
        "paragraph_id": "para_487"
      },
      {
        "text": "As an initial matter, an essential premise of DHS's",
        "paragraph_id": "para_488"
      },
      {
        "text": "argument -- that third-country removals pursuant to the Guidance",
        "paragraph_id": "para_489"
      },
      {
        "text": "are \"decision[s] or action[s]\" to \"execute\" the class's \"removal",
        "paragraph_id": "para_490"
      },
      {
        "text": "order[s]\" -- is flawed. Removal orders are not mere directives",
        "paragraph_id": "para_491"
      },
      {
        "text": "that noncitizens be removed from the country; such orders also",
        "paragraph_id": "para_492"
      },
      {
        "text": "must \"identify a country, or countries in the alternative, to which",
        "paragraph_id": "para_493"
      },
      {
        "text": "the alien's removal may in the first instance be made, pursuant to",
        "paragraph_id": "para_494"
      },
      {
        "text": "the provisions of [§ 1231(b)].\" 8 C.F.R. § 1240.12(d); see also",
        "paragraph_id": "para_495"
      },
      {
        "text": "- 19 -",
        "paragraph_id": "para_496"
      },
      {
        "text": "id. § 1240.10(f) (\"The [immigration judge] shall also identify for",
        "paragraph_id": "para_497"
      },
      {
        "text": "the record a country, or countries in the alternative, to which",
        "paragraph_id": "para_498"
      },
      {
        "text": "the alien's removal may be made pursuant to [§ 1231(b)(2)] if the",
        "paragraph_id": "para_499"
      },
      {
        "text": "country of the alien's designation will not accept him or her into",
        "paragraph_id": "para_500"
      },
      {
        "text": "its territory, or fails to furnish timely notice of acceptance, or",
        "paragraph_id": "para_501"
      },
      {
        "text": "if the alien declines to designate a country.\"). Further, removal",
        "paragraph_id": "para_502"
      },
      {
        "text": "orders explicitly require DHS to observe § 1231(b)'s other",
        "paragraph_id": "para_503"
      },
      {
        "text": "constraints on its authority when it cannot remove a noncitizen to",
        "paragraph_id": "para_504"
      },
      {
        "text": "the country or countries identified in his or her removal order.",
        "paragraph_id": "para_505"
      },
      {
        "text": "Id. § 1240.12(d) (\"In the event that [DHS] is unable to remove the",
        "paragraph_id": "para_506"
      },
      {
        "text": "alien to the specified or alternative country or countries, the",
        "paragraph_id": "para_507"
      },
      {
        "text": "[removal] order . . . does not limit the authority of [DHS] to",
        "paragraph_id": "para_508"
      },
      {
        "text": "remove the alien to any other country as permitted by [§ 1231(b)].\"",
        "paragraph_id": "para_509"
      },
      {
        "text": "(emphasis added)); see also id. §§ 208.16(f), 241.15, 1208.16(f).",
        "paragraph_id": "para_510"
      },
      {
        "text": "The class does not contest its removability. Nor does",
        "paragraph_id": "para_511"
      },
      {
        "text": "it challenge the validity of its removal orders, seek to delay or",
        "paragraph_id": "para_512"
      },
      {
        "text": "thwart the execution of those orders, or deny that its members can",
        "paragraph_id": "para_513"
      },
      {
        "text": "be removed lawfully to third countries based on those orders.",
        "paragraph_id": "para_514"
      },
      {
        "text": "Rather, the class seeks a declaration that its members cannot",
        "paragraph_id": "para_515"
      },
      {
        "text": "lawfully be removed to third countries, as permitted by § 1231(b),",
        "paragraph_id": "para_516"
      },
      {
        "text": "without first being provided effective notice and a meaningful",
        "paragraph_id": "para_517"
      },
      {
        "text": "opportunity to raise fear-based claims concerning those countries.",
        "paragraph_id": "para_518"
      },
      {
        "text": "The class contends that carrying out removals without providing",
        "paragraph_id": "para_519"
      },
      {
        "text": "these two essential components of due process ignores legal",
        "paragraph_id": "para_520"
      },
      {
        "text": "- 20 -",
        "paragraph_id": "para_521"
      },
      {
        "text": "requirements implicit in the scheme permitting their removal to a",
        "paragraph_id": "para_522"
      },
      {
        "text": "country not identified in their removal orders. See Mullane v.",
        "paragraph_id": "para_523"
      },
      {
        "text": "Cent. Hanover Bank & Tr. Co., 339 U.S. 306, 314 (1950) (\"An",
        "paragraph_id": "para_524"
      },
      {
        "text": "elementary and fundamental requirement of due process in any",
        "paragraph_id": "para_525"
      },
      {
        "text": "proceeding which is to be accorded finality is notice reasonably",
        "paragraph_id": "para_526"
      },
      {
        "text": "calculated, under all the circumstances, to apprise interested",
        "paragraph_id": "para_527"
      },
      {
        "text": "parties of the pendency of the action and afford them an",
        "paragraph_id": "para_528"
      },
      {
        "text": "opportunity to present their objections.\").",
        "paragraph_id": "para_529"
      },
      {
        "text": "We address the merits of the class's argument below.",
        "paragraph_id": "para_530"
      },
      {
        "text": "For now, it suffices to observe that a claim directed at DHS's",
        "paragraph_id": "para_531"
      },
      {
        "text": "adoption of policies involving identification of a country of",
        "paragraph_id": "para_532"
      },
      {
        "text": "removal not contemplated by the removal order does not arise from",
        "paragraph_id": "para_533"
      },
      {
        "text": "the decision or action to \"execute\" that order. § 1252(g). If",
        "paragraph_id": "para_534"
      },
      {
        "text": "anything, it arises from the decision or action not to execute the",
        "paragraph_id": "para_535"
      },
      {
        "text": "country-designation aspect of the removal order when removing",
        "paragraph_id": "para_536"
      },
      {
        "text": "class members. Thus, the challenge here is not to DHS's decision",
        "paragraph_id": "para_537"
      },
      {
        "text": "or action to \"execute\" class members' removal orders even under",
        "paragraph_id": "para_538"
      },
      {
        "text": "DHS's but-for reading of § 1252(g). See Ibarra-Perez v. United",
        "paragraph_id": "para_539"
      },
      {
        "text": "States, 154 F.4th 989, 997 (9th Cir. 2025) (explaining that removal",
        "paragraph_id": "para_540"
      },
      {
        "text": "to a country not mentioned in one's order of removal is not",
        "paragraph_id": "para_541"
      },
      {
        "text": "\"execution\" of the removal order under § 1252(g)).4",
        "paragraph_id": "para_542"
      },
      {
        "text": "4 This conclusion is reinforced by the \"familiar principle",
        "paragraph_id": "para_543"
      },
      {
        "text": "of statutory construction\" that, \"[w]hen a statute is 'reasonably",
        "paragraph_id": "para_544"
      },
      {
        "text": "susceptible to divergent interpretation, we adopt the reading that",
        "paragraph_id": "para_545"
      },
      {
        "text": "accords with traditional understandings and basic principles: that",
        "paragraph_id": "para_546"
      },
      {
        "text": "- 21 -",
        "paragraph_id": "para_547"
      },
      {
        "text": "In any event, as the district court recognized, DHS's",
        "paragraph_id": "para_548"
      },
      {
        "text": "but-for reading of § 1252(g) is foreclosed by Supreme Court",
        "paragraph_id": "para_549"
      },
      {
        "text": "precedent. The Supreme Court has held that § 1252(g) does not",
        "paragraph_id": "para_550"
      },
      {
        "text": "strip jurisdiction over all cases involving claims challenging",
        "paragraph_id": "para_551"
      },
      {
        "text": "removals; rather, it only does so when the claim involves one of",
        "paragraph_id": "para_552"
      },
      {
        "text": "the \"three discrete actions\" listed in § 1252. See AADC, 525 U.S.",
        "paragraph_id": "para_553"
      },
      {
        "text": "at 482. To harmonize § 1252(g) with other provisions of the INA",
        "paragraph_id": "para_554"
      },
      {
        "text": "following enactment of the IIRIRA, the Court has read the statute",
        "paragraph_id": "para_555"
      },
      {
        "text": "to strip jurisdiction only over challenges to decisions or actions",
        "paragraph_id": "para_556"
      },
      {
        "text": "to deny requests for discretionary relief from removal (such as",
        "paragraph_id": "para_557"
      },
      {
        "text": "deferred action) and instead to commence proceedings, adjudicate",
        "paragraph_id": "para_558"
      },
      {
        "text": "cases, or execute removal orders against noncitizens. See id. at",
        "paragraph_id": "para_559"
      },
      {
        "text": "482-85; see also Dep't of Homeland Sec. v. Regents of the Univ. of",
        "paragraph_id": "para_560"
      },
      {
        "text": "Cal., 591 U.S. 1, 19 (2020) (reaffirming that § 1252(g) does not",
        "paragraph_id": "para_561"
      },
      {
        "text": "cover \"all claims arising from deportation proceedings\"); INS v.",
        "paragraph_id": "para_562"
      },
      {
        "text": "St. Cyr, 533 U.S. 289, 311 n.34 (2001) (similar); Jennings v.",
        "paragraph_id": "para_563"
      },
      {
        "text": "Rodriguez, 583 U.S. 281, 294 (2018) (plurality opinion) (stating",
        "paragraph_id": "para_564"
      },
      {
        "text": "that AADC did not interpret § 1252(g) \"to sweep in any claim that",
        "paragraph_id": "para_565"
      },
      {
        "text": "can technically be said to 'arise from' the three listed actions\"",
        "paragraph_id": "para_566"
      },
      {
        "text": "executive determinations generally are subject to judicial",
        "paragraph_id": "para_567"
      },
      {
        "text": "review.'\" Kucana v. Holder, 558 U.S. 233, 251 (2010) (quoting",
        "paragraph_id": "para_568"
      },
      {
        "text": "Gutierrez de Martinez v. Lamagno, 515 U.S. 417, 434 (1995)); see",
        "paragraph_id": "para_569"
      },
      {
        "text": "also id. (\"We have consistently applied [the interpretive",
        "paragraph_id": "para_570"
      },
      {
        "text": "principle quoted above] to legislation regarding immigration, and",
        "paragraph_id": "para_571"
      },
      {
        "text": "particularly to questions concerning the preservation of",
        "paragraph_id": "para_572"
      },
      {
        "text": "federal-court jurisdiction.\").",
        "paragraph_id": "para_573"
      },
      {
        "text": "- 22 -",
        "paragraph_id": "para_574"
      },
      {
        "text": "but instead \"to refer to just those three specific actions",
        "paragraph_id": "para_575"
      },
      {
        "text": "themselves\"); Jennings, 583 U.S. at 355 (Breyer, J., dissenting)",
        "paragraph_id": "para_576"
      },
      {
        "text": "(agreeing with the plurality’s understanding on this point). And,",
        "paragraph_id": "para_577"
      },
      {
        "text": "as we have stated, this is not a case involving requests by",
        "paragraph_id": "para_578"
      },
      {
        "text": "noncitizens for discretionary relief from the execution of their",
        "paragraph_id": "para_579"
      },
      {
        "text": "removal orders.",
        "paragraph_id": "para_580"
      },
      {
        "text": "Circuit precedent also conflicts with DHS's but-for",
        "paragraph_id": "para_581"
      },
      {
        "text": "reading of the statute. In Kong v. United States, 62 F.4th 608",
        "paragraph_id": "para_582"
      },
      {
        "text": "(1st Cir. 2023), we considered whether § 1252(g) barred a",
        "paragraph_id": "para_583"
      },
      {

        "text": "Id. at 608-09. We held that it did not. In so ruling, we confirmed",

        "text": "that while \"[the petitioner's] claim of improper detention 'arose",

      },

        "text": "from' the government's decision to execute his removal\" in a",

        "text": "but-for sense, id. at 613, reading § 1252(g) to bar his claim would",
        "paragraph_id": "para_589"
      },
      {
        "text": "be contrary to the Supreme Court decisions discussed above, see",

      {
        "text": "id. at 612-13.",
        "paragraph_id": "para_591"
      },
      {
        "text": "Moreover, we explained, reading § 1252(g) to foreclose",
        "paragraph_id": "para_592"
      },
      {
        "text": "the petitioner's claim also would conflict with prior circuit",
        "paragraph_id": "para_593"
      },
      {
        "text": "precedent rejecting a but-for reading of the statutory phrase",
        "paragraph_id": "para_594"
      },
      {
        "text": "\"arising from\" in the context of § 1252(b)(9), a",
        "paragraph_id": "para_595"
      },
      {
        "text": "jurisdiction-channeling provision of the INA that we discuss",
        "paragraph_id": "para_596"
      },
      {
        "text": "below. See Kong, 62 F.4th at 613-17 (analyzing Aguilar v. U.S.",
        "paragraph_id": "para_597"
      },
      {
        "text": "Immigr. & Customs Enf't Div. of the Dep't of Homeland Sec., 510",
        "paragraph_id": "para_598"
      },
      {

      {

        "text": "§ 1252(g) to permit the petitioner's claim to proceed was",

      },
      {
        "text": "consistent with cases from other circuits. Id. at 617-18 (citing",

      },
      {
        "text": "Arce v. United States, 899 F.3d 796, 800 (9th Cir. 2018) (holding",
        "paragraph_id": "para_603"
      },
      {
        "text": "that a challenge to removal in violation of a judicial stay order",
        "paragraph_id": "para_604"
      },
      {
        "text": "was not barred by § 1252(g)), Madu v. Att'y Gen., 470 F.3d 1362,",
        "paragraph_id": "para_605"
      },
      {
        "text": "1368 (11th Cir. 2006) (explaining that a challenge to the legality",
        "paragraph_id": "para_606"
      },
      {
        "text": "of detention was distinct from a challenge to the government's",
        "paragraph_id": "para_607"
      },
      {
        "text": "discretionary decision to execute a removal not barred",
        "paragraph_id": "para_608"
      },
      {
        "text": "by § 1252(g)), and Garcia v. Att'y Gen., 553 F.3d 724, 729 (3d",
        "paragraph_id": "para_609"
      },
      {
        "text": "Cir. 2009) (stating that § 1252(g)'s jurisdictional bar does not",
        "paragraph_id": "para_610"
      },
      {
        "text": "apply when a petitioner \"is not challenging the discretionary",
        "paragraph_id": "para_611"
      },
      {
        "text": "decision to commence proceedings, but is challenging the very",
        "paragraph_id": "para_612"
      },
      {
        "text": "authority to commence those proceedings\")); see also Ibarra-Perez,",
        "paragraph_id": "para_613"
      },
      {
        "text": "154 F.4th at 997 (holding post-Kong that § 1252(g) did not bar a",
        "paragraph_id": "para_614"
      },
      {
        "text": "noncitizen's claim that \"he had a right to meaningful notice and",
        "paragraph_id": "para_615"
      },
      {
        "text": "an opportunity to present a fear-based claim before he was removed",
        "paragraph_id": "para_616"
      },
      {
        "text": "to [a third country]\").5",
        "paragraph_id": "para_617"
      },
      {
        "text": "5 DHS cites E.F.L. v. Prim, 986 F.3d 959, 965 (7th Cir.",
        "paragraph_id": "para_618"
      },
      {
        "text": "2021), and Rauda v. Jennings, 55 F.4th 773, 777-78 (9th Cir. 2022),",
        "paragraph_id": "para_619"
      },
      {
        "text": "for the proposition that \"[§] 1252(g) is not limited to only the",
        "paragraph_id": "para_620"
      },
      {
        "text": "discretionary aspects of the [three actions specified in the",
        "paragraph_id": "para_621"
      },
      {
        "text": "statute]; its text reaches 'any' action taken to 'execute removal",
        "paragraph_id": "para_622"
      },
      {
        "text": "orders.'\" But these cases differ fundamentally from the present",
        "paragraph_id": "para_623"
      },
      {
        "text": "action. Both involved requests from noncitizens that courts delay",
        "paragraph_id": "para_624"
      },
      {
        "text": "the execution of their removal orders while certain administrative",
        "paragraph_id": "para_625"
      },
      {
        "text": "petitions they had filed remained pending. See E.F.L., 986 F.3d",
        "paragraph_id": "para_626"
      },
      {
        "text": "at 961-62; Rauda, 55 F.4th at 775-76. In both cases, the",
        "paragraph_id": "para_627"
      },
      {
        "text": "- 24 -",
        "paragraph_id": "para_628"
      },
      {
        "text": "Again, the class is not challenging DHS's discretionary",
        "paragraph_id": "para_629"
      },
      {
        "text": "decision or action to proceed with the removal of class members.",
        "paragraph_id": "para_630"
      },
      {
        "text": "Nor is it challenging DHS's authority to remove class members to",
        "paragraph_id": "para_631"
      },
      {
        "text": "third countries. Rather, the class is challenging the lawfulness",
        "paragraph_id": "para_632"
      },
      {
        "text": "of DHS conducting third-country removals without first providing",
        "paragraph_id": "para_633"
      },
      {
        "text": "class members with effective notice and a meaningful opportunity",
        "paragraph_id": "para_634"
      },
      {
        "text": "to raise any fear-based claims they might have about removal to a",
        "paragraph_id": "para_635"
      },
      {
        "text": "particular third country. Accordingly, under Supreme Court and",
        "paragraph_id": "para_636"
      },
      {
        "text": "circuit precedent, the class's claims are not barred by § 1252(g).",
        "paragraph_id": "para_637"
      },
      {
        "text": "As the district court recognized, the mere fact that the class's",
        "paragraph_id": "para_638"
      },
      {
        "text": "potential fear-based claims would not have arisen but for DHS's",
        "paragraph_id": "para_639"
      },
      {
        "text": "decision or action to remove class members does not bring the",
        "paragraph_id": "para_640"
      },
      {
        "text": "claims within § 1252(g)'s bar on jurisdiction.",
        "paragraph_id": "para_641"
      },
      {
        "text": "2. 8 U.S.C. § 1252(a)(4) and FARRA § 2242(d)",
        "paragraph_id": "para_642"
      },
      {
        "text": "DHS next argues that the district court erred by",
        "paragraph_id": "para_643"
      },
      {
        "text": "rejecting its argument that 8 U.S.C. § 1252(a)(4) and § 2242(d) of",
        "paragraph_id": "para_644"
      },
      {
        "text": "noncitizens sought to avoid the jurisdictional bar by casting their",
        "paragraph_id": "para_645"
      },
      {
        "text": "requests as challenges to the government's authority to remove",
        "paragraph_id": "para_646"
      },
      {
        "text": "them while their petitions were pending, and in both cases, the",
        "paragraph_id": "para_647"
      },
      {
        "text": "court rejected their recharacterization efforts and emphasized",
        "paragraph_id": "para_648"
      },
      {
        "text": "that § 1252(g) precludes all challenges to the government's",
        "paragraph_id": "para_649"
      },
      {
        "text": "decision to execute a removal order, regardless of how the",
        "paragraph_id": "para_650"
      },
      {
        "text": "challenge is framed. See E.F.L., 986 F.3d at 964-965; Rauda, 55",
        "paragraph_id": "para_651"
      },
      {
        "text": "F.4th at 777-78. Here, as we have explained, the class does not",
        "paragraph_id": "para_652"
      },
      {
        "text": "challenge the decision to execute their removal orders. Rather,",
        "paragraph_id": "para_653"
      },
      {
        "text": "it seeks a declaration that class members are entitled to effective",
        "paragraph_id": "para_654"
      },
      {
        "text": "notice and a meaningful opportunity to raise fear-based claims if",
        "paragraph_id": "para_655"
      },
      {
        "text": "the government seeks to carry out their removals to countries not",
        "paragraph_id": "para_656"
      },
      {
        "text": "contemplated by their removal orders.",
        "paragraph_id": "para_657"
      },
      {
        "text": "- 25 -",
        "paragraph_id": "para_658"
      },
      {
        "text": "the FARRA strip it of jurisdiction over the class's",
        "paragraph_id": "para_659"
      },
      {
        "text": "fear-of-torture-related claim. That claim, again, is that the",
        "paragraph_id": "para_660"
      },
      {
        "text": "Guidance violates the APA insofar as it authorizes third-country",
        "paragraph_id": "para_661"
      },
      {
        "text": "removals without giving class members effective notice and a",
        "paragraph_id": "para_662"
      },
      {
        "text": "meaningful opportunity to assert, under the FARRA/CAT, a",
        "paragraph_id": "para_663"
      },
      {
        "text": "fear-of-torture claim with respect to the third country.",
        "paragraph_id": "para_664"
      },
      {
        "text": "Section 1252(a)(4) states in relevant part that \"[n]otwithstanding",
        "paragraph_id": "para_665"
      },
      {
        "text": "any other provision of law (statutory or non-statutory), including",
        "paragraph_id": "para_666"
      },
      {
        "text": "[§] 2241 of [T]itle 28, . . . a petition for review filed with the",
        "paragraph_id": "para_667"
      },
      {
        "text": "appropriate court of appeals . . . shall be the sole and exclusive",
        "paragraph_id": "para_668"
      },
      {
        "text": "means for judicial review of any cause or claim under [the CAT].\"",
        "paragraph_id": "para_669"
      },
      {
        "text": "Section 2242(d) of the FARRA states in relevant part:",
        "paragraph_id": "para_670"
      },
      {
        "text": "[N]othing in this section shall be construed",
        "paragraph_id": "para_671"
      },
      {
        "text": "as providing any court jurisdiction to",
        "paragraph_id": "para_672"
      },
      {
        "text": "consider or review claims raised under [the",
        "paragraph_id": "para_673"
      },
      {
        "text": "FARRA/CAT] or this section, or any other",
        "paragraph_id": "para_674"
      },
      {
        "text": "determination made with respect to [the",
        "paragraph_id": "para_675"
      },
      {
        "text": "FARRA/CAT's policy to refrain from sending any",
        "paragraph_id": "para_676"
      },
      {
        "text": "person to a country where there are",
        "paragraph_id": "para_677"
      },
      {
        "text": "substantial grounds for believing the person",
        "paragraph_id": "para_678"
      },
      {
        "text": "would be in danger of being subjected to",
        "paragraph_id": "para_679"
      },
      {
        "text": "torture], except as part of the review of a",
        "paragraph_id": "para_680"
      },
      {
        "text": "final order of removal . . . .6",
        "paragraph_id": "para_681"
      },
      {
        "text": "6 In framing its jurisdictional challenge to the district",
        "paragraph_id": "para_682"
      },
      {
        "text": "court's FARRA/CAT ruling, DHS quotes § 2242(d) as stating that \"no",
        "paragraph_id": "para_683"
      },
      {
        "text": "court shall have jurisdiction to review . . . any . . .",
        "paragraph_id": "para_684"
      },
      {
        "text": "determination made with respect to the application of [the",
        "paragraph_id": "para_685"
      },
      {
        "text": "FARRA/CAT] . . . except as part of the review of a final order of",
        "paragraph_id": "para_686"
      },
      {
        "text": "removal.\" These ellipses render the quotation materially",
        "paragraph_id": "para_687"
      },
      {
        "text": "inaccurate. Section 2242(d) in fact states that \"no court shall",
        "paragraph_id": "para_688"
      },
      {
        "text": "have jurisdiction to review the regulations adopted to implement",
        "paragraph_id": "para_689"
      },
      {
        "text": "this section.\" (emphasis added). Only after this underscored",
        "paragraph_id": "para_690"
      },
      {
        "text": "language does the statute state what we quote in the text. And",
        "paragraph_id": "para_691"
      },
      {
        "text": "the provision we quote in the text does not purport to oust courts",
        "paragraph_id": "para_692"
      },
      {
        "text": "- 26 -",
        "paragraph_id": "para_693"
      },
      {
        "text": "The district court rejected DHS's jurisdiction-stripping",
        "paragraph_id": "para_694"
      },
      {
        "text": "argument, insofar as it is premised on § 1252(a)(4), because the",
        "paragraph_id": "para_695"
      },
      {
        "text": "class's APA claim is not a \"cause or claim under [the FARRA/CAT].\"",
        "paragraph_id": "para_696"
      },
      {
        "text": "See Am. Well Works Co. v. Layne & Bowler Co., 241 U.S. 257, 260",
        "paragraph_id": "para_697"
      },
      {
        "text": "(1916) (\"A suit arises under the law that creates the cause of",
        "paragraph_id": "para_698"
      },
      {
        "text": "action.\"). DHS challenges this ruling with the following argument:",
        "paragraph_id": "para_699"
      },
      {
        "text": "\"But [the] CAT, a non-self-executing treaty, does not itself create",
        "paragraph_id": "para_700"
      },
      {
        "text": "any justiciable cause of action. If the court were correct,",
        "paragraph_id": "para_701"
      },
      {
        "text": "[§] 1252(a)(4) would not apply to any claims and would effectively",
        "paragraph_id": "para_702"
      },
      {
        "text": "be rendered meaningless. That cannot be right.\"",
        "paragraph_id": "para_703"
      },
      {
        "text": "This argument is confusing. Congress enacted",
        "paragraph_id": "para_704"
      },
      {
        "text": "§ 1252(a)(4) as part of the REAL ID Act of 2005 to clarify, as the",
        "paragraph_id": "para_705"
      },
      {
        "text": "text of the statute says, that noncitizens may not raise CAT claims",
        "paragraph_id": "para_706"
      },
      {
        "text": "in habeas corpus petitions under 28 U.S.C. § 2241. See, e.g.,",
        "paragraph_id": "para_707"
      },
      {
        "text": "Nasrallah v. Barr, 590 U.S. 573, 580-81 (2020); Kapoor v. DeMarco,",
        "paragraph_id": "para_708"
      },
      {
        "text": "132 F.4th 595, 606-10 (2d Cir. 2025). The statute will continue",
        "paragraph_id": "para_709"
      },
      {
        "text": "to do this work irrespective of anything we decide here. Thus, we",
        "paragraph_id": "para_710"
      },
      {
        "text": "do not render § 1252(a)(4) meaningless by agreeing with the",
        "paragraph_id": "para_711"
      },
      {
        "text": "district court. And the court was clearly correct in holding",
        "paragraph_id": "para_712"
      },
      {
        "text": "that § 1254(a)(4) did not deprive it of jurisdiction. As the court",
        "paragraph_id": "para_713"
      },
      {
        "text": "of jurisdiction found elsewhere; it merely disclaims that it should",
        "paragraph_id": "para_714"
      },
      {
        "text": "serve as a source of jurisdiction. See Saint Fort v. Ashcroft,",
        "paragraph_id": "para_715"
      },
      {
        "text": "329 F.3d 191, 201 (1st Cir. 2003).",
        "paragraph_id": "para_716"
      },
      {
        "text": "- 27 -",
        "paragraph_id": "para_717"
      },
      {
        "text": "stated, the class's fear-of-torture-related claim arises under the",
        "paragraph_id": "para_718"
      },
      {
        "text": "APA, not the FARRA/CAT, so § 1252(a)(4) does not apply.",
        "paragraph_id": "para_719"
      },
      {
        "text": "Turning to FARRA § 2242(d), the district court rejected",
        "paragraph_id": "para_720"
      },
      {
        "text": "DHS's jurisdiction-stripping argument insofar as it is premised on",
        "paragraph_id": "para_721"
      },
      {
        "text": "that section because the relevant portion of the statute, quoted",
        "paragraph_id": "para_722"
      },
      {
        "text": "above, says only that it does not provide jurisdiction; it does",
        "paragraph_id": "para_723"
      },
      {
        "text": "not purport to repeal jurisdiction elsewhere provided. See Saint",
        "paragraph_id": "para_724"
      },
      {
        "text": "Fort v. Ashcroft, 329 F.3d 191, 201 (1st Cir. 2003). DHS",
        "paragraph_id": "para_725"
      },
      {
        "text": "challenges this aspect of the court's ruling with the following",
        "paragraph_id": "para_726"
      },
      {
        "text": "argument:",
        "paragraph_id": "para_727"
      },
      {
        "text": "But [the court's] myopic reading overlooks",
        "paragraph_id": "para_728"
      },
      {
        "text": "that [§] 2242(d) states that \"nothing\" in",
        "paragraph_id": "para_729"
      },
      {
        "text": "[the] FARRA supplies jurisdiction to review",
        "paragraph_id": "para_730"
      },
      {
        "text": "CAT claims \"except\" as part of a final order",
        "paragraph_id": "para_731"
      },
      {
        "text": "of removal. That language is best read to",
        "paragraph_id": "para_732"
      },
      {
        "text": "mean that CAT claims may be reviewed only via",
        "paragraph_id": "para_733"
      },
      {
        "text": "a petition for review. The court's contrary",
        "paragraph_id": "para_734"
      },
      {
        "text": "reading . . . violates the INA's command that",
        "paragraph_id": "para_735"
      },
      {
        "text": "a petition for review is the \"sole and",
        "paragraph_id": "para_736"
      },
      {
        "text": "exhaustive means\" to review CAT claims",
        "paragraph_id": "para_737"
      },
      {
        "text": "\"[n]otwithstanding any other provision of",
        "paragraph_id": "para_738"
      },
      {
        "text": "law.\" 8 U.S.C. § 1254(a)(4).",
        "paragraph_id": "para_739"
      },
      {
        "text": "DHS's argument is built from two premises: first, that",
        "paragraph_id": "para_740"
      },
      {
        "text": "the class's fear-of-torture-related claim is a CAT claim, and",
        "paragraph_id": "para_741"
      },
      {
        "text": "second, that the district court construed the INA to permit CAT",
        "paragraph_id": "para_742"
      },
      {
        "text": "claims to be asserted outside the petition-for-review process.",
        "paragraph_id": "para_743"
      },
      {
        "text": "Neither premise is accurate. As we have just explained, the",
        "paragraph_id": "para_744"
      },
      {
        "text": "class's fear-of-torture-related claim arises under the APA, not",
        "paragraph_id": "para_745"
      },
      {
        "text": "the FARRA/CAT. Moreover, the court clearly appreciated the",
        "paragraph_id": "para_746"
      },
      {
        "text": "- 28 -",
        "paragraph_id": "para_747"
      },
      {
        "text": "distinction; it did not express any view on whether the INA permits",
        "paragraph_id": "para_748"
      },
      {
        "text": "a \"cause or claim under [the FARRA/CAT]\" to be asserted outside",
        "paragraph_id": "para_749"
      },
      {
        "text": "the petition-for-review process as that is not an issue in this",
        "paragraph_id": "para_750"
      },
      {
        "text": "case. The court correctly ruled that § 2242(d) of the FARRA did",
        "paragraph_id": "para_751"
      },
      {
        "text": "not deprive it of jurisdiction over the class's",
        "paragraph_id": "para_752"
      },
      {
        "text": "fear-of-torture-related claim because that claim arises under the",
        "paragraph_id": "para_753"
      },
      {
        "text": "APA, not the CAT.7",
        "paragraph_id": "para_754"
      },
      {
        "text": "3. 8 U.S.C. § 1252(a)(5) and (b)(9)",
        "paragraph_id": "para_755"
      },
      {
        "text": "DHS's final jurisdictional argument is that, even",
        "paragraph_id": "para_756"
      },
      {
        "text": "if applicable law does not strip the federal courts of jurisdiction",
        "paragraph_id": "para_757"
      },
      {
        "text": "7 DHS concludes its case for treating the class's",
        "paragraph_id": "para_758"
      },
      {
        "text": "fear-of-torture-related claim as jurisdictionally barred with two",
        "paragraph_id": "para_759"
      },
      {
        "text": "brief additional arguments. First, DHS argues that the district",
        "paragraph_id": "para_760"
      },
      {
        "text": "court erred in failing to recognize that the claim is barred under",
        "paragraph_id": "para_761"
      },
      {
        "text": "the provision of the FARRA § 2242(d) stating that \"no court shall",
        "paragraph_id": "para_762"
      },
      {
        "text": "have jurisdiction to review the regulations adopted to implement",
        "paragraph_id": "para_763"
      },
      {
        "text": "this section.\" DHS contends that this bar applies because the",
        "paragraph_id": "para_764"
      },
      {
        "text": "class's fear-of-torture-related claim \"seek[s] additional",
        "paragraph_id": "para_765"
      },
      {
        "text": "procedures with respect to [the] CAT beyond those prescribed by",
        "paragraph_id": "para_766"
      },
      {
        "text": "the Executive in the applicable regulations,\" and thus constitutes",
        "paragraph_id": "para_767"
      },
      {
        "text": "a challenge to the regulations. We reject this characterization",
        "paragraph_id": "para_768"
      },
      {
        "text": "of the class's claim. The class does not seek to engraft",
        "paragraph_id": "para_769"
      },
      {
        "text": "\"additional procedures\" onto the FARRA/CAT regulations; rather, it",
        "paragraph_id": "para_770"
      },
      {
        "text": "contends that effective notice and a meaningful opportunity to",
        "paragraph_id": "para_771"
      },
      {
        "text": "raise fear-of-torture claims are implicitly guaranteed by those",
        "paragraph_id": "para_772"
      },
      {
        "text": "regulations as they currently exist and that the Guidance is",
        "paragraph_id": "para_773"
      },
      {
        "text": "unlawful because it conflicts with these existing regulations.",
        "paragraph_id": "para_774"
      },
      {
        "text": "Second, DHS argues that the court erred in failing to apply",
        "paragraph_id": "para_775"
      },
      {
        "text": "§ 2242(d)'s jurisdictional bar to the fear-of-torture-related",
        "paragraph_id": "para_776"
      },
      {
        "text": "claim because the claim challenges a \"determination made with",
        "paragraph_id": "para_777"
      },
      {
        "text": "respect to the application of the policy set forth in subsection",
        "paragraph_id": "para_778"
      },
      {
        "text": "(a),\" which in turn implements the CAT. But § 2242(d)'s",
        "paragraph_id": "para_779"
      },
      {
        "text": "jurisdictional bar does not apply to challenges to such",
        "paragraph_id": "para_780"
      },
      {
        "text": "determinations; it applies only to challenges to the CAT",
        "paragraph_id": "para_781"
      },
      {
        "text": "regulations. See supra note 6. DHS's argument is thus built on a",
        "paragraph_id": "para_782"
      },
      {
        "text": "misconstruction of the statute.",
        "paragraph_id": "para_783"
      },
      {
        "text": "- 29 -",
        "paragraph_id": "para_784"
      },
      {
        "text": "to entertain the class's claims regarding its ability to assert",
        "paragraph_id": "para_785"
      },
      {
        "text": "fear-based claims in connection with third-country removals, the",
        "paragraph_id": "para_786"
      },
      {
        "text": "district court could not entertain those claims because they may",
        "paragraph_id": "para_787"
      },
      {
        "text": "only be asserted in petitions for review of final orders of removal",
        "paragraph_id": "para_788"
      },
      {
        "text": "in the courts of appeals. DHS relies upon two",
        "paragraph_id": "para_789"
      },
      {
        "text": "jurisdiction-channeling provisions in the INA: § 1252(a)(5) and",
        "paragraph_id": "para_790"
      },
      {
        "text": "(b)(9). Section 1252(a)(5), captioned \"Exclusive means of",
        "paragraph_id": "para_791"
      },
      {
        "text": "review,\" states in relevant part that \"a petition for review filed",
        "paragraph_id": "para_792"
      },
      {
        "text": "with an appropriate court of appeals . . . shall be the sole and",
        "paragraph_id": "para_793"
      },
      {
        "text": "exclusive means for judicial review of an order of removal.\"",
        "paragraph_id": "para_794"
      },
      {
        "text": "Section 1252(b)(9), captioned \"Consolidation of questions for",

        "text": "Judicial review of all questions of law and",
        "paragraph_id": "para_797"
      },
      {
        "text": "fact, including interpretation and",
        "paragraph_id": "para_798"
      },
      {
        "text": "application of constitutional and statutory",
        "paragraph_id": "para_799"
      },
      {
        "text": "provisions, arising from any action taken or",
        "paragraph_id": "para_800"
      },
      {
        "text": "proceeding brought to remove an",
        "paragraph_id": "para_801"
      },
      {
        "text": "alien . . . shall be available only in",
        "paragraph_id": "para_802"
      },
      {
        "text": "judicial review of a final order under this",
        "paragraph_id": "para_803"
      },
      {
        "text": "section. Except as otherwise provided in this",
        "paragraph_id": "para_804"
      },
      {
        "text": "section, no court shall have",
        "paragraph_id": "para_805"
      },
      {
        "text": "jurisdiction . . . to review such an order or",
        "paragraph_id": "para_806"
      },
      {
        "text": "such questions of law or fact.",
        "paragraph_id": "para_807"
      },
      {
        "text": "Focusing primarily on § 1252(b)(9),8 the district court",
        "paragraph_id": "para_808"
      },
      {
        "text": "rejected DHS's alternative, jurisdiction-channeling argument for",
        "paragraph_id": "para_809"
      },
      {
        "text": "8 The district court focused on § 1252(b)(9) because DHS",
        "paragraph_id": "para_810"
      },
      {
        "text": "did not develop an argument for application of § 1252(a)(5) that",
        "paragraph_id": "para_811"
      },
      {
        "text": "was independent of its § 1252(b)(9) argument. Because DHS takes",
        "paragraph_id": "para_812"
      },
      {
        "text": "the same approach on appeal, we follow suit. But in doing so, we",
        "paragraph_id": "para_813"
      },
      {
        "text": "note that § 1252(a)(5) would seem to be inapposite because, for",
        "paragraph_id": "para_814"
      },
      {
        "text": "- 30 -",
        "paragraph_id": "para_815"
      },
      {
        "text": "reasons the court described as \"functional\" and \"categorical.\"",
        "paragraph_id": "para_816"
      },
      {
        "text": "The functional reason is that class members cannot, as a practical",
        "paragraph_id": "para_817"
      },
      {
        "text": "matter, anticipatorily raise in their removal proceedings",
        "paragraph_id": "para_818"
      },
      {
        "text": "fear-based claims about removal to a country not identified in",
        "paragraph_id": "para_819"
      },
      {
        "text": "those proceedings. See Aguilar, 510 F.3d at 11",
        "paragraph_id": "para_820"
      },
      {
        "text": "(construing § 1252(b)(9) not to bar \"claims that cannot",
        "paragraph_id": "para_821"
      },
      {
        "text": "effectively be handled through the available administrative",
        "paragraph_id": "para_822"
      },
      {
        "text": "process\"); id. at 12 (expressing \"hostility toward requiring",
        "paragraph_id": "para_823"
      },
      {
        "text": "exhaustion when adequate relief could not feasibly be obtained",
        "paragraph_id": "para_824"
      },
      {
        "text": "through the prescribed administrative proceedings\"). The",
        "paragraph_id": "para_825"
      },
      {
        "text": "categorical reason is that the Supreme Court has",
        "paragraph_id": "para_826"
      },
      {
        "text": "interpreted § 1252(b)(9) to contain \"targeted language\" that does",
        "paragraph_id": "para_827"
      },
      {
        "text": "not oust the district courts of jurisdiction unless the suit seeks",
        "paragraph_id": "para_828"
      },
      {
        "text": "\"review of an order of removal, the decision to seek removal, or",
        "paragraph_id": "para_829"
      },
      {
        "text": "the process by which removability will be determined.\" Regents,",
        "paragraph_id": "para_830"
      },
      {
        "text": "591 U.S. at 19 (citation modified); see also Jennings, 583 U.S. at",
        "paragraph_id": "para_831"
      },
      {
        "text": "294 (plurality opinion), 355 (Breyer, J., dissenting).",
        "paragraph_id": "para_832"
      },
      {
        "text": "While there is considerable force to the district",
        "paragraph_id": "para_833"
      },
      {
        "text": "court's functional analysis,9 we think it sufficient to reject",
        "paragraph_id": "para_834"
      },
      {
        "text": "reasons we have already explained, this case does not involve a",
        "paragraph_id": "para_835"
      },
      {
        "text": "challenge to a final order of removal.",
        "paragraph_id": "para_836"
      },
      {
        "text": "9 The district court set forth in depth its reasoning,",
        "paragraph_id": "para_837"
      },
      {
        "text": "based on the summary-judgment record, that administrative",
        "paragraph_id": "para_838"
      },
      {
        "text": "exhaustion is impractical for noncitizens raising fear-based",
        "paragraph_id": "para_839"
      },
      {
        "text": "claims concerning removals to third countries not identified until",
        "paragraph_id": "para_840"
      },
      {
        "text": "- 31 -",
        "paragraph_id": "para_841"
      },
      {
        "text": "DHS's § 1252(b)(9) argument on the purely legal, \"categorical\"",
        "paragraph_id": "para_842"
      },
      {
        "text": "grounds that the court alternatively identified. DHS attempts to",
        "paragraph_id": "para_843"
      },
      {
        "text": "distinguish this case from Regents and Jennings by saying that,",
        "paragraph_id": "para_844"
      },
      {
        "text": "unlike those cases, this case can be characterized as one that",
        "paragraph_id": "para_845"
      },
      {
        "text": "involves an \"action\" to remove class members. But DHS fails to",
        "paragraph_id": "para_846"
      },
      {
        "text": "grapple with the fact that, like Regents and Jennings, this is not",
        "paragraph_id": "para_847"
      },
      {
        "text": "a case that seeks review of an order of removal, the decision to",
        "paragraph_id": "para_848"
      },
      {
        "text": "seek removal, or the process by which removability is determined.",
        "paragraph_id": "para_849"
      },
      {
        "text": "Rather, this is a case about the procedures DHS must follow when,",
        "paragraph_id": "para_850"
      },
      {
        "text": "after it decides to remove a person, it chooses to remove them to",
        "paragraph_id": "para_851"
      },
      {
        "text": "a country not identified in the removal order. Thus, this case",
        "paragraph_id": "para_852"
      },
      {
        "text": "challenges action that post-dates any of the three contexts",
        "paragraph_id": "para_853"
      },
      {
        "text": "identified in Regents and Jennings as triggering § 1252(b)(9)'s",
        "paragraph_id": "para_854"
      },
      {
        "text": "limitations. Regents, 591 U.S. at 19; Jennings, 583 U.S. at 294",
        "paragraph_id": "para_855"
      },
      {
        "text": "(plurality opinion), 355 (Breyer, J., dissenting).",
        "paragraph_id": "para_856"
      },
      {
        "text": "Accordingly, § 1252(b)(9) did not prohibit the district court from",
        "paragraph_id": "para_857"
      },
      {
        "text": "addressing the class's claims.",
        "paragraph_id": "para_858"
      },
      {
        "text": "C. The Merits",
        "paragraph_id": "para_859"
      },
      {
        "text": "As explained above, the district court held the Guidance",
        "paragraph_id": "para_860"
      },
      {
        "text": "unlawful for three reasons. First, it held that the Guidance is",
        "paragraph_id": "para_861"
      },
      {
        "text": "unlawful because it authorizes DHS to conduct third-country",
        "paragraph_id": "para_862"
      },
      {
        "text": "removals without first engaging in statutory sequencing: that is,",
        "paragraph_id": "para_863"
      },
      {
        "text": "after the conclusion of their removal proceedings. See D.V.D.",
        "paragraph_id": "para_864"
      },
      {
        "text": "III, 821 F. Supp. 3d at 131-35.",
        "paragraph_id": "para_865"
      },
      {
        "text": "- 32 -",
        "paragraph_id": "para_866"
      },
      {
        "text": "without first seeking to remove class members to the countries",
        "paragraph_id": "para_867"
      },
      {
        "text": "they designate, see 8 U.S.C. § 1231(b)(2)(A)-(C), or, failing",
        "paragraph_id": "para_868"
      },
      {
        "text": "that, to countries \"of which [they are] subject[s], national[s],",
        "paragraph_id": "para_869"
      },
      {
        "text": "or citizen[s],\" id. § 1231(b)(2)(D). Second, it held that the",
        "paragraph_id": "para_870"
      },
      {
        "text": "Guidance is unlawful for failing to provide eligible class members,",
        "paragraph_id": "para_871"
      },
      {
        "text": "see supra note 3, with effective notice and a meaningful",
        "paragraph_id": "para_872"
      },
      {
        "text": "opportunity to raise any fear-of-persecution claims they might",
        "paragraph_id": "para_873"
      },
      {
        "text": "have about removal to a third country, as they are entitled to do",
        "paragraph_id": "para_874"
      },
      {
        "text": "under § 1231(b)(3) and related regulations. Third, it held that",
        "paragraph_id": "para_875"
      },
      {
        "text": "the Guidance is unlawful for failing to provide class members with",
        "paragraph_id": "para_876"
      },
      {
        "text": "notice and a meaningful opportunity to raise any fear-of-torture",
        "paragraph_id": "para_877"
      },
      {
        "text": "claims they might have about removal to a third country under the",
        "paragraph_id": "para_878"
      },
      {
        "text": "Fifth Amendment's Due Process Clause. DHS contests each of these",
        "paragraph_id": "para_879"
      },
      {
        "text": "rulings.",
        "paragraph_id": "para_880"
      },
      {
        "text": "1. Sequencing",
        "paragraph_id": "para_881"
      },
      {
        "text": "The complaint in this case did not contain allegations",
        "paragraph_id": "para_882"
      },
      {
        "text": "that DHS unlawfully failed to engage in sequencing prior to",
        "paragraph_id": "para_883"
      },
      {
        "text": "carrying out third-country removals. Rather, the issue appears to",
        "paragraph_id": "para_884"
      },
      {
        "text": "have first arisen during the summary-judgment stage of the",
        "paragraph_id": "para_885"
      },
      {
        "text": "proceedings. DHS presents several arguments about this procedural",
        "paragraph_id": "para_886"
      },
      {
        "text": "irregularity, including an argument that none of the",
        "paragraph_id": "para_887"
      },
      {
        "text": "representative plaintiffs possessed Article III standing to",
        "paragraph_id": "para_888"
      },
      {
        "text": "litigate the issue. We agree with DHS that this claim must be",
        "paragraph_id": "para_889"
      },
      {
        "text": "- 33 -",
        "paragraph_id": "para_890"
      },
      {
        "text": "dismissed, and the declarations based on this claim vacated,",
        "paragraph_id": "para_891"
      },
      {
        "text": "because the representative plaintiffs lack Article III standing.",
        "paragraph_id": "para_892"
      },
      {
        "text": "Each of the representative plaintiffs alleges or implies",
        "paragraph_id": "para_893"
      },
      {
        "text": "that they have a final order of removal designating their country",
        "paragraph_id": "para_894"
      },
      {
        "text": "of citizenship as the one to which they will be removed. Each",
        "paragraph_id": "para_895"
      },
      {
        "text": "also alleges or implies that their country of citizenship is the",
        "paragraph_id": "para_896"
      },
      {
        "text": "only country designated for removal in their final removal order.",
        "paragraph_id": "para_897"
      },
      {
        "text": "Each further alleges or implies either that their country of",
        "paragraph_id": "para_898"
      },
      {
        "text": "citizenship will not take them or that they have successfully",
        "paragraph_id": "para_899"
      },
      {
        "text": "secured protection from removal to their home country based on a",
        "paragraph_id": "para_900"
      },
      {
        "text": "fear-based claim. And none alleges or implies that, during their",
        "paragraph_id": "para_901"
      },
      {
        "text": "removal proceedings, they designated a country other than their",
        "paragraph_id": "para_902"
      },
      {
        "text": "country of citizenship, see § 1231(b)(2)(A),10 that DHS",
        "paragraph_id": "para_903"
      },
      {
        "text": "10 In relevant part, § 1231(b)(2)(A)(i) states that a",
        "paragraph_id": "para_904"
      },
      {
        "text": "noncitizen who has been ordered removed \"may designate one country",
        "paragraph_id": "para_905"
      },
      {
        "text": "to which the alien wants to be removed.\" Section 1231(b)(2)(A)(ii)",
        "paragraph_id": "para_906"
      },
      {
        "text": "in turn provides that DHS \"shall remove the alien to the country",
        "paragraph_id": "para_907"
      },
      {
        "text": "the alien so designates,\" subject to limitations described",
        "paragraph_id": "para_908"
      },
      {
        "text": "in § 1231(b)(2)(B) that are not germane.",
        "paragraph_id": "para_909"
      },
      {
        "text": "- 34 -",
        "paragraph_id": "para_910"
      },
      {
        "text": "disregarded, see § 1231(b)(2)(C),11 in favor of their country of",
        "paragraph_id": "para_911"
      },
      {
        "text": "citizenship, see § 1231(b)(2)(D).12",
        "paragraph_id": "para_912"
      },
      {
        "text": "Taken together, these allegations fail to establish that",
        "paragraph_id": "para_913"
      },
      {
        "text": "DHS has disregarded the statutory sequencing requirements",
        "paragraph_id": "para_914"
      },
      {
        "text": "of § 1231(b)(2)(A)-(D) -- which, again, were the subjects of the",
        "paragraph_id": "para_915"
      },
      {
        "text": "district court's declaratory judgments regarding sequencing -- in",
        "paragraph_id": "para_916"
      },
      {
        "text": "seeking to remove the representative plaintiffs from the country.",
        "paragraph_id": "para_917"
      },
      {
        "text": "The representative plaintiffs have therefore failed to plead facts",
        "paragraph_id": "para_918"
      },
      {
        "text": "suggesting that they were injured by DHS's allegedly unlawful",
        "paragraph_id": "para_919"
      },
      {
        "text": "sequencing practices. Accordingly, we dismiss the class's",
        "paragraph_id": "para_920"
      },
      {
        "text": "sequencing claim for lack of Article III standing. See Spokeo,",
        "paragraph_id": "para_921"
      },
      {
        "text": "Inc. v. Robins, 578 U.S. 330, 338 n.6 (2016) (observing that \"named",
        "paragraph_id": "para_922"
      },
      {
        "text": "plaintiffs who represent a class must allege and show that they",
        "paragraph_id": "para_923"
      },
      {
        "text": "11 In relevant part, § 1231(b)(2)(C) authorizes DHS to",
        "paragraph_id": "para_924"
      },
      {
        "text": "disregard a noncitizen's designation of a preferred country of",
        "paragraph_id": "para_925"
      },
      {
        "text": "removal under § 1231(b)(2)(A)(i) if the noncitizen fails to",
        "paragraph_id": "para_926"
      },
      {
        "text": "designate a country promptly; if the government of the selected",
        "paragraph_id": "para_927"
      },
      {
        "text": "country does not inform DHS \"finally, within 30 days after the",
        "paragraph_id": "para_928"
      },
      {
        "text": "date [DHS] first inquires, whether the government will accept the",
        "paragraph_id": "para_929"
      },
      {
        "text": "alien into the country\"; if the government of the selected country",
        "paragraph_id": "para_930"
      },
      {
        "text": "\"is not willing to accept the alien into the country\"; or if DHS",
        "paragraph_id": "para_931"
      },
      {
        "text": "\"decides that removing the alien to the country is prejudicial to",
        "paragraph_id": "para_932"
      },
      {
        "text": "the United States.\"",
        "paragraph_id": "para_933"
      },
      {
        "text": "12 In relevant part, § 1231(b)(2)(D) states that \"[i]f an",
        "paragraph_id": "para_934"
      },
      {
        "text": "alien is not removed to a country designated under",
        "paragraph_id": "para_935"
      },
      {
        "text": "[§ 1231(b)(2)(A)(i)], [DHS] shall remove the alien to a country of",
        "paragraph_id": "para_936"
      },
      {
        "text": "which the alien is a subject, national, or citizen\" unless the",
        "paragraph_id": "para_937"
      },
      {
        "text": "country is not responsive to DHS's inquiry whether the country",
        "paragraph_id": "para_938"
      },
      {
        "text": "will accept the alien, or is not willing to accept the alien.",
        "paragraph_id": "para_939"
      },
      {
        "text": "- 35 -",
        "paragraph_id": "para_940"
      },
      {
        "text": "personally have been injured\" to satisfy the demands of Article",
        "paragraph_id": "para_941"
      },
      {
        "text": "III (citation modified)).",
        "paragraph_id": "para_942"
      },
      {
        "text": "2. Fear of Persecution",
        "paragraph_id": "para_943"
      },
      {
        "text": "The district court's fear-of-persecution ruling was",
        "paragraph_id": "para_944"
      },
      {
        "text": "based on two subsidiary conclusions. First, the court construed",
        "paragraph_id": "para_945"
      },
      {
        "text": "§ 1231(b) and related regulations, which are the provisions of law",
        "paragraph_id": "para_946"
      },
      {
        "text": "that authorize the removal of class members with final removal",
        "paragraph_id": "para_947"
      },
      {
        "text": "orders, to require DHS to provide eligible class members with",
        "paragraph_id": "para_948"
      },
      {
        "text": "effective notice and a meaningful opportunity to raise any",
        "paragraph_id": "para_949"
      },
      {
        "text": "fear-of-persecution claim before a third-country removal. Second,",
        "paragraph_id": "para_950"
      },
      {
        "text": "the court deemed the Guidance unlawful because it authorizes",
        "paragraph_id": "para_951"
      },
      {
        "text": "third-country removals without providing such notice and",
        "paragraph_id": "para_952"
      },
      {
        "text": "opportunity.",
        "paragraph_id": "para_953"
      },
      {
        "text": "The district court reached the first conclusion because,",
        "paragraph_id": "para_954"
      },
      {
        "text": "as a statutory matter, DHS exercises the power to remove class",
        "paragraph_id": "para_955"
      },
      {
        "text": "members under § 1231(b), including the power to conduct",
        "paragraph_id": "para_956"
      },
      {
        "text": "third-country removals under § 1231(b)(2)(E),13 \"[s]ubject to",
        "paragraph_id": "para_957"
      },
      {
        "text": "13 Section 1231(b)(2)(E), titled \"Additional removal",
        "paragraph_id": "para_958"
      },
      {
        "text": "countries,\" is the INA's source of authority for the third-country",
        "paragraph_id": "para_959"
      },
      {
        "text": "removal of a noncitizen who is not removed to a country the",
        "paragraph_id": "para_960"
      },
      {
        "text": "noncitizen designates under § 1231(b)(1)(A), or to a country of",
        "paragraph_id": "para_961"
      },
      {
        "text": "which the noncitizen is a subject, national, or citizen",
        "paragraph_id": "para_962"
      },
      {
        "text": "under § 1231(b)(2)(D). Section 1231(b)(2)(E)(i) to (vi) provide",
        "paragraph_id": "para_963"
      },
      {
        "text": "a list of six additional countries with which the noncitizen has",
        "paragraph_id": "para_964"
      },
      {
        "text": "lesser connections and to which the noncitizen may be",
        "paragraph_id": "para_965"
      },
      {
        "text": "removed -- e.g., \"the country from which the alien was admitted to",
        "paragraph_id": "para_966"
      },
      {
        "text": "the United States.\" § 1231(b)(2)(E)(i). The subsection concludes",
        "paragraph_id": "para_967"
      },
      {
        "text": "with § 1231(b)(2)(E)(vii), a catchall provision authorizing a",
        "paragraph_id": "para_968"
      },
      {
        "text": "third-country removal to \"another country whose government will",
        "paragraph_id": "para_969"
      },
      {
        "text": "- 36 -",
        "paragraph_id": "para_970"
      },
      {
        "text": "[§ 1231(b)(3)].\" Id. § 1231(b)(1)-(2). Again, § 1231(b)(3)",
        "paragraph_id": "para_971"
      },
      {
        "text": "categorically prohibits DHS from removing eligible class members",
        "paragraph_id": "para_972"
      },
      {
        "text": "to a country (including a third country) if DHS decides that they",
        "paragraph_id": "para_973"
      },
      {
        "text": "would face persecution there based on a protected characteristic.",
        "paragraph_id": "para_974"
      },
      {
        "text": "The court also emphasized that § 1231(b)(3) contemplates that a",
        "paragraph_id": "para_975"
      },
      {
        "text": "\"trier of fact\" would be the one to decide a fear-of-persecution",
        "paragraph_id": "para_976"
      },
      {
        "text": "claim on an individualized basis following a formal process",
        "paragraph_id": "para_977"
      },
      {
        "text": "involving the introduction of evidence and credibility",
        "paragraph_id": "para_978"
      },
      {
        "text": "determinations. See § 1231(b)(3)(C); 8 C.F.R. §§ 208.16, 1208.16",
        "paragraph_id": "para_979"
      },
      {
        "text": "(establishing standards and procedures for the adjudication of",
        "paragraph_id": "para_980"
      },
      {
        "text": "claims for withholding of removal under § 1231(b)(3) and the",
        "paragraph_id": "para_981"
      },
      {
        "text": "FARRA/CAT). Finally, the court invoked the assumption of",
        "paragraph_id": "para_982"
      },
      {
        "text": "\"congressional solicitude for fair procedure, absent explicit",
        "paragraph_id": "para_983"
      },
      {
        "text": "statutory language to the contrary,\" Califano v. Yamasaki, 442",
        "paragraph_id": "para_984"
      },
      {
        "text": "U.S. 682, 693 (1979), and the related constitutional-avoidance",
        "paragraph_id": "para_985"
      },
      {
        "text": "canon, see id.; see also, e.g., Zadvydas v. Davis, 533 U.S. 678,",
        "paragraph_id": "para_986"
      },
      {
        "text": "689 (2001) (observing that the Supreme Court has \"read significant",
        "paragraph_id": "para_987"
      },
      {
        "text": "limitations into other immigration statutes in order to avoid their",
        "paragraph_id": "para_988"
      },
      {
        "text": "constitutional invalidation\"), in support of reading a requirement",
        "paragraph_id": "para_989"
      },
      {
        "text": "of effective notice and a meaningful opportunity to present a",
        "paragraph_id": "para_990"
      },
      {
        "text": "fear-of-persecution claim into the applicable statutory and",
        "paragraph_id": "para_991"
      },
      {
        "text": "accept the alien into that country\" only if it is \"impracticable,",
        "paragraph_id": "para_992"
      },
      {
        "text": "inadvisable, or impossible to remove the alien to\" any of the",
        "paragraph_id": "para_993"
      },
      {
        "text": "countries listed in § 1231(b)(2)(E)(i)-(vi).",
        "paragraph_id": "para_994"
      },
      {
        "text": "- 37 -",
        "paragraph_id": "para_995"
      },
      {
        "text": "regulatory framework, see A.A.R.P. v. Trump, 605 U.S. 91, 94-95",
        "paragraph_id": "para_996"
      },
      {
        "text": "(2025) (confirming that the Fifth Amendment guarantees noncitizens",
        "paragraph_id": "para_997"
      },
      {
        "text": "due process of law in the context of removal proceedings).",
        "paragraph_id": "para_998"
      },
      {
        "text": "The district court reached the second conclusion -- that",
        "paragraph_id": "para_999"
      },
      {
        "text": "the Guidance is unlawful -- because, as we have explained, the",
        "paragraph_id": "para_1000"
      },
      {
        "text": "Guidance guarantees class members no notice at all of an impending",
        "paragraph_id": "para_1001"
      },
      {
        "text": "third-country removal when the country to which the noncitizen is",
        "paragraph_id": "para_1002"
      },
      {
        "text": "to be removed has provided credible (in the State Department's",
        "paragraph_id": "para_1003"
      },
      {
        "text": "judgment) diplomatic assurances that noncitizens removed there",
        "paragraph_id": "para_1004"
      },
      {
        "text": "from the United States will not be persecuted or tortured.14 And",
        "paragraph_id": "para_1005"
      },
      {
        "text": "as to countries that have not provided such diplomatic assurances,",
        "paragraph_id": "para_1006"
      },
      {
        "text": "the Guidance contemplates inadequate notice, generally only",
        "paragraph_id": "para_1007"
      },
      {
        "text": "twenty-four hours or less, of an impending third-country removal",
        "paragraph_id": "para_1008"
      },
      {
        "text": "prior to the effectuation of removal. Cf. A.A.R.P., 605 U.S. at",
        "paragraph_id": "para_1009"
      },
      {
        "text": "95 (stating that notice roughly twenty-four hours before removal",
        "paragraph_id": "para_1010"
      },
      {
        "text": "under the Alien Enemies Act, devoid of information about how to",
        "paragraph_id": "para_1011"
      },
      {

        "text": "opportunity to raise a fear-of-persecution claim, it is difficult",
        "paragraph_id": "para_1013"
      },
      {
        "text": "to see how the Guidance conforms to the detailed statutory and",
        "paragraph_id": "para_1014"
      },
      {
        "text": "regulatory regime governing such a claim. For nothing in that",
        "paragraph_id": "para_1015"
      },
      {
        "text": "regime contemplates the substitution of blanket diplomatic",
        "paragraph_id": "para_1016"
      },
      {
        "text": "assurances for the detailed and individualized procedures",
        "paragraph_id": "para_1017"
      },
      {
        "text": "governing such a claim. In this respect, 8 C.F.R. §§ 208.18(c)",
        "paragraph_id": "para_1018"
      },
      {
        "text": "and 1208.18(c) do contemplate, in the FARRA/CAT context, that",
        "paragraph_id": "para_1019"
      },
      {
        "text": "individualized diplomatic assurances obtained by the Secretary of",
        "paragraph_id": "para_1020"
      },
      {
        "text": "State can in some circumstances substitute for an administrative",
        "paragraph_id": "para_1021"
      },
      {
        "text": "order providing the noncitizen with FARRA/CAT protection.",
        "paragraph_id": "para_1022"
      },
      {
        "text": "- 38 -",
        "paragraph_id": "para_1023"
      },
      {
        "text": "exercise due process rights to contest the removal, does not",
        "paragraph_id": "para_1024"
      },
      {
        "text": "satisfy due process).15",
        "paragraph_id": "para_1025"
      },
      {
        "text": "DHS presents three arguments that the district court",
        "paragraph_id": "para_1026"
      },
      {
        "text": "erred in construing applicable statutory and regulatory law to",
        "paragraph_id": "para_1027"
      },
      {
        "text": "require effective notice of an impending third-country removal and",
        "paragraph_id": "para_1028"
      },
      {
        "text": "a meaningful opportunity to bring a fear-of-persecution claim",
        "paragraph_id": "para_1029"
      },
      {
        "text": "regarding removal to that third country.16 First, DHS asserts that",
        "paragraph_id": "para_1030"
      },
      {

        "text": "this case discloses what countries, if any, have provided the State",
        "paragraph_id": "para_1032"
      },
      {
        "text": "Department with the diplomatic assurances contemplated by the",
        "paragraph_id": "para_1033"
      },
      {
        "text": "Guidance and what countries, if any, have declined to do so. We",
        "paragraph_id": "para_1034"
      },
      {
        "text": "also note that, although it does not affect our analysis, we have",
        "paragraph_id": "para_1035"
      },
      {
        "text": "some difficulty seeing how a receiving country can credibly provide",
        "paragraph_id": "para_1036"
      },
      {
        "text": "blanket assurances that all removed noncitizens will not be",
        "paragraph_id": "para_1037"
      },
      {
        "text": "persecuted or tortured there unless it intends to provide them",
        "paragraph_id": "para_1038"
      },
      {
        "text": "with some sort of affirmative protection against rogue agents and",
        "paragraph_id": "para_1039"
      },
      {
        "text": "non-state actors, who can be persecutors within the meaning",
        "paragraph_id": "para_1040"
      },
      {
        "text": "of § 1231(b)(3), see Paye v. Garland, 109 F.4th 1, 11-12 (1st Cir.",
        "paragraph_id": "para_1041"
      },
      {
        "text": "2024), and torturers within the meaning of the FARRA/CAT, see",
        "paragraph_id": "para_1042"
      },
      {
        "text": "Escobar v. Garland, 122 F.4th 465, 481 (1st Cir. 2024).",
        "paragraph_id": "para_1043"
      },
      {
        "text": "16 In passing, DHS also takes issue with the district",
        "paragraph_id": "para_1044"
      },
      {
        "text": "court's reliance on the statutory references to the \"trier of fact\"",
        "paragraph_id": "para_1045"
      },
      {
        "text": "and \"credibility determinations\" in § 1231(b)(3)(C), arguing that",
        "paragraph_id": "para_1046"
      },
      {
        "text": "the provision containing those references \"was added in 2005\" and",
        "paragraph_id": "para_1047"
      },
      {
        "text": "is \"inapposite because it obviously refers to proceedings under",
        "paragraph_id": "para_1048"
      },
      {
        "text": "the existing regulations . . . which even the district court",
        "paragraph_id": "para_1049"
      },
      {
        "text": "agrees do not speak to third country removals.\" And DHS further",
        "paragraph_id": "para_1050"
      },
      {
        "text": "contests the inference the court drew with respect to the",
        "paragraph_id": "para_1051"
      },
      {
        "text": "interrelationship between § 1231(b)(2)(E) and § 1231(b)(3),",
        "paragraph_id": "para_1052"
      },
      {
        "text": "arguing that the provisions in § 1231(b) conditioning removal",
        "paragraph_id": "para_1053"
      },
      {
        "text": "authority on § 1231(b)(3) \"mean[] nothing more and nothing less",
        "paragraph_id": "para_1054"
      },
      {
        "text": "than if an alien has been granted withholding of removal to a",
        "paragraph_id": "para_1055"
      },
      {
        "text": "particular country, the government may not, when applying the",
        "paragraph_id": "para_1056"
      },
      {
        "text": "sequencing provisions in [§] 1231(b)(2), remove an alien to that",
        "paragraph_id": "para_1057"
      },
      {
        "text": "country.\" But DHS does not elaborate either argument, both of",
        "paragraph_id": "para_1058"
      },
      {
        "text": "which are so underdeveloped that we find them difficult to",
        "paragraph_id": "para_1059"
      },
      {
        "text": "understand. We therefore regard them as waived. See, e.g., United",
        "paragraph_id": "para_1060"
      },
      {
        "text": "States v. Zannino, 895 F.2d 1, 17 (1st Cir. 1990) (\"[I]ssues",
        "paragraph_id": "para_1061"
      },
      {
        "text": "adverted to in a perfunctory manner, unaccompanied by some effort",
        "paragraph_id": "para_1062"
      },
      {
        "text": "- 39 -",
        "paragraph_id": "para_1063"
      },
      {
        "text": "\"the [district] court did not identify any text in",
        "paragraph_id": "para_1064"
      },
      {
        "text": "Section 1231(b)(2) or 1231(b)(3) creating such an entitlement.\"",
        "paragraph_id": "para_1065"
      },
      {
        "text": "But the statute need not state the particulars of these procedural",
        "paragraph_id": "para_1066"
      },
      {
        "text": "rights for their existence to be evident in the structure of",
        "paragraph_id": "para_1067"
      },
      {
        "text": "§ 1231(b) and in the specific guarantees provided by § 1231(b)(3).",
        "paragraph_id": "para_1068"
      },
      {
        "text": "Indeed, immigration statutes are often construed to mean more than",
        "paragraph_id": "para_1069"
      },
      {
        "text": "what they plainly say -- especially when the government's proposed",
        "paragraph_id": "para_1070"
      },
      {
        "text": "reading raises serious due process concerns and where there is no",
        "paragraph_id": "para_1071"
      },
      {
        "text": "clear basis for concluding that Congress intended that problematic",
        "paragraph_id": "para_1072"
      },
      {
        "text": "reading. See, e.g., Zadvydas, 533 U.S. at 689-99 (reading \"an",
        "paragraph_id": "para_1073"
      },
      {
        "text": "implicit limitation\" into a post-removal statute such that the",
        "paragraph_id": "para_1074"
      },
      {
        "text": "noncitizen could not be detained indefinitely but rather only for",
        "paragraph_id": "para_1075"
      },
      {
        "text": "the \"period reasonably necessary\" to accomplish the noncitizen's",
        "paragraph_id": "para_1076"
      },
      {
        "text": "removal).",
        "paragraph_id": "para_1077"
      },
      {
        "text": "Here, the district court conducted a conventional",
        "paragraph_id": "para_1078"
      },
      {
        "text": "analysis of § 1231(b)(2) and (c) that led it to adopt a sensible",
        "paragraph_id": "para_1079"
      },
      {
        "text": "interpretation of statutory meaning that avoids constitutional",
        "paragraph_id": "para_1080"
      },
      {
        "text": "problems. For, as the court concluded, an individual's right to",
        "paragraph_id": "para_1081"
      },
      {
        "text": "contest removal to a country based on a fear of persecution in",
        "paragraph_id": "para_1082"
      },
      {
        "text": "that country means little if one does not receive prior notice of",
        "paragraph_id": "para_1083"
      },
      {
        "text": "the intended removal destination and a meaningful opportunity to",
        "paragraph_id": "para_1084"
      },
      {
        "text": "at developed argumentation, are deemed waived.\") In any event, we",
        "paragraph_id": "para_1085"
      },
      {
        "text": "see no basis for untethering the provisions authorizing removal",
        "paragraph_id": "para_1086"
      },
      {
        "text": "in § 1231(b) from the explicit and implicit requirements and",
        "paragraph_id": "para_1087"
      },
      {
        "text": "limitations of § 1231(b)(3).",
        "paragraph_id": "para_1088"
      },
      {
        "text": "- 40 -",
        "paragraph_id": "para_1089"
      },
      {
        "text": "contest that destination. Section 1231(b)(3) applies broadly to",
        "paragraph_id": "para_1090"
      },
      {
        "text": "prevent persecution, while DHS's proposed interpretation would",
        "paragraph_id": "para_1091"
      },
      {
        "text": "deny access to that protection to a substantial swath of",
        "paragraph_id": "para_1092"
      },
      {
        "text": "noncitizens who are sent to third countries with no notice of their",
        "paragraph_id": "para_1093"
      },
      {
        "text": "destination. We decline to adopt such an interpretation.",
        "paragraph_id": "para_1094"
      },
      {
        "text": "Second, DHS argues that § 1231(h) prohibited the",
        "paragraph_id": "para_1095"
      },
      {
        "text": "district court from recognizing the requirements and limitations",
        "paragraph_id": "para_1096"
      },
      {
        "text": "it construed § 1231(b)(2) and (3) to contain. Section 1231(h)",
        "paragraph_id": "para_1097"
      },
      {
        "text": "states that \"[n]othing in [§ 1231] shall be construed to create",
        "paragraph_id": "para_1098"
      },
      {
        "text": "any substantive or procedural right or benefit that is legally",
        "paragraph_id": "para_1099"
      },
      {
        "text": "enforceable by any party against the United States or its agencies",
        "paragraph_id": "para_1100"
      },
      {
        "text": "or officers or any other person.\" In making this argument, DHS",
        "paragraph_id": "para_1101"
      },
      {
        "text": "acknowledges that § 1231(h) cannot be read to mean that judicial",
        "paragraph_id": "para_1102"
      },
      {
        "text": "review is unavailable to enforce any right created by § 1231(b)(2)",
        "paragraph_id": "para_1103"
      },
      {
        "text": "and (3). DHS recognizes that § 1252(a)(5) and (b)(4), discussed",
        "paragraph_id": "para_1104"
      },
      {
        "text": "above, \"authorize[] judicial review of certain withholding of",
        "paragraph_id": "para_1105"
      },
      {
        "text": "removal determinations in a petition for review, and thus must",
        "paragraph_id": "para_1106"
      },
      {
        "text": "allow for some determination of rights under Section 1231(b)(3) in",
        "paragraph_id": "para_1107"
      },
      {
        "text": "the Court of Appeals.\" But, DHS continues, \"there is no corollary",
        "paragraph_id": "para_1108"
      },
      {
        "text": "exception to Section 1231(h) for district court review and",
        "paragraph_id": "para_1109"
      },
      {
        "text": "determination of such rights.\" Thus, DHS concludes, \"[s]ections",
        "paragraph_id": "para_1110"
      },
      {
        "text": "1231(h), 1252(a)(5), and 1252(b)(4) are . . . best harmonized to",
        "paragraph_id": "para_1111"
      },
      {
        "text": "mean that any procedural or substantive rights under the",
        "paragraph_id": "para_1112"
      },
      {
        "text": "withholding statute may be determined only in a petition for review",
        "paragraph_id": "para_1113"
      },
      {
        "text": "- 41 -",
        "paragraph_id": "para_1114"
      },
      {
        "text": ". . . and are not legally enforceable in any other type of suit",
        "paragraph_id": "para_1115"
      },
      {
        "text": "(like this one).\"",
        "paragraph_id": "para_1116"
      },
      {
        "text": "DHS fails to explain why § 1231(h) should be read to",
        "paragraph_id": "para_1117"
      },
      {
        "text": "permit judicial review under § 1252(a)(5) and (b)(4), but preclude",
        "paragraph_id": "para_1118"
      },
      {
        "text": "judicial review under non-INA statutes that authorize claims based",
        "paragraph_id": "para_1119"
      },
      {
        "text": "on a failure to comply with the requirements and limitations of",
        "paragraph_id": "para_1120"
      },
      {
        "text": "§ 1231(b)(2) and (c), such as the APA and the all-purpose habeas",
        "paragraph_id": "para_1121"
      },
      {
        "text": "statute, 28 U.S.C. § 2241. In any event, we need not explore this",
        "paragraph_id": "para_1122"
      },
      {
        "text": "mystery, or the meaning of § 1231(h), any further. The Supreme",
        "paragraph_id": "para_1123"
      },
      {
        "text": "Court has made clear that § 1231(h) does not bar such claims under",
        "paragraph_id": "para_1124"
      },
      {
        "text": "such statutes. Zadvydas, 533 U.S. at 687-88 (holding",
        "paragraph_id": "para_1125"
      },
      {
        "text": "that § 1231(h) \"simply forbids courts to construe [§ 1231] 'to",
        "paragraph_id": "para_1126"
      },
      {
        "text": "create any . . . procedural right or benefit that is legally",
        "paragraph_id": "para_1127"
      },
      {
        "text": "enforceable'\" and \"does not deprive an alien of the right to rely",
        "paragraph_id": "para_1128"
      },
      {
        "text": "on 28 U.S.C. § 2241 to challenge detention that is [unauthorized",
        "paragraph_id": "para_1129"
      },
      {
        "text": "by § 1231(a), which governs the detention of aliens who have been",
        "paragraph_id": "para_1130"
      },
      {
        "text": "ordered removed]\"); see generally Jama v. Immigr. & Customs Enf't,",
        "paragraph_id": "para_1131"
      },
      {
        "text": "543 U.S. 335 (2005) (reviewing on the merits a habeas petition",
        "paragraph_id": "para_1132"
      },
      {
        "text": "under § 2241 challenging the lawfulness under § 1231(b)(2)(E)(iv)",
        "paragraph_id": "para_1133"
      },
      {
        "text": "of removing a noncitizen to his country of birth when that country",
        "paragraph_id": "para_1134"
      },
      {
        "text": "did not accept him in advance); see also Pavlovich v. Gonzales,",
        "paragraph_id": "para_1135"
      },
      {
        "text": "476 F.3d 613, 615 n.1 (8th Cir. 2007) (rejecting as \"flatly",
        "paragraph_id": "para_1136"
      },
      {
        "text": "contrary to Jama\" an argument that § 1231(h) prohibits noncitizens",
        "paragraph_id": "para_1137"
      },
      {
        "text": "from claiming error in a removal-country designation",
        "paragraph_id": "para_1138"
      },
      {
        "text": "- 42 -",
        "paragraph_id": "para_1139"
      },
      {
        "text": "under § 1231(b)(2)); Texas v. United States, 515 F. Supp. 3d 627,",
        "paragraph_id": "para_1140"
      },
      {
        "text": "634 (S.D. Tex. 2021) (holding that § 1231(h) does not preclude an",
        "paragraph_id": "para_1141"
      },
      {
        "text": "APA claim based on an alleged violation of § 1231(a)(1)(A)).",
        "paragraph_id": "para_1142"
      },
      {
        "text": "Third, and finally, DHS argues that, because withholding",
        "paragraph_id": "para_1143"
      },
      {
        "text": "of removal to a country based on a fear-of-persecution claim is",
        "paragraph_id": "para_1144"
      },
      {
        "text": "dependent on the government deciding that the noncitizen's life or",
        "paragraph_id": "para_1145"
      },
      {
        "text": "freedom would be threatened there, see § 1231(b)(3)(A), the",
        "paragraph_id": "para_1146"
      },
      {
        "text": "government \"has discretion to fashion procedures to make that",
        "paragraph_id": "para_1147"
      },
      {
        "text": "decision.\" And, the argument continues, \"while the government has",
        "paragraph_id": "para_1148"
      },
      {
        "text": "provided a robust process in connection with issuance of removal",
        "paragraph_id": "para_1149"
      },
      {
        "text": "orders, . . . it has opted for a more streamlined process for",
        "paragraph_id": "para_1150"
      },
      {
        "text": "covered third-country removals\" -- i.e., removals pursuant to the",
        "paragraph_id": "para_1151"
      },
      {
        "text": "procedures contemplated by the Guidance.",
        "paragraph_id": "para_1152"
      },
      {
        "text": "This argument assumes what the class disputes: that the",
        "paragraph_id": "para_1153"
      },
      {
        "text": "duly enacted statutes and regulations applicable to",
        "paragraph_id": "para_1154"
      },
      {
        "text": "fear-of-persecution claims leave room for the \"more streamlined\"",
        "paragraph_id": "para_1155"
      },
      {
        "text": "third-country removal process that the Guidance authorizes, i.e.,",
        "paragraph_id": "para_1156"
      },
      {
        "text": "removals without notice and a meaningful opportunity to assert",
        "paragraph_id": "para_1157"
      },
      {
        "text": "fear-of-persecution claims. But the question in this case is not",
        "paragraph_id": "para_1158"
      },
      {
        "text": "whether, if the government were starting from scratch, it could by",
        "paragraph_id": "para_1159"
      },
      {
        "text": "statute or regulation lawfully adopt the streamlined process for",
        "paragraph_id": "para_1160"
      },
      {
        "text": "third-party removals contemplated by the Guidance; the question is",
        "paragraph_id": "para_1161"
      },
      {
        "text": "whether that process is consistent with the applicable statutes",
        "paragraph_id": "para_1162"
      },
      {
        "text": "and regulations that presently govern fear-of-persecution claims.",
        "paragraph_id": "para_1163"
      },
      {
        "text": "- 43 -",
        "paragraph_id": "para_1164"
      },
      {
        "text": "As the district court properly concluded, it is not. The statute",
        "paragraph_id": "para_1165"
      },
      {
        "text": "and regulations prescribe hearing-related procedures for",
        "paragraph_id": "para_1166"
      },
      {
        "text": "fear-of-persecution claims with no exception for third-country",
        "paragraph_id": "para_1167"
      },
      {
        "text": "removals. We reject DHS's efforts to create such an exception",
        "paragraph_id": "para_1168"
      },
      {
        "text": "from whole cloth.",
        "paragraph_id": "para_1169"
      },
      {
        "text": "For the reasons stated, the Guidance conflicts with the",
        "paragraph_id": "para_1170"
      },
      {
        "text": "statutory and regulatory provisions governing fear-of-persecution",
        "paragraph_id": "para_1171"
      },
      {
        "text": "claims insofar as it authorizes third-country removals without the",
        "paragraph_id": "para_1172"
      },
      {
        "text": "provision of effective notice and a meaningful opportunity to",
        "paragraph_id": "para_1173"
      },
      {
        "text": "assert such claims. The Guidance is therefore unlawful under the",
        "paragraph_id": "para_1174"
      },
      {
        "text": "APA. See 5 U.S.C. § 706(2)(A), (C).",
        "paragraph_id": "para_1175"
      },
      {
        "text": "3. Fear of Torture",
        "paragraph_id": "para_1176"
      },
      {
        "text": "After concluding that the statutory and regulatory",
        "paragraph_id": "para_1177"
      },
      {
        "text": "provisions governing fear-of-persecution claims should be read to",
        "paragraph_id": "para_1178"
      },
      {
        "text": "require effective notice and a meaningful opportunity to present",
        "paragraph_id": "para_1179"
      },
      {
        "text": "such claims before a third-country removal, and that third-country",
        "paragraph_id": "para_1180"
      },
      {
        "text": "removals under the Guidance are unlawful because the Guidance fails",
        "paragraph_id": "para_1181"
      },
      {
        "text": "to provide for either, the district court turned to whether these",
        "paragraph_id": "para_1182"
      },
      {
        "text": "procedures also are required under the FARRA/CAT.17 Here again,",
        "paragraph_id": "para_1183"
      },
      {
        "text": "17 Recall that some class members cannot assert",

        "text": "fear-of-persecution claims under § 1231(b)(3). See supra note 3.",
        "paragraph_id": "para_1185"
      },
      {
        "text": "These class members are therefore ineligible for declaratory or",
        "paragraph_id": "para_1186"
      },
      {
        "text": "APA-based relief based on the incompatibility between the Guidance",
        "paragraph_id": "para_1187"
      },
      {
        "text": "and § 1231(b)(3) and related regulatory provisions. These class",
        "paragraph_id": "para_1188"
      },
      {
        "text": "members are, however, eligible to assert fear-of-torture claims",
        "paragraph_id": "para_1189"
      },
      {
        "text": "under the FARRA/CAT. See id. Accordingly, we separately address",
        "paragraph_id": "para_1190"
      },
      {
        "text": "- 44 -",
        "paragraph_id": "para_1191"
      },
      {
        "text": "the court concluded that they are required. But the court did not",
        "paragraph_id": "para_1192"
      },
      {
        "text": "arrive at this conclusion based on an interpretation of the",
        "paragraph_id": "para_1193"
      },
      {
        "text": "FARRA/CAT and related regulations. Rather, the court bypassed the",
        "paragraph_id": "para_1194"
      },
      {
        "text": "statutory/regulatory question to resolve the issue based on the",
        "paragraph_id": "para_1195"
      },
      {
        "text": "Fifth Amendment's Due Process Clause.18",
        "paragraph_id": "para_1196"
      },
      {
        "text": "By order dated March 16, 2026, we granted DHS's emergency",
        "paragraph_id": "para_1197"
      },
      {
        "text": "motion for a stay pending appeal and directed the parties to",
        "paragraph_id": "para_1198"
      },
      {
        "text": "address in their briefing, inter alia, the following question:",
        "paragraph_id": "para_1199"
      },
      {
        "text": "\"Whether the appeal with respect to class members ineligible for",
        "paragraph_id": "para_1200"
      },
      {
        "text": "statutory withholding of removal under § 1231(b)(3) can be",
        "paragraph_id": "para_1201"
      },
      {
        "text": "resolved without regard to any question of procedural due process",
        "paragraph_id": "para_1202"
      },
      {
        "text": "under the Fifth Amendment to the Constitution.\" DHS did not",
        "paragraph_id": "para_1203"
      },
      {
        "text": "address the issue in its opening brief and devoted a single",
        "paragraph_id": "para_1204"
      },
      {
        "text": "paragraph to the issue in its reply brief, which inaccurately",
        "paragraph_id": "para_1205"
      },
      {
        "text": "described the district court as having \"properly rejected\" the",
        "paragraph_id": "para_1206"
      },
      {
        "text": "argument that the FARRA/CAT, its implementing regulations, and",
        "paragraph_id": "para_1207"
      },
      {
        "text": "international law require effective notice and a meaningful",
        "paragraph_id": "para_1208"
      },
      {
        "text": "whether APA-based relief is warranted due to the Guidance’s",
        "paragraph_id": "para_1209"
      },
      {
        "text": "violation of the requirements of the FARRA/CAT.",
        "paragraph_id": "para_1210"
      },
      {
        "text": "18 The district court declined to address the question of",
        "paragraph_id": "para_1211"
      },
      {
        "text": "statutory and regulatory meaning because, \"[a]lthough an argument",
        "paragraph_id": "para_1212"
      },
      {
        "text": "could be made that the same constitutional-avoidance logic",

      },
      {
        "text": "[grounding the court's reading of § 1231(b)(3) and related",
        "paragraph_id": "para_1214"
      },
      {
        "text": "regulations] should apply to [the right to seek relief under the",
        "paragraph_id": "para_1215"
      },
      {
        "text": "FARRA/CAT] 'absent explicit . . . language to the contrary,'",
        "paragraph_id": "para_1216"
      },
      {
        "text": "Califano, 442 U.S. at 693, there is less direct, affirmative",
        "paragraph_id": "para_1217"
      },
      {
        "text": "textual support for it.\" D.V.D. III, 821 F. Supp. 3d at 148.",
        "paragraph_id": "para_1218"
      },
      {
        "text": "- 45 -",
        "paragraph_id": "para_1219"
      },
      {
        "text": "opportunity to present a fear-of-torture claim before a",
        "paragraph_id": "para_1220"
      },
      {

        "text": "In any event, we conclude that, as with § 1231(b)(3),",

        "text": "the FARRA/CAT and its implementing regulations require that",

        "text": "noncitizens be provided with effective notice and a meaningful",
        "paragraph_id": "para_1224"
      },
      {
        "text": "opportunity to present a fear-of-torture claim before DHS may",
        "paragraph_id": "para_1225"
      },
      {
        "text": "remove them to a third country. In reading these requirements",
        "paragraph_id": "para_1226"
      },
      {
        "text": "into the relevant statutory and regulatory provisions, we do not",
        "paragraph_id": "para_1227"
      },
      {
        "text": "imply doubt about the merits of the district court's due process",
        "paragraph_id": "para_1228"
      },
      {
        "text": "analysis, whose force only bolsters our conclusion that this",
        "paragraph_id": "para_1229"
      },
      {
        "text": "situation calls for application of the constitutional-avoidance",
        "paragraph_id": "para_1230"
      },
      {
        "text": "canon and an assumption of \"congressional solicitude for fair",
        "paragraph_id": "para_1231"
      },
      {
        "text": "procedure, absent explicit statutory language to the contrary.\"",
        "paragraph_id": "para_1232"
      },
      {
        "text": "Califano, 442 U.S. at 693; see Zadvydas, 533 U.S. at 689. Where,",
        "paragraph_id": "para_1233"
      },
      {
        "text": "as here, there is no explicit language in the FARRA/CAT or related",
        "paragraph_id": "para_1234"
      },
      {
        "text": "regulations that precludes our doing so, see Califano, 442 U.S. at",
        "paragraph_id": "para_1235"
      },
      {
        "text": "693, we think it preferable to avoid a serious constitutional",
        "paragraph_id": "para_1236"
      },
      {
        "text": "problem and instead to follow the established practice of",
        "paragraph_id": "para_1237"
      },
      {
        "text": "\"read[ing] significant limitations into . . . immigration",
        "paragraph_id": "para_1238"
      },
      {
        "text": "statutes in order to avoid their constitutional invalidation.\"",
        "paragraph_id": "para_1239"
      },
      {
        "text": "Zadvydas, 533 U.S. at 689, 696-99 (analyzing whether there was \"any",
        "paragraph_id": "para_1240"
      },
      {
        "text": "clear indication of congressional intent\" to adopt a",
        "paragraph_id": "para_1241"
      },
      {

      {
        "text": "As with § 1231(b)(3), such a construction of the",
        "paragraph_id": "para_1247"
      },
      {
        "text": "FARRA/CAT and its related regulations coheres with the",
        "paragraph_id": "para_1248"
      },
      {
        "text": "FARRA § 2242(d)'s textual contemplation of an administrative",
        "paragraph_id": "para_1249"
      },
      {
        "text": "hearing and judicial review of \"claims raised under [the",
        "paragraph_id": "para_1250"
      },
      {
        "text": "FARRA/CAT]\" and \"determination[s] made with respect to the",
        "paragraph_id": "para_1251"
      },
      {
        "text": "application of [the FARRA/CAT's policy of not removing any person",
        "paragraph_id": "para_1252"
      },
      {
        "text": "to a country in which there are substantial grounds for believing",
        "paragraph_id": "para_1253"
      },
      {
        "text": "the person would be in danger of being subjected to torture].\"",
        "paragraph_id": "para_1254"
      },
      {
        "text": "See FARRA § 2242(d); see also 8 U.S.C. § 1252(a)(4) and supra note",
        "paragraph_id": "para_1255"
      },
      {
        "text": "6. Also, such a construction avoids drawing a different inference",
        "paragraph_id": "para_1256"
      },
      {
        "text": "in the FARRA/CAT context than in the § 1231(b)(3) context about",
        "paragraph_id": "para_1257"
      },
      {
        "text": "whether the provisions governing the adjudication of fear-based",
        "paragraph_id": "para_1258"
      },
      {
        "text": "claims (both persecution and torture) in 8 C.F.R. §§ 208.16 and",
        "paragraph_id": "para_1259"
      },
      {
        "text": "1208.16 imply that noncitizens must be given effective notice and",
        "paragraph_id": "para_1260"
      },
      {
        "text": "a meaningful opportunity to be heard on any such claim before DHS",
        "paragraph_id": "para_1261"
      },
      {
        "text": "may remove them to a third country. Cf. Clark v. Martinez, 543",
        "paragraph_id": "para_1262"
      },
      {
        "text": "U.S. 371, 380 (2005) (stating that textual provisions must be given",
        "paragraph_id": "para_1263"
      },
      {
        "text": "consistent readings from context to context). Finally, and most",
        "paragraph_id": "para_1264"
      },
      {
        "text": "fundamentally, just as we observed with respect to § 1231(b)(3),",
        "paragraph_id": "para_1265"
      },
      {
        "text": "an individual's right to avoid removal to a country where one is",
        "paragraph_id": "para_1266"
      },
      {
        "text": "likely to be tortured means little if one is not given prior notice",
        "paragraph_id": "para_1267"
      },
      {
        "text": "of an intended third-country removal to that country and a",
        "paragraph_id": "para_1268"
      },
      {
        "text": "- 47 -",
        "paragraph_id": "para_1269"
      },
      {
        "text": "meaningful opportunity to assert their fear of torture if removed",
        "paragraph_id": "para_1270"
      },
      {
        "text": "to that location. Our reading of the statute and regulations thus",
        "paragraph_id": "para_1271"
      },
      {
        "text": "avoids a serious constitutional problem.",
        "paragraph_id": "para_1272"
      },
      {
        "text": "In a single paragraph in its reply brief, DHS contests",
        "paragraph_id": "para_1273"
      },
      {
        "text": "our reading of the FARRA/CAT and related regulations with three",
        "paragraph_id": "para_1274"
      },
      {
        "text": "undeveloped assertions. First, DHS states that § 2242(d)'s use of",
        "paragraph_id": "para_1275"
      },
      {
        "text": "the term \"determination\" is an insufficient textual basis for",
        "paragraph_id": "para_1276"
      },
      {
        "text": "reading the FARRA/CAT and related regulations to require the",
        "paragraph_id": "para_1277"
      },
      {
        "text": "provision of effective individualized notice and a meaningful",
        "paragraph_id": "para_1278"
      },
      {
        "text": "opportunity to assert one's rights. But as explained above, our",
        "paragraph_id": "para_1279"
      },
      {
        "text": "contrary conclusion is based on far more than extrapolation from",
        "paragraph_id": "para_1280"
      },
      {
        "text": "the word \"determination.\"",
        "paragraph_id": "para_1281"
      },
      {
        "text": "Second, DHS argues that the FARRA/CAT's implementing",
        "paragraph_id": "para_1282"
      },
      {
        "text": "regulations \"plainly refer to applications for protection",
        "paragraph_id": "para_1283"
      },
      {
        "text": "submitted during removal proceedings\" and \"clarify that nothing in",
        "paragraph_id": "para_1284"
      },
      {
        "text": "the [regulations] should be construed as preventing removal to a",
        "paragraph_id": "para_1285"
      },
      {
        "text": "third country.\" These assertions miss identify the question before",
        "paragraph_id": "para_1286"
      },
      {
        "text": "us. The issue we confront is whether noncitizens are entitled to",
        "paragraph_id": "para_1287"
      },
      {
        "text": "notice and a meaningful opportunity to raise a fear-of-torture",
        "paragraph_id": "para_1288"
      },
      {
        "text": "claim in connection with any such third-country removal. We see",
        "paragraph_id": "para_1289"
      },
      {
        "text": "no reason to read the regulations to treat noncitizens with final",
        "paragraph_id": "para_1290"
      },
      {
        "text": "removal orders less favorably than noncitizens still in removal",
        "paragraph_id": "para_1291"
      },
      {
        "text": "proceedings with respect to the ability to assert such a claim.",
        "paragraph_id": "para_1292"
      },
      {
        "text": "- 48 -",
        "paragraph_id": "para_1293"
      },
      {
        "text": "Third, DHS asserts that there is support for its position",
        "paragraph_id": "para_1294"
      },
      {
        "text": "in 8 C.F.R. §§ 208.17(b)(2) and 1208.17(b)(2), which require",
        "paragraph_id": "para_1295"
      },
      {
        "text": "immigration judges to inform noncitizens who have been granted",
        "paragraph_id": "para_1296"
      },
      {
        "text": "deferral of removal to a country in which they are likely to be",
        "paragraph_id": "para_1297"
      },
      {
        "text": "tortured that they \"may be removed at any time to another country",
        "paragraph_id": "para_1298"
      },
      {
        "text": "where [they are] not likely to be tortured.\" DHS contends that",
        "paragraph_id": "para_1299"
      },
      {
        "text": "these regulatory provisions show that the provision of notice and",
        "paragraph_id": "para_1300"
      },
      {
        "text": "a meaningful opportunity to raise a fear-of-torture claim is",
        "paragraph_id": "para_1301"
      },
      {
        "text": "unnecessary as to that third country, arguing that \"[t]here would",
        "paragraph_id": "para_1302"
      },
      {
        "text": "be no reason for the regulations to note that protection under CAT",
        "paragraph_id": "para_1303"
      },
      {
        "text": "is country specific, such that an alien can be removed to [a] third",
        "paragraph_id": "para_1304"
      },
      {
        "text": "country, if the government had to start from the beginning each",
        "paragraph_id": "para_1305"
      },
      {
        "text": "time it sought to remove an alien to a third country.\"",
        "paragraph_id": "para_1306"
      },
      {
        "text": "We see no redundancy. The class does not claim",
        "paragraph_id": "para_1307"
      },
      {
        "text": "entitlement to restart the removal process from the beginning when",
        "paragraph_id": "para_1308"
      },
      {
        "text": "DHS seeks to execute a third-country removal. Rather, it seeks",
        "paragraph_id": "para_1309"
      },
      {
        "text": "only prior notice of the intended removal destination and a",
        "paragraph_id": "para_1310"
      },
      {
        "text": "meaningful opportunity to raise any fear-based claims they might",
        "paragraph_id": "para_1311"
      },
      {
        "text": "have regarding it. The regulatory provisions serve an antecedent",
        "paragraph_id": "para_1312"
      },
      {
        "text": "purpose. They place affected noncitizens on general notice of the",
        "paragraph_id": "para_1313"
      },
      {
        "text": "possibility of a third-country removal.",
        "paragraph_id": "para_1314"
      },
      {
        "text": "For the reasons stated, the Guidance conflicts with the",
        "paragraph_id": "para_1315"
      },
      {
        "text": "statutory and regulatory provisions governing fear-of-torture",
        "paragraph_id": "para_1316"
      },
      {
        "text": "claims insofar as it authorizes third-country removals without",
        "paragraph_id": "para_1317"
      },
      {
        "text": "- 49 -",
        "paragraph_id": "para_1318"
      },
      {
        "text": "effective notice and a meaningful opportunity to assert such claims",
        "paragraph_id": "para_1319"
      },
      {
        "text": "in connection with such removals. The Guidance is therefore",
        "paragraph_id": "para_1320"
      },
      {
        "text": "unlawful under the APA. See 5 U.S.C. § 706(2)(A), (C).20",
        "paragraph_id": "para_1321"
      },
      {
        "text": "D. Scope of the Remedy and 8 U.S.C. § 1252(f)(1)",
        "paragraph_id": "para_1322"
      },
      {
        "text": "Finally, DHS argues that the declaratory and APA-based",
        "paragraph_id": "para_1323"
      },
      {
        "text": "vacatur relief ordered by the district court violates",
        "paragraph_id": "para_1324"
      },
      {
        "text": "8 U.S.C. § 1252(f)(1). Section 1252(f)(1), captioned \"Limit on",
        "paragraph_id": "para_1325"
      },
      {
        "text": "injunctive relief,\" states in relevant part:",
        "paragraph_id": "para_1326"
      },
      {
        "text": "Regardless of the nature of the action or",
        "paragraph_id": "para_1327"
      },
      {
        "text": "claim or of the identity of the party or",
        "paragraph_id": "para_1328"
      },
      {
        "text": "parties bringing the action, no court (other",
        "paragraph_id": "para_1329"
      },
      {
        "text": "than the Supreme Court) shall have",
        "paragraph_id": "para_1330"
      },
      {
        "text": "jurisdiction or authority to enjoin or",
        "paragraph_id": "para_1331"
      },
      {
        "text": "restrain the operation of the provisions",
        "paragraph_id": "para_1332"
      },
      {
        "text": "[authorizing third-country removals] . . .",
        "paragraph_id": "para_1333"
      },
      {
        "text": "other than with respect to the application of",
        "paragraph_id": "para_1334"
      },
      {
        "text": "such provisions to an individual alien against",
        "paragraph_id": "para_1335"
      },
      {
        "text": "whom proceedings under such part have been",
        "paragraph_id": "para_1336"
      },
      {
        "text": "initiated.",
        "paragraph_id": "para_1337"
      },
      {
        "text": "DHS contends that the practical effect of the court's declaratory",
        "paragraph_id": "para_1338"
      },
      {
        "text": "judgments and vacatur of the Guidance is \"to enjoin or restrain",
        "paragraph_id": "para_1339"
      },
      {
        "text": "the operation\" of § 1231(b)(2)(E) in violation of the statute.",
        "paragraph_id": "para_1340"
      },
      {
        "text": "20 Because we affirm the district court's conclusion that",
        "paragraph_id": "para_1341"
      },
      {
        "text": "the Guidance is unlawful under the APA on the ground that it",
        "paragraph_id": "para_1342"
      },
      {
        "text": "violates the class's statutory and regulatory rights, and because",
        "paragraph_id": "para_1343"
      },
      {
        "text": "we do not reach the question whether the Guidance also violates",
        "paragraph_id": "para_1344"
      },
      {
        "text": "the Fifth Amendment's Due Process Clause, we do not address DHS's",
        "paragraph_id": "para_1345"
      },
      {
        "text": "argument that the Guidance satisfies due process requirements",
        "paragraph_id": "para_1346"
      },
      {
        "text": "because blanket diplomatic assurances can substitute for",
        "paragraph_id": "para_1347"
      },
      {
        "text": "individualized process as a constitutional matter. Nor do we",
        "paragraph_id": "para_1348"
      },
      {
        "text": "address DHS's argument that class members who entered the country",
        "paragraph_id": "para_1349"
      },
      {
        "text": "clandestinely should be treated as not having been admitted",
        "paragraph_id": "para_1350"
      },
      {
        "text": "pursuant to the so-called \"entry fiction.\"",
        "paragraph_id": "para_1351"
      },
      {
        "text": "- 50 -",
        "paragraph_id": "para_1352"
      },
      {
        "text": "Insofar as DHS challenges the district court's",
        "paragraph_id": "para_1353"
      },
      {
        "text": "declaratory judgments, circuit precedent directly forecloses its",
        "paragraph_id": "para_1354"
      },
      {
        "text": "argument. In Brito v. Garland, 22 F.4th 240, 250-52 (1st Cir.",
        "paragraph_id": "para_1355"
      },
      {
        "text": "2021), we held that § 1252(f)(1) does not prevent a district court",
        "paragraph_id": "para_1356"
      },
      {
        "text": "from providing declaratory relief to a class of noncitizens. We",
        "paragraph_id": "para_1357"
      },
      {
        "text": "provided four principal reasons for our conclusion.",
        "paragraph_id": "para_1358"
      },
      {
        "text": "Our analysis started with the statute's caption and",
        "paragraph_id": "para_1359"
      },
      {
        "text": "text, both of which reference only injunctions and neither of which",
        "paragraph_id": "para_1360"
      },
      {
        "text": "suggests a ban on declaratory judgments. See id. at 251; see also",
        "paragraph_id": "para_1361"
      },
      {
        "text": "AADC, 525 U.S. at 481 (observing that § 1252(f)(1) is \"nothing",
        "paragraph_id": "para_1362"
      },
      {
        "text": "more or less than a limit on injunctive relief\"). We next",
        "paragraph_id": "para_1363"
      },
      {
        "text": "emphasized that a declaratory judgment is a \"milder remedy\" than",
        "paragraph_id": "para_1364"
      },
      {
        "text": "an injunction; it does not coerce a party, prohibit any future",
        "paragraph_id": "para_1365"
      },
      {
        "text": "action, or \"set the stage for a finding of contempt\" -- a",
        "paragraph_id": "para_1366"
      },
      {
        "text": "\"distinction\" we described as being \"of special note in cases in",
        "paragraph_id": "para_1367"
      },
      {
        "text": "which the government is a party.\" Brito, 22 F.4th at 251.",
        "paragraph_id": "para_1368"
      },
      {
        "text": "Third, we observed that \"Congress knows how to prohibit",
        "paragraph_id": "para_1369"
      },
      {
        "text": "declaratory relief when it so chooses,\" noting that \"the preceding",
        "paragraph_id": "para_1370"
      },
      {
        "text": "subpart in section 1252 prohibits courts from granting",
        "paragraph_id": "para_1371"
      },
      {
        "text": "'declaratory, injunctive, or other equitable relief in any action",
        "paragraph_id": "para_1372"
      },
      {
        "text": "pertaining to an order to exclude an alien in accordance with",
        "paragraph_id": "para_1373"
      },
      {
        "text": "[§] 1225(b)(1).'\" Id. (quoting § 1252(e)(1)(A)); see id. (\"[W]hen",
        "paragraph_id": "para_1374"
      },
      {
        "text": "Congress includes particular language in one section of a statute",
        "paragraph_id": "para_1375"
      },
      {
        "text": "but omits it in another section of the same Act, it is generally",
        "paragraph_id": "para_1376"
      },
      {
        "text": "- 51 -",
        "paragraph_id": "para_1377"
      },
      {
        "text": "presumed that Congress acts intentionally and purposely in the",
        "paragraph_id": "para_1378"
      },
      {
        "text": "disparate inclusion or exclusion\" (citation modified) (quoting",
        "paragraph_id": "para_1379"
      },
      {
        "text": "Barnhart v. Sigmon Coal Co., 534 U.S. 438, 452 (2002))).",
        "paragraph_id": "para_1380"
      },
      {
        "text": "Finally, we distinguished a Supreme Court case on which",
        "paragraph_id": "para_1381"
      },
      {
        "text": "DHS heavily relies, California v. Grace Brethren Church, 457 U.S.",
        "paragraph_id": "para_1382"
      },
      {
        "text": "393, 407-09 (1982), where the Supreme Court held that declaratory",
        "paragraph_id": "para_1383"
      },
      {
        "text": "relief is unavailable under a statute that only expressly prohibits",
        "paragraph_id": "para_1384"
      },
      {
        "text": "injunctive relief. We noted that Grace Brethren Church had limited",
        "paragraph_id": "para_1385"
      },
      {
        "text": "relevance because it involved federalism concerns that are not",
        "paragraph_id": "para_1386"
      },
      {
        "text": "present in the immigration-law context. See Brito, 22 F.4th at",
        "paragraph_id": "para_1387"
      },
      {
        "text": "251-52 (citing, inter alia, Steffel v. Thompson, 415 U.S. 452, 472",
        "paragraph_id": "para_1388"
      },
      {
        "text": "(1974) (stating that \"[t]he only occasions where this Court has",
        "paragraph_id": "para_1389"
      },
      {
        "text": ". . . found that a preclusion of injunctive relief inevitably led",
        "paragraph_id": "para_1390"
      },
      {
        "text": "to a denial of declaratory relief have been cases in which",
        "paragraph_id": "para_1391"
      },
      {
        "text": "principles of federalism militated altogether against federal",
        "paragraph_id": "para_1392"
      },
      {
        "text": "intervention in a class of adjudications\")).",
        "paragraph_id": "para_1393"
      },
      {
        "text": "We recognize that, after Brito, the Supreme Court",
        "paragraph_id": "para_1394"
      },
      {
        "text": "decided Garland v. Aleman Gonzalez, 596 U.S. 543 (2022). DHS reads",
        "paragraph_id": "para_1395"
      },
      {
        "text": "Aleman Gonzalez to have accorded such a broad construction of the",
        "paragraph_id": "para_1396"
      },
      {
        "text": "statutory term \"restrain\" such that declaratory judgments (and",
        "paragraph_id": "para_1397"
      },
      {
        "text": "vacaturs) of the sort at issue here fall within the sweep",
        "paragraph_id": "para_1398"
      },
      {
        "text": "of § 1252(f)(1). Thus, DHS argues, we are not bound by Brito.",
        "paragraph_id": "para_1399"
      },
      {
        "text": "See Williams v. Ashland Eng'g Co., 45 F.3d 588, 592 (1st Cir. 1995)",
        "paragraph_id": "para_1400"
      },
      {
        "text": "(prior panel holding does not bind a subsequent panel when",
        "paragraph_id": "para_1401"
      },
      {
        "text": "- 52 -",
        "paragraph_id": "para_1402"
      },
      {
        "text": "\"authority that postdates the original decision, although not",
        "paragraph_id": "para_1403"
      },
      {
        "text": "directly controlling, nevertheless offers a sound reason for",
        "paragraph_id": "para_1404"
      },
      {
        "text": "believing that the former panel, in light of fresh developments,",
        "paragraph_id": "para_1405"
      },
      {
        "text": "would change its collective mind\").",
        "paragraph_id": "para_1406"
      },
      {
        "text": "Aleman Gonzalez does not so clearly reject Brito's",
        "paragraph_id": "para_1407"
      },
      {
        "text": "reasoning that we may disregard its holding. In fact, Aleman",
        "paragraph_id": "para_1408"
      },
      {
        "text": "Gonzalez expressly reserves the question whether § 1252(f)(1)",
        "paragraph_id": "para_1409"
      },
      {
        "text": "prohibits any form of relief that is similar to an injunction,",
        "paragraph_id": "para_1410"
      },
      {
        "text": "including class-wide declaratory relief. See 596 U.S. at 551 n.2.",
        "paragraph_id": "para_1411"
      },
      {
        "text": "Under the circumstances, we must follow Brito. See, e.g., United",
        "paragraph_id": "para_1412"
      },
      {
        "text": "States v. Perez, 89 F.4th 247, 250 (1st Cir. 2023) (emphasizing",
        "paragraph_id": "para_1413"
      },
      {
        "text": "that the exception to the law-of-the-circuit doctrine described",
        "paragraph_id": "para_1414"
      },
      {
        "text": "above in the Williams parenthetical is \"hen's-teeth-rare\" and",
        "paragraph_id": "para_1415"
      },
      {
        "text": "\"applies only when the new authority provides a clear and",
        "paragraph_id": "para_1416"
      },
      {
        "text": "convincing basis to conclude that the prior panel would have",
        "paragraph_id": "para_1417"
      },
      {
        "text": "changed its mind\" (citation modified)).",
        "paragraph_id": "para_1418"
      },
      {
        "text": "Insofar as DHS challenges the district court's vacatur",
        "paragraph_id": "para_1419"
      },
      {
        "text": "order based on Aleman Gonzalez, we reach the same conclusion.",
        "paragraph_id": "para_1420"
      },
      {
        "text": "Although Brito does not directly control, as it does in the",
        "paragraph_id": "para_1421"
      },
      {
        "text": "declaratory-judgment context, we could not accept DHS's argument",
        "paragraph_id": "para_1422"
      },
      {
        "text": "without ignoring the substance of Brito's analysis. First, as is",
        "paragraph_id": "para_1423"
      },
      {
        "text": "the case with declaratory relief, neither the caption",
        "paragraph_id": "para_1424"
      },
      {
        "text": "of § 1252(f)(1) nor the statutory text mentions vacatur, which the",
        "paragraph_id": "para_1425"
      },
      {
        "text": "APA makes mandatory once a court finds agency action to be",
        "paragraph_id": "para_1426"
      },
      {

      },
      {
        "text": "unlawful. See 5 U.S.C. § 706(2) (\"The reviewing court",
        "paragraph_id": "para_1428"
      },
      {
        "text": "shall . . . hold unlawful and set aside [such] agency action.\");",
        "paragraph_id": "para_1429"
      },
      {
        "text": "see also Epic Sys. Corp. v. Lewis, 584 U.S. 497, 510 (2018)",
        "paragraph_id": "para_1430"
      },

        "text": "bears the heavy burden of showing 'a clearly expressed",
        "paragraph_id": "para_1434"

        "text": "congressional intention' that such a result should follow\"",

      },
      {
        "text": "(citation modified)); Kucana v. Holder, 558 U.S. 233, 251 (2010)",

      {
        "text": "(noting a presumption in favor of judicial review of executive",

      },

        "text": "action, particularly in the immigration-law context).",

        "text": "Second, as is the case with declaratory relief, vacatur",
        "paragraph_id": "para_1439"
      },
      {
        "text": "is a milder remedy than an injunction. Monsanto Co. v. Geertson",

      {
        "text": "Seed Farms, 561 U.S. 139, 165-66 (2010) (describing an injunction",

      {
        "text": "as a \"drastic and extraordinary remedy\" and vacatur as \"a less",

      },
      {
        "text": "drastic remedy\"); see also Texas v. United States, 40 F.4th 205,",

      },
      {
        "text": "220 (5th Cir. 2022) (noting that \"a vacatur does nothing but",

      },
      {
        "text": "re-establish the status quo absent the unlawful agency action\" and",

      },
      {
        "text": "\"neither compels nor restrains further agency decision-making\").",
        "paragraph_id": "para_1446"
      },
      {
        "text": "And third, as we have just said in addressing whether § 1252(f)(1)",
        "paragraph_id": "para_1447"
      },
      {
        "text": "precludes declaratory relief, Congress knows how to be specific",
        "paragraph_id": "para_1448"
      },
      {
        "text": "when it wants to bar remedies beyond injunctive relief.",

      },
      {

        "text": "Because faithful application of the reasoning in Brito",

        "text": "requires that we do so, we reject DHS's argument that the district",

        "text": "court's vacatur of the Guidance under the APA is barred",
        "paragraph_id": "para_1454"
      },
      {
        "text": "by § 1252(f)(1). We note that this is the uniform position of",
        "paragraph_id": "para_1455"
      },
      {
        "text": "courts that have considered the question after Aleman Gonzalez.",
        "paragraph_id": "para_1456"
      },
      {
        "text": "See Refugee & Immigrant Ctr. for Educ. & Legal Servs. v. Mullin,",

      },
      {

        "text": "220. We also note that, in Trump v. CASA, Inc., 606 U.S. 831",

        "text": "issue nationwide injunctions, the Court explicitly stated that its",

        "text": "III.",
        "paragraph_id": "para_1466"
      },
      {
        "text": "For the reasons stated, we vacate on standing grounds",
        "paragraph_id": "para_1467"
      },
      {
        "text": "the two declarations pertaining to DHS's statutory obligation to",
        "paragraph_id": "para_1468"
      },
      {
        "text": "seek to remove class members to countries they have designated, or",
        "paragraph_id": "para_1469"
      },
      {
        "text": "of which they are subjects, nationals, or citizens, prior to",
        "paragraph_id": "para_1470"
      },
      {
        "text": "removing them to third countries. We otherwise affirm the final",
        "paragraph_id": "para_1471"
      },
      {
        "text": "judgment.",
        "paragraph_id": "para_1472"
      },
      {
        "text": "So ordered.21",
