        "text": "Parente (\"Parente\") and Eric L. Stewart (\"Stewart\") sued the Rhode",
        "paragraph_id": "para_48"
      },
      {
        "text": "Island Department of Corrections and its staff (collectively,",
        "paragraph_id": "para_49"
      },
      {
        "text": "\"RIDOC\") for failing to properly treat their preexisting medical",
        "paragraph_id": "para_50"
      },
      {
        "text": "conditions. They allege various federal and state constitutional,",
        "paragraph_id": "para_51"
      },
      {
        "text": "statutory, and common law bases for relief, including a claim under",
        "paragraph_id": "para_52"
      },
      {
        "text": "the Rhode Island Civil Rights Act of 1990 (\"RICRA\"). Only the",
        "paragraph_id": "para_53"
      },
      {
        "text": "RICRA claim is before us. The district court denied RIDOC's motion",
        "paragraph_id": "para_54"
      },
      {
        "text": "for summary judgment on Eleventh Amendment grounds as to RICRA.",
        "paragraph_id": "para_55"
      },
      {
        "text": "RIDOC argues that the district court erred in holding that",
        "paragraph_id": "para_56"
      },
      {
        "text": "violations of civil rights under RICRA are subject to the general",
        "paragraph_id": "para_57"
      },
      {
        "text": "waiver of Eleventh Amendment immunity under Rhode Island's Tort",
        "paragraph_id": "para_58"
      },
      {
        "text": "Claims Act.1 Parente and Stewart respond that the Rhode Island",
        "paragraph_id": "para_59"
      },
      {
        "text": "Supreme Court's decision in Laird v. Chrysler Corp., 460 A.2d 425",
        "paragraph_id": "para_60"
      },
      {
        "text": "(R.I. 1983), establishes that RICRA claims must be subject to this",
        "paragraph_id": "para_61"
      },
      {
        "text": "general waiver. In evaluating the Eleventh Amendment question",
        "paragraph_id": "para_62"
      },
      {
        "text": "posed by this appeal, we conclude that there is \"special reason\"",
        "paragraph_id": "para_63"
      },
      {
        "text": "to certify the underlying state-law issue to the Rhode Island",
        "paragraph_id": "para_64"
      },
      {
        "text": "Supreme Court. Figueroa-Rodriguez v. Aquino, 863 F.2d 1037, 1045",
        "paragraph_id": "para_65"
      },
      {
        "text": "(1st Cir. 1988) (\"[I]f the [federal] court felt there was special",
        "paragraph_id": "para_66"
      },
      {
        "text": "reason to do so, it could certify the [state-law] issue to the",
        "paragraph_id": "para_67"
      },
      {
        "text": "[relevant state supreme court], whose finding of waiver, if made,",
        "paragraph_id": "para_68"
      },
      {

      {
        "text": "explicit language.\").",
        "paragraph_id": "para_73"
      },
      {
        "text": "I. BACKGROUND",
        "paragraph_id": "para_74"
      },
      {
        "text": "We begin by recounting the facts and procedural history",
        "paragraph_id": "para_75"
      },
      {
        "text": "of the case. A lengthy summary of the facts is unnecessary for",
        "paragraph_id": "para_76"
      },
      {
        "text": "this opinion. Instead, we opt to briefly recite only those facts",
        "paragraph_id": "para_77"
      },
      {
        "text": "necessary to understand the parties' arguments. For greater",
        "paragraph_id": "para_78"
      },
      {
        "text": "detail, consult Parente v. Wall, 708 F. Supp. 3d 192, 197-99",
        "paragraph_id": "para_79"
      },
      {
        "text": "(D.R.I. 2023).",
        "paragraph_id": "para_80"
      },
      {
        "text": "A. Parente and Stewart's Allegations",
        "paragraph_id": "para_81"
      },
      {
        "text": "Parente and Stewart entered RIDOC's custody with",
        "paragraph_id": "para_82"
      },
      {
        "text": "preexisting injuries.2 Parente injured his ankles while attempting",
        "paragraph_id": "para_83"
      },
      {
        "text": "to evade arrest. After several visits to non-RIDOC hospitals",
        "paragraph_id": "para_84"
      },
      {
        "text": "following his arrest, medical staff diagnosed Parente with a",
        "paragraph_id": "para_85"
      },
      {
        "text": "calcaneal fracture of his right foot and ankle and additional",
        "paragraph_id": "para_86"
      },
      {
        "text": "fractures in his left heel and ankle. Parente's hospital discharge",
        "paragraph_id": "para_87"
      },
      {
        "text": "papers recommended, among other things, that he use a carter pillow",
        "paragraph_id": "para_88"
      },
      {
        "text": "to elevate his feet, ice his injuries, use a trauma chair with arm",
        "paragraph_id": "para_89"
      },
      {
        "text": "rails, and take medication to manage his pain and to prevent blood",
        "paragraph_id": "para_90"
      },
      {
        "text": "clots. Stewart, on the other hand, entered custody having already",
        "paragraph_id": "para_91"
      },
      {
        "text": "sprained his ankle about a month before his arrest. His treating",
        "paragraph_id": "para_92"
      },
      {

        "text": "had long histories of psychiatric conditions.",
        "paragraph_id": "para_94"
      },
      {

      },
      {
        "text": "physicians at a non-RIDOC hospital advised him to use crutches, to",
        "paragraph_id": "para_96"
      },
      {
        "text": "keep his leg elevated, to apply ice on his ankle, and to use",
        "paragraph_id": "para_97"
      },
      {
        "text": "medication to manage his pain.",
        "paragraph_id": "para_98"
      },
      {
        "text": "Parente and Stewart sued RIDOC on February 10, 2016,",
        "paragraph_id": "para_99"
      },
      {
        "text": "alleging various federal and state constitutional, statutory, and",
        "paragraph_id": "para_100"
      },
      {
        "text": "common law bases for relief. They amended that complaint for the",
        "paragraph_id": "para_101"
      },
      {
        "text": "second time on June 22, 2020. Generally, they claimed that RIDOC's",
        "paragraph_id": "para_102"
      },
      {
        "text": "medical and correctional staff failed to meet their medical needs.",
        "paragraph_id": "para_103"
      },
      {
        "text": "Because of the limited nature of this appeal and our decision, we",
        "paragraph_id": "para_104"
      },
      {
        "text": "discuss only Count II of their Second Amended Complaint -- the",
        "paragraph_id": "para_105"
      },
      {
        "text": "claims under RICRA, R.I. Gen. Laws § 42-112-1 to -2. Specifically,",
        "paragraph_id": "para_106"
      },
      {
        "text": "Parente and Stewart allege that RIDOC's corrections and medical",
        "paragraph_id": "para_107"
      },
      {
        "text": "staff \"discriminated against\" them and caused them to \"suffer harm\"",
        "paragraph_id": "para_108"
      },
      {
        "text": "by \"depriv[ing] them of their rights under RICRA,\" including their",
        "paragraph_id": "para_109"
      },
      {
        "text": "\"rights to reasonable accommodations.\" In its answer, RIDOC denied",
        "paragraph_id": "para_110"
      },
      {
        "text": "the allegations contained in Count II and asserted that it was",
        "paragraph_id": "para_111"
      },
      {
        "text": "immune from liability under RICRA, pursuant to the Eleventh",
        "paragraph_id": "para_112"
      },
      {
        "text": "Amendment to the United States Constitution.",
        "paragraph_id": "para_113"
      },
      {
        "text": "B. District Court Proceedings",
        "paragraph_id": "para_114"
      },
      {
        "text": "On February 23, 2023, the parties filed cross motions",
        "paragraph_id": "para_115"
      },
      {
        "text": "for summary judgment. With respect to Count II, RIDOC pressed its",
        "paragraph_id": "para_116"
      },
      {
        "text": "sovereign immunity argument. But the district court disagreed",
        "paragraph_id": "para_117"
      },
      {
        "text": "with RIDOC's assessment. In denying RIDOC's motion, the district",
        "paragraph_id": "para_118"
      },
      {
        "text": "court reasoned that Rhode Island had adopted a general waiver of",
        "paragraph_id": "para_119"
      },
      {
        "text": "- 6 -",
        "paragraph_id": "para_120"
      },
      {
        "text": "its sovereign immunity for \"all actions of tort\" through the",
        "paragraph_id": "para_121"
      },
      {
        "text": "enactment of the State Tort Claims Act. Parente, 708 F. Supp. 3d",
        "paragraph_id": "para_122"
      },
      {
        "text": "at 211 (emphasis added) (quoting Laird, 460 A.2d at 427). The",
        "paragraph_id": "para_123"
      },
      {
        "text": "district court analogized an action for damages under RICRA to an",
        "paragraph_id": "para_124"
      },
      {
        "text": "action for damages under the since-amended Civil Rights Act of",
        "paragraph_id": "para_125"
      },
      {
        "text": "1968, which \"sound[ed] basically in tort,\" and determined that",
        "paragraph_id": "para_126"
      },
      {
        "text": "RICRA was thus not subject to Eleventh Amendment immunity. Id.",
        "paragraph_id": "para_127"
      },
      {
        "text": "(quoting Curtis v. Loether, 415 U.S. 189, 195 (1974)); see also 42",
        "paragraph_id": "para_128"
      },
      {
        "text": "U.S.C. § 3612 (1974), repealed and amended by Fair Housing",
        "paragraph_id": "para_129"
      },
      {
        "text": "Amendments Act of 1988, Pub. L. No. 100-430, § 8(2), 102 Stat.",
        "paragraph_id": "para_130"
      },
      {
        "text": "1619, 1625. Accordingly, the district court concluded that the",
        "paragraph_id": "para_131"
      },
      {
        "text": "general waiver enacted under the State Tort Claims Act also applied",
        "paragraph_id": "para_132"
      },
      {
        "text": "to actions under RICRA. Parente, 708 F. Supp. 3d at 212.",
        "paragraph_id": "para_133"
      },
      {
        "text": "The district court further explained that the Rhode",
        "paragraph_id": "para_134"
      },
      {
        "text": "Island Supreme Court held in Pellegrino v. Rhode Island Ethics",
        "paragraph_id": "para_135"
      },
      {
        "text": "Commission, 788 A.2d 1119, 1123-24 (R.I. 2002), that \"a waiver of",
        "paragraph_id": "para_136"
      },
      {
        "text": "sovereign immunity may be implicit and need not be express in the",
        "paragraph_id": "para_137"
      },
      {
        "text": "statute that gives rise to the cause of action.\" Parente, 708 F.",
        "paragraph_id": "para_138"
      },
      {
        "text": "Supp. 3d at 211. Therefore, the district court reasoned, the",
        "paragraph_id": "para_139"
      },
      {
        "text": "critical question here was \"whether discrimination actions [under",
        "paragraph_id": "para_140"
      },
      {
        "text": "RICRA] sound in tort.\" Id. The district court, relying on",
        "paragraph_id": "para_141"
      },
      {
        "text": "precedent from various federal and state cases,3 answered that",
        "paragraph_id": "para_142"
      },
      {

        "text": "question in the affirmative, holding that \"Rhode Island's general",
        "paragraph_id": "para_146"
      },
      {
        "text": "waiver of sovereign immunity statute requires us to find that",
        "paragraph_id": "para_147"
      },
      {
        "text": "immunity has been waived.\" Parente, 708 F. Supp. 3d at 212.",
        "paragraph_id": "para_148"
      },
      {
        "text": "RIDOC timely appealed that decision. We have",
        "paragraph_id": "para_149"
      },
      {
        "text": "jurisdiction under the collateral order doctrine to review the",
        "paragraph_id": "para_150"
      },
      {
        "text": "district court's decision to deny RIDOC immunity under the Eleventh",
        "paragraph_id": "para_151"
      },
      {
        "text": "Amendment. Nieves-Marquez v. Puerto Rico, 353 F.3d 108, 122-23",
        "paragraph_id": "para_152"
      },
      {
        "text": "(1st Cir. 2003) (citing P.R. Aqueduct & Sewer Auth. v. Metcalf &",
        "paragraph_id": "para_153"
      },
      {
        "text": "Eddy, Inc., 506 U.S. 139, 147 (1993)).",
        "paragraph_id": "para_154"
      },
      {
        "text": "II. DISCUSSION",
        "paragraph_id": "para_155"
      },
      {
        "text": "A. Sovereign Immunity and the State Tort Claims Act",
        "paragraph_id": "para_156"
      },
      {
        "text": "\"The Eleventh Amendment generally bars suits against",
        "paragraph_id": "para_157"
      },
      {
        "text": "states and state officials\" in federal court. Doe v. Shibinette,",
        "paragraph_id": "para_158"
      },
      {
        "text": "16 F.4th 894, 903 (1st Cir. 2021) (citing Ex parte Young, 209 U.S.",
        "paragraph_id": "para_159"
      },
      {
        "text": "123 (1908)). States \"may waive [their] eleventh amendment immunity",
        "paragraph_id": "para_160"
      },
      {
        "text": "to suit.\" Della Grotta v. Rhode Island, 781 F.2d 343, 346 (1st",
        "paragraph_id": "para_161"
      },
      {
        "text": "Cir. 1986) (citations omitted), abrogated on other grounds by Will",
        "paragraph_id": "para_162"
      },
      {
        "text": "v. Mich. Dep't of State Police, 491 U.S. 58 (1989). The question",
        "paragraph_id": "para_163"
      },
      {
        "text": "of whether the state has waived sovereign immunity against suit in",
        "paragraph_id": "para_164"
      },
      {
        "text": "Autozone, Inc., 361 F.3d 62, 67, 70 (1st Cir. 2004); Acevedo Lopez",
        "paragraph_id": "para_165"
      },
      {
        "text": "v. Police Dep't of P.R., 247 F.3d 26, 29 (1st Cir. 2001); Milton",
        "paragraph_id": "para_166"
      },
      {
        "text": "v. Scrivner, Inc., 53 F.3d 1118, 1120-21 (10th Cir. 1995); Mancuso",
        "paragraph_id": "para_167"
      },
      {
        "text": "v. Douglas Elliman LLC, 808 F. Supp. 2d 606, 632 (S.D.N.Y. 2011);",
        "paragraph_id": "para_168"
      },
      {
        "text": "McMillan v. Lincoln Fed. Sav. Loan Ass'n, 678 F. Supp. 89, 92",
        "paragraph_id": "para_169"
      },
      {
        "text": "(D.N.J. 1988); Marrapese v. Rhode Island, 500 F. Supp. 1207,",
        "paragraph_id": "para_170"
      },
      {
        "text": "1221-22 (D.R.I. 1980); Pellegrino, 788 A.2d at 1123-24; and Laird,",
        "paragraph_id": "para_171"
      },
      {
        "text": "460 A.2d at 427-28, 430.",
        "paragraph_id": "para_172"
      },
      {
        "text": "- 8 -",
        "paragraph_id": "para_173"
      },
      {
        "text": "federal court is one of federal law. When evaluating whether a",
        "paragraph_id": "para_174"
      },
      {
        "text": "statute includes such a waiver, this court \"will find waiver only",
        "paragraph_id": "para_175"
      },
      {
        "text": "where stated 'by the most express language or by such overwhelming",
        "paragraph_id": "para_176"
      },
      {
        "text": "implications from the text as [will] leave no room for any other",
        "paragraph_id": "para_177"
      },
      {
        "text": "reasonable construction.'\" Davidson v. Howe, 749 F.3d 21, 28 (1st",
        "paragraph_id": "para_178"
      },
      {
        "text": "Cir. 2014) (alteration in original) (first quoting Edelman v.",
        "paragraph_id": "para_179"
      },
      {
        "text": "Jordan, 415 U.S. 651, 673 (1974); then quoting Murray v. Wilson",
        "paragraph_id": "para_180"
      },
      {
        "text": "Distilling Co., 213 U.S. 151, 171 (1909)). We can also find a",
        "paragraph_id": "para_181"
      },
      {
        "text": "waiver of Eleventh Amendment immunity as a matter of federal law",
        "paragraph_id": "para_182"
      },
      {
        "text": "if a state's highest court has expressly held that the state",
        "paragraph_id": "para_183"
      },
      {
        "text": "statute at issue includes such a waiver. See Della Grotta, 781",
        "paragraph_id": "para_184"
      },
      {
        "text": "F.2d at 347 (explaining that the rule \"that waiver may not be",
        "paragraph_id": "para_185"
      },
      {
        "text": "inferred from a less than explicit statute\" was \"designed to",
        "paragraph_id": "para_186"
      },
      {
        "text": "protect a state from a federal court's ill-founded, possibly",
        "paragraph_id": "para_187"
      },
      {
        "text": "mistaken, view of what its state legislature really intended\").",
        "paragraph_id": "para_188"
      },
      {
        "text": "The State Tort Claims Act, R.I. Gen. Laws § 9-31-1(a),",
        "paragraph_id": "para_189"
      },
      {
        "text": "provides that Rhode Island is \"liable in all actions of tort in",
        "paragraph_id": "para_190"
      },
      {
        "text": "the same manner as a private individual or corporation\" (emphasis",
        "paragraph_id": "para_191"
      },
      {
        "text": "added). In Laird, the Rhode Island Supreme Court interpreted the",
        "paragraph_id": "para_192"
      },
      {
        "text": "State Tort Claims Act to contain \"sweeping language abrogating the",
        "paragraph_id": "para_193"
      },
      {
        "text": "sovereign immunity of the state as well as all other political",
        "paragraph_id": "para_194"
      },
      {
        "text": "subdivisions in Rhode Island,\" including for suits in federal",
        "paragraph_id": "para_195"
      },
      {
        "text": "court. 460 A.2d at 428. RICRA, on the other hand, protects",
        "paragraph_id": "para_196"
      },
      {
        "text": "individuals from discrimination. R.I. Gen. Laws § 42-112-1 to -2.",
        "paragraph_id": "para_197"
      },
      {
        "text": "- 9 -",
        "paragraph_id": "para_198"
      },
      {
        "text": "Section 42-112-1(a) provides, in relevant part, that \"[a]ll",
        "paragraph_id": "para_199"
      },
      {
        "text": "persons within the state, regardless of race, color, religion,",
        "paragraph_id": "para_200"
      },
      {
        "text": "sex, disability, age, or country of ancestral origin,",
        "paragraph_id": "para_201"
      },
      {
        "text": "have . . . the same rights . . . to the full and equal benefit of",
        "paragraph_id": "para_202"
      },
      {
        "text": "all laws and proceedings for the security of persons and property.\"",
        "paragraph_id": "para_203"
      },
      {
        "text": "RICRA does not expressly state whether the state is immune from",
        "paragraph_id": "para_204"
      },
      {
        "text": "suit.",
        "paragraph_id": "para_205"
      },
      {
        "text": "RIDOC argues that the district court erred by broadening",
        "paragraph_id": "para_206"
      },
      {
        "text": "that waiver of the state's Eleventh Amendment immunity from suit",
        "paragraph_id": "para_207"
      },
      {
        "text": "to include cases brought under RICRA. RIDOC rests its argument on",
        "paragraph_id": "para_208"
      },
      {
        "text": "the stringent test articulated by the U.S. Supreme Court in",
        "paragraph_id": "para_209"
      },
      {
        "text": "Edelman, which is that a state's waiver of sovereign immunity must",
        "paragraph_id": "para_210"
      },
      {
        "text": "be presented in \"the most express language or by such overwhelming",
        "paragraph_id": "para_211"
      },
      {
        "text": "implications from the text as [will] leave no room for any other",
        "paragraph_id": "para_212"
      },
      {
        "text": "reasonable construction.\" 415 U.S. at 673 (internal quotation",
        "paragraph_id": "para_213"
      },
      {
        "text": "marks and citation omitted). Since RICRA neither expressly",
        "paragraph_id": "para_214"
      },
      {
        "text": "mentions waiving sovereign immunity nor implicitly suggests it",
        "paragraph_id": "para_215"
      },
      {
        "text": "through such an \"overwhelming implication[],\" id., RIDOC argues",
        "paragraph_id": "para_216"
      },
      {
        "text": "that the district court erred in interpreting the State Tort Claims",
        "paragraph_id": "para_217"
      },
      {
        "text": "Act to have waived Eleventh Amendment immunity over claims based",
        "paragraph_id": "para_218"
      },
      {
        "text": "on RICRA.",
        "paragraph_id": "para_219"
      },
      {
        "text": "B. Certification",
        "paragraph_id": "para_220"
      },
      {
        "text": "This court typically reviews de novo a district court's",
        "paragraph_id": "para_221"
      },
      {
        "text": "denial of an Eleventh Amendment immunity-based motion for summary",
        "paragraph_id": "para_222"
      },
      {
        "text": "- 10 -",
        "paragraph_id": "para_223"
      },
      {
        "text": "judgment. Fresenius Med. Care Cardiovascular Res., Inc. v. P.R.",
        "paragraph_id": "para_224"
      },
      {
        "text": "& the Caribbean Cardiovascular Ctr. Corp., 322 F.3d 56, 60 (1st",
        "paragraph_id": "para_225"
      },
      {
        "text": "Cir. 2003) (citing Arecibo Cmty. Health Care, Inc. v. Puerto Rico,",
        "paragraph_id": "para_226"
      },
      {
        "text": "270 F.3d 17, 22 (1st Cir. 2001)). For Rhode Island to have waived",
        "paragraph_id": "para_227"
      },
      {
        "text": "its sovereign immunity for civil rights claims under RICRA, those",
        "paragraph_id": "para_228"
      },
      {
        "text": "claims need to be considered \"actions of tort\" under the State",
        "paragraph_id": "para_229"
      },
      {
        "text": "Tort Claims Act. R.I. Gen. Laws § 9-31-1(a).",
        "paragraph_id": "para_230"
      },
      {
        "text": "As we noted above, whether a state has waived Eleventh",
        "paragraph_id": "para_231"
      },
      {
        "text": "Amendment immunity is a question of federal constitutional law.",
        "paragraph_id": "para_232"
      },
      {
        "text": "See Edelman, 415 U.S. at 673. Ordinarily, \"we will not consider",
        "paragraph_id": "para_233"
      },
      {
        "text": "a State to have waived its sovereign immunity\" where \"a statute is",
        "paragraph_id": "para_234"
      },
      {
        "text": "susceptible of multiple plausible interpretations.\" Sossamon v.",
        "paragraph_id": "para_235"
      },
      {
        "text": "Texas, 563 U.S. 277, 288 (2011) (holding that a state's acceptance",
        "paragraph_id": "para_236"
      },
      {
        "text": "of federal funds pursuant to the ambiguous terms of a federal",
        "paragraph_id": "para_237"
      },
      {
        "text": "statute did not constitute waiver). And in most cases,",
        "paragraph_id": "para_238"
      },
      {
        "text": "certification to a state's highest court is not the appropriate",
        "paragraph_id": "para_239"
      },
      {
        "text": "remedy. See Micomonaco v. Washington, 45 F.3d 316, 322 (9th Cir.",
        "paragraph_id": "para_240"
      },
      {
        "text": "1995) (resolving, rather than certifying, the question of whether",
        "paragraph_id": "para_241"
      },
      {
        "text": "a Washington statute waived Eleventh Amendment immunity); see also",
        "paragraph_id": "para_242"
      },
      {

      },
      {
        "text": "to interpret state law while deciding the ultimate federal question",
        "paragraph_id": "para_249"
      },
      {
        "text": "at issue: whether a state has waived Eleventh Amendment immunity.",
        "paragraph_id": "para_250"
      },
      {
        "text": "See Atascadero State Hosp. v. Scanlon, 473 U.S. 234, 241 (1985)",
        "paragraph_id": "para_251"
      },
      {
        "text": "(reading a California constitutional provision not to waive",
        "paragraph_id": "para_252"
      },
      {
        "text": "sovereign immunity but only to authorize the state legislature's",
        "paragraph_id": "para_253"
      },
      {
        "text": "waiver of sovereign immunity and therefore declining to find",
        "paragraph_id": "para_254"
      },
      {
        "text": "waiver). Accordingly, we have held that where there is \"special",
        "paragraph_id": "para_255"
      },
      {
        "text": "reason to do so,\" a federal court grappling with an underlying",
        "paragraph_id": "para_256"
      },
      {
        "text": "state-law issue while interpreting a state statute may \"certify",
        "paragraph_id": "para_257"
      },
      {
        "text": "the issue to\" the relevant state supreme court, \"whose finding of",
        "paragraph_id": "para_258"
      },
      {
        "text": "waiver, if made, would be binding . . . notwithstanding the",
        "paragraph_id": "para_259"
      },
      {
        "text": "statute's lack of explicit language.\" Figueroa-Rodriguez, 863",
        "paragraph_id": "para_260"
      },
      {
        "text": "F.2d at 1045.",
        "paragraph_id": "para_261"
      },
      {
        "text": "Here, we are presented with one such special reason to",
        "paragraph_id": "para_262"
      },
      {
        "text": "certify. The parties' dispute focuses on the scope of Laird, a",
        "paragraph_id": "para_263"
      },
      {
        "text": "Rhode Island Supreme Court decision. In particular, counsel for",
        "paragraph_id": "para_264"
      },
      {
        "text": "Parente and Stewart contended at oral argument that Laird alone",
        "paragraph_id": "para_265"
      },
      {
        "text": "establishes waiver in this case. She pointed to Laird's",
        "paragraph_id": "para_266"
      },
      {
        "text": "interpretation of the State Tort Claims Act as reflecting \"a",
        "paragraph_id": "para_267"
      },
      {
        "text": "legislative intent to place the state in the same position as any",
        "paragraph_id": "para_268"
      },
      {
        "text": "other private litigant and thus amenable to suit in either state",
        "paragraph_id": "para_269"
      },
      {
        "text": "or federal court,\" and Laird's reasoning that \"in order to have an",
        "paragraph_id": "para_270"
      },
      {
        "text": "actionable claim against the state, just as with a private",
        "paragraph_id": "para_271"
      },
      {
        "text": "defendant, a plaintiff must show that there was a breach of a duty",
        "paragraph_id": "para_272"
      },
      {
        "text": "- 12 -",
        "paragraph_id": "para_273"
      },
      {
        "text": "owed to him or her in an individual capacity and not merely a",
        "paragraph_id": "para_274"
      },
      {
        "text": "breach of some obligation owed to the general public.\" 460 A.2d",
        "paragraph_id": "para_275"
      },
      {
        "text": "at 429-30 (citing Ryan v. State Dep't of Transp., 420 A.2d 841,",
        "paragraph_id": "para_276"
      },
      {
        "text": "843 (R.I. 1980)). Counsel for Parente and Stewart therefore frames",
        "paragraph_id": "para_277"
      },
      {
        "text": "the issue as one requiring us to interpret a potential ambiguity",
        "paragraph_id": "para_278"
      },
      {
        "text": "in Laird itself. In these circumstances, we choose to exercise",
        "paragraph_id": "para_279"
      },
      {
        "text": "our discretion to certify the state-law question below to the Rhode",
        "paragraph_id": "para_280"
      },
      {
        "text": "Island Supreme Court. In so doing, we reserve for a later date",
        "paragraph_id": "para_281"
      },
      {
        "text": "the federal constitutional question of whether state law, as",
        "paragraph_id": "para_282"
      },
      {
        "text": "interpreted by the Rhode Island Supreme Court, waives immunity \"by",
        "paragraph_id": "para_283"
      },
      {
        "text": "the most express language or by such overwhelming implications",
        "paragraph_id": "para_284"
      },
      {
        "text": "from the text as [will] leave no room for any other reasonable",
        "paragraph_id": "para_285"
      },
      {
        "text": "construction.\" Edelman, 415 U.S. at 673 (internal quotation marks",
        "paragraph_id": "para_286"
      },
      {
        "text": "and citation omitted).",
        "paragraph_id": "para_287"
      },
      {
        "text": "The Rhode Island Supreme Court \"may answer questions of",
        "paragraph_id": "para_288"
      },
      {
        "text": "law certified to it\" if the state-law question \"may be",
        "paragraph_id": "para_289"
      },
      {
        "text": "determinative of the cause then pending in the certifying court\"",
        "paragraph_id": "para_290"
      },
      {
        "text": "and \"it appears to the certifying court there is no controlling",
        "paragraph_id": "para_291"
      },
      {
        "text": "precedent in the decisions of the Supreme Court.\" R.I. Sup. Ct.",
        "paragraph_id": "para_292"
      },
      {
        "text": "R. 6. The conditions necessary for certification, in our view,",
        "paragraph_id": "para_293"
      },
      {
        "text": "are satisfied here.",
        "paragraph_id": "para_294"
      },
      {
        "text": "We begin by considering how the question we certify may",
        "paragraph_id": "para_295"
      },
      {
        "text": "be determinative of the issue before us. As mentioned, the State",
        "paragraph_id": "para_296"
      },
      {
        "text": "Tort Claims Act waived Eleventh Amendment immunity for \"all actions",
        "paragraph_id": "para_297"
      },
      {
        "text": "- 13 -",
        "paragraph_id": "para_298"
      },
      {
        "text": "of tort.\" R.I. Gen. Laws §9-31-1(a) (emphasis added). The Rhode",
        "paragraph_id": "para_299"
      },
      {
        "text": "Island Supreme Court in Laird held that the Rhode Island",
        "paragraph_id": "para_300"
      },
      {
        "text": "legislature, by enacting this provision, intended \"to place the",
        "paragraph_id": "para_301"
      },
      {
        "text": "state in the same position as any other private litigant and thus",
        "paragraph_id": "para_302"
      },
      {
        "text": "amenable to suit in either state or federal court.\" 460 A.2d at",
        "paragraph_id": "para_303"
      },
      {
        "text": "430. But Parente and Stewart do not bring claims under the State",
        "paragraph_id": "para_304"
      },
      {
        "text": "Tort Claims Act. Rather, their claims hinge on alleged violations",
        "paragraph_id": "para_305"
      },
      {
        "text": "of their rights under RICRA -- a separate statute that is silent",
        "paragraph_id": "para_306"
      },
      {
        "text": "as to immunity. R.I. Gen. Laws § 42-112-1 to -2. Thus, a",
        "paragraph_id": "para_307"
      },
      {
        "text": "subsidiary state-law question in this appeal is whether claims",
        "paragraph_id": "para_308"
      },
      {
        "text": "under RICRA are \"actions of tort\" under the State Tort Claims Act.",
        "paragraph_id": "para_309"
      },
      {
        "text": "If they are not, then the Eleventh Amendment would bar their RICRA",
        "paragraph_id": "para_310"
      },
      {
        "text": "claims. And as noted above, we have held that a state's highest",
        "paragraph_id": "para_311"
      },
      {
        "text": "court can speak with finality on whether a state statute was",
        "paragraph_id": "para_312"
      },
      {
        "text": "intended to waive the state's Eleventh Amendment immunity. Della",
        "paragraph_id": "para_313"
      },
      {
        "text": "Grotta, 781 F.2d at 347. Therefore, an answer from the Rhode",
        "paragraph_id": "para_314"
      },
      {
        "text": "Island Supreme Court on this open question of state law may be",
        "paragraph_id": "para_315"
      },
      {
        "text": "outcome-determinative.",
        "paragraph_id": "para_316"
      },
      {
        "text": "Having concluded that the answer to the certified",
        "paragraph_id": "para_317"
      },
      {
        "text": "question may be determinative of the issue before us, we next",
        "paragraph_id": "para_318"
      },
      {
        "text": "address the lack of dispositive state court precedent. The Rhode",
        "paragraph_id": "para_319"
      },
      {
        "text": "Island Supreme Court has not addressed whether RICRA claims are",
        "paragraph_id": "para_320"
      },
      {
        "text": "covered by the general waiver of sovereign immunity under the State",
        "paragraph_id": "para_321"
      },
      {
        "text": "Tort Claims Act.",
        "paragraph_id": "para_322"
      },
      {
        "text": "- 14 -",
        "paragraph_id": "para_323"
      },
      {
        "text": "The district court relied on Pellegrino, 788 A.2d 1119,",
        "paragraph_id": "para_324"
      },
      {
        "text": "in which the Rhode Island Supreme Court held that the state had",
        "paragraph_id": "para_325"
      },
      {
        "text": "waived its sovereign immunity in suits brought by former members",
        "paragraph_id": "para_326"
      },
      {
        "text": "of the Rhode Island Ethics Commission in state court. The Court",
        "paragraph_id": "para_327"
      },
      {
        "text": "found waiver \"by necessary implication from the very statutory",
        "paragraph_id": "para_328"
      },
      {
        "text": "terms that provided for specific compensation\" to be paid to the",
        "paragraph_id": "para_329"
      },
      {
        "text": "plaintiffs for attending commission meetings. Id. at 1123-24.",
        "paragraph_id": "para_330"
      },
      {
        "text": "But unlike the plaintiffs in Pellegrino, Parente and Stewart do",
        "paragraph_id": "para_331"
      },
      {
        "text": "not suggest that the text of the statute at issue (here, RICRA)",
        "paragraph_id": "para_332"
      },
      {
        "text": "necessarily implies a waiver. Instead, they rely on the express",
        "paragraph_id": "para_333"
      },
      {
        "text": "waiver in the State Tort Claims Act. The more precise question is",
        "paragraph_id": "para_334"
      },
      {
        "text": "whether the text of the State Tort Claims Act, properly construed,",
        "paragraph_id": "para_335"
      },
      {
        "text": "includes waiver of immunity over RICRA claims. Pellegrino is",
        "paragraph_id": "para_336"
      },
      {
        "text": "therefore inapplicable here.4",
        "paragraph_id": "para_337"
      },
      {
        "text": "The district court's reliance on the U.S. Supreme",
        "paragraph_id": "para_338"
      },
      {
        "text": "Court's decision in Loether was similarly misplaced. In Loether,",
        "paragraph_id": "para_339"
      },
      {
        "text": "the Court held that a private enforcement action arising under the",
        "paragraph_id": "para_340"
      },
      {
        "text": "Civil Rights Act for money damages \"sound[ed] basically in tort\"",
        "paragraph_id": "para_341"
      },
      {
        "text": "4 Further, Pellegrino concerned waiver of Rhode Island's",
        "paragraph_id": "para_342"
      },
      {
        "text": "sovereign immunity in state, not federal, court. To the extent",
        "paragraph_id": "para_343"
      },
      {
        "text": "that the district court suggested that Pellegrino's holding was in",
        "paragraph_id": "para_344"
      },
      {
        "text": "tension with our holding in Acevedo Lopez, 247 F.3d at 29, we",
        "paragraph_id": "para_345"
      },
      {
        "text": "disagree. Both cases acknowledge that immunity may be waived by",
        "paragraph_id": "para_346"
      },
      {
        "text": "necessary implication from statutory text. See Pellegrino, 788",
        "paragraph_id": "para_347"
      },
      {
        "text": "A.2d at 1223 (phrasing it as \"necessary implication\"); Acevedo",
        "paragraph_id": "para_348"
      },
      {
        "text": "Lopez, 247 F.3d at 28 (phrasing it as \"overwhelming implication[]\"",
        "paragraph_id": "para_349"
      },
      {
        "text": "precluding \"any other reasonable construction\" (quoting Edelman,",
        "paragraph_id": "para_350"
      },
      {
        "text": "415 U.S. at 673)).",
        "paragraph_id": "para_351"
      },
      {
        "text": "- 15 -",
        "paragraph_id": "para_352"
      },
      {
        "text": "and, in turn, was an action \"to enforce legal rights\" triggering",
        "paragraph_id": "para_353"
      },
      {
        "text": "the Seventh Amendment's jury-trial guarantee. 415 U.S. at 196-97.",
        "paragraph_id": "para_354"
      },
      {
        "text": "RICRA, on the other hand, authorizes both money damages and",
        "paragraph_id": "para_355"
      },
      {
        "text": "\"injunctive and other appropriate equitable relief.\" R.I. Gen.",
        "paragraph_id": "para_356"
      },
      {
        "text": "Laws § 42-112-2 (2024). Hence, the statute at issue in Loether is",
        "paragraph_id": "para_357"
      },
      {
        "text": "not fully analogous here, where Parente and Stewart request damages",
        "paragraph_id": "para_358"
      },
      {
        "text": "and injunctive relief on the basis of RICRA. And in any event,",
        "paragraph_id": "para_359"
      },
      {
        "text": "whether RICRA is an \"action[] of tort\" is a question of Rhode",
        "paragraph_id": "para_360"
      },
      {
        "text": "Island law, so any reasoning as to analogous federal laws might be",
        "paragraph_id": "para_361"
      },
      {
        "text": "persuasive but not binding. W. Rsrv. Life Assur. Co. v. ADM",
        "paragraph_id": "para_362"
      },
      {
        "text": "Assocs., LLC, 737 F.3d 135, 136 (1st Cir. 2013) (\"[T]he Rhode",
        "paragraph_id": "para_363"
      },
      {
        "text": "Island Supreme Court is the ultimate arbiter of matters of Rhode",
        "paragraph_id": "para_364"
      },
      {
        "text": "Island law . . . .\").",
        "paragraph_id": "para_365"
      },
      {
        "text": "For these reasons, we conclude that it is an open",
        "paragraph_id": "para_366"
      },
      {
        "text": "question under Rhode Island law whether discrimination claims",
        "paragraph_id": "para_367"
      },
      {
        "text": "under RICRA are covered by the waiver of sovereign immunity",
        "paragraph_id": "para_368"
      },
      {
        "text": "articulated in the State Tort Claims Act.",
        "paragraph_id": "para_369"
      },
      {
        "text": "III. CONCLUSION",
        "paragraph_id": "para_370"
      },
      {
        "text": "In light of the foregoing, we certify the following",
        "paragraph_id": "para_371"
      },
      {
        "text": "question to the Rhode Island Supreme Court:",
        "paragraph_id": "para_372"
      },
      {
        "text": "1. Whether discrimination claims under the Rhode Island",
        "paragraph_id": "para_373"
      },
      {
        "text": "Civil Rights Act of 1990, R.I. Gen. Laws § 42-112-1 to -2, are",
        "paragraph_id": "para_374"
      },
      {
        "text": "\"actions of tort\" under the State Tort Claims Act, R.I. Gen. Laws",
        "paragraph_id": "para_375"
      },
      {
