Avskrivningsbeslutet får i stället anses vara att jämställa med ett beslut om avskrivning på grund av återkallelse (se Bostadsdomstolens refererade avgörande RBD 38:76). Ett sådant beslut får överklagas (se 23 § tredje stycket 2 jämförd med 8 § sjätte stycket lagen om arrendenämnder och hyresnämnder). T.A. får anses ha överklagat beslutet i rätt tid (jfr NJA 1982 s. 823).
