Han har hållit sina fingrar i flickans slida under en icke obetydlig tid. M har flera gånger sagt till D att sluta med sitt beteende. Denne har avbrutit sitt handlande först sedan hon knuffat bort hans hand. Den handling som D har utfört framstår som klart mer kränkande än den som prövades av Högsta domstolen i NJA 2006 s. 221.
