        "text": "Gärningen: S.J. har under tiden 16 januari - 22 april 2003 uppsåtligen eller av grov oaktsamhet genom vanvård bestående i bristande utfodring, tillsyn och rengöring otillbörligen utsatt fyra kor för lidande. - S.J. anförde till sitt försvar bl.a. att en rörledning till en gödselbrunn hade frusit igen, vilket hade gjort att han fick problem med renhållningen.",

        "text": "Enligt tingsrätten hade korna av grov oaktsamhet utsatts för otillbörligt lidande under tre veckor och dömde S.J. för djurplågeri till villkorlig dom och 80 dagsböter. I fråga om påföljden anförde tingsrätten: \"Av rättspraxis från hovrätter framgår att påföljden vid allvarligare fall av djurplågeri bestäms till fängelse. Det har dock i dessa fall varit fråga om betydligt flera djur eller allvarligare lidande än det som nu är uppe till bedömning (se RH 1992:9 och 1993:94). I det senaste refererade hovrättsfallet (RH 1999:85) stannade påföljden vid höga böter. Mot bakgrund av denna praxis och med beaktande av de problem som S.J. redovisat anser tingsrätten att ett fängelsestraff inte är påkallat utan att påföljden kan stanna vid villkorlig dom i kombination med ett högt bötesstraff.\"",
