Hovrätten har ändrat\nbeslutet och förordnat en god man för henne.\nÖverförmyndarnämnden i Södertälje kommun har överklagat\nbeslutet och anfört att S.E. inte har någon kognitiv nedsättning och att det\ndärför saknas förutsättningar att anordna godmanskap för henne. Nämnden\nhar också anfört att hon kan få hjälp på annat mindre ingripande sätt och\ndärmed inte har behov av en god man.\nSida 3 (6)\nHÖGSTA DOMSTOLEN BESLUT Ä 6277-25\nDok.Id 371936\nFrågan i Högsta domstolen\nMålet rör förutsättningarna för att förordna en god man på grund av\nsjukdom eller försvagat hälsotillstånd och särskilt frågan om det krävs att\nden enskilde har en nedsatt kognitiv förmåga.\nFörutsättningar för anordnande av godmanskap\nFörutsättningarna för anordnande av godmanskap anges i 11 kap. 4 §\nföräldrabalken. Paragrafen fick en ny lydelse den 1 juli 2026. Enligt\növergångsbestämmelserna ska äldre bestämmelser tillämpas i ärenden som\ninletts dessförinnan (se SFS 2026:490, p. 2). Ändringarna avser dock inte\nde grundläggande förutsättningar som redovisas i det följande (p. 6–9).\nOm någon på grund av sjukdom, psykisk störning, försvagat\nhälsotillstånd eller liknande förhållande behöver hjälp med att bevaka sin\nrätt, förvalta sin egendom eller sörja för sin person ska rätten besluta att\nanordna godmanskap för honom eller henne. Ett sådant beslut får inte\nmeddelas utan samtycke av den för vilken godmanskap ska anordnas, om\ninte den enskildes tillstånd hindrar att hans eller hennes mening inhämtas.\n(Se 11 kap. 4 § första stycket i dess lydelse före den 1 juli 2026.)\nParagrafen ställer upp ett krav på att det ska finnas ett\norsakssamband mellan de uppräknade hälsotillstånden och den enskildes\nbehov av hjälp. Den enskildes tillstånd ska påverka dennes förmåga att fatta\nbeslut på ett sådant sätt att han eller hon har särskilt svårt att sköta sina\njuridiska, ekonomiska eller personliga angelägenheter (se NJA 2018 s. 825\np. 6).\nSida 4 (6)\nHÖGSTA DOMSTOLEN BESLUT Ä 6277-25\nDok.Id 371936\nI rättsfallet ”Godmansförutsättningarna” NJA 2022 s. 623 angavs att\ndetta också kunde beskrivas så att den enskildes kognitiva förmåga ska vara\nnedsatt (se p. 12 i rättsfallet). Uttalandet bör ses mot bakgrund av att målet\nfrämst rörde frågan om språksvårigheter och nedsatt förmåga att läsa och\nskriva på grund av analfabetism kunde anses utgöra ett sådant liknande\nförhållande som avses i 11 kap. 4 §. I avgörandet konstaterades att med\nliknande förhållande avses omständigheter som – utan att nödvändigtvis\nutgöra fysisk eller psykisk ohälsa – påverkar den enskildes kognitiva\nförmåga, till exempel ålder eller vissa slag av missbruk (se p. 13). Då den\nenskildes svårigheter inte ansågs bero på nedsatt kognitiv förmåga fanns det\ninte förutsättningar att förordna en god man. Det saknades således ett\norsakssamband mellan den enskildes hälsotillstånd och behovet av hjälp.\nAv rättsfallet kan alltså inte slutsatsen dras att en förutsättning för att\nen god man ska förordnas är att den enskildes svårigheter beror på en\nkognitiv nedsättning. Vad som ska bedömas är om det finns ett\norsakssamband mellan hälsotillståndet och hjälpbehovet. Om den enskildes\nhälsotillstånd påverkar hans eller hennes förmåga att exempelvis ta initiativ,\nfatta beslut, överblicka konsekvenser eller kommunicera med omvärlden\nföreligger normalt sett ett sådant samband. En annan sak är att godmanskap\ni praktiken främst blir aktuellt när den enskilde har en nedsatt kognitiv\nförmåga.\nEn ytterligare förutsättning för att en god man ska förordnas är att\ndet i rättslig mening behövs.1 I detta ligger att hjälpbehovet måste vara av\nviss betydelse. I fråga om juridiska\noch ekonomiska angelägenheter är alternativet till godmanskap främst att\nden enskilde utfärdar en fullmakt eller på annat sätt uppdrar åt någon att\nsköta hans eller hennes angelägenheter. Detta förutsätter att den enskilde\nhar förmåga att instruera en uppdragstagare och sedan följa upp de åtgärder\nsom vidtas. Saknas det lämpliga personer i den enskildes närhet som kan,\noch är beredda att, ta på sig ett sådant ansvar kan det vägas in vid\nbedömningen av den enskildes behov av god man. Enligt intyget behöver hon hjälp med\nskötseln av sin ekonomi samt kontakter med myndigheter och hälso- och\nsjukvård. Läkare har efter ett kort samtal med henne inte något intryck av\natt hon skulle ha en kognitiv nedsättning.\nDet är tydligt att S.E. har behov av hjälp med att sköta sina juridiska,\nekonomiska och personliga angelägenheter.
