Rapportering av betydande incidenter, NIS2 art. 23
Betydande incidenter rapporteras till CSIRT eller behörig myndighet i steg: tidig varning inom 24 timmar, incidentanmälan inom 72 timmar och slutrapport inom en månad. Mottagare av tjänsterna informeras när det behövs.

Art. 23(1) Notify significant incidents without undue delay (summary)
Entities notify their CSIRT or competent authority without undue delay of any significant incident, and where appropriate notify the recipients of their services of significant incidents likely to adversely affect the provision of those services.

Where applicable, entities communicate to recipients of their services potentially affected by a significant cyber threat any measures or remedies they can take, and where appropriate the threat itself.

Art. 23(3) When an incident is significant (summary)
An incident is significant if it has caused or is capable of causing severe operational disruption of the services or financial loss for the entity, or has affected or is capable of affecting other persons by causing considerable material or non-material damage.

Art. 23(4) Early warning 24 hours, notification 72 hours, final report one month (summary)
Early warning within 24 hours of becoming aware; incident notification within 72 hours of becoming aware; intermediate report on request; final report not later than one month after the incident notification.

Frister

Sanktioner
Väsentliga verksamheter: högsta böter på minst 10 miljoner euro eller 2 procent av global årsomsättning, det högsta beloppet (art. 34.4).
Viktiga verksamheter: minst 7 miljoner euro eller 1,4 procent (art. 34.5).
Väsentliga verksamheter: tillfälligt förbud för person i ledningen att utöva ledningsuppdrag (art. 32.5).

Medelstora och stora verksamheter i sektorerna i bilaga I och II, bland annat energi, transport, hälso- och sjukvård, digital infrastruktur, IT-tjänster, livsmedel och tillverkning. För finansiella företag gäller DORA före NIS2 (art. 4).
