AI-kunnighet och förbjudna AI-metoder, AI-förordningen art. 4–5
Alla som tillhandahåller eller använder AI-system ska se till att personalen har tillräcklig AI-kunnighet. Vissa metoder är helt förbjudna, bland annat social poängsättning, manipulation och känsloigenkänning på arbetsplatsen. Båda gäller sedan 2 februari 2025.
Krav
Art. 4 Sufficient AI literacy of staff
Providers and deployers of AI systems shall take measures to ensure, to their best extent, a sufficient level of AI literacy of their staff and other persons dealing with the operation and use of AI systems on their behalf, taking into account their technical knowledge, experience, education and training and the context the AI systems are to be used in, and considering the persons or groups of persons on whom the AI systems are to be used.
Art. 5(1) Prohibited AI practices (summary)
Prohibited: manipulative or deceptive techniques causing significant harm; exploiting vulnerabilities due to age, disability or social or economic situation; social scoring leading to detrimental treatment; predicting criminal offences based solely on profiling; untargeted scraping of facial images for recognition databases; emotion recognition in workplaces and education except for medical or safety reasons; biometric categorisation inferring sensitive characteristics; real-time remote biometric identification in public spaces for law enforcement, save narrow exceptions.

Frister
- AI-kunnighet och förbudet mot vissa AI-metoder gäller sedan 2 februari 2025 (art. 113).
Sanktioner
Förbjudna AI-metoder: upp till 35 miljoner euro eller 7 procent av global årsomsättning, det högsta beloppet (art. 99.3).
Övriga skyldigheter: upp till 15 miljoner euro eller 3 procent (art. 99.4).
Felaktiga uppgifter till myndighet: upp till 7,5 miljoner euro eller 1 procent; för små och medelstora företag gäller det lägsta beloppet (art. 99.5–6).

Vem omfattas
Leverantörer, användare, importörer och distributörer av AI-system, även utanför EU när resultatet används i EU (art. 2.1). Banker och försäkringsbolag berörs särskilt genom kreditprövning och prissättning av liv- och sjukförsäkring.
